This week several records where broken at the Heffel auction house in Toronto. Some of the Group of Seven paintings sold well into the millions. I have always recommended to art collectors that Canadiana Art is good investment because it is relatively inexpensive in comparison to other more famous internationally recognized artists. However, after this week Canadiana Art is showing it&#8217;s well deserved worth. So, if you folks bought when I told you so&#8230; good, If you are looking to buy now&#8230; good luck.</p>

<title><![CDATA[Auction seller won't agree to the sale]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p>This does happen also, but not nearly as often as a buyer not performing.  What we have in this case is a seller who, after the auctioneer says, &#8220;Sold!&#8221; doesn&#8217;t want to allow transfer of title &#8212; doesn&#8217;t want to agree to the sale.</p>
<p>Let&#8217;s discuss, first, when a seller can withdraw an item from an auction without recourse.  In the two types of auctions per the <a href="http://www.law.cornell.edu/ucc/2/2-328.html">UCC 2-328</a>:</p>
<ul>
<li>With reserve:  The seller may withdraw the item from the auction anytime up until the announcement of &#8220;Sold!&#8221;</li>
<p></p>
<li>Without reserve:  The seller may withdraw the item prior to the opening solicitation for bids, or may withdraw the item if after that solicitation, no bid is received within a &#8220;reasonable time.&#8221;</li>
</ul>
<p></p>
<p>What we now want to discuss here in more detail is what happens when a seller wants to cancel or otherwise won&#8217;t agree to the sale by auction, outside of his permitted methods of withdrawal aforementioned.</p>
<p>Case #1:  Seller wants to withdraw the item in a without reserve auction after the opening solicitation for bids, and after a bid is received within a reasonable time.  This case is clearly prohibited by contract law precedent and the UCC 2-328.  Court cases with standing in this type of withdraw have ruled nearly unanimously that the seller may not withdraw the item given these circumstances.</p>
<p>Case # 2:  Seller wants to withdraw the item in a with reserve or without reserve auction after the auctioneer announces, &#8220;Sold!&#8221;  The word, &#8220;Sold!&#8221; means that a contract has been formed between the seller and a buyer.  If the seller wishes to void this contract, or withdraw from this contract, it can only be done with the consent of the buyer.  </p>
<p>For example, the seller could say, &#8220;Gosh, I really didn&#8217;t want to sell my grandmother&#8217;s wedding ring, and I hope you (the buyer) understand &#8230; is it okay with you if I (the seller) just keep it, and you don&#8217;t pay for it?&#8221;  Outside of mutual release from the contract, the seller&#8217;s voiding or withdrawal constitute a breach of contract; the buyer can sue for specific performance or compensatory damages, and typically win easily.</p>
<p>Is seller performance sometimes used in illegal and unethical schemes by auctioneers to promote, in particular, absolute (without reserve) auctions?  Yes, unfortunately this has happened over the years, and continues in some markets.  The schemes are basically one of two kinds and work as follows:  </p>
<p>Scheme #1:  <em>Betty, the owner of a farm in Lincoln, Nebraska, wants to sell her farm at auction.  These auctioneers using this unethical, illegal scheme tell Betty that by marketing the property as &#8220;SELLING ABSOLUTE&#8221; she will attract far more inquiries, and demand much more attention, and more bidders, for her auction.  Yet, Betty doesn&#8217;t necessarily want to accept just any amount for her farm.  The scheme is designed to go ahead with the absolute auction, and then if the final bid is not acceptable to Betty, she can just refuse to close (breach the contract).</em></p>
<p>How can this work?  If the buyer wishes to sue Betty for specific performance, the auctioneer can assist Betty with a long, drawn out defense of the lawsuit, which in many cases, the buyer will see as costing them more than if he would just let Betty out of the deal.  A variation on this scheme sometimes involves the auctioneer offering the buyer a bit of compensation &#8220;for their trouble,&#8221; in return for dismissal of the lawsuit.</p>
<p>Scheme # 2:  Another scheme sometimes employed, and more-so in our Internet-age, is bidding for the seller in absolute (without reserve) auctions, thus withdrawing the item with such a bid.  The Internet allows these types of bids to be made in an undisclosed fashion, via online bidding, so this can be accomplished without the other bidders&#8217; knowledge.  And, not to ignore that this same scheme was employed decades before now, with non-existent phone bidders, and/or phony absentee bidders.  In other words, this scheme is much older than the current technology used to employ it.</p>
<p>Most auctioneers are ethical and act in accordance with the law.  Schemes such as the above are being more exposed and buyers are becoming more informed about unethical and illegal auction practices; so as these practices become exposed, hopefully their use will diminish.  Still, sellers sometimes won&#8217;t agree to the sale.</p>

<p>I am back from the country, comfortably in my city loft getting ready to go back to work. I purchased a digital picture frame today and think my &#8220;California Dreaming&#8221; photo series will be smashing in this device. I am anxious to set it up and see how light transforms my work. Maybe I could offer memory sticks loaded with images just for this purpose? Is there a market here?</p>

Slick Rick’s legend precedes him like no other, for he foreshadowed the pimpster attitude of many blinged celebrities of his era with his gold chains, resplendent gold tooth and his trademark diamond encrusted eye patch. The trademark eye patch is set with colorless, pink, yellow, blue and black pavé diamonds, and was estimated to sell between <span style="color:#ff0000;">$20,000-$25,000 in the British auction</span>.</strong></p>

<title><![CDATA[Do the tools mask what social media really is?]]></title>

My mother says she didn’t want any of her friends to be left out so my brother and I have around eight each! This, of course, has many benefits. In my early years it ensured a high yield of gifts on birthdays and at Christmas, and this week I was invited by one of my godfathers to a Livery Dinner held by the <a href="http://www.salters.co.uk/" target="_blank">The Worshipful Company of Salters</a>. Oh yes!</p>
<p><strong>Out of my league</strong></p>
<p><strong> </strong></p>
<p>I wasn’t too sure what to expect. My godfather was a solicitor and having Googled the<a href="http://en.wikipedia.org/wiki/Livery_Company" target="_blank"> Livery Companies</a>, I had an idea of the company I would be in plus there had been talk of having to wear white tie and tails…and I am still not really sure what that is. Anyway, I found myself amongst diplomats, MP’s, chairmen of some massive corporations and high ranking chemists, with some of the wearing robes, medals and animal hide! It was patently clear I was way out of my league on so many levels and when I explained I was in the social media, emerging technology ‘field’ there were various glazed expressions and one “…how funny!”. Awesome.</p>
<p><strong>Very minor epiphany</strong></p>
<p><a href="http://edhartigan.wordpress.com/files/2009/11/saltershall.jpg"><img class="alignleft size-full wp-image-73" title="saltershall" src="http://edhartigan.wordpress.com/files/2009/11/saltershall.jpg" alt="" width="180" height="183" /></a>During the dinner I, again, found myself trying to ‘pitch’ the industry to Dr. Gordon, a chemist from Geneva who knew way too much about wine. He was fascinated by the theories and possibilities of social media that I was attempting to explain, but couldn’t see any practical purpose for himself. He used email to stay in touch with his family and had heard of Facebook and Twitter but certainly wouldn’t consider himself a social media ‘user’. Reaching for examples or case studies that I could launch at him, I asked what his favourite pastime was? <em>“Easy, wine.”</em></p>
<p><em>“Cool</em>”, I replied, <em>“there are loads of ways to use social media for wine …”</em> And then the minor epiphany happened. He cut me off and said, the only thing he had really done online was buy wine at an auction through a live feed. He went on to say how amazing it was to feel so connected to the actual event and could bid in realtime, see the auctioneer, other bidders etc. <em>“And you said you have never used social media?” </em>I said. <em>“What, that was social media was it?”</em> was the answer!</p>
<p><strong>Look past the tools</strong></p>
<p>My point is that it is so easy to see social media as the tools or platforms that grab the headlines rather than a wider capability to connect you to people and places, which is where the real magic is. Dr Gordon had a ‘real’ human experience using social media for what it is meant to be…and he apparently got a good deal on the wine!</p>

<p style="text-align:justify;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><span style="color:#00045d;"><strong>A wealthy man and his son loved to collect rare works of art. They had everything in their collection, from Picasso to Raphael . They would often sit together and admire the great works of art.</strong></span><span style="color:#000000;"><strong> </strong></span></span></span></p>

<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>When the Vietnam conflict broke out, the son went to war. He was very courageous and died in battle while rescuing another soldier. The father was notified and grieved deeply for his only son.</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>About a month later, just before Christmas,</strong><span style="color:#000000;"><span style="font-family:TimesNewRomanPSMT, serif;"><span style="font-size:large;">t</span></span></span><strong>here was a knock at the door. A young man stood at the door with a large package in his hands.</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>He said, &#8216;Sir, you don&#8217;t know me, but I am the soldier for whom your son gave his life. He saved many lives that day, and he was carrying me to safety when a bullet struck him in the heart and he died instantly. He often talked about you, and your love for art.&#8217; The young man held out this package. &#8216;I know this isn&#8217;t much. I&#8217;m not really a great artist, but I think your son would have wanted you to have this.&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>The father opened the package. It was a portrait of his son, painted by the young man. He stared in awe at the way the soldier had captured the personality of his son in the painting. The father was so drawn to the eyes that his own eyes welled up with tears. He thanked the young man and offered to pay him for the picture.. &#8216;Oh, no sir, I could never repay what your son did for me. It&#8217;s a gift.&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>The father hung the portrait over his mantle. Every time visitors came to his home he took them to see the portrait of his son before he showed them any of the other great works he had collected.</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>The man died a few months later. There was to be a great auction of his paintings. Many influential people gathered, excited over seeing the great paintings and having an opportunity to purchase one for their collection.</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>On the platform sat the painting of the son. The auctioneer pounded his gavel. &#8216;We will start the bidding with this picture of the son. Who will bid for this picture?&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>There was silence.</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>Then a voice in the back of the room shouted, &#8216;We want to see the famous paintings. Skip this one.&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>But the auctioneer persisted. &#8216;Will somebody bid for this painting? Who will start the bidding? $100, $200?&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><span style="color:#00045d;"><strong>Another voice rang angrily. &#8216;We came to see the Van Gogh&#8217;s, the Rembrandts. Get on with the . . . (agitated words) </strong></span><span style="color:#00045d;"><span style="text-decoration:underline;"><strong>Real bids!&#8217;</strong></span></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>But still the auctioneer continued. &#8216;The son! The son! Who&#8217;ll take the son?&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>Finally, a voice came from the very back of the room. It was the long-time gardener of the man and his son. &#8216;I&#8217;ll give $10 for the painting . . .&#8217; Being a poor man, it was all he could afford.</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>&#8216;We have $10, who will bid $20?&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>&#8216;Give it to him for $10. Let&#8217;s see the masters.&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>The crowd was becoming angry. They didn&#8217;t want the picture of the son.</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>They wanted the more worthy investments for their collections.</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>The auctioneer pounded the gavel. &#8216;Going once, twice, SOLD for $10!&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>A man sitting on the second row shouted, &#8216;Now let&#8217;s get on with the collection!&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>The auctioneer laid down his gavel. &#8216;I&#8217;m sorry, the auction is over.&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>&#8216;What about the paintings?&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>&#8216;I am sorry. When I was called to conduct this auction, I was told of a secret stipulation in the will. I was not allowed to reveal that stipulation until  this time. Only the painting of the son would be auctioned. Whoever bought that painting would inherit the entire estate, including the paintings.</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><strong>The man who took the son gets everything!&#8217;</strong></span></span></span></p>
<p style="text-align:justify;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><em><strong>God gave His son 2,000 years ago to die on the cross. Much like the auctioneer, His message today is: &#8216;The son, the son, who&#8217;ll take the son?&#8217;</strong></em></span></span></span></p>
<p style="text-align:center;"><span style="color:#00045d;"><span style="font-family:Palatino, serif;"><span style="font-size:medium;"><em><strong>Because, you see, whoever takes the Son gets everything.</strong></em></span></span></span></p>

<li>Photos and readings from the <a href="http://www.cbc.ca/arts/books/story/2009/11/25/harbourfront-archives.html?ref=rss">Harbourfront reading series to be archived</a>.</li>

<p>A nude photo of director Roman Polanski with actress Sharon Tate will be sold at auction in early December.</p>
<p>According to Agerpres, the large print, made in 1969 by photographer David Bailey, shows the director and his wife embracing, with only a few months before she was killed by members of Charles Manson cult, in Los Angeles.</p>
<p>The auction will take place on December 7 in New York and the organizers hope that the amount offered by the buyer to reach 15,000 dollars. Roman Polanski is currently in detention in Switzerland, following an arrest warrant issued by the U.S. for sexual intercourse with a minor.</p>

<p>Of all the glum news occurring lately about companies laying off employees along with uncertain economic times of employment &#8211; including mine &#8211; is awesome to see this news. Especially since Ericsson&#8217;s mobile partnership with Sony; Sony Ericsson laying off employees and closing offices in 3 United States.</p>
<p>Being a successful bidder in the auction of Nortel&#8217;s North American GSM/GSM-R business gives Ericsson contracts with AT&#38;T &#38; T-Mobile USA. This means not only will T-Mobile USA get to expidite their 3G deployment, or AT&#38;T finally getting proper 3G/HSPA deployment and better bandwidth for a horribly congested network, but adding 350 employees!</p>
<p>Not too long ago many pensioners from Nortel faced off against Parlament here in Toronto, Ontario. I&#8217;m unsure of the outcome considering the following but it may shift a hand in these pensioners coming closure to a better retirement.</p>

The residual side affect of this deal &#8211; if approval from regulatory bodies allows &#8211; means possible SonyEricsson handsets being able to use decent mobile chipsets from Ericsson, not to mention many of the competition.</p>

<p>A PAINTING by renowned artist <a href="http://en.wikipedia.org/wiki/L._S._Lowry">LS Lowry</a> thought to be worth more than £100,000 is to go under the hammer next week.</p>
<p>‘Barges on a Manchester Canal’ could fetch well over the estimated price when it appears at auction at Edinburgh’s <a href="http://www.lyonandturnbull.com/">Lyon &#38; Turnbull</a> on 2 December.</p>
<p>The distinctive works of the Lancashire-born painter &#8211; known for his famous depictions of Glasgow’s docks – have been sold for several times the estimated price in the past.</p>
<p>His painting of The Liver Building went for £1million in 2006 – double the expected price.</p>
<p>While Cranes and Ships, a 1947 painting of Glasgow’s Prince’s Dock, was bought by the city’s council for £200,000 in 2006.<!--more-->Nick Curnow, paintings specialist at Lyon &#38; Turnbull described the piece as a “marvellous example of Lowry’s work.”</p>
<p>He said: “The painting doesn’t have figures in it, and that’s obviously something that people like to see, those famous matchstick men.</p>
<p>“But it’s still wonderful in its own right, and it shows the isolation that Lowry felt.</p>
<p>“It’s a slow burner, but you really grow to appreciate it.”</p>
<p>Lowry famously led a humble life as a cashier for the Pall Mall Company, while taking evening classes in art.</p>
<p>He was famous for drawing characters as ‘matchstick men’ as well as for his works of industrial northern towns, docks, and the sea.</p>
<p>Burberry designer Christopher Bailey drew influences from Lowry’s work for last winter’s collection, while Lowry-style animation has also been used for the Oasis music video The Masterplan.</p>
