Al principio eran cortos, de una sola frase, pero después empezaron a ser más largos; todos ellos nos dejaban pensando cómo era posible encontrar tantos misterios en lo cotidiano. En eso consiste su escritura, en desvelar lo que hay detrás de las cosas sencillas. Ahora, con la publicación del libro, Manuel ha descorchado su botella de cuentos y todos nos hemos alegrado.

There is a free service provided by Google where you can get a written translation of any text. It is very unreliable but you can get a idea as to what a text is saying. The web address is the following:-

. Your supply has been cut because of lack of payment and the contract is now cancelled.

If this is the case it is not just as simple as paying the bill & being reconnected in a few hours. The process for reconnection is almost the same as registering a new house with the electricity company. You will need a series of documents:-

1. A habitation licence or licence of first/second occupation from the town hall. To get this you will need to go to the town hall with a copy of the deeds N.I.E. number, Copy of the rates bill up to date. And a certificate from an architect with a plan of the property. This certificate should not cost more than 450€. Once this is presented to the town hall with the application form they will locate your property on the town planning map and stamp your application for with a entry number and application date.
2. A buletin. This is a certificate issued by an official electrical installer that certifies that the instillation in your home is according to the regional health & safety regulations. The installer will check your instillation and possibly need to change some items if he house has not been recently built. Some installers are stricter than others and will charge you according to the amount of work they deem necessary to bring your instillation up to standard.
3. A Hoja de Enlace certificate. This is issued by the installer which states that the point of connection from the mains supply to where your meter will be installed in order. These two certificates should cost no more than 180€, plus any payment for adjusting the installation in your home.

Once you have all the necessary documents with a copy of your N.I.E.  number and bank account details, they must be sent to Iberdrola, you can ring 902201520 and apply for the connection. You will have to keep saying English until you are put through an English speaking operator. They will ask you to send the documentation to acometidas@iberdrola.es or give you a fax number. On some occasions the electrical installer will forward these certificates for you but don’t count on it. Once everything has been submitted to iberdrola they will take some days to confirm that the documentation is in order then they will have a new meter installed and connect you.

This process can take some time so if you are a coming to Spain on holiday at your holiday home it is necessary to give at least a week or two for a representative to deal with this on your behalf so there is electricity in your home when you come. Iberdola charge for there connections service than they will bill you for the amount of electricity you use. There are also many other companies that supply electricity that you can choose from.

.The builder has you on a work supply and has not connected your home to a proper supply yet.

This supply can be a little temperamental especially if there are continuing works on the estate. It is important that constant pressure is put on the builder to issue the certificates necessary for you to get your individual supply so that you are not cut off if the builder goes bust. The reason that this lack of individual supply has continued needs to be investigated especially if your part or sector of the estate has been completed. Perhaps the builder has not applied for the correct planning permission and is having difficulties with the town hall as a result or the bank is not lending him any more money to complete the building.

.You do not have a legal supply because your house was illegally built and you do not have the proper certificate that gives you the right to supply.

Getting the necessary certificates from the town hall can be very difficult because the Valencian community has some very strict guidelines about how to deal with illegal properties, these guidelines make it very difficult for the town halls to easily regularise the properties built without planning permission. These laws are laid down to protect the environment against exploitation (unfortunately these rules have not been enforced in the past & that is the reason why there have been so many infractions). Some town halls are finding solutions to assist home owners others are not. Often a home owner is left to find there own solution I have even been told by town hall operatives not to bring the property problems to them, others have been informative and helpful.

.You have electricity but you have not received any bill because the connection is illegal and you are receiving stolen electricity.

This is a very difficult position to be in. It is most probable that in the near future the electricity company will cut you off and you will receive a large fine for stealing electricity. It is advisable to seek legal assistance as what to do. This assistance can be expensive and if you are living in an illegal property I’m sure you are fed up with paying solicitors to get no where. There is free legal assistance available in this area. Contact me & I will let you know how to get it. Many times people are told that the builder that has put you in this situation is bankrupt and it is a waste of time and money trying to bring a case for compensation against them. There is a way of finding out if that is the case. It is quite easy to do a search to see if the rumour of bankruptcy is true. One the solvency of the builder is established then you can decide if you want to bring him/them to court. One very brave lady has decided to do all she can to bring the builder to justice even if he is not solvent just to make a statement that this sort of behaviour should be dealt with and we have to take a stand.

.You are connected but the contract is not for a house but a warehouse or for a water pump etc.

This is better than no connection at all. Once you have a contract with the electricity company it is very difficult that it will be cancelled. It is important that you keep the payments up to date so the connection is not cut. You can investigate the possibility of regularising your property. It become a bit more difficult when it is a question of a group of properties connected to one meter. There is always the risk of someone reporting the illegal connections to the ministry of industry and the connection being cut off and the meter taken away.

It is important to seek a way of attaining a legal connection. You may need the assistance of a qualified electrical engineer to find out what is the most cost effective way. There are no guarantees of a quick solution. If there is a possible solution it is important to act quickly as what so often happens is there can be a change in the politics/laws that close the window of opportunity for a legal connection.

. You live in an area where there is not an electricity line near your home.

-First you should make an application to Iberdrola for a connection.

-If there is not a point of connection you will need to consider having a transformer installed. This is quite expensive but it can serve a large number of properties so if you have other properties around then the expense can be shared. If no one is willing to share the cost then it is possible to install the transformer and charge any future person who desires to connect to it.  An engineers plan will be necessary and licences etc. It can take considerable time for this to go through.

Alternatives,

Solar and wind turbine electricity are a good alternative. They have there limitations and the initial outlay can be expensive but prices are dropping & the instillations are improving. It is important to talk to a registered electrical engeneer who is qualified to advise on the possible alternatives.

Take your builder to court

Many of us who have purchased properties in Spain have been let down, lied too, and fraudulently ripped off buy builders, solicitors & estate agents. Now if this has happened to you and you don’t take action then the cancer in this country will only fester. The question is how much will it cost to take legal action and how long will it take. The answer is it might not cost you anything if you take the option of legal aid but it will take a long time with or without legal aid.. Taking the option of legal aid makes the government more aware of the problem. Another consideration is if action is taken what can be gained at the end of the long legal procedure. Is compensation a real possibility if we win the case.

I am helping some brave clients through the process at this time and I can inform you of how the process is going and the advice as to what action should be taken.

One of my clients was sold a villa in 2006. All seemed o.k. a solicitor was present at the signing of the deeds and my client asked him if all was legal she was assured it was and within six weeks the habitation certificate would be issued and the electricity would be connected. After many visits to the builders & estate agents office the and a bit of investigation it was discovered that the property was built without the licences on a rustic plot that was not big enough to build on. (10,000m2 on this area). The builder & estate agent continued to assure her that soon the electricity would be connected. My friend is now in the process of taking the builder to court.

The land the property is situated on is agricultural land, It has been divided into sections through a process called “division horizontal” so smaller parts of the plot could be sold off to individuals. This is no longer legal but was some years ago. The builder then built a house without a licence to build, without certified architects plans and without any possibility of getting the finishing certification (Bulitin and habitation certificate). No taxes were ever paid to the authorities. The property was not registered with the rates department. The house was built without a 10 year guarantee or insurance. It was not checked by an architect to make sure it had been built according to all the legal safety standards. Under normal circumstances a notary will not allow such a property to be signed over to a purchaser but the builders architect signed an antiquity certificate declaring that the property was more than 4 years old which is a offence in its self.

First we went to the school of  lawyers and we were appointed legal aid and a solicitor. We took all of the paperwork with us. Sales contract, letters from the builder declaring that the electricity would be connected soon. We had previously obtained paperwork from the registry office which showed the name of the architect that had provided false certificates to the notary and land registry at the time of the horizontal division. It was also discovered that the builder & architect had declared that the land had two other properties on it that did not exist. The builder has started to build a second house there now which according to the architects certificate was built in 2002. When this was exposed we denounced it to the town hall who have sanctioned the builder and are raising a demolition order.

Last Friday we visited the solicitor that is attending us & she has informed us that we have a solid case against the builders and when it gets to court we will win the case. The first thing to do is find out if the builders have property and monies in there name. If he does not have anything then it is unlikely that compensation will be given at the end of the process.  To find out if the builder has a first we need a note from the registry office to see if the builders have anything in Spain. In this case it has turned out as a positive. The next step is to get “nota simples” which explains in detail what is what the property is. The paperwork to do this costs 10€ for the first search then just over 3€ for each “nota Simple”.

Once the information is collected then you will know if there is a case for compensation from the builder. I personally think it is good to take matters as far as possible even if there is not a possibility to get compensation because it is a statement that expats will take action if we are victimized in this fraudulent way. Unfortunately in this country the law dictates that this type of offence is not criminal but civil. This does not mean you will get nothing at the end of the legal process, the judge will decide according to the evidence that you have been left without the services and compensated appropriately.

The solicitor advised us that at the beginning of the process she will apply for a tempory freeze of the builders assets until the court case has finished. If the builders only have property then it will be embargoed. This means that he will not be able to sell or pass it on without compensation first being paid.

There are different ways of bringing a case against the builder. If the offence was made over 4 years ago then it is only possible to go for the company that appears in the paperwork(deeds etc). If it is less than 4 years then it is possible to take the case against the administrators of the company as individuals to court. (The administrators are those who have made the profits and have most assets, houses etc.). On many occasions solicitors have advised not to take builders to court because you will get nothing at the end. Then later sometimes when it is now a little late in the day it has been found out that the builder did have assets and a case could have been (or can be) formulated. I think it is a terrible negligents on behalf of solicitors that have advised there clients without first investigating the real state of affairs. I know that speaking to clients who have purchased illegal properties that if compensation is not forth coming then it is the satisfaction of taking these fraudsters to court and doing all in our ability to rectify the situation. After all the builders have mad a fortune out of illegal building and I can not believe that the money has just disappeared. The recession took most by surprise in 2007 and most of these builders were happily investing in land and building etc. So in many cases there are properties in the name of the builders which can be embargoed if the builder has no liquid assets.

The architects involvement is also quite significant. If it wasn’t for that false piece of paper then the property would not have been able to be sold. The false certificate has been produced to deceive the notary, town hall, land registry & the person purchasing. The architect can also be taken to court and charged with a case that has had a terrible consequence on the purchaser of the property. The architect has a insurance that protects him in the case of his actions leading to a compensation procedure. If the case is won then compensation is most likely & it is possible that the architect will be put under disciplinary order or struck off the register and not allowed to faction in the capacity of architect for a long period of time or never again.

What can be claimed?

The expense that has been created from the builder not supplying electricity, water, not finishing the instillations, roads. Also the effect that the situation has had on your health. Stress causes a lot of medical complications.

Another consideration is that now you own a property that is almost impossible to sell because of its illegal status. In the Valencian community if the property is less that four years old it can be demolished. If the builder has liquid assets then it might be possible for the judge to order him to pay you the total amount of  the cost of the property plus compensation. Perhaps this is a bit of a high hope but there is a provision in Spanish law for this.

I have a few very valiant clients that are going through this process, we have a long way to go but we are on our way. Potencialidad Turística
La potenciación de la actividad turística ha sido un punto de referencia para lograr una diversificación económica que contribuya al progreso económico y social municipal y también para relanzar y dinamizar aquellos municipios que han caído en una fase de estancamiento de su actividad económica.

Una buena planificación del desarrollo turístico, supone una excelente oportunidad de conservación del patrimonio cultural, arquitectónico, natural, gastronómico….

La consecución del desarrollo turístico, requiere unos condicionantes previos relacionados con la localización del área, la situación socioeconómica, las infraestructuras, la accesibilidad, la existencia de atractivos turísticos…. además de la situación de la oferta y la demanda. También se debe tener en cuanta que el desarrollo turístico es particularmente difícil en aquellos municipios que cuentan con escasa o nula tradición turística.

No basta una simple adecuación de los recursos turísticos para incentivar el proceso de desarrollo turístico local, sino que para lograr una plena rentabilidad económica y social, debe integrarse al turismo en todo proceso de desarrollo local.

Situación Territorial

El municipio de Callosa de Segura, se encuentra ubicado a 16 metros de altitud sobre el nivel del mar, localizados en la estación de ferrocarril de la localidad, para ir aumentando considerablemente a medida que la población se va asentando en las proximidades de la Sierra. Su localización exacta queda definida en 38º 07’ 21” latitud norte y a 0º 52’ 47” longitud oeste.
El territorio principal en el que se enclava el núcleo urbano se divide orográficamente en dos zonas perfectamente diferenciadas: una en el extremo oeste del término municipal, donde al pie de ésta se localizada el asentamiento poblacional más importante, con altitudes sobre el nivel del mar que oscilan entre los 15 metros y los 525 metros. El resto del territorio no posee oscilaciones que merezcan especial atención.
La extensión de su término municipal es de 24,8 km². El municipio se encuentra al sur de la Comunidad Valenciana, en la zona más meridional de la provincia de Alicante, concretamente, en el curso bajo del río Segura (Comarca de la Vega Baja).
Dista 51 km de la ciudad de Alicante, 92 km de Benidorm, 6 km de Orihuela, 29 km de Guardamar del Segura y 25 km de Torrevieja.
Callosa de Segura se caracteriza por disponer de una accesibilidad muy variada y eficiente, con unas modernas comunicaciones. Se encuentra situada en un punto estratégico, no sólo por su proximidad a ciudades de tradición turística, sino también porque posee buenas vías de comunicación con las ciudades más importantes de las provincias limítrofes de Murcia y Alicante.
El acceso por carretera a la ciudad puede hacerse fundamentalmente por varias vías: tomando la autovía del Mediterráneo A7 (salida Granja de Rocamora), a través de la carretera N-340 y con la que da acceso a la ciudad, la C.V. 900. Otros ejes de comunicación son la CV-311 por Rafal y la CV-313 por Catral.
Posee un clima mediterráneo suave, con unos 18ºC de temperatura media anual.
Su proximidad al mar mediterráneo incide en la bondad térmica, existiendo una configuración estacional de las precipitaciones con máximos en primavera y otoño.

Análisis demográfico
Callosa cuenta con una población de 17.743 habitantes, 9.022 hombres y 8.721 mujeres. Las familias que residen en el municipio tienen un tamaño medio de 3,39 miembros, siendo las de 4 miembros las más numerosas.

El interés del estudio demográfico radica en que a partir de las conclusiones pueden establecerse proyecciones de su evolución futura, y servir de base para conocer el impacto que, desde el punto de vista demográfico, puede suponer para la actividad turística.

Las infraestructuras, equipamientos y servicios públicos, el estado de conservación del medio ambiente, las actuaciones públicas municipales y el grado de implicación social son algunos de los principales factores que condicionan de manera decisiva el desarrollo de la actividad turística.

Gastronomía

Uno de los recursos importantes de nuestra oferta turística es, sin duda, la gastronomía.
La riqueza gastronómica de Callosa de Segura es tan variada como lo son sus paisajes y productos. Es típicamente mediterránea, con recetas de antaño y costumbres alimenticias que han permanecido inalterables durante siglos; recetas donde se funden la cocina tradicional y la moderna. En definitiva, deliciosos platos que encontramos en cada uno de los bares y restaurantes de la localidad.
La herencia que nos han dejado las distintas culturas y pueblos asentados en la región se puede comprobar en multitud de platos que aún hoy perduran, tales como Arroz con costra”, “Bacalao meneao”, “Gachas con arrope”, o “Almojábanas callosinas”. Nuestra gastronomía se ha convertido en un motivo más para alentar el viaje de los aficionados a comer bien y comer mucho. Desde nuestro Mercado de Abastos, la ciudad ofrece todos sus productos frescos recién salidos de la huerta decorando los bares y restaurantes.
No debemos olvidar que, la gastronomía, es la expresión cultural de un pueblo en la mesa y, en el caso de Callosa de Segura, su historia, su situación geográfica, su clima y la fertilidad de su huerta la han dotado de una enorme calidad y variedad muy apreciada por los visitantes.
Es imprescindible probar las distintas variedades de arroz de la zona, ya que se prepara con los mejores embutidos de elaboración casera. Además se pueden degustar platos como guisado de “pava negra borracha”, el cocido con “pelotas”, el “bacalao meneao”, “gachas con arrope” y un largo sinfín. Y para postre, un amplio surtido de pasteles y dulces apropiados para cada época del año, entre los que cabe destacar la “torta boba”, “leche asada” los “pasteles de gloria” y las “tortas de calabaza con miel”.Aunque quizá no constituyan el aspecto más destacable de la gastronomía callosina, las tapas que se sirven en los bares de nuestra ciudad junto con el chato de vino o la caña de cerveza resultan una apetitosa forma de despertar los sentidos de la gran cantidad de viajeros que acogemos durante todas las épocas del año.
En este segmento gastronómico encontraremos de todo: desde las tapas más tradicionales y perfectas hasta las más imaginativas innovaciones.
Todo ello en el escenario que una ciudad como Callosa de Segura, con sus calles, sus museos y monumentos, su clima y sus gentes, ofrece al visitante.

Conclusiones
El municipio de Callosa de Segura dispone de una gran riqueza de recursos que, aunque algunos de ellos como la Iglesia de San Martín, la representación de la Pasión, la Semana Santa callosina y las fiestas patronales de San Roque, mueven a numerosos turistas/viajeros por su amplia difusión y conocimiento, no constituyen por sí solos una oferta turística que ayude al desarrollo de Callosa de Segura como producto turístico.

Debemos ser capaces de aglutinar una oferta turística en la que se incluyan, además de los itinerarios patrimoniales, los recursos naturales, culturales, sociales y gastronómicos.

If you have taken the step of  reporting the crime or case to the police or at the law courts, then you will have received a copy of the report (denuncia) and this will be presented to a judge who will decide if it is a criminal or a civil case. If it is a criminal case then it will be processed by the courts. If it is a civil case then it will be archived. The courts will now do nothing but there is still a case that you can take up and bring to the courts. For the case to be heard you will need to engage a lawyer to take the case forward so you can claim compensation.

One your case has been before the judge you can go to the court and after finding out if it is criminal or a civil case then you can ask for free legal assistance. It is quite common for the fraudulant activities of many of the builders, laywers and architects to be considers as not criminal but civil cases. If you are not sure you can go Directly to the school of Lawers and ask them to assess your case and they will let you know that it is civil or criminal. If it is civil then you can save yourself a few months wait and just ask the school of laywers to deal with the case without it first going before the judge.

Legal assistance is obtained at the school of Lawyers office at the Orihuela law courts. It is the first door on the right as you walk in through the doors. They request that you have a translator to assist them in communicating with you. The assistance required can not be applied for over the phone, you have to go in person.

There is a form Spanish to fill in which you will have to give your details, the details of your partner and those who live with you & the details of the persons or company which you have a case against. They will take a copy of your police report if you have one.

You will be given an appointment for an interview to ascertain in you are legible for free legal assistance in a court case. It is best to inform the assistant if you are going to be away before you are processed so that they are aware of your holidays not to give you a appointment the is difficult for you to attend.

You will be asked to bring certain documents to the appointment.

- Photocopy of your passport or residence card.

- Photocopy of your family registration book (if you have one).

- Spanish tax returns (if you don’t have them you can go to the tax office and ask for a certificate that you do not pay tax).

- Certificate of electoral role. (Pardon).

- Certificate of bank movements from the bank with its official stamp.

- Certificate of patrimony obtained from the town hall. (Even if you do not own property this is required).

- Certificate of work (Vida Laboral) obtained from the social security office. (If you are retired you do not need this).

- Photocopy of your deeds of your property, then a copy of your last rates bill, last payment of the mortgage if you have one.

- If you rent a property then a copy of your rental contract, last payment receipts.

- If you are self employed a copies of your last 3 monthly tax declaration, IVA payments, and social security payments.

- If you are employed then a copy of the last 3 pay slips.

- If you are a pensioner in Spain a copy of certificate from the INSS (Instituto Nacional de Seguridad Social).

Once you have these documents and you present them to the school of lawyers then you will be assessed and assisted in the court case. They will appoint a lawyer for you and give you his details so you can make a apointment. When you call the Lawyer he or she will not know that you are receiving legal assistance so it is best that you let hem know that you have been sent by the school of lawyers.

If your individual  income and savings amount to more than 14,950€ then you may not be able to get free assistance.

Dolores

The village of Dolores was established in 1715 when the Vega Baja marshland was drained for farming. Dolores is an agricultural village and it is well worth sampling some of the exquisite produce available including fresh fruits, seafood and cold meats. Dolores plays host to one of the most significant fiestas in the Spanish calendar – the August fair.  This Spanish fiesta features a number of equestrian competitions with over 1,500 horses participating.

Callosa de Segura

One of the smaller villages in Vega Baja with an abundance of natural fresh water springs, Callosa de Segura is an ideal location in which to relax.  The springs are naturally warm attaining average temperatures of 18ºC, perfect for bathing in the hot summer months.  The region is distinguished by the characteristically Mediterranean citrus orchards.  Callosa is no exception;  the orange orchards present a vibrant landscape adored by locals and tourists alike. The village is close to Guardamar beach and is approximately 25 minutes from Alicante airport.

Catral

The rural agricultural town of Catral is south-west of Alicante and is in an ideal location being only 20km from the coast of Guardamar and 25km from Torrevieja.  One of the most popular attractions of this area is the Hondo Reservoir, a preserved natural park which many people have embarked on as a rural trail.  The Moorish influence on this town is reflected in the architecture;  even the name Catral originates from the Moorish language.

Almoradi

To the north of the Segura River lies Almoradi, a well established town just a 25 minute drive outside Torrevieja and close to the La Finca Algorfa Golf Club.  Almoradi offers excellent amenities but yet it is full of tradition and culture. The architecturally imposing Church of San Andrés and the renowned Saturday market make this town the perfect place to experience the tradition of Spain

San Roque Hermitage Callosa de Segura

Today’s picture is of the San Roque hermitage, located in the Spanish town of Callosa de Segura, Alicante, Costa Blanca. Callosa de Segura is a little inland from the Costa Blanca coastline and is built at the foot and up the slopes of a nearby mountain. The town is typically spanish and celebrated a number of Fiestas through the year including on dedicated to San Roque. The hermitage overlooks the town from its lofty position on a hill.

Antes de la charla, la diputada hizo un repaso de las posiciones mantenidas por EU en los temas claves en el panorama noticioso actual: economía, educación y salud. Albiol mantuvo en todo momento un discurso crítico con la privatización tanto de la educación como la sanidad pública en la Comunidad.

En el sector educativo esta privatización se transforma en la creación de ghettos. En la Comunidad Valenciana “el 80% de los estudiantes inmigrantes van a la escuela pública porque no les dejan matricularse en los concertados subvencionados por el dinero de todos los valencianos”

También habló de los trabajadores inmigrantes, quienes “durante mucho tiempo sustentaron nuestro sistema de pensiones y cuidaron de nuestros ancianos, pero cuando llegan las vacas flacas se les invita a irse del país”. Las mujeres inmigrantes, empleadas domésticas sin contratas en muchas ocasiones, “son las primeras en sufrir las consecuencias de la crisis” porque han perdido su trabajo y no tienen derecho a prestaciones. Finalmente Marina Albiol se mostró partidaria de reformar la Ley de Extranjeria para que los inmigrantes tengan los mismos derechos que los trabajadores.

La ruta es força complicada per la dificultat tècnica que té. La serra de Callosa de Segura te poques possibilitats de trobar un camí còmode per la seua forma, i el camí (encara que siga assenyalat com a PR o no) es només apte per a les cabres, i per a nosaltres.

Com he dit al principi, hi havia molta gent degut a la pujada del pessebre. Es va celebrar una missa, al costat del refugi, on van colocar el pessebre. Aquest any, ja fan 45 vegades que s’ha celebrat aquest esdeveniment.

Des d’el cim anomenat “El alto del águila” es veia la serra d’Oriola. El cim es troba a uns cinc minuts del lloc on es celebrava la missa. Hi vam fer la parada per esmorzar, i després vam tornar a baixar per un altre camí.

La baixada sí la vam fer seguint els senyals de PR, encara que això no vol dir que el camí siga menys perillós o més fàcil.

Al final la ruta fou d’uns 5 quilòmetres de distància. Un diumenge molt divertit i singular.
