After the sickening murder of a 9-year-old boy in Washington, our friend Spencer Ackerman made an impassioned plea: U.S. Central Command chief General David Petraeus for D.C. metro police chief. The idea of America’s leading counterinsurgent taking on one of its most crime-ridden towns definitely has a certain visceral appeal. But militarizing our approach to policing is an idea that could backfire in a hurry.

Spencer’s done an outstanding job of explaining counterinsurgency as a progressive military doctrine: The whole point is to not uphold the social status quo, it’s an attempt to get at the “root causes” of violence through political reform and public works. These days, that’s a job for both the armed forces and the police. “The ’soldiers aren’t cops’ argument isn’t going to fly here,” he wrote. After all, talented military officers are now telling their fellow soldiers to “view neighborhood security as if they were running Kansas City police patrols.”

Ackerman’s not the first to pick up on the idea that smart counterinsurgents could teach the police a thing or two. Last week, Karl Vick of the Washington Post reported on how the police in Salinas, Calif., enlisted the help of the Naval Postgraduate School to help them combat a homicide wave. And earlier this year, Andrew “Abu Muqawama” Exum hosted an interesting discussion thread about using counterinsurgency tactics in Oakland.

At first glance, counterinsurgency (at least the “soft,” population-centric American version) bears a fair amount of resemblance to community policing: It’s all about changing the dynamic in the communities where insurgents operate, encouraging troops to “walk the beat” and bringing in social services. And many of the tools of the modern counterinsurgent — forensic exploitation, pattern analysis and social-network diagramming — would be familiar to any detective. (The Law Enforcement Professionals program for combating roadside bombs in Iraq and Afghanistan even called on retired agents from the Federal Bureau of Investigation, the Drug Enforcement Administration and the Bureau of Alcohol, Tobacco, Firearms and Explosives to help take down insurgent networks.) And if you look at the geographic reach and organizational sophistication of some gangs — think Mara Salvatrucha or 18 — and it’s tempting to draw comparisons with, say, a Hezbollah or a Hamas.

But to the COINdinistas I would say: Be careful what you wish for. Counterinsurgency is still a tool for dealing with political emergencies, and it involves a heavy degree of population control. And at home, it’s a bridge too far.

“Policing can be informed by counterinsurgency – and they are in fact similar at some points,” said John P. Sullivan, a lieutenant with the Los Angeles County Sheriff’s Department and an expert on transnational gangs. “But at others they really diverge. So you need to be very, very careful.”

Sullivan, the co-founder of the Los Angeles Terrorism Early Warning Group, told Danger Room the parallels with community policing — patrolling contested areas, identifying centers of gravity — make it tempting to view counterinsurgency as a tool for containing gang violence. But domestic policing and military operations, he added, are inherently different. “It [counterinsurgency theory] is attractive, and I think that people looking at gangs should look at the literature,” he said. “But to wholesale take it in and do it is probably not a good idea.”

Take, for instance, checkpoint operations — a regular feature of any counterinsurgency. No harm, right? Well, the police in Washington tried that; the whole idea was to “protect” the endangered population of the Trinidad neighborhood by cordoning it off and restricting the movement of vehicles. A federal appeals court struck down the operation as unconstitutional. Same for “cordon and knock” — going house to house, politely searching for contraband. The police tried that in D.C., too, under something called the “Safe Homes Initiative.” It didn’t go down well, either.

That’s not to mention the more potent intelligence tools of control that are essential to fighting insurgents: Human intelligence (i.e. informants); intrusive surveillance; biometric collection. Those methods are available to domestic law enforcement, but the point is counterinsurgency is to establish sweeping civil control. Anacostia ain’t Anbar province (Al Anbar Governorate). As Sullivan described it, the bar for collecting intelligence on your own population has to be much higher.

“The liberty issues are vital,” Sullivan said. “What gives you legitimacy in the long haul is preserving liberty while providing security. If you don’t end up doing it right, it ends up enhancing the legitimacy of the gang.”

Want to see what a place looks like when counterinsurgency starts to seep into policing? For a softer example, take a look at the United Kingdom. I’m not going to wade into Second Amendment territory here, but suffice to say that the United Kingdom has a pretty expansive surveillance system that in part was developed in response to IRA terror. (It also has a more robust Official Secrets Act.) For a more dismal example of what happens when the police take enthusiastically to checkpoint operations, take a look at Russia. We’ve been spared much of this, because we tend to intervene in other countries’ counterinsurgencies. Let’s not start looking for one at home.

There is still plenty of overlap between good policing and counterinsurgency “best practices.” Collecting unbelievably fine-grained statistics and holding local commanders responsible for their patrol areas are essential tasks. But we are dealing with two different things. Insurgency, at its heart, is a political struggle. I don’t see drug dealers or street gangs expressing a political grievance, or trying to control of some part of the government. We have an unhappy tendency to declare “war” on problems (drugs, crime, poverty, terrorism) that defy easy solution; do we need to treat a D.C. crime wave like a mini-Malaya Emergency?

Anyone who drove by the Auburn Mall last night might have been shocked to see dozens of police and SWAT team vehicles parked there. Fortunately, there was no emergency.

A training exercise at the mall involved federal agents and more than 100 police officers and 20 police dogs from across Massachusetts. Data from the exercise will be used to increase security across the country, according to police.

The exercise, code name “Auburn Project,” was requested by the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives and designed by the Auburn and Boston police departments.

Joining ATF and U.S. Department of the Interior agents at the mall last night were U.S. Air Marshals and police from Boston, Auburn, Worcester, Quincy, Chelsea, Everett, Hanover, Revere, New Bedford and the Massachusetts Bay Transportation Authority.

There were also officers from the Central Massachusetts Law Enforcement Council training inside the mall in conjunction with the K-9 officers.

Dozens of uniformed police swarmed throughout the length of the mall, while police dogs searched the mall inside and a row of school buses outside.

Officer James D. Ljunggren, Auburn’s K-9 officer, said ATF members kept detailed records of every aspect of the operation to help determine how many dogs are needed to find explosives hidden in a school bus, mall or other large building or vehicle.

Officer P. Troy Caisey, head dog trainer at the Boston Police Department, said “canine explosives-training devices” were hidden in school buses and in the mall, where police tested dogs facing distractions including scents left by thousands of shoppers and cooking odors in the food court.

“Every dog hit the odor every time. This was an invaluable experience. It was good to get the dogs out of the Boston area, which they are used to,” Officer Caisey said.

There as observers were state Rep. Paul K. Frost, R-Auburn, and state Sen. Michael O. Moore, D-Millbury.

Mr. Frost said, “Seeing local police and federal agencies coming together to train on such a massive scale is great. Thanks to the Auburn Mall for allowing this during their busiest season.”

Mr. Moore said, “This is a wonderful program. With dwindling state resources, we need to encourage regionalization. This is a perfect example of how the state’s 20,000 municipal police officers can share resources.”

Auburn Police Chief Andrew J. Sluckis said many of the explosives-detecting dogs and vehicles were paid for by Homeland Security grants, and said Mr. Moore and Mr. Frost were instrumental in helping Auburn get its grant.

He said that Officer Ljunggren has worked regularly with other departments when explosives are involved.

“He went to Boston to help in the church at Sen. (Edward) Kennedy’s funeral. There were four presidents, the vice president, senators and representatives there,” Chief Sluckis said.

Just last week, Officer Ljunggren traveled to Quincy, where explosives were found in a residence. Last year, Quincy police helped search Auburn Middle School when a bullet was found, Chief Sluckis said “These days, sharing resources is vital, “ Officer Ljunggren said.

He thanked the Auburn Mall, which closes at 6 p.m. on Sundays, for allowing police to stage training there, and said, “This is the largest Homeland Security operation ever held in Central Massachusetts. The information learned here will help across the state and the country.”

Domenic Schiavone, mall manager, said, “Our partnership with public safety is key. We’ve had smaller training exercises, but nothing like this.”

Officer Ljunggren said drug dogs must be trained once a week.

Explosives dogs are trained every day, only receiving their daily meals when they find the explosives scent.

Only three police officers in the state are certified nationally as explosives detection dog trainers. They are Officers Caisey and Ljunggren and Worcester Police Officer Stephen C. Cortis.

Officer Ljunggren said, “If a drug dog makes a mistake, someone might get away. If an explosives dog makes a mistake, there can be a disaster. We need them to be close to 100 percent.”

Today I had a day off and decided to do one of my favorite things, nothing. Now that might sound like a bit of a copout but consider just how difficult it is to do nothing, I dont mean in a quantum physics sense mearly in a lazy day sort of way. While your doing nothing you cant do anything else at the same time, you exist in some Schroedinger-flux state between busy and not busy but cant provide a reason to get out of doing anything for anyone else without coming up with some rather inventive lie which more often than not requires alot of extra effort to keep up the pretence of not procrastinating.

So trying to do nothing can in many ways involve more work unless your good at it, and if there is anything im good at its nothing.

Looking back on the day though I managed to do alot while doing nothing, I installed ubuntu 9.10 on a spare laptop I had lying around (thanks to DJM for burning the disk).

I played a few games including the left4dead2 demo, which seems pleasent enough. I wont be offering a full post review of the game as I don’t really think I’ll be playing it that often, I wasn’t exactly a huge fan of the original L4D, I didn’t dislike it I just felt I played it more out of a sense of obligation then for enjoyment.

Over in World of Warcraft (yes I play it, no I’m not sorry, and no I don’t know where your key’s are have you checked behind the sofa?) I managed to get a couple of levels on my Druid questing in Ashenvale, so John if your reading this its time to catch up.

Also I came up with a few drafts for the Comic but I suspect non of them will ever reach the production stage, so I go into tomorrow still script-less and hoping John is too busy killing fighting for his life against hordes of the undead and playing left4dead2 to notice.

But in my dreams, I slew the dragon

The declining state of the US economy has convinced a growing number of American analysts that the US capitalist financial system is doomed to disintegrate.

Citing the works of other leading economists such as Jack Bogle and Marc Faber, Market Watch commentator Paul B. Farrell gives 20 reasons, in a recent article, why the “American capitalism has lost its soul” and will.

Farrell points to Faber’s Doom, Boom and Gloom Report and asserts that the economist is warning of the fall of “the entire system of capitalism.”

“The future will be a total disaster, with a collapse of our capitalistic system as we know it today,” Farrell adds, quoting the report. “Get it? The engine driving the great ‘American Economic Empire‘ for 233 years will collapse, a total disaster, a destiny we created.”

He writes that based on Faber’s predictions, capitalism, which has been the driving engine of America and global economies for over two hundred years, will collapse and, consequently, trigger global “wars, massive government-debt defaults, and the impoverishment of large segments of western society.”

He goes on to explain how the Wall Street has “sacked Washington” by examining Bogle’s writings.

Farrell mentions that in “The Battle for the Soul of Capitalism,” Bogle warns of a growing three-part threat or in other words a “happy conspiracy.”

“The business and ethical standards of corporate America, of investment America, and of mutual fund America have been gravely compromised,” writes Farrell citing Bogle’s book.

“But since his book, ‘Wall Street America’ went over to the dark side, got mega-greedy and took control of ‘Washington America.’ Their spoils of war included bailouts, bankruptcies, stimulus, nationalizations and $23.7 trillion new debt off-loaded to the Treasury, Fed and American people.”

Going back to Faber’s work, Farrell argues that it is a historical imperative for “Every successful society” to grow “out of some kind of challenge.”

“Today, the ‘life cycle’ of capitalism is on the decline,” he reiterates.

Farrell believes that, in short, America has turned into a “grumpy old man with hardening of the arteries.” “Our capitalism,” he writes, “is near the tipping point, unprepared for a catastrophe, set up for collapse and rapid decline.”

Among the reasons he offers to back his claims about the failing US economy are that America’s top 1% own more than 90% of America’s wealth, the average worker’s income has declined while the CEO compensations have exploded over ten times, the federal debt has skyrocketed from $11.2 to $23.7 trillion in two years, and that it is the Wall Street wealth that now calls the shots in the US Congress and the White House.

Farrell finally concludes, “American Capitalism is a ‘Lost Soul’ … we’ve lost our moral compass … the coming collapse is the end of an ‘inevitable’ historical cycle stalking all great empires to their graves. Downsize your lifestyle expectations, trust no one; not even the media.”

NASHVILLE, Tenn. — A Special Forces soldier was arrested Monday after a pair of hunters found about 100 pounds of explosives outside his home near Fort Campbell.

Timothy Ryan Richards was charged with possessing two unregistered guns, and Bureau of Alcohol, Tobacco, Firearms and Explosives agent Eric Kehn said he expects Richards will face more charges related to the explosives.

A sworn statement said agents found about 100 pounds of explosives — including C-4, a plastic explosive commonly used by the military. The material was sealed in watertight containers and partially buried near his home outside of Clarksville, near the sprawling Army post on the Tennessee-Kentucky state line.

Joel Siskovic, a spokesman for the FBI in Tennessee, said agents from the Joint Terrorism Task Force were called to the scene, but determined there was no terrorism connection.

According to police, two hunters found the explosives early Sunday morning and alerted the sheriff’s department.

ATF agents contacted Richards and he told agents that he had placed the explosives there, according to the affidavit.

Agents also found a 5.56mm caliber rifle and a .45 caliber machine gun inside his home.

Maj. April Olsen, a spokeswoman for the Army Special Forces at Fort Campbell, confirmed that he was a member of the 5th Special Forces Group, but his age and rank weren’t immediately available.

He appeared in court handcuffed in green coveralls. U.S. Magistrate Clifton Knowles ordered the federal public defender’s office to represent him and that he be held until a hearing Thursday.

He didn’t make any statements, but acknowledged to the judge that he understand the charge. He faces a maximum 10 years in prison if convicted on the weapons charge.

Another Fort Campbell soldier was arrested in October and charged with selling four stolen hand grenades and a stolen anti-tank rocket to an undercover officer in Tennessee.

Prosecutors said the transaction with Pfc. Joshua Bartlett Etherton, a 101st Airborne Division soldier, was arranged after police in the small town of Paris received a tip, but they would not say who he believed was the buyer.

He remains held without bond.

What if there was no justice in Arizona?

By John Donnelly

What would you do if you were a successful dentist and had been falsely arrested and held for several months under charges that were made up by your scheming wife (long-term drug addict and alcoholic) who was trying to get a divorce, obtain a strategic position for custody of your two children, gain control of all your money and property by lying to police in order to have you kept in jail so she could loot your bank accounts (corporate and joint accounts), steal drugs (DEA controlled narcotics), patient dental records, personal firearms collection (99 guns, ammo & accessories)?

What if your wife and her lawyer, accompanied by the lawyer’s paralegal, the paralegal’s husband (a Phoenix firefighter) 2 Sheriff’s detectives and another un-named person came into your house at midnight while you were in the hospital, opened your gun safes and removed your ninety-nine (99) guns and accessories, supposedly under a court order, for placement at a gun shop for consignment? What if there has NEVER been any court order produced to show the need to remove your firearms? What if the detectives were supposedly there for a civil standby, but have no official documents requesting their presence? What if they never made an accurate accounting (make, model and serial number) of the items removed? (Chain of custody) What if between the house and the gun shop, thirty-three (33) of the firearms disappeared? What if the lawyer denied the existence of these firearms for several months, and in several certified letters requesting information, the truth finally came out that he and the detectives had bought some of these guns and ammo? (Grand Theft) What if the gun shop where the other guns were taken refused to give you a list of firearms that they received and subsequently sold? (ATF form 4473 – Federal requirement for firearms transfer) What if, under a court-ordered subpoena, they still refused to provide this information? (Contempt of court) What if the gun shop owners sent a letter to the judge on your divorce trial telling him that they sold a large number of your guns for about $3,000? (Way under market value)

What if your wife had been seeing at least 18 different doctors (doctor shopping) in order to get prescriptions for narcotics? What if she had been taking these drugs behind your back for several years? What if she was writing prescriptions in other peoples’ names, and calling them in to pharmacies for herself (using your DEA license) and getting more drugs in that manner? What if, in addition to the illegal narcotics that she was taking, she also was taking prescription drugs for depression and schizophrenia? What if you found out that your wife had been stealing drugs from your office as early as one year after you had been married? What if she met an attorney at the gun range whom she kept in contact with for several years, and used this attorney later when your guns were stolen? What if she obtained a confidential list of judges (and their home addresses) from this attorney, and this list was found in your vehicle when you were arrested? What if it is not illegal or unlawful to have a copy of this list?

What would you do if the attorney that represented your wife, had you allegedly sign papers (with her attorney acting as the Notary) while you are in the hospital due to a head injury and under heavy medication (vulnerable adult), giving her access to your corporate bank account, and then she promptly cleaned out the account of about $22,000? (NOTARY FRAUD by the Attorney, and conflict of interest, assisting another in commission of a Felony)

What if she (the wife) stole vehicles and property that belonged to the corporate trust and concealed their whereabouts? What if she stole your computers, over 2,000 patient records [HIPAA violation (Federal) Identity theft] gold, DEA controlled narcotics (drugs), DEA controlled substance logs, and prescription pads from your office.

What if your wife filed a restraining order against you in order to keep you away from your house in order to conceal the fact that she had cleaned out the house, safes and office, of all your money, property ($663,000) and possessions? What if she sold some of that property (that was not hers) in order to buy drugs, go on uncontrolled spending sprees, and take trips to Mexico and California?

What if the local police department assisted her in removing your property from your house, locked safes and office, and when you tried to report the theft of property, the police failed and refused to respond or act on the report or any other reports that you attempted to make and treated you in a hostile manner?

What if the wife was found passed out in the gravel in front of Walgreens, with an open bottle of rum? (PUBLIC DRUNKENESS) What if her employer drove her home from work, (the school where she teaches) because she was drunk on the job? What if she was drunk and running through her apartment complex late at night, banging on doors and screaming that she was sexually assaulted, and when the police came, denied it? What if the wife was charged with 3 DUI’s within 2 years, one involving an accident where she INJURED a young man, who was required to be in the hospital for several weeks for treatment and recovery, destroying his semester at ASU? What if she didn’t get any REAL punishment or jail time for these 3 DUI’s, and what she did get, amounted to a slap on the wrist?

What if during one of the DUI’s she was involved in an accident, WHILE your child was in the vehicle? (FELONY CHILD ENDANGERMENT) What if the detectives and county prosecutor were covering up all these crimes by the wife (a known drug addict and alcoholic), because she was the only witness that they had against you? What if the wife had tried to commit suicide on at least 2 occasions, while your children were in her care (drugs and/or alcohol) and CPS refused to remove your children from her home? What if her own daughter expressed to police deep concern for her mother’s behavior? What if the police came and made a report, called CPS and they did NOTHING about removing the children from this home? What if you weren’t allowed to see, or have any contact with, your own children for over 3 years?

What if her attorney, and the detectives who were present when her lawyer cleaned out your gun safes, (99 guns, ammo, and accessories) purchased some of these guns for much less than fair market value, and lied about it to you and the State Bar, for several months before being caught in a lie? What if this attorney “gave” one of the guns to his brother out of state? (Federal firearms violation – interstate transportation of a stolen firearm)

What if the Arizona State Bar ADMITTED that this attorney was guilty of lying and theft, but failed to file sanctions against him (censure) or recommend disbarment for his crimes?

What if the attorney that you hired to defend you, pretended to act in your interests and failed to provide a reasonable defense, (ineffective counsel) failed to file objections and motions needed in a timely manner, and all the while charging you exorbitant amounts and when you ask for an itemized billing, made excuse after excuse and never provided the requested information? What if this attorney also had possession of 12 of your firearms, (that were given to him by the wife’s attorney) and sold those firearms for his personal gain? (Grand Theft) What if this attorney knew of the firearms theft by the wife’s attorney and (by state law) FAILED to report him to the state bar for punishment?

What if the Sheriff made inflammatory public statements (SLANDER) to the media about you regarding the false charges? What if the Sheriff also put you in jail among the general population, endangering your life?

What would you do, if, while you are being held in jail illegally, the detectives who were working on your case, lied to the grand jury (PERJURY) about evidence that they had in their possession, that POSITIVELY cleared you of the charges that you were being held for? What if they held you in jail for several more weeks, AFTER they KNEW of the evidence EXCLUDING you from the alleged crime? What if they made you pay a ridiculously high bond, ($360,000.00) that didn’t fit the crime, in order for you to get out of jail?

What if the county prosecutor called herself the “ANGEL OF DEATH” (and was so proud of this name she used it for her email name) and had previously worked with these lying detectives and was now trying to put you away for several felony counts? (CONSPIRACY) What if her motives were to keep you quiet, so the REAL TRUTH about the trumped-up charges, and her involvement with the lying, thieving detectives were never known?

What if the judges assigned to your case kept making delay after delay (usually 30-60 days) WITHOUT making any rulings, and then recusing themselves when things started getting hot, and judge after judge refused to hear the case, because it was a political hot potato? What if the judge kept making delays that pushed your trial date PAST the legally allowed time (over 3 years since your initial arrest) to deny your constitutional right to a speedy trial? What if the judge failed to follow both Arizona Constitution and the U.S. Constitution laws guaranteeing your rights? What if the judge got sick and never recused himself? The Supreme Court acted to intervene, without obtaining his recusal! (More delays)

What if they finally got a judge from an adjoining county, (who continued making 60-day delays) that held a hearing in the next county, that you were unable to attend, (and judge refused to allow you to appear telephonically) because it would violate your bond release agreement?

What if the wife’s lawyers pushed this judge to revoke your bond to restrict your movements and hamper your efforts to get the truth, work on your defense and in order for your wife to try and claim your house to get money? What if you were put back in jail because of this supposed bond revocation?

What if a good friend worked all night to file a Writ of Habeas Corpus with the Supreme Court and they refused to order your release? What if the judge failed to follow both Arizona Constitution and the U.S. Constitution laws guaranteeing your rights? What if all the law enforcement officers, attorneys, prosecutors, and judges involved in your case were totally ignored the rule of law, violating both STATE and FEDERAL statutes and DENYING YOUR CIVIL and HUMAN RIGHTS?

What if, because of these problems, you were not able to practice in your profession, and have lost out on over $300,000.00 in income? What if your mother (retired) had been paying your bills and helping in your legal defense for the past three years, expending all of her retirement savings?

What if your attorney at your divorce trial was inexperienced and didn’t get any help in defending you after being asked to? (Ineffective counsel) What if he failed to file motions in a timely manner or even to object to the nonsense that the wife’s attorneys were pulling and just kept billing you $300 an hour for doing nothing? What if the police pulled your mother over on the freeway, removed her from the car at gunpoint, and took away the car she was driving, even though she had a legal right to possess the car? What if your attorney didn’t even check on the status of the car for several days, to try and recover it for your mother, until after the wife had picked up the car from impound?

What if, during your criminal trial, you were taken from your cell at about 5:30 AM to be transported to the courthouse, without having anything to eat? What if you were put in a holding room until court started at 9:00 AM, sat in court until they recessed for lunch, were put back in the holding room (without getting any lunch) until court resumed at about 1:30 PM, and were taken back to your cell after court adjourned at 5:00 PM and didn’t get any dinner? What if this went on for 4 days a week for the entire time of your 3-week trial?

What if, during your trial, the prosecutor submitted circumstantial evidence that was never positively linked to you by DNA or fingerprints? What if the judge denied every motion from your defense attorneys to present evidence that disproved the prosecutions allegations? What if the judge had been talking to other judges and had a preconceived notion of your guilt, even before the trial commenced?

What if this judge denied your defense, in violation of your Constitutional rights guaranteed by the Arizona and U.S. Constitutions? What if, the judge prohibited the defense attorneys from giving the sentencing guidelines to the jury. What if the jury, after listening to the lies fabricated by your wife and the prosecutors, failed to understand the true legal definitions of the charges against you because of the interpretation given to them by the prosecutor, and found you guilty on all charges?

What if the judge sentenced you to 17-year (123.5 years total) consecutive terms on each charge? What if the sentence was excessive for a non-violent charge and this was your first offense? What if your defense attorneys ask the court to grant them an executive clemency hearing and were flat out denied? What if they explained to the judge that his sentence was extremely excessive for a non-violent charge, and that if you had committed something like a rape or murder, you would have received less time, and would be eligible for parole and the judge denied them again?

What if, 2 days after your sentencing, while you were in county jail, supposedly in protective custody, you were put in a cell with a convicted murderer, (ex-Mexican Mafia) who knew several of the judges, attorneys, etc. involved in your case? What if he came up behind you at 4:00 AM and severely beat you and knocked your 8 front teeth loose? What if, when you were taken to county hospital for treatment, and when you were taken back to jail, you were denied ANY pain medication? What if you were taken a few days later to a state facility for classification, while you were supposed to be in protective custody, where 2 inmates beat you again while the detention officers turned their heads? What if you heard that there was a contract out on you, because the (guilty) people involved in your case didn’t want you to talk about the case or ever see the light of day again?

What if, a month after your trial, a copy of the sheriff’s detective’s report turned up, showing that they were at your house the night that your guns were stolen? [and the report was concealed from evidence]

What would you do if all these things were TRUE? And you were not guilty of anything.

Would you finally believe there is no justice in Arizona?

IF you still have doubts, ask me – I have PROOF!

The new organization dedicated to rooting out political corruption in San Bernardino County held its first public meeting on October 6 in Redlands. The meeting was relocated at the last minute when the San Bernardino Public Employees Association (SBPEA) reneged on its agreement to allow the group to use its meeting room.

The organizers had hoped for eight to 12 people, but were pleasantly surprised when 26 showed up, including one broadcast reporter and Press-Enterprise columnist Cassie MacDuff. MacDuff has since written two columns on the group.

The next meeting of the group will be on Tuesday, October 20, at 6 p.m., in the meeting room of the Denny’s Restaurant located at 1180 Alabama Street, just north of Interstate 10, in Redlands.

Of those in attendance, 23 shared their impressions of witnessing years of various aspects of political corruption in the Inland Empire, although few had ever met each other and almost none had ever worked together.

Although the meeting was set to adjourn at 9 p.m., and the agenda was not completed until 9:45, there were still 20 people networking with each other at 10:45, and there were still ten left at midnight.

While continuing to work under the generic name of the “San Bernardino County Anti-Corruption Group,” organizational names being considered include “Citizens Inspiring Victory by Impeachment of Corruption (CIVIC)” and “Ethics, Truth, and Honesty In the County of San Bernardino (ETHICSb).”

The greatest challenge facing the group is to develop a general plan which unifies all efforts on a countywide level while addressing the diversity of each individual’s need for personal support to deal with the cases of corruption they are most personally troubled by. The group plans to work on both levels, as well as an intermediate level in which individuals from the same community also work on their local issues of corruption.

The group plans to prioritize county-wide cases of corruption in two ways. The primary priority will be whatever is the most controversial form of corruption at any given time. The secondary priority will be whatever issue of corruption the group can most directly influence.

Local community subgroups will set their own priorities for what issues of corruption to deal with. Individuals will be able to access all resources the group can muster to deal with their own personal issues and cases of corruption.

The group loosely addressed a mission statement and set of organizational goals. Some of the specifics mentioned were “to educate the citizens of San Bernardino County on ethics and corruption; to highlight, expose, and fight political corruption in San Bernardino County; to act as a citizens ethics commission to establish an official San Bernardino County Ethics Commission; to establish campaign finance and contribution limits, a sunshine ordinance, and a commitment to criminal prosecution and civil litigation; and to act as a citizens watchdog group to monitor the county ethics commission and support the county grand jury.”

The group is considering forming as a non-profit educational corporation, a non-profit membership corporation, and also as a political action committee. The original board of directors will be established with volunteers to elect from among them a chair, vice-chair, secretary, and treasurer for the organization.

Numerous tactics were discussed for attacking political corruption. The group set its sights on the election in June and November, 2010, with the intent of replacing the district attorney, county sheriff, various county judges, and two county supervisors. Also mentioned was a countywide initiative to establish an ethics commission and campaign contribution limits.

Several methods of fundraising were discussed. General fundraising was mentioned, including receiving tax-deductible contributions, grants, and direct mail solicitations. Topical fundraising, such as memberships, raffles, 50-50 drawings, refreshments for sale, and the passing of a collection plate at open forums were suggested.

Media communications were considered, including the need for a website, and plans to make digital video and audio recordings of the public forums to be aired on television and radio.

Public relations and outreach were considered. The public image and appeal of the organization, as well as the framing of its agenda and shaping of its issues, was also discussed. Several individuals and outlets in the media were mentioned as potential associates to be developed for the ongoing campaigns against political corruption.

A discussion of other organizations with which to affiliate identified Judicial Watch, the American Civil Liberties Union (ACLU), Common Cause, Citizens for Responsibility and Ethics in Washington (CREW), The Howard Jarvis organization, the First Amendment Coalition, CopWatch, and Californians Aware.

The group plans to host public forums on the first and third Tuesdays of each month, beginning with its first one on Tuesday, Nov. 17. The locations of the public forums will be announced when a venue is secured.

Growing lists of celebrities are publishing autobiographies to chronicle their lives in and out of the public eye. An upcoming book, “Open,” by Andre Agassi describes the 1997 event when Agassi tried crystal methamphetamine from his assistant Slim to soothe his pain from poor posture and anguish over his marriage to actress Brook Shields. After taking the drug, Agassi tested positive in an American Tennis Federation drug test, to which he concocted a lie to free his name. He said Slim would put crystal meth in his soda, which was true, but then Agassi lied and said he accidentally ingested the soda. The ATF believed his story and allowed him to continue in the league, without penalizing him.

This is a major revelation that casts a terrible light on the ATF and Agassi. I do not see the purpose of releasing this information. Clearly, Agassi wants to sell more copies of his book, so such a large revelation will boast sales. However, this revelation serves no greater good. Hulk Hogan, or Terry Bollea, is also releasing a book. Inside the book, he discusses his suicidal thoughts after filing for divorce from his wife, Linda Bollea. His purpose of releasing this information is it can serve a greater good, showing people going through divorce that there is light at the end of the tunnel. In Agassi’s book, I do not sense any greater good. He talks about lying and getting away with it, as well as doing drugs. He says he felt terrible, but without consequence, it shows others that lying can help you achieve success. Agassi went on to become one of six men to complete a grand slam. When the book comes out, maybe there will be a lesson from this story, but now it seems only like a publicity stunt.

In terms of damage to the AFC, I think it is unfair for Agassi to release this information. First, he lied to them, now he released this information. It is obviously embarrassing for the AFC, but they probably had faith in Agassi. His long history in the league and good name gave him credibility. When he lied, the ATC believed him because they had no reason not to. It reminds me of the saying, “Don’t bite the hand that feeds you.” In essence, the ATC was a venue for Agassi to achieve fame, success and wealth. Then, he went against them in his book. In my eyes, he is being ungrateful and harming the organization that did so much for him. Hopefully his negligence will not affect other tennis players within the organization by making the management trust them less.

Do you think his revelation has any significance or is it simply publicity?

Nullification: Firearms Freedom Act Introduced in Ohio. Firearms Freedom Acts have already passed in

Nullification: Firearms Freedom Act Introduced in Ohio.

Firearms Freedom Acts have already passed in both Montana and Tennessee, and have been introduced in a number of other states around the country. There’s been no lack of controversy surrounding them, either.

The Tenth Amendment Center recently reported on the ATF’s position that such laws don’t matter:

The Federal Government, by way of the Bureau of Alcohol, Tobacco and Firearms expressed its own view of the Tenth Amendment this week when it issued an open letter to ‘all Tennessee Federal Firearms Licensees’ in which it denounced the opinion of Beavers and the Tennessee legislature. ATF assistant director Carson W. Carroll wrote that ‘Federal law supersedes the Act’, and thus the ATF considers it meaningless.

Constitutional historian Kevin R.C. Gutzman sees this as something far removed from the founders’ vision of constitutional government:

“Their view is that the states exist for the administrative convenience of the Federal Government, and so of course any conflict between state and federal policy must be resolved in favor of the latter.”

“This is another way of saying that the Tenth Amendment is not binding on the Federal Government. Of course, that amounts to saying that federal officials have decided to ignore the Constitution when it doesn’t suit them.”

The Troops to Teachers program would be rejuvenated to attract younger veterans to work as public school teachers under a bipartisan plan announced Tuesday.

The existing program, created in 1994 to help find post-service work for people whose military careers were being cut short by the post-Cold War drawdown, has been limited to career service members with at least six years of active service or 10 years of reserve service.

The Post-9/11 Troops to Teachers Enhancement Act would reduce the requirement so that anyone who has served at least 90 days of continuous active duty since Sept. 11, 2001, could be eligible to participate in the program. Those who have not served 90 days of active service since Sept. 11, 2001, would be eligible if they served four years on active duty, two fewer than current requirements.

The program expansion is sponsored by Sens. Michael Bennet, D-Colo., and John McCain, R-Ariz., and Reps. Joe Courtney, D-Conn., Doris Matsui, D-Calif. and Thomas Petri, R-Wis.

Separate but identical bills were introduced Tuesday in the House and Senate. Bill numbers had not yet been assigned.

Courtney said the change is much like the Post-9/11 GI Bill, which took an old program and updated it for a new generation of veterans. “We are taking a program that is out of date and modernizing it,” he said.

The existing Troops to Teachers program has seen about 10,000 people, most but not all of them former officers, find jobs in public schools, Courtney said.

“It has been a very successful program, but it has not been as successful as it can be,” said McCain.

Reduced length-of-service requirements would not change other rules. A service member or veteran still must have at least a bachelor’s degree to participate in the program.

Financial incentives include a $5,000 stipend to pay for teacher certification costs for those who agree to teach in a school in which at least 20 percent of the students come from families living below the poverty line, or a $10,000 bonus for those who agree to teach in schools where at least 50 percent of the students come from families living below the poverty line.

The new bill proposes to expand availability of the $5,000 stipend by paying it to those who agree to teach three years in any public school district receiving federal funding to help disadvantaged students. Supporters said only about seven states quality for stipends today, which means service members and veterans cannot always find schools that have openings near where they live or want to live.

The new bill would not make any changes to the $10,000 bonus program.

Bennet said that changes would result in a 49 percent increase in the number of schools in which someone could teach under the program.

In addition to the eligibility changes, the bill authorizes — subject to appropriation — $50 million annually for five years to pay for incentives, a significant boost over the $15 million a year being spent today.

One problem with the current Troops to Teachers program is that appropriations — actual funding provided by Congress — has been limited.

Courtney acknowledged that the new legislation would not make that problem magically disappear; the revamped Troops to Teachers initiative still would have to compete for money with other Department of Education programs.
