<p><a title="Health Secretary Sebelius Should be Terminated for Violating Hatch Act" href="http://godfatherpolitics.com/7063/health-secretary-sebelius-should-be-terminated-for-violating-hatch-act/"><img title="sebelius obama" src="http://godfatherpolitics.com/wp-content/uploads/2012/09/sebelius-obama-220x120.jpg" alt="sebelius obama" width="220" height="120" /></a>In 1939, the <a href="http://en.wikipedia.org/wiki/Hatch_Act_of_1939">Act to Prevent Pernicious Political Activities</a> was passed by Congress and became federal law.  The act prohibits federal employees from being involved or holding membership in any political organization which advocates the overthrow of the constitutional form of government.  (Say, isn’t that what the Democratic Party has been doing with the help of Barack Obama and Eric Holder?)</p>
<p>The main aspect of the Act, later called the <a class="zem_slink" title="Hatch Act of 1939" href="http://en.wikipedia.org/wiki/Hatch_Act_of_1939" rel="wikipedia" target="_blank">Hatch Act</a> after New Mexico Senator <a class="zem_slink" title="Carl Hatch" href="http://en.wikipedia.org/wiki/Carl_Hatch" rel="wikipedia" target="_blank">Carl Hatch</a>, is to prohibit federal civil servant employees in the executive branch from taking part in partisan political activity.  It also forbids them participating in political campaign activities and from intimidating or bribing voters.  They are also not allowed to use public funds for political campaign purposes.</p>
<p>The Hatch Act also covers all Presidential appointees including the Secretary of State and other cabinet positions.  This could be part of the reason that Hillary Clinton was outside the country during the Democratic National Convention.</p>
<p>As a rule most violators of the Hatch Act are instantly terminated.  In lieu of the fact that <a class="zem_slink" title="Barack Hussein Obama, Jr." href="http://www.biography.com/people/barack-obama-12782369" rel="biographycom" target="_blank">President Barack Obama’s</a> declaration of establishing the toughest ethics laws and transparency of his administration, you would expect him to keep to the normal procedure for those in his executive branch who violate the Hatch Act, but that does not seem to be the case.</p>
<p>Back in February, <a class="zem_slink" title="Kathleen Sebelius" href="http://en.wikipedia.org/wiki/Kathleen_Sebelius" rel="wikipedia" target="_blank">Kathleen Sebelius</a>, <a class="zem_slink" title="United States Secretary of Health and Human Services" href="http://en.wikipedia.org/wiki/United_States_Secretary_of_Health_and_Human_Services" rel="wikipedia" target="_blank">Secretary of Health and Human services</a>, attended a taxpayer funded campaign event in North Carolina.  While participating in the event, Sebelius publicly endorsed Obama’s bid for re-election along with Walter Dalton’s bid for re-election as <a class="zem_slink" title="Lieutenant Governor of North Carolina" href="http://en.wikipedia.org/wiki/Lieutenant_Governor_of_North_Carolina" rel="wikipedia" target="_blank">Lieutenant Governor of North Carolina</a>.</p>
<p>According to the <a href="http://dailycaller.com/2012/09/14/rep-walsh-obama-should-follow-standard-procedure-fire-sebelius/">U.S. Office of Special Counsel</a>, (OSC), Sebelius violated the Hatch Act on more than one account.  The OSC also states that an:</p>
<p>“Employee who violates the Hatch Act shall be removed from their position, and funds appropriated for the position from which removed thereafter may not be used to pay the employee or individual.”</p>
<p>There is a provision that offers an <a href="http://dailycaller.com/2012/09/14/rep-walsh-obama-should-follow-standard-procedure-fire-sebelius/">alternative to termination</a> for violations of the Hatch Act.  Those federal employees that aren’t appointed to their position by the president or approved by the Senate can be given a punishment that allows them to retain their position if:</p>
<p>“The <a class="zem_slink" title="United States Merit Systems Protection Board" href="http://www.mspb.gov/" rel="homepage" target="_blank">Merit Systems Protection Board</a> finds by unanimous vote that the violation does not warrant removal, a penalty of not less than a 30-day suspension without pay shall be imposed by direction of the board.”</p>
<p>But, Sebelius is a presidential appointee that was confirmed by the Senate, so she is not eligible for review by the Merit Systems Protection Board.  President Obama has been informed by <a href="http://dailycaller.com/2012/09/12/white-house-sebelius-unlikely-to-be-punished-for-violating-hatch-act/">Special Counsel Carolyn Lerner</a> that Secretary Sebelius:</p>

<p>“Violated the Hatch Act by making extemporaneous political remarks in a speech delivered in her official capacity.”</p>
<p>“The Hatch Act prohibits federal employees from using their official authority or influence to affect the outcome of an election.  A federal employee is permitted to make partisan remarks when speaking in their personal capacity, but not when using an official title or when speaking about agency business.”</p>
<p>“Secretary Sebelius and the <a class="zem_slink" title="United States Department of Health and Human Services" href="http://maps.google.com/maps?ll=38.8866666667,-77.0144444444&#38;spn=0.01,0.01&#38;q=38.8866666667,-77.0144444444 (United%20States%20Department%20of%20Health%20and%20Human%20Services)&#38;t=h" rel="geolocation" target="_blank">Department of Health and Human Services</a> reimbursed the U.S. government for all costs and expenses associated with her travel to the February 25, 2012, event.  HHS subsequently reclassified the trip from official to political and issued a statement to that effect. OSC found no evidence that Secretary Sebelius made any other political statements in her official capacity.”</p>
<p>Rep. Tim Huelskamp (R-KS) told <a href="http://dailycaller.com/2012/09/14/rep-walsh-obama-should-follow-standard-procedure-fire-sebelius/">The Daily Caller</a>:</p>
<p>“This is exactly why they did the Hatch Act — so you wouldn’t have unions running the government and secretaries weren’t forcing politics on employees.  Here you have the most pro-union administration allowing someone to do exactly that. For an administration that claims to be pro-workers — and that’s why the Hatch Act was written, to be protect workers. But hey, what do you expect? This is not surprising. They finally let themselves get caught doing it.”</p>
<p>“I mean, clearly the unions have made it their life’s work to re-elect this president.  It sends a very chilling message: If you’re a federal worker, you’re now also an employee of the campaign, perhaps, rather than just an employee of the federal government.”</p>
<p>According to <a href="http://dailycaller.com/2012/09/14/rep-walsh-obama-should-follow-standard-procedure-fire-sebelius/">Dan Epstein</a>, President of the Cause of Action watchdog organization:</p>
<p>“Thus the point is that by close of business on Sept. 12, 2012, the president has been informed of a Hatch Act violation and yet has decided not to fire Sebelius.  The president has therefore decided to overlook the improper political activities of his appointees when in their official capacities. He has effectively said it is okay to politicize the executive branch.”</p>
<p>Personally, I believe that Sebelius is too important to his healthcare plan and to the contraceptive mandate to terminate her.  Nor can he afford to have her suspended for 30 days with all of the court challenges to the health care program and contraception mandate.</p>
<p>So, will President Obama keep his word about strict ethical laws and a transparent administration or will he do his best to ignore the situation and hope it goes away?</p>

<title><![CDATA[Has AD-69 Candidate Jose Moreno Violated Federal Law?]]></title>

<p>In a rather unfortunate turn of events, it appears AD-69 candidate Jose &#8220;Joe&#8221; Moreno may have violated federal law. (Remember, this Jose Moreno should not be confused with Anaheim City School District Trustee <a href="http://www.voiceofoc.org/community_editorial_board/article_d5a8ba3a-4d75-11e1-b8e1-001871e3ce6c.html" target="_blank">Jose F. Moreno</a>.) The explanation for this lies in a Fresno County Assembly district.</p>
<p>On Friday, the <em>Fresno Bee</em> <a href="http://www.fresnobee.com/2012/04/06/2791313/political-notebook-lickey-leaves.html" target="_blank">reported</a> that Republican Geof Lickey <a href="http://www.fresnobee.com/2012/04/06/2791313/political-notebook-lickey-leaves.html" target="_blank">withdrew from the AD-31 race</a> against incumbent Democrat <a href="http://www.assembly.ca.gov/perea/" target="_blank">Henry Perea</a>. The <em>Bee</em> indicated Lickey had indeed met the March 9 filing deadline and qualified for the ballot before his withdrawal; this <a href="http://www.sos.ca.gov/elections/2012-elections/june-primary/pdf/notice-to-candidates-assembly-2012.pdf" target="_blank">March 23 list of candidates who qualified for the ballot</a> from the Secretary of State also confirms this. Lickey was able to remove himself from the ballot, as this <a href="http://www.sos.ca.gov/elections/2012-elections/june-primary/pdf/updated-contact-info-cert-list.pdf" target="_blank">April 4 list</a> from the Secretary of State indicates Perea is the sole candidate in AD-31.</p>
<p>The <em>Bee</em> <a href="http://www.fresnobee.com/2012/04/06/2791313/political-notebook-lickey-leaves.html" target="_blank">reported</a>, &#8220;The Hatch Act bars federal employees from using government resources for partisan purposes. But Lickey was told it also prohibited him from running for partisan political office &#8212; even though he doesn&#8217;t work for a federal agency.&#8221;</p>
<p>The <a href="http://www.osc.gov/hatchact.htm" target="_blank">Hatch Act</a>, named after its author, U.S. Senator <a href="http://bioguide.congress.gov/scripts/biodisplay.pl?index=H000334" target="_blank">Carl Hatch</a> (D-NM), was adopted to reduce the usage of federal government jobs to advance partisan political ends after <a href="http://en.wikipedia.org/wiki/Works_Progress_Administration" target="_blank">Works Progress Administration</a> officials were found to be using their positions to win votes for Hatch&#8217;s party.  Hatch was outraged by this corruption from his own party and wrote the Hatch Act.  Two attempts to have the act overturned on free speech grounds were rejected by the U.S. Supreme Court, who held that the Hatch Act is constitutional.</p>
<p>Among other things, the Hatch Act <a href="http://www.osc.gov/haStateLocalProhibitedActivities.htm" target="_blank">prohibits covered employees</a> from being &#8220;candidates for public office in a partisan election.&#8221;</p>
<p>Potential candidates covered by the Hatch Act should act with caution before entering partisan politics. Indeed, when speculation surrounded a potential State Senate candidacy by <a href="http://www.cuiab.ca.gov/" target="_blank">California Unemployment Insurance Appeals Board</a> Member <a href="http://www.senate.ca.gov/runner/" target="_blank">Sharon Runner</a> in 2010, she refused to even comment on whether she would enter the race due to the Hatch Act. Only after Runner resigned from the CUIAB did she announce that she was running for the State Senate (which she went on to win).</p>
<p>Moreno selected &#8220;Orange County Eligibility Technician&#8221; as his ballot designation, and that, of course, is his actual job. What does an Eligibility Technician at the County of Orange do? Well, <a href="http://egov.ocgov.com/portal/site/ocgov/menuitem.02b739dec30413a69add603d100000f7/?vgnextoid=82f05ea684586110VgnVCM1000000a00610aRCRD" target="_blank">here&#8217;s the County&#8217;s job description</a>.</p>
<p>So how does the federal Hatch Act apply to a county employee like Moreno?</p>
<p>Well, the U.S. Office of Special Counsel <a href="http://www.osc.gov/haStateLocalwhoiscovered.htm" target="_blank">states</a>, &#8220;The Hatch Act restricts the political activity of individuals principally employed by state or local executive agencies and who work in connection with programs financed in whole or in part by federal loans or grants.&#8221;</p>
<p>According to <a href="http://egov.ocgov.com/portal/site/ocgov/menuitem.02b739dec30413a69add603d100000f7/?vgnextoid=82f05ea684586110VgnVCM1000000a00610aRCRD" target="_blank">the County&#8217;s job description</a>, part of Moreno&#8217;s job is: &#8220;explaining and administering laws and policies pertaining to Federal/State/County assistance programs.&#8221;</p>
<p>(If you&#8217;re wondering why partisan elected officials aren&#8217;t banned from running for re-election, <a href="http://www.osc.gov/haStateLocalwhoisnotcovered.htm" target="_blank">elected officials are exempted</a> from the Hatch Act if their elected post deals with federal dollars and their elected post would be the sole cause for a Hatch Act conflict. It would be kind of funny, though, if the Hatch Act prevented every Governor in the country from running for re-election because states administer many federally-funded programs.)</p>
<p>As I mentioned above, the Hatch Act <a href="http://www.osc.gov/haStateLocalProhibitedActivities.htm" target="_blank">prohibits covered employees</a> from being &#8220;candidates for public office in a partisan election.&#8221;</p>
<p>In light of Prop 14, is a race for the Assembly still a partisan election since candidates are no longer nominated by political parties?</p>
<p>Under the <a href="http://www.osc.gov/haStateLocalfaq.htm" target="_blank">Hatch Act FAQs</a>: &#8220;if a candidate solicits or advertises the endorsement of a partisan political party or uses a political party&#8217;s resources to further his or her campaign, these actions may rebut the presumption that an election is nonpartisan, and thus, indicate that the election is a partisan one. While each case is fact specific, the Board has consistently held that it is less about the title used, and more about the actions of the candidate.&#8221;</p>
<p>More definitively, the <a href="http://www.osc.gov" target="_blank">U.S. Office of Special Counsel</a> issued an <a href="http://www.osc.gov/documents/hatchact/federal/fha-27.htm" target="_blank">advisory opinion</a> in 2001 stating, &#8220;For purposes of the Hatch Act, an election is deemed partisan if political party designations appear on a ballot next to candidates&#8217; names.&#8221;</p>
<p>Moreno <a href="http://www.sos.ca.gov/elections/2012-elections/june-primary/pdf/updated-contact-info-cert-list.pdf" target="_blank">listed himself on the ballot</a> as a Republican. He also told the <em>Orange County Register</em> that he had sought financing from the Republican Party to pay the filing fee to run for Assembly.</p>
<p>It looks like the Hatch Act may put an end to the Moreno candidacy for AD-69.</p>
