This week, the French government decided to adopt a”three strikes” policy against illegal file sharers on the  Internet. Effectively, it means that if you are caught illegally sharing music, you risk a large fine and a one year Internet ban. The law is soon to be adopted in UK, and there are signs that other European countries will follow with similar laws of their own.

On one hand, government action seems reasonable. Musicians and music companies spend significant time and energy creating and promoting new music. It seems unfair that, after all this hard work, the product of their efforts is subject to a free-for-all with no obvious flow of money back to the producers. There is a parallel here with common theft.  Arguments such as “the record companies make enough money, so a free copy of my own won’t make a difference” are equally applicable in the case of shoplifting, for instance.

On the other hand the Internet is totally unsuitable for a pay-per-copy model. It’s impossible to police without draconian measures that have impacts way beyond the stated intent of preventing piracy. From the viewpoint of the file sharers, it costs the music companies nothing to distribute their songs and the products are infinitely available, so the whole meaning of theft needs to be re-assessed in this new digital environment. There is also the argument that copyright restrictions greatly limit creativity in the digital realm, although this issue applies to many physical products also.

Personally, I don’t file share. I’m happy enough to get what music I want through iTunes without resorting to BitTorrent or Limewire. Call me a traditionalist, but the idea of having thousands of illegally obtained video and music titles clogging up my hard disk space is somewhat distasteful. If I like a piece of music, I’ll buy it, and I don’t have a problem with that.  However I can also understand the argument that, with the Internet, the world has changed. I think the idea of limitations being placed on personal usage of digital products (i.e. Digital Rights Management, or DRM) repulsive. I think there are serious issues with governments and private firms monitoring our Internet usage. I’m inclined to agree that a radical re-assessment of the whole business is necessary.

With the Internet, we seem to be moving into a world of openness, rather than protection. Openness implies sharing, collaboration, continuous improvement and mass-participation. Although it’s obvious that many traditional businesses are suffering in these circumstances, it’s not obvious to me why there would be a whole-scale business implosion over time. Indeed the Internet might well create new ways of generating wealth, through, for instance, extension of brand image and mind-share leading to greater demand for performances, merchandise and premium downloads.  The examples of Radiohead and Trent Reznor certainly point to some interesting ideas in this area.

I’m interested in your thoughts on this. Is file-sharing just a polite word for stealing or is it symptomatic of a changing world order? What are your thoughts about file-sharing and why you think it’s good or bad?

No he escrito ni dos frases y ya me estoy planteando qué hago aquí. Esto de las hormonas es horrible, estoy en uno de esos días en los que me pregunto a qué huelen las nubes (y cuanto arsénico se necesita para matar a un publicista -shum shum) y para ser sincera no se me ocurre nada sobre lo que escribir. Además, no malinterpretéis pero creo que no estoy a la altura. No soy sórdida, nisiquiera demasiado afilada y soy inevitablemente ñoña en ciertos temas. Quiero creer que si el Sr. Tenacioso me ha ofrecido un hueco es como contrapunto a su corrosividad y para darle un toque femenino y friki (a partes iguales) a este antro de perversión. Creo también que quiere sacar a relucir en mí esa parte malvada que todas las mujeres tenemos dentro y definitivamente ha elegido la mejor época para proponérmelo porque estoy un poco hasta los ovarios de todo. Así que, señoras, señores y demás seres asexuados, si me disculpan y una vez hechas las presentaciones, allá voy…

Antes de empezar quiero puntualizar algo, para que no os llevéis ideas equivocadas.

“Friki, friqui, frik, frikie o freaky (del inglés freak, extraño, extravagante, estrafalario, fanático), es un término coloquial, peyorativo en algunos casos, no aceptado actualmente por la Real Academia Española, usado para referirse al individuo de apariencia o comportamiento inusual, que se muestra interesado u obsesionado en un tema muy específico del que se considera fanático. Estos temas, conocidos como cultura friki, suelen estar centrados en la ciencia ficción, la fantasía, el manga, el anime, los videojuegos y la informática.”

No voy a hablaros sobre la vida sexual de los personajes que aparecen en programas como el Diario de Patricia ni en la sección de Cárdenas. Me niego. Os lo repito, no soy tan sórdida.

Os voy a hablar de esos seres tan entrañables llamados frikis (qué monos ellos) y sus costumbres de apareamiento. Estoy por realizar una campaña con el lema “Ponga un friki en su vida. Ponga un friki en su cama” y creo que tendría bastante tirón. Una vez descubiertas las virtudes sexuales del macho friki creo que nadie cambiaría a su frikitín por un tío normal. Podríamos hacernos de oro, chicos! Vosotros pillaríais y yo me iría a las Bahamas de vacaciones.

El frikismo te llevará alto.

Afortunadamente, o desafortunadamente, depende de por donde se mire, tengo y he tenido una vida sexual activa (ya sabéis, eso de que “en Euskadi no se folla” sólo se aplica a los vascos, no a las vascas) y puedo afirmar rotundamente que mis mejores experiencias sexuales las he tenido con frikis. Los frikis ponen todo su empeño, se esfuerzan, nos cogen con ganas y no nos sueltan, los frikis son agotadores. A pesar de su extraña afición por coleccionar muñequitos japoneses, ver series subtituladas y pasarse horas delante del ordenador, cuando consiques sacarles de su mundo y los metes entre tus sábanas no te arrepientes. Son imaginativos, apasionados y te preparan el desayuno al día siguiente, son un buen partido. Doy fe.

El problema con los frikis viene después. Y es doble problema porque por un lado son frikis y por el otro lado son hombres. Y no, no todos los hombres son iguales, los frikis son incluso peores. Con los hombres en general solemos tener el problema de las pelotas. No, esta vez no me refiero a que sean todos unos huevones, me refiero a los deportes televisados. Luchamos contra el fútbol (la Liga, la Copa, el Mundial, la Champions, los torneos de -los cojones- verano), la NBA, el tenis, la F1, el ciclismo y todo lo que incluya ver a otros hombres sudando detrás de una pelotita o peleando por ser el mejor en algo. Joder que si luchamos. Conozco casos verídicos de amigas en lencería, insinuaciones, toqueteos y metidas de mano que han finalizado con un “GOOOOL” o un “UY” cuando la susodicha creía que tenía todas las de ganar. No podemos luchar contra su naturaleza, podremos ganar alguna batallita en partidos aburridos pero normalmente acabaremos frustradas, excesivamente calientes y haciéndonos las uñas pensando en porqué coño no nos haríamos lesbianas.

En fin, volvamos a los frikis, los frikis no suelen, aunque se den casos, no suelen ser amantes de los deportes (gracias a Dios). Eso sí, si elegis a un friki tenéis que tener en cuenta que  a parte de a vosotras van a amar muchísimas otras cosas, y muchas de ellas por encima de vosotras. Aquí es donde es importante categorizar, clasificar, ordenar y buscar puntos débiles.

El otaku (o friki del manga/anime/cultura japonesa):

Lo siento mucho pero lo lleváis algo jodido. Nunca podréis competir con Rei Ayanami, con Lucy o con cualquiera de esas tías perfectas que aparecen en sus series manga o en sus pelis Hentai recién bajaditas de internet. Pero podéis luchar.

Consejo sórdido: A vosotras os parecerá ridículo pero un buen disfraz de su personaje favorito puede haceros recuperar su atención. Cuanta menos tela, mejor.

El gamer (o jugador de videojuegos, viciado y vicioso a shooters, mmorpgs y/o estrategia).

Éste es fácil de reconocer, normalmente se queda hasta las tantas haciendo innumerables clicks con el ratón disparando a muñequitos o construyendo cosas, mientras se ríe solo o suelta exabruptos del tipo “Qué cabrón”, “Maldito paquete”, o “Ese lleva cheto fijo”.

Este especimen es también más fácil de atormentar. Tenéis que elegir el momento, nunca durante partidos de clan o competiciones “oficiales” porque puede ocasionar una ruptura, pero con estos las distracciones del tipo lengua en la oreja (no os olvidéis de quitarles los cascos antes, si no no funcionará) o caricias en el brazo izquierdo (con el derecho están haciendo click al ratón) podréis lograr alejarle del pc o consola y que tras horas dandoos amor os haga soltar un “Impressive”. Si no lo conseguís siempre podéis jugar sucio.

Consejo sórdido: Contra los jugadores de consola os recomiendo que se produzca un “desafortunado y disimulado” apagón de electricidad en casa, se pasará un rato bastante enfadado consigo mismo por no haber guardado la partida pero enseguida será vuestro.
No hay nada peor para un gamer de ordenador que poner el emule mientras está jugando. Si no funciona optad por el Bittorrent. No podrán contra el lag.

El programador, el modder, el informático (o ese tío al que nunca le ha dado el Sol).

Yo tengo la teoría de que algún día los programadores se extinguirán (porque se reproducen más bien poco) y de que los informáticos de pura cepa digievolucionarán hasta convertirse en seres andróginos. Son la raza más dura del macho friki, puedes haberles secuestrado a una casa rural en medio de ninguna parte (sin cobertura en el móvil, sin internet, sin ordenador y casi sin electricidad) y ellos siguen programando en su cabeza o construyendo mentalmente un sistema de refrigreración líquida. No hay enemigo más difícil que un informático puro. Contra el programador hay pocas soluciones, o bien te quiere con locura y esa línea de código que le daba error es menos importante que tú o ya te puedes ir buscando un disfraz de Princesa Leia (situaciones desesperadas requieren medidas desesperadas). Un modder es como el de bricomanía pero en sexy, de esos que madrugan los domingos para construir cositas que no entiendes y que lo llenan todo de cachivaches, ventiladores y demás porquería informática. Y qué me decis del típico informático que se pasa la noche del viernes arreglándole el ordenador a su sobrino, o que le ves bajándose totalmente emocionado la nueva versión de Windows UE (o peor aún, una nueva distribución de Linux).

Consejo sórdido: Suerte, maja. Lo tienes crudo.

El friki de las series y el friki de la Ciencia Ficción (o también conocido como “Ese tio que se bajará cualquier serie que venga de USA y que está enamorado de un tal JJ Abrahams”)

O Ese tío que se sabe cómo va a acabar Perdidos, que conoce de memoria todas las habilidades de todos los personajes de Heroes o los nombres de las naves de Star Trek, Stargate, Star Wars o cualquier cosa que empiece con Star, que se mete en foros, que se lee libros de Isaac Asimov o G.R.R Martin, que cuando se reune con sus amigos discute sobre el último capítulo de “Cómo conocí a vuestra madre” o “Big Bang Theory” y que te tiene todas las noches de 40 minutos o  4 horas  (los fines de semana y en versión extendida) esperando a que termine de ver su serie o película rara favorita. Este es el más fácil de todos. Si no puedes con el enemigo, únete a él. Acabarás cogiéndole el gustillo al tema y además, sólo son 40 minutos por noche o como mucho uno o dos maratones al año con los amigotes tan frikis como él. La espera merecerá la pena.

Consejo sórdido: Niégate a ir a convenciones, acabarás hasta los ovarios de tanto friki.

El gran friki o el señor de todos los frikis.

Imagínate a un tío que le mola el anime, que se ve todas las series que caen en sus manos, colecciona figuritas, que trabaja como programador y encima es gamer. En este tipo de casos  vas a tener que trabajar duro, improvisar, engañar, chantajear y tirar de lencería.

Hay más tipos de frikis, de hecho creo que hay frikis de todos los tipos. Y no caigas en la leyenda urbana de que no hay frikis tíos buenos, los hay a montones. Seguro que se te ocurre algo para desviar su atención hacia ti, dale duro, merecerá la pena (sexo con frikis = sexo de calidad).

I am ver happy to see that. Since I was the one that talking th lisense processes not right. Eine systematische Überlegung dazu findet sich bei den “Bissigen Liberalen ohne Gnade“. Die lässt aber ausser Acht, wie die Musik- und Filmindustrie die Aktzeptanz solch illegaler Kopierens einschränken könnte: Durch Preissenkungen. Dafür gibt es auch schon einen empirischen Test: I-Tunes. “Raubkopien” gibt es spätestens seit der Erfindung der Musik- und Video-Cassette. Seit frühester Kindheit wurden die Platten von Freunden und Geschwistern auch Cassette kopiert und als ich als Bundeswehrsoldat 1983 im Zuge des NATO-Doppelbeschlusses dank einiger “Friedensbewegten” genötigt war, ein Wochenende im Bundesministerium der Verteidigung zu verbringen, hatte die dort versammelte Unteroffiziersschaft eien Armada von VHS-Recordern versammelt, mit denen sie ihr nicht jugendfreies heimisches Material gegenseitig kopierten. Da stellt sich doch die Frage, ob die Bundeswehr sich durch die Bereitstellung der Räume und des elektrischen Stroms nicht strafbar gemacht hat?

Und zum zweiten stellt sich die Frage nach dem Schaden, der der Unterhaltungsindustrie entstanden sein mag. Hier wird üblicherweise der Kaufpreis der Raubkopien addiert und so entstehen im Internet-Zeitalter horrende Milliardenbeträge. Es ist allerdings zweifelhaft, ob alle Raubkopierer den Content, den sie stehlen, auch bezahlen würden oder gar könnten. Ersteres tun sie nicht, wenn ihnen der Kaufpreis unangemessen hoch erscheint und zweiteres dürfte bei den ungeheuren Mengen, die über solche virtuellen Tauschbörsen verteilt werden, unwahrscheinlich sein. 

Der tatsächliche Schaden für Film- und Musikindustrie dürfte also weitaus geringer liegen als vermutet, aber ein Schaden und eine Enschränkung der eigenen Verfügungsrechte ist es schon. Auch wenn mir bei der alltäglichen Bouelvard-Berichterstattung etwa über Madonnas neuen Stadtpalais in Manhattan mit 26 Zimmern nicht gleich die Tränen kommen. 

Immerhin ist die Musikindustrie in den vergangenen zehn Jahren in die Krise geraten. Und Apple verdient wohl auch kein Geld mit dem Verkauf im I-Tunes-Store, sondern mit dem Verkauf von I-Pods. Als ich mich vor zwei Jahren für die Auflegung enes legalen Stores interessierte, stellte sich schnell heraus, dass das auf Geldtauschen heraus gekommen wäre: Von den 99 Cent pro Song mt denen man konkurrenzfähig gewesen wäre, gingen über 70 für die Lizenzkosten und fast der ganze Rest für die Software und Server drauf. Für Vertrieb, Marketing und Gewinn wäre am Ende exakt ein Cent übrig geblieben. Das lässt man dann lieber. 

Mit juristischen Mitteln lässt sich das Problem nicht lösen. Aber mit niedrigeren Preisen ließe sich der Schaden mehr als nur begrenzen. So lassen sich bei zugegebenermassen sinkenden Margen auch in Zukunft ausreichend Inhalte produzieren.
