<p>A briefing schedule has been announced by the 3rd U.S. Circuit Court of Appeals in a case alleging Congress failed in its constitutional duties by refusing to investigate the eligibility of Barack Obama to be president, according to an attorney handling the challenge.</p>
<p><a href="http://www.wnd.com/index.php?fa=PAGE.view&#38;pageId=113651">WND previously reported on the lawsuit filed by lead plaintiff Charles F. Kerchner Jr. and others against Congress.</a></p>
<p>Attorney Mario Apuzzo filed the action in January on behalf of Kerchner, Lowell T. Patterson, Darrell James Lenormand and Donald H. Nelson Jr. Named as defendants were Barack Hussein Obama II, the U.S., Congress, the Senate, House of Representatives and former Vice President Dick Cheney along with House Speaker Nancy Pelosi.</p>
<p>The case focuses on the alleged failure of Congress to follow the Constitution. That document, the lawsuit states, &#8220;provides that Congress must fully qualify the candidate &#8216;elected&#8217; by the Electoral College Electors.&#8221;</p>
<p>The case asserts &#8220;when Obama was born his father was a British subject/citizen and Obama himself was the same.&#8221;</p>

<p>The Constitution also provides, the lawsuit says, &#8220;If the president-elect shall have failed to qualify, then the vice president elect shall act as president until a president shall have qualified.&#8221;</p>

<p>&#8220;There existed significant public doubt and grievances from plaintiffs and other concerned Americans regarding Obama&#8217;s eligibility to be president and defendants had the sworn duty to protect and preserve the Constitution and specifically under the 20th Amendment, Section 3, a Constitutional obligation to confirm whether Obama, once the electors elected him, was qualified,&#8221; the case explained.</p>
<p><a href="http://puzo1.blogspot.com/2009/11/kerchner-v-obama-congress-3rd-circuit.html">Now the attorney has posted an online statement that the brief on behalf of the appellants is due Jan. 4, 2010.</a></p>
<p>In an e-mail announcing the schedule, Kerchner wrote, &#8220;We look forward to moving ahead with this very important constitutional case along the legal pathway to the ultimate decision maker for this historic and precedence setting lawsuit, the U.S. Supreme Court.&#8221;</p>
<p>He continued. &#8220;They will determine the answer to the pressing legal question of what is a &#8216;natural born citizen&#8217; of the USA per Article II constitutional standards and did Obama and the U.S. Congress violate the Constitution and statutory laws and my constitutional rights during the 2008 election cycle.&#8221;</p>
<p>&#8220;I say Obama does not meet the founders and framers intent for the Article II eligibility clause. I say Obama is a deceiver and a usurper,&#8221; he wrote today.</p>
<p><a href="http://puzo1.blogspot.com/2009/10/kerchner-appeal-filed-with-third.html">Apuzzo earlier argued in his notice of appeal that the district court judge &#8220;avoided&#8221; a conclusion on the merits of the case.</a></p>
<p>&#8220;We allege that Obama has not conclusively proven that he was born in Hawaii. More importantly, we also allege that he is not an Article II &#8216;natural born Citizen&#8217; because when Obama was born his father was a British subject/citizen and Obama himself was the same,&#8221; he wrote.</p>
<p>The lawyer said it is important that the court did not rule Obama was born in Hawaii, nor did it rule that the claim was frivolous.</p>
<p>It simply said the case was dismissed because of a jurisdiction issue.</p>
<p>&#8220;By the court finding that plaintiffs do not have standing and that their claims present a political question, the court was able to avoid having to address the underlying merits of the Kerchner case. With such a decision, the American people unfortunately still do not know where Obama was born and whether he is an Article II &#8216;natural born Citizen&#8217; and therefore constitutionally eligible to be president and commander in chief,&#8221; the attorney said.</p>
<p>&#8220;A court cannot refuse to hear a case on the merits merely because it prefers not to due to grave social or political ramifications,&#8221; he continued. &#8220;The court&#8217;s opinion dismissing the Kerchner complaint/petition did not address the real Kerchner case but rather looked for a way to dismiss the case without having to reach the merits of the question of whether Obama is an Article II &#8216;natural born citizen.&#8217;</p>
<p>&#8220;The American people deserve to know whether Obama was in fact born in Hawaii. More importantly, even if he is born in Hawaii, given that he was born with dual allegiance and citizenship, the American people deserve to know whether he is an Article II &#8216;natural born citizen&#8217; which would make him eligible to be president,&#8221; the attorney said.</p>
<p><a href="http://www.wnd.com/index.php?fa=PAGE.view&#38;pageId=112707">WND reported earlier</a> when Kerchner publicly argued the courts have an obligation to make a decision on Obama&#8217;s eligibility.</p>
<p>He wrote, &#8220;The federal courts and judges are committing treason to the Constitution by not taking jurisdiction and getting to the merits in the various cases before them regarding the Article II eligibility clause question for Obama.&#8221;</p>
<p>He said his basis for such a statement is the opinion of U.S. Supreme Court Chief Justice John Marshall, who wrote in an 1821 case, Cohens vs. Virginia:</p>
<blockquote><p>&#8220;It is most true that this court will not take jurisdiction if it should not: but it is equally true, that it must take jurisdiction if it should. The judiciary cannot, as the legislature may, avoid a measure because it approaches the confines of the constitution. We cannot pass it by because it is doubtful. With whatever doubts, with whatever difficulties, a case may be attended, we must decide it, if it be brought before us. We have no more right to decline the exercise of jurisdiction which is given, than to usurp that which is not given. The one or the other would be treason to the constitution. Questions may occur which we would gladly avoid; but we cannot avoid them. All we can do is, to exercise our best judgment, and conscientiously to perform our duty. In doing this, on the present occasion, we find this tribunal invested with appellate jurisdiction in all cases arising under the constitution and laws of the United States. We find no exception to this grant, and we cannot insert one.&#8221;</p></blockquote>
<p>WND has reported on dozens of legal challenges to Obama&#8217;s status as a &#8220;natural born citizen.&#8221; The Constitution, Article 2, Section 1, states, &#8220;No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President.&#8221;</p>
<p>Some of the lawsuits question whether he was actually born in Hawaii, as he insists. If he was born out of the country, Obama&#8217;s American mother, the suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.</p>
<p>Other challenges have focused on Obama&#8217;s citizenship through his father, a Kenyan subject to the jurisdiction of the United Kingdom at the time of his birth, thus making him a dual citizen. The cases contend the framers of the Constitution excluded dual citizens from qualifying as natural born.</p>
<p>Further, others question his citizenship by virtue of his attendance in Indonesian schools during his childhood and question on what passport did he travel to Pakistan three decades ago.</p>
<p>Adding fuel to the fire is Obama&#8217;s persistent refusal to release documents that could provide answers and the appointment – at a cost confirmed to be at least $1.7 million – of myriad lawyers to defend against all requests for his documentation. While his supporters cite an online version of a &#8220;Certification of Live Birth&#8221; from Hawaii as his birth verification, critics point out such documents actually were issued for children not born in the state.</p>
<p>The ultimate questions remain unaddressed to date: Is Obama a natural born citizen, and, if so, why hasn&#8217;t documentation been provided? And, of course, if he is not, what does it mean to the 2008 election or the U.S. Constitution if it is revealed that there has been a violation?</p>
<p><a href="http://www.wnd.com/index.php?fa=PAGE.view&#38;pageId=112225">WND has reported on another case</a> that was dismissed by U.S. District Judge David Carter in California. It also now is heading to the appeals level.</p>
<p><a href="http://www.wnd.com/index.php?fa=PAGE.view&#38;pageId=100613">WND also has reported that among the documentation not yet available</a> for Obama includes his kindergarten records, Punahou school records, Occidental College records, Columbia University records, Columbia thesis, Harvard Law School records, Harvard Law Review articles, scholarly articles from the University of Chicago, passport, medical records, files from his years as an Illinois state senator, his Illinois State Bar Association records, any baptism records and his adoption records.</p>
<p><a href="http://shop.wnd.com/store/item.asp?ITEM_ID=2866">Because of the dearth of information about Obama&#8217;s eligibility, WND founder Joseph Farah has launched a campaign to raise contributions to post billboards asking a simple question: &#8220;Where&#8217;s the birth certificate?&#8221;</a></p>

<p>The campaign followed <a href="http://www.wnd.com/obama_petition">a petition that has collected more than 480,000 signatures</a> demanding proof of his eligibility, <a href="http://shop.wnd.com/store/item.asp?ITEM_ID=2942">the availability of yard signs</a> raising the question and <a href="http://shop.wnd.com/store/item.asp?ITEM_ID=2722">the production of permanent, detachable magnetic bumper stickers asking the question.</a></p>
<p>The &#8220;certification of live birth&#8221; posted online and widely touted as &#8220;Obama&#8217;s birth certificate&#8221; does not in any way prove he was born in Hawaii, since the same &#8220;short-form&#8221; document is easily obtainable for children not born in Hawaii. The true &#8220;long-form&#8221; birth certificate – which includes information such as the name of the birth hospital and attending physician – is the only document that can prove Obama was born in Hawaii, but to date he has not permitted its release for public or press scrutiny.</p>
<p>Oddly, though congressional hearings were held to determine whether Sen. John McCain was constitutionally eligible to be president as a &#8220;natural born citizen,&#8221; no controlling legal authority ever sought to verify Obama&#8217;s claim to a Hawaiian birth.</p>

<p>Sheriff. Illegal. What part of law enforcement don&#8217;t these idiots understand? And we have U. S. DISTRICT Judge Mary <em><strong>Murguria</strong></em> (Hmmm. Smell any possible conflict of interest there?) refusing to dismiss this case.</p>
<blockquote><p>More people sneak into Arizona from Mexico than any other state in the nation. It is estimated that in Phoenix alone, where Joe Arpaio is Sheriff, that there are over 400,000 illegal aliens</p>
<p>Most of the crime committed in Phoenix, especially gruesome murders, rapes and kidnappings, are committed by illegal aliens. So, in July of 2007, Sheriff Joe launched a hotline for tips on illegal aliens and began to arrest them.</p></blockquote>
<p>Yes, this place is asking for donations to keep going, but these are the people with the cameras along the fence, etc. Surveillance aircraft need fuel, and the Border Patrol proper is stretched too thin to actually PATROL it all. These are people very involved in getting the BP to where they need to be.</p>
<p>Now, on the back of the envelope is a picture of a wetback protest with signs.</p>
<p>&#8220;We are indigenous! The ONLY owners of this Continent!&#8221;  Blah blah, woof woof, ad infinitum.</p>
<p>So, if my grandfather sold your grandfather something, and I want that something back, does that mean it&#8217;s rightfully mine and you&#8217;ve got to give it back?</p>
<p>These are our borders, this is our nation. If you want to live in it, follow our laws. If you do not follow our laws, just as does your own government within your own borders, we reserve the right to put you in jail and/or deport you.</p>
<p>Alternatively, since we ARE engaged in a war, and &#8220;illegal alien&#8221; may also be defined as &#8220;foreign invader&#8221;, patriotic Americans would be justified in killing you on sight as enemy combatants.</p>
<p>You want to live in these United States? LEGALLY immigrate. You cross the border illegally, you have violated immigration law, and you are an unknown quantity as to reason. You may be sneaking in to plant a bomb. To establish a cell of enemy combatants in vital places. We don&#8217;t know.</p>
<p>What we do know is that there are people out there who want to enslave or kill us. Best way not to get killed is to kill your opponent first.</p>
<p>All you have to do is accept the fact that this simply is the way it is. Legal immigration, jail, or death by combat.</p>

<p>You know that one of the biggest problems we&#8217;ve faced in establishing a sound government over there has been all the tribal bullshit. Tribal. Didn&#8217;t that pretty much go away here in the States around 150 years ago? Some tried to keep it going, enough realized it detrimental that the tribes here have become &#8220;The Indian Nation&#8221;. Organization/sheer numbers can lead to far greater things than individual flaps here and there.</p>
<p>That is what these Kurds are trying to do. Get all the various &#8220;tribes&#8221; of the middle east to put aside their differences and work together to bring <strong>that</strong> region into <strong>this</strong> century.</p>
<p>I think you will find that article a very interesting read. Some of those people are getting fed the fuck up with the division, with the theocracy, and they want to become a Democratic Republic.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>As recently as two years ago, Congressman Ron Paul introduced a bill to audit the Federal Reserve Bank that headed to oblivion. Year after year — beginning in 1983 — the bill never even won a committee hearing. Dr. Paul was ignored in Washington, and was a lonely voice for freedom back in his Texas congressional district.</p>
<p>Times have changed. Ron Paul is on a political roll. The bill Dr. Paul introduced in the current Congress to audit the Federal Reserve Bank (H.R. 1207) has more than 300 cosponsors — including every House Republican and more than 100 Democrats — and the backing of House Financial Services Committee Chairman Barney Frank. Frank has promised a committee vote, and it has a better-than-average chance of House passage this year. Dr. Paul’s new book End the Fed sailed into the top twenty of Amazon.com’s sales figures more than a month before it was available. It debuted on both Amazon.com and New York Times bestseller lists, and sales remain strong even today. His old presidential campaign has rolled over into a “Campaign for Liberty” that has raised more than $4 million since its founding in February of this year. </p>
<p>More importantly, his presidential campaign evidently inspired dozens of candidates for congressional office across the nation who seek to reform Congress from a constitutionalist perspective. And several of them are both well funded and being taken seriously by the political establishment.</p>
<p>Rand Paul<br />
Prime among these constitutionalist “Ron Paul” candidates is the Congressman’s third child, Dr. Rand Paul. While the elder Dr. Paul was an obstetrician by trade before being elected to Congress, Dr. Rand Paul is an eye surgeon (ophthalmologist). The 46-year-old Dr. Rand Paul announced his candidacy for the open U.S. Senate seat in Kentucky in August. Days before Dr. Paul’s announcement, incumbent Republican Jim Bunning had bowed out of a reelection contest after Kentucky’s establishment Republican Senator Mitch McConnell (who is also the Senate Minority Leader) had made fundraising in Washington difficult for Bunning. “Over the past year,” Bunning said, “some of the leaders of the Republican Party in the Senate have done everything in their power to dry up my fundraising. The simple fact is that I have not raised the funds necessary to run an effective campaign for the U.S. Senate.” Time magazine on July 29 explained that the “some leaders” Bunning was talking about was his fellow Kentucky Republican Mitch McConnell: “He quietly signaled to Republican moneymen that they ought to wait Bunning out. Party leaders in Washington met with a potential primary opponent&#8230;. McConnell’s strategy ultimately worked.”</p>
<p>Dr. Rand Paul is the founder of the conservative Kentucky Taxpayers United and has also campaigned for his father, so he isn’t a stranger to politics. But he hasn’t seen McConnell open the monetary floodgates from Washington on his behalf either. Politico.com has noted that “the GOP establishment has lined up behind Secretary of State Trey Grayson.” Perhaps Grayson is favored by the Washington Republican establishment because Grayson’s campaign website is bereft of mention of bringing the federal government back within the bounds of the U.S. Constitution. By way of contrast, Rand Paul has made the Constitution a centerpiece of his campaign. “The Federal Government must return to its constitutionally enumerated powers and restore our inalienable rights,” the younger Dr. Paul says on his campaign website, in an echo of his father’s principles. “America can prosper, preserve personal liberty, and repel national security threats without intruding into the personal lives of its citizens.” </p>
<p>The fact that the establishment isn’t behind him hasn’t hurt Rand Paul in the crucial fundraising part of the race; he raised more than $1.1 million by the end of the third quarter of this year. Grayson’s Washington fundraising, which included a $500 per plate fundraiser hosted by McConnell on September 23, has been matched by Dr. Paul’s vibrant Internet strategy dollar-for-dollar thus far. “We actually outraised both Democrats and our primary opponents this past quarter,” Dr. Paul told The New American.</p>
<p>Rand Paul is quick to say that his first problem was “name recognition,” though he told The New American “we are now probably very close to being on a par with our primary opponent now.” Of the two, Grayson has been far better known in Kentucky; he’s been the Secretary of State for five years. Therefore, even though Grayson’s polling numbers were stronger back in August, 40 percent to Dr. Paul’s 25 percent according to an August poll, Rand Paul is being given a good chance of prevailing by professional political observers. Dr. Paul has numbers to back up his statement that he’s pulled up to a par with Grayson. An October Rasmussen poll put Paul’s and Grayson’s “favorability” percentages within the poll’s margin of error, and a November WHAS11/Survey USA poll put Paul ahead at 35 to 32 percent.</p>
<p>If the younger Dr. Paul survives the Republican primary, he has a better-than-even chance of winning the GOP-leaning Kentucky general election. Democrats who face a Republican candidacy of Rand Paul would not only face a united conservative base but also significant crossover from some traditionally Democratic voting groups, especially those opposing unnecessary wars and assaults on civil liberties under the guise of the “war on terror.” Dr. Paul told The New American that he maintains a bipartisan appeal that criticizes both parties when they are at fault, “On the stump I promise that I will vote against any budget that is not balanced, either Republican or Democrat.” The crossover phenomenon may even impact the primaries, as many have changed from independents or Democratic registration to vote for him in the primary. “We re-register people a lot of the time, and there is a lot of crossover.”</p>
<p>Peter Schiff<br />
Another well-funded Ron Paul presidential campaign supporter is Connecticut-based Peter Schiff, who had been an economic adviser to the Ron Paul presidential campaign. Schiff has become an Internet sensation on his own as president of Euro-Pacific Capital, largely because he accurately predicted the current economic recession with astonishing precision on a variety of financial television talk shows. He not only predicted the current recession in 2006 and 2007, he also explained why it would happen to pundits who often laughed at him for predicting the housing boom would go bust. In 2008, some of his friends put together a montage of his television clips called “Peter Schiff Was Right” and posted it on YouTube. The clips received several million views and dramatically increased demand for Schiff’s guest appearances on national television shows.</p>
<p>Schiff is an acolyte of the free-market “Austrian School” of economics, is for ending America’s military interventions abroad, and is emphatic about returning the federal government to the limits of the U.S. Constitution’s delegated powers. </p>
<p>Schiff announced in September that he would run for the U.S. Senate in Connecticut against longtime incumbent Christopher Dodd. Dodd would ordinarily be considered a safe incumbent. On paper, Dodd is an entrenched Democrat in a Democratic-leaning state, but the 28-year incumbent is considered highly vulnerable this time around. As chairman of the Senate Banking, Housing and Urban Affairs Committee, he was the Senator who could have — and should have — raised the alarm about the housing bubble. But instead, Dodd built a cozy relationship with sub-prime lender Countrywide. Although technically cleared of ethics violations in a recent investigation concluded August 7, the Senate inquiry criticized Dodd’s efforts as less than cautious. “The committee does believe that you should have exercised more vigilance in your dealings with Countrywide in order to avoid the appearance that you were receiving preferential treatment based on your status as a senator,” the Senate Ethics Committee concluded. Dodd also has personal health issues to deal with this time around. Last summer he was diagnosed with prostate cancer, so he may not be able to wage as vigorous a campaign as in the past. </p>
<p>As a result of Dodd’s recent missteps, Schiff will have to get in line to have a crack at him. The Republican Party smells blood, and a number of other Republicans have declared their candidacies as well. Among the better known are World Wrestling Entertainment CEO Linda McMahon and former Congressman Rob Simmons, who appears to be the early front-runner. Schiff’s greatest challenge may be winning the Republican primary. With his financial background and his accurate economic predictions, he’s the perfect constitutionalist foil for the leftist Dodd in a general election. But despite already having raised more than $1.1 million in Internet donations for his campaign, he barely registers in polling data. That’s perhaps expected, since he’s a political novice in the Republican Party and outside his coterie of YouTube followers he’s virtually unknown in Connecticut. </p>
<p>Schiff will definitely need that impressive $1.1 million he’s already raised, and more, in order to introduce himself to more Connecticut primary voters if he wants to win. He’ll also have to mobilize a local army of volunteers in Connecticut. If he can do that, Schiff could become the next Senator from Connecticut.</p>
<p>Adam Kokesh<br />
Adam Kokesh is best known as an Iraq War veteran who returned opposed to the war and was a keynote speaker at Ron Paul’s “Rally for the Republic” that competed with the Republican National Convention in the summer of 2008. He volunteered for service in Iraq, where he witnessed the bureaucracy, waste, and corruption in the U.S. reconstruction of that country. According to his campaign website, he emerged from the military a strict noninterventionist in foreign policy and defender of Congress’ constitutional authority to declare war:</p>
<p>Inherent with the right to self-defense is the right to collective self-defense, and in the world that we live in, this is the most important function of the federal government. To ensure that this power is used responsibly, Congress, as the best representation of the people, was given the exclusive power to declare war&#8230;. The executive branch has set a dangerous precedent by taking powers that are supposed to be vested in the Congress. By not abiding by the Constitution and using the collective wisdom of the Congress to ensure judicious use of force, we find ourselves spending hundreds of billions more than is necessary for legitimate defense.</p>
<p>Kokesh has echoed Rep. Paul’s position on the Federal Reserve Bank, called for a smaller government role in the management of healthcare, and pronounced a nuanced view about the immigration issue. </p>
<p>Kokesh has an uphill battle as a Republican in New Mexico’s heavily Democratic Third District against freshman Democrat Ben R. Luján. Luján hasn’t had much time to dig in as an incumbent, but his northern New Mexico district hasn’t been won by a Republican since 1996. Kokesh, in his favor, was able to tell The New American that he has raised over $100,000 in donations in the first few months of his candidacy. “What was shocking for me was that for the third quarter we actually beat Luján,” he told The New American. That goes a long way toward making up for the $100,000 Washington, D.C., fundraiser Democratic Majority Leader Steny Hoyer hosted earlier this year for Luján. Neither candidate is even close to the $1 million or so they’ll have to raise to wage winning a House campaign, but Kokesh’s early fundraising numbers suggest that he won’t be at a financial disadvantage on this front.</p>
<p>Kokesh told The New American that the traditional political wisdom in New Mexico is that “if you want to play and you want to win, you’re going to run as a Democrat.” Yet, the state has elected conservative Republicans occasionally because “a lot of those people would be Republicans anywhere else.” Kokesh notes that the local Democratic Party still postures as pro-gun and as socially conservative, and he sees a “great potential for a crossover vote, just because of those Democratic voters that have been sucked into the machine.” </p>
<p>And Kokesh’s anti-war, noninterventionist foreign policy, and pro-civil liberties positions just may have the decisive bipartisan appeal he’ll need. “People [are] calling to say they are changing their party registration so they can vote in the primary” for him, he told The New American. But if people can see through to the principles of the Constitution, the liberal media is still seeing things in terms of the phony left-right spectrum. The local weekly news magazine Santa Fe Reporter published an article on congressional candidates called “The Early Birds” on July 29, labeling Kokesh a right-winger. “They gave me a 4.2 out of 5 for being true conservative,” Kokesh said, “then two or three months later, they wrote about how I had all of these liberal ideologies.” The Marine Corps veteran says, “To me … one of the biggest frustrations and also one of the most rewarding things about this race is taking on the left-right spectrum.” </p>
<p>Also in Kokesh’s favor is the expectation that most analysts believe 2010 will be a Republican year, just as 1994 and 1996 were. Count Kokesh as an underdog, but he may have a shot. </p>
<p>Other Candidates<br />
These are only three of the better known among more than a dozen candidates nationwide who have been inspired by Ron Paul’s 2008 candidacy to run for the House or Senate. It has almost taken on the form of a slate in some quarters, as Internet fundraisers like ThisNovember5th.com are seeking to raise funds for more than a dozen candidates on the same day as Ron Paul’s 2007 “money bomb” when he raised a then-record $4 million in a single day. The idea of Internet “money bombs” has proliferated among the constitutionalist movement, often resulting in more frequent but smaller one-day fundraising numbers for candidates. This year’s money bomblets have netted from tens of thousands to several hundred thousand dollars on a single day for the better-known candidates. And while this article will be at press on November 5, tens of thousand dollars were pledged two weeks in advance of the day. But ThisNovember5th.com is only one of many independent efforts to raise funds for constitutionalist candidates and enable them to become independent of the Washington, D.C., fundraisers and not beholden to power-brokers in the same quarters. </p>
<p>Among the ThisNovember5th.com candidates is Marine Corps veteran David W. Hedrick, who is running against five-term liberal Democratic Congressman Brian Baird of Washington’s Third Congressional District. Before announcing his candidacy, Hedrick confronted Baird at an August 18 town hall, telling him: “I also heard you say that you were going to let us keep our health insurance. Well thank you! It’s not your right to decide whether I keep my current plan or not. That’s my decision.” But that’s not all. Directly confronting the claim made by some leading Democrats that attempts to “disrupt” town hall meetings display a fascist tendency, he also told Baird:</p>
<p>A little history lesson. The Nazis were the National Socialist Party. They were leftists. They took over finance. They took over the car industry. They took over the health care in that country. If Nancy Pelosi wants to find a swastika, maybe the first place she should look is the sleeve of her own arm.</p>
<p>Meanwhile, R.J. Harris is opposing three-term incumbent Republican Tom Cole in Oklahoma’s Fourth Congressional District. A veteran commentator on Judge Andrew Napolitano’s Freedom Watch Internet show on Fox News’ website, Harris encapsulates his decision to run against a fellow Republican in a video advertisement: “How can we Republicans demand to replace the Democrat bailout voters without doing anything about our own? If we don’t clean our own house, we can expect the Democrats to do it for us.” Cole voted for the Bush bailout bill, the TARP legislation. Harris calls himself a “constitutional conservative Republican” and says, “I will never vote for bailouts, required servitude, taxation without representation or give your money to foreign governments. However, Tom Cole has voted for all of these things.” </p>
<p>Jake Towne of Pennsylvania’s 15th District will also try to make Republicans honest by running against liberal Republican incumbent Charlie Dent (The New American’s Freedom Index rating: 40 percent).</p>
<p>Minuteman founder Chris Simcox, though not a newcomer to politics as a result of the Ron Paul 2008 presidential bid, has announced a challenge against John McCain’s Senate seat in Arizona and has been put on the ThisNovember5th.com fundraising list.</p>
<p>Dr. Mike Vasovski in South Carolina’s Third District will run in a crowded Republican primary for an open congression-al seat.</p>
<p>Other House of Representatives candidates ThisNovemer5th.com will be raising funds for include John Dennis (California), Jaynee Germond (Oregon), David Ratowitz (Illinois), Bob Parker (Missouri), and both Collins Baily and Robert Broadus of Maryland.</p>

<p>Like, for example, that Teddy Kennedy had worked to block at least one judicial appointment so that it would be filled by &#8220;the <span style="text-decoration:line-through;">right</span>left type&#8221; of Judge. There was a screen left open that caught someone&#8217;s attention, the file was accessed, the file got released.</p>
<p>We knew the glowbull worming bullshit was. Somebody hacked the CRU, the files were released, we have the proof. That should put paid to the Crap and Slave, but there&#8217;s no guaranteeing that. The government doesn&#8217;t seem to care to listen to its constituency any longer. <a href="http://nicedoggie.net/index.php/archives/3571">Even though we have the proof, we may still need to install some real fear to get that shit straight</a>. It may end up being the trigger, I am pretty sure it could be, but not 100%.</p>

<p>We knew the G20 was all about the destruction of our national sovereignty to the OWG, and we found the speech from the EU pointing out that very thing. And that ObaMao was going there to do just that.</p>
<p>We know that ObaMao hates America, and there is something DREADFULLY wrong in his background. Why the fuck else would he have spent somewhere in the neighborhood of  2 MILLION DOLLARS hiding his background? When articles from over 5 years ago, from a Kenyan newspaper, suddenly disappear from the archives when they&#8217;re discovered and posted on the net. When the script of a TV show about alien visitors hits too close to home, and all of a sudden the producer, director, and writer are fired and the show goes on hiatus until the spring after 4 shows. You know the show will be radically different when it comes back, the propaganda ministry will see to that.</p>
<p>Somebody, somewhere has the files. Undoubtedly, more than one of those somebodies. Why do you think the &#8220;wall of separation&#8221; between the law/intelligence agencies came back up the instant this pos was in the Whitehouse and could control it. One <em><strong>or more</strong></em> of the alphabet agencies has the dirt. Somebody, somewhere has the proof.</p>
<p>And that somebody, somewhere has SWORN THAT SAME OATH TO SUPPORT AND DEFEND THE CONSTITUTION AGAINST ALL ENEMIES FOREIGN AND DOMESTIC that many of us have. But they are, for some reason, not exposing this truth because of some conflicting oath of secrecy or some shit.</p>
<p>Which one is more important, hmm? Which one? I&#8217;d really love to know why we don&#8217;t have PATRIOTS defending our nation. &#8220;300,000,000 people and we can&#8217;t find 545 patriots to run it&#8221;. On which side of the line will they stand when America decides ENOUGH? These are the people who can <strong>stop</strong> the coming hellstorm. <strong>These</strong> are the people who could release the facts and <strong>prevent</strong> what is surely coming. These are the people that could monitor the coming elections (should we actually have them) to prevent false signals from the voting machines, catch more people voting than there are registered, ad infinitum.</p>
<p>Alright, they&#8217;ve sworn some bullshit &#8220;oath of secrecy&#8221; that they, for some reason, believe is more important than their OATH to the Constitution, to this very nation.</p>
<p>Wouldn&#8217;t it be lovely if, somehow, a firewall was weak? If, somehow, some &#8220;hacker&#8221; got that/those file(s) so they hit the air/news/net waves? If, somehow, the alphabet agencies got hacked for that/those particular files and we could SAVE THIS NATION? If we could stop the bloodshed that is sure to come if this shit isn&#8217;t stopped before it goes ANY further?</p>
<p>The next war to save this country isn&#8217;t going to be fought in some bullshit third world country, it is going to be right here. Somebody, somewhere, please remove the mirrors and blow away the smoke. Get the moving crew and turn on the fan. There may be a large number of people who&#8217;ve grown fat, lazy, and dependent. But there are more who have not. There are far more who are being pushed to the very edge by the destruction of our founding beliefs, who are on that very edge of taking it back or dying trying.</p>

<p><span style="font-family:Georgia, Times New Roman, Times, serif;">[The following is the full text of an address presented to the National Heritage Center for Constitutional Studies at its 2009 Constitution Day conference.]</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">The Tenth-Amendment Resolutions from State Legislatures, the Tea Parties, the Town Hall Meetings, and other manifestations of WE THE PEOPLE’S feedupidness with monkey-business as usual in the Disgrace of Columbia—even the massive congregation on the Mall last September—are some of the most enlightening, encouraging, and energizing developments that American patriots have witnessed in a long time. For these events are all premised on the idea: “We don’t want you!”—that WE THE PEOPLE do not want any more, indeed they demand a great deal less, interference in their lives from rogue public officials in the General Government.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">These events notwithstanding, the problem remains that too many among WE THE PEOPLE will start <em>but then stop</em> right there, with “We don’t want you!” That is not enough.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">The complaint “We don’t want you!” needs to go further, to the resolve, “We won’t have you!” — that WE THE PEOPLE intend to rid themselves of the General Government’s interference.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">And to make this resolve effective, WE THE PEOPLE need to design and put into effect <em>remedial action</em>, so that they can say with finality: “We don’t need you!”</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">The sequence must be—</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">(i) We don’t NEED you!” which makes it realistic to say:</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">(ii) We don’t WANT you!” which combined with the ability to make WE THE PEOPLE’S wants effective will lead to the necessary and sufficient action:</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">(iii) We won’t HAVE you!” and finally will yield the desired result:</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">(iv) We are RID of you!”</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">If WE THE PEOPLE have the ability they can give “teeth” to the desire, take the necessary action, and thereby accomplish their goal.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">But what will all of this require?</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;"><strong>•</strong> WE THE PEOPLE need to create actual workable institutions that take advantage of the political and legal position THE PEOPLE hold—i.e., as the ultimate sovereigns.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;"><strong>•</strong> WE THE PEOPLE need to create actual workable institutions that take advantage of the economic resources THE PEOPLE command—that THE PEOPLE are the true source of all real wealth in this country, and <em>are in actual physical possession of most of it.</em></span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">True enough, the Establishment holds bundles of <em>paper claims</em> to wealth, many (if not most) of them generated through the unconstitutional Federal Reserve System. But the insuperable problem for the Establishment will be how to collect on those claims if WE THE PEOPLE simply refuse to honor them. Anyone in the paper-currency racket who doubts that these claims can be declared unenforceable should read the Supreme Court’s decision in Craig v. Missouri, 29 U.S. (4 Peters) 410 (1830).</span></p>
<p>&#160;</p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;"><strong>•</strong> WE THE PEOPLE need to create actual workable institutions that are <em>politically, economically, and legally independent</em> of the General Government:</span></p>
<blockquote>
<div><span style="font-family:Georgia, Times New Roman, Times, serif;">Institutions that can compete with the faulty and fraudulent mechanisms that rogue officials in the General Government have foisted on this country in the key areas of economic and political control, particularly in the areas of (i) money and banking and (ii) what is called “homeland security”.</span></div>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">Institutions that can replace these fraudulent control-mechanisms with proper means to “establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity”. And</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">Institutions that will enable WE THE PEOPLE to defend themselves against retaliation from rogue officials in the General Government and from the private centers of multinational economic power.</span></p></blockquote>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">In sum, WE THE PEOPLE must combine their economic resources and abilities with political and legal authority in large-scale organizations that will reflect the power inherent in numbers.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">This cannot be done by or through the General Government at the present time, because the General Government is the main locus of this country’s problem, not the source of any solution for them.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">It cannot be done through political parties, because parties (along with other factions and special-interest groups) are the control-mechanisms in the “divide and conquer” strategy the Establishment employs to prevent WE THE PEOPLE from asserting their political sovereignty in their own interest.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">It cannot be done by individuals or private groups alone, primarily because: (i) private individuals and groups enjoy no independent legal authority; and (ii) there is probably no way to create a sufficiently large and effective private operation in any State, let alone throughout the entire country, in time.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">It cannot be done by the State governments alone, because it is not simply a political question of governmental finance and administration, but will require a revamping of the entire private economies in each State, too.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">Therefore, it will require <em>both</em> (i) participation by the State governments, because they have the legal authority and the ability to mobilize people in sufficient numbers, <em>and</em> (ii) <em>mass action by WE THE PEOPLE as a whole.</em></span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">The <em>only</em> establishment or institution that combines all of these elements is “the Militia of the several States”, the “well regulated Militia” that the Second Amendment tells us are “necessary to the security of a free State”.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">But a true constitutional “well regulated Militia” exists in not one State in this Union today.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">So, WE THE PEOPLE need to revitalize “the Militia of the several States” in order to regain and retain popular control over State governments, and through them to regain and retain control over the two fundamental powers of sovereignty: (i) the Power of the Purse—<em>i.e.</em>, currency and credit, and (ii) the Power of the Sword—<em>i.e</em>., community self-defense.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">Revitalization of the Militia will enable WE THE PEOPLE to exercise community self-reliance and ultimately true self-government in “a free State” with a sound free-market economy.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">Americans need to combine all of the following elements in a single plan for mass action:</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;"><strong>1. Revitalization of “the Militia of the several States”.</strong></span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">·The Second Amendment instructs every American that “[a] well regulated Militia” is “necessary to the security of a free State”—not just “useful”, and certainly not “optional”, but <em><strong>“necessary”</strong></em>. And not “necessary” in only some general sense, but specifically with respect to “the security of a free State”—which means that, <strong><em>according to “the supreme Law of the Land” itself, the very survival of constitutional freedom in this country depends upon the Militia</em></strong>.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">The Constitution identifies <strong><em>no other</em></strong> establishment, institution, or entity as “necessary” for this vital purpose, or for any other purpose.</span></p>
<p>&#160;</p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">So why is not revitalization of the Militia, <em>immediately if not sooner</em>, “job one” on the agenda of every constitutionalist? How can patriots continue to deny in their actions what the Constitution tells them is “necessary” for the maintenance of constitutional government? Americans may say that they have faith in the Constitution—but faith without works is dead; and the Constitution is not self-executing.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">·The purpose of revitalizing the Militia is to combine <em>all</em> the elements of each State’s “homeland security”—including police, emergency response, and so on—under the Militia, in order to obviate “top down” control by the police-state apparatus being set up through the Department of Homeland Security in Washington, D.C., and its various satellites, transmission-belts, and fellow travelers around the country. Revitalization of the Militia will return control to whom it belongs, in the hands of WE THE PEOPLE directly, with:</span></p>

<p><span style="font-family:Georgia, Times New Roman, Times, serif;">(i) total organizing, arming, disciplining, and training of THE PEOPLE to handle any emergency;<br />
</span><span style="font-family:Georgia, Times New Roman, Times, serif;">(ii) State production and provision of arms, ammunition, and accoutrements for the Militia—with all individuals to possess their arms and ammunition, whenever obtained from whatever source, as part of their Militia service—thus ending all of the General Government’s oppressive “gun control”; and, perhaps of most immediate importance,</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">(iii) assignment to the Militia of oversight over all new institutions of “economic homeland security” within the State.</span></p>

<p><span style="font-family:Georgia, Times New Roman, Times, serif;"><strong>2. Adoption of an alternative currency.</strong></span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">This is an idea which began in New Hampshire, and subsequently spread to other States, including Indiana, Colorado, and Montana. An alternative-currency bill has yet to be reported out of committee in any State legislature. But as the national economy melts down, the pressure for serious consideration and then passage of such a bill will become overwhelming, simply because <em>there is no workable alternative consistent with the maintenance of America’s national economic sovereignty that can be put into operation in time.</em></span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">The alternative-currency system will require not just the State to participate through its own public financial operations, but also will require every individual member of the Militia—that is, every able-bodied adult man and women—to participate in his or her own private economic transactions, in order to move both the State’s government and the State’s private economy as quickly as possible out from under the control of the Federal Reserve System and the rotten financial power-structure of the New York City-Washington, D.C. axis of fraud.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">The actual silver and gold will be held: (i) in a State vault controlled by the Militia, and (ii) in the hands of Militiamen (the private holding of silver and gold will be as important as the private possession of arms). And,</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">Experts drawn from and subject to supervision by the Militia will be in charge of or will provide oversight for the system.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;"><strong>3. Establishment of a State Credit Exchange.</strong></span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">This Exchange will deal solely in so-called “real bills” financed with actual deposits of the alternative currency (no “fractional reserves”). This will be necessary in order to protect the State’s private economy from retaliation by the multinational financial power-structure, which will doubtlessly attempt to cut off credit to the State’s businessmen, farmers, and others, so as to sabotage the alternative-currency system.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">Experts drawn from and subject to supervision by the Militia will be in charge of or will provide oversight for this Exchange, too. </span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;"><strong>4. Additional areas of concern and action could include:</strong></span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">Food independence and security through the suppression of multinational corporate agribusinesses.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">Energy independence and security through mobilization of local resources and radical innovation in the provision of energy.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">Assertion of local control over land and water usage, and other natural resources.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">&#8230;et cetera&#8230;</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">All of these arrangements will be statutorily structured as functions of the State government and thereby extensions of direct popular sovereignty, and will be administered through the Militia, thus coming under the Second and Tenth Amendments’ guarantees of reserved powers to the States and the people.</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;"><strong>5. Considerations for the selection of an initial State in which to bring this project to fruition.</strong></span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">In the nature of things, the necessary legislation will have to be drafted one State at a time. (No “one size fits all” bill is possible). Inevitably, therefore, this work will require the commitment of a great deal of time, effort, and expertise. Before such a commitment can be expected, let alone requested, of anyone, adequate groundwork must be laid:</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">There must be an extensive local grass-roots “freedom movement” <em>in existence</em> in that State <em>and prepared specifically to promote the reform legislation.</em></span></p>
<p><em> </em></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">There must be a solid legislative caucus <em>in existence</em> in that State’s legislature, preferably in each house (where a bicameral legislature exists).</span></p>
<p><span style="font-family:Georgia, Times New Roman, Times, serif;">There must be a workable plan, <em>ready to implement and adequately funded</em>, for mobilizing large numbers of activists <em>from across the country</em> to work in the targeted State to promote the reform legislation.</span></p>
