I also think he really put his foot in his mouth when he suggested that he had investigators in Hawaii checking out information about the POTUS.

My guess is that he is being led by the nose by famed birther and former “swift boat” creator, Jerome Corsi.

It’s highly unlikely that Trump would really end up doing this well as an independent, but even if he just pulled 5-10% it would probably be enough to ensure Obama’s reelection. And these numbers show that if Romney’s the GOP nominee there may be enough consternation on the far right that another third party candidate and not necessarily just Trump could earn enough support from those voters to have a spoiler effect much as Ralph Nader did for Al Gore in 2000. 

Is he that serious? One fears he may be. Or if one is a Democrat, perhaps a licking of the lips is in order. But you never know. This is America. Right-wing populism has its moments. They rarely last; but they often shine brilliantly in the meantime.

When one recalls that Charlie Sheen has always been a “9/11 Truther” this revelation comes as no surprise.

During Charlie Sheen’s Tuesday performance at Washington, D.C.’s DAR Constitution Hall, the actor-turned-sideshow confessed that he’s one of those who are unconvinced of President Barack Obama’s citizenship. 

Sheen cited a Huffington Post presidential poll that, he said, “had me annihilating that lunatic from Alaska,” former Gov. Sarah Palin. 

Other polls, said Sheen, “had me beating our president.”

“Is that the craziest f— idea ever?” Sheen asked the friendly crowd, who cheered in support of a potential presidential bid by the longtime (and recently deposed) star of “Two and a Half Men.”

“For starters, I was f—king born here, how about that? And I got proof! Nothing photoshopped about my birth certificate.”

“I know I promised this wouldn’t be political, but look where we f— are, man!”

In a town accustomed to stuffy black-tie events, Sheen’s show was as out of place as things get in Washington. Case in point: The opening line, provided by local DJ Tommy Griffiths. He said, “How many goddesses do we have out there? Any warlocks? How many trolls?” 

Griffiths helped get the show off to a disastrous start, as his sleep-inducing and awkward interview of Sheen prompted audience members to heckle him relentlessly. In fact, the ticket-holders seemed to feel perfectly comfortable shouting anything and everything from their seats, however profane, sexist or juvenile. 

Sheen seemed to sense how quickly the show was devolving, and he took a break and subsequently relieved Griffiths of his duties. Comedian Jeffrey Ross took his place and provided the night’s only genuinely funny moments with his roast of Sheen. Ross said, “Just when I thought Washington, D.C., couldn’t be any slimier, the Violent Torpedo of Truth tour rolls in.” He asked Sheen, “Why don’t you go visit the White House, which is also the nickname for your nostrils?” 

Although Sheen tends to talk more warlocks and goddesses than congressmen and senators these days, the locale brought out the wonk in him.

Orange County Republican party official Marilyn Davenport has sort-of apologized for sending out a racist picture of President Obama depicting him as a chimp being held by his chimp parents: “I’m sorry if my email offended anyone. I simply found it amusing regarding the character of Obama and all the questions surrounding his origin of birth.”

She added: “Again, for those select few who might be truly offended by viewing a copy of an email I sent to a select list of friends and acquaintances, unlike the liberal left when they do the same, I offer my sincere apologies to you–the email was not meant for you.”

Davenport’s message came after the OC Weekly obtained a copy of an e-mail on Friday with a picture of the President photoshopped onto a baby chimp that’s being held by two adult chimps. “Now you know why no birth certificate,” the picture says.

Here’s Davenport’s full apology e-mail from Saturday — it’s definitely worth a read:

I’m sorry if my email offended anyone. I simply found it amusing regarding the character of Obama and all the questions surrounding his origin of birth. In no way did I even consider the fact he’s half black when I sent out the email. In fact, the thought never entered my mind until one or two other people tried to make this about race. We all know a double standard applies regarding this president. I received plenty of emails about George Bush that I didn’t particularly like yet there was no ‘cry’ in the media about them. One only has to go to Youtube or Google Images to see a plethora or lampooning videos and pictures of Obama, Bush and other politicians. That being said, I will NOT resign my central committee position over this matter that the average person knows and agrees is much to do about nothing. Again, for those select few who might be truly offended by viewing a copy of an email I sent to a select list of friends and acquaintances, unlike the liberal left when they do the same, I offer my sincere apologies to you–the email was not meant for you. For any of my friends or acquaintances who were the recipients of my email and were truly offended, please call me so I may offer a sincere verbal apology to you.

Calling it “a bridge too far,” Arizona Gov. Jan Brewer on Monday vetoed the state legislature’s controversial “birther bill” and also rejected a bill that would have permitted guns on college campuses.

The Republican governor said the birther bill would have created “significant new problems while failing to do anything constructive for Arizona” and that she had no choice but to nix the legislation, which would have required presidential candidates to provide their birth certificates or other documentation proving that they were born in the United States.

In a letter explaining her veto to the House speaker, Brewer said she could not support legislation that “could lead to arbitrary or politically motivated decisions” about candidates’ eligibility for the presidential race, since Arizona’s secretary of state would be the single person to ultimately decide whether a hopeful’s documentation met the state’s standards.

“I never imagined being presented with a bill that could require candidates for president of the greatest and most powerful nation on earth to submit their ‘early baptismal or circumcision certificates’ among other records to the Arizona secretary of state,” she said in the letter. “This is a bridge too far.”

 The truth behind the rhetoric

A common complaint by politicians is that they are misquoted by the media. Donald Trump, the tycoon-and-possible-presidential candidate, is not yet a politician, but he’s come up with a new grievance: No one asked for my side of the story.

We were reading an article about Trump in the New York Observer in which he once again claimed that Obama has not fessed up to the truth about his birth certificate. The article said:

“I’m amazed that the press gives him such a free ride on that,” he said. When told that the Washington Post fact-checked many of his claims on this issue and found them to be inaccurate, Trump held his ground. 

He said the paper should have called him for [his] side of the story. 

The Facts 

Hmm, we thought we did call him. In fact, didn’t we quote him in the column, which looked into his assertion (and also Sarah Palin’s claim) that Obama has spent $2 million covering up questions about his birth certificate?

On Monday, we actually contacted two people who work for Trump: Michael Cohen, a spokesman, and Rhona Graff, vice president and assistant to the president (Trump) of the Trump Organization. We asked both the same basic question: “Donald Trump says that Obama has spent more than $2 millions on legal fees on the birth certificate issue. Where does he get that figure from?”

Cohen never responded. However, Graff sent us an e-mail at 5:06 p.m. which said this:

Hi Glenn: 

Below is Mr. Trump’s response to your question. 

“It is well known in legal circles that this is the kind of time they are spending on the issue. Isn’t it a shame when all he has to do is produce his birth certificate, which he has not done.”

That’s the quote that was used in the article. Obviously, if he had wanted to get on the phone, that would have been preferable. But he chose to give us a statement through an assistant. 

 

The Pinnochio Test 

Arguing with Donald Trump about the truth is obviously a fool’s errand. He will say what he wants, even if it is easily proven false.

In a Friday appearance on CNN’s John King USA, Birther queen Orly Taitz rolled over the eponymous host, and beleaguered guest Cornell Belcher, like that boulder in Raiders of the Lost Ark. Taitz emptied clip after clip of false and unsubstantiated claims at a helpless John King, but just when all seemed lost, King  fought back with his own daisy-cutter of crazy, suggesting that President Obama has been rebutting Birthers in code.

There are probably many who wonder why CNN would choose to give twelve minutes of airtime to the widely discredited Orly Taitz. While most of Taitz’s wild claims have been disposed of here and elsewhere, Donald Trump has certainly proven that Birthers are good for business, media-wise.

It also seems as though John King thinks he is going to be the one to spring that one special logic trap that’s going to make Taitz & Co. spring up from their pews, cleansed of the demons, the Holy Spirit of sanity in their feet. Taitz comically disposes of that notion in a Kenyan minute, and leaves King huddled at her feet, covered in Birther pea soup. Belcher tries valiantly to cut in, but is met only with Taitz’s Dueling Birther Banjo.

The controversy over the circumstances of President Obama’s birth has erupted once again, courtesy of Donald Trump’s sudden desire to test the presidential waters. He has appeared on numerous television shows and written a letter to the editor of the New York Times, spouting all sorts of Four-Pinocchio innuendo that had long ago been debunked by my colleagues at PolitiFact and FactCheck.org. Their fine work does not need to be repeated, and below we provide links to their articles to address many of the issues Trump has raised.

The charge that Obama has spent $2 million to keep this issue quiet is a relatively new one. (Trump has also said Obama spent “millions of dollars trying to get away from this.”) Sarah Palin also echoed the claim over the weekend when she congratulated Trump for hiring investigators to look into this issue.

(Note to the former governor: The Fact Checker dealt with The Donald in a previous life as a financial reporter for New York Newsday. We wouldn’t bet he has actually hired anyone unless he presented us with the canceled check.)

Let’s examine this latest claim about Obama and his circumstances of his birth…

The Facts

Barack Hussein Obama II was born on Aug. 4, 1961, at 7:24 p.m. in Honolulu. His parents were Stanley Ann Dunham and Barack Hussein Obama. The birth was reported by the state’s two main newspapers about a week or so later, based on information received from the State Department of Health, as thus: “Mr. and Mrs. Barack H. Obama, 6085 Kalanianaole Highway, son, Aug. 4.”

The above information is extremely controversial to some people, though it requires a highly imagined sense of conspiracy to believe fake birth notices would be placed in newspapers decades ago on the extremely unlikely possibility that the baby would become president of the United States.

Although the Obama presidential campaign posted on its Web site a copy of the birth certificate that would be good enough for him to get a passport (it includes an embosed seal and official signature), the myth persists that he has never produced the actual birth certificate — i.e., the original document held in the state’s files. Generally, however, you don’t get that kind of document when you request a copy of your birth certificate, since birth certificates evolve over time.

A state official has stated that such a document exists, and Obama appears to believe that there is no need to give in to conspiracy theorists by requesting its release. (A more cynical view might be that the president thinks the controversy helps rev up his base and has the added benefit of tying the Republican Party to an extreme right-wing fringe that would never be satisfied with any document that was released.)

Other ‘Birther’ myths debunked

In his letter to the New York Times, Trump raised other questions that have already been answered by either PolitiCact or FactCheck.org. The New York Times did not provide an annotated guide to this hooey, so here are the relevant links. 

“His grandmother from Kenya stated, on tape, that he was born in Kenya and she was there to watch the birth.” False: On the tape, there was initial misunderstanding but then she said he was born in Hawaii. 

“His family in Honolulu is fighting over which hospital in Hawaii he was born in — they just don’t know.” Another myth with no basis in fact. 

“He has not been able to produce a ‘birth certificate’ but merely a totally unsigned ‘certificate of live birth’ — which is totally different and of very little significance.” Wrong: It is signed and has full legal significance. 

“There are no records in Hawaii that a Barack Hussein Obama was born there.” Wrong again, there is plenty of evidence. 

“As far as the two notices placed in newspapers, many things could have happened, but some feel the grandparents put an ad in order to show that he was a citizen of the U.S.” Oops, the information was provided by the State Department of Health — not the grandparents.

Jon Stewart sized up some of the “crazy” Republican candidates, quickly taking down Rick Santorum and Michele Bachmann before setting his comedic crosshairs on the “odd-headed reality show star” Donald Trump. After playing a clip of Trump questioning President Obama’s birth certificate, Stewart yelled in response, “his mother was American you fu*kwad!”

Stewart realized the Republicans have at least one plausible candidate in Mitt Romney, or as Stewart referred to him, “Captain Buzzkill.” Romney received some light comedic jabs from Stewart, but also a warning. Stewart advised, “you’re competing with crazy people Mitt. I’m a competent businessman is not going to cut through.” Instead, Stewart suggested that Trump’s “crazy” talk is just the type of “candy” that Romney might have to utilize so that he doesn’t fade from the media spotlight.

A lot of the times we miss out on the latest and greatest Barack Obama conspiracy theories that aren’t being promoted by legitimate presidential candidates. This is especially true ever since I started blocking emails from my aunt who was positive that Obama held a “Pimps and Ho’s Party” at the White House (Sorry, Aunt Becky. If you’re hosting Christmas this year, you’re gonna have to call me by phone about it). Anyway, thank goodness for Wonkette picking up on this article from The Daily Mail. You’d think we’d be annoyed at the British tabloid printing unsubstantiated rumors about our president, but how else would we know about Obama’s sinister brain surgery scars! Now that’s an awesome conspiracy.

The Daily Mail piece collects some theories from bloggers who noticed an odd pattern in Obama’s hair in pictures of he and George Lopez. Not content to ask the obvious questions (when and why Obama was hanging with George Lopez in the first place?), the bloggers dug deeper and realized that the hair pattern was clearly a scar from brain surgery.

“Ben Hart, a blogger for Escape The Tyranny a website which presents itself as a Social Network & Forum For Conservatives, said: ‘Obama’s almost done with his first term, and we still know almost nothing about the background of the President of the United States.

‘Whatever happened to create that scar, it was clearly something serious. Was it a brain operation? Has it affected his thinking?

‘No one is allowed to see his birth certificate. He is just one big mystery man, which adds intrigue to what that huge scar is all about.’

He also said that surgery might explain why the President gets lost speaking without a teleprompter, and posted a video of Obama struggling through a speech, repeating his words and getting lost mid-sentence.”

My first question was why the most powerful man in the world couldn’t get his hands on a surgeon who wouldn’t leave noticeable scars. But then I realized Obama probably used some cheap surgeon…in Kenya!

I had some more questions but, unfortunately, I got distracted by The Daily Mail’s photos of Christine Hendricks in a nightie. Hopefully some legitimate, real, totally serious presidential candidate will pick up this story and talk about it on every news show ever for three weeks straight so that I can learn more.

World Net Daily‘s Jack Cashill, best known for claiming that Bill Ayers ghost-authored Obama’s book, is promoting a new conspiracy theory. Cashill says that the picture on the left, of Obama with his grandparents, is a forgery. Unfortunately for Cashill, what he describes as the original photograph (right) still contains the president’s knee. Pareene bait:

What was Barack Obama’s knee doing in New York, while the rest of him was in Pakistan, and Indonesia? Dealing drugs? Why are mainstream journalists afraid to ask tough questions about the president’s detachable knee? The people have a right to know!

No one can possibly take Donald Trump’s alleged candidacy seriously when there are several issues facing this country that could in fact be directly attributed to President Obama.  Instead Trump decides to go on his “birther” circuit across the networks and continue to look like a clown.  He is obviously not running for the Presidency because the topic he chose to exploit the president over is a non sequitur in the 2012 Campaign world.

Essentially one can deduce that the Republican party has now embraced “birtherism”.

Mike Huckabee supposedly “misspoke” when he said Barack Obama grew up in Kenya. The potential 2012 candidate and other Obama bashers need to accept that the president was born in the U.S. and is Christian—and try to beat him with ideas, argues Mark McKinnon.

Mike Huckabee has really stepped in it. I only wish I could believe it was entirely accidental. But, boy, there sure is a lot on his shoes. People like Mike Huckabee. I like Mike Huckabee. Or, I did anyway. But just because he can be charming and self-effacing doesn’t mean we should excuse him from appropriate standards of conduct and character assassination.

Huckabee said in an interview this week that President Obama grew up in Kenya. His spokesman tried to mop up by suggesting he misspoke and meant to say he grew up in Indonesia, which in itself is a vast overstatement and misleading. The problem is that Huckabee talked in the same breath about the Mau Mau Revolution, which happened in Kenya.

Here’s what I think. I doubt most Americans have a clue about the Mau Mau Revolution, including me. But, I’m pretty sure for most folks it sounds like something extremely foreign, vaguely socialist, anti-Christian or at the very least un-American. And unfortunately, whether it was overt or not, I think that Huckabee’s intent was to further sow the seeds that Obama is somehow “not really one of us…he’s one of them.” Take your pick and use your imagination about who “them” might be.    Continue reading…

Georgia is the latest state to propose legislation that questions whether President Barack Obama was born in the U.S., joining 10 other states who have measures that want more proof before his name is put on the 2012 ballot.

Even though Hawaii officials have repeatedly confirmed Obama’s citizenship, his birth certificate has been made public and courts have rebuffed challenges, the so-called “birther” issue hasn’t gone away.

Georgia Rep. Mark Hatfield, a Republican, said he still doesn’t know if Obama is eligible to serve as president, and 92 of his GOP colleagues and one Democrat support the bill introduced Monday.

“Most people feel it’s an issue to a significant enough portion of our population that it needs to be addressed by the state,” Hatfield said. “It is, in a sense, a response to … the sitting president and his inability or unwillingness to release his original birth certificate.”

So-called “birthers” have contended since 2008 that Obama is ineligible to be president. They argue he was actually born in Kenya, his father’s homeland. They have also not been satisfied with the “Certification of Live Birth” Obama has released, which is a digital document.

Hatfield’s bill would require a certified copy of Obama’s original birth certificate be provided.

University of Georgia political scientist Charles Bullock said the issue was likely more about politics.

“It could be that this individual really does doubt that Barack Obama was born in this country, despite evidence to the contrary,” he said. “There are also people who think we have never sent astronauts to the moon. Or, the legislator may not have any real qualms, but figures this may play very well with his constituency in the district back home.”

A handful of states, including Georgia, have proposed similar bills since Obama was elected, but five more states joined them during the current legislative session.          Continue reading here…

On Sunday Morning’s The Chris Matthews Show, panelist Cynthia Tucker of the Atlanta Journal Constitution may have coined a phrase that will help to define the 2012 Republican presidential field. Speaking about the unlikelihood of a run by Gov. Chris Christie (R-NJ), Tucker said that the rising GOP star would be unwilling to pay the Republican “crazy tax” of pandering to the likes of the “Birthers” (and their Pied Dog-whistlers like Michele Bachmann and Sarah Palin), and denying science. Ozzy Osborne, we’ve got the DNC on line 1.

Despite the fact that Christie has said, over and over again, that he will not run in 2012, the energy around the NJ Governor has proven irresistible to pundits. The Matthews panel (guest-hosted by Nora O’Donnell) ticks off several great reasons to believe Christie won’t run, before Tucker delivers her gem:

I don’t know if Tucker is the first to use the phrase, but it is whip-smart, elegant, and more bumper sticker-friendly than Whip ‘em Out Wednesday. The difference, of course, is that the “crazy tax” exposes things about Republicans that most voters won’t find all that attractive.

Thanks to Gov. Neil Abercrombie (D-HI), the “birther” issue is, once again, alive and kicking, but even absent Abercrombie’s efforts, there’s an ugly, racially-tinged conspiracy subculture among Obama opponents (beginning with Hillary Clinton) that has continued to strengthen since the President took office. Many who don’t believe the “birther” garbage are a little more open to the idea that he’s a “secret Muslim,” and those who reject both of those “theories” still see resonance in their overall theme that President Obama “just ain’t one of us,” is not a product of the “real America” that Sarah Palin spoke of during the 2008 campaign.

Unfortunately, the rest of America has grown tired of these attacks, which is why Bill O’Reilly became so incensed at David Gregory for daring to ask House Speaker John Boehner (R-Ohio) to denounce them. His failure (and the failures of Eric Cantor, Michele Bachmann, and soon, every other GOP hopeful) to do so  makes them look crazy.

O’Reilly, to his credit, strongly dismisses the idea that the President is some kind of Indo-Kenyan Manchurian Secret Muslim, but fails to recognize why it’s a big deal that Republican leaders will not. As Robert Gibbs pointed out, the President himself has demonstrated a willingness to do the same when the shoe was on John McCain’s foot.

Going into 2012, Republicans are going to have to decide if keeping the “Birthers” and their spiritual brethren happy is worth alienating independents and conservative Democrats who not only want this crazy talk rejected, but who will question the judgment of those who don’t. If team Obama is smart, they’ll also highlight the contrast between the “un-American” rhetoric, and the high marks the President gets for protecting the US from Al Qaeda.

You can believe that the President is an un-American, secret Muslim sleeper, and you’ll look crazy, or you can believe that he’s killing too damn many terrorists, and look idiotic, but if you try to say you believe both…well, time to put the lotion in the basket.

a)  The people who were required to see the documents, have seen them.  End of story.  The President issued his birth certificate and there is no need to cater further to the lunatic fringe of the Republican party.  By the way, it’s getting increasingly more difficult to refer to the kooks on the right as being part of a ‘fringe’.  The right-wing fringe has gone mainstream.

b)  If this was a “White House strategy”, it’s a damn good one. Birthers are conservatives and Republicans and voters should be reminded of this fact at every opportunity. They were not created by Dems but instead emerged from the bigoted, idiot wing of the Republican party.  Birthers are conservatives who are unwilling to accept a black man as their President.

Sorry Karl, but these idiots are part of the folks you counted on to vote for George W. Bush.  You loved them then.  You’re stuck with them now.

Chris Matthews welcomed two frequent guests to Hardball, Salon’s Joan Walsh and Washington Post’s Eugene Robinson to discuss some controversial Republican stories ranging from Governor Haley Barbour refusing to denounce license plates that honor the KKK’s founder to Speaker of the House John Boehner refusing to tell Americans whether or not they should believe President Obama is a Muslim. Somehow Republican Congresswoman Michele Bachmann snuck into the conversation too, with Matthews finally just concluding that Republicans are a “party of crazy people.”

Walsh found it peculiar that Boehner “makes his living telling Americans what to believe” on issues like the economy, yet demonstrates a cowardice to stand up to the half of his base that still believes Obama is a Muslim. Walsh warned that Republicans are playing with “racist fire.” Matthews admitted he was having fun discussing the “new group of crazy people” taking over the Republican party, but worried that establishment Republicans soon might not recognize their party anymore. Matthews concluded, “I think it’s a crazy coalition . . . all these guys from main street who run a little business [are going to] realize they are in a party of crazy people.”

The Supreme Court has rejected an appeal from a lawyer who has been in the forefront of the challenge to President Barack Obama’s citizenship.

The high court on Monday did not comment in refusing to hear the appeal filed by California lawyer and dentist Orly Taitz. She was contesting a $20,000 fine for filing what a federal judge determined was a frivolous lawsuit.

The suit was filed on behalf of Army Capt. Connie Rhodes, who sought to avoid deployment to Iraq by claiming Obama wasn’t born in the United States and thus, is ineligible to be president and commander in chief.

WASHINGTON — House Republicans’ reading of the Constitution was interrupted Thursday by a woman who shouted “except Obama, except Obama” to the venerable document’s words on a U.S. citizen’s eligibility to be president.

Boehner addresses birthers

Just as Rep. Frank Pallone, D-N.J., was reading “no person, except a natural-born citizen, or a citizen of the United States” is eligible for the presidency, a woman in the visitor’s gallery yelled out that it did not apply to President Barack Obama.

Rep. Mike Simpson, R-Idaho, who was presiding over the House, banged the gavel and halted the proceedings, warning that such action from members of the public was a violation of House rules. The woman was quickly removed by Capitol police.

Lawmakers took turns reciting each verse and article of the document. Republicans in charge of the chamber rattled it off with missionary zeal, as if in a school civics class. Democrats pitched in, but with seemingly less ardor.

Historians said it was the first time the 222-year-old governing document had been read in its entirety on the House floor.

‘Birthers’ question Obama’s eligibility
So-called “birthers” claim Obama is ineligible to be president because they say there’s no proof he was born in the United States, with many of the skeptics questioning whether he was actually born in Kenya — his father’s home country.

The Obama campaign issued a certificate of live birth in 2008, an official document from Hawaii showing the president’s birth date, city and name, along with his parents’ names and races. The certificate doesn’t list the name of the hospital where he was born or the physician who delivered him, information collected by the state as part of its vital records. Hawaii’s health director said last year and in 2008 that she had seen and verified Obama’s original vital records.    More…

Chris Matthews waded into the birther controversy on his Monday show, wondering why President Obama has not demanded a copy of his full birth certificate to put the conspiracy theories about his birth to rest.

Speaking to reporters Clarence Page and David Corn, Matthews addressed the recent efforts by Hawaii Governor Neil Abercrombie to be able to release more information about Obama’s birth.

“I am not a birther, I am an enemy of the birthers,” Matthews assured Page and Corn, before comparing a so-called “long form” birth certificate to the more abridged copy that Obama has released. “Why has the president himself not demanded that they put out the initial documents?” he asked.

Page said there was no point in Obama engaging birthers, because they were not interested in evidence showing that he is a natural-born citizen. Matthews responded that, no matter what, it will be interesting to see if Abercrombie’s quest for the full document is successful.

“Don’t we want to know if he can find it?” he said. “I don’t know why the Governor doesn’t say, ‘snap it up, whoever is there in the Department of Records, send me a copy right now. And why doesn’t the president just say, ‘send me a copy right now’?”

In spite of the lower courts and the Supreme Court’s propensity to dismiss most “birther suits” as frivolous and without merit,  this is not going away any time soon…

The Supreme Court has again cast aside an appeal that raised doubts about President Barack Obama’s U.S. citizenship, a grass-roots legal issue that has gained little legal or political footing, but continues to persist in the courts.

The justices without comment Monday rejected a challenge from Charles Kerchner Jr., a Pennsylvania man who sought a trial in federal court forcing the president to produce documents regarding his birth and citizenship.

Kerchner’s attorney, Mario Apuzzo, had argued in a petition with the Supreme Court that Obama did not fit the definition of a “natural-born citizen” required for the nation’s highest office, as defined by Article II, Section 1 of the Constitution.

That clause states, “No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.”

Kerchner, a retired military officer who describes himself on his website as a “genetic genealogy pioneer,” argues the framers of the 1789 document intended a “natural-born” citizen to mean someone born in the U.S. to parents who were both American citizens.

A state appellate court in Sacramento tossed out a lawsuit claiming President Barack Obama is not eligible to occupy the White House because he is not a natural-born citizen of the United States. The court ordered the plaintiffs to pay all court costs of the defendants.

The lawsuit was filed shortly after the 2008 general election. The leading plaintiff (of three) was Alan Keyes, a former member of President Ronald Reagan’s administration from Maryland, and the 2008 American Independent Party candidate for president.

Keyes is a member of the so-called “birthers” movement. In his complaint, he claimed there is persuasive evidence Obama was born in what is now Kenya, which was then (1961) the British East African Protectorate of Zanzibar. He further claimed that President Obama would have automatically been a British citizen, based on his father’s citizenship, and ineligible for office.
