Madison County, Indiana, Circuit Judge David Happe ruled Tuesday that Portwood must serve the prison time he imposed earlier this year when she pleaded guilty to a felony drug charge. She had avoided prison with a plea deal that included drug rehab, but she dropped out of the program last month.

Portwood, 22, was arrested on May 24 for violating her drug court probation requirements by failing a urine test and then lying about it, Prosecuting Attorney Rodney Cummings said.

That violation may not have caused probation to be revoked, since probationers are given two or three opportunities, “but she just opted out,” Cummings said. “I just don’t think she knew opting out meant five years in prison.”

Portwood will likely spend two-and-a-half years in prison before being released on parole for the remainder of the five years, Cummings said. Inmates get a day reduced from their prison time for each day successfully served. It is possible she could get another 30-day reduction for completing a drug rehab program while in prison, he said.

The report that Portwood definitely will be placed in a prison drug rehab program is not accurate, since that can only be decided once she is in the Indiana prison system, he said.

It probably will take two weeks before the commitment order is signed by the judge and Portwood is transferred from the Madison County jail to state corrections department custody, he said.

Portwood was first arrested on felony domestic violence charges in November 2010 because of incidents seen on her reality TV show — where she was shown shoving, punching, slapping and choking her boyfriend, Gary Shirley.

She was rearrested last December when a probation search found “a fairly sufficient amount of several different prescription pills” that were not prescribed to her, Cummings said.

She spent more than a month in jail before reaching a plea deal on a felony drug charge that included the drug rehab program, he said.

Her 3-year-old daughter is in the custody of Shirley, the father.

About a month ago, Portwood struck a plea agreement which mandated that she completes a drug rehab program or go to prison. Then just last week she appeared in front of the judge claiming she cannot complete drug rehab and would rather be put in prison! Amber said she will always be a “bad girl” and prison is the only thing that can help her.

She may be right, as her list of legal charges continues to grow. Back in 2010 she was charged with three felonies for domestic violence against her babies father and ex-fiance, Gary Shirley. The acts of violence were not only in front of their daughter Leah, but they even caught on camera during filming of Teen Mom. The outcome of that was two years of probation, just barley avoiding a jail sentence. The bad girl didn’t stop there, a year later she then violated her probation by getting into another physical altercation plus having prescription medication on her, with no prescription. Exactly on year ago she was rushed to the hospital for attempting suicide.

In the past season of Teen Mom, Portwood has addressed the issues she has with herself, blaming it on her childhood and how she was neglected. The third season of Teen Mom, which is set to air next week will unfold the event leading up to Portwood being referred to the Indiana Department of Corrections’ drug program.

Hopefully her identifying the fact that a drug treatment program won’t work will be good in the long run. Gary Shirley has shown characteristic in being a stable, strong father for their three year old.

After straight up asking to be sent back to jail, Amber Portwood‘s Indiana judge imposed his original sentence of five years in prison, saying he had no choice but to enforce her plea.

According to a report from TMZ, the 21-year-old was in court on the morning of June 5 when the judge reimposed the sentence that stemmed from her December drug arrest.

Amber’s five-year sentence could have been avoided had she completed her drug rehabilitation program, but she couldn’t stay clean, saying she will always be a “bad girl.”

The judge referred Amber to the Indiana Department of Corrections therapeutic community program that is incarceration-based.

Babies having babies means drama and this series definitely brings in the ratings for MTV! But what do the girls featured on the show get out of  it? It appears that they are all struggling with money and time. Many of these young women didn’t graduate from high school because of the birth of their baby. So what’s in it for them besides being a reality tv star?

According to a new report from Radaronline.com, these teen moms actually get a pretty decent salary from MTV. Amber Portwood who was one of the mother’s from the original Teen Mom reported during a court hearing that she made a whopping $280k a year!!!!! Who knew that dropping out of high school and getting knocked up at 16 could be such a smart career move?

So what do some of the other Teen Mom’s make? According to the report trouble maker Janelle Evans rakes in an estimated $75k a year. I guess that’s good for her considering she always finds herself in trouble with the law. Leah Messer, who had twins Ally and Alecia, is expected to make $20k alone just to get married on camera for the next season. She’s also the highest paid member on that cast.

Many of the Teen Mom’s have come under criticism for the way they spend they money they’ve earned. Some have bought expensive trips, cars for family members, and even boob jobs. I just hope these girls are putting their money away for their child’s future. I realize they need to get paid to be on the reality tv show, but couldn’t they be paid in the form of a trust account. That way these young girls wouldn’t be able to blow all their cash and their child would be taken care of as well.

Breaking it down it is obvious that Portwood needs a quality TEAM. If she were my client I would insist she saw a quality psychiatrist and an addiction specialist while completing her court mandated rehab. Yet Portwood seems convinced that serving 5 years in jail is the only way to get and stay sober, and the only way to stay out of legal trouble. Is this rational? Of course not and yet why would we expect a person in severe crisis like Amber Portwood to be able to make good choices?

The fact of the matter is that I work with people like Portwood every day. People who find themselves in legal trouble are also often dealing with addiction and mental health issues. I take into account the entire picture when helping clients and their families handle an arrest and potential jail time. The truth is that nobody is better off in jail than in a quality treatment program and it is likely that Portwood will still be able to make a pitch to the court for an alternative sentence. This, even after Portwood has failed drug tests and lied to her caseworker in order to get out of “required” meetings and testing. But of course!

Portwood’s brother Shawn told E! News that the system has failed her. The truth is that the system is not responsible for the choices of Amber Portwood- She is and yet is unable to make good choices due to her condition. What now needs to happen is a version of in-patient treatment that includes drug rehabilitation, therapy and community service. A true ALTERNATIVE SENTENCE. Why all three? I believe that everybody in crisis benefits from community service, as if the type of service fits the need, it will empower the person in trouble while also helping society. That is the key- EMPOWERMENT.

For now all we can do is hope that there is time for a quality and long-term outcome for Amber Portwood and her child. Remember that families are the forgotten consequences of crime. Change is possible Amber- never give up.

It all began innocently enough with talk shows, yet the clamor for “dirt and secrets” soon gave way to daytime talk shows such as Donahue, Geraldo and Sally Jesse Raphael. Not to be outdone, smaller scale affiliations started to introduce viewers to a more explosive and controversial side to reality and came up with the Richard Bey show (a talk show which incorporated elephant noises when overweight people walked on stage) to the more popular Jerry Springer show.

After the daytime crap shows came what (at first) seemed to be a new type of reality show; the competition. Here we see the birth of Fear Factor, Big Brother and Survivor. Surely taking a bunch of strangers and having them compete for cash prize must be a good idea right? Right? after all, when these people are done the show they will go back to their dreary lives and forget their 15 minutes of fame…..

I mean Take Survivor for instance, The first winner pretty much walked around nude the whole damn show, wagging his peen in everyone’s way…if i did that on the street I’d be arrested. How was this not sexual harassment of some sort? Plus it was supposed to be a family show.

That’s alright, i’m sure everything else he did was on the up and up….Oh no wait, he was arrested and charged with tax evasion and served jail time TWICE…but he said it was because he was gay. On top of all of this, he still managed to appear on another reality show, The apprentice. So much for fading away into obscurity for winning a game.

Now a show that gave us that gem so early on in the game couldn’t have possibly given us another right? I mean what could be worse than honoring a guy that really didn’t do much in the first place? How about giving a racist, bigoted, uptight crazy bitch a talk show?

Oh Elisabeth Hasselback, one of the most asshole-y people on the planet, she was a rude bitch on survivor and continues to be a rude bitch on the view. Yet she’s not fired, why? Because people still continue to watch that shitty show and continue to enable her career. Kudos to Bill Maher for not punching her in the face when she wouldn’t shut up about a joke he made and she took it completely out of context:

She also tried to take on, Whoopi Goldburg, Rosie O’Donnell, Kathy Griffen, and Janine Garofalo…i think she just hates anything funny.

In the last few years we have been bombarded with reality t.v aimed at a younger crowd. Teen Mom and 16 and pregnant, for instance seem to be aimed at the under 18 crowd. The show’s stars and producers tell the media that their intent is to warn kids to have safe sex and wait to have kids. Some of the teens like Janelle Evans and Amber Portwood have lost custody of their children and have both been in jail, yet they are still being pursued by MTV and its affiliates as well as being paid for appearances in magazines and other forms of media. I could fill a whole other blog on these two shows alone. The worst part with these shows is the sheer fact that these kids are being used by adults.

So to recap, we started off with reality shows based on interviews and talk shows, graduated to competition shows, reached the horror of teen pregnancy and child exploitation (don’t even get me started on Toddlers and Tiaras..i had to stop myself from even going there) and now we end with..Socialites. Paris Hilton and Kim Kardashian, People famous for being rich and nothing else…..

Oh Man! these two are sure a piece of work, and the public keeps lapping the shit up! After the release of Paris’s sex tape, she had a steady stream of shit shows for years. Plus an album or two! And don’t even get me started on Kim, I’m not even sure what she does, except wander around wearing different wigs and using different accents to scare the crap out of her family. (seriously, watch this clip to see what it looks like to watch a mind snap)

Amber Portwood was thrown in jail AGAIN last week after skipping a drug court appointment and lying about it — saying she had doctor’s orders to stay home after a surgery. However, now she’s a free woman again…sort of.

“The judge told Amber he wants her to continue drug rehab treatment and find a real job,” TMZ reports, explaining that the troubled Teen Mom star is under home detention as of yesterday.

However, if Amber has any more issues with her drug program, she’s going to be thrown out altogether and back to facing five years in jail.

She’s already been caught lying about housing to receive extra financial help from the government. She’s already been charged with assault. If she spent as much time trying to raise her child as she did trying to fight the law, she’d be the best darn mother we’ve ever come across.

Alas, some things never change.

Amber Portwood made $280,000 in 2010, but applied for low-income accommodations in subsidized government housing, TMZ reports. Since the 21-year-old mom failed to declare her accurate income, she has to dish out $673 in 30 days because she claimed she only earned $10,000 per year!

Amber lives in Indiana and the salary requirement for the low-income housing in the state is between $30,000 and $40,000 per year, The Daily Mail reports. Did she really think she was going to get away with the false declaration?

However, this mom has a past of neglecting to follow the rules! After failing to take a required drug test, Amber faced a sentence of five years in prison back in March, but luckily just had to re-do the drug test and write a report!

She got off easy the last time, but will she this time?

Her ex-fiance Gary Shirley seems to think so!  Gary posted this explosive tweeted on his official Twitter profile:

“For all you lucky ladies I just found out Ambers a lesbian I think I turned her gay. D*mn it this always happens to me lol.”

He even went on to say that Amber has a girlfriend.  The drama between these two never seems to end.  This is very shocking news!  Amber has been through so much in the past few months.  She was in jail back in December until she was released to go to rehab.  If this is what Amber wants for herself, than I say good for her!  I hope Gary isn’t making this stuff up just to mess with Amber!  She has enough stuff to worry about.

It’s been quite a rocky road for the troubled Teen Mom star Amber Portwood. She spent time in jail for battering her ex-fiance and daughter’s father, Gary Shirley, and barely avoided another stint for failing to take a mandated drug test. Even though the reality starlet earns $280,000 per year for letting MTV into her home, Amber’s legal fees are mounting, and she’s willing to do whatever it takes to pay them off.

“Her paycheck from MTV only goes so far, and she’s really worried it will soon all be over,” an insider tells Reality Weekly. “And Amber hasn’t gotten any other offers as far as TV shows or promotions.”

Well, aside from the one offer to star in an adult film by Vivid Entertainment. “Vivid told her she was big and beautiful and that really boosted her self-esteem,” the insider reveals. “Amber’s legal problems took over her life — but now that she is out of jail, she’s told them she’s really interested.”

Unfortunately, it seems that Amber missed her moment. “We would not be willing to pay Amber $500,000 anymore,” Vivid Entertainment CEO and Founder, Steven Hirsch, exclusively tells HollywoodLife.com. “I don’t believe she is as popular as she once was. She was more of a novelty.” Ouch!

Well this is bittersweet news!  I have been a huge fan of the original, “Teen Mom” for years!  This upcoming season will be the final season for the original cast.  It hardly comes as a shock for two reasons.  First, Amber Portwood has been in jail for months.  Second, the girls are soon not technically going to be teen moms anymore.  Most have already turned 20 or will soon.  I’m guessing MTV wants to launch some of the new girls from, “16 & Pregnant” into a new, “Teen Mom” show.

The final season of, “Teen Mom” will premiere in the summer on MTV.
