The attorney for one of the terrorist defendants has had some interesting tings to say. Thinking about what he said and reading a  comment or two from rush have switched the light on for me, I think. The attorney is  Scott  Fenstermaker and he had  this to say. The defendants will  plead not guilt but will not deny their role in he 9/11 attacks. But, they intend, according to him, to tell what happened and why. Along the way, they will share their thoughts about United States foreign policy, particularly vis-a-vis terrorism.

Now, if I am Attorney General Holder of maybe even the President, I may just like the sound of that. If U S foreign policy is “put on trial”, wonder what Administration’s foreign policy it will be? Not this one, but the Bush Administartion of course. So, and I would lik eto be wrong, rally I would, but maybe the potential for this kind of thing played into the Administration”s decision to use civilian courts, rather than the military . Another opportunity to stick it to Bush and continue to place the blame  thereon.

One side note, Congressman Louie Gohmert, R, Tx  has proposed a bill that would require terrorist defendants to be  tried before a  military tribunal. He probably knows the bill, even with 40 co-sponsors, has very little chance. But I applaud his pushing this issue  and publicly keeping the heat on the Administartion decision.

Attorney-General Holder recently announced plans to move the trials of several Guantanamo detainees, among them Khalid Sheikh Mohammed, to New York City. The plan has drawn opposition from both sides of the political spectrum and is a bad idea for several reasons.

Most obviously, the show trial is a bad idea because it is unnecessary. The detainees have already admitted guilt. KSM in particular has repeatedly confessed his role in planning the 9/11 attacks and has indicated his desire to be executed so that he can become a martyr [1 ]. As radio talk show host and author Michael Medved put it, “Normally I don’t agree with giving in to the demands of terrorists, but when they demand to be executed, that is one demand that we should give in to” [2].

The detainees were set to receive fair trials from military tribunal. A military trial would have saved the government millions of dollars. A criminal trial in the civilian justice system will be expensive, especially in light of the runaway spending habits the Obama Administration has already exhibited. A civilian trial will mean that the government must pay for civilian lawyers, court costs, and security in expensive New York City. A military trial could have been conducted on a secure military base with military lawyers at minimal cost.

Security is also a concern. It will be very difficult to provide security for the courthouse and for all the people involved in the trials. Securing the area will likely involve a huge disruption of buildings and streets surrounding the courthouse as well. In an era when one terror plot after another is being discovered – or carried out – a huge, well publicized trial will provide a tempting target for both homegrown radicals and international terrorists.

A show trial will necessarily be covered in-depth by the media. This media coverage will grant the defendents a golden opportunity to espouse their radical anti-American views and claim abuse at the hands of the United States. Likely defense strategies will involve claims of torture and attacks on US foreign policy. The defendents have already announced their plans to plead not guilty in order to justify their actions as a reasonable response to American actions abroad [3]. This publicity can do nothing but harm the United States and will likely serve to radicalize more Muslims and inspire them to carry on the jihad. Justice does not require that the US give terrorists a media soapbox from which to address the world.

There is also a question of jurisdiction. These detainees are not US citizens, they were not arrested in the United States, and their crimes were not committed in the United States. Most of the detainees were captured in Afghanistan. KSM was captured in Pakistan. None of the detainees were directly involved in the 9/11 terror attacks or any other attacks on US soil. Instead, they planned and supported attacks on the US and other countries from bases in other countries.

As noncitizens, the detainees are not entitled to the protections of the US Constitution. As illegal combatants who were not members of an organized national army, they are entitled to only limited protection under the Geneva Convention. To move military prisoners from a war into the civilian criminal justice system is unprecedented. In World War II, prison camps in the continental United States housed German and Italian prisoners-of-war. These POWs were not granted habeas corpus and were not allowed to challenge their detention in US courts.

Additionally, since these prisoners of the War on Terror were captured by the military, the standard of proof of guilt is different that what is required for arrest by a civilian police officer. For example, a defense attorney might object because soldiers never advised the detainees of their Miranda rights. It may also be difficult for a prosecutor to show enough evidence to a jury to assure a conviction without compromising intelligence sources. Rules are very different for soldiers and police officers because they serve different roles.

Along the same lines, if US soldiers are required to abide by civilian standards in order to protect prosecution in future cases, the result will be more dead soldiers and more terror attacks. Applying peacetime civilian standards to soldiers in combat will mean that more terrorists go free. If more terrorists remain on the loose, it means that they will be free to attack US soldiers abroad or civilian targets here at home. It might also mean that US forces are less likely to take prisoners in the future if it becomes apparent that lawyers are intent on forcing the release of terrorists based on legal technicalities.

In some cases, civilian criminal courts are an appropriate venue for trying terrorists. For example, when a terrorist is a US citizen he has a constitutional right to a trial by jury. Likewise, a foreign terrorist who is apprehended within the US by civilian authorities can correctly processed in the civilian criminal justice system. However, it is gross mistake to place foreign terrorists and guerillas, captured abroad, into a criminal justice system better suited to dealing with common murderers and burglars.

Attorney-General Holder and President Obama’s plan for show trials in New York City is a bad idea on many levels. It will be expensive, dangerous and embarassing to the United States. It will waste millions of dollars in a time when our national treasury is already depleted. It will attract terrorists to the cameras like moths to a flame. It will provide a means for the terrorists on trial to broadcast their views to the world and recruit more disaffected Muslims. Finally, it is legally questionable and completely unnecessary. It grants unprecedented rights to illegal combatants and sets a frightening precedent for how the US will handle terrorist trials in the future. Such decisions by President Obama and the members of his administration cannot help but have a negative affect on the prosecution of the War on Terror and consequently make us all less safe.

9/11 Suspects to Use U.S. Foreign Policy as Defense for Killing Americans

The Associated Press offered a superficial glance at a complex and alarming update in the upcoming trial of the five 9/11 defendants,  leaving me to wonder where is their thoughtful, penetrating examination of this judicial travesty about to take place in New York City. There is certainly no shortage of critical questions in want of answers.

The AP reported Sunday that the five 9/11 defendants to be tried in New York City will not deny their role in the terrorist attacks of Sept. 11, 2001, but will nonetheless be pleading “not guilty.” This, to me, initially seemed a sure sign that the defense attorney feels compelled to observe no ethical responsibilities to the American judicial system as his clients attempt to put U.S. foreign policy on trial.

The attorney assigned to defend the five terrorists on trial, Scott Fenstermaker, reported Sunday that all five of his clients are also planning to use the “stage” they are given to deliver their radical Jihadist message and explain why they believe more Americans must die. The Obama Administration can’t say they weren’t warned – again, and again, and again.

There is the possibility that Fenstermaker has chosen the path of least resistance in representing his clients, for the sake of self-preservation.  There can be no doubt this case will have a significant impact on his career – for better or worse. But what we may perceive during this trial as over-zealous representation may be the actions of a defense attorney caught between the rock of the American justice system and the hard place of representing hardened terrorists who would stop at nothing to continue their mission against America.

Either way, Attorney General Eric Holder and the Obama Administration, which pulls his strings, opted to take great risks with a trial in our civilian judicial system, and for no clear, justifiable reason.  Even if the trial concludes without incident, the results would not justify the risk. If it does not go without incident, the results could be catastrophic.

Holder’s defense to the outrage following the announcement of the trial in NYC was weak, aloof and dismissive of the true weight of his choice.

“I have every confidence that the nation and the world will see him for the coward that he is,” Holder said. “I’m not scared of what Khalid Sheikh Mohammed has to say at trial, and no one else needs to be, either.”

The blatant arrogance and ignorance exhibited by the Obama Administration and Holder is of far less concern than the wider implications to our judicial system. Merely saying that these five terrorists will have the same rights as any other American defendant in our court system doesn’t begin to convey the realities of the situation in which our justice system has been placed.

John Yoo, a columnist with the Philadelphia Inquirer and law professor at the University of California, Berkeley, made up for the AP’s lack of insight on the trial when he wrote extensively on the disaster about to unfold:

“…the positive benefits [of a civilian trial] remain obscure to the point of vanishing. All that is known for certain are the heavy costs:

Giving Mohammed and his fellow terrorists the same constitutional rights as any U.S. citizen accused of a crime risks our nation’s most vital intelligence secrets. Mohammed can demand that the government turn over all of its information on him and tell him how it was acquired or it risks a mistrial or acquittal. Soviet moles like Aldrich Ames and Robert Hanssen used the same tactic to bargain the government down from the death penalty. Ordinarily, such information does not harm the public because the crime has already been committed. But the release of intelligence during hostilities can be disastrous when it informs the enemy of our knowledge, capabilities, and intentions.”

He went on to say:

“This red herring [Holder’s statement] distracts from the administration’s failure to explain why the benefits of using civilian courts outweigh the costs to the war effort. It certainly doesn’t help those who are already protected by the Bill of Rights and can be tried in civilian courts. If anything, their rights are at risk, not just by a failure to convict terrorists who killed almost 3,000 people, but by the inevitable judicial compromises that must balance the requirements of a fair public trial with the demands of protecting wartime secrets. Those compromises will no longer be limited to the special context of military courts in wartime, but will become part of the law that governs all Americans.”

Until the trial concludes, Americans will be forced to hold their breath and hope the Obama/Holder decision doesn’t cost us all a great deal in life and/or liberties.

Joey Styles is in the ring as Bill Whistle Man and Taz march into the ring. Bill starts ranting on Joey Styles saying he hates him and hates Queens, New York. Bill says that 911 is finish. Rey Mysterio Jr. interrupts Taz—and says he is not afraid of Taz. Bill talks some trash, but then Rey spinning-heel kicks him. Rey then hits a botched hurrcanarana. Rey goes up the top and tries to go springboard, but get caught in a Taz Suplex. Rey fights back but Taz hits another Taz Suplex that puts Rey inside and out.  Wrestlers and Refs come out to check on Rey. Joey Styles is addressing for some help for Rey.  Joey Styles then puts over ECW by saying that you will not see action like this. Woman enters, and says that Joey Styles and her can go to WWF, but Joey says he wants to stay here. Sandman enters, and she asked him if he wants to come with her. He says he does not want to “come” with her, and then he says she has been a bitch her whole life. Women says she wants to stay here along time being the bitch here for along time, and no one is going to remove her from the ring. 2 Cold comes out and joins Women.  2 Cold then says business is picking up. He pretends he is with her, but he says Nancy you out of here. 2 Cold takes her out of the arena, and puts her in the limo. Stevie Richards comes out with Blue Meany, and lays down the offer. Sandman says never has he ever backed down from a fight. Richards says Sandman feels like a tough person with a chain in his and—and he thinks Blue Meany and him are a puss. Richards says Sandman should back out of the match—or he will have to Stevie-kick him. Blue Meany says he will do it. Blue tries to superkick him, but cannot reach him. Sandman canes Meany and Sandman said he is going for Raven. Richards is paranoid, as Raven enters the ring. Raven calls Stevie a moron. Raven then disses on Meany. Ravens says he was supposed to give Beulah her pill, but he could not handle that. Raven starts to beat the crap out of him. Richards tries sucking up to Raven. He goes into Blue’s paints—and it says Richards the king of dancing is engaging a lawsuit against Missy Hyatt for sexual harassment. Hyatt comes out and calls Richards a joke. Raven says that the other option is that she joins up with him. Hyatt says look at her and look at Raven because he is not on her level. She says that the bitch he is with now is a whore, and we all know that Raven has a low sperm count since Dreamer knocked up his ex. Raven gets angry and takes his coat off.  Sandman makes the save and canes all of them. Hyatt tells Sandman she likes that. Sandman and Hyatt celebrate hardcore style with beer, squares and Enter Sandman in the back round.

Shane Douglas/ Tommy Dreamer. w/ Beulah vs. Stevie Richards/Raven

Richard and Dreamer start the match. Dreamer hits a closeline that drives Richards out, and the crowd is wild up.  Shane sets up a chair near Richards head and Dreamer baseball slides into it. Dreamer throws Richards in. Richards puts on a Razor shirt and puts a toothpick behind the ear trying to piss off Shane. It cuts to a better part as Shane is cleaning house with the chair.  Shane tries getting a pin on Raven, but gets only two. Douglas hits a Piledriver on Richard, but Raven makes the save. Tommy jumps Raven. Cactus jumps into the match. Shane fights off Foley. Raven hits Shane with something, but only gets tow. Sandman enters, canes everyone including the ref as the place goes wid. Raven gets up, and pins Douglas, but there is no ref. Richards wakes up the ref, and Raven pile drives Douglas. ONE-TWO-NO.  Richards gets the tag in, and dominates Douglas. Raven comes back in, but Douglas hits him with a DDT.  Both men are done in the ring. Dreamer wants the tag, but Richards cuts him off. Richards hits a Stevie-bomb. ONE-TWO-NO.  Douglas gets Irish wiped, but hits a launch backwards springboard elbow. Dreamer has a frying pan and cleans house with it. Richards gets tree of wowed, and catches a pain in the groin. Dreamer goes for a cover, but Raven hits them with a chair. Dreamer gets back up, and attacks Richard. Meany is clueless and hits a meanymoonsualt onto Richards. Tommy goes for a pin, but Raven breaks it up. Raven hits a DDT but only gets two. She ties the frying pain to Dreamer’s boot. Dreamer kicks Stevie in the head. ONE-TWO-THREE.  You could feel the drama and the heat between all the wrestlers in the match. The excessive run ins and shenanigans made it a little overbooked, but that was pretty much what ECW was all about; it was about having that realism playing in—and making it seem like anything can happen at any given moment. Pretty decent and exciting and well booked match overall, but I cannot rate a match that was this clipped fairly.

Taz vs. Shark attack kid.

The kid tries to get fancy with Taz, but he gets drilled with a T-Bone on his head. Taz then hits a vicious Tazplex onto the kid, but Kid gets back up. Taz hit a belly-to-belly suplex him from the top of the top. Taz puts in the Taz-mission and that is it @ 2:00. Taz calls out 911, but Gordon comes out with the mic. Gordon comes out and says 911 do not want to wrestle him. Bill calls out Gordon. Gordon gets in the ring, and Gordon punches him in the face. Gordon closelines Bill—and attacks him. Taz attacks Gordon, but Bam Bam Bigelow makes the save! Bam Bam calls out Taz.

Going Home: We started ECW off this week with possibly the longest segment in the history of humanity. Well maybe I am exaggerating, but it was still very long. Some of the stuff on it was very interesting, but some of it was simply ridiculous. I liked the stuff with Sandman and Raven’s flock; it drew good heat and expanded the rivalry in the right direction. I found the stuff with Missy Hyatt and the restraining order to be entertaining, and they did a good job of making you want to see where Sandman and Hyatt goes from this point on. Both matches on the show were fine, but I think there could have been more wrestling on this show than what they gave us. Taz was possibly the most interesting and well-booked thing going for ECW at the time and I loved how they brought in Bam Bam in surprisingly. Overall, the show wasn’t bad, but if you missed it—or haven’t seen it, you really are not missing a whole lot.

ELON, N. C.—Under the hot midday sun, a group of students, teachers and faculty gathered in front of the Fonville Fountain at Elon University to participate in a ceremony to remember the events that took place eight years ago, when the nation was reminded that it was not invincible.

9/11 is the current generation’s Kennedy assassination. “It was an event that every person in America witnessed or was influenced by in some way. As observers congregated before the ceremony began, they made small talk and shared personal stories about where they had been and what they were doing when they first learned about the terrorist attack.

“I was eating cupcakes in my seventh grade religion class for my friend’s birthday,” said Camille DeMere, a junior from Greenville, S.C.. Her teacher had turned on the television to show the class a video, but abandoned the plan when the network replayed the images of the plane crashing into the first tower. “We spent the second half of school at mass, praying on our rosaries.”

David Wells, a senior from Bel Air, Maryland, described the confusion and worry that ran through the halls of his own school when the news broke. “I was in eighth grade,” Wells said. “Parents would call their students or pick them up… Around 12:30 or 1 they decided to close the school.”

Chet Denlinger, a chaplaincy intern at the Truitt Center for Religious and Spiritual Life, put the ceremony together and was the sole speaker. Before beginning, Denlinger explained that he felt  the ceremony was necessary because “it gives power to the present… it’s a unifying force.”

The crowd grew as the minutes ticked by, students and professionals growing hotter as the sun beat down on their backs. Members of the school newspaper joined the crowd as did other media personnel, cameras and video recorders held at ready. After a slight delay, allowing students who had just got out of class to join, Denlinger took his place underneath the American flag.

“We are gathering as a community out of a need to remember… to remember an event that has impacted who we are and our place in the world,” Denlinger said. After asking for a moment of silence, Denlinger explained that  he believed 9/11 was the nation’s first time to experience struggle and that response to the struggle defined America as a whole. His message was a gentle reminder that people are not alone in their pain; that in unity there is strength, hope and healing.

“I invite you to focus on us as a human race,” he said.

During the entire ceremony there was not a single cough or sneeze. Aside from the chaplaincy intern speaking, the only other sounds that could be heard were of reporters furiously taking notes and students walking to their classes, continuing on with their day and life.

Leave it to barbarous murderers who have utter disdain for the United States to take advantage of the American system of justice for their own benefit. Leave it to vermin who target innocents through acts of war to milk the American Constitution for the very rights they abhor. Leave it to those who laughed and applauded when the Twin Towers came crashing down to squeeze the American legal system by using a civilian courtroom as a showcase for their repugnant rhetoric – and do so only blocks from where those towers once stood. And leave it to American leftists to afford these remorseless war-makers Constitutional rights in the first place so all of this can happen.

To the Eric Holders and Barack Obamas of the world, this circus-to-be will demonstrate to our fellow citizens-of-the-world what American fairness is really all about. Our openness will inspire. Our transparency will impress.

It isn’t hard to imagine a cave hidden somewhere in the treacherous mountains of northern Afghanistan where would-be terrorists are sitting around having conversations such as this:

Terrorist 1: “Man, that American legal system is really wonderful, isn’t it, Mohammed?”

Terrorist 2: “Damn straight, Ali.”

Terrorist 1: “They are leading by example, Mohammed.”

Terrorist 2: “We should all get along. America is showing us how.”

Terrorist 1: “It was that last apology Obama made for America that really got to me.”

Terrorist 2: “Yes. me, too.”

As first glance, to go from wanting to die to pleading “not guilty” may seem like quite a leap - even for Muslim terrorists - but that’s precisely what’s happened.

And it really shouldn’t have surprised anyone.

According to the attorney of one of the “defendants,” the five terrorists slated to stand trial in New York for the September 11th attacks will not deny their involvement. Rather, they want to take the opportunity to “explain what happened and why they did it.”

The first thought that came to mind, of course, was, “Thank God! Now we can finally get the bottom of all this. This ought to shed some much needed light on that whole 9/11 thing.”

Such a relief!

Karen Matthews of the Associated Press writes:

[Ali Abd al-Aziz] Ali, also known as Ammar al-Baluchi, is a nephew of professed 9/11 mastermind Khalid Sheikh Mohammed. Mohammed, Ali and the others will explain “their assessment of American foreign policy,” Fenstermaker said.

“Their assessment is negative,” he said.

I think we can all take a “No, really?” out of petty cash.

Critics of Attorney General Eric Holder’s decision to try the men in a New York City civilian courthouse have warned that the trial would provide the defendants with a propaganda platform.

Critics of Holder’s decision — mostly Republicans — argued the trial will give Mohammed and his co-defendants a world stage to spout hateful rhetoric. Holder said such concerns are misplaced, and any pronouncements by the suspects would only make them look worse.

“I have every confidence that the nation and the world will see him for the coward that he is,” Holder told the committee. “I’m not scared of what Khalid Sheikh Mohammed has to say at trial — and no one else needs to be, either.”

They were all minding their own businesses, planting sunflowers, harvesting radishes, exchanging falafel recipes, playing soccer, performing innocent nondescript clitoridectomies on their female young when war-mongering, Israel-loving America came swooping in with her implements of death to slaughter as many Muslims as possible.

Something like that.

Using “Justice” to destroy America

A few days ago, the alleged Attorney General, Eric Holder, announced that Kalid Sheik Mohammad and other 9/11 conspirators would be tried before a civilian court in New York. Most Americans were outraged by this. I was more than outraged and appalled. I understood this more than most Americans. You see, I am a criminal defense lawyer.

If someone wanted to truly gut our intelligence agencies and our anti terrorist efforts, there could be no better way than by putting these terrorists on trial in a Federal court, giving them all of the rights an American citizen would have. Let me spell some of this out for you.

In a criminal case, first there is the right to discovery. That means the prosecution has to turn over EVERTYTHING it intends to use against the defendant. This includes lists of witnesses so they can be interviewed and investigated. Tangible evidence. Tapes. Reports that have statements the defendant made. It covers a lot. Much of this information is classified. The courts have a system for dealing with classified information in a trial. The Classified Information Procedures Act does set parameters to try and keep classified information secret. But that assumes that all parties are willing to abide by the rules. As we saw in the case of radical lawyer Lynn Stewart, some of these radical lawyers, who support these terrorists, are quite happy to violate the rules and share information they are not supposed to release.

Does anyone remember the case of Johnny Walker Lindh? Do you know why he only got 20 years? The Bush administration agreed to a plea bargain to keep classified information from being released in a public trial. Lindh was an American citizen and his lawyers were going to put the Bush administration on trial. Now, instead of having an administration that wants to protect this country and keep our antiterrorism strategies secret, we have an administration bound and determined to destroy our ability to defend ourselves. This trial will be a gold mine for Islamic terrorists. They will know how we operate, what we are doing and where our weaknesses are.

Since a defendant has a constitutional to subpoena witnesses or items that maybe material to their defense, the list of subpoenas will be monumental. Even if the items are not presented at the trial, the defense will be allowed a fishing expedition into all kinds of classified operations.

In addition, the defendant is entitled to “exculpatory” evidence. This means more fishing expeditions. The personnel files of CIA operatives will be fair game. If you are a CIA operative, how well are you sleeping, knowing the government will turn over your personnel file to a radical lawyer, who will share it with his terrorist client?

This begs the whole question of whether these clowns can even get a conviction. In 1962, the United States Supreme Court, in a case called Mapp v. Ohio, established something called the exclusionary rule. Evidence gathered in violation of someone’s constitutional rights could be excluded at trial. Extreme and outrageous government conduct can even be a basis for dismissal of the charges. Can you imagine how much of the government’s case is even going to make it to trial with a liberal judge? Obama, Holder and the hard left have one further agenda item here. They want to put America and the Bush administration on trial. By allowing these cases to be heard in a civilian court, that will be what happens. Ultimately, these lunatics want to see George Bush, Dick Cheney and others hauled before the International Criminal Court in The Hague to be tried for crimes against humanity.
