The fact that any payment was made with a subsequently dishonored negotiable instrument shall constitute prima facie evidence that the actor failed to pay within the meaning of subsection a. of this section, and the trier of fact may draw a permissive inference therefrom that the actor did not intend to make the payment.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>It scares the wee out of me.  Aggressive trampling crowd, elbows flying, sprints to endcaps, a tug of war over the last one, where you end up beaten bloody on the floor -crying Mama &#8211; while you rock back and forth sucking your thumb.</p>
<p>Um, no thanks!  Okay, I&#8217;m sure that&#8217;s not what <em>really</em> happens, but I have no desire to find out otherwise. I&#8217;ll just lounge in my PJs, thankyouverymuch.</p>
<p>Yesterday was my first Thanksgiving with Jason&#8217;s family. His mother graciously welcomed me, my mother, and my daughter Sydney to the grand feast.  The table was decorated with ceramic pumpkins, fancily folded napkins in rings, and beautiful china. The food was a foodie lover&#8217;s dream, so friggin&#8217; delicious. She went above and beyond. That is one mother who <em>LOVES</em> with all her heart, and it spills over into all the hard work she puts into this Thanksgiving dinner for her family.</p>
<p>Even more beautiful was the children racing around, giggling, screeching, and constantly filling their bellies. I have decided my delight in  children comes from a long line of family genes. Goes back as far as we know to teachers in the previous generations. Except it ended with me, because I loved travel more, but I digress.</p>
<p>I got a kick out of watching my mother, mingle, laugh, and enjoy the meelee. Most of the children in our family are grown, so this was a sight to see and reminisce.  It was eerie how well she fit in. But I&#8217;m not surprised. Good people with the same values, and upbringings as ours, which is why I love them so much.</p>
<p>Good Friday kicks off the start of the countdown to Christmas.  Good Friday is a shoppers dream. Good Friday reminds me of the time my car was broken into. I was running on the trails in Fort Worth.  It was somewhere around six or seven miles.  I get back to find a policeman next to my car which has a shattered drivers side window.</p>
<p>That wasn&#8217;t even the worst of it. My purse was in the car. Yes, I know -  how dumb. I went to the back hatch opened it, popped the hidey hole, and voila there was my purse. Then I checked the middle console where my keys were (to the car, house, etc). Yep! Still there. Oh the cop was none to happy about that, but seriously &#8211; jogging with a big wad of keys? &#8211; or jogging with a very small remote to the car? Yeah, I chose remote &#8211; shamefully.</p>
<p>I was very lucky. I never parked there again, and at the time &#8211; I wasn&#8217;t sure I&#8217;d ever get to jog again. Husband 2 was a tyrant. He went ballistic over this infraction. Of course, it was<em> my fault</em>, and I was never to jog again, EVER. Insurance does not pay for that, so we had to fork over a few hundred dollars. Some Black Friday, huh? See why I don&#8217;t like them.</p>
<p>But the gift was that it could have been so much worse, being my purse<em> was</em> in the car, and keys. All I lost was a lousy tinted window.  I have never parked there again, in fact, I started parking in a shopping center and walking to the trails. I never, ever took my purse with me.  So, it all worked out, I got to keep running at my favorite park and learned some valuable lessons.</p>
<p>That brings me to what I promised myself, that I would begin a series of posts,  from now until Christmas titled<em> Timeless Gifts.</em> You know what those are &#8211; things you can&#8217;t price &#8211; just revel in the majesty of the gift. Instances of  kindness that blow you away, or movement of the season to make you really realize what Christmas is all about. An unbelievable act that has you falling to the floor, shouting  &#8220;I&#8217;m not worthy!&#8221;  Yeah, those kind.</p>
<p>I have a lot of those in my life. The car breakage is one.  Can you imagine right before Christmas to have your I.D and bank card stolen? It would have made for a tough time, to deal with all that, and wonder if you&#8217;d ever be safe again &#8211; not to mention the fallout, and punishment from #2.</p>
<p>I, for one, was very grateful it wasn&#8217;t that bad and still am. My eyes were opened to the<em> Timeless Gifts</em> that happen all around. I hope I can share them with you. I hope I do the stories justice in the coming weeks. Until then&#8230;.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>The <em>Los Angeles Times</em> <a href="http://www.latimes.com/news/nation-and-world/la-na-little-mogadishu25-2009nov25,0,6965393.story?page=1">has an analysis</a> of what might have prompted <a href="http://refugeeresettlementwatch.wordpress.com/2008/11/26/holy-cow-now-40-young-somalis-are-missing-in-minnesota/">Somali former refugees</a> to trade their lives in Minneapolis (aka Little Mogadishu) for life in the real war-torn hell-hole, Mogadishu.  I don&#8217;t really buy the &#8216;youths trying to find themselves&#8217; angle or the &#8216;poverty made them do it&#8217; excuse.   As a matter of fact, other refugees from other nations also live in poverty and they don&#8217;t take up arms and dash off to terrorist training camps.  The article doesn&#8217;t say much about the patriotism angle we often hear, and barely touches on what I believe is the real reason&#8212;they responded to the call of Allah.</p>
<p>In any case, please read this article, it&#8217;s more than the usual boilerplate story we have seen on this topic because it gives us some new information, even if for some it may get your blood pressure up! </p>
<p>Here is how it begins, little Moghadishu&#8212;a neighborhood Mark Twain would not recognize!</p>
<p style="padding-left:30px;">Reporting from Minneapolis &#8211; Barely a block from the Mississippi River sits a neighborhood Mark Twain could not have imagined.</p>
<p style="padding-left:30px;">Men with henna-streaked beards and women in full-body <em>hijabs </em>streamed Tuesday past the Maashaa Allah Restaurant, the Alle Aamin Coffee Shop, the Kaah Express Money Wiring stall, the storefront Al-Qaaniteen Mosque and other similar structures.</p>
<p style="padding-left:30px;">&#8220;When I came here as a refugee in 1995, there were just a few hundred Somalis, and we were very alone,&#8221; said Adar Kahin, 48, who was a famous singer back home and now volunteers at a local community center.</p>
<p style="padding-left:30px;">&#8220;Now everyone is here,&#8221; she said cheerfully. &#8220;It&#8217;s like being back in Mogadishu. That&#8217;s what we call it, Little Mogadishu.&#8221;</p>
<p>Then here we go with the FBI promoting the &#8216;poverty made them do it&#8217; excuse.</p>
<p style="padding-left:30px;">For the FBI, Little Mogadishu has become the center of an intense investigation into a recruiting network that sent young men to fight in Somalia for a radical Islamist group known as Shabab, or &#8220;the Youth.&#8221;</p>
<p style="padding-left:30px;">Investigators say the poverty, grim gang wars and overpacked public housing towers produced one of the largest militant operations in the United States since the Sept. 11 terrorist attacks.</p>
<p>Trying to find their identities, some &#8216;youths&#8217; applaud the Jihadists who called <em>America the land of the devil </em>and others don&#8217;t.</p>
<p style="padding-left:30px;">Outside the Brian Coyle Community Center, five young men who emigrated from Somalia as toddlers huddled in black hoodies under a cold, clammy fog that turned the day dull gray. They shared smokes and spoke of those who had joined the jihad, or holy war.</p>
<p style="padding-left:30px;">&#8220;Some of them felt America is the land of the devil,&#8221; said Said Ali, who is 20, rail-thin and jobless. &#8220;They were losing their culture, their language and their religion. They&#8217;ve got family there. They feel at home.&#8221;</p>
<p style="padding-left:30px;">If he had the money, he said, he would go to Somalia too.</p>
<p style="padding-left:30px;">&#8220;My friend went,&#8221; he said. &#8220;He&#8217;s running a hotel. He carries an AK-47. He&#8217;s living life good.&#8221;</p>
<p style="padding-left:30px;">Ali Mohamed, also 20 and unemployed, jumped in. &#8220;These guys are blowing up women and kids,&#8221; he said. &#8220;That ain&#8217;t right.&#8221;</p>
<p style="padding-left:30px;">The difficult search for identity is an old story in this area.</p>
<p>This is new information: the radical cleric who is thought to have influenced Major Nidal Hasan is fingered in this article by none other than <a href="http://refugeeresettlementwatch.wordpress.com/2009/11/17/lol-omar-jamal-to-represent-somalia-at-the-un/">our old buddy Omar Jamal</a>.  I wouldn&#8217;t put it past Jamal to shift the attention away from the mosque in Minnesota to an Imam in Yemen.</p>
<p style="padding-left:30px;">Some members of the group that went to Somalia were said to be followers of Anwar al Awlaki, an American-born firebrand imam who preaches on the Internet in flawless English about the need to fight for Islam.</p>
<p style="padding-left:30px;">Army Maj. Nidal Malik Hasan, the accused killer of 13 people at Ft. Hood in Texas this month, had exchanged e-mails with Awlaki, who is based in Yemen.</p>
<p style="padding-left:30px;">Omar Jamal, director of the Somali Justice Advocacy Center here, said Awlaki&#8217;s fierce sermons helped inspire several of the youths who later joined Shabab in Somalia. Awlaki has praised the militia, which U.S. officials say is allied with Al Qaeda.</p>
<p style="padding-left:30px;">&#8220;They exchanged messages on his blog,&#8221; Jamal said. &#8220;They prayed for him. They watched his videos. They fell under his spell of influence.&#8221;</p>
<p>Finally at the end, a hint about the real reason these youths joined the Jihad&#8212;the mosque and the call of Allah.</p>
<p style="padding-left:30px;">&#8220;All these guys who left, we looked up to,&#8221; Bosir said. &#8220;When we came here to play basketball, they would go to the mosque. And somehow, they got brainwashed. And now they&#8217;re dead.&#8221;</p>
<p>Just a reminder to readers, we learned from <a href="http://refugeeresettlementwatch.wordpress.com/2009/11/24/who-fingered-zakaria-maruf/">Zakaria Maruf,</a> one of the  missing (maybe now dead) youths, that <a href="http://refugeeresettlementwatch.wordpress.com/2009/09/13/6th-american-jihadist-believed-to-have-died-in-somalia/">they heard the call of Allah</a>.</p>
<p>If only we citizens and people in authority in places like the FBI, would start to focus on the real reason (religion) and not try to analyze this in terms of our view of the world, we might actually avert Islamic radicalization and inevitable terrorist attacks.  These Somalis don&#8217;t care about patriotism or material things, two main driving forces in American society, they care about creating <a href="http://refugeeresettlementwatch.wordpress.com/2009/01/09/beware-we-are-coming-al-shabab-spells-out-its-plan-for-worldwide-caliphate/">an Islamic caliphate across the globe</a>!</p>

<p>The US State Department has <a rel="#someid81" href="http://refugeeresettlementwatch.wordpress.com/2008/09/10/how-did-we-get-so-many-somali-refugees-the-numbers-are-telling/">admitted over 80,000 Somali refugees to the US </a>in the last 25 years and then last year had to suspend family reunification because <a rel="#someid82" href="http://refugeeresettlementwatch.wordpress.com/2008/11/12/state-department-possibly-tens-of-thousands-of-somalis-in-the-us-illegally/">widespread immigration fraud</a> was revealed through DNA testing.  That specific program has not yet been reopened, but <a href="http://refugeeresettlementwatch.wordpress.com/2009/11/20/state-department-close-to-reopening-previously-fraud-ridden-program/">will be soon</a>.  Nevertheless, thousands of Somalis continue to be resettled as I write this.</p>

Por unanimidade, os ministros indeferiram o Habeas Corpus (HC 97413) impetrado pela defesa.</span></span></p>
<p style="text-align:justify;"><span style="color:#333333;"><span style="font-size:small;">J.R. foi preso em Ribeirão Preto (SP), em 2008. Outros dois HCs em favor do empresário já foram negados pelo Tribunal de Justiça de São Paulo e pelo Superior Tribunal de Justiça.</span></span></p>
<p style="text-align:justify;"><span style="color:#333333;"><span style="font-size:small;">O réu é acusado de supostamente realizar vendas pela Internet e não entregar equipamentos de informática. No habeas corpus apresentado ao STF, alegava-se a nulidade absoluta do processo devido à deficiente apresentação de defesa prévia, pelo defensor dativo, por ter emitido juízo de valor sobre a causa.</span></span></p>
<p style="text-align:justify;"><span style="color:#333333;"><span style="font-size:small;">Em março de 2006, ele não obedeceu à intimação da Comarca de Ribeirão Preto para ser interrogado. Seguindo os trâmites legais, foi nomeado defensor dativo para apresentação de defesa prévia.</span></span></p>
<p style="text-align:justify;"><span style="color:#333333;"><span style="font-size:small;">Conforme o HC, o defensor dativo afirmou, de forma pessoal e categoricamente, que o empresário praticou o delito. Assim, sustenta que a defesa proporcionada foi omissa, meramente formal, sem sequer entrevistar o acusado, além de não estarem presentes as diligências recomendáveis.</span></span></p>
<p style="text-align:justify;"><span style="color:#333333;"><span style="font-size:small;">O relator, ministro Dias Toffoli, destacou o texto da defesa prévia: “apresentar a sua defesa prévia e assim faz reservando-se o direito de ao final, após a produção de provas demonstrar sua inocência, já que embora leva-se a crer que o requerido tenha cometido a infração penal que lhe é imputada às folhas 3”. Entretanto, segundo o ministro “é evidente que o defensor dativo quis dizer que a denúncia leva a crer, mas que ele vai provar a inocência ao longo da instrução”.</span></span></p>
<p style="text-align:justify;"><span style="color:#333333;">“</span><span style="color:#333333;"><span style="font-size:small;">O acusado estava revel. Foi feita a defesa do possível”, completou o ministro Marco Aurélio. Assim, para os ministros que compõem a Primeira Turma do STF, não houve nulidade do processo por ausência de defesa prévia. Esse foi o entendimento do relator, ministro Dias Toffoli, no sentido de negar o pedido, tendo sido acompanhado por unanimidade dos votos.</span></span></p>

No, this is not an attack on President Obama or on the Democrat-controlled Washington. It is simply a review of what the USA has come to, some things under the banner of freedom and democracy.</p>
<p>Here is a partial list:</p>
<p>•	Way back we knew that Americans have equal rights. Somehow today, equality means Women First.</p>
<p>•	Civil Rights were transformed into Affirmative Action, and have brought endless instances of Reverse Discrimination.</p>
<p>•	Freedom of Speech is your right as long someone does not take you to court for libel, defamation, or go figure whatever crazy law lawmakers on all levels of governments voted into the books since 1789.</p>
<p>•	Way back, Americans knew they had the right of privacy. In these days, however, under the banner of Freedom, everything needs to be made public record, including any Police-reported domestic dispute or traffic arrest you once had. Go figure where your privacy disappeared.</p>
<p>•	Officially you have s right of self-defense. But&#8230; when using this right make sure not to go too far, because you might land up in jail as a result of a government prosecution against you, or you will likely get sued for millions as a result of assault charges brought to you by the person who intruded your property and privacy.</p>
<p>•	It is illegal to write today a check, dated for today, if there is not enough money in the bank to cover it. Yet, in 2009, US banks will earn a total of $40 billion-plus in over-draft fees, including banks that charge you $35 for over-drafting despite that they don’t cover your check.</p>
<p>•	Under the name of a “right to choose,” discovered by the courts only close to 200 hundred years after the Bill of Rights was written, doctors may do a procedure on a fetus that others get charged with murder if they do the same. Yes America: Decide if destroying a fetus is a matter of choice, or a matter of murder.</p>
<p>•	If you are a Navy SEAL who arrested a terrorist that killed, mutilated, and hung on a bridge American contractors in Iraq, you might stand trial on assault charges for punching this madman in his face. Worse, your own Department of Defense will lead the charges against you. Not enough? If you didn’t commit this act, yet you didn’t report your colleague either (same goes if you don’t want to give up information to the government about a criminal family member), you can be charged with “aiding and abetting” a criminal.</p>
<p>I am certain that more things might come to mind regarding where America has gone crazy, a craziness which is mostly rooted in political correctness, and/or pure stupidity.</p>

O prazo atual de seis meses adotado pela empresa faz com que crimes, como de exploração sexual da criança e do adolescente, fiquem impunes. O MPF requisitou que a empresa se posicione em dez dias.</span></span></p>

A recomendação surge para que os crimes cibernéticos possam ser apurados sem perder dados necessários à investigação. Para o procurador da República Marcio Schusterschitz, autor da recomendação, </span><em><span style="font-size:small;">&#8220;é fundamental a empresa guardar os logs de acesso para que as investigações de crimes cibernéticos não sejam interrompidas por não se saber quem é o usuário que os cometeu&#8221;. </span></em></span></p>

</span></em></span><span style="color:#333333;"><span style="font-size:small;">Ele explica que </span><em><span style="font-size:small;">&#8220;se em uma investigação um saite informa o log de acesso de um internauta, que guardava em sua página fotos de crianças ou adolescentes explorados sexualmente, caso a Justiça demore mais de seis meses para determinar que a empresa identifique de quem era o log de acesso, o mesmo já terá sumido, porque o provedor não o guarda por mais de seis meses&#8221;.</span></em></span></p>

</span></em></span><span style="color:#333333;"><span style="font-size:small;">O procurador, que faz parte do <a href="http://www.prsp.mpf.gov.br/crimes-ciberneticos" target="_blank">Grupo de Combate a Crimes Cibernéticos</a> do MPF em São Paulo, ressalta que o fornecedor de serviços de Internet deve proteger a criança e o adolescente contra formas de exploração sexual que ocorrem por meio da web.</span></span></p>

A Internet permite que pessoas utilizem identidades falsas ou se façam passar por crianças para aliciá-las com finalidades sexuais. </span><em><span style="font-size:small;">&#8220;Por meio de ferramentas da web, os predadores sexuais exploram a inocência da criança ou do adolescente&#8221;,</span></em></span><span style="color:#333333;"><span style="font-size:small;"> afirma o procurador.</span></span></p>

O Grupo de Combate a Crimes Cibernéticos vem atuando para coibir e previnir os crimes na Internet. O MPF já recomendou ao Google que informe o conteúdo de 3.261 álbuns de fotografia bloqueados por usuários denunciados pela ONG Safernet &#8211; que contêm fotos de pornografia infantil. O assunto foi levado à CPI da Pedofilia, que quebrou o sigilo dos dados e a companhia os entregou.</span></span></p>

Cinco provedores brasileiros &#8211; Uol, Terra, IG, Bol e Yahoo &#8211; também já receberam recomendação para que monitorem chats de crianças e adolescentes para evitar que possíveis pedófilos abusem de menores.</span></span></p>

<p class="western" style="font-weight:normal;margin-bottom:0;"><span style="font-family:Verdana, sans-serif;"><span style="font-size:small;">Como gosta de repetir o presidente Lula em seus discursos, nunca antes na história deste País, o seu governo foi tão bondoso e generoso com o auto-intitulado Movimento dos Trabalhadores Rurais Sem Terras (MST). Um movimento que sob a bandeira da reforma agrária, promove o caos e a desgraça no campo, mas que possui fervorosos defensores, até mesmo, nas atitudes mais extremas e radicais. </span></span></p>
<p class="western" style="font-weight:normal;margin-bottom:0;"><span style="font-family:Verdana, sans-serif;"><span style="font-size:small;">Recentemente, um promotor gaúcho tentou pôr fim às ações truculentas do MST. Mas não conseguiu. Gilberto Thums, do Ministério Público Estadual, provocou uma onda de ódio pelo mundo. Recebeu e-mails de vários países condenando sua postura, foi chamado de Hitler, ameaçado de morte, e numa sessão da Assembleia Legislativa gaúcha, foi encurralado por um turba de sem terras que babavam de ódio, por ele propor acabar com as madraçais do MST, as chamadas escolas itinerantes, que instigam o ódio nas crianças.</span></span></p>
<p class="western" style="margin-bottom:0;"><span style="font-family:Verdana, sans-serif;"><span style="font-size:small;"><span style="font-weight:normal;">O MST é hoje uma organização criminosa e sem personalidade jurídica – portanto, inimputável, sob a ótica da lei. No entanto, como um movimento que não existe juridicamente no papel, tem conta no Banco do Brasil e consegue receber mais de R$ 115 milhões do Governo Federal? A resposta parece complexa, mas não é. Segundo reportagem de setembro da revista </span><em><span style="font-weight:normal;">Veja</span></em><span style="font-weight:normal;">, parte do dinheiro é repassado através de quatro entidades ligadas ao MST (Anca, Concrab, Cepatec e Itac), que depois o utiliza para pagar empresas de transporte, gráficas e editoras vinculadas a partidos políticos. É o mesmo dinheiro que financia invasões de propriedades privadas e produtivas, destruição de laboratórios de pesquisa e milhares de pés de laranja da fazenda Cutrale, maior empresa produtora e exportadora de suco de laranja do mundo.</span></span></span></p>
<p class="western" style="font-weight:normal;margin-bottom:0;"><span style="font-family:Verdana, sans-serif;"><span style="font-size:small;">Contudo, para alguns boçais isso é “normal”. É tudo pela reforma agrária. Por ela, vale tudo. Vale degolar Policial Militar, vale manter em cárcere privado e sob a mira de um revólver a família do fazendeiro, vale destruir mais de 10 mil pés de laranja, vale matar cães e atirá-los nos poços de água potável da propriedade, vale matar seguranças da fazenda. Pra essa gente, vale tudo.</span></span></p>

The names do not correspond with the address and are in a random order. But first States Attorney&#8217;s, (who was her attorney at one time), letter. She was never arrested or prosecuted for<span style="color:#800000;"> Identity theft of her daughter or the social security numbers on her credit report.<span style="color:#000000;"> Nor the no account checks listed in a brief history of an id theif.</span><br />

<p>Acompanhando o twitter da prefeita Dárcy Vera recebi mensagens sobre a duplicação da Av. Henry Nestlé, e da intenção da prefeita em levantar verba para recapeamento asfáltico de 1826 quadras. Sejam bem vindas essas melhorias para Ribeirão Preto, cidade que a maioria nos orgulhamos de pertencer.</p>
<p>MAS&#8230;</p>
<p>Sugestão de pauta, enviem exatamente as 18:00 horas de algum dia da semana um repórter, cinegrafista ou fotógrafo no cruzamento da rua Luiz Barreto com o córrego do Tanquinho, local onde existe a favela do Brejo de um lado e um terreno baldio de outro.  Ali, no terreno baldio (local que deveria ser de preservação ambiental por se tratar das margens de um córrego, e também deveria existir uma avenida projetada a mais de 40 anos e que nem se ouve falar) a partir das 18:00 horas, começa a aglomerar-se por volta de 35, 40 usuários de drogas. É a cracôlandia de Ribeirão Preto.</p>
<p>Conhecidos popularmente como &#8220;casqueiros&#8221;,  os indivíduos usam o local não só para o uso de entorpecentes, mas também para dividir produtos de roubos feitos durante o &#8220;horário comercial&#8221; em lojas, domicílios e carros por toda a região. Campos Elíseos, Jd. Independência, etc. Por isso visitem o local após 18:00 horas.</p>
<p>No local, encontra-se até barracas no meio do mato para os usuários se abrigar e organizarem suas mais variadas forma de arrecadarem dinheiro para o uso, na maioria, de crack.</p>
<p>Não só de crimes vivem os marginais ali reunidos. Alguns fazem mendicâncias, &#8220;vigiam carro&#8221;, limpam vidros no semáforo, isso quando não se aproximam de uma idosa gritando, impondo que ela lhe dê algum dinheiro.</p>
<p>Andem pelo bairro de Campos Elíseos, da Av. Francisco Junqueira até a Vila Mariana, da Av. Meira Júnior até a Via Norte, cruzem o bairro na madrugada, no meio dia, a não ser pela manhã, pois a maioria dos freqüentadores da cracolandia ribeiraopretana estará dormindo após horas e horas de vadiagem, crimes e consumos de drogas, e constatarão uma verdadeira invasão de usuários, andarilhos, mendigos, retardados e outros tipos que não conseguimos classificar. Perguntem aos moradores, o quanto aumentou o numero de pessoas estranhas, sujas, sem documentos, marginais foragidos que a policia não abordam pensando serem simples catadores de recicláveis.</p>
<p>O bairro está abandonado pelo poder público, e não de agora com a atual administração. A administração de Welson Gasparini, de Palloci, de Magioni e de Jábali, deram as costas para o maior bairro e colégio eleitoral da cidade. Aqui no Campos Elíseos vivem idosos indefesos, casais com baixa renda indefesos, trabalhadores indefesos, comerciantes indefesos, crianças indefesas, etc.</p>
<p>Agora, “SE” a prefeita está realmente interessada na urbanização da cidade, abrindo avenidas indo atrás de dinheiro pra conseguir dar uma nova cara pra cidade, já demorou pra ela abrir a tal da Avenida Contorno Norte, popularmente conhecida como Avenida do Tanquinho. Não precisa ser toda feita, uma parte, o menor trecho, entre a rua Onze de Agosto e a Via Norte, cerca de 2 km, e ela ajudaria a vida de quase 150 mil pessoas que moram na região e estão indefesas, assustadas, com nojo de outros seres humanos por desconhecerem tal capacidade de se destruir e incomodarem o próximo  como os casqueiros fazem.</p>
<p>O Campos Elíseos e região não conseguem mais com suas próprias forças brigar contra a violência que aqui se encontra, isso por causa de uma simples avenida que não se faz o mínimo esforço para se construir, tornando um local de favelados, usuários, foragidos e criminosos atuantes. Não se esquecendo dos problemas ambientais.</p>
<p>Vocês são da imprensa, sabem que os números apontam o Campos Elíseos como o bairro mais violento de Ribeirão Preto, sou vitima da violência, alguns de vocês também são. Aquele trecho de avenida limparia a região, resolveria problemas sociais, de saúde pública, de violência, eliminaria buracos negros da cidade, espaços sem urbanização e iluminação, que extrairia o maior dente cariado que Ribeirão Preto tem. No maior bairro, com mais tradição, onde se encontram tudo e mais um pouco, mas que foi e continua esquecido pelas administrações.&#8221;</p>

<p>最近テレビでよく見る、<a href="http://en.wikipedia.org/wiki/The_Home_office">Home Office</a>（イギリス内務省）が先日21日に新しく始めた「<a href="http://policingpledge.direct.gov.uk/">The Policing Pledge</a>（警察活動の誓約）」の広告。190万ポンドをかけたこの全国的な広告キャンペーンは、11月、12月の間、イングランドとウェールズの警察が地域住民への義務を謳ったもので、テレビ、ラジオ、雑誌、インターネットで展開、また600万戸の家庭にパンフレットが配られる。</p>
<p>このPolicing Pledgeは、警官は80％の時間を地域のために使い、緊急ではない問題を届け出た住人には48時間以内に会うこと等を約束している。また、12月には、「<a href="http://news.bbc.co.uk/1/hi/uk/8371219.stm">Name and Shame</a>（名前を公表して恥をさらす）plan」を地元警察と地方自治体に通達、有罪判決を受けた犯罪者をウェブサイトで公表する計画だ。</p>
<p>これは昨年度の統計で、盗みや窃盗などの軽犯罪から性犯罪、強盗、詐欺、暴力犯罪、薬物犯罪の重犯罪まで、全犯罪520万件のうち約3分の1に当たる170万件もの犯罪が、「screening out（ふるい分け）」されて取り調べてられていなかったとして、警察が批判を浴びたことが背景にある。最悪なのはロンドンの<a title="首都警察 (イギリス)" href="http://ja.wikipedia.org/wiki/%E9%A6%96%E9%83%BD%E8%AD%A6%E5%AF%9F_(%E3%82%A4%E3%82%AE%E3%83%AA%E3%82%B9)">首都警察</a>で、通報された犯罪のうち、たった48％しか捜査に至っていない。平均で75％の盗み、70％の器物損壊、55％の窃盗、44％の詐欺や偽造、20％の強盗、15％の暴力犯罪、2％の性犯罪、1％以下の薬物犯罪が「ふるいわけ」されたと言う。私たちもMの自転車を盗まれたり、バイクのナンバープレートを偽造されたりしたことがあるけれど、こんな些細なこと、警察は何もしてくれていないんだろうな。でもこの「ふるい分けシステム」が続けば、犯罪者のやり得、逆に犯罪率が高くなるか心配だ。この「約束」がちゃんと実行されて、地域住民が安心して生活できるよう頑張ってもらいたい。</p>
<p>ちなみにこの広告キャンペーンに使われているデザインは、第二次世界大戦初期の1939年に政府によって作られたポスター（実際には使われなかったが）、「<a href="http://en.wikipedia.org/wiki/Keep_Calm_and_Carry_On">Keep Calm and Carry On</a>（平常心を保って、頑張れ）」を元にしている。このポスターが2000年に「再発見」されてから、多くの企業が使用、このデザインを使ったTシャツやマグカップ、バッグ、ポスター、tea towel（布巾）等さまざまな<a href="http://www.keepcalmandcarryon.com/">グッズ</a>が作られている。私もこのシンプルだけれど、インパクトのあるデザインが好きで、ポスターを2枚持っている。Mはしばしばパニクってしまうことがあるので、その際はポスターを指差し、冷静になるように自制を促すのにも役立っている。</p>
<p>Recently I have seen few times the TV advertisement of &#8220;<a href="http://policingpledge.direct.gov.uk/">The Policing Pledge</a>&#8220;, a £1.9m national advertising campaign explaining what should be expected of police in England and Wales. Launched on November 21, t<a href="http://en.wikipedia.org/wiki/The_Home_office">he Home Office</a>&#8217;s campaign involves adverts on television, radio, magazines and internet throughout November and December, as well as leaflets distributed to 6 million homes.</p>
<p>According to the Policing Pledge, neighbourhood officers should spend 80% of their time on duty in the community and members of the public reporting a non-emergency problems will be seen within 48 hours. In December, the Home Office also introduce &#8220;<a href="http://news.bbc.co.uk/1/hi/uk/8371219.stm">Name and Shame</a>&#8221; plan, which encourage police forces and councils to use websites to name key local convicted criminals.</p>
<p>What urges the Home Office to put up the Policing Pledge is the criticism against <a href="http://www.telegraph.co.uk/news/newstopics/politics/lawandorder/6623745/Police-fail-to-investigate-one-third-of-crimes.html">the police that failed to investigate around 1.7 million out of 5.2 million reported crimes</a> last year, <span style="font-size:13px;">including sex attacks, robberies, fraud, violent crimes and drug    offences, as well as large numbers of burglaries and thefts – around one-third of all offences were dismissed as unsolvable within hours by &#8220;screening    out&#8221;. The highest rate of screening out was by the <a href="http://en.wikipedia.org/wiki/Metropolitan_Police">Metropolitan Police</a>, with only 48% of reported offences dealt with in 2008/9. In parts of the country, an average of around 75% of theft are screened out, as well as around 70% for    criminal damage, 55% for burglary, 44% for fraud and    forgery, 20% for robbery, 15% for violent offences, 2% for sexual attacks, and less than 1% for drug offences. We experienced petit crimes like M&#8217;s bicycle stolen or his <a href="http://everydaylifestyle.wordpress.com/2009/07/16/new-number-plate-for-ms-vespa/">Vespa&#8217;s number plate cloned</a>, but I guess that nothing have been done for it. But criminals are the sole winner with this &#8221;screening out&#8221; system, and this could endanger the security of the community and possibly encourage more crimes to happen. Hope this campaign will work to regain the public&#8217;s confidence and trust in police force, and contribute to reduce the crime rate.</span></p>
<p>The design used for the Policing Pledge is originally from &#8220;<a href="http://en.wikipedia.org/wiki/Keep_Calm_and_Carry_On">Keep Calm and Carry On</a>&#8220;, the World War II motivational poster produced by the government in 1939 but never used. It was rediscovered in 2000 and has been re-issued by a number of companies, and used in a range of <a href="http://www.keepcalmandcarryon.com/">products</a> such as T-shirts, mugs, bags, posters, tea towels and so on. I like this simple but strong design, and we have two posters ourselves. M gets panic easily and when that happens, it is useful for me to remind him what he should do, by just pointing out the poster!</p>

<p style="text-align:justify;">As a Filipino youth voter and  Mindanaoan, I am one with the thousands of Filipinos grieving and condemning this inhuman act.</p>
<p style="text-align:justify;">I am greatly disturbed knowing that such merciless people exists in this country. They weren&#8217;t satisfied indiscriminately killing people, they even mutilated, shot in private parts and  allegedly, raped their victims.</p>
<p style="text-align:justify;">I am also saddened that the government seems not powerful enough to enforce the full force of the law. As of the last count, 57 dead bodies were recovered. Authorities know who the perpetrators are but still, after 3 days, no concrete actions were taken, no suspects were invited (to at least) give a statement, no warrants of arrests.</p>

<p>When the Indian Prime Minister Manmohan Singh meets President Obama during his visit to the US this week, the two leaders will discuss the framework for strategic dialogue between the two countries.</p>
<p>Singh seeks to solidify a relationship, transformed under the Bush administration from distant friendship to that of a ‘key ally’. That transformation led to a nuclear cooperation deal, increasing trade and investment, educational exchanges and unprecedented security collaboration. He is keen to finalize the civilian nuclear deal and seek Obama’s support for his bid for a permanent seat on the UN Security Council.</p>
<p>Singh may also seek reassurance that the Indo-US relationship will not be overshadowed by the increasing Sino-US collaboration.</p>
<p>&#160;</p>
<p>After the collapse of Soviet Union, India’s former mentor and ally, India sought an alliance with the United States who also had interest in wooing it. In the US containment-of-China policy under Bush, India could prove extremely useful to advance U.S. interests, particularly because of strained Sino-Indian relations over regional ambitions and border disputes which led it into a war with China in 1962, though with a humiliating outcome.</p>
<p>But this created a paradox for the US. Pakistan was once a key ally of the U.S., an important link in their strategy to contain communism during the cold war era and a member of the U.S.-sponsored, but now defunct military pacts – SEATO &#38; CENTO. Pakistan became highly suspicious of this U.S. ‘tilt’ towards India. Pakistan had an acrimonious relationship with India mainly over the Kashmir and water and India’s blatant role in the dismemberment of Pakistan in 1971.</p>
<p>The consistent Indian threat to Pakistan’s security led Pakistan to develop a nuclear response to Indian acquisition of nuclear weapons in 1974 to maintain the balance of power and ward off Indian hegemonic designs. Despite Pakistan’s efforts and calls by the international community, India refused negotiated settlements of disputes. This has kept the pot simmering, maintaining an uneasy peace in the region. In the absence of progress in resolving the root causes of tensions, recent assurances by Obama and Singh, that India poses no threat to Pakistan – were rejected outright in Pakistan.</p>
<p>The US has used Pakistan for its own geopolitical objectives in the past during the cold war, to drive the Soviets out of Afghanistan in the 1980s and then for its war on terror in Afghanistan after 9/11. While it aided and equipped Pakistan for the role it wanted Pakistan to play, Pakistan’s relationship with the US has swung from being the ‘most allied ally’ to being the “most neglected ally” and then to being the ‘most sanctioned ally’, depending upon how much the US needed Pakistan’s services at any given time. In Pakistan, the US has come to be perceived as most unreliable and is viewed with deep suspicion.</p>
<p>Presently, the deepening U.S. relations with India result from the changing American perspective of the region. India could prove to be a huge market for American high tech goods and weapon systems in the future. Also its growing nuclear and military strength coupled with regional ambitions could be useful to the US as its proxy for policing the region.</p>
<p>Realizing that he cannot maintain a military presence in Afghanistan for long, Obama needs to install a proxy power there too when he decides to pull out, most likely by 2011. India fits the bill. The US expects India to keep the government in Kabul under check, keep peace among warring factions and protect American interests.</p>
<p>India has its own interests too. The nuclear deterrence will not allow India to launch military aggression against Pakistan, but it can work for the dismemberment of Pakistan by promoting an Eastern Pakistan style insurgency in Balochistan and by continuing to squeeze Pakistan on the western border using rogue elements from the tribal belt. It has already begun to position its troops there under cover of “development work”.</p>
<p>The belief that India can hold the fort for the US is a fallacy. If the Afghans, who fiercely oppose foreign occupiers whom they have thrown out unceremoniously in the past and if the U.S. is also on the verge of withdrawal, what makes anyone think that Indian forces would be welcome to stay? Besides, the Taliban, who are bound to gain political influence in Kabul sooner or later, will reject Indian military presence on their soil, as it will represent American interests.</p>
<p>This Indo-US partnership, which seeks to serve divergent geopolitical objectives and is based on taking advantage of one and other, will neither be smooth nor lasting. Above all, it will seriously jeopardize peace in South Asia by alienating Pakistan and adding to its existing tensions with India. This will also ring alarm bells in Tehran and Beijing.</p>
<p>As of now in the current US matrix, cordial Sino-US relations are very important for a variety of reasons, mainly owing to U.S. reliance on Chinese economic support and that will not end any time soon. It is clearly not feasible for Obama to promote relations with India at the cost of its relations with China.</p>
<p>But this will not sit well with a sensitive India, given the history of Sino-Indian rivalry. Only recently the Indian officials, says a Washington Post report, in an outburst of Brahmanic self importance expressed concern that New Delhi has suddenly been relegated to the second tier of U.S.-Asian relations because Obama did not mention India in his speech on US relations in Asia recently. The speech was delivered in Tokyo and focused on the Asia-Pacific region and not South Asia. This, the Indians believe, is Obama’s failure to recognize India’s broader regional aspirations, something that the Bush administration had encouraged. The Indians were upset that “Washington was leaning too closely to China”.</p>
<p>Then to India’s chagrin came a call made through the joint statement on conclusion of Obama’s visit to China, in which Obama suggested that Beijing mediate between India and Pakistan. The statement said,</p>
<blockquote><p>“China and the United States are ready to strengthen communication, dialogue and cooperation on issues related to South Asia and work together to promote peace, stability and development in that region.”</p></blockquote>
<p><em>“A third-country role cannot be envisaged nor is it necessary”</em> to solve disputes between India and Pakistan, was the retort by Indian Foreign Ministry. The influential Times of India headline read “Obama’s China [credit] card casts shadow on PM’s US visit,” referring to the $800 billion in U.S. Treasury securities held by China.</p>
<p>Ashley Tellis of the Carnegie Endowment said he detected in India <em>“a sense of exclusion that’s been gnawing at them since the Tokyo speech.” </em>He added: “The joint statement prompted new fears that somehow the United States and China would collude to manage events in South Asia.”</p>
<p>Tellis said this has caused particular neuralgia in India because tensions between Beijing and New Delhi have risen recently over competing border claims. India is also upset over Chinese plans to divert waters of Brahmaputra River that originates in Tibet and flows into Northeastern India, without whose water its plains would lay waste. In addition, Indians are concerned that the Obama administration, unlike the Bush administration, views India as part of the South Asian problem, which includes the instability in Pakistan.</p>
<p>China’s interest in South Asia, a natural outcome of its regional security concerns in its sensitive underbelly and its very close relations with Pakistan, is unpalatable for India which considers South Asia as its exclusive domain.</p>
<p>These Indian sensitivities will keep the US on the edge. To assure them that India was in its own league in South Asia and of America’s growing closeness, Secretary Clinton spent four days in India in July but refrained from a stopover in neighboring Pakistan.</p>
<p>In a geopolitically sensitive region, where the US has to cater to important bilateral interests with China, even handedly deal with a Pakistan whose cooperation in Afghanistan is key to its success and which is increasingly angry over repeated American betrayals, and to keep the Taliban and Pashtun sensitivities in mind while negotiating a exit deal with them, the tendency to throw tantrums on the part of Indian leadership could make the new partnership difficult to sustain.</p>
<p>Therefore, before rushing into a collaborative arrangement with India and offering highly sensitive nuclear technologies, the US will be well-advised to first test out the prickly world of relations with New Delhi.</p>
<p>Despite tall claims about being the biggest democracy, India remains high on the list of human rights violations and has a long way to go in ensuring equal social status to Dalits (also called the <em>untouchables</em>) who form 20 percent of the population. It has been repeatedly accused of ethnic and religious cleansing of minorities.</p>
<p>If the US could make a political issue out of Tiananmen Square and Obama could refer to human rights issues during his China visit, why should not India be held to the same standard during Singh’s visit.</p>
<p>As for the Indian request for a permanent seat on the Security Council, it is important to bear in mind that India itself is involved in Kashmir dispute pending before the Security Council and whose Resolutions it has refused to implement. At the bottom of the dispute is the issue of exercise of the people’s will in determining Kashmir’s final dispensation. The dispute has led India to fight three wars with Pakistan and one with China. India has stationed several army divisions in Kashmir to subjugate the people and independent sources have confirmed killings of thousands of unarmed Kashmiris and sexual abuse perpetrated on thousands of women by these security forces.</p>
<p>In response to a similar bid earlier, India was advised to first settle the Kashmir dispute. Then the U.S.-India relationship had just begun to take shape with limited US influence over India. But now that the US enjoys greater clout, it could more effectively pressure India for a negotiated settlement, which is in every one’s interest, as well as in the interest of peace.</p>
