<h2 style="text-align:left;">What is BitTorrent Anyway??</h2>

<p><a href="http://www.bittorrent.com/">BitTorrent</a> is an extremely fast and efficient means of uploading and downloading.  BitTorrent is an excellent way to distribute large materials to many people via the internet.</p>
<h2>Radical Ideas</h2>
<p>Like so many of the radical new ways to do things that technology and the internet have made possible, BitTorrent can only work through co-operation.  BitTorrent requires a network of &#8220;peers&#8221;, or other people&#8217;s computers who are willing to share the file.  This is referred to as &#8220;peer to peer&#8221; or &#8220;<strong>p2p</strong>.  </p>
<p style="text-align:center;">If I have a large file I want to transfer, the first step is to “seed” the file, transferring portions of the file to multiple members of the p2p network.</p>

<h2>Bell Canada “Throttles” BitTorrent</h2>

<p style="text-align:left;">When Bell Canada was first caught “throttling” internet traffic to the Independent ISP customers, <a href="http://internet.bell.ca/index.cfm?method=content.view&#38;content_id=12119">Bell Canada&#8217;s justification</a> to the CRTC was that the internet was too crowded, and that it was necessary to “manage” the traffic.  Bell claimed that they needed to employ <a href="http://stopusagebasedbilling.wordpress.com/2009/10/28/c-deep-packet-inspection/">Deep Packet Inspection</a> to identify BitTorrent Traffic so that they can  “throttle” it.</p>

<p>Amazingly, the CRTC had nothing to say about Bell Canada&#8217;s plans to discriminate against particular Canadian internet users.</p>
<p>The CRTC has accepted Bell&#8217;s unsubstantiated contention that this discrimination was necessary, and in approving it they have allowed Bell Canada to think that this discrimination is acceptable.  In no way does this serve the Canadian public.</p>
<p>You might almost think that the CRTC mandate was to suppress Canadian creativity and the creation of Canadian movies and music.  The availability of the technologies that exist to make it easy to create our own movies and music should be welcomed as an opportunity to add to and help grow our Canadian Culture.</p>
<h2>Why single out BitTorrent traffic for throttling if it is an efficient use of the available bandwidth?</h2>
<p>One of Bell Canada&#8217;s arguments for implementation of Usage Based Billing is that Canadian internet bandwidth is in short supply, making it necessary for them to &#8220;manage&#8221; bandwidth by penalizing heavy users.</p>
<p><strong>So how could anything as efficient as BitTorrent possibly be seen as a bad thing if the Internet is so crowded? </strong></p>
<p>It doesn&#8217;t make sense to discriminate against BitTorrent use.  There is nothing inherently bad about BitTorrent use or BitTorrent internet traffic.   But Bell Canada&#8217;s contention is that BitTorrent is bad because people use it to download movies and music.</p>
<p>Which begs the question: how does that make BitTorrent bad?<br />

<h2>The Copyright Red Herring</h2>
<p>The &#8220;Copyright Lobby&#8221;, which consists of large media producers and distributors (like <a href="http://www.powells.com/biblio?isbn=0345422805">Disney</a>), and corporations and organizations (like <a href="http://www.defectivebydesign.org/mpaa-drm-tv">MPAA</a>), who distribute commercial movies and music, want us to believe that this is a bad thing.</p>
<p>This corporate special interest group has spent a great deal of time, energy and cash trying to promote the “<a href="http://en.wikipedia.org/wiki/Pravda">pravda</a>” that any digital copying of copyright works is bad.   Making no distinction between commercial bootleggers who distribute illegal copies for profit and legal purchasers who seek to make a back-up copy or digital format shift for personal use, the Copyright Lobby has been pressuring governments the world over to criminalize personal use copying.</p>
<p>The problem for ordinary citizens is that these corporate interests have vast quantities of money to spend and a great deal of media power.  This makes it incredibly difficult for governments to stand up to their onslaught.  In some parts of the world this persistent advocacy has paid off for the Copyright Lobby, as lawmakers knuckle under and legislate to the detriment of their own citizens by making it illegal even to copy or download movies or music for personal use.</p>
<p>Here in Canada the Copyright Lobby is seeking to influence our lawmakers to criminalize personal use copying.  They are trying to make Canadians think that people who make copies for personal use are performing criminal acts, and should be penalized the same as a a bootlegger who films the latest theatrical release off a theatre screen and proceeds to sell hundreds of thousands of bootleg DVDs.</p>
<p>Once again, <a title="go to Channel 4 programs: The I.T. Crowd" href="http://www.channel4.com/programmes/the-it-crowd/episode-guide">Channel Four&#8217;s hilarious I.T. Crowd</a> puts this question in perspective with this send-up of a <a title="go to YouTube to see Channel 4 programs The I.T. Crowd parody piracy commercial" href="http://www.youtube.com/watch?v=ALZZx1xmAzg">video piracy commercial</a> I found on <a href="http://www.youtube.com/">YouTube</a>.</p>

<h2>Canadian Law says</h2>
<p>RIGHT NOW, in Canada, personal use copying is simply not illegal.</p>
<p>RIGHT NOW, in Canada, use of the BitTorrent file transfer protocol is also perfectly legal.</p>
<p>RIGHT NOW, in Canada, peer to peer (<strong>p2p</strong>) file sharing is legal; Canadians break no laws simply by joining in a p2p network.</p>
<p>The Copyright Lobby’s smear tactics have gone a long way toward making the world believe that BitTorrent is inherently bad.</p>
<p>Bell Canada has convinced the CRTC that it is acceptable to “throttle” BitTorrent, because of BitTorrent&#8217;s reputed connection with possible copyright infringement.  So although BitTorrent is perfectly legal, Canadian internet users are paying the price for the success of this Copyright Lobby propaganda.</p>
<h2>Myth: All BitTorrent/p2p internet traffic consists of copyright movies and music</h2>
<p>The Corporate world doesn&#8217;t understand radical ideas like Open Source software and p2p file sharing because these concepts are so different from anything appearing in the old business models.  Even more incomprehensible to the outdated business models is the fact that it may or may not generate a direct monetary profit.</p>

<p style="text-align:left;"><img class="alignleft size-thumbnail wp-image-1544" title="IBM" src="http://stopusagebasedbilling.wordpress.com/files/2009/11/ibm.jpg?w=150" alt="IBM" width="150" height="73" /> For many years <a href="http://www.ibm.com/ca/en/">IBM</a> has taken the rap for this quote whether or not Mr. Watson really did say it.  (Most likely not.)   Maybe proving it wrong is part of why IBM is such a going concern in the 21st Century.   Having weathered the storms of fortune today&#8217;s IBM is a world leader by continuing to innovate and adapt alongside evolving attitudes and technologies.   IBM has been steadily increasing their participation and involvement with Open Source software in this new century.</p>
<p style="text-align:left;">The reality is that IBM not only understands the importance of open source, the corporation has actively supported and promoted adoption of <a href="http://www.ibm.com/developerworks/linux/library/l-lobintro.html">Linux</a> and Open Office in the corporate world.  And naturally <a href="http://www.ibm.com/developerworks/aix/library/au-spunix_rsync/">BitTorrent</a> is a part of the equation because it is such an efficient means to distribute large files (like for instance, <a href="http://www.canonical.com/">Canonical&#8217;s Ubuntu</a>.) <img class="alignright size-full wp-image-1547" title="ibmLINUX" src="http://stopusagebasedbilling.wordpress.com/files/2009/11/ibmlinux.jpg" alt="" width="92" height="111" /></p>

<p>Seems IBM actually does heed their most enduring slogan (which definitely <em>was</em> coined by Mr. Watson).   Sadly, this type of foresight is uncommon.  Because BitTorrent is such a radical idea, most entrenched corporations simply aren&#8217;t capable of understanding it.</p>
<h2>There are other uses for BitTorrent that are not only legal, but even perfectly acceptable in polite society.</h2>

Probably my favorite use of BitTorrent is the amazing <a href="http://www.gutenberg.org/">Project Gutenberg</a>.  This organization has been digitizing books in the public domain and distributing them freely&#8230; via BitTorrent, since this is such an efficient method of digital distribution.  After all, BitTorrent is used for transferring very large files like music and movies because it is very efficient.<br />

<p>BitTorrent file sharing is <em>not</em> all movies and music.  Like IBM, many people actually use p2p to help distribute open source software like <a href="http://distribution.openoffice.org/">OpenOffice</a> via p2p.  There is a growing body of open source software available, for instance my favorite web browser is Mozilla&#8217;s <a href="http://www.mozilla.com/en-US/firefox/personal.html">Firefox</a>.</p>
<p>In fact, there the awesome <a href="http://sourceforge.net/">SourceForge</a> website which provides a place to find all manner of open source software, or where you can release your own.<img class="alignright size-thumbnail wp-image-1712" title="ubuntu" style="border-width:0;" src="http://stopusagebasedbilling.wordpress.com/files/2009/11/ubuntu2.png?w=146" alt="" width="102" height="105" /></p>
<p>When a new distribution of <a href="http://www.ubuntu.com/">Ubuntu</a> is released, people around the world gather together and have <a href="http://laurelrusswurm.wordpress.com/2009/10/30/karmic-koala-release-party/">Ubuntu Release Parties</a> making more good use of BitTorrent</p>
<p><img class="alignleft size-full wp-image-1780" title="Pirate Party of Canada" style="border-width:0;" src="http://stopusagebasedbilling.wordpress.com/files/2009/11/pround.png" alt="" width="106" height="105" />And of course the Pirate Party of Canada has established <a href="http://www.pirateparty.ca/captain/torrents">Captain: the Canadian Pirate Tracker</a>, their own BitTorrent site where Recording Artists and Filmmakers (and I imagine novelists, and software creators as well would be welcome to utilize this) to freely distribute their work.</p>
<p>Every bit of music and every movie transferred is not a copyright infringement.  If I get to the point where my home made movies may prove marketable, I would certainly be looking at BitTorrent Distribution.  In fact it would probably be easier to distribute home movies to family via BitTorrent than it would be to try to burn DVDs.  (DRM makes the two commercial movie making software packages I&#8217;ve purchased almost unusable.  Of course it doesn&#8217;t slow down the bootleggers.)  If YouTube is an indicator, I&#8217;m not the only person who wants to transfer music and movies freely &#8230; not as copyright infringements.  I have paid levies to the music industry for home movies I have made and burrned to CD for distribution to friends and family.  If I choose to transfer them via BitTorrent now I can avoid the levy but instead suffer the added expense of Bell Canada&#8217;s deliberate throttling inflation?</p>
<p>Another really good legal use of BitTorrents are the actual commercial websites where people can go to to purchase downloads of music.  So far no one seems to have found anything wrong with this practice.</p>
<p>But that&#8217;s not all.  Canada&#8217;s own <a href="http://www.cbc.ca/">CBC Television Network</a> tried their own experiment by releasing an episode of their program <a href="http://www.cbc.ca/nextprimeminister/blog/2008/03/canadas_next_great_prime_minis.html">Canada&#8217;s Next Great Prime Minister</a> via BitTorrent.  Unfortunately the BitTorrent didn&#8217;t work so well because of <a href="http://newteevee.com/2008/03/27/cbc-torrent-caught-up-in-isps-bittorrent-throttling/">Bell Canada&#8217;s CRTC approved BitTorrent “throttling”</a>.</p>

<p>Which is not to say it wasn&#8217;t a good idea.  Not too long ago <a href="http://twitter.com/michaelgeist">Michael Geist</a> tweeted about the <a href="http://nrkbeta.no/2009/03/08/norwegian-broadcasting-corporation-sets-up-its-own-bittorrent-tracker/">Norwegian Broadcasting Corporation</a>&#8217;s foray into BitTorrent use.  All accounts indicate that their experiment was very successful indeed, which is having a big impact in the way they do business.</p>

<p>I guess it isn&#8217;t such a sad story after all.   </p>
<p>Thanks to piracy this Indie film called <a href="http://www.doubleedgefilms.com/">INK</a> was has been achieving a distribution level that the filmmakers had never dreamed of.   They are of course extraordinarily pleased.</p>
<p>I think what is being called piracy here is BitTorrent p2p personal use sharing.   Friends sharing with friends is one of the most effective ways to achieve recognition.  They used to call it a &#8220;grass roots&#8221; movement.  This is one of the major issues for the large movie studios.  This is the place where they complain of being ripped off.  What they don&#8217;t seem to realize is that this is a good thing.  Exposure garners fans,  makes a &#8220;name&#8221;.  Fans buy stuff.</p>
<h2>BitTorrent Traffic is not the only thing Bell Canada is Throttling</h2>

Rumour has it that there are people who actually work from home.  </p>
<p>Time was the government encouraged the idea of people working from home.  There are all sorts of advantages to society, like reduced congestion on actual highways, less wear and tear on our roads, a decrease in commuting based pollutants in our environment, a reduction of human depletion of fossil fuels.</p>
<p>But if you work from home, you are probably going to have to transfer files back and forth between your  home and workplace.  Chances are good that you are going to encrypt this type of traffic for security reasons.  Although Bell Canada says they are only “throttling” BitTorrent traffic, in fact there have been instances of Bell throttling encrypted internet traffic on the assumption that if it&#8217;s encrypted, it must be BitTorrent traffic.</p>
<p>Bell places the onus on the customer to prove their &#8220;innocence&#8221; before they will consider stopping throttling.</p>
<p>Since the CRTC gave Bell Canada permission to use <a href="http://stopusagebasedbilling.wordpress.com/2009/10/28/c-deep-packet-inspection/">Deep Packet Inspection</a> to inspect our packets, the only way to ensure that our private information remains private is through encryption.  And in Canada any encrypted internet traffic will most likely to be throttled.</p>
<h2>Canadian Copyright Consultation</h2>
<p>The Canadian Government is looking at updating Canadian copyright law.  They held a copyright consultation process this year, traveling around Canada soliciting opinions of stakeholders.  Even better, they set up a website where they accepted submissions from any Canadian who wished to contribute.  This website was flooded with <a href="http://www.ic.gc.ca/eic/site/008.nsf/eng/h_00001.html#itm7">thousands of submissions</a>.  Some are simply a few lines, some are extensive essays covering all sorts of topics, but all I&#8217;ve read are heartfelt.   Because of the overwhelming response it took a long time to get all the submissions posted.  (<a href="http://www.ic.gc.ca/eic/site/008.nsf/eng/02770.html">My own submission</a> finally made online.)</p>
<p>This process led a lot of Canadians, including me, to believe that the copycon process might actually mean that our elected representatives were listening to us.</p>
<p>Unfortunately there is currently a lot of pressure on our government to make copying movies, software and music for personal use illegal.  The secret <a href="http://www.michaelgeist.ca/content/view/4530/125/">ACTA</a> meetings have caused a feeling of dread to settle over most Canadians.   There has been deprecating talk about weak Canadian copyright law.  </p>

<p>If anything, Canadian copyright law is probably more robust than is good for us.</p>
<p>The essential problem that the copyright lobby is attempting to overcome the problem of suing their own customers for what they imagine are infringements.  They have noticed that fighting personal use copying garners bad publicity.  This problem can be neatly solved by passing the responsibility for finding and prosecuting copyright infringement to governments.  And of course the only was to get government to take ob the responsibility is to convince them that the copyright infringement is a criminal offense.  </p>
<p>Regardless, currently copyright law is imprecise as regards personal use copying.  So we&#8217;ll just have to wait for an actual law to be passed before it becomes illegal.  (This pressure is actually largely from foreign owned interests&#8211; like Disney.  It will be interesting to see if our government caves to this outside pressure.)</p>

They let it go because it was in their best interests to allow time shifting (i.e personal use copying).   Disney knew this was in their best interests because it would help the Canadian cable companies build their market.</p>
<p>Of course now Disney doesn&#8217;t want us to record their movies for personal use.  Disney would be happy if our government decided personal use copying was illegal.  They would be happier still if our government spent time and energy searching out and charging people who download Disney movies.</p>
<p>Disney would be happy they no longer had to expend time and energy chasing down copyright infringements.  They would be ecstatic if our Mounties were to do it for them.  Gratis.</p>

<p>So even though p2p networks or copying movies and music are not actually illegal in Canada, our friends the CRTC gave Bell Canada permission to &#8220;throttle&#8221; anyone using BitTorrent transfers. <p>Dulu, kira2 waktu masih SMP, sy, kakak, &#38; orangtua pergi ke toko sepatu.. tujuannya, mw nyari sepatu sekolah utk kakak sy.. memang sepatu kakak sy udah rusak.. sy cm nemenin (ikut jalan2..=))..</p>

<p>Nah, waktu kakak sy ngeliat2 sepatu, sy ngeliat sandal biru yg bagus bgt.. tp sy kan masih punya sandal.. lagian mahal.. jd sy ga bilang ke orangtua sy..</p>

<p>Setelah kakak sy slesai membeli sepatu, kami keluar toko dan nyari makan siang.. setelah agak jauh, akhirnya nemu tukang sate..</p>

Semoga PJ panitia mendapat balasan atas kebaikannya, udah ngebantuin sy nyari sandal.. ya, walaupun sy ga nyerita, PJ-nya tau klo sandal itu berarti buat sy..</p>

<p>Transfers to a CRT are “delayed” charitable contributions. As such, they can significantly reduce a donor’s income and estate tax liability without completely divesting the donor of the current benefit of the donated property. In addition, if appreciated property, such as real estate, is donated to the CRT, there is no capital gains tax due when those assets are sold.</p>
<p>A CRT gives the donor an opportunity to (1) be the trustee of his or her CRT; (2) receive an immediate income tax deduction equal to the present value of the remainder interest; (3) avoid capital gains tax on the sale of appreciated property contributed to the CRT; (4) diversify assets; (5) receive annual income from the trust; and (6) reduce estate taxes since the appreciated property is deductible from the donor’s estate tax base.</p>
<p>Insurance purchased in an Irrevocable Life Insurance Trust (ILIT) can be used to replace the value of the assets contributed to a CRT for family members. The ILIT can be funded by tax savings provided by the charitable donation.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>A diretora do Centro de Referência e Treinamento em DST/Aids (CRT) de São Paulo, Maria Clara Gianna, defendeu durante o 1° Encontro Paulista de Prevenção e Controle das DST/Aids, realizado entre os dias 4 e 6 em São Paulo, a interação entre a sociedade civil, os municípios e o CRT no enfrentamento dessas doenças.</p>
<p>“A proximidade com os movimentos sociais é importante porque você tem acesso aos problemas reais do país sobre a questão das DST/aids”, disse.</p>
<p>Maria Clara fez os pronunciamentos quando palestrava sobre o funcionamento do programa estadual de DST/aids no país, no âmbito das estruturas de gestão do Sistema Único de Saúde (SUS) e suas interfaces com os programas de DST/aids. Para a diretora do CRT é importante que cada município receba recursos.</p>
<p><strong>Conheça a estrutura da Secretaria</strong></p>
<p>A Secretaria de Estado da Saúde de São Paulo (SES/SP), cuja missão consiste na formulação da Política Estadual de Saúde e de suas diretrizes, norteada pelos princípios do Sistema Único de Saúde (SUS), tem sua atual estrutura administrativa pelos Decretos Estaduais n° 49.343/05 e n° 51.433/2006.</p>
<p>Além dos órgãos vinculados diretamente ao Gabinete do Secretário de Estado da Saúde (Conselho Estadual de Saúde, Conselho Técnico Administrativo, Consultoria Jurídica e Ouvidoria), compõem a Secretaria de Estado da Saúde (SES) três fundações e oito coordenadorias.</p>
<p>Entre as coordenadorias estão a Geral de Administração, de Gestão de Contratos de Serviços de Saúde, de Recursos Humanos, de Planejamento de Saúde, de Ciência, Tecnologia e Insumos Estratégicos de Saúde, de Serviços de Saúde, de Regiões de Saúde e a Coordenadoria de Controle de Doenças (CDD).</p>

<p>Pada tanggal 5 November 2009 Dirjen Pajak telah menetapkan Peraturan No <a href="http://www.pajak.go.id/dmdocuments/KEP-61-2009.pdf">PER-61/PJ./2009 </a>tentang Tata Cara Penerapan Penghindaran Pajak Berganda (P3B).  Peraturan tsb mulai berlaku terhitung sejak 1 Januari 2010 (Alhamdulillah tidak berlaku surut hehehehe).</p>
<p>Sesuai dengan UU PPh, Pemotong/Pemungut Pajak *) wajib untuk memotong atau memungut pajak yang terutang atas penghasilan yang diterima/ diperoleh oleh Wajib Pajak Luar Negeri (WPLN). Namun demikian, dalam hal WPLN berasal dari Negara mitra P3B, pemotongan/pemungutan pajak juga akan mengikuti ketentuan yang diatur dalam P3B.</p>
<p>Pemotong/Pemungut pajak terdiri dari :</p>
<p>a)      Badan Pemerintah;</p>
<p>b)      Subyek Pajak dalam Negeri;</p>
<p>c)       Penyelenggara Kegiatan;</p>
<p>d)      Bentuk Usaha Tetap; atau</p>
<p>e)      Perwawilan perusahaan luar negeri lainnya;</p>
<p>yang diwajibkan melakukan pemotongan atau pemungutan pajak atas penghasilan yang diterima atau diperoleh WPLN.</p>
<p><strong>Penerapan tariff sesuai P3B</strong></p>
<p>1. Pemotong/Pemungut Pajak harus melakukan pemotongan atau pemungutan pajak sesuai dengan ketentuan yang diatur dalam P3B, apabila :</p>
<p>a)      Penerima Penghasilan bukan Subyek Pajak dalam negeri Indonesia</p>
<p>b)      Persyaratan Administratif untuk menerapkan ketentuan yang diatur dalam P3B telah dipenuhi</p>
<p>c)       Tidak terjadi penyalahgunaan P3B oleh WPLN sebagaimana telah diatur dalam <a href="http://www.pajak.go.id/dmdocuments/KEP-62-2009.pdf">PER-62/PJ./2009</a></p>
<p>2. Apabila syarat2 tersebut diatas (point 1a-1c) tidak terpenuhi maka pemotong/pemungut pajak wajib memotong/memungut pajak yang terutang sesuai dengan UU PPh.</p>
<p>3. Persyaratan Administratif yang harus dipenuhi (ref point 1b diatas) adalah sbb :</p>
<p>a)      Menggunakan formulir Surat Keterangan Domisili (SKD)yang telah ditetapkan Dirjen Pajak (Lampiran II PER 61 –[Form – DGT I] atau Lampiran III PER 61 [form – DGT II] )</p>
<p>b)      (Formulir tsb) telah diisi oleh WPLN dengan lengkap</p>
<p>c)       (Formulir tsb) telah ditandatangani oleh WPLN</p>
<p>d)      (formulir tsb) telah disahkan oleh pejabat pajak yang berwenang di Negara mitra P3B, dan</p>
<p>e)      Disampaikan sebelum berakhirnya batas waktu penyampaian SPT Masa untuk masa pajak terutangnya pajak</p>
<p>4. SKD yang menggunakan [form DGT-1] yang disampaikan kepada pemotong /pemungut pajak setelah berakhirnya batas waktu penyampaian SPT Masa untuk masa pajak terutangnya pajak, tidak dapat  dipertimbangkan sebagai dasar penerapan ketentuan yang diatur dalam P3B sejak tanggal SKD tersebut disahkan oleh pejabat yang berwenang dari Negara mitra perjanjian dan berlaku selama 12 (dua belas) bulan</p>
<p><strong>Restitusi</strong></p>
<p>5. WPLN dapat menyampaikan permohonan pengembalian kelebihan Pajak yang tidak seharusnya terutang sesuai dengan ketentuan yang berlaku apabila manfaat P3B tidak diberikan akibat persyaratan administrative sebagaimana dimaksid pada point 3 tidak terpenuhi, tetapi WPLN menganggap pemotongan atau pemungutan pajak tidak sesuai dengan ketentuan yang diatur dalam P3B.</p>
<p><strong>Bukti Potong</strong></p>
<p>6. Bukti pemotongan/pemungutan wajib dibuat oleh pemotong pajak/pemungut pajak sesuai dengan ketentuan yang berlaku</p>
<p>7. Apabila terdapat penghasilan yang diterima/diperoleh WPLN, tetapi tidak terdapat pajak yang dipotong/dipungut di Indonesia berdasarkan ketentuan yang diatur dalam P3B, Pemotong/Pemungut Pajak tetap diwajibkan untuk membuat bukti pemotongan/pemungutan Pajak.</p>
<p><strong>Lain-Lain</strong></p>
<p>8. Pemotong/Pemungut Pajak wajib menyampaikan fotocopi SKD yang diterima dari WPLN sebagai lampiran SPT Masa</p>
<p>9. Kepala KPP harus melakukan penelitian kebenaran pelaporan atas jumlah pajak yang dipotong dan melakukan perekaman SKD dan bukti pemotongan/pemungutan yang dilaporkan oleh pemotong/pemungut pajak</p>
<p>10. Kepala KPP harus melakukan penelitian mengenai ada atau tidaknya BUT dari WPLN yang berada di Indonesia sesuai dengan ketentuan yang diatur dalam P3B</p>
<p>11. Apabila terdapat indikasi bahwa WPLN menjalankan kegiatan atau usaha di Indonesia melalui suatu BUT dan belum terdaftar sebagai wajib pajak, KPP memberitahukan KPP tempat BUT seharusnya terdaftar untuk dikirimi Surat Himbauan sesuai dengan ketentuan yang berlaku</p>
<p>12. Dengan berlakunya PER-62 ini, maka SE-03/PJ.101/1996 dan SE-04/PJ.101/1996 dicabut dan dinyatakan tidak berlaku</p>
<p><strong>Kesimpulannya</strong></p>
<p>Untuk dapat menerapkan tariff pemotongan/pemungutan PPh sesuai dengan P3B, hal-hal yang harus dilakukan adalah sbb :</p>
<p>1)      Pada saat pengiriman document tagihan (Invoice) ke Indonesia, WPLN harus sudah menyertakan SKD [form DGT-1 /  form DGT-2]  yang diisi lengkap, ditandatangani dan telah disahkan oleh pejabat yang berwenang, atau</p>
<p>2)      Akan lebih baik jika Blanko form DGT-1 atau form DGT-2 diserahkan ke Lawan Transaksi (WPLN) bersamaan dengan penandatanganan Agremeent agar dapat diisi lengkap, ditandatangani dan dimintakan pengesahan kepada pihak yang berwenang) sehingga dapat dikirim bersamaan pada saat pengiriman Invoice</p>
<p>3)      Jika terdapat beberapa transaksi dalam satu tahun, SKD tersebut (sepertinya) harus diisi kembali setiap bulan (bener ga sih?), kecuali untuk WPLN Bank dan  WPLN yang menerima/memperoleh penghasilan melalui custodian sehubungan dengan transaksi pengalihan saham/obligasi yang diperdagangkan atau dilaporkan di pasar modal di Indonesia, selain bunga dan Dividen</p>
<p>4)      Photocopy SKD harus dilampirkan dalam SPT Masa yang dilaporkan ke KPP</p>
<p>5)      SKD Asli harus disimpan Pemotong/Pemungut Pajak selama 10 tahun</p>
<p>6)      Meskipun PPh yang terutang NIHIL atau tidak terdapat pemotongan/pemungutan pajak, apabila terdapat pembayaran penghasilan kepada WPLN, Pemotong/Pemungut Pajak WAJIB membuat  bukti Potong PPh 26 dengan mencantumkan besarnya penghasilan bruto.</p>
<p>7)      Dan lain lain (nanti ditambahin lagi kalau sempat)</p>

<p>For 4 år siden, nærmere bestemt 29. juni 2005, kjøpte jeg mitt første LCD-TV; en Viewpia 32-tommer som var såkalt HD-ready. Det spesielle den gangen var at det stort sett var ukjente merker som dominerte det nedre prissjiktet blant LCD-TV&#8217;er og kampen sto da mellom Viewpia, Hanoi, Akai, Viewell, og en rekke andre mer eller mindre ukjente merker.</p>
<p>Det virket den gang som om de etablerte produsentene ikke var villige til å prise sine nye produkter så lavt fordi de da ville konkurrere direkte med den gamle billedrørsteknologien som de fremedeles pushet. Dette ga rom for nye aktører som så sitt snitt til å entre markedet og spille ball med de store ved å tilby ny teknologi med god kvalitet til en fornuftig pris.<!--more--></p>
<p>Overgangen fra store klumpete billedrørsfjernsyn til dagens full-HD flatskjerm TV&#8217;er var et paradigmeskifte innen TV-teknologien, og det største som har skjedd siden fargefjernsyn tok over for sort-hvitt mer en 40 år tidligere. Det er derfor også brukt som eksempel på en &#8220;<a href="http://en.wikipedia.org/wiki/Disruptive_technology#Examples_of_disruptive_innovations">disruptive innovations</a>&#8221; (bla. omtalt av Clayton M. Christensen i boka &#8220;The innovators dilemma&#8221;). I et slikt landskap vil den naturlige reaksjonen til de tunge etablerte aktørene være at de ikke ønsker endring, i allefall ikke så veldig fort.</p>
<p>Det interessante med overgangen fra CRT til LCD er at 4 åre senere har de store aktørene vunnet likevel. De har gjenerobret markedet, men nå med den nye teknologien som utgangspunkt. Butikkhyllene til de store kjedene domineres av merker som Sony, Philips, Panasonic, Samsung, LG og Toshiba. Kun 4 år etter at en bråte med nye, ukjente aktører &#8220;truet&#8221; de store med å ta over omsetningen &#8220;over natta&#8221; er de nærmest utradert til fordel for de samme gamle trauste og kjente merkene som den gangen ikke var så veldig interesserte i å fornye seg.</p>
<p><strong>Fra informasjon til kommunikasjon</strong></p>
<p>Sosiale medier er en annen slik disruptive innovation. &#8220;Social web&#8221;, eller &#8220;semantic web&#8221; vil overta for den gamle web&#8217;en, eller Internettet som de fleste kjenner det som. I morgendagens Internett er det brukergenerert innhold som er kongen på haugen, og vi ser allerede at de store trauste aktørene kjemper i mot. De ønsker ikke å endre seg, i allefall ikke så fort.</p>
<p>Med store trauste aktører mener jeg teknologiselskaper som Microsoft, HP, IBM, Oracle og kanskje til og med Google, samt tradisjonelle formidlere som aviser, forlag, musikk, radio og TV-selskaper. De som leder racet er selskaper som Amazon, Apple, Facebook, Twitter, MySpace og P2P-selskaper som PirateBay. Det finnes i tillegg et utall selskaper og teknologier innenfor nisjer og sjangere som dekker alt fra deling av film, tekst, bokmerker, bilder og annen media. En aktør som faktisk hadde litt fart, men som nå har mistet moment er eBay.</p>
<p>Et eksempel på brukergenerert innhold er når du under TV-programmet Skavlan <a href="http://twitter.com/#search?q=%23skavlan">søker på Twitter etter #skavlan</a> og kan i real-time følge med på hva folk i Norge og Sverige skriver om programmet og de som deltar der samtidig som du ser på. Det gir en merverdi som ikke må undervurderes, spesielt ikke av de som er opptatt av merkevaren.</p>

<p>I denne overgangen fra informasjonssamfunnet til kommunikasjonssamfunnet vil det i en tid være en del aktører som baner vei mens tradisjonelt store kjente merker stritter i mot. Selvsagt vil det gi grobunn for at nye selskap kan vokse fram og konkurrere med de store, som Facebook og Twitter, men i det lange løp vil nok de store kjente merkevarene likevel ta over og bli dominerende.</p>
<p>Min påstand er at på samme måte som med TV-produsentene vil vi om 4 år se at selskaper som IBM, Oracle, Microsoft, Apple og Google er de som dominere kommunikasjonskanalene og være &#8220;merkene&#8221; alle kjører sine varianter av applikasjonene på. Glemt er de små unike selskapene som tilbød geniale C2C (Customer2Customer) løsninger i en kort periode før de ble kjøpt opp eller gikk over styr.</p>
<p>I mellomtiden får vi nyte tilværelsen som best vi kan&#8230;.</p>

<p>P: “Kalau tmn2 kamu yg lain, udah beres draft-nya.. makanya bisa wisuda Juli. Kalau kamu juga mau Juli berarti sy yg harus menyiapkan waktu ekstra untuk memeriksa Bab 1 &#38; 2.. padahal ada S2 &#38; S3 yg harus lulus Juli ini, mereka terikat kontrak beasiswa..”</p>
<p>N: “Oh.. sy tanya dulu ke ibu sy. Kalau boleh Oktober, sy Oktober aja..”</p>
<p>P: “Iya, nanti hubungi Ibu lg.”</p>
<p>Sy pun pulang dan langsung bertanya ke ibu sy,,</p>
<p>N: “Mah, klo wisudanya ga jadi Juli gmn? Soalnya..bla..bla..bla..”</p>
<p>M: “Ya udah, Oktober aja..”</p>
<p>Hmm,, ternyata ga susah bilangnya..hehe..</p>
<p>Tp walaupun ibu sy udah setuju, sy masih berkeinginan utk wisuda Juli..hmm…</p>
<p>Sblm bilang ke pembimbing, sy ktemu tmn2 SMA dl,, yg memang lg kumpul2,, dan masuk ke topik, “Kapan mau wisuda?”</p>
<p>D: “Sy Oktober soalnya bla..bla..bla..”</p>
<p>M: “Sy juga Oktober. Klo ngga mah hari ini wisudanya..”</p>
<p>Hmm.. tmn2 pada Oktober jg..</p>
<p>Pdhl target awal tuh, sy ingin udah diwisuda sblm mudik..ingin udah diwisuda waktu umurnya masih 21thn..</p>
<p>ya udah, untuk kebaikan bersama, sy pilih Oktober,, dan sy pun merevisi target.. targetnya, bisa seminar 2 sblm Ramadhan..</p>
<p>Seiring berjalannya waktu, setelah sy memutuskan utk wisuda Oktober, banyak hal-hal positif yg terjadi.. memang, Allah selalu memberi yg terbaik utk hambaNya,, wisuda di waktu yg terbaik, dan hal-hal yg baik lainnya.. selalu ada hikmah di balik semua peristiwa..=)</p>
<p>Alhamdulillah, target hasil revisi telah tercapai, dan akhirnya sy wisuda tgl 24 Okt ’09.. =D</p>

<p>21.20       Rombongan (mobil 1: Ka2k, Ka2k ipar/t’Evi, Kayla/Ke2y, Mamah, n Bapak.. mobil 2: pak Rahmat, de An, Aa -yg baru nyampe bgt dari Bengkulu-, Te2h, n sy) berangkat dari rumah.</p>
<p>22.50      Nagreg, macet. Pak Polisi bilang, “Motor di sebelah kiri, jgn nyalip2!”</p>
<p>23.51       Cagak. Karena ngeliat mobil orang lain keluar jalur antrian, pak Rahmat nyangkanya memang dibuat jd 2 jalur, mobil 2 pun ikut2an yg keluar jalur itu.. karena ga ngantri, dimarahin polisi.. eh, tiba2 mobil yg td diikutin ngerasa ditabrak.. pdhl ngga kq.. kata sy mah itu kena dikit gara2 digebrak sama polisi yg tadi ngemarahin..atau kena motornya..soalnya kenanya itu di samping kanan,, mobil 2 kan ada di belakang mobil itu, bkn di samping kanan..  minta 200rb lg.. ya udah, drpd ribut, kami ngajakin ke bengkel aja brng2, ntar uangnya diganti, dianya ga mau.. ngajaknya ke pos polisi..</p>

<p>Shubuh di Jatilawang.</p>
<p>Pagi di Karanganyar.</p>

<p>Buka shaum ktemu keluarga ka2k sepupu sy (yg tinggal di Bandung jg)..</p>
<p>Trs, walaupun ‘sopir’-nya gantian antara ka2k, de An, dan pak Rahmat, ttp aja cape.. jd sering berhenti utk istirahat..</p>

<p>zZzz.. tau2 udah di Kab. Jember, Kencong, Kraton, nyampe rmh Bu’de Mus pas sahur..</p>
<p>lalu ba’da shubuh langsung istirahat, meluruskan badan stlh sekian lama duduk..hehe..</p>
<p><strong>Ahad, 20 Sep ‘09</strong></p>
<p>Sholat Idul Fitri, ngedengerin khutbah berbahasa Jawa.. ga ada yg nge-translate,,soalnya tante sy duduk di dpn, dtngnya lbh pagi dari sy..</p>
<p>Pulang dari masjid, salam2an,, ga ada opor ataupun ketupat.. Ibu sy lupa soalnya udah lama (&#62; dari 10 thn) ga mudik.. klo dulu, sblm Idul Fitri, ibu sy ke pasar utk belanja bwt bikin ketupat n opor.. jadinya makan pecel..</p>
<p>Nah, siangnya dibawain opor sm Mba’ Iin (anaknya Bu’de).. hehe..makan opor jg..</p>
<p>Trs, pkl 14.00 pergi ke rmh Mas Towi. Menikmati kelapa muda..emmm..enak bgt.. kelapa muda paling enak yg pernah sy makan, ya di sini ini tempatnya..</p>
<p>Pkl 15.10 keluarga dari Probolinggo datang, Mba’ Luluk, Mba’ Yuyun, istri n anak2nya de An, keluarga dari Lumajang jg dtng..</p>
<p><strong>Senin, 21 Sep ‘09</strong></p>
<p>06.41       Menuju Probolinggo, utk nitip Mamah n Ke2y karena ‘lima bersaudara’ mau pergi..</p>
<p>09.46      Main arung jeraaam..!!, di Songa atas.. di Probolinggo.. =D</p>
<p>Pas, bisa satu perahu soalnya lima orang, ‘lima bersaudara’ (sy n kakak2 jg t’Evi)..</p>
<p>Subhanallah, pemandangannya bagus bgt.. air sungainya bersih, ngeliat banyak kelelawar, ngerasain di bawah air terjun, n ngerasa kaget pas perahu karetnya digulingkan..</p>
<p>Setelah beres, sholat, makan siang dll, langsung ke rumah Mba’ Luluk, ngejemput Mamah n Ke2y..</p>
<p>16.45       Pergi ke Pelabuhan. Biasanya di sana ada pasar ikan, tp katanya masih libur.. ya udah, foto2 n makan bakso aja..brng Mamah, Aa, te2h, t’Evi, n Ke2y.. juga rombongan keluarga Lumajang..</p>
<p>Setelah nyampe lg di rumah Mba’ Luluk, makan malam, trs istirahat, n siap2 utk pergi ke Bromo..zZZzz.. (ayah sy memang ga ikut ke Probolinggo ini, mau siap2 utk acara reuni keluarga besar)..</p>

<p>Sekitar pkl 01.00, pergi menuju ke Penanjakan..</p>
<p>03.19       Nyampe di Penanjakan, siap2 utk ngeliat matahari terbit.. makan dl, minum yg anget2.. soalnya dingin bgt..grrrrr..</p>

<p>11.40         Nyampe di Masjid Agung Ciamis.. nungguin ayah sy sholat Jumat.. trs, sehabis sholat dzuhur, (sy, mamah, te2h) minum es campur..</p>
<p>Perjalanan dilanjutkan ke Leles, Garut, mengunjungi mertua ka2k sy..</p>
<p>Lalu pulang menuju ke rumah.. hampir kena sistem buka-tutup.. Alhamdulillah, perjalanannya lancar.. nyampe rumah dengan selamat pkl 17.30..</p>
<p>Ya, memang sy menanti-nantikan mudik ini soalnya pas liburan sblm seminar, tmn2 ada yg main ke Yogya, dll.. bener2 ingin liburan saat itu,, tapi ibu sy bilang, “Nanti aja pas mudik juga kita jalan2..”</p>
<p>Makanya, pengen bgt mudik, ktemu saudara n ngeliat pemandangaaaan..!!!</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Setelah seminar, sy melengkapi draft utk disusun menjadi buku TA. Membuat kesimpulan (yg lbh baik), cover, halaman pengesahan, kata2 mutiara, abstract, abstrak, prakata, daftar isi, n daftar gambar..</p>
<p>hmmm,, yg paling seneng tuh pas bikin prakata,, nulis ucapan terima kasih utk keluarga, dosen, saudara, sahabat, n tmn2 semua.. =)</p>
<p>Saat tahap penyusunan, terjadi tragedi luar biasa.. T_T.. laptop sy rusak,,kena lemparan benda tumpul dng kerasnya..jd LCD-nya pecah.. setengah dari layar laptop jd hitam, burem, campur aduk, ga bisa ngeliat apa2 di setengah layar itu..</p>
<p>sy kaget.. sedih jg (krn inget tmn sy yg harus kehilangan data TA-nya).. kembali ke dunia nyata, sambil berusaha menenangkan diri, sy nyoba transfer data ke DVD, Alhamdulillah, ternyata bisa..semua data pun ditransfer.. kejadiannya tuh bbrp hari sblm mudik.. saat itu ada banyak kejadian lain jg, mis: ada saudara yg kecelakaan, dll.. sampai2 kepikiran, ‘Ntar jadi mudik ga ya? Suasananya ga enak gini..’</p>
<p>Sy pun dipinjamkan laptop, tp word-nya 2003.. pdhl TA sy word 2007.. makanya ke warnet dl, nge-save-as k 2003..</p>
<p>Rencananya laptop pinjaman ini mw dibawa pas mudik, soalnya sy mw merapikan buku TA, biar ntar pas pulang langsung bs di-print..mw ngerjain tugas akta jg sih..</p>
<p>Hmm,, memang laptopnya dibawa, tp ga mood ngerjain tugas, jadinya dipake utk transfer foto dll..hehe.. ok, kisahnya dilanjutkan ke ‘Mudik 1430 H’,, yg sangat berkesan.. =D</p>

<p>Jadinya hari Rabu pkl 11.. dgn dosen penguji Pak Djoko (sama dgn seminar 1), dan Bu Hanni (dosen Aljabar)..</p>
<p>Sblm hari-H, sy udah siap2, udah menguasai semua teori dasar yg sy tulis di draft TA.. lalu,,</p>
<p>D: “Apakah graf GxH sama dengan HxG?”</p>
<p>D: “Apa itu isomorfis?”</p>
<p>Padahal ga nulis ttg itu di draft.. sy waktu itu tau jawabannya tp susah menguraikannya dgn kata2.. ok, sy menenangkan diri dl.. terus dgn bantuan ilustrasi dari dosen pembimbing, sy pun bs menjawabnya.. pertanyaannya memang bs kemana-mana (di luar draft),, beda ama seminar 1..</p>
<p>Akhirnya 1 jam berlalu..seminarpun selesai.. sy dan tmn2 (yg menonton seminar) keluar dl karena para dosen akan diskusi mengenai nilai yg akan diberikan..</p>
<p>Setelah beres2, dosen pembimbing ngasih tau nilai sy..</p>
<p>Alhamdulillah, dpt A.. dan target tercapai,, bs seminar sebelum Ramadhan.. =)</p>

<p>Voici quelques munitions pour vous aider…</p>

<h2>Un écran LCD est meilleur pour votre vue</h2>
<p>Un point sur un écran LCD, c’est un point.</p>
<p>Un point sur un écran CRT, c’est un gros pâté.</p>
<p>C’est la technologie qui veut ça.</p>
<p>Sur un écran à tube cathodique, le principe est d’envoyer un faisceau d’électrons s’écraser sur du phosphore (le phosphore ainsi excité génère de la lumière). Forcément, ça éclabousse.</p>
<p>Sur un écran LCD, le principe est d’allumer ou d’éteindre chaque point individuellement.</p>
<p>Vous vous fatiguerez donc moins la vue lorsque vous essaierez de lire les petits caractères.</p>
<p>Sans compter qu’avec l’âge, un écran à tube cathodique peut perdre certains réglages et devenir plus flou…</p>
<h2>Un écran LCD cause moins de migraines</h2>
<p>Sur un écran CRT, il n’y a qu’un seul faisceau et c’est lui qui doit se taper l’illumination de chaque point. Quand il a fini un écran, il doit remonter et recommencer car le phosphore ne reste pas allumé éternellement. Et c’est le problème !</p>
<p>Vous ne vous en apercevez pas, mais un écran à tube cathodique clignote sans arrêt. Il faudrait monter au-delà de 100 Hz (100 rafraîchissement par seconde) pour avoir un réel confort. Ce qui est très loin d’être la majorité des cas : les cartes vidéos et les écrans restent souvent sur leurs paramétrages par défaut.</p>
<p>Un écran LCD fonctionne différemment. Les points laissent passer ou pas la lumière (ce ne sont pas eux qui générent la lumière). Celle-ci est générée par des tubes fluorescent ou des DELs constamment allumés.</p>
<h2>Un écran LCD occupe moins de place sur le bureau</h2>
<p>Ça, je n’ai pas vraiment besoin de vous expliquer pourquoi <img src='http://s.wordpress.com/wp-includes/images/smilies/icon_wink.gif' alt=';-)' class='wp-smiley' /> </p>
<p>Et c’est également plus facile à déplacer quand on change de bureau.</p>
<h2>Un écran LCD consomme moins qu’un CRT</h2>
<p>Ça a été un grand débat. Pour couper court, je me base sur 2 sources :</p>
<ul>
<li>un <a title="Test comparatif du site Les Numériques" href="http://www.lesnumeriques.com/article-332.html">test comparatif du site Les Numériques</a> qui montre qu’effectivement les LCD consomment moins que les CRT,</li>
<li>la comparaison des chiffres constructeurs de 2 de mes moniteurs : Dell P1110 21” (CRT) donné pour 125 W, Iiyama ProLite E2607WS 26” (LCD) donné pour 52 W.</li>
</ul>
<p>Sachant qu’un écran d’ordinateur en milieu professionnel reste allumé 8 heures par jour, 5 jours sur 7.</p>
<p>Sachant que cette consommation doit être multipliée par le nombre d’ordinateurs, il s’agit d’une bonne piste pour les économies d’énergie.</p>
<p>Autre avantage de l’écran LCD : n’avez-vous jamais remarqué quand les lumières sont allumées et que vous allumez votre écran CRT que la lumière baisse d’intensité ? Pour pouvoir fonctionner, l’écran CRT utilise un THT, un Transformateur Haute Tension. Sa mise en route pompe une énorme quantité d’énergie. Après une panne de courant, la remise en route est toujours délicate avec ce type d’écran car si tout le monde rallume son écran, on repart facilement vers une coupure de courant. C’est également pour cette raison qu’il est déconseillé de brancher un moniteur CRT sur un onduleur personnel.</p>
<p>L’écran LCD n’a pas de THT.</p>
<h2>Conclusion</h2>
<p>Vous avez les principaux arguments en faveur du LCD.</p>
<p>Il ne reste plus qu’à convaincre votre supérieur. Il ne reste que l’argument des finances qui ne seraient pas au beau fixe ces jours-ci…</p>
