<p>As many of our neighbours struggle to find enough work to put end&#8217;s meat on the table, it&#8217;s hard to justify outsourcing contracts to workers from other parts of the globe. One of the most notable examples was the BC Place roof:</p>

<p><strong>Ironworkers outraged after Quebec company wins BC Place Stadium roof contract<br />

<p>B.C. ironworkers are outraged that a Quebec-based company has been awarded a $100 million contract for the construction of the new roof for B.C. Place Stadium in Vancouver.</p>
<p>Structal-Heavy Steel Construction (Structal), which is a business unit of Canam Group Inc., won the contract for the construction of the world’s largest cable-supported retractable roof from PCL Constructors Westcoast Inc.</p>
<p>“This is a terrible day for the B.C. economy and a disastrous decision by the B.C. government and PAVCO (BC Place Pavilion Corporation) to export hundreds of jobs from our province,” said Rene Watteel, Business Manager for Ironworkers Local 712.</p>

<p>“It’s outrageous that B.C. taxpayers are stimulating the economies of Washington State and Quebec and foreign countries instead of doing the work here in B.C. and creating jobs and investment at a time of economic recession,” Watteel said.</p>
<p>In a press release Canam said the steel components for the project will be fabricated by plants in St. Gédéon de Beauce, QC, and Sunnyside, WA, as well as by local and international subcontractors.</p>
<p>However, the erection of the roof will be done for the most part by local manpower.</p>
<p>PAVCO negotiated a $458 million fixed-price contract with PCL Westcoast Constructors Inc., which will assume responsibility for the delivery of the roof.</p>
<p>Watteel said the Ironworkers Local 712 hopes that the B.C. government might reconsider the decision if it receives enough of a negative reaction from British Columbians. PAVCO is a government agency.</p>
<p>Construction involves the roof replacement, engineering cost and planning and the creation of a temporary facility to accommodate the BC Lions and the Vancouver White Caps.</p>
<p>The contract includes design-assist, detailing and project management services, as well as the fabrication and erection of the structural steel and cables for the retractable roof.</p>
<p>Watteel said the decision by PAVCO would cost 150 direct and hundreds more indirect jobs in B.C.</p>
<p>PAVCO is required to look for bids on an open basis, which means qualified contractors across the country are invited to bid.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p><strong><a href="http://ameglegal.wordpress.com/files/2009/12/merry-christmas.jpg"><img class="alignleft size-thumbnail wp-image-853" title="Merry-Christmas" src="http://ameglegal.wordpress.com/files/2009/12/merry-christmas.jpg?w=150" alt="" width="150" height="112" /></a>Transaction or Administrative Fees</strong> also known as Doc Fees, or BAC fees…are back in the news.  Sue Sanders, NVAR General Counsel has issued the following Opinion Statement, <strong><a href="http://ameglegal.wordpress.com/files/2009/11/respa-fees.pdf" target="_blank">“<span style="text-decoration:underline;">Risk to the Unwary</span>”</a></strong> concerning these fees.  She reminds us that RESPA only allows fees for services, “actually performed.”  Prudential, Americana Group, REALTORS® agrees. </p>
<p>As noted in the Prudential, Americana Group, REALTORS® Policies and Procedure Manual, p. 44, the “Broker Administrative Commission” <em>is a commission</em>, and not merely a fee.  Like all commissions it is not required.  It is separately invoiced by Americana for accounting purposes, as it is additional commission, in excess of the listing and selling commission.  The Americana BAC fee invoice is located<a href="http://americenter.americanagrp.com/info/AmeriHelp/Net%20Forms/BrokerAdministrationCommissionForm.pdf" target="_blank"><strong> <span style="text-decoration:underline;">here</span></strong>.</a></p>
<p><strong>So…the $350 question is WHAT IS IT?</strong>  It is commission that is not required by the state or federal government to ensure that prospective purchaser’s and sellers’ transactions comply with federal state laws and regulations.  It is not a fee for additional services.  The BAC is additional commission for the real estate services provided by Americana for a buyer or seller.  It is for services actually performed and is the result of the buyer and seller engaging Americana.  The BAC is assessed to each client in excess of the commission that the listing broker typically pays the buyer’s broker and is in excess of the listing commission amount.  The BAC is separated from the other commission, such as the listing or buyer broker, and is earmarked as a commission for the client to pay separately from other charges for the broker&#8217;s accounting purposes.  Federal law states a real estate broker’s fees may only be charged if the broker is engaged independently and the fees are reasonable and customary. The legal status of land contracts varies from region to region. Typical land contracts are easy to understand, and typically represent only 3-5 pages. Land contracts are common in the United States. </p>
<p> <strong><b>Buyer</b></strong> </p>
<p> <b>Buyers</b> are less likely toaway from a contract on the ground on foot or hire-purchase agreement to pay more if the buyer has made a great advance. Often, <b>home buyers</b> are able to make combined monthly payments associated with home ownership, but they lack the down payment needed to buy a house. In these cases it often makes sense for <b>buyers</b> to consider buying a house or a piece of property and the owners / sellers to provide financingpurchase. </p>
<p> <strong>Exposition</strong> </p>

<p> Land contracts vary widely fromTransaction to transaction. Land contracts are often misunderstood and are often in favor of other, less for the purchase and sale of homes to avoid preferred. </p>

<p>Mondays trading turned out to be a mover, to the upside. The market has pushed itself back up to the top of its range and in fact hit that all elusive number I had called for so many months ago, 1120. Mondays we hit 1120.25 on the cash market S&#38;P a full 50% fibonaci retracement of the full trading move over the past two years.</p>
<p> The momentum did turn rather quickly with the size of the move and currently is up on the 120 minute chart. As I write this post it is currently Tuesday a.m. and today happens to be the day that the new investors sentiment numbers come out. I will not see them until Thursday, but the price action that takes place today is reflective of those numbers. So today&#8217;s close on Tuesday, is going to be very important.</p>
<p>I am anticipating the numbers to turn more positive which in-fact will be more negative in reality, but we will have to see how it turns out, first with todays close and then with the numbers themselves.</p>
<p>The month of December has traditionally been a positive one and some have even called it &#8220;The Santa Clause rally&#8221;.  In the last 20 years, Decembers trading has shown a gain 16 out of the last 20 years. At this level, it would be 17, but we are not finished yet. It is noteworthy and that is why I point it out.</p>
<p>Below, I have posted the trades I took for Monday. I have not traded for several days, but thought I would squeeze a little in. The market was just coming off a big rally up and then I come in. Well, I knew better, to try to play the trend, because we were coming into overhead resistance and coming off a large move up already, which started in the pre-market. That is why I have a different model to trade out of, based on price action conditions. It is not rocket science for me to switch to &#8220;Scalp Mode&#8221; and pick up a few trades and points in both directions. All I do is follow my &#8220;Turning Points&#8221; as I have shown you before. In-fact I mentioned it in my last post. The thing to do is just follow it. If you do, the trades work out, if you don&#8217;t, they don&#8217;t, pretty simple. I did an OK job in following my signals, I could have done better. You can see where I came in and compare that to the signal turns in the link below.</p>
<p>If I was trading earlier, I am sure I would have had those break outs to the upside. Starting January, I will definitely be trading the open and getting my points for the day will be easier and quicker for me. The pace is faster and I like it. Trading after the market has slowed, is not what I prefer, but as I have said before, I have to take what the market gives at the time I decide to trade. A trader can not impose there will on the markets, so you learn to take what it offers at that time.</p>
<p>I absolutely love the way I approach the market. I could always stay in &#8220;Scalp Mode&#8221; if I want to, but I would at times miss out when the market shows signs of life and has legs. I have my other screen set up to accomodate this type of run away condition and can easily take advantage of it, if it presents itself. It is not really hard to switch into this screen, one click of the mouse at the bottom of my Trade Station Platform and I am there. A screen set up to accomodate large moves that are very clearly defined that only require you to follow it. It always boils down to that, can you follow signs to get to your destination, they are clearly marked.</p>
<p>In my blog, I often talk about things that hold traders back from following their signals. If you can get a handle on the trading discipline that is required to execute, you will make it. You first need the method or plan and some may call it system, but what ever it is you follow, it needs to be clearly defined and show consistency. Then you need to exercise your mind and build your character to follow through with it. If you don&#8217;t have the first one, the second one will not help you and if you have the first one without the second, you will still be in trouble, the two go hand in hand.</p>
<p>Start the rebuilding process now, start exercising your mind, write out your plans on paper in your trading journal, hopefully you have one. Start exercising your body as well, this will get your endorphins kicking in and give you some blood flow and hopefully motivation, be consistent. Get going now, see the picture in your mind of how it all comes together, but it takes action. It is not going to happen only by thinking about it. Once you see the big picture, break it down into small bit size pieces. What is it going to take to get step one finished or started, then on to step two. Break each one of the steps down as well, if it requires more work. If you write it out and take this approach, you will be moving forward towards your goal and dreams. This takes you out of the dream state and puts you in the driver seat. Do you know where you are going? When will you get there? What will it be like when you arrive? Taking charge of your life is up to you and all it really requires is one small word &#8220;DECIDE&#8221;. Have you?</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>At the Council Rock School Board meeting of December 17th, Paul Anagnostakos expressed the opinion that it was a bad reflection on the Board as far as its ability to make decisions for it to reconsider granting an extension of the sales agreement for the Melsky Tract to Toll Brothers and Leo Holt.  After all, it was just on December 9th that the Board, at a special meeting, had voted <strong><em>not</em></strong> to grant an extension. He said they had voted no and that it was laughable to vote again so soon &#8212; and that Toll was trying to embarrass the Board by coming back again.</p>
<p>Later in the meeting, Richard Abramson contended it was not a bad reflection on the Board but that it showed flexibility and good governance.</p>
<p>I would tend to agree with Dr. Anagnostakos&#8217; statement on how this vote made the Board look.</p>
<p>The way the motion was worded in the agenda, and the explanation given ahead of the vote, included the following:</p>
<blockquote><p>The rational behind this one month extension is to allow our Board and the public to fully understand the terms and conditions of the proposed settlement.</p></blockquote>
<p>What&#8217;s at odds with this statement is that it was <em>not made clear</em> to the public nor to the Board precisely what the terms and conditions of the proposed settlement were.  During the meeting it was clear that the Board (and thus the public) had differing notions of the reason this extension was being granted.  At some points, it was contended (by John Donaghy, the Board&#8217;s special counsel for the Melsky sale) that this extension was simply to allow Toll Brothers more time to draw up settlement documents to execute the purchase &#8212; he cited the timeline of substantial time to work out documents for closing.  Yet Mr. Donaghy also had  indicated the request was for 30 days to explore a proposed settlement, to afford the Board and the public time for review. At some points, there were statements by Board members that the time may be for Toll to make new proposals (about what was never made clear), while at others there were statements that this was just added time for closing documents to be prepared.</p>
<p><strong>So if the rationale were to allow full understanding, the rationale was not met and the extension should not have been approved without such clarification.</strong></p>
<p>But that didn&#8217;t stop the School Board from approving it by a vote of 6-3. Only Paul Anagnostakos, J. Dennis McMenamin and Robert Donnelly voted against it.  After having voted no on December 9th, Richard Abramson and Kyle McKessy voted affirmatively this time.</p>
<p>It should be remembered that this was a sales agreement dating back to June 2007, with full terms and conditions of sale clearly set forth.  A contention that the Board and the public need an additional month to &#8220;fully understand the terms and conditions of the proposed settlement&#8221; would make one question why what was not understood in two and a half years could now be understood in a month.  Hence the contention that this was not simply an extension so Toll could draw up documents for settlement of the sale, but that something else was being planned, potentially a proposed change in conditions and terms.</p>
<p>Mr. McMenamin found the concept that more time was needed simply for settlement documents to be prepared for execution untenable, saying it &#8220;isn&#8217;t rocket science.&#8221;  (remember, Toll and Holt still maintained the ability to close on the agreement anytime before December 31st).  He said they don&#8217;t need more time, proffering instead that they&#8217;re looking to change the agreement.</p>
<p>A read of the original agreement would also cast doubt on any contention that Toll Brothers needs more time simply to draw up documents to execute the closing. The sales agreement had stated that once land issues were resolved, settlement would take place within five days.  So that would mean it <em>can&#8217;t</em> take more than five days to draw up settlement documents.  And since the meeting was being held December 17th and Toll (and Holt) had until December 31st to close the sale, they had more than the five days needed.</p>
<p>So if it were not reasonably necessary so such documents could be drawn up, it lends credence to the idea that there is some new proposal in the offing.  There were references to this idea by Mr. Abramson, indicating near the end of debate that he fully expects there to be a new proposal (this after saying earlier in the meeting that this is an extension of time to settle, <em>not</em> for another proposal).  Patti Sexton mentioned the District may be asked to do something different and maybe needs to look at it a little longer.  Kyle McKessy said that if we don&#8217;t know the details of the settlement it would be irresponsible not to extend.</p>
<p>Thus Board members were basically saying that after two and a half years of a binding agreement and retaining the services of a special counsel, they did not understand the terms and conditions of the Melsky sale.</p>
<p>If it&#8217;s just an extension so they can draw up documents, why the wording of a &#8216;rationale to allow the Board and the public to fully understand the terms and conditions?&#8217;  Yet if it<em> is</em> anything but an unconditioned extension of settlement, the public has a right to ask how this Board can allow Toll and Holt to come up with new terms and conditions.  After all the concerns and division raised the last few years as Veterans Cemetery issues were held hostage until the School Board agreed to sell Melsky, Toll is to be allowed new consideration?</p>
<p>One of the public comments made at the meeting spoke of how many sellers to Toll wait inexorably for their money. Dr. Anagnostakos thought this wasn&#8217;t just an extension, that Toll may come in with conditions of when to pay, or some payment plan. Mr. McMenamin also indicated his belief Toll is looking to change things, otherwise a title company could draw up papers quickly.  Yet this flies against statements by the special counsel that it was all because the timeline didn&#8217;t allow enough time for settlement documents to be drawn up.</p>
<p>So was the rationale clear?</p>

<p><strong>Hi I’m Betsy Stowe a student at the Windswept Center.  I’m interviewing Vickie Parker the founder and director of the Windswept Center about Energy Beings. </strong></p>
<p><strong> </strong></p>
<p><strong>B.   Tell me about these beings.  There are some people who think it’s scary that beings can come in and inhabit human bodies.  Most think that it is possession or something akin to satanic experiences.</strong></p>
<p><strong> </strong></p>
<p><strong>V.   Most of the beings I’m going to talk about are beings we make contracts with to help us, say for instance, stand, energetically speaking, between us and an abuser.  They protect us from the ‘punishment’.  This punishment or abuse could be physical, mental or emotional. </strong></p>
<p><strong> </strong></p>
<p><strong>Beings can also come in to fight a fight for us against a group of thugs that caught us off guard in a dark alley or walking home at night.  Or they help lift a car off of a child that is pinned underneath it.  Not all beings that come into a human body are bad.</strong></p>
<p><strong> </strong></p>
<p><strong>B.  But there are other types of beings?  Those who inhabit a body when an opportunity arises such as a person getting drunk and leaving their body.</strong></p>
<p><strong> </strong></p>
<p><strong>V.   Yes, drinking lots of alcohol creates disconnect between the human body and the spirit inside.  And I’ll talk about this more later.</strong></p>
<p><strong> </strong></p>
<p><strong>B.  Great!</strong></p>
<p><strong> </strong></p>
<p><strong>V.    Beings inhabit human bodies more than people know.  They do this for many different reasons.  One of the first is to protect a child from some type of ongoing punishment or physical, mental and/or emotional abuse from a parent.  I’m one of these children, and I didn’t know I had a being in me until I was in my 30’s.</strong></p>
<p><strong> </strong></p>
<p><strong>B.    Will you tell us more about this?</strong></p>
<p><strong> </strong></p>
<p><strong>V.   Sure.  In an abusive situation children can’t handle what is going on.  The situation is more than a young child can take and they ‘leave’.  Vacate.  While they are gone the abuse happens and they are not aware of what happened even after they return back to the body.     A being coming in to protect is actually pretty common and I came across one a couple of weeks ago in one of my students.  She is totally unaware that she has one, and it is a powerful one that needs to leave.  He has fulfilled his ‘duty’ and should not be inside her anymore.</strong></p>
<p><strong> </strong></p>
<p><strong>This being first came into her body to protect her from a step father.  She actually surrendered most of her identity in times of crisis as a child to this being.  The being would stand between the child (Her) and the adult so that the child consciously would not experience the abuse.  You could say that there was no body home other than the being when the child’s body experienced the abuse.</strong></p>
<p><strong> </strong></p>
<p><strong>B.   So when the being doesn’t leave when the child grows up what happens?</strong></p>
<p><strong> </strong></p>
<p><strong>V.   There can be a total disconnect when the being is in control most of the time.  What is interesting is that you can see the shift from the person to the being by watching their face.  The face actually changes in front of your eyes. Maybe the face gets longer and the nose changes.  Sometimes the eye color changes somewhat and they get taller. And what is even more interesting is if the being sees in your eyes that you saw the change they actually let you know that they know you saw them by a slight shift in the eyes or another part of the face as the lips.</strong></p>
<p><strong> </strong></p>
<p><strong>As the years pass the being can become more in control of the human to the point that the human may hardly ever be present. </strong></p>
<p><strong> </strong></p>
<p><strong>B.  So you experienced something similar?</strong></p>
<p><strong> </strong></p>
<p><strong>V.  For a long time I didn’t know that the ‘talking to both sides of me” was me and a being.  What I mean by “both sides of me” is I would have conversations back and forth in my head about topics and I actually caught many years worth of these conversations in my journal.  Journaling was when I was more receptive to what was going on in my mind.  About me.  Inside of me.</strong></p>
<p><strong> </strong></p>
<p><strong>One part of me would write about what they thought something was about. Or I had an opinion on something I heard.  Or experienced.  Then I would almost immediately get another opinion from what I thought was the other side of my brain.  Kinda like right brain versus left brain reasoning.</strong></p>
<p><strong> </strong></p>
<p><strong>I just thought that I was fantastic at looking at both sides of things.  And as the conversations continued we, me and the being, would come up with combined finished ideas, an awareness, on a topic we were discussing.  Never once did I realize I had a being in me.  I was totally impressed and fascinated by my mind.</strong></p>
<p><strong> </strong></p>
<p><strong>B.   So how did you discover the being?</strong></p>
<p><strong> </strong></p>
<p><strong>V.   The being surfaced in an intuitive reading I had back in 2001.  The reading was a very thorough one that caused the being to show itself because it was fascinated by what was being shown to me about myself.  The reader actually saw the being by my 1<sup>st</sup>, 2<sup>nd</sup>, and 3<sup>rd</sup> chakras, and let me know it was there.   The reader asked me if I would like to remove this being.   I went inside and clairvoyantly looked at it.  When I realized what its purpose was I asked the being is they were ready to leave.  It was hesitant at first.  I said that I no longer needed them to protect me. They were still protecting me even though the original experiences no longer occurred. </strong></p>
<p><strong> </strong></p>
<p><strong>Once it reluctantly agreed to leave I worked with the reader who walked me through the steps from moving it out of the chakras and on out through the top of my head.  It was a fascinating process as the being actually was not quite ready to leave. It was in resistance.  So energetically I kept talking to the being that it was alright.  That I was all grown up and no longer needed it to protect me.</strong></p>
<p><strong> </strong></p>
<p><strong>The process to remove the being took 20 minutes because I had to remove all of its energy from every part of me including my chakras, and the energy system around me.   The complete reading was an hour and half.</strong></p>
<p><strong> </strong></p>
<p><strong>When the being emerged and stood in front of me it was a little boy about 5 years old.  He had medium brown wavy hair and big brown eyes.  He had on pants too long for him and they were rolled up at the ankles.  He had a checkered shirt on.  And boot like shoes.  He was very present as he looked at me.  He even smiled child like at me. </strong></p>
<p><strong> </strong></p>
<p><strong>Then he turned around and ran off.  He disappeared through a doorway that did not exist on this plane.  What I saw vanished as soon as he went through the doorway.</strong></p>
<p><strong> </strong></p>
<p><strong> With him gone I was totally different.  I realized that all the years he was with me I was looking through his eyes.  That I really was so use to him being with me that I was not even aware of the difference between myself and him.  It was an interesting experience becoming totally acquainted with a space I hadn’t inhabited by myself for ¾’s of my life.  It took awhile to fully get acquainted with how it felt to be the only spirit in my body.</strong></p>
<p><strong> </strong></p>
<p><strong>On my own after releasing the being I would have anxiety in stressful situations but I realized I had to learn how to cope with it.  So it took me awhile to gain some sense of feeling ok when I was confronted with situations I was not use to or had experience with.  It took about a total of 3 or 4 years to really get to know who I was and to start understanding the world around me through my own eyes and my responses to it. </strong></p>
<p><strong>The major change that I noticed at the beginning of me being on my own was that my vision was totally clearer than it had been previously when I was looking through another set of eyes.  I felt very vulnerable for quite some time as I did not have that energy standing between me and the world.  But as the weeks past I totally loved having just me in this body.  And I was able to take full charge of me and live the life I came to experience this lifetime.</strong></p>
<p><strong> </strong></p>
<p><strong>It was exceptionally hard for me to make friends because I did not have the tools.  All of my behavior before belonged to another spirit.  Work relationships was the hardest for me because I spent at least 8 hours a day with other people. </strong></p>
<p><strong> </strong></p>
<p><strong> </strong></p>
<p><strong>B.  Tell me about the OJ Simpson speculations that he had a being in his body when he killed his wife.</strong></p>
<p><strong> </strong></p>
<p><strong>V.   There are stories that OJ abused his wife during their relationship.  There is also speculation that he killed her and Goldman in a jealous rage when he saw her with him.  And that the emotion he had at seeing them together allowed a being to come in to commit the murder.  There are those who observed OJ during the trial that were positive that he believed he was not guilty of the murders.  They base this on his responses to questions and how he behaved in court that he never once showed himself as a killer.  He was acquitted. </strong></p>
<p><strong> </strong></p>
<p><strong>Let’s go back to what drinking a lot of alcohol does.</strong></p>
<p><strong> </strong></p>
<p><strong>B.   You’ve discussed in a class of yours that alcohol consumption can cause the spirit of an individual to leave and allow a being to come in and take over the body.</strong></p>
<p><strong> </strong></p>
<p><strong>V.   Yes.  A prime example of this is at bars.  If you are clairvoyant enough you can see beings hovering over the head of or staying close to people consuming alcohol as they wait for an opportunity to take over the body if just for only a little while. </strong></p>
<p><strong> </strong></p>
<p><strong>For beings that don’t have bodies a physical body is prime real estate.  The reason some beings don’t have bodies is that they are not advanced enough to create a body for themselves.  So they take a body when it becomes available.</strong></p>
<p><strong> </strong></p>
<p><strong>So say you’re with a group of people and all of you are laughing and drinking and having a good time.  A couple of hours pass and all of the sudden one of the people becomes angry and starts calling a couple of people in the group nasty names.  Everyone is astounded by the behavior because they have never seen the person act this way.  This is a prime example of a being taking a body.</strong></p>
<p><strong> </strong></p>
<p><strong>Later on, usually the next day, the person who the body belongs to is back and has no memory that they were a handful until they were told by others in the group.  This person has no memory what so ever of anything happening.  They remember to a certain part of the night out but nothing after that until they woke up the next day.  They don’t even remember how they got home and in their bed.</strong></p>
