Ich bin mehr oder weniger durch Zufall drauf gestoßen &#8211; weil es doch jetzt seit zwei Tagen die SC:10 kostenlos zum Download gibt. Naja &#8230; keine Ahnung, ob das wirklich ne Relevanz hat, aber auf jeden Fall haben die da so Download Chart-Listen und da hat sich die SC:10 direkt auf Rang 2 hochgeschossen. Einzig Trackmania scheint unter den kostenlosen Games aktuell noch beliebter zu sein.</p>

Climategate shifts the field of debate from statistics and facts, which only a small minority are qualified to discuss, to the field of interpersonal relations and “bad behavior,” on which we can all have an opinion. It’s being pushed as a “huge scandal” precisely because it remakes climate change into a moral question about how smart people sometimes turn out to be arrogant jerks. That this moral question is totally irrelevant to the facts isn’t a bug, it’s the whole point.</p>

<description><![CDATA[Die Kläger erhoben Daten über die Nutzung von Musikliedern im Hörfunk der Bundesrepublik Deutschland]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p>Die Kläger erhoben Daten über die Nutzung von Musikliedern im Hörfunk der Bundesrepublik Deutschland und ermittelten wöchentlich durch statistische Stichproben die Verkaufszahlen der entsprechenden Tonträger. Aus diesen Daten erstellten sie sog. „Charts“, die wöchentlich die aktuelle Platzierung, den Titel und den Interpreten, das „Label“ und die in der Vorwoche erreichte Position sowie die für die Platzierung maßgebliche Punktzahl auswiesen.  Diese „Charts“ wurden in zwei Zeitschriften veröffentlicht.</p>
<p>Die Beklagten vertrieben unter dem Titel „HIT BILANZ“ in Buchform und auf CD-ROM eine Liste von Interpreten und ihren Hits, die auf dem Datenmaterial der Kläger beruhte. Diese Liste war in Zeiträume eingeteilt und sortierte die dargestellten Hitlisten alphabetisch nach den Interpreten mit den entsprechenden Zusatzinformationen wie bspw. Jahreszahlen der Chartsplatzierungen und Anzahl der Wochen in den Charts. Darüber hinaus enthielt die CD-ROM ein Suchsystem.</p>
<p>Die Kläger waren der Ansicht, dass ihre „Charts“ entweder nach § 4 UrhG oder nach §§ 87a ff. UrhG geschützt seien und sahen deshalb hierin eine Verletzung ihrer Rechte.   </p>
<p>Der BGH verneinte zunächst einen Urheberschutz gem. § 4 UrhG, da „es sich bei den „Charts“ der Kläger nicht um persönliche geistige Schöpfungen handele. Die Darstellung dieser „Charts“, also die Auswahl und Anordnung ihrer einzelnen Elemente, basiere allein auf Zweckmäßigkeitserwägungen.“</p>
<p>Jedoch bejahte er eine Schutzfähigkeit als Datenbank gem. § 87a Abs. 1 Satz 1 UrhG.</p>
<p>Schließlich bejahte er auch eine Verletzung des Leistungsschutzrechtes aus § 87a Abs. 1 Satz 1 UrhG durch die Übernahme der Daten seitens der Beklagten.</p>
<p>Dazu führte er aus, dass „die Vervielfältigung dann ein Eingriff in das ausschließliche Recht des Datenbankherstellers sei, wenn sie einen nach Art oder Umfang wesentlichen Teil der Datenbank betrifft.“ </p>
<p>Dieses bejahte der BGH in diesem Fall. </p>
<p>Denn seiner Ansicht nach, „komme es nicht auf die Übernahme der Anordnung der Daten in einer der Datenbank des Herstellers entsprechenden Gestaltung an, weshalb eine andersartige Anordnung der entnommenen Daten durch den Verwender nicht dazu führe, dass diese ihre Eigenschaft als wesentlichen Teil der Datenbank verlieren“.<br />
Daher waren die Unterschiede im Aufbau und der Anordnung der Daten zwischen den „Charts“ der Kläger und der Liste des Beklagten unerheblich.</p>
<p>Mein Fazit:</p>
<p>Bei dem Schutz des § 87 a UrhG handelt es sich um einen Investitionsschutz und nicht um den Schutz einer persönlichen geistigen Schöpfung. § 4 UrhG und § 87 a UrhG sind nebeneinander anwendbar, so dass ein Urheberschutz neben einem Leistungsschutz in Betracht kommt. Soweit die Verfolgung von Zweckmäßigkeitserwägungen den Aufbau und die Gestaltung der Datenbank bestimmen, kommt jedoch nur ein Leistungsschutz in Betracht.   </p>

Super Junior – M sweeps music charts in Taiwan, China, Philippines and Thailand.<br />
According to SM Entertainment, the mini-album ‘SUPER GIRL’ which was just released in the Philippines on the 18th managed to find their way into the Philippines’ music chart ‘MUSIC ONE TOP 25′ in the first week of release and was ranked #1 in the second week of November.</p>
<p>‘MUSIC ONE TOP 25′ chart, being the largest music chain in the Philippines released a weekly chart after tallying the aggregate amount of album sales, revealing that ‘SUPER GIRL’ is indeed number one in the Philippines and abroad thus naming Super Junior – M an Asian superstar.</p>
<p>“Before Super Junior-M’s ‘SUPER GIRL’, Super Junior Vol 3 ‘SORRY, SORRY’ also topped the chart, making Super Junior the first South Korea’s artist to set up a record of having two number one albums,” said an official at Universal Records, who is in charge of music distribution of Super Junior in the Philippines, disclosing the high rate of popularity among local customers.</p>
<p>Super Junior-M’s title track ‘SUPER GIRL’ also topped the chart in Thailand Channel [V] Countdown for 2 consecutive weeks (November 2 to November 15) confirming a dynamic performance of the group.</p>
<p>“We have tried our best in our first mini-album’s promotion and we would like to send our thanks to our fans who have showed us a lot of attention. We will endeavor to show you a great performance”</p>

<p>This was reported on Mediatakeout. Never buy their story but this seem accurate. Here&#8217;s what they also reported.<br />
MediaTakeOut.com learned that Rihanna and her people are PANICKING!!! According to our insider her label Def Jam is extremely worried that Rihanna&#8217;s new album, Rated R is not performing.</p>
<p>And it gets worse. Early numbers say that Rih has been outpaced 2x over by UK singer Susan Boyle and a Lady Gaga Rereleases. So it&#8217;s looking like she may only have a number 3 record.</p>
<p>To save face, MediaTajkeOut.com learned that Def Jam marked down her album price to $3.99 on Amazon yesterday. And that today they&#8217;re having an early morning meeting to decide whether to sell it as a .99 cent special on black friday.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>We were sitting in a small, dark booth drinking expensive beer when Abby and I decided that we had a ethical (perhaps even a moral) obligation to explain something to you.</p>
<p>One of the things that united us as Jerks With Glasses &#8211; aside from the fact that we, you know, both wear glasses &#8211; is an abiding love of categorization.  This love led us to create a tongue-in-cheek photographic archive of people on boats (with such categories as UNSAFE!, your kids are bored, and phallic symbols).  It led us to produce a series of events that neatly organize your moments of adolescent humiliation into themes.</p>
<p>And it is leading us, over the next several weeks, to present to you a taxonomy of jerks (with glasses).</p>
<p>It is our hope that you will use this information to orient yourself to the world with a better understanding of the motivations (and often the poor choices) of those that surround you.</p>
<p>In planning this taxonomy, we sketched out a chart*.  One axis denotes the level of influence or the amount of power a jerk has.  We have affectionately named the other axis &#8220;The Fuck You Axis,&#8221; which should be self-explanatory and accounts for an important problem we&#8217;ve encountered when writing about jerks.  There are some jerks you admire and some jerks you really loath.</p>
<p>And so begins your Snarkimental Education:<br />
HIPSTERS WITH GLASSES BIGGER THAN YOURS</p>

<p>We agonized over how to define this category.  It hits a little close to home.  We have prominent frames.  We listen to music that&#8217;s generally better than yours.  We have vintage aprons and cookbooks.  We watch our artsy tv series with the French subtitles turned on.  We&#8217;ve created this site, for goodness sake.</p>
<p>But we&#8217;re not sure we want to be considered <a href="http://www.time.com/time/arts/article/0,8599,1913220,00.html">&#8220;the dead end of Western civilization.&#8221;</a></p>
<p>So.  Here it is.  Hipsters recycle prior trends without a fleck of authenticity.  So, remember those Sally Jesse Raphael frames your mother inexplicably made you wear in middle school?  Yeah.  Hipsters like those.  Remember Elvis Costello&#8217;s glasses (great band name, by the way)?  They wear those without recognizing the man to whom they ought to be paying homage.  Hipsters are jerks because they hate history.  They hate history while pretending not to care.</p>
