When a beaming Rathore walked out of a Chandigarh court on Monday, convicted of molestation but sentenced to just six months in jail, the verdict mocked all that our law and justice system stands for.

In the 19 years between Ruchika’s first complaint to Monday’s judgment, the crime of molestation was compounded by many other horrors. First was the long delay in filing an FIR, despite the then Haryana DGP’s recommendation. Then there was the prolonged hounding of the Girhotra family. The many cases filed against Ruchika’s brother were finally halted only after the Punjab and Haryana high court stepped in. Meanwhile, the family went into hiding, and Ruchika killed herself. Even in death, she was besmirched. In court, the defence counsel’s lengthy arguments cast aspersions on her character and that of her father. Though no charges of abetment to suicide or criminal harassment have been successfully proved against Rathore, the travesty of justice that Ruchika and her family faced — over and above her molestation — is in plain sight.

In this context, it is still some consolation that Rathore’s crime has been confirmed by a court of law — even if the sentence seems paltry for such a crime and other accusations remain unresolved. The case shows once again how inept the system can be, by design or otherwise, in speedily processing cases. Prompt registering of an FIR, a speedy trial and swift conviction might have prevented the many horrors that followed Rathore’s original crime. Besides, when there is clear power asymmetry between the perpetrator and the victim, the judicial process must be extra-sensitive to protecting the victim and complainants against retribution. S.P.S. Rathore was even at the time of the crime a powerful officer; in a shocking act of political indifference, he was promoted all the way to eventually become Haryana’s DGP. As the higher judiciary and law ministry ponder ways to speed up justice delivery, the many injustices inflicted on Ruchika Girhotra during the agonisingly long wait for justice provides a salutary, if sobering, lesson.

Pay czar, Kenneth Feinberg, has been fairly consistent in giving only bare-bones compensation to management at firms that have taken TARP funds. Most executives are making less than $500,000 in base salary. Bonuses are limited, except in the case of some AIG (NYSE:AIG) managers who threatened to leave the insurance company.
GM’s new CFO was able to get around almost all the compensation restrictions set by the government. Chris Liddell, who left the job as CFO of Microsoft (NASDAQ:MSFT) to become chief financial officer and one of the vice-chairmen at GM, will receive a first year pay package worth $6.2 million. Liddell’s base salary will be $750,000 but the substantial part of his compensation is $3.5 million in salary stock and $2 million in restricted shares. The new CEO of GMAC, Michael Carpenter, also got a special dispensation from Feinberg. He will receive a base salary of $950,000.

The case that GM may have made to Feinberg about Liddell is that it needs a financial star in the CFO’s office when the auto company goes public again, if it ever does. An IPO would give taxpayers some of their $50 billion investment in GM back, so skilled hands are critical to the process. GM might also argue that Liddell is the next CEO at the company and will take over when current chairman and interim CEO Ed Whitacre, a former telephone company executive, steps down.

There will be a lot of unhappy executives at the banks that took TARP money or had it forced on them a year ago. Feinberg has been hard on their managers and the argument that they will leave en masse to hedge funds, private equity firms, or foreign banks has not swayed the czar at all.

Feinberg is shrewd. There are a lot of people who want to live in New York City and work for a major money center bank or large insurance company. The pool of talent to operate trading floors and M&A businesses is relatively large. The number of people who will live in Detroit and try to turn around a failing car company is very limited. Feinberg is willing to pay Liddell more than the czar may want to because the number of qualified people interested in being CFO of GM was probably only one.

Steve Jobs, the CEO of Apple (NASDAQ:AAPL), is doing fine, financially. He took a salary of just $1 last year but owns 5.546 million Apple shares. The stock trades above $200, so Jobs has over $1 billion invested in the company.

The Apple proxy also reports that most of the firm’s top people have to rely on stock holdings and options to do well. Apple N0.2 executive Tim Cook had a base of only $750,000 last year and got an $800,000 bonus. Next year his base will rise to $800,000.

The top four executives other than Jobs had base salaries averaging only $600,000 for 2009, but Cook and the managers who run hardware and software, Peter Oppenehimer and Scott Forstall, each were granted over 12 million stock options.

The only really interesting point in the Apple proxy is that the company’s board wants to increase shares available for employee compensation by 36 million. Apple clearly thinks that it will be richly rewarding management going forward. The proposal for the share increase will certainly pass.

A previous post I wrote where I bitched, moaned, sniveled, whined, griped and complained about receiving a Walmart gift card instead of a Christmas bonus raised a question:

Did my boss select a gift card instead of cash or a real bonus to gain some sort of advantage on his taxes?

I did a bit of quick checking and, as far as I can tell, the answer is a resounding “no.”

Whaaaa!

Don’t worry, he’s still evil. But apparently that evil didn’t come into play … this time!

What I learned is that the IRS treats cash and gift cards exactly the same. The gross amount for both types of gifts must be reported by your employer to the IRS as “compensation.”

A gift certificate to a local restaurant would be taxable. Taking employees out to dinner at that same restaurant, on the other hand, would still be considered “non-taxable.”

Small gifts, like a Christmas turkey or a fruit basket, may be considered de minimis by the IRS and not subject to reporting as compensation.

For me the issue isn’t one of taxation. It’s that I’ve taken on a ton of additional responsibilities in the last 12 months and I’ve come through time and time again for the team. As such a $50 gift card to a store I don’t like feels more like an insult rather than a reward.
