<title><![CDATA[Breaking Down Barriers…or Doors - Part Deux]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p>6:30pm &#8211; Currently I&#8217;m in <strong><a href="http://www.world-airport-codes.com/united-states/gainesville-regional-2466.html" target="_blank">GNV</a></strong> sitting on a broken airplane. We got down here with no problems, but now things seemed to have spiraled out of control.</p>
<p>As soon as we open the door to deplane the gate agent asks when I&#8217;ll be ready to board again because apparently they want to get these people out of here. We only have 19 passengers so I asked for five minutes.</p>
<p>Everyone gets on and gets settled, but we&#8217;re still not even fueled, and the fueler is busy with another plane, so we wait. ATC has given us a window of 10-12 minutes past the hour to get off the ground before we have to wait on another slot; the flight deck clock says nine minutes past and we&#8217;ve not even been fueled.  I&#8217;m not too sure we&#8217;ll make that window.</p>
<p>After a few minutes we have our 6,500 pounds of Jet A fuel and the captain tells me I&#8217;m clear to close the door. I press the door assist button, and wouldn&#8217;t you know the thing doesn&#8217;t work. I&#8217;ve been in this spot before, but it doesn&#8217;t make it any more pleasant, not at all. In addition to a main cabin door that won&#8217;t close, the galley service door is showing as open. That problem is identified as a circuit breaker that keeps popping out.</p>
<p>The captain gets on the horn with maintenance, and they end up sending a contract maintenance guy out. He takes 45 minutes to arrive. Right now, I&#8217;m just drinking hot chocolate hoping we cancel, because a pilot that I met earlier today will be down here to overnight, and she&#8217;s got great freckles and pretty eyes.</p>
<p>I&#8217;ll update as news breaks.</p>
<p>7:20pm &#8211; Update: The guy came, and it was a quick fix. Something about a wire in the cargo hold that &#8220;popped&#8221; and deactivated all the door sensors causing them to go inop.  At least we didn&#8217;t have some aircraft safety guru trying to tell me we failed our safety inspection this time.</p>
<p>We were supposed to overnight in <strong><a href="http://www.world-airport-codes.com/united-states/lovell-field-1393.html" target="_blank">CHA</a></strong>, but now we spend the night in <strong><a href="http://www.world-airport-codes.com/united-states/charlotte-douglas-1382.html" target="_blank">CLT</a></strong> when we get back. That&#8217;s fine with me. I don&#8217;t get to see the cute pilot, but I do get to drink cheap beer and get paid for a flight I&#8217;ll never work. Rum all &#8217;round!</p>

<p>US Airways&#8217; (Phoenix) pilots, represented by The US Airline Pilots Association (USAPA), announced yesterday (November 30) that it is seeking a full investigation on the impact of a proposed slot, gate and facility transaction between US Airways and Delta Air Lines at New York’s LaGuardia and Washington’s Reagan National airports. In a letter to Christine Varney, assistant attorney general of the Department of Justice’s Antitrust Division, USAPA stated that this transaction may have serious antitrust concerns.</p>

<p>In the best known methodology handbooks, foreign language teaching is viewed through the lens of a few closely related European languages. Their grammars are often transparent for each other. This explains to some extent the severe doubts cast upon grammar teaching in general, rather than only against its misuse.</p>
<p>But a focus on grammar is not only indispensable for remote languages. It can really help the learner by making “odd” constructions meaningful and transparent, for instance through idiomatic and literal translation (“mirroring”) combined. That is why grammar should not be dealt with in a cavalier fashion. However, at all times the teacher must discipline himself to be brief, to confine the focus on form – in whatever way it is done – to matters of immediate practical relevance, and above all, to be clear. That is no easy matter for any language. On the other hand, for many foreign languages taught in schools excellent grammars have been made available, which represent a great advance on the grammars of earlier centuries.</p>

<p>A few nights ago I was boarding a plane to <strong><a href="http://www.world-airport-codes.com/united-states/tallahassee-regional-airport-9065.html" target="_blank">TLH</a></strong>.  It appeared to me that we had a good group of passengers on board.  We weren&#8217;t full, we were on time, and 75% of the crew was pretty rockin&#8217;.  As I&#8217;m closing the main cabin door a ramper comes scampering up waving his hand to get me to stop.  The door is roughly halfway closed, but I release the Door Assist button, dropping the 200 pound door back to the ground.  As <a href="http://ararity.wordpress.com/files/2009/11/blog-pictures-003.jpg"><img class="alignleft size-medium wp-image-218" title="motor housing covers" src="http://ararity.wordpress.com/files/2009/11/blog-pictures-003.jpg?w=300" alt="" width="180" height="135" /></a>soon as I release the button, though, I see that the aforementioned ramper is standing under the door . . . kind of like an idiot would do.  Not wanting to hit him in the head I quickly press the Door Assist button so he can move himself out of harm&#8217;s way before letting the door drop again.  He tells me that the captain needs to add three more checked bags into the fancy computer.  We do that, the captain tells me we are once again clear to close the door, and I hit the button for the third time.</p>
<p>Only this time nothing happens.  The door just sits there on the ground like a jerk.  After a few minutes maintenance comes out to the plane and diagnoses the problem as a faulty motor.  We are given the option to swap aircraft or have them repair it.   Thankfully, our large-nostriled captain wants to just repair the motor and that&#8217;s what happens.  It would have been a royal pain in the butt to find a plane, deplane everyone, transfer bags, cater the plane, do our checks, and board them up again.  Plus, when passengers have to get off a plane before it even leaves its originating point they seem to get a lot crankier.  Crisis averted. <p>While we&#8217;re waiting for the maintenance guys to finish some brainiac in the back asks the other flight attendant if our planes have safety inspections.  Obviously she tells him they do, and he proceeds to tell her that this particular plane has failed, like he knows anything about aircraft maintenance or safety.  No way.  No way!  I wonder what he says and how he feels when he has to fill his gas tank or change a tire on his &#8216;94 Ford Escort.  What a jabroney!</p>
<p>We get the thing fixed and make it to TLH only about 30 minutes late because, yeah, we&#8217;re that good.  Most of the passengers were fine and didn&#8217;t mind the slight delay.</p>
<p>And as it turns out I had to do a line check on someone down to TLH a few days later, and one of the same guys was on the plane going back to CLT.  Thankfully, it wasn&#8217;t Mr. Aircraft-Door-Safety-Man.  Getting to the point &#8211; this whole thing could have been avoided if the ramper had thought to himself that it might not be such a bright idea to stand under a rather large aircraft door as it falls open, or maybe even just tell the flight crew over the radio to add more checked bags.  But at least he wasn&#8217;t hurt and I didn&#8217;t get in trouble for &#8220;breaking&#8221; the motor.</p>

<title><![CDATA[Learning and Teaching English in German All-day Schools]]></title>

<p>The 2009 National GGT Conference took place at Karlsruhe University of Education between Wednesday, November 11 and Friday, November 13.  Focused on the further development of all-day schooling in Germany (<em>&#8220;Ganztagsschulen &#8211; Motor der Schulreform&#8221;</em>), it provided a great opportunity for researchers, headmasters and teachers, education policy makers and administrators to share concepts, strategies and personal experiences, and to discuss future directions (background information: the majority of schools in Germany are half-day schools). On Thursday, November 12 all of the several hundred participants were given the chance to visit various types of all-day schools in Karlsruhe and in the surrounding area and see them in action (including free public transport). In my view, the organizers accomplished a (logistic, etc.) masterpiece that day.</p>
<p>As a researcher interested in how theory and practice can be brought together more closely, this was definitely one of the highlights, something that should be taken into consideration for all future conferences focusing on school development and on the quality of education (including the teaching of English as a foreign or second language).</p>
<p>I was generously invited to conduct a 2 1/2 hour workshop on learning and teaching English as a foreign language in all-day schools in Germany (<em>&#8220;Englischunterricht an Ganztagsschulen: Herausforderungen, Erfahrungen und Konzepte, Praxisbeispiele&#8221;). </em>The central questions raised in this workshop were:  Does it make any difference to teach English as a foreign language in all-day schools (as compared to half-day schools)? What are the advantages and disadvantages, potentials and limits? Do we, perhaps, need specific approaches to learning in afternoon lessons, including specific designs of instruction? And, more specifically related to current SLA / EFL research: How is discovery, inductive, increasingly self-regulated grammar, vocabulary, culture etc. learning possible, if students are tired, disinterested, no longer capable or willing to learn between 1.30 and 4 pm?</p>
<p>A lively discussion arose. Whereas some participants argued that successful foreign language education and learning in all-day schools largely (but of course not only) depended on the organization of the school day, i.e. on &#8216;pedagogically&#8217; convincing timetables (an optimal balance of lessons and breaks), others felt that more emphasis needed to be placed on learners and learning processes in afternoon lessons, especially on the development and implementation of specific, less linear instructional designs geared toward maintaining learners&#8217; interest and motivation and toward keeping them on task and focused. <p>Since schooling is naturally understood in other countries as all-day schooling, it would be very interesting to hear your thoughts on this.</p>

<p style="font-style:italic;">As entidades sindicais, mesmo alegando liberdade sindical, não estão autorizadas a “efetuar ajustes” e estipular novos valores da contribuição por meio de assembleias ou resoluções, sob pena de ofensa ao princípio da legalidade. Com esse entendimento, a 40ª Vara Trabalhista da capital paulista <a href="http://s.conjur.com.br/dl/devolucao-contribuicao-sindicato.pdf">julgou</a> procedente o pedido de restituição da empresa Gtech Brasil das contribuições feitas ao Sindicato das Empresas de Processamento de Dados e Serviços do Estado de São Paulo (Seprosp).</p>
<p>A decisão determinou que a empresa fosse reembolsada dos valores pagos de 2005 a 2008 e “eximida da obrigação de pagar” os mais de R$ 5 mil que se constam como devidos pelo ano de 2009. Segundo o advogado da empresa, <strong>Daniel Lourenço</strong>, do Leite, Tosto e Barros Advogados Associados, embora a cobrança de contribuições sindicais esteja prevista na CLT (Consolidação das Leis do Trabalho), sindicatos e confederações têm embutido em suas tabelas todos os expurgos inflacionários que julgam devidos. “Especialmente durante o período de 1979 a 1991, época em que o MVR (Maior Valor de Referência) ainda existia como base de conversão para a Unidade Fiscal de Referência (Ufir)”, afirma. “Some-se a isso os arredondamentos que cada sindicato faz, o que justifica também a disparidade entre as bases de cálculo de cada um”.</p>
<p>Segundo a juíza Eumara Nogueira Borges Lyra Pimenta, de acordo com a CLT, “a contribuição sindical será recolhida, de uma só vez, anualmente, e consistirá para os empregadores, numa importância proporcional ao capital social da firma ou empresa”. A sentença ainda determina que os valores devem ser calculados mediante “a aplicação de alíquotas, conforme a tabela progressiva”, prevista em lei.</p>
<p>Para Lourenço, como cada categoria de sindicato aplica reajustes inexistentes, aumentando consideravelmente o valor a ser cobrado, a quantia cobrada é bem superior aos valores efetivamente devidos. “Sendo assim, surge a possibilidade de se questionar judicialmente a base de cálculo adotada pelas federações e sindicatos, vez que não foi observado por estes o princípio da legalidade”, afirma.</p>

<p><span style="font-family:Arial;color:#000000;font-size:x-small;"><span style="font-size:small;">Os trabalhadores em seus direitos garantidos pela Consolidação das Leis do Trabalho (CLT). Alguns pontos foram modificados por legislações específicas ou alterações na própria CLT. <li><span style="font-size:small;">Carteira de trabalho assinada desde o  primeiro dia de serviço;</span></li>
<li><span style="font-size:small;">Exames médicos de admissão e  demissão;</span></li>
<li><span style="font-size:small;">Repouso Semanal Remunerado (1 folga por  semana);</span></li>
<li><span style="font-size:small;">Salário pago até o 5º dia útil do  mês;</span></li>
<li><span style="font-size:small;">Primeira parcela do 13º salário paga até  30 de novembro. Segunda parcela até 20 de dezembro;</span></li>
<li><span style="font-size:small;">Férias de 30 dias com acréscimos de 1/3 do  salário;</span></li>
<li><span style="font-size:small;">Vale-Transporte com desconto máximo de 6%  do salário;</span></li>
<li><span style="font-size:small;">Licença Maternidade de 120 dias, com  garantia de emprego até 5 meses depois do parto;</span></li>
<li><span style="font-size:small;">Licença Paternidade de 5 dias  corridos;</span></li>
<li><span style="font-size:small;">FGTS: depósito de 8% do salário em conta  bancária a favor do empregado;</span></li>
<li><span style="font-size:small;">Horas-Extras pagas com acréscimo de 50% do  valor da hora normal;</span></li>
<li><span style="font-size:small;">Garantia de 12 meses em casos de  acidente;</span></li>
<li><span style="font-size:small;">Adicional noturno de 20% para quem  trabalha de 22:00 às 05:00 horas;</span></li>
<li><span style="font-size:small;">Faltas ao trabalho nos casos de casamento (3 dias), doação de sangue (1 dia/ano), alistamento eleitoral (2 dias), morte de parente próximo (2 dias), testemunho na Justiça do Trabalho (no dia), doença comprovada por atestado médico;</span></li>
<li><span style="font-size:small;">Aviso prévio de 30 dias, em caso de  demissão;</span></li>

<p><span style="font-family:Arial;color:#000000;font-size:x-small;"><span style="font-size:small;"><strong>OBS.: </strong>Esses são alguns dos  direitos assegurados pela CLT, mas verificar sempre as <strong>CONVENÇÕES  COLETIVAS DE TRABALHO</strong> que muitas vezes oferece melhores vantagens. Como por exemplo no caso das horas extras em algumas convenções tem garantido acréscimos de 100%.</span></span></p>

<p><span style="font-family:Arial;color:#000000;font-size:x-small;"><span style="font-size:small;"><strong>11. INDENIZAÇÃO ADICIONAL DO EMPREGADO DISPENSADO SEM JUSTA CAUSA NO PERIODO DE 30 DIAS QUE ANTECEDE A CORREÇÃO SALARIAL (Art. 9º das leis nº 6.708/79 e 7.238/84)</strong></span></span></p>
<p><span style="font-family:Arial;color:#000000;font-size:x-small;"> </span></p>
<p><span style="font-family:Arial;color:#000000;font-size:x-small;"><span style="font-size:small;">O empregador que dispensar o empregado sem justa causa, no período de 30 (trinta) dias que antecede a data de sua correção salarial (data-base), pagará ao trabalhador dispensado indenização adicional equivalente a um salário mensal do próprio empregado. Com referência ao Aviso Prévio Indenizado, se o último dia do aviso prévio cair no período de 30 dias que antecede a correção salarial, esse fato gera direito à indenização de que se trata, posteriormente à saída física do empregado, considerando que esse aviso prévio fica integrado ao período de serviço.</span></span></p>
<p><span style="font-family:Arial;color:#000000;font-size:x-small;"> </span></p>
<p><span style="font-family:Arial;color:#000000;font-size:x-small;"><span style="font-size:small;"><strong>12. O QUE COMPREENDE O  SALÁRIO?</strong></span></span></p>
<p><span style="font-family:Arial;color:#000000;font-size:x-small;"> </span></p>
<p><span style="font-family:Arial;color:#000000;font-size:x-small;"><span style="font-size:small;">Nos termos do art. 457 da CLT, integram a remuneração do empregado, para todos os efeitos legais: as gorjetas, as comissões, percentagens, gratificações ajustadas, diárias para viagem, abonos, além das ajudas de custos superiores a cinqüenta por cento do salário percebido pelo empregado.</span></span></p>
<p><span style="font-family:Arial;color:#000000;font-size:x-small;"> </span></p>
<p><span style="font-family:Arial;color:#000000;font-size:x-small;"><span style="font-size:small;">Também, integram os salários os adicionais noturno, de insalubridade e periculosidade, o adicional por tempo de serviço, as horas extras, o adicional de quebra-de-caixa e demais remunerações habitualmente pagas pelo empregador.</span></span></p>
<p><span style="font-family:Arial;color:#000000;font-size:x-small;"> </span></p>
<p><span style="font-family:Arial;color:#000000;font-size:x-small;"><span style="font-size:small;"><strong>FÉRIAS PROPORCIONAIS – tabela de  proporcionalidade e faltas</strong></span></span></p>

<p><span style="font-family:Arial;color:#000000;font-size:x-small;"><span style="font-size:small;">Após cada período de 12 meses de vigência do contrato de trabalho, o empregado terá direito ao gozo de um período de férias, sem prejuízo da remuneração, na seguinte proporção:</span></span></p>

<content:encoded><![CDATA[<div class='snap_preview'><p><img class="alignleft" title="Courtesy http://www.destination360.com/caribbean/bahamas/freeport" src="http://www.destination360.com/caribbean/bahamas/images/s/bahamas-freeport.jpg" alt="" width="155" height="124" />Hip, hip, hooray!  We&#8217;re picking up new service to two new destinations early next year.  Yesterday the Check Flight Attendant group (of which I am a part because I&#8217;m a big deal) received an email that on 11 January we&#8217;ll start back service to <strong><a href="http://www.world-airport-codes.com/bahamas/grand-bahama-international-11416.html" target="_blank">FPO</a></strong>.  My airline has performed this service in the past but discontinued it before I started.  We were told a few weeks ago that &#8220;we may have an opportunity to perform  international operations beginning first quarter 2010,&#8221; and obviously there was speculation as to where we&#8217;d go.  We all figured it was either Canada or the Bahamas.  Personally, I was hoping for Canada because we would overnight there while Bahamas would just be a turn, and we all know I&#8217;m here for the stamps in my passport, not to end up in <strong><a href="http://www.world-airport-codes.com/united-states/northwest-arkansas-regional-8186.html" target="_blank">XNA</a></strong>.  Either way, I&#8217;m pretty pumped about the once daily service, even if <strong><a href="http://www.world-airport-codes.com/united-states/charlotte-douglas-1382.html" target="_blank">CLT</a></strong> crews get to work the flights.  Anyway, at least we&#8217;ll be doing the turn on the <strong><a href="http://en.wikipedia.org/wiki/Bombardier_CRJ700" target="_blank">700 (CRJ-700)</a></strong> so if I do get to do it I won&#8217;t be stuck all by my lonesome.  Perhaps in the coming months we <em>will</em> start back service to Canada.  A boy can hope, right?</p>
<p><img class="alignright" title="Courtesy http://www.gatewaygourmet.com/images/melbourne.jpg" src="http://www.gatewaygourmet.com/images/melbourne.jpg" alt="" width="223" height="179" />Also, while waiting out a <strong><a href="http://en.wikipedia.org/wiki/Air_traffic_flow_management" target="_blank">flow control program</a></strong> into CLT I got on my fancy iPhone and saw that we&#8217;ll also be starting service to Florida&#8217;s Space Coast on 11 February, going to <strong><a href="http://www.world-airport-codes.com/united-states/melbourne-international-airport-4647.html" target="_blank">MLB</a></strong> after a 12-year hiatus.  This we&#8217;ll be doing three times a day, seven days a week on the 700 as well.  This is an overnight so maybe I can score this one and hit up the Space Center; I&#8217;ve always wanted to be an astronaut.  In fact, should NASA contact me today about going to the moon I&#8217;d leave my job and be there most Rikki-Tik.</p>
<p>So we&#8217;re getting new service, but here&#8217;s the rub: just because we serve new destinations doesn&#8217;t mean we&#8217;re growing.  It doesn&#8217;t mean we&#8217;re not, though.  A lot of times when one carrier starts service to a new city, they also lose service to an existing destination to another affiliate carrier.  My hope is that, at the very least, a non-wholly owned carrier doesn&#8217;t pick up some service that we gave up; we are a small airline after all and I&#8217;d rather grow than shrink to some jabroneys with an SA5P boarding priority.  I guess we&#8217;ll see what happens in the coming months.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>The great thing about elections:  hypotheses are tested and questions are answered.  A campaign manager can tell a candidate, “We need to win these precincts by this much in order to win.”  On election day, you find out not only if you could win those precincts but if you were right that they were the key to victory.”  I didn’t put forward any such hypotheses this year, but I did raise some questions.  Let’s answer them:</p>
<p><strong>Question 1 for 2009:  Will Charlotte’s move towards partisan divide continue?</strong></p>
<p><strong> </strong></p>
<p>Citing at-large city council races from 1997 and 2005, I suggested Charlotte was growing more divided on partisan lines.  I broke precincts into four categories “Straight Democrat,” “Straight Republican,” “Winner Ticket” and “Random Mixed.”  I did hear some concern about picking just two data points, so before we look at 2009, let’s look at all four elections in the last 12 years in which both parties ran 4 candidates for at-large city council.</p>

<p>Obviously, the addition of 2001, and 2005 alter the view of a steadily progressing march towards partisanship.  Apparently, the national political climate, candidates and campaigns make a difference.  No doubt.  I draw two conclusions from this data that are more nuanced than “Charlotte is becoming more divided by partisanship.”  1.  Straight party Democratic precincts are on the rise.  2.  When precincts split tickets, they are more likely to give their votes to candidates who don’t win.  So what did 2009 deliver?  More partisanship.</p>

<p><strong>Question 2 for 2009: Will a fractured District 3 vote lead to a surprise winner?</strong></p>
<p><strong> </strong></p>
<p>This wasn’t a perfectly worded question, as someone could certainly say that they were surprised by Joyce Waddell’s victory.  But it wasn’t the type of surprise I contemplated.  In fact, considering there were 9 candidates, the outcome was surprisingly predictable.  The runner-up had been endorsed by the Charlotte Observer.  The winner had the nod of the Black Political Caucus.  Since the Black Political Caucus hands out their list at the polls and the Observer does not, it really isn’t that surprising that their endorsement is apparently more impactful, at least in this district.  Here were the district 3 results:</p>

<p><strong>Question 3- Does the early vote indicate Anthony Foxx (D) holding Unaffiliated and white Democrats or is John Lassiter (R) winning most of those votes?</strong></p>
<p><strong> </strong></p>
<p><strong>I offered this guidance last weekend: </strong></p>
<p><strong> </strong></p>
<p><em>If Foxx holds a 3000 vote lead or more when the early vote is reported, it will indicate that he is doing well among white Democratic voters and will likely expect victory a few hours later.  If however, the early vote shows Lassiter within 1000 votes or so, it will indicate that he is pulling a significant amount of both Unaffiliated and white Democrats. That will mean a long night where voter turnout becomes the key question.</em></p>
<p><em> </em></p>
<p>That guidance really wasn’t helpful when the two split the difference and Foxx emerged from the early vote with a 2,200 vote lead.  Implicit in my projection, however, was that the Democratic get-out-the-vote machine would carry the early vote but Lassiter would make up ground on Election Day.  That didn’t happen.  Foxx not only won early voting, he won Election Day voting.  And, while we don’t have exit data to help us, if we assume that Foxx won the African-American vote at about the same rate that Lassiter won the Republican vote, then we can deduce that Foxx won the White-Democrat/Unaffiliated vote by about 3-1.  That will do it.</p>
<p><strong>Question 4: Are demographics electoral destiny?</strong></p>
<p><strong> </strong></p>
<p>We won’t know for several weeks what the demographic breakdown was on Election Day, so I’m going to use this space to add my opinion to the “key precinct” analysis that you may have seen elsewhere.  The Charlotte Observer cites <a href="http://" target="_blank">30 precincts</a> that voted for Republican Pat McCrory in 2007 and Foxx in 2009.  Meanwhile, Jeff Taylor at MeckDeck points <a href="http://charlotte.johnlocke.org/blog/?p=5550" target="_blank">to low turnout in some south Charlotte precincts </a>as the “bigger story.”  I’ve always believed that when you lose a close race (51.5 % to 48.5% in this case) there isn’t one thing that cost you, there are twelve.  If you’d turned any one of them around, you might have one.  Similarly, if you win a close race, you didn’t do one thing right, you did twenty.  And if you had done any one of those wrong, it could have cost you.  Having said that, I point to these nine precincts that made the difference.  Across these precincts, Anthony Foxx picked up 3,454 votes net against Lassiter compared to how Democrat Beverly Earle fared against Republican Pat McCrory two years ago.  Foxx’s margin of victory, 3,239</p>

<p>These precincts really illustrate the different ways that Foxx won.  Precincts 210 and 16 are Democratic strongholds where Foxx used voter turnout to improve upon his party’s effort two years ago.  (In precinct 16, Foxx won 1037-3.  THREE!  You’d expect Lassiter to get more than 3 votes just by people accidently pushing the wrong button).  These are reliable boxes where the Democratic machine picked up votes.</p>
<p>Precinct 203 was a new precinct for this election, added through annexation.  It provided one of Foxx’s biggest swings and perhaps sheds light on precinct 145.  John Lassiter won this precinct that includes Highland Creek but not by a significantly lower margin than McCrory in ’07.  This precinct grew due to annexation, and it’s not clear if the vote swing was the result of attitude changes or annexation.</p>
<p>Foxx also did well on the edges of the University area (212, 204, 203), just outside of downtown (11) and the Derita area (146).</p>

<p>IBON Features—Recent tropical storms Ondoy and Pepeng reportedly caused P20 billion worth of damages to agriculture and destroyed crops amounting to P11 billion. But disaster or no disaster, this year’s Peasant Month again finds the Filipino farmer still deep in distress from the effects of unprecedented land-use conversion, land monopoly, high rent, usury and low wages, lack of government support and a litany of social injustices—or the failure that was the Comprehensive Agrarian Reform Program (CARP). </p>
<p>The CARP Extended with Reforms or CARPER, which Congess passed this year, will be hounding the peasantry for another five years as it retains the original CARP’s pro-landlord provisions. </p>
<p>Unprecedented land use conversion<br />
The conversion of agricultural lands to commercial use has left farmers only poorer and with little or no land to till. Because of land use conversions (LUCs), farm area fell by 304,078 hectares between 1991 and 2002. Under the Arroyo administration, more than 20,000 hectares of agricultural lands awarded to farmers outside Metro Manila have been canceled, displacing more than 10,000 farmer families. In 1995, a total of 2,780 emancipation patents (EPs) and certificates of land ownership award (CLOAs) covering 16, 213.36 hectares awarded to peasants were canceled mostly due to LUCs. In December 2006, the number ballooned to 108,141 EPs/ CLOAs canceled, covering 204,579 hectares. </p>
<p>No amount of lip service by the Arroyo administration calling for any moratorium can possibly recall these cases of extensive land use conversion: In 2007, through Executive Order 647, 21 barangays of the municipality of Nasugbu, Batangas covering 14,000 hectares of rice lands, sugar farms and coastal areas were declared as a major tourism destination and part of the Tourism Economic Zone. Last year, by virtue of DOJ Opinion No. 44, the Department of Agrarian Reform (DAR) approved 22,900.34 hectares of agricultural lands for exemption from CARP coverage in the Central Luzon and Calabarzon regions for conversion to either residential or commercial use. Also last year, presidential brother-in-law Ignacio “Iggy” Arroyo pushed for the conversion of his family’s 157-hectare Hacienda Bacan into agro-industrial uses, particularly for the production of ethanol. These cases of LUCs alone already cover 37,057 hectares of farmlands, surpassing 11,721 hectares approved for LUC during the Estrada administration and 19, 726.53 hectares under Ramos. </p>
<p>Earlier cases of farmlands converted for commercial, residential and eco-tourism ventures have also led to CLOA cancellations and the eviction of hundreds of peasant families such as the First Cavite Industrial Estate by Marubeni Corporation of Japan involving 232 hectares; Hacienda Looc in Batangas with 8,650 hectares, 400 hectares in Aplaya Laiya, Batangas and 218 hectares in Silang and Dasmarinas, Cavite. </p>
<p>Land monopoly fortified<br />
While government claims that the CARP has successfully reached 80% of its reduced scope, genuine land distribution remains elusive. Only 1% of the entire Philippine population still owns almost 1/5 of the country’s total agricultural lands while 2 million farmers are left to divide another 1/5 among themselves. </p>
<p>Land reform programs have been slow to acquire most of privately owned-land, including commercial farms and plantations. According to Anakpawis Rep. Rafael Mariano, only 1.9 million hectares out of 6.2 million hectares of distributed agricultural lands from 1988 to present were private. Still, data from the Department of Agrarian Reform (DAR) in 2008 shows that the remaining 1.2 million hectares of private agricultural lands for distribution under CARP’s Compulsory Acquisition actually constitutes the largest percentage of the total remaining undistributed land at 94 percent. Meanwhile, 82% of the supposedly distributed agricultural lands still have pending cases and have not yet been physically distributed. It should also be noted that the scope of CARP had actually been reduced from 10.3 million hectares in 1988 to only 8.1 million hectares. </p>
<p>The Voluntary Land Transfer (VLT) scheme has also been proven to undermine genuine land distribution, as DAR overseers attest that a huge 70% of VLTs involved landlords evading CARP coverage. Though DAR data shows the VLT mode&#8217;s accomplishment to have soared to 248% this year, its character of direct land transfer from landlords to farmers with minimal government intervention allowed relatives to be named as beneficiaries; DAR reports were tampered with to count ordinary, non-CARP land sales as CARP accomplishments and ‘joint ownership’ arrangements between landlords, agribusinesses and farmers saw the latter at the losing end. The World Bank’s concrete recommendation of completing CARP through a market-assisted land reform towards privatizing communal lands and promoting land markets, suits globalization and endorses VLTs, with limited government subsidy and assistance from international financial institutions. Thus, VLT and the voluntary offer to sell (VOS) modes are encouraged by DAR more than it perseveres in Compulsory Acquisition. </p>
<p>It is therefore not surprising that the landscape of land ownership in the Philippines has barely changed. In fact, big landlords remain dominant around the country, such as Danding Cojuangco Jr. owning 30,000 hectares in Negros, Isabela, Cagayan, Davao del Sur, Palawan and Cotobato; the Cojuangcos, Faustino Dy and Juan Ponce Enrile sharing 13,085 hectares in Iligan, Isabela; the Zobel-Ayalas with more than 12,000 hectares of land in Calatagan, Batangas and the Floreindo Family with 11,048 hectares in Davao and Davao del Norte. </p>
<p>Unjust rent, low wages and usury<br />
Apart from the ages-old miserable working conditions of Filipino peasants prevalent in foreign and local agribusinesses, haciendas and farms, feudal rent, low wages and usury continue to immiserate the Filipino peasant. </p>
<p>The 60-40 to 10-90 distribution of gross harvest favorable to landlords remains intact. In the Southern Tagalog and Eastern Visayas , studies by farmers&#8217; groups KASAMA-TK and SAGUPA-SB show that land tillers still receive a low 19%-21% of the gross sales of harvested palay. </p>
<p>The actual amount peasants earn fall way below the agricultural daily minimum wages that range from P151 to P212 nationwide: P20 per day in Negros, P50 in Samar and P69 in Cagayan Valley . In the 6,000-hectare sugar lands of Hacienda Luisita, farm workers receive a measly weekly pay of P9.50, in gross violation of the P273 daily wage set by the Regional Wage Board (RWB). In the sugar plantations of Batangas, over 50,000 agricultural workers receive P35 to P150 per day, still below the P211 set by the RWB. In the sugar lands of Negros where the RWB set wages at P203 per day, farm workers receive only P30 to P200 per day. In Far South Mindanao, where the RWB prescribed P205 per day for wages, farm workers get only P80 to P130 daily. </p>
<p>Extreme poverty compels farmers to usury, where they are obliged to pay high interest rates for credit. It ranges from 15%-35% per cropping season up to anywhere between 100%-300% per harvest and 400% per year, plus peripheral favors loan sharks demand from farmers. </p>
<p>Lack of support<br />
That Agrarian Reform Communities (ARCs) have not progressed both in scope and in terms of support received demonstrates how CARP is bound to fail even despite its five-year extension. Chosen by government to supposedly focus CARP funds on, in these barangays, agribusiness companies engage Agrarian Reform Beneficiaries (ARBs) in contract growing, joint venture or lease arrangements for the production of crops for export. These were supposed to showcase the success of CARP. </p>
<p>However, only 3 out of 10 CARP beneficiaries are covered by 1,959 ARCs. ARCs also suffer from lack of government support. Only 7.9 out of 10 ARCs or 655,437 beneficiaries have received official development assistance. Most of these beneficiaries reportedly have pending land disputes, hinting that despite the hype, the farmers have not benefited substantially at all. </p>
<p>The CARP itself suffers from lack of support. According to a German Technical Assistance (GTZ)-commissioned review of the CARP in 2007, CARP lacked the support services and credit that farmer beneficiaries needed to prosper. The study revealed DAR’s admission “that about 3 million out of the 4 million farmer-beneficiaries did not receive any support services.” The GTZ further exposed that “only 50% of the required funding for CARP was allotted by government” and “60% of the funds allotted went mainly to personnel salaries”. This is amid the decline of the share of land distribution in the national budget from 8% in 2004 to merely 3% in 2009. </p>
<p>CARPER, another tropical depression?<br />
For Filipino farmers, the CARPER is another storm to be weathered, a strengthening of the anti-peasant CARP. Under it there is no intention to plan agriculture and boost local productivity primarily to meet the people&#8217;s basic needs. It is seen to accelerate the maximization of ARCs for the benefit of big local and foreign agribusinesses, as well as perceived cronies of the administration. </p>
<p>In the wake of the recent typhoons, the Philippine Forest Corporation cited that the massive plantation of biofuel source jatropha provides sustainable income for small farmers. Note that of the 375,091 hectares planted to jatropha, 10,000 have been leased to Teves Co. owned by the brother of close Arroyo ally and Finance Secretary Margarito Teves, and 7,450 hectares were committed in a joint venture with the local government of Camarines Sur headed by the son of another Arroyo ally Cong. Luis Villafuerte, who has recently advanced in grabbing 375 hectares of farmlands in San Miguel Bulacan for commercial development. </p>
<p>This October, no less than the US Secretary of Agriculture and 20 American agribusiness firms are coming to the Philippines in a “mission” to form partnerships with 200 local companies in in accordance with the US Agricultural Trade and Assistance Act. In July, South Korean Firm Jeonnam Feedstock Ltd has leased 94,000 hectares of farmland in Mindoro to grow animal feeds. </p>
<p>According to the KMP, President Arroyo is planning to sell 3 million hectares to foreign agro-corporations, reserving 1 million hectares for the Cojuangco-Kuok Group partnership, another for China-firm Fuhua Co., a hybrid rice corporation, 40,000 hectares to the Agriculture Department of Guangxi Zhuang Autonomous Region (ADGZAR) of China, 200,000 hectares to the Beijing Hualian Group (BHG) of China, and 60,000 hectares to the Pacific Bio-Fields Corp. of Japan. </p>
<p>Pushing the peasantry deeper in poverty<br />
These ventures are seen to worsen the problems in the production of rice, vegetable and livestock industry brought about by the influx of imported agricultural products. Although some groups request for exemption, that the Philippines is party to the Asian Free Trade Agreement which will soon relax tariffs on imports including agricultural products is no consolation. The country is now the world&#8217;s no. 1 rice importer, pushing farmers and producers into deeper debt and poverty. From 2001 to 2008, farmgate prices of rice increased by only P6 per kg, from P8.17 to P14.13 per kg, while the price of rice has hiked by P12, from P17.54 to P29.38. Local production&#8217;s share to the country&#8217;s gross supply decreased from 74%to 70% while the share of imported rice increased significantly from 7% to 16 percent. </p>
<p>Weathering the storm<br />
The implementers of the failed CARP still owe the Filipino people, especially the farmers, an accounting of the P162 billion allocated for the program that ran for 20 years. There is reason to believe that the P150 billion-budget allocated for the program&#8217;s 5-year extension may end up being used to further vested landlord and business interests. </p>
<p>Similar to the devastation suffered by the people on the onslaught of Ondoy and Pepeng, the hardships imposed by anti-peasant programs, whether it be the CARP or its extended version, are borne out of a system plagued with indifference to the needs and aspirations of the people. As ordinary Filipinos are helping one another in the difficult process of rising up from the destruction caused by the super-typhoons, it is becoming ever clearer that the realization of genuine agrarian reform lies in the relentless struggle of the Filipino peasants.
