Just had some plane time and a chance to read the Center for Democracy and Technology’s  comments submitted to the FTC on business practices for the collection and use of consumer data. If you haven’t already read it -and you’re interested in privacy- it’s very informative and raises some compelling points.

The FTC is conducting a public roundtable discussion to explore this topic further and gather views and recommendations. A host of other parties have also submitted comments and the first discussion is in Washington, D.C. on December 7, 2009.

In short, the CDT argues that the current framework of notice, consent, and security is insufficient because consumers are still left exposed to unfair practices even though they were technically informed by the privacy policy of the service provider.  CDT goes on to urge the FTC to adopt a more comprehensive privacy framework described as Fair Information Practice Principles.

CDT also makes a number of specific recommendations for FTC action, including:

• The FTC should reaffirm that violating FIPs can result in consumer harm. The Commission should pursue enforcement actions against those engaged in unfair practices, not just in the spyware space, but in the general realm of online consumer privacy.  The FTC should use these actions to highlight violations of any or all of the FIPs, not merely notice, choice, and security. Query whether this would provide a cause of action for toolbars or add-ons that furtively change user preferences?
  
• The FTC should encourage Congress to pass general consumer privacy legislation that is based on a full set of FIPS. Self-regulation cannot adequately protect consumer privacy…
• The FTC should consider drafting its own set of consumer privacy rules if it is granted standard rule making authority to clarify basic privacy expectations for consumers and businesses alike.
• The FTC should explore creating benchmarks and metrics for evaluating company privacy polices.

Although very subjective, this notion of “fairness” really resonates and may have (should have) broader implications.  There is plenty of room to better incorporate such principles in privacy policies, terms of use, and new web services that are presented to users, but at the same time fairness should also include some reasonable balance between the interests of both users and service providers.  No doubt there’s going to be a lot more discussion on this topic and more to learn here.

A actividade teve o objectivo de promover o desenvolvimento de conhecimentos e de estratégias que permitam simultaneamente a gestão preventiva da indisciplina e a gestão remediativa do comportamento inadequado e perturbador.

No próximo Sábado, 21 de Novembro, terá lugar no Auditório da ESEQ, uma actividade de formação promovida pelas estruturas da ESEQ: Serviço de Psicologia e Orientação, Núcleo de Apoio Educativo e Coordenação dos Directores de Turma. A actividade tem o objectivo de promover o desenvolvimento de conhecimentos e de estratégias que permitam simultaneamente a gestão preventiva da indisciplina e a gestão remediativa do comportamento inadequado e perturbador.

Se ha celebrado en Benidorm el XIII Foro Internacional de Turismo. Con el lema “Revolucionar la Publicidad Turística: Fórmulas Creativas y Eficientes“, las jornadas se centraron en la comercialización del turismo (destinos, establecimientos, etc) mediante el uso intensivo de las herramientas de la Sociedad de la Información y la utilización “cualitativa” de la publicidad, con propuestas innovadoras.

Los ponentes, especializados la mayoría en el sector de la publicidad, abogaron el uso de Internet como vía de promoción y comercialización de los productos turísticos en toda su extensión. Por supuesto todo a través del prisma de la web 2.0, con las redes sociales como máximos exponentes de los nuevos tiempos.

En el apartado de la promoción “tradicional” a través de la publicidad, fue unánime el llamamiento a la creatividad y la adopción de fórmulas arriesgadas como único camino hacia el éxito de una campaña en un entorno cada día más competitivo.

Otra idea muy interesante fue la necesidad de conjugar la promoción con el desarrollo de un producto turístico consecuente con lo que se promociona, adecuado a las necesidades del cliente y capaz de colmar sus expectativas.

En fechas cercanas se organizó desde en el CDT de Gandia, impulsado por la Concejalía de Turismo de Gandia, un curso sobre comercialización de empresas mixtas de turismo.

Este curso ahondaba en lo expuesto en el Foro de Benidorm, apostando por la innovación en la promoción turística, el uso de Internet y particularmente del fenómeno de las redes sociales, y la necesidad de que el destino respalde mediante una adecuada experiencia de disfrute, lo anticipado en la publicidad.

The amazing alpaca dam: instinctually standing still for a newborn who searches for milk

So for those all too few golden weeks when a dam is open, I like to get a lot of things taken care of that I let slide during that sensitive last trimester. I like to call them spa days. I’m sure the dam doesn’t view them that way, but it sure makes me feel a lot better.

As with any spa treatment, the dam also gets some good-for-you snacks. In this case, it’s extra helpings of alfalfa as she takes on the burden of a nursing baby. That part of spa days, at least, she heartily enjoys.

S. 773, The Cybersecurity Act of 2009, presently being redacted by the Senate Commerce Committee, is a piece of pending legislation that bears watching. On April 1, 2009, Senators John D. Rockefeller (D-WV) and Olympia Snowe (R-ME) introduced legislation designed to promote cybersecurity, a reasonable cause per se. 

President Obama, in a public statement delivered from the East Room of the White House on May 29, 2009 emphasized the need for “securing our nation’s cyber infrastructure”. While considering this essential, he emphasized his commitment to an open Internet:

Let me also be clear about what we will not do. Our pursuit of cybersecurity will not — I repeat, will not include — monitoring private sector networks or Internet traffic. We will preserve and protect the personal privacy and civil liberties that we cherish as Americans. Indeed, I remain firmly committed to net neutrality so we can keep the Internet as it should be open and free.

Now those in the know, including The Center for Democracy and Technology,  have expressed concerns about components of the proposed legislation. CDT, defines itself as ”a non-profit public interest organization working to keep the Internet open, innovative, and free.” Its mission is to build “consensus among all parties interested in the future of the Internet and other new communications media.”

Now those who claim to be in the know,  in a variety of recent articles over the past several days,  in the blogosphere and elsewhere,  have made statements about this issue which are more prone to incite than inform. Some of the rhetoric being used is akin to that being employed in the health care debate. Both issues are too important to be reduced to epithets.

On August 20, Commerce Committee staff circulated for comment a draft Committee Amendment to S. 773.

In an effort to render a reasoned interpretation of where this proposed legislation now stands, C&C contacted Greg Nojeim, Senior Counsel at the Center for Democracy & Technology and the Director of its Project on Freedom, Security & Technology. He provided  the following statement:

“The draft Committee Amendment to the Cybersecurity Act marks a substantial improvement over the original version, but ambiguous language in the draft Committee Amendment also raises new concerns and questions about its scope.”

Previously this blog referenced the attempt by the government of Iran to impose an information blackout during the  protest by its citizens of a suspect election. “Internet access has been successfully curtailed to strangle the flow of information in and out of the country.” (http://bit.ly/2N4UUg). Of course the citizenry turned to their cellphones and through tweets on Twitter and video on YouTube circumvented the Internet shut down. 

Throughout history, to the present day, totalitarian regimes  use access to information to subjugate. In this country, civil liberties are protected. The balancing of  these rights with legitimate national security concerns in an Internet driven world is what is at stake in this case.

While there are a number of elements in S. 733 in need of scrutiny,  the section which deals with Presidential  authority to address a cybersecurity emergency is certainly and rightly a “hot button” issue, no pun intended (“kill switch” was a term previously employed in connection with this provision).

Beyond the Commerce Committee, there are other proposed pieces of related legislation circulating. The Senate Homeland Security and Governmental Affairs Committee is supposed to issue its own bill sometime this fall.

 It is expected that The Center for Democracy & Technology, in consort with other responsible organizations, will continue to voice concerns and work with Commerce Committee staff regarding this bill. In the meantime, stay calm and vigilant.

In Shots for Beginners, I talked about the basic medications and vaccines a beginning breeder should keep on hand and also provided a brief guide to abbreviations commonly used in livestock care. To supplement that, I thought I would post my quick and dirty reference for shots and medication dosages. I keep this posted on my board and refer to it all the time. You’d think that over time, I would have all of these memorized, but the opposite has happened instead! My memory just seems to get less and less reliable and I, as in most cases, like to blame it on getting older.

I feel the need… the need for speed!

With this one-liner in my head I went to two air shows, one in Volkel (The Netherlands) and one in Koksijde (Belgium)! I’m not a spotter as such, but I like the speed and sound of those jets and planes! Also the whole atmosphere at an air show, attracts me. And off course… when you are there with good friends, that makes everything complete!

PrivacyCampDC is in the books and it was fantastic!  A collection of people representing interests in both the public and private sector gathered together to share knowledge and expertise on a number of topics including (but certainly not limited to) the future of privacy rights in a Government 2.0 world, surveillance technologies, digital signage, updating the 1974 federal Privacy Act (something CDT is pushing for citizen feedback on with their Privacy Act Wiki if you want to check it out), and how we achieve a greater level of transparency and openness without compromising ones privacy.  With attendees representing privacy organizations, federal agencies, security companies, information technology and even Congress, there were a lot of great ideas shared during the event.

One of the most important takeaways that nearly everyone walked away with was the notion that collaborative discussion is vital to protecting privacy in the digital age.  The more voices and interests at the table from the beginning, the more likely concerns will be addressed as legislation is crafted, regulations are made, and the intersection between government and new and emerging technologies grows.

Una teoría cuántica de la gravedad en 3+1 dimensiones que aproxime a la teoría de Einstein debe pagar un precio que hasta ahora nadie se había atrevido a pagar: la invarianza de Lorentz exacta. A Petr Hořava, hace un cuarto de siglo le hubieran “quemado en la hoguera,” pero este año, será recordado en los anales de la física teórica como su año: 2009, el año de Petr Hořava. Cientos de artículos se están publicando sobre su teoría. Hoy, un físico teórico “chic” tiene que trabajar en la teoría de la gravedad de Hořava-Lifshitz. ¿Que no conoces dicha teoría? No estás al loro, amigo. Nos lo cuenta Matt Visser, “Quantum gravity: Progress at a price. A potentially testable quantum field theory that can accommodate gravity but at the expense of Lorentz invariance,” Nature Physics 5: 385-386, June 2009.

¿Confirmará el satélite Planck sus predicciones sobre la polarización del fondo cósmico de microdondas y obtendrá Petr Hořava un ansiado Premio Nobel de Física? Muchos no lo creen así y las críticas, cual bofetadas, han empezado a lloverle a Hořava por doquier. ¿Aguantará todos los embites? Ahora mismo en Strings 2009, en Roma, mucha gente debe estar discutiendo largo y tendido las ideas de Petr. Sólo el tiempo nos dirá lo que salga de dichas discusiones.

Petr Hořava (pronunciando la ř como en Antonín Dvořák) escribió un artículo que pasó bastante desapercibido en el ArXiv: ”Membranes at Quantum Criticality,” JHEP 0903: 020, 3 Mar 2009 (ArXiv preprint). Proponía una teoría no relativista para la gravedad en la que separa el espacio y el tiempo (que Einstein unió), en la que el tiempo es invariante ante un cambio , con z=2 (en relatividad z=1). Aparentemente algo inocuo. Un mero flirteo de un físico teórico de cierto renombre con la gravedad de Einstein. Pero Petr guardaba una bala oculta en la recámara de su revólver (¿qué pasa cuando z=3?). Una bomba que ha explotado con sus dos últimos artículos, aparecidos en ArXiv en enero y febrero, aceptados en marzo en Physical Review D y Physical Review Letters. Una bomba que ha generado toda una tormenta en ArXiv, donde casi todos los días aparecen 1 o 2 artículos relacionados con su teoría. Los artículos que hay que leer para estar al día en física teórica son Petr Hořava, “Spectral Dimension of the Universe in Quantum Gravity at a Lifshitz Point,” Phys. Rev. Lett. 102: Art. 161301, 2009 (ArXiv, Submitted on 23 Feb 2009) y Petr Hořava, “Quantum gravity at a Lifshitz point,” Phys. Rev. D 79: Art. 084008, 2009 (ArXiv, Submitted on 26 Jan 2009). Este último paper, hoy, según SPIRES-HEP ha sido citado 85 veces (el primero solo 46 veces).

Eres físico teórico: tienes que escribir artículos a favor o en contra de la teoría de Hořava-Lifshitz. Serán ampliamente citados en los próximos meses. Sé de los pioneros y tu CV recibirá la recompensa. No importa si la teoría de Hořava-Lifshitz sobrevive a las críticas o no, tu CV lo agradecerá. Cualquier cosa que hayas hecho sobre teoría de la gravedad ¿cómo cambia cuando se aplica la teoría de Hořava-Lifshitz? Todo un filón para cientos, digo cientos, miles de físicos relativistas.

Petr Hořava, físico teórico de la University of California, Berkeley, EEUU, afirma haber logrado desarrollar una teoría cuántica de campos de la gravedad que es renormalizable en 3+1 dimensiones, aunque no es relativista. Una teoría cuántica de campos no relativista de la gravedad. Esta teoría es aplicable a corta distancia y permite comprender el comportamiento de los gravitones (las partículas que propagan la gravedad). Lo sorprendente es que a larga distancia, él afirma que se recupera la teoría relativista de Einstein de la gravedad. Tanto la velocidad de la luz, como la constante de Newton y la constante cosmológica emergen en este límite a partir de la teoría no relativista subyacente. La teoría tiene consecuencias que podrían ser revolucionarias. Por ejemplo, a escalas espaciales muy cortas la velocidad de la luz crece hacia infinito, luego el problema del horizonte que llevó al desarrollo de los modelos inflacionarios para la Gran Explosión se resuelve trivialmente: no es necesaria la inflación. ¡Ay va esa! Más aún, la materia oscura y la energía oscura podrían tener explicación en la nueva teoría (ya hay varias propuestas al respecto pero todavía es pronto para asegurar nada al respecto). ¡Increíble!

Cuando un físico teórico desafía al mundo, el mundo prepara sus armas y ataca en un “uno contra todos, todos contra uno.” Las hostias le están lloviendo a Petr  Hořava por todos lados. Estimo que 1 de cada 5 artículos critica su teoría. Los 4 restantes, todavía, no quieren matar a la gallina de los huevos de oro.

Las primeras críticas han ido dirigidas a la simetría que Hořava utiliza para sustituir al Principio de Equivalencia de Einstein, pero a distancias cortas, el Principio del Equilibrio Detallado (“detailed balance“) ampliamente utilizado en física estadística y de la materia condensada. La teoría de Hořava predice una constante cosmológica negativa (con el signo contrario al experimentalmente observado). Él sugiere que la ruptura a distancias grandes de la simetría de paridad implicada por dicho principio es necesaria para recuperar la teoría de la gravedad de Einstein. Pero entonces, ¿qué importancia tiene su nuevo Principio? Algunos han tratado de obtener la teoría de Hořava-Lifshitz sin usar dicho Principio y han empezado a encontrar problemas con la propia teoría. Puede que no permita obtener exactamente la teoría de Einstein, como ha predicho Hořava. Las debilidades de la teoría han empezado a aparecer a la luz.

Hořava utiliza también lo que el llama la Condición de Proyectividad, necesaria para obtener soluciones para agujeros negros compatibles con las de Schwarzschild, Reissner–Nordström, Kerr y Kerr–Newman, o para obtener modelos cosmológicos compatibles con los de Friedmann–Lemaître–Robertson–Walker. Sin embargo, dicha Condición en la gravedad de Einstein tiene su origen en la invarianza relativista. Sin invarianza relativista, cómo se justifica dicha Condición. El estudio de si esta condición es esencial para la teoría es otra línea de trabajo en la que han empezado a observarse las debilidades de la teoría. Parece que aparece un gravitón escalar (del tipo de la teoría que desarrolló Lifshitz y que está en la base de la teoría Hořava) además del gravitón usual. Hořava necesita la Condición para eliminarlo pero cómo justificar dicha condición. Sin esa condición la nueva teoría es incompatible con los resultados experimentales para la gravitación (como el comportamiento de púlsares binarios).

Recuerdas que dije antes “¿qué pasa cuando z=3?” Habrá que contestarlo. ¿Sabes lo que es la teoría del universo fractal basada en triangulaciones dinámicas causales (CDT)? En Investigación y Ciencia, septiembre 2008, pudiste leer el artículo “El universo cuántico autoorganizado,” Jan Ambjorn, Jerzy Jurkiewicz, y Renate Loll (versión en inglés “The self-organizing quantum universe,” Scientific American). El espacio tiempo está formado por bloques (simplices) que se organizan en redes o grafos que preservan la causalidad temporal. El resultado es que la dimensión efectiva de los espaciotiempos más probables es aproximadamente 4. Hořava observó que su teoría (para z=3) es compatible con la teoría CDT, una especie de límite continuo de las teorías discretas tipo CDT. Muchos han tratado de lograr una teoría continua de este tipo. La mecha estaba encendida.

Hořava ha encendido un llama con sus propios dedos y ahora mismo se está quemando. Pero no le duele. La fama, aunque efímera, nunca duele.

El amante de las críticas, Luboš Motl, desde su cervecera Pilsen, en su criti-blog “The Reference Frame,” ha dedicado dos entradas a Hořava. En la primera dejaba caer que la teoría de la gravedad de Hořava-Lifshitz era demasiado buena para ser correcta  y encontraba 4 posibles inconvenientes y concluía “demasiado bonita para ser verdad.” En la segunda sus críticas eran contundentes, al más puro estilo de Motl. Basándose en el artículo de Christos Charmousis, Gustavo Niz, Antonio Padilla, Paul M. Saffin, “Strong coupling in Hořava gravity,” ArXiv, 15 May 2009, arrete contra la teoría. La verdad, merece la pena leer sus críticas y este último artículo. ¿Se obtiene la teoría de Einstein a partir de la teoría de Hořava? No. Esta es la respuesta de estos autores. ¿Podrán Hořava y sus seguidores lograr que así sea? No, si mantienen la idea de que la teoría no sea relativista. Suena fuerte, pero así son los comentarios de Motl. Para él solo existen el blanco y el negro. La moraleja de Luboš os la copio en inglés.

“I think that this episode is just another manifestation of the crucial role played by the local Lorentz symmetry in the context of General Relativity and its extensions. There exist good theoretical reasons why these principles should be obeyed exactly. And in fact, there exist empirical reasons, too. String theory is the only framework that goes beyond the classical theories written down by Einstein around 1916, that respects the corresponding consistency conditions in this extended framework, and that respects these principles exactly.”

Otro artículo reciente que critica fuertemente la teoría es D. Blas, O. Pujolas, S. Sibiryakov, “On the Extra Mode and Inconsistency of Horava Gravity,” ArXiv, Submitted on 17 Jun 2009. La teoría en sus formulaciones actuales es calificada de inconsistente. ¿Será capaz Petr de superar estas críticas y cual ave fenix resurgir de sus cenizas?

La Facultad de Ciencias Jurídicas y Sociales de la UCEN lanzará un Centro de Derecho y Tecnologías, unidad que se enfocará a la investigación, extensión y docencia en áreas de interrelación entre el Derecho, la informática, las telecomunicaciones, la biotecnología, la propiedad intelectual y las políticas públicas.

La idea es generar cursos de pregrado, diplomas de posttítulo, proyectos de investigación, programas de Magíster, publicaciones especializadas, proyectos de cooperación internacional (Latinoamérica y Unión Europea), consultorías y asesorías a organismos públicos y privados.

La masificación de las tecnologías de la información y las comunicaciones requiere de la existencia de Centros altamente especializados que se aboquen al análisis crítico del Derecho vigente, a efectos de analizar su adecuación a las nuevas formas de hacer o a los nuevos fenómenos.

Estos Centros deben ser capaces de detectar las brechas que afectan a la realidad jurídica y social para proponer las soluciones adecuadas que permitan cerrarlas.

Deben, además, tener la capacidad de intervenir en todas las áreas sociales, para propiciar el tránsito de una sociedad cuyo sistema legislativo fue diseñado para regular las relaciones en sociedades analógicas y presenciales, hacia una etapa en que podamos hablar en propiedad de “un Estado inmerso en la Sociedad de la Información”. Ello requiere diseñar estrategias de anticipación, análisis y desarrollo de cuerpos legislativos, capacidades para generar una oferta de capacitación no sólo dirigida a abogados, sino a otros profesionales de la sociedad de la información, como médicos, sociólogos, periodistas, ingenieros, etc.

En este contexto, la misión del Centro de Derecho y Tecnologías (CDT) es el análisis crítico del Derecho vigente a la luz de la realidad tecnológica y sus avances. Se busca, a partir de la doctrina y Derecho comparado, realizar investigaciones y contribuciones a la discusión legislativa y a las políticas públicas que hagan posible la definición de los estándares jurídicos que habrán de respetarse a nivel nacional, en la nueva sociedad del conocimiento.
