<content:encoded><![CDATA[<div class='snap_preview'><p>Actress Mischa Barton has reportedly been placed under involuntary psychiatric hold at Cedars Sinai Medical Center in Los Angeles.</p>
<p>The reports come a day after Barton called police to her L.A. home for help with a “health problem.” Details on her condition were not released, though LAPD officer April Harding confirmed that authorities had removed Barton from her home. “We assisted her with a medical issue and removed her from her home,” Harding said, adding that no paramedics were involved.</p>
<p>A rep for the 23-year-old tells People magazine the police were called to help protect Barton from the media while she was transported to her doctor.</p>
<p>Sources now tell Access Hollywood that the former OC star has been put on a 5150 hold, which means police can hold a person involuntarily in a psychiatric ward if they present a danger to themselves or others, or suffer from a mental disorder. The same hold was placed on Britney Spears twice in 2008.</p>
<p>A rep for Barton says the actress will not attend the world premiere of her new film Homecoming Thursday night in NYC.</p>

A judge decided this week to <strong>extend the conservatorship</strong> overseeing Britney Spears&#8217; financial and legal decisions.  The conservatorship, headed up by <strong>Brit&#8217;s dad Jamie</strong>, is expected to <a title="continue" href="http://popsquire.com/2008/07/31/gimme-more-britney-timelines-2/" target="_blank">continue</a> until at least until the end of October and possibly through December 2008.  In short, Brit remains a <strong><em>Slaaaaaave 4 Her Dad</em>!</strong></p>

Nikki was charged with <strong>assault</strong>, while her father is facing charges for causing bodily injury.  Nikki&#8217;s anticipated defense: &#8220;<strong>You Can&#8217;t Stop The Beat&#8230;ing!</strong>&#8220;</p>
<p><a href="http://blog-imgs-21.fc2.com/a/o/h/aohimeno/lindsay-lohan-sam-ronson-lesbian.jpg"><img class="alignleft" src="http://blog-imgs-21.fc2.com/a/o/h/aohimeno/lindsay-lohan-sam-ronson-lesbian.jpg" alt="" width="100" height="100" /></a>And yesterday, the <strong>LA City Council</strong> entertained <a title="hearings" href="http://popsquire.com/2008/08/01/la-city-council-vs-paparazzi/" target="_blank">hearings</a> to address ongoing problems with the <strong>paparazzi</strong>.  Speaking out against any further regulations, LAPD Chief William Bratton implied that<strong> celebrities are to blame</strong>, stating: &#8220;As you notice, since Britney started wearing clothes and behaving, Paris is out of town, not bothering anybody anymore, thank God, and evidently Lindsay Lohan has gone gay, we don&#8217;t have much of an issue.&#8221;  <strong>No joke needed.</strong></p>

<p><strong>Feb. 21: </strong>Britney attacks photographer’s car with an umbrella<strong></strong>.</p>

<p><strong>May 2</strong>: Britney performs at House of Blues San Diego, launching a brief tour showcasing 10-15 minute performances in various cities.</p>
<p><strong>July 6</strong>: Britney apologizes for attacking photographer’s car with an <strong>umbrella</strong>.</p>
<p><strong>July 30</strong>: Britney’s <strong>divorce</strong> from K-Fed becomes final.</p>
<p><strong>Aug. 6</strong>: Britney, who does not have a valid CA driver’s license, is involved in a minor <strong>fender bender</strong> with a parked car and leaves the scene.</p>
<p><strong>Sept. 9</strong>: Britney performs at the MTV <strong>Video Music Awards</strong>.</p>
<p><strong>Sept. 18</strong>: Britney is ordered by judge to submit to random <strong>drug tests</strong>; the judge concluded that she had engaged in <strong>“habitual, frequent, and continuous use of controlled substances and alcohol.” </strong>She also must attend parent counseling classes</p>
<p><strong>Oct. 1</strong>: Britney is ordered by judge to <strong>give up custody</strong> of her kids, at least temporarily, for failure to comply with court orders.</p>
<p><strong>Oct. 15</strong>: Britney turns herself in to be booked on charges arising out of the Aug. 6 fender bender.</p>
<p><strong>Oct.17</strong>: Britney’s <strong>visitation rights</strong> are suspended by court commissioner until she complies with court orders, including answering phone calls from court-appointed monitor.</p>
<p><strong>Oct. 20</strong>: Britney regains rights to visitation with her children and must be accompanied by <strong>court-ordered monitor</strong>.</p>
<p><strong>Oct. 25: </strong>Britney’s hit-and-run <strong>misdemeanor</strong> charge related to Aug. 6 incident is <strong>dismissed</strong>, and she pleads guilty to driving without valid CA driver’s license.</p>
<p><strong>Oct. 29: </strong>Britney’s former manager, Johnny Wright, sues for alleged unpaid commission in excess of <strong>$15,000</strong>.</p>
<p><strong>Nov. 9: </strong>Britney is accused of <strong>failing to respond to eight out of 14 drug t</strong>est requests.  As part of the Sept. 19 order, Britney must submit to twice-weekly drug tests and is required of providing a urine sample within six hours of being called.</p>
<p><strong>Nov. 13: </strong>Britney’s album, <strong>Blackout</strong>, is released and sells almost 300,000 copies in first week.</p>
<p><strong>Nov. 24</strong>: Britney is caught driving through Los Angeles <strong>stop signs</strong>.</p>
<p><strong>Dec. 7</strong>: Britney is caught on camera taking a lighter <strong>without paying</strong>.</p>
<p><strong>Dec. 8</strong>: Britney is caught on camera running more Los Angeles <strong>stop signs</strong>.</p>
<p><strong>Dec. 11</strong>: Britney’s pet store of choice, Pets of Bel Air, is accused of buying puppies from puppy mills.</p>
<p><strong>Dec. 12</strong>: Britney fails to show up at her <strong>deposition</strong> in her custody case.</p>
<p><strong>Dec. 18: </strong>Britney is ordered to appear for deposition in her custody case in January.  Meanwhile, a Florida court clerk enters <strong>defaul</strong>t against Britney for failing to respond to the lawsuit for alleged unpaid commissions filed by Johnny Wright in October.</p></blockquote>
<blockquote><p><strong>Jan. 15</strong>: Complaint filed against Dr. Phil, arising out of his hospital visit with Britney.</p></blockquote>
<blockquote><p><strong>Jan. 21</strong>: Britney attends deposition for approximately 2.5 hours.</p>
<p><strong>Jan. 23</strong>: Britney unsuccessfully seeks to modify court’s <strong>no-visitation</strong> order. Britney’s lawyers withdraw motion to be relieved as counsel, previously scheduled for Feb. 4.</p>
<p><strong>Jan. 31: </strong>Britney is placed on <strong>another</strong> <strong>5150 hold</strong>, this time at UCLA Medical Center.</p>
<p><strong>Feb. 1</strong>: (a) Britney’s dad and independent lawyer are appointed as <strong>conservators</strong> of her estate; and (b) Court issues temporary restraining order against <strong>Sam Lutfi</strong>, prohibiting him from getting near Britney.</p>
<p><strong>Feb. 3</strong>: Britney’s 5150 hold is extended by 14 days.</p></blockquote>
<blockquote><p><strong>Feb. 4</strong>: (a) After a court challenge, Brit’s dad and independent attorney remain conservators of her estate at least until Feb. 14; and (b) Amid alleged concerns that Sam Lutfi contacted Britney by telephone, the court confirmed that Lutfi is not permitted to contact Britney, <strong>even by telephone or email</strong>.</p>
<p><strong>Feb. 6</strong>: (a) UCLA <strong>releases Britney</strong> from the extended 5150 hold; (b) Maria Shriver introduces herself to Britney; and (c) Britney’s parents release statement to press.</p>
<p><strong>Feb. 7: </strong>Attorneys appear in court regarding Britney; information remains under seal.</p>
<p><strong>Feb. 13: </strong>Court continues Britney’s family law attorneys’ request to be <strong>removed</strong> as counsel until Feb. 19.</p>
<p><strong>Feb. 14: </strong>(a) Court <strong>extends conservatorship </strong>until March 10; (b) Bryan Spears and attorney named co-trustees of Britney’s trust; (c) Britney is ordered to undergo a 730 evaluation; and (d) an attorney files a notice to remove Britney’s legal troubles to federal court.</p></blockquote>
<blockquote><p><strong>Feb. 19</strong>: (a) Stacy Philips becomes Britney’s <strong>new attorney</strong>; (b) court denies request for gag order; and (c) parties unable to reach an agreement to permit Britney to resume visitation with kids.</p>
<p><strong>Feb. 20: </strong>Federal court issues tentative order to deny<strong> </strong>the notice of removal previously filed by attorney Jon Eardley and sets deadline for Eardley to convince the court to change its mind.</p>
<p><strong>Feb. 21: </strong>Sam Lutfi is finally served with restraining order, and court issues extension of order until March 17.</p>
<p><strong>Feb. 23: </strong>Britney <strong>resumes visitation</strong> with children, supervised by her father and a mental health professional.</p>
<p><strong>Feb. 26: </strong>The federal court judge kicks the <strong>Britney Spears conservatorship</strong> case back to<strong> state court</strong>. The judge’s decision is plain and simple: “Mr. Eardley is not Ms. Spears attorney and acted improperly by removing her conservatorship proceeding to federal court.”</p>
<p><strong>March 5: </strong>Court approves an <strong>extension of the conservatorship</strong> until July 31, 2008.</p>
<p><strong>March 15: </strong>UCLA Hospital takes steps to <strong>fire at least 13 employees</strong> for snooping into Britney’s private medical records.</p>
<p><strong>March 17: </strong>(a) Court extends <strong>restraining order</strong> against Sam Lutfi for another month; (b) Court approves Jamie Spears’ decision to sell off some of Britney’s cars; and (c) Court ordered Britney to <strong>pay K-Fed’s attorneys’ fees</strong> totaling approximately <strong>$375,000</strong>, a discount from the$500,000 requested.</p>
<p><strong>April 12: </strong>Britney is involved in minor fender bender, allegedly while <strong>applying makeup</strong> and driving.</p>
<p><strong>April 17</strong>: Court extends restraining order against Lutfi until July 31.</p>
<p><strong>May 29</strong>: The commissioner presiding over <strong>Britney Spears’ conservatorship</strong> determines that she remains <strong>unable to participate</strong> “in any meaningful way” in legal proceedings and may need <strong>further tests</strong>.  During a 90-minute closed-door session with lawyers, the commissioner also says that Britney’s doctor “wants to do additional testing.”</p>
<p><strong>June 6</strong>: <strong>Jamie Spears</strong> asks the Court to authorize payment to him for his services as conservator from <strong>January 31 to March 3, 2008</strong>.</p>
<p><strong>June 16</strong>: The Los Angeles DA’s office <strong>rejects </strong>a charge against Britney Spears for allegedly <strong>running over a paparazzo’s foot</strong> in November 2007 outside of the Beverly Hills Hotel.</p>
<p><strong>June 17</strong>: The conservatorship overseeing Britney Spears’ finances receives <strong>court permission</strong> to sell <strong>Britney’s house</strong> located in the Summit, a gated community near Beverly Hills.</p>
<p><strong>June 18</strong>: While Britney is en route to Louisiana to be with her sister, one of her many attorneys obtains an extension of time to resolve charges arising out of her alleged August 2007 <strong>hit-and-run accident</strong>.  The new court date is August 11.</p>
<p><strong>June 24</strong>: Widely respected family law attorney, <strong>Laura Wasser</strong>, returns to Britney’s legal team, and Los Angeles Commissioner Scott Gordon approves a <strong>new visitation/custody agreement</strong> that gives Britney <strong>overnight visits</strong> with her sons.</p>
<p><strong>July 18: </strong>Britney and K-Fed agree to settle their custody battle and submit the agreement to the court for approval.</p>
<p><strong>July 25</strong>: Court approves custody agreement, providing K-Fed with <strong>sole physical custody</strong> and <strong>$20,000</strong> per month in child support.  Britney gets increased visitation with the kids.</p></blockquote>

<p>Sam Lutfi says he&#8217;s not Toxic!</p>
<p>Because you are a <strong>faithful Popsquire follower</strong>, you remember that Britney Spears&#8217; father, Jamie, was successful in obtaining a <strong>temporary restraining order</strong> against Lutfi on February 1.  Since then, the order has been extended <strong>three times</strong> and is scheduled for a hearing <strong>tomorrow</strong>, along with the conservatorship trial.</p>
<p>According to <a title="E! News" href="http://www.eonline.com/uberblog/b148390_sam_lutfi_wont_agree_permanent_britney.html" target="_blank">E! <p style="padding-left:30px;"><strong>Legal custody</strong> refers to the ability to make major decisions &#8212; e.g., <strong>medical, educational, religious</strong> &#8212; about the course of the children&#8217;s lives.  <strong>Physical custody</strong> simply refers to the parent with whom the kids primarily live.</p>

<p>Widely respected family law attorney, Laura Wasser, is back on her team, and Los Angeles Commissioner Scott Gordon approved a <strong>new visitation/custody agreement</strong> that gives Britney <strong>overnight visits</strong> with her sons.</p>
<p>Los Angeles Superior Court spokesman Allan Parachini told reporters that &#8220;both sides have been very cooperative the past couple of weeks,&#8221; and, according to <a title="E! Online" href="http://www.eonline.com/uberblog/b144032_britney_granted_overnights_with_her_boys.html" target="_self">E! Online</a>, the boys are tentatively scheduled to start the overnight visits <strong>this Saturday</strong>.  The next court hearing is July 15.</p>
<p><strong>Popsquire&#8217;s perspective&#8230;</strong></p>
<p>This is what family law courts are all about.  Circumstances <strong>change </strong>and, as a result, so do custody and visitation arrangements.  So long as Britney continues to show <strong>progress</strong>, we can expect the custody and visitation arrangement to continue to change.</p>
<p>Of course, K-Fed may not want her to re-gain primary custody because that&#8217;s when his <strong>child support payments</strong> could be materially decreased!</p>
<p>In short, it looks like Britney is getting closer and closer to getting back &#8220;On Top Of The World.&#8221;</p>

<p>Britney Spears left LA this morning on a Delta flight headed for <strong>Louisiana</strong> to be with her sister, Jamie Lynn, who is expected to <strong>give birth imminently</strong>.</p>
<p>While other blogs may tell you what she was wearing or feign shock that Britney is flying a commercial plane, Popsquire brings you the <strong>pop culture/law collisions</strong>&#8230;</p>
<p>(1) While Britney was en route to Louisiana, one of her many attorneys sought an extension of time to resolve charges arising out of her alleged August 2007 <strong>hit-and-run accident</strong>.  The new court date is August 11.</p>
<p>(2) Britney&#8217;s sons did not travel with her.  Due to ongoing <strong>visitation/custody restrictions</strong>, permission to travel outside the state with them likely would require an agreement from K-Fed and possibly approval by the court.</p>
<p>(3) Popsquire previously explained that Louisiana&#8217;s <a title="anti-stalking" href="http://popsquire.com/2008/06/05/paparazzo-stalker-jamielynn/" target="_self">anti-stalking</a> statute presents a much <strong>lower standard</strong> than <strong>California’s</strong> <strong>anti-stalking laws</strong>.  So, although this likely won&#8217;t stop the photogs from bombarding the Spears family, they have been warned!</p>

<p>The <strong>next hearing date</strong> for Britney&#8217;s conservatorship is July 31. If the parties do not agree to voluntarily extend the conservatorship, the court will set a <strong>trial date</strong> to decide Britney&#8217;s fate.</p>

<p><strong>March 5: </strong>Court approves an <strong>extension of the conservatorship</strong> until July 31, 2008.</p>
<p><strong>March 15: </strong>UCLA Hospital takes steps to <strong>fire at least 13 employees</strong> for snooping into Britney’s private medical records.</p>
<p><strong>March 17: </strong>(a) Court extends <strong>restraining order</strong> against Sam Lutfi for another month; (b) Court approves Jamie Spears’ decision to sell off some of Britney’s cars; and (c) Court ordered Britney to <strong>pay K-Fed’s attorneys’ fees</strong> totaling approximately <strong>$375,000</strong>, a discount from the$500,000 requested.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Coinciding with <strong>Britney Spears</strong>&#8216; second appearance on &#8220;How I Met Your Mother&#8221; tonight, K-Fed&#8217;s family law attorney, <strong>Mark Vincent Kaplan</strong>, was interviewed during the third hour of The Today Show this morning.   In case you have a job and missed it, here&#8217;s what Kaplan told Natalie Morales&#8230;</p>

<li>In response to a question about a future <strong>50/50 custody</strong> split, Kaplan explained that we shouldn&#8217;t be fixated on percentages.  Instead, <strong>Kevin&#8217;s intent</strong> is to have an order or arrangement that allows <strong>both parents</strong> to participate in their kids&#8217; lives.</li>
<li>Although Kaplan will not confirm exactly how much time Britney is currently spending with the kids under the new court order, he did tell Natalie that the new arrangement &#8220;<strong>reflects improvement</strong>.&#8221;  He also explained that further expansion of visitation will depend on how things progress.</li>
<li>Kaplan said he knows nothing about any rumors that Britney and K-Fed are rekindling their relationship.</li>

In California, family law courts typically <strong>calculate child support</strong> based on the the parents&#8217; income and the <strong>percentage</strong> of time they have with the kids.</p>
<p style="padding-left:30px;">Despite what Kaplan said this morning, he likely may be fixated on the percentage of visitation for this very reason &#8212; the <strong>more</strong> <strong>time</strong> Britney gets, the <strong>less child support</strong> Kevin may receive.</p>

<p>Britney Spears is in court this morning for another <strong>custody hearing</strong>.  Popsquire predicts that she will regain additional visitation time with her kids.  While we await results, please refresh your memory on Britney&#8217;s collisions with the law by reviewing (and <strong>memorizing</strong>) this helpful timeline:</p>

<p><strong>Jan. 31: </strong>Britney is placed on <strong>another</strong> <strong>5150 hold</strong>, this time at UCLA Medical Center.</p>
<p><strong>Feb. 1</strong>: (a) Britney’s dad and independent lawyer are appointed as <strong>conservators</strong> of her estate; and (b) Court issues temporary restraining <a title="order" href="../2008/02/06/lynn-spears-i-do-declare">order</a> against <strong>Sam Lutfi</strong>, prohibiting him from getting near Britney.</p>

<p><strong>Feb. 14: </strong>(a) Court extends conservatorship until March 10; (b) Bryan Spears and attorney named co-trustees of Britney’s trust; (c) Britney is ordered to undergo an <a title="730 evaluation" href="http://www.730evaluation.com/730overview.php">730 evaluation</a>; and (d) an attorney files a notice to remove Britney’s legal troubles to federal court.</p></blockquote>
<blockquote><p><strong>Feb. 19</strong>: (a) <a title="Stacy Phillips" href="../2008/02/20/popsquire-peeps-out-britneys-new-counsel">Stacy Phillips</a> becomes Britney’s <strong>new attorney</strong>; (b) court denies request for gag order; and (c) parties unable to reach an agreement to permit Britney to resume visitation with kids.</p>
<p><strong>Feb. 20: </strong>Federal court issues tentative order to deny<strong> </strong>the notice of removal previously filed by attorney Jon Eardley and sets deadline for Eardley to convince the court to change its mind.</p>
<p><strong>Feb. 21: </strong>Sam Lutfi is finally served with <a title="restraining order" href="../2008/02/21/lutfi-loopholed">restraining order</a>, and court issues extension of order until March 17.</p>
<p><strong>Feb. 23: </strong>Britney <strong>resumes visitation</strong> with children, supervised by her father and a mental health professional.</p>
<p><strong>Feb. 26: </strong>As predicted in this previous <a title="post" href="../2008/02/21/popsquire-smells-victory-for-spears-conservatorship">post</a>, the federal court judge kicks the <strong>Britney Spears conservatorship</strong> case back to<strong> state court</strong>. The judge’s decision is plain and simple: “Mr. Eardley is not Ms. Spears attorney and acted improperly by removing her conservatorship proceeding to federal court.”</p>
<p><strong>March 5: </strong>Court approves an <strong>extension of the conservatorship</strong> until July 31, 2008.</p>
<p><strong>March 15: </strong>UCLA Hospital takes steps to <strong>fire at least 13 employees</strong> for snooping into Britney’s private medical records.</p>
<p><strong>March 17: </strong>(a) Court extends <strong>restraining order</strong> against Sam Lutfi for another month; (b) Court approves Jamie Spears’ decision to sell off some of Britney’s cars; and (c) Court ordered Britney to <strong>pay K-Fed’s attorneys’ fees</strong> totaling approximately <strong>$375,000</strong>, a discount from the$500,000 requested.</p>
<p><strong>April 12: </strong>Britney is involved in minor fender bender, allegedly while <strong>applying makeup</strong> and driving.</p>

Popsquire <b>highly recommends </b>that you read the <b>entire</b> document <a href="http://popsquire.wordpress.com/files/2008/02/lynnspears.pdf" title="here">here</a>, but if you are impatient (like Popsquire), then here are some <b>shocking quotes</b> that will allow you to keep up with the water cooler crowd:</p>

<li>&#8220;Sam disabled all of Britney&#8217;s cars (she has several at her residence).&#8221;</li>

<content:encoded><![CDATA[<div class='snap_preview'><p>Popsquire previously informed you in this <font color="#0000ff"><a href="http://popsquire.wordpress.com/2008/02/01/britney-spears-conservatorship-court-hearing/" title="post">post</a></font> that Britney&#8217;s parents were scheduled to appear in court to establish a conservatorship.   According to <font color="#0000ff"><a href="http://www.tmz.com/2008/02/01/brits-parents-get-restraining-order-against-sam/" title="TMZ">TMZ</a></font>, the hearing produced two results:</p>
<ol>
<li>The court established a <b>conservatorship</b> to manage Britney&#8217;s <b>financial</b> matters, placing Britney&#8217;s dad and an independent attorney in the driver&#8217;s seat; and</li>
<li>The court issued a <b>restraining order against Sam Lufti</b>, barring him from visiting Britney for 22 days.</li>
</ol>
<p>Popsquire is pleased that someone is stepping in to take care of Britney, yet still wonders whether the Spears parents will seek a conservatorship to make <b>medical decisions</b>.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>According to <a href="http://www.tmz.com/2008/02/01/do-not-publish-brits-parents-make-their-move-in-court/" title="TMZ">TMZ</a>, Britney Spears&#8217; parents are scheduled to attend a court hearing today at 1:30 pm to establish a &#8220;<b>conversatorship</b>,&#8221; which would allow them to make <b>medical</b> and <b>financial</b> decisions on Britney&#8217;s behalf.</p>

<blockquote><p>When a developmental or <b>mental impairment</b> limits an adult&#8217;s capacity to exercise her rights, a <b>conservatorship</b> can enable the parent to act on behalf of the person subject to periodic <b>reviews by the court</b>.</p></blockquote>
<blockquote><p>A conservatorship is <b>crucial to medical treatment</b>.  For example, the &#8220;<b>informed consent</b>&#8221; of a patient is required before most medical treatments.  If the patient is an adult with a developmental disability, <b>parental consent </b>frequently is <b>not accepted</b> unless the parent is also the patient&#8217;s <b>conservator</b>.</p></blockquote>
