OK, I don’t really know where to go with this one but Andrew Robert Holland has appeared in court accused of possessing a pornographic image of a person having sex with a tiger. No people, not THAT Tiger, a real one. Mr Holland from Coedpoeth, Wrexham, Clwyd (where ever the hell that is ?) is accused of being in possession of the extreme bestiality image which probably resulted in serious injury to the person’s genitals and which (more to the point) was “grossly offensive, disgusting or otherwise of an obscene character”. OK, curious minded loons, the story doesn’t actually say if the “person” was male or female, whether they were a willing participant, if Mr Holland was the one who took the photo (assuming it was a photograph!) or where the tiger came from. So many questions, so few answers!

Rodell Green was just sentenced to three years imprisonment for having sex with a horse. Over at the Atlantic Blog, correspondent Wendy Kaminer asks the following “quick question“:

Can someone explain to me why it is a criminal offense to have sex with animals but entirely legal to kill and eat them?  Surely laws against bestiality don’t reflect concern about the rights of animals, (who would probably opt for sex over death.) I don’t mean to denigrate meat eating (I’m a carnivore;) I do mean to point out the absurdities of imprisoning people for “buggery.”

In a sense, Ms. Kaminer is right. It is simply inconsistent for the law to send someone to jail for three years for having sex with a horse while simultaneously allowing billions of animals to unnecessarily suffer as a result of factory farming.

Nevertheless, I believe that there is a way to explain this inconsistency. As I pointed out in a previous post, it’s unclear whether the purpose of bestiality statutes is to protect animals from cruelty. As a matter of fact, I think that bestiality statutes have little to do with preventing animal suffering. Instead, it’s more likely that the purpose of bestiality statutes is to enforce a moral principle, namely: that it’s against natural law and morality for human beings to have sex with an animal.  This reading of bestiality statutes is supported by the history of laws criminalizing such conduct.

The first statute criminalizing bestiality in common law jurisdictions was England’s Buggery Act of 1533. The statute made engaging in anal sexual intercourse or having sex with an animal a crime punishable by hanging. These acts were criminalized because they were unnatural and against God’s will. After all, as Blackstone (in)famously asserted in his famous Commentaries, someone who engaged in these acts committed the “abominable and detestable crime against nature”. As a result, it seems fairly obvious that what inspired bestiality laws was the state’s desire to enforce a particular moral view.

Furthermore, given that statutes protecting animals from cruelty were not enacted in common law jurisdictions until the Nineteenth Century, it would be odd to conclude that the Buggery Act was intended to protect animals from pain. In addition, the fact that bestiality was criminalized in the same statute that prohibited anal sexual intercourse is telling. Why would a law intended to protect animals from suffering always be included alongside a law prohibiting human beings from engaging in anal intercourse with each other? The only way of making sense of this is by asserting that bestiality statutes – like sodomy laws – are intended to enforce morality rather than to protect animals (or humans, for that matter).

Once we construe bestiality statutes as laws that are enacted to enforce a moral principle, it’s easier to understand why the law provides that a man can be imprisoned for three years for having sex with an animal while it simultaneously allows people to treat animals cruelly in factory farms.  Most people believe that having sex with an animal is immoral (against nature, religion, etc), whereas unfortunately most people still believe that producing cheap and tasty meat products justifies inflicting incredible amounts of pain on animals. After all,  God frowns upon having sex with animals (“Neither shalt thou lie with any beast to defile thyself therewith: neither shall any woman stand before a beast to lie down thereto: it is confusion” – Leviticus 18:23)  but doesn’t really object to eating or killing them. (e.g., “Every moving thing that lives shall be food for you” – Genesis 9:3).

Of course, there are many reasons to take issue with this conclusion. For starters, criminalizing conduct merely because it violates a moral principle strikes many – including myself – as illegitimate. If we believe, as John Stuart Mill and H.L.A. Hart did, that the state can legitimately prohibit conduct only to prevent harm to others, it would seem that criminalizing bestiality solely because it violates a moral principle is unwarranted. Furthermore, regardless of the moral beliefs of the majority and of what religion or the Bible has to say about the issue of factory farming, it’s fairly obvious to anyone who gives serious thought to the issue that factory farming practices are immoral for a variety of reasons (animal suffering, CO2 emissions, etc). Therefore, the reasons in favor of prohibiting factory farming are clearly more powerful than the reasons in favor of criminalizing bestiality.

In sum, it’s easy to explain why having sex with an animal may land someone in prison whereas factory farming practices that cause animals to endure unimaginable amounts of pain are authorized. The former practice is viewed by a majority of the population as immoral, while the latter is not. The distinction is grounded in historical practice and in religious considerations that are not easily exorcised.

Ms. Kaminer pointed out that the disparate legal treatment of these two acts reveals the “absurdities of imprisoning people for buggery”. What Ms. Kaminer didn’t mention, however, was that this incongruity reveals something else about our legal system that’s even more disturbing: it unjustifiably lets factory farming go unpunished.

After being engulfed in Metallica’s artistic smorgaborg last night and with 2 long meetings coming up today, I’m lounging – and watching what’s washed ashore in my You Tube feed. Today, I’m getting a lot of animal-on-animal fucking sequences and, nature lover than I am (don’t go too literal here), I have to watch them.

Look at all help and encouragement “Trigger” gets when he’s mounting Miss Mare here. Mid-wives are helping him up, guiding him in (she’s done this before…) and patting him on his hind quarters when he gets some traction. And just look at the size of his hoagie! (it had to be said) This is organized horse sex at its best.

I came across this charming ‘cow tree’ in New Brunswick last month. There was magic in that warm August air, and I couldn’t resist bringing some back to Calgary to share with all my readers. Of course, the ‘real’ lesson here is that the inherent romance of some settings can even, on the rare occasion, transend species. Oh Newton, how different your future (and all of ours!) might have been if you’d planted yourself under a cow tree on that sunny afternoon in Lincolnshire.

Is oral sex a crime?  Not necessarily, of course.  But absent consent, it sounds like a crime to me.

Not so if the mouth belongs to an animal, according to a Burlington County, New Jersey judge who dismissed charges against a police officer accused of putting his penis in the mouths of at least 5 calves for the purpose of gaining sexual pleasure.  The judge said it was questionable that the acts constituted animal cruelty.  Why don’t calves deserve protection from sexual predators?  It doesn’t make any sense.

If you were wondering whether judges in Kansas were paid enough, the answer is “NO.”    Judges in Kansas have to sometimes decide whether a person caught en flagrante with his ex-girlfriend’s dog (after sneaking into her garage) should have to register as a sex offender.  (Apparently so.)  That type of work, in my humble opinion, defies a compensatory dollar figure.

A man in the US has been arrested for allegedly breaking into a house to have sex with a dog.

Christopher Bagwell, 26, is accused of entering a home in Farmington, West Virginia while the owner was at work.

A friend of the person who owned the house had stopped by to leave off some possessions when she said she caught Bagwell having sex with the owner’s dog, a male Australian shepherd, border collie mix.

She said: “His pants were down around his ankles and the dog was making an awful sound.”

At the time, she called Bagwell a “sick bastard” and he let go of the dog.

“The dog jumped down off the chair and ran over towards the love seat. At that time Chris started towards her, pulling his pants up,” the police report said.

Bagwell has been charged with burglary and animal cruelty.

My ability to express myself in prose began with a talkboy. My friend Carly and I had a minor obsession with prank phone calling people our entire adolscent lives. One day we busted out the Talkboy she got for Christmas like eight years prior. The Talkboy pranking started off innocently enough. We’d call random restaurants and use the slowed-down, creepy voice to ask them about their menu items.

Then, we began using the slowed-down creepy voice to inquire our friends about their current situation with their panties–  meaning, what kind they were wearing. Then, we began to using the slowed-down creepy voice to inquire our friend’s parents about their current panty situation.

Then, we took it to another level. With the animal sex and zoo poem (recited in the slowed-down, creepy voice–of course). I can’t remember the exact words but I remember it began with standard talk about how we had been watching them and then immediately went in to how we wanted to have sex with them and zoo animals at the zoo. I remember one line verbatim:

Let’s have wild sex at the zoo,
we’ll make that fat ass cow scream moo.

Lovely, right? I’m working on Carly finding her Talkboy because it’s still saved on there, but she has real things to worry about like a full-time job and kids, so I’m being patient.

Anyways, that’s where it began but not where I flourished. In my freshmen year of college I used to spend countless hours on AIM (I have really constructive uses of my time, hence while I’m still trying to get my ungrad six years later), and would make up stupid poems with my friend Bridget. I think it needs a little introduction because there are some things you may not understand as the poem is mostly made up of inside jokes.

-Snax is Bridget. She got her  nickname that way when we all went on a roadtrip senior year and she brought like an entire grocery store with her for the bus ride. She even had a freaking loaf of bread and jars of PB&J.
-Traci is Bridget’s mom who is totally hot. I’m not a lesbian but she is a hot mom, it’s undisputable. Junior year of high school I used to pass Bridget a note everyday in Western Civ. that said: tell your mom I said thanks. Everyday, without fail.
