<content:encoded><![CDATA[<div class='snap_preview'><p><img class="alignleft size-medium wp-image-288" title="kiosk" src="http://digitaldesignyork.wordpress.com/files/2009/12/kiosk.jpg?w=136" alt="" width="136" height="300" />For my interactive product design project I will be creating an interactive product to meet the needs of a specificly chosen target audience.  I will need to consider who this design is for and what is my frame of reference.  I will first start off this project by having a few design ideas and sketches that show my initial ideas so I can then use these to show my working methods throughout the designing process.</p>
<p>One of the things I have just been looking at today is the interactive kiosk. As we have one of these in college I thought that it would be a good place to start my research as I do have access to use one of these in my work. Basically the device is a computer and it links up at the moment through usb device. This allows us to create and upload things that we have made in flash so we can see them on the screen. An example of when this has been used is in York. The screens are used so you can purchase tickets ect! also this is used for maps an things so tourists when visiting will be able to get information easily.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Ok today Miia Fohlin(Marketing Manager of Fonecta) who talked about planning and assessing marketing communication campaigns with us. This was so interesting. We actually had to do stuff ourselves like creating a brief. I have never done that before and therefor this was very exciting. A brief is a detailed written  assignment that enables the advertising/media agencies to actually plan a marketing campaign with which the marketing objectives can be reached. It was also very interesting to hear that 70% nof the budget  you spend on planning communication goes actually to media only. I always thought it would be way less. But now when I think about it, it seems very reasonable because the media is everything that is seen(by other parties) so a lot of money actually should flow on there.</p>
<p>Phase 2 of communication campaigns is all about the production plan(which is clear to me) and also Pre-testing. Ok, to be honest I kinda expected something like that. Of course u have to test it if you &#8216;re using a new concept and things like that but I did not know that it can take up to 2 weeks. This is a long time and for that reason it is not very surprising that a lot of advertising agencies don&#8217;t like the idea of pre-testing.(or actually it was surprising or I expected something like that but still very informative to find out!)</p>
<p>It was very intersting to listen to Miia explaining phase 2. Never thought how many details you have to keep in mind when you are actually producing the TV spot or something like that. A lot of spots are shot in South Africa for example and when you are shooting a Finnish commercial you actually have to make sure that everything&#8230;from the pavement on the streets to the clothes and hairstyles the people/models are wearing are looking Finnish enough so the viewer will believe the message of the spot.</p>
<p>The last thing that was intersing is phase 4&#8230;the follow up. Never even thought of the fact that you actually have to somehow measure how succesful your campaign actually was. This is actually very clever because when asking the consumers directly you will get the best feedback on how and what to improve for next time so yor campaigns are successful!</p>
<p>Phase 3 is all about campaigning. Here it was very intersting to hear how important internal commnication is in a company. It is very important to launch the campaign internally first before you launch it and it appears in the media so the people inside the company know what is going on. This also keeps the people very motivated!</p>

<p>Sie haben durch Ihre engagierte Kritik entscheidende Anstöße dazu gegeben, dass die Bologna-Reform weiter entwickelt wird: Die Kultusministerkonferenz hat sich in ihrer Sitzung am 10. Dezember 2009 gemeinsam mit der Hochschulrektorenkonferenz auf Eckpunkte geeinigt, die zu einer entscheidenden Verbesserung der Studienbedingungen im Rahmen des Bachelor-Master-Studiensystems beitragen werden.</p>
<p>Zusammengefasst haben sich die Kultusministerkonferenz und die Hochschulrektorenkonferenz auf Folgendes verständigt:</p>
<ul>
<li> die Prüfungsbelastungen sollen reduziert werden, indem grundsätzlich nicht mehr als &#8220;eine Prüfung pro Modul&#8221; vorgesehenwird;</li>
</ul>
<ul>
<li> die Arbeitsbelastung für die Studierenden soll überprüft werden und auf ein realistisches und vertretbares Maß begrenzt werden;</li>
</ul>
<ul>
<li> die Anerkennung der Prüfungsleistungen zwischen den Hochschulen (national und international) wird vereinfacht, um Mobilität der Studierenden zu gewährleisten;</li>
</ul>
<ul>
<li> die Strukturvorgaben für die Bachelor- und Masterstudiengänge werden flexibilisiert und der Übergang vom Bachelor zum Master vereinfacht.</li>
</ul>
<p>Bisher sollten die Hochschulen neben dem ersten berufsqualifizierenden Hochschulabschluss weitere besondere Zugangsvoraussetzungen festlegen. Die Kultusministerkonferenz hat in ihrem Eckpunktepapier vorgesehen, dass diese sogenannte &#8220;Soll-Vorschrift&#8221; durch eine &#8220;Kann-Vorschrift&#8221; zu ersetzen ist.</p>
<p>Mir ist bewusst, dass die Betreuungssituation an den Hochschulen nicht in allen Studiengängen optimal ist. Zu oft muss in zu großen Gruppen studiert werden. Ich bin deshalb der Auffassung, dass die Gelder, die<br />
Brandenburg aus dem Hochschulpakt 2020 zur Verfügung stehen, konsequent zur Verbesserung der Betreuungsrelation &#8211; und damit zur Verbesserung der Qualität der Lehre &#8211; verwendet werden sollten. Die Hochschulen können aus diesen Mitteln für zusätzliches Personal sorgen.</p>
<p>Dem Landtag liegt ein Entschließungsantrag vor, der vorsieht, dass die Bologna-Reform gemeinsam mit den Betroffenen ausgewertet wird. Bereits im ersten Quartal 2010 wird die Landesregierung darstellen, an welchen Stellen zur Weiterentwicklung der Bologna-Prozesses Änderungen im<br />
Hochschulrecht  erforderlich sind.</p>
<p>Lassen Sie uns den konstruktiven Dialog fortsetzen. Zu diesem Zweck möchte ich gleich zu Beginn des neuen Jahres 2010 wieder das Gespräch mit Studierendenvertretern suchen und gemeinsam weiter an Lösungen für die Probleme im Zusammenhang mit dem Bologna-Prozess arbeiten.</p>

The audience that i&#8217;m aiming to target the product at will range from beginners who are just starting to play the flute to those which are more experienced. From producing the interface I would promise that it would be a very useful when playing the flute and at the same time exciting. It would bring a whole new dimension to playing the flute. It would not only be the interface design however but the use of technology which will make people interested in the product.<img class="alignleft size-medium wp-image-139" title="flute" src="http://digitaldesignyork.wordpress.com/files/2009/11/flute.png?w=300" alt="" width="300" height="224" /></p>
<p>The main thing which I am trying to bring across to people with this design is that playing the flute does not have to be boring.People always associate the flute as been used in only classical music or folk music. I want to try make the instrument be used in lots of other genres&#8230; so the main aim of my project is to get people more interested! and so they can see that they can actually play anything they want to. Not only this but i want to make it easier for people to learn to play. I would expect that my target audience would use this very often, especially when practicing to play. The device will also be used as a recording device so can be used as a way to directly record to your computer. An interface for this will also need to be designed so you can see the product on screen and what it is doing at the same time as you&#8217;re using it.</p>
<p>The main interface on the flute will have a touchscreen scroll device. It will be easy to use with a fairly basic structure. The structure of the interface will developed like a mobile phone and will have a main menu that everything branches from, the design will not only however just be on the flute, because this product is linked to augmented reality it will also have an interface design for the computer. The pack when bought will also come with a special screen to use with this so if you dont have a computer you can use that instead. The screen will be a completely new design but will link in with the one designed for the computer. It will work with both MAC and PC so that files of recordings ect will be able to be moved around freely and there will be no compatability isues with the software.</p>

which has 6 elements: The sun, which is the main source of energy<br />
for this cycle, the producer, the herbivore (or plant eater), the<br />
carnivore (or meat eater), the omnivore (eats plant and meat), and<br />
the decomposer (that decomposes or &#8216;breaks down&#8217; the waste).<br />
These are different species connected to each other through the<br />
food chain and the stamps illustrate that by using abstract versions<br />
of textures/patterns that have been screen-printed/lino-printed to<br />
make them as unique as the species themselves. The text supports<br />
the image and educates the user by stating a quick fact related to a<br />
very important subject.<br />

<p>This breaks my heart.</p>
<p>At a time when such technological innovations are breaking through centuries-old learning models, democratizing information and influencing a whole generation&#8217;s habits, it is struggling to stay afloat its operational requirements. I can&#8217;t believe it.</p>
<p>I was brainstorming names for new products at work and naturally was led to<a href="http://wikipedia.org" target="_blank"> Wikipedia</a>, and this 900 pixel wide message was their banner.</p>

<p>How. Does. An innovative idea. Not. Have. Any financial backing. Especially when the innovation from the previous model means:</p>

<li>lower operational and distribution costs</li>
<li>faster and deeper market diffusion</li>
<li>easier and higher usage levels</li>
</ul>
<p>HOW.</p>
<p>I don&#8217;t get it. I especially am wondering why no capitalist has invested on it yet, at a time when Google, Twitter and Facebook&#8217;s &#8220;real&#8221; values are being accepted already by credit markets.</p>

It&#8217;s hand in week this week so the tutors are basically on our backs stressing at us to get the work handed in. I hate hand-in weeks because it&#8217;s like the only week they seem to be bothered about you getting the work done and all in the short time of a few hours. I got quite a bit of work done today. Produced a simple logo for the Grange Arts along with a business card etc.</p>

<p>What do you think? I know it&#8217;s simple but I whipped it up in like an hour after trying a few logo ideas this was the best and most simple but effective. I won&#8217;t upload hi-res versions of these since I don&#8217;t want anyone claiming my work as there own. <img src='http://s.wordpress.com/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' />  I&#8217;ve had problems with people ripping my work in the past so I don&#8217;t need that hassle again.</p>
<p>I also produced a website. I&#8217;ll upload it when it&#8217;s pretty much finished being coded. It&#8217;s nothing special just a fan based site for the Dead Space video game. Our brief was to produce a simple web page based either on a band, video game or movie. So I chose Dead Space since at the time I was addicted to that game and still think it&#8217;s one of the best games I&#8217;ve played. Can&#8217;t fault it! If you haven&#8217;t tried it make sure you give it a spin sometime it will scare the living day lights out of you!! There&#8217;s been many times were it made me scream like a little girl haha.</p>
<p>Anyway that&#8217;s all for now, I shall blog again in a short while as I&#8217;m in a very talkative mood tonight!</p>

<p>1. <a href="http://adblockplus.org/en/">Adblock Plus</a></p>
<p>This easy to use add-on gets rid of all of the annoying ads across the Internet. Either a filter subscription, or a right click, and they will never show up again. Not only does it make the screen less busy and distracting, it frees up tons of RAM because your computer will no longer have to load the ads.</p>
<p>2. <a href="http://firefox.exxile.net/aios/">All-in-One Sidebar</a></p>
<p>Easily hidden on the left side of your screen, this powerful, flexible sidebar allows for easy access to your bookmarks, history, downloads, add-ons, source code and more. It&#8217;s easily customizable, it&#8217;s convenient, and it allows for more browser and toolbar space.</p>
<p>3. <a href="http://brief.mozdev.org/">Brief</a></p>
<p>Not loaded with useless features, and not bare-bones, this feed reading extension is perfect for compiling all of your RSS subscriptions. It&#8217;s light-weight, and easy to use.</p>
<p>4. <a href="http://downloadstatusbar.mozdev.org/">Download Statusbar</a></p>
<p>As the name says, this is a statusbar to manage your downloads. It&#8217;s only visible when in use, and it&#8217;s easy to customize so you only see what you want. Tons of useful features, despite it&#8217;s compact size.</p>
<p>5. <a href="https://addons.mozilla.org/en-US/firefox/addon/8049">GoogleTube</a></p>
<p>GoogleTube is a youtube player that you can access from your status bar, Yahoo, Bing, and of course, Google search results. It acts as an independent pop-out player, and is very useful in many situations. Want to search for a movie trailer? Google it and watch it right in your search results.</p>
<p>6. <a href="http://yellow5.us/firefox/osb/">Organize Status Bar</a></p>
<p>As all of these great add-ons start piling up, you&#8217;ll start to notice that most of them put their icons on your statusbar, and many don&#8217;t have an option to hide it. This add-on allows you to hide and rearrange these icons, to make room for the ones you really want.</p>
<p>7. <a href="http://readitlaterlist.com/">Read it Later</a></p>
<p>This add-on allows you to save pages to read them later. If there&#8217;s an article or page of any sort that you don&#8217;t have time to read, you just click the check mark icon and it will be added to your Read it Later list, accessible from an icon in the navigation bar, as well as from the previously mentioned All-in-One sidebar. This also helps keep your bookmarks from getting cluttered with something you&#8217;re only going to read once.</p>
<p>8. <a href="http://www.stumbleupon.com/aboutus/">StumbleUpon</a></p>
<p>StumbleUpon learns what you like, and suggests websites based on your interests. The more often you use it, the better it gets to know you. You just click the Stumble icon and a page pops up, based on questions you answer and websites that you &#8216;Like&#8217;. It&#8217;s an easy, fun way to discover and share great websites.</p>
<p>9. <a href="http://www.xmarks.com/about/features">Xmarks</a></p>
<p>Although it has many interesting features, like smarter search and easily accessible site information, it&#8217;s main use is to sync and backup your bookmarks. This allows you to sign in and access your bookmarks from any computer. If your computer crashes you can sync it with their server, and get them all back. It can also sync across browsers.</p>
<p>10. <a href="https://addons.mozilla.org/en-US/firefox/addon/6311">YouTube Cinema</a></p>
<p>Another YouTube add-on. This one allows you to maximize the size of the player, and black out the background to hide all of the distractions like the comments and similar videos. I also like that you can Ctrl click the link to view it normally.</p>

<title><![CDATA[Design Briefs: Don't Get Caught Without Them]]></title>

<description><![CDATA[Starting a project without a design brief is a bit like setting out on a long backpacking trip with ]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p>Starting a project without a <a href="http://janepell.wordpress.com/files/2009/12/allegro_logobrief.pdf">design brief</a> is a bit like setting out on a long backpacking trip with no map or compass&#8230;only worse. There&#8217;s really no harm in wandering aimlessly in the wilderness, especially if you have no destination in mind and there&#8217;s no fear of getting lost. (This might be called fine art.)</p>
<p>But daily, designers go into the wilderness without a map or compass (some of their own volition), often pressured to begin work without a sense of direction. While no-parameter design might sound like every <a title="Mick Jagger's design brief to Andy Warhol" href="http://www.made-in-england.org/rolling-stones-album-cover-brief">designer&#8217;s dream</a>, this approach sets the designer up for failure. (More benignly, a designer loses the satisfaction of doing effective work.) Even the most innovative, risk-taking client has specific goals to achieve and audiences to speak to. Rather than resist developing a clear direction, a client should feel lucky if the designer they hired is requiring a map to success.</p>
<p>Clear direction is a completed and thoughtful design brief. Clear direction is not &#8220;We want a logo that shows a person with their hand raised in the air. And we like red.&#8221; It also isn&#8217;t, &#8220;We&#8217;re an innovative software company.&#8221; In other words, broad enough direction that leaves room for the creativity you contracted for. And unique enough to foster ideas specific to <em>you</em>.</p>
<p>As designers, our frustration working without client direction might be tempered if we consider that clients don&#8217;t knowingly want to sabotage the process. The client contact has bosses to satisfy, budgets to mind, deadlines to meet—and sometimes egos to satisfy, not to mention hiring and managing a designer.</p>
<p>But there are two ironies here. Most often, a designer&#8217;s work can&#8217;t pass Go without a lot of tinkering by the client team (expected). And yet when it comes to design briefs, the much-needed background information that will<em> dictate</em> the design is not freely offered. The other irony is that there is not much inherent trust (expected) built into the design process, and yet clients&#8217; behavior regarding design briefs suggests there is a lot of trust.</p>
<p>Here are some possible reasons why.</p>
<p><strong>It is easier to comment on what already exists than shape what does not.</strong> <em>I don&#8217;t know what I want, but I&#8217;ll know I like it when I see it.</em></p>
<p><strong>Not understanding how the designer goes from point A to point B.</strong> Clients might wonder how exactly the designer will go from, <em>We want to be the leader in widgets, being recognized for our exceptionally unusual customer service,</em> to developing a cool-looking symbol. If a client can&#8217;t fathom the leaps, they may not want to bother gathering information. There&#8217;s a reason designers get such specific feedback on design concepts like, move that there, make that bigger, make it red. We want to know what the client is trying to solve for (what is most important, what is the hierarchy of information). <em>How</em> to get there is why we&#8217;re in this business. But how is murky. And people don&#8217;t feel comfortable with murky.</p>
<p>The land between the logical business/marketing objectives and the tangible final design solution is the murky place. The designer had a good map, but wandered down side paths, looked up, looked down, looked around, sniffed the air, scribbled, turned over some rocks, took a good nap, and bingo, ideas emerged. Clients have to get comfortable with murky, which is possible if the client starts out making the right choices: designer, planning, budget, etc. (topics for future posts).</p>
<p><strong>Eagerness to see ideas.</strong> The project is a long time in coming. The 20th anniversary is coming up in two months. We need a logo design now. We love your work. We trust you. Let&#8217;s just get started. My boss doesn&#8217;t have time to fill out the brief. He&#8217;ll look at the design when we&#8217;re done. We know we&#8217;re concerned about budget (see below). Don&#8217;t worry, he&#8217;ll love it. There should be no connection between client-side delays in getting a project off the ground and the speed with which the designer must work. Good designers are eager to keep a project moving; give them time to do good work.</p>
<p><strong>Self examination is hard.</strong> By default, settling on what you <em>are</em> also means settling on what you <em>are not.</em> Eliminating possible attributes and strengths of your business might seem like shutting doors. Especially in this economy, who can afford to shut doors? Who can afford not to is the real question. Consider that closing doors is keeping the really important ones open. Communicate clearly to the few important people rather than sort of communicate to the many.</p>
<p><strong>Internal politics.</strong> Too often, personalities foil the potential of a good design process. There is no key decision maker or too many decisions makers. The project &#8220;owner&#8221; doesn&#8217;t have the full authority they want or need, departments have conflicting goals, personal likes rather than business goals drive approvals, the unheard voices wait to be heard at the point of no return (perhaps hoping that the already-committed designer will forge ahead with new ideas at no extra cost).</p>
<p><strong>Belief that good planning and staying within budget aren&#8217;t related.</strong> This needs no elaboration.</p>
<p><strong>Not understanding the value of good design.</strong> We are told to brush and floss often to avoid costly dental work down the road. But how many of us listen to this advice? Most things worth the effort, take effort, but not so much that it&#8217;s painful. It is incumbent on designers to articulate the difference between what they can deliver if a good plan is in place, versus what they cannot deliver without a plan. It is incumbent on clients to make a leap of faith.</p>
<p>David Airey has a great blog post about working with a <a href="http:///">design brief</a>. Another excellent <a href="http://www.howdesign.com//article/?p_ArticleId=7654">post</a> on the subject in <em>How</em> magazine covers the importance of a creative brief and how it leads to success. Designers might consider sending clients these links, especially if your pleas are falling on deaf ears.</p>

<p>The women employed in our program are formerly abducted child soldiers, often used in captivity as sex slaves. Those lucky enough to escape, often with children of their own, are ostracized due to their affiliation with the rebels. They lack education, and are taught sewing as a part of their brief rehabilitation. With demand for seamstresses already sparse due to the war, many are left without the means to support themselves and their children. </p>
<p>MEND is a socially and environmentally responsible company, made in afflicted emergent regions in hopes of stimulating growth, local employment, and economic stability. Similar to its parent company- Invisible Children, MEND is beginning with northern Uganda, with the possibility of heedful worldwide expansion. In October of 2007, 13 women began to MEND. Our dream is that many more will follow.</p>

Dieser ist Scheff der (oekonomisch betrachtet längst bankrotten) Schweizer Post und stellt nun allen Ernstes die Idee in den Raum, Empfänger von Brief- und wohl auch Paketpost hätten für die Zustellung der Lieferung eine Pauschalgebühr zu entrichten. Wie der Herr gemäss <a href="http://www.20min.ch/finance/news/story/Auch-wer-Post-erhaelt--soll-kuenftig-zahlen-17569689" target="_blank">20min</a> meint, soll dies analog der Anschlussgebühr für Radio/ TV funktionieren:</p>
<blockquote><p>Man könne analog der Lösung für TV und Radio dem Empfänger eine Geführ für die Nutzung der postalischen Grundversorgung abverlangen. Diese soll laut Kunz fix und mengenunabhängig sein und müsste einmal pro Jahr entrichtet werden.</p></blockquote>
<p>Während man dem Verzweifelten zugute halten muss, dass er das Problem erkennt</p>
<blockquote><p>Die immer stärkere Verlagerung in Richtung E-Mail führe dazu, dass die Kosten pro Brief entsprechend steigen, so Kunz weiter.</p></blockquote>
<p>so ist dennoch seine vorgeschlagene Lösung die absolut untauglichste:</p>
<p>Denn Kunz versucht, eine weit überdimensionierte Infrastruktur, für welche die Nachfrage stetig abnimmt, mittels immer weiter steigenden Zwangsabgaben zu finanzieren. Hätten die SBB in den letzten 100 Jahren diese Quelle der Finanzierung konsequent erschlossen, wäre der heutige Billetpreis zu einem guten Teil dazu da, Dampflokomotiven und gewerkschaftlich geschützte Kohleheizer zu beschäftigen. Obschon die längst keiner mehr braucht.</p>
<p>Ueberdies entfernt sich Kunz mit dieser absurden Idee noch weiter von der Kostenwahrheit. Abgelegene Randregionen würden nämlich gemessen an ihrer Briefkastendichte noch einmal weniger an die Finanzierung der Postinfrastruktur bezahlen.</p>
<p>Und die Anschlussgebühr ist einfach umgangen: Der Briefkasten ist schnell abgeschraubt, die (noch wenigen verbleibenden) Posteingänge auf die Adresse des Arbeitgebers umgeleitet. Briefpost wird mit E-Mail ersetzt, Paketpost mit Kurierdiensten. Adieu überteuerter &#8220;Service public&#8221;!<br />
Und würde einmal mehr die Billag- Logik (&#8220;ja, Sie haben zwar weder Radio noch TV, aber sie könnten theoretisch ja über den Notebook ihres Sohnes, der in den USA lebt, aber vielleicht mal zu Ihnen nach Hause kommt, Radio hören&#8221;) angewandt, wäre wenigstens klar, woher der Wind wirklich weht &#8212; einmal mehr aus dem sozialistischen Steuer-Bern.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>For this brief, we had to write a personal manifest, publish it on twitter and then visualise it. I chose as my manifesto: &#8220;Play with Fire&#8221;. I wanted to emphasise the fact that designers shouldn&#8217;t be afraid to take risks.</p>
<p>My first idea was that I wanted to present fire as something beautiful. I wanted to get the message across that taking risks can provide us with something beautiful we prehaps wouldn&#8217;t have had before. I researched fire art and also Chinese sky lanterns and floating lanterns.</p>
<p>I experimented making floating lanterns with polystyrene and tissue paper. Although they looked quite pretty, I didn&#8217;t think they really conveyed the message unless I was to actually write my manifesto somewhere on the lantern. I did this but it was difficult to read and I wasn&#8217;t really happy with the result.</p>
<p>My next idea was to burn my manifesto on to toast. I tried a couple of different ways of doing this: the first was to cut out a template of the words with foil and place it on the toast as it cooked under the grill; the second was to burn the message into the toast with a soldering iron. I burnt several pieces of toast with varying degrees of success. Again, I wasn&#8217;t totally satisfied with this solution.</p>

<p>After a couple more unsuccessful experiments, I decided I wanted to focus more on the element of danger. I considered what things were associated with danger and eventually came up with the idea of using fireworks. Using a teddy to model a human, I took a rocket and placed it in different &#8216;play&#8217; situations as a substitute for the usual tools or implements we would use.</p>

<p>I had a lot of fun with this brief. I came to the conclusion that actual fire is a fun thing to play with and one of the best ways for designers to take risks! As with my last brief, I feel I could have pushed ideas further and got more out of them than I actually did. I looked more this time at the work of relevant designers although I&#8217;m sure there is more I could have explored.</p>

<content:encoded><![CDATA[<div class='snap_preview'><div>Labor and employment attorney and fellow Baker Hostetler partner, <a title="Todd Lebowitz Bio" href="http://bhintranetnlb/Pages/bio.aspx" target="_self">Todd Lebowitz</a>, sent me a helpful reminder today about changes to the time calculation rules and time periods in the Federal Rules of Civil Procedure, Criminal Procedure, and Bankruptcy Procedure.  There are some significant changes, including:</div>
<ul>
<li>All dates are now calculated by counting all calendar days, not just business days, even if the time period being measured is ten days or shorter. </li>
<li>Three days are still added for service, and the due date still skips to the next business day if it falls on a weekend or holiday, but there is no more skipping of interim weekends and holidays when counting days. </li>
<li>The new time periods are generally multiples of seven, such as 21 days to answer a complaint, 21 days to respond to MSJ, 14 days to reply to MSJ response.</li>
</ul>
<div>The changes apply to all cases filed after today and, &#8220;insofar as just and practicable, all proceedings [already] pending.&#8221;  Here is some further info and helpful links from the <a title="Revisions to FRCP 12/1/09" href="http://www.uscourts.gov/rules/index2.html#rules120109" target="_self">uscourts.gov</a> website:</div>

<p>Congress has taken no action on the amendments to the Federal Rules of Appellate, Bankruptcy, Civil, and Criminal Procedure, approved by the Supreme Court on March 26, 2009, which include revisions of time periods in 91 rules. The following amendments to the rules on the computation of time therefore will take effect on December 1, 2009:</p>
<ul>
<li>Appellate Rules 4, 5, 6, 10, 12, 15, 19, 25, 26, 27, 28.1, 30, 31, 39, and 41;</li>
<li>Bankruptcy Rules 1007, 1011, 1019, 1020, 2002, 2003, 2006, 2007, 2007.2, 2008, 2015, 2015.1, 2015.2, 2015.3, 2016, 3001, 3015, 3017, 3019, 3020, 4001, 4002, 4004, 6003, 6004, 6006, 6007, 7004, 7012, 8001, 8002, 8003, 8006, 8009, 8015, 8017, 9006, 9027, and 9033;</li>
<li>Civil Rules 6, 12, 14, 15, 23, 27, 32, 38, 50, 52, 53, 54, 55, 56, 59, 62, 65, 68, 71.1, 72, 81; Supplemental Rules B, C, and G; and Illustrative Civil Forms 3, 4, and 60; and</li>
<li>Criminal Rules 5.1, 7, 12.1, 12.3, 29, 33, 34, 35, 41, 45, 47, 58, and 59; Rule 8 of the Rules Governing Section 2254 Cases in the United States District Courts; and Rule 8 of the Rules Governing Section 2255 Proceedings for the United States District Courts.</li>
</ul>
<p>The following non-time computation amendments and new rules under the Federal Rules of Appellate, Bankruptcy, Civil, and Criminal Procedure will also take effect on December 1, 2009:</p>
<ul>
<li>Appellate Rules 4, 22, 26, and new Rule 12.1;</li>
<li>Bankruptcy Rules 2016, 4008, 7052, 9006, 9015, 9021, 9023, and new Rule 7058;</li>
<li>Civil Rules 13, 15, 48, and 81, and new Rule 62.1; and</li>
<li>Criminal Rules 7, 32, 32.2, and 41; Rule 11 and new Rule 12 of the Rules Governing Section 2254 Cases in the United States District Courts; and Rule 11 of the Rules Governing Section 2255 Proceedings for the United States District Courts.</li>
</ul>
<p>In accordance with 28 U.S.C. § 2074(a) and the March 26, 2009, Supreme Court orders, they will govern all proceedings commenced on or after December 1, 2009, and “insofar as just and practicable” all proceedings then pending.</p>
<p>The time-computation changes are intended to make the federal rules on calculating time periods simpler, clearer, and consistent. The principal simplifying innovation is to count all days, including intermediate weekends and holidays, in computing time periods under the procedural rules. The current rules exclude intermediate weekends and holidays for some short time periods, resulting in inconsistency and unnecessary complication. In addition, all the deadlines in the rules were reviewed and most short periods were extended to offset the shift in the time-computation rules and to ensure that each period is reasonable.</p>
