<p>Povos timbira do Maranhão e Tocantins, reunidos no Centro de Ensino e Pesquisa Timbira Pënxwyj                    Hëmpejxà em Carolina-MA, criaram o Território Etnoeducacional Timbira e já elegeram seus representantes que integrarão o Conselho do Território. Os povos envolvidos são os Krahô, Apinajé, Krikati,                    Pykobjê, Apãniekra, Ramkokamekra, Krepynkatejê e                    Krenjê, falantes da mesma língua e de costumes semelhantes.</p>
<p>Vários povos do Brasil estão tomando a mesma iniciativa na intenção de se adequar e poder pleitear recursos nos termos do recente Decreto nº 6.861/2009. A lei dispõe sobre a Educação Escolar Indígena e cria os Territórios Etnoeducacionais (TE), instância regional que deverá gerir a Educação Indígena com participação dos índios e flexibilidade de critérios.</p>
<p>No caso timbira, os trabalhos começarão com uma comissão de professores que realizará o diagnóstico da situação                      escolar das aldeias e elaborará propostas sobre os critérios                      da representação dos povos timbira no Conselho da TE.</p>

<p>Do lado de lá tá a família, os almoços dominicais, os amigos queridos e agora&#8230;meu pai na CTI de um hospital.</p>
<p>Devo deixar tudo e partir pro lado de lá, pra junto da mãe, pra perto dos irmãos.</p>
<p>É preciso fechar as janelas e travar as portas&#8230;correr pro aeroporto e pegar o primeiro vôo. Ouvir o barulho dos aparelhos e vê-lo de perto respirando e com vida.</p>
<p>Como é difícil lhe dar com a falta de saúde, com a fragilidade da vida&#8230;com perdas.</p>
<p>Tenho vivido anos de ganhos e perdas&#8230;.mas não estou preparada pra perdê-los&#8230;</p>
<p>Bateu um pânico, uma dor no estômago, um vazio profundo e dolorido&#8230;a solidão de anos de distância que não sentimos no dia a dia, no corre corre dessa vida que não para.</p>
<p>Temos fé, temos coragem, temos confiança de que tudo se acertará e, em breve, o teremos de volta a casa. E lá estará ele rondando, fazendo perguntas e reclamando da janela aberta, do ar condicionado ligado, do volume do som ou da demora do almoço&#8230;</p>

<description><![CDATA[Cuando el año pasado Santiago Almada me pidió una reseña sobre mí para publicar uno de mis poemas en]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p><img class="aligncenter" src="http://www.tribunalatina.com/argentina/img2/20070601_ARGENTINA_seleccion_futbol.jpg" alt="" width="400" height="328" />Cuando el año pasado Santiago Almada me pidió una reseña sobre mí para <a href="http://www.clavedigital.com/App_Pages/Ocio/Ocio.aspx?Id_Articulo=4102" target="_blank">publicar uno de mis poemas</a> en <a href="http://www.clavedigital.com" target="_blank">Clave Digital</a>, empecé con un detalle muy particular. &#8220;<em>Soy</em>, le dije, <em>fanático de dos cosas en este mundo: las <strong>Aguilas Cibaeñas </strong>y la gloriosa <strong>Albiceleste</strong></em>&#8220;. Estos cuatro años de Catarsis han sido testigos fieles de mis desvelos y desvaríos por la selección argentina de fútbol.</p>
<p>Desde el 1986 (bueno, realmente desde el 90, siendo sinceros), he germinado y dejado crecer esta pasión por el equipo de rayas blancas y azul celeste, con cada torneo en el que he tenido chance de seguirlos (y sí, me dí el gustazo de gritar el épico cántico de <em>&#8220;vamos, vamos, Argentina&#8230;&#8221;</em> en la final de los Panam 2003 en el Estadio Olímpico -que entonces no se llamaba &#8220;Félix Sánchez&#8221;). Han sido años de pequeños goces, de desiluciones malditas (como aquella descalificación temprana del mundial 2002), pero de mucha emoción.<!--more--></p>
<p>Ahora que el equipo ya está clasificado para Sudáfrica 2012, empiezo la espera. Después del &#8220;<em>bloffff</em>&#8221; de nuestro equipo de baseball en el WBC, he mirado hacia mi otra pasión del cono sur. Poco importa la mala fama que algunos porteños han querido dar hacia la humanidad, poco importa encontrarme solo en una isla poco futbolera que -además- se decanta por Brasil en estos días. Yo sigo aferrado hacia esa pasión futbolera argenta que supieron enseñarme apellidos como Maradona, Verón, Batistuta, Caniggia, Abbondanzieri, Messi&#8230; y brincar junto con las barras como un aficionado más que siente la camiseta como suya.</p>
<p>En este viernes quiero compartir con ustedes una serie de anuncios televisivos que han sabido interpretar ese vibrar de un modo muy suyo. Se los dedico a mi hermana Romina Bayo, con quien me siento orgulloso de conocer y compartir argentinidades. Disfrútenlos! Y, con todo y Maradona de DT, nos vemos en Sudáfrica en el 2010!</p>

<title><![CDATA[You Should See Your Face!]]></title>

<p>A large part of coaching is reading the emotional field. When I sense a shift in the energy of a call, I will make note of it and ask, &#8220;What just happened?&#8221; Those moments are magical because they&#8217;re the ones that so easily get stepped over in regular life. It&#8217;s in those in-between spaces that the truth is held.</p>
<p>While most of my coaching is done one-to-one over the phone, in-person sessions offer a different advantage&#8211;visually seeing a change of expression or body movement. I told a participant in yesterday&#8217;s Mastermind Group that I wished I&#8217;d had a camera to record her facial expressions. As much as I could describe what I saw to her, there&#8217;s nothing like seeing it yourself to realize the impact.</p>
<p>During one of my Leadership retreats in California&#8211;one I was participating in, not leading&#8211;an assistant was constantly recording our activities with a video camera. When the discussion came around to a leader&#8217;s impact&#8211;intended or unintended&#8211;we were shown digital footage of ourselves when we weren&#8217;t aware of the camera.</p>
<p>It turned out that one of the biggest take-aways for me throughout the year long program was seeing the recording of myself and my default expression. Ugh! I looked angry, skeptical and confused. <a href="http://www.thecoaches.com/leaders/program-leaders/" target="_blank">Henry Kimsey-House</a>, one of the founders of the <a href="http://www.thecoaches.com/" target="_blank">Coaches Training Institute</a>, was a co-leader of this program. He said that he knows what his facial expression looks like when he&#8217;s checking out at the grocery store and when he&#8217;s arguing with his wife. He has made a conscious decision to take full responsibility for his impact on the world at all times starting with the awareness of his own facial expression.</p>
<p>Since that experience, I take stock on a regular basis of my expression wherever I am. It&#8217;s become part of my daily awareness, and I consciously note to myself, &#8220;Change your expression, Jane. Smile, relax, let go.&#8221;</p>

<title><![CDATA[The Right of Resale]]></title>

<p class="MsoNormal" style="margin:0;"><span style="font-family:Arial;color:#000080;font-size:small;">Imagine you bought a second hand car and, upon registering its purchase, you were notified by the manufacturer that the original buyer hadn’t actually bought the software in its fuel injection system but had only bought a right to use the software it and that that right to use was not transferrable. You just might be tempted to respond rude words – I know I would.</span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Arial;color:#000080;font-size:small;"> </span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Arial;color:#000080;font-size:small;">Then consider this real world example. Several years ago, one client of mine was using Zeacom’s CTI software at one site and, as they were consolidating to a new site using a PABX with which this software couldn’t work, it was to become surplus. At the same time, another client was planning to consolidate its call centres to one that had an NEC PABX for which Zeacom’s software was designed. How fortuitous, or so I thought, client one could sell this software to client two. However, there was a catch. When I raised the matter with Zeacom, they advised me that to be transferred, the software would have to be relicensed. And what would be the relicensing cost? The same as buying the software anew! Needless to say, the sale did not proceed.</span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Arial;color:#000080;font-size:small;"> </span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Arial;color:#000080;font-size:small;">Not long thereafter, another client had bought an Ericsson PABX for its call centre under the mistaken belief that it could better integrate with some sort of radio system they had also bought from Ericsson. When it became clear that call centres weren’t Ericsson’s forte, that client sought to resell the two systems, neither of which had been installed. Guess what? Any buyer would have had to relicense the software.</span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Arial;color:#000080;font-size:small;"> </span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Arial;color:#000080;font-size:small;">Every year, a significant percentage of the billions and billions of dollars worth of purchased software &#8220;out there&#8221;, both embedded and non-embedded, becomes surplus to needs. In many cases, the software’s functionality will be out of date and of little use to anyone else. However, there is also a lot of software that has a significant value on the second hand market. And some of this is embedded software in such systems as PABXs without which they would be unable to function.</span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Arial;color:#000080;font-size:small;"> </span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Arial;color:#000080;font-size:small;">Not long after becoming aware of the issue of software relicensing, I surveyed a number of developers and distributors of contact centre products. With the obvious proviso that the sale would be a complete sale with no copies being retained, some companies imposed no restrictions on resale, some required only a nominal relicensing fee be paid to cover the cost of updating their records. However, others were adamant that resale would not be permitted although none could give a good reason why not. One made the interesting observation that resale could be restricted only if this was specified in the terms of the original sale.</span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Arial;color:#000080;font-size:small;"> </span></p>

<p>Symposium  on Coral Reef Management of Coral Reef Traingle (CRMCRT) minggu ini terasa sangat special bagi saya. Bahkan saya merasa ada getaran masa depan yang lebih baik dari pengalaman simposium tersebut. Mimpi saya untuk menjadi peneliti yang memiliki kontribusi pada dunia terumbu karang internasional terasa semakin terjangkau, bukan sekedar mission impossible yang dikejar seorang petualang bonek. Semoga semua ini akan menjadi ibadah saya dan keluarga saya untuk melakukan syiar Islam di dunia internasional terumbu karang.<br />

Keikutsertaan saya di simposium CRMCRT agak terpaksa. Sudah lama saya mengetahui adanya simposium tersebut lewat milis COREMAP (Coral Reef Rehabilitation and Management Program) maupun INCRES (Indonesian Coral Reef Society). Tetapi karena saya sudah menjadwalkan pergi ke Florida paling lambat tanggal 10 Oktober, maka keikutsertaan saya di simposium menjadi tidak memungkinkan. Saya secara pribadi sudah minta maaf atas ketidakhadiran saya di simposium kepada Eva yang menjadi panitia.<br />
Tetapi Allah menghendaki yang lain. Ia Maha mengetahui apa yang terbaik untuk saya dan memberikan apa yang saya butuhkan. Pengurusan paspor saya tertunda-tunda secara menjengkelkan karena saya tidak mau menyuap petugas BKLN. Paspor yang ditanda-tangani tanggal 30 September baru dapat saya terima tanggal 7 Oktober 2009 pukul 16:00. Ketika paspor dinas yang menjadi persyaratan pengurusan Via J-1 di University of Florida (USF) tersebut saya scan dan dikirimkan pada malam itu juga ternyata ada keteledoran, paspor tersebut belum saya tanda-tangani. Profesor Pamella hillock-Muller (PHM) yang akan membimbing saya di USF minta dikirim ulang. Besoknya saya scan lagi paspor yang sudah ditandatangani dan dikirimkan lagi ke USF. Lagi-lagi ada masalah muncul. PMH bilang bahwa formulir permohonan visa J-1 yang sudah lama dikirimkan kepada saya berubah. Padahal saya sudah menandatangani dan mengirim formulir tersebut pada bulan Ramadhan dari Sragen ketika menjemput Naila di Gontor. Mama mia …. Formulir barupun dikirim dari USF, saya isi dan tandatangani, kemudian saya kirim kembali ke PHM di USF. Lagi-lagi saya teledor dengan mengirimkan lampiran dua halaman yang sama (halaman 4), sehingga halaman yang ditandatangani (hal 3) tidak ikut terkirim. PHM merespon keteledoran saya dengan komentar singkat: “It is really an adventure”. Untungnya saya mengirimkan dokumen tersebut dua kali dengan dua alamat email yang berbeda. Nah, kiriman yang lewat telkomnet berisi lampiran yang lengkap (halaman 3 dan 4), sehingga masalah yang muncul tidak menunda proses yang akan dilakukan oleh PHM. Singkat cerita proses keberangkatan saya ke USF tertunda-tunda. Hingga tanggal 10 Oktober 2009, saya belum dapat memastikan kapan mau berangkat.<br />
Pada hari itu, tanggal 7 Oktober 2009, Ibu Yosephine Tuti yang biasa saya panggil Mbak Yos, seorang peneliti di P2O LIPI menelpon saya. “Mam bisa nggak minta tolong untuk membantu teman-teman di DKP dalam simposium CRMCRT. Mereka sedang kesulitan makalah untuk simposium dan mereka juga kesulitan mencari moderator karena simposium tersebut akan menggunakan bahasa Ingggris.” Dalam keadaan masih jengkel dengan ketidakpastian visa J-1, saya menyanggupi permintaan Mbak Yos tersebut. Perkiraan saya berangkat ke Florida paling cepat tanggal 15 Oktober. Akhirnya saya mengirimkan dua makalah untuk simposium tersebut agar kehadiran saya tidak hanya sebagai moderator. Kedua abstrak tersebut saya buat pada malam yang sama.<br />
Hari simposium akhirnya tiba, tanggal 12 Oktober 2009. Saya berangkat pukul 06:20 dari Cibanteng dan mendapatkan kereta Pakuan Express yang berangkat pukul 06:24. Saya turun di stasiun Manggarai kemudian kembali kea rah Bogor dengan kerata ekonomi untuk turun di stasiun Cawang. Dengan menggunakan ojek saya sampai di Hotel Bumi Karsa di kompleks Bidakara Tower.<br />
Pada hari itu saya baru mengetahui bahwa saya akan mendapat tugas menjadi moderator pada tiga sesi dan sebagai presenter satu makalah. Sebenarnya agenda tersebut sudah dikirim lewat email tiga kali, tetapi saya masih sibuk dengan urusan visa sehingga tidak banyak menarik perhatian saya. Sebuah makalah sudah saya cabut karena ternyata ada banyak makalah yang masuk ke panitia pada hari-hari terakhir. Dengan tugas seperti itu, nama saya paling banyak muncul pada jadwal simposium sehingga banyak teman yang memperhatikan ini, walaupun saya sekedar membantu teman-teman DKP saja.<br />
 Pada hari pertama simposium saya melihat Thomas Goerou, seorang peneliti dari USA, duduk sendirian di kursi depan. Saya agak kurang percaya karena dua hari sebelumnya Delphine Robb, instruktur selam di Gili Trawangan, mengatakan kepada saya bahwa Tom tidak bisa berangkat ke Indonesia karena tidak punya tiket. Dia gembira sekali ketika saya menyapanya. Kami memang sudah lama kenal di Lombok dan dia juga pernah membantu saya membelikan titanium mesh untuk proyek biorock Dinas Perikanan NTB. Kamipun mengobrol sebenar sebelum acara pembukaan dimulai.<br />
Suatu saat saya sedang berbincang dengan Pak Suharsono, Ketua P2O LIPI yang juga menjadi pembimbing saya, Terry Done dari Australia ikut bergabung. Terry Done adalah peneliti senior di AIMS dan pernah menjadi presiden ISRS, sebuah organisasi internasional peneliti terumbu karang. Saya menjadi anggota ISRS sejak tahun 1995 sampai sekarang. Terry menyatakan minatnya terhadap presentasi saya tetapi sayangnya ia sudah diminta Leonas untuk menghadiri presentasinya. Kebetulan jadwal presentasi Leonas dan saya besok sama persis jadwalnya.<br />
Simposium hari pertama, saya menjadi moderator pada sesi pertama dan ketiga. Pada sesi pertama saya bertugas di ruang Topik Pertama. Saya pimpin simposium sebagaimana simposium internasional yang mempunyai waktu sangat ketat. Jika setiap peserta diberi waktu 10 menit, mereka hanya berhak 10 menit berbicara. Ketika sudah berbicara 9 menit, maka saya pukul gelas minum dengan pensil sebagai tanda peringatan. Dari lima penyaji makalah ada dua yang harus saya berhentikan karena sudah melewati waktu yang menjadi hak mereka. “I am sorry I have to stop your presentation. I know that you may have travelled more than three hours to come here but you only have right for 10 minutes presentation.” Begitulah cara saya menghentikan presentasi. Alhamdulillah tugas pertama dapat berlangsung dengan baik. Ternyata ada kejutan yang menyenangkan, ada honor bagi moderator. Alhamdulillah.<br />
Ketika saya akan menjadi moderator pada sesi ketiga di ruang Topik Ketiga, saya melihat jalan simposium yang berbeda. Jadwal sesi ketiga ternyata baru diisi dengan presentasi peserta sesi kedua. Hal ini terjadi karena moderatornya tidak seketat saya dalam mempimpin diskusi. Karena kacaunya jadwal simposium pada Topik ketiga saya akhirnya batal menjadi moderator.<br />
Pada saat makan malam saya mencari Tom, karena kami sudah berjanji mau mendiskusikan terumbu karang di Gili Trawangan. Saya ajak Tom yang berdiri di belakang ke meja saya dan kami berdiskusi di sana. Tom juga saya perkenalkan kepada Pak Fedi, Bu Nurul, Bu Prity, Pak Makruf, dan Pak Kun, yang semeja dengan kami. Pak Kun sangat kaget bahwa orang yang bersama saya adalah Thomas Goerou yang terkenal dengan biorock-nya.<br />
Saya jadi teringat pertanyaan anak saya: mengapa negara Amerika Serikat disebut juga sebagai Negeri Paman Sam. “Tom, could you tell me why the united states is also called as the “Uncle Sam Country”. To agak kaget dengan pertanyaan saya tersebut. “My daughter asked me that question and I did not have the answer” , kataku mencoba membuat ia lebih relaks. “Well, I don’t really know exactly. Just like you. But I think it just a myth”. Jawaban itu saya klarifikasi lebih jauh untuk memastikan bahwa mitos tersebut tidak ada hubungannya dengan isu politis atau nama seorang pahlawan.<br />
Hari kedua simposium, saya mendapat jadwal presentasi pada sesi pertama. Moderatornya Pak Fedi Sondita, dosen perikanan IPB yang telah menjadi teman akrab sejak di JCU (James Cook University) Townsville. Presentasi saya tersebut dilihat langsung oleh pak Terry Done. Ini sebuah kehormatan dan kesempatan yang besar bagi saya. Saya ingin mendengar komentar dan saran beliau. Ketika pak Fedi mempersilahkan peserta untuk bertanya Pak Terry khusus hanya bertanya atas presentasi saya. Beliau juga menjanjikan diskusi yang lebih banyak di luar jadwal simposium. Presentasi saya juga disaksikan oleh teman-teman mahasiswa dari SPL IPB. Pada sesi pertama tersebut, saya dipersandingkan dengan empat pemakalah dari luar negeri, termasuk Pak Tom Goerou. Pemakalah yang lainnya adalah dua gadis Jerman dan seorang peneliti dari Jepang.  Alhamdulillah.<br />
Setelah presentasi, masih di ruang yang sama, saya mendapat tugas menjadi moderator. Saya memimpin jalannya simposium dengan cara persis seperti kemarin. Peserta hanya diberi waktu 10 menit karena hak mereka memang selama itu. Dengan teknik peringatanmemukulkan pensil ke gelas sehingga terdengar bunyi ‘ting’ yang nyaring, saya dapat membatasi presntasi yang akan berkepanjangan. Pak Fedi yang tadinya menjadi moderator pada sesi pertama, sekarang menjadi pemakalah pada sesi kedua. Pak Mulia Purba, dosen senior ITK IPB, yang sudah mepersiapkan banyak slide terpaksa harus mempersingkat presentasinya hingga 40% dari slide yang disiapkannya. Alhamdulillah, saya tidak sampai menghentikan presentasi para peserta pada hari ini. Begitu mendengar bunyi gelas dipukul pensil peserta angsung segera menghentikan presentasinya dengan menyajikan kesimpulan. Bu Mujizat Kawaroe, dosen ITK IPB, yang meminta waktu presentasi dua makalah juga hanya saya berikan waktu 10 menit.<br />
 	Malam harinya adalah acara penutupan simposium dan makan malam perpisahan. Saya makan malam bersama dengan Pak Terry Done dan mendiskusikan tentang rencana penelitian saya. Sebelumnya saya agak khawatir dia kecewa dengan presentasi saya karena saya tidak memasukkan variable rekruitmen karang. Alhamdulillah, ternyata dia suka dengan rencana penelitian saya dan bersedia membantu saya jika membutuhkannya. Ketika kami mulai menikmati desert, Bu Anabel Cababan dari Filipina, ikut bergabung. “Imam, I know that I met you before but I don’t remember where and when”. Tampaknya ia juga menyaksikan presentasi saya tadi pagi. Kami memang sudah pernah bertemu dua kali, sekali di Bangkok dan sekali di Hanoi. Bu Anabel adalah seorang wanita yang produktif mempublikaikan terumbu karang di Malaysia dan Filippina. Kami bertiga mengobrol agak lama hingga petugas hotel mulai merobohkan meja untuk membersihkan ruang ball-room. Pak Terry dan Bu Anabel melanjutkan ngobrol dan minum bir di kafe, sedangkan saya pamitan dengan pak Jamal Jompa dan Pak Yaya Mulyana yang masih diskusi ringan di pojok depan.<br />
Hari ini sudah tidak ada simposium. Saya turun dari kamar di lantai tujuh untuk sarapan di Restoran Kenanga pukul 06:15. Di dalam lift bertemu dengan Pak Sudarma, staff di Bapedalreg Bali.  Seorang teman bapedalreg yang lain, Pak Sakdullah juga ada di sana.<br />
Di dalam Restoran Kenanga tampak Pak Terry yang sedang sarapan sendirian. Setelah saya mengambil nasi goring sayapun ajak Pak .. bergabung dengan Pak Terry. Inilah kesempatan terbesar saya dalam simposium ini, sarapan berdua dengan Pak terry. Bagi saya sarapan ini merupakan sesuatu yang sangat istimewa karena saya dapat konsultasi tentang penelitian saya selama satu setengah jam bersama mantan presiden ISRS. Disamping itu, saya juga jadi mendengar kabar teman-teman lama yang tinggal di Townsville, misalnya keluarga Eric dan Ross Gill, keluarga John dan Gilianne Brodie, keluarga Erick dan Bette Willis. Sayangnya banyak kabar yang tidak baik, karena kesehatan teman-teman lama tersebut sudah banyak menurun akibat penuaan. Ada yang harus cuci darah setiap hari, ada yang tidak mampu berjalan lagi. Walaupun demikian, sarapan kali ini merupakan pencerahan terhadap sejumlah hal yang selama ini masih remang-remang dalam penelitian saya.</p>

<p>Similarly to <a href="http://music-selections.com/2008/10/14/a-smooth-mix-to-celebrate-2-years-of-mj/" target="_blank">my previous mix</a>, I tried to put together a sequence of smooth tunes that sound good together (at least to me), and tried to create an atmosphere out of it. The Lowest Common Denominator is having a warm and deep bassline, somehow Lowend-Theory-sounding, you know what i mean, we all love that sound.</p>

<p>You got some Fusion Jazz originals represented by virtuosos like Stanley Clarke (who provides a really cool intro if you ask me), Miroslav Vitous and german band Passport, some 90&#8217;s Hip Hop classic instrumentals, a <a href="http://music-selections.com/2009/08/26/ultimate-ultimate-ultimate/" target="_blank">classic UBB</a> tune by Bo Diddley (really nasty drums), an underrated track from Funkadalic followed by a great sampling of the same by none other than the 45 King.</p>

<p>Then you got some Barry White, a couple of crazy jazzy beats from the Wild Style soundtrack, a Tribe Called Quest break I took from a bootleg vinyl I bought in Paris many years ago (that&#8217;s when I discovered breaks albums&#8230;crazy), and the solemn <a href="http://music-selections.com/2006/11/30/a-gift-for-all-you-36-chambers-fanatics/" target="_blank">El Michaels Affair banger</a> &#8220;Glaciers Of Ice&#8221; to close the mix. SYDNEY (Reuters)  &#8212; An Australian court has ruled that <a href="http://cfd.net.au/home/topic/local-governments">local governments</a> can pursue financial claims against collapsed U.S. <a href="http://cfd.net.au/home/topic/investment-bank">investment bank</a> Lehman Brothers in Australia and elsewhere, a firm that is funding the litigation said on Monday.<br />
</P></p>
<p>
<a href="http://cfd.net.au/home/topic/imf">IMF</a> (Australia) Ltd. said the Federal Court ruled on Friday in favor of <a href="http://cfd.net.au/home/topic/town-councils">town councils</a> and others which had lost money in <a href="http://cfd.net.au/home/topic/collateralized-debt-obligations">collateralized debt obligations</a> marketed and issued by Lehman, opening the door to legal claims to recover their losses.<br />
</P></p>
<p>
However, the judgment does not set a precedent for the many other Lehman investors and <a href="http://cfd.net.au/home/topic/creditors">creditors</a> worldwide who are seeking hundreds of millions of dollars from the bankrupt bank&#8217;s estate, said Susanna Khouri, <a href="http://cfd.net.au/home/topic/investment-manager">investment manager</a> at <a href="http://cfd.net.au/home/topic/imf">IMF</a>.<br />
</P></p>
<p>
&#8220;This does not have implications beyond Australian law. It is not going to be a precedent for <a href="http://cfd.net.au/home/topic/creditors">creditors</a> to other Lehman entities around the world,&#8221; Khouri told Reuters.<br />
</P></p>
<p>
The firm said in a short statement to the <a href="http://cfd.net.au/home/topic/stock-exchange">stock exchange</a> that the court had found against the validity of a Deed of Company Arrangement which had prevented the councils and others from pursuing claims against Lehman entities and from pursuing payment under various <a href="http://cfd.net.au/home/topic/insurance-policies">insurance policies</a>.<br />

&#8220;IMF will now fund those councils and other parties in litigation to recover <a href="http://cfd.net.au/home/topic/monies">monies</a> lost when they invested in <a href="http://cfd.net.au/home/topic/collateralized-debt-obligations">collateralized debt obligations</a> arranged, issued and promoted by those Lehman entities,&#8221; the statement said.<br />

Lehman&#8217;s estate is facing a <a href="http://cfd.net.au/home/topic/slew">slew</a> of claims from <a href="http://cfd.net.au/home/topic/creditors">creditors</a> worldwide, including <a href="http://cfd.net.au/home/topic/bondholders">bondholders</a>, <a href="http://cfd.net.au/home/topic/derivatives">derivatives</a> counterparties, states, towns and individuals.<br />

Administrators of the London arm of Lehman Brothers said last month the claims it is handling against the collapsed <a href="http://cfd.net.au/home/topic/wall-street">Wall Street</a> bank could total as much as $100 billion.<br />
</P></p>
<p>
Lehman&#8217;s demise a year ago brought the global financial system to the brink of collapse, and accountants and lawyers expect to have to work for years to sort out billions of dollars worth of assets left locked in its accounts.<br />
</P></p>
<p>
About 35 councils in Australia invested $22 million in Federation <a href="http://cfd.net.au/home/topic/cdo">CDO</a>, a long-term, synthetic instrument based on a list of 40 residential mortgage-backed securities linked to the U.S. subprime market, financial magazine the Government News said in a report in April.</p>

NEW YORK (Reuters)  &#8212; CIT Group Inc. is negotiating a new credit facility that could total $10 billion, which could help the <a href="http://cfd.net.au/home/topic/finance-company">finance company</a> pay off maturing debt and stave off bankruptcy, people familiar with the situation said.<br />
</P></p>

The details of the facility are still being negotiated, and its size might be substantially smaller than $10 billion, two people familiar with the matter said. The company may forgo the loan if it successfully renegotiates the terms of some of its existing credit lines, the sources said.<br />

The existing credit lines include a $3 billion loan that CIT clinched from <a href="http://cfd.net.au/home/topic/bondholders">bondholders</a> in July and a financing facility from Goldman Sachs. (<br />

Earlier, the shares rose about 11% after a <a href="http://cfd.net.au/home/topic/newspaper-report">newspaper report</a> that <a href="http://cfd.net.au/home/topic/hedge-fund">hedge fund</a> Paulson &#38; Co. was looking at combining CIT with a Paulson-affiliated bank once known as IndyMac. A person familiar with the matter told Reuters the report was wrong.<br />

CIT is struggling to fund itself after losing access to the unsecured <a href="http://cfd.net.au/home/topic/corporate-bond-market">corporate bond market</a>. The company has $3 billion of debt maturing in the <a href="http://cfd.net.au/home/topic/fourth-quarter">fourth quarter</a>, according to a quarterly filing in August. About half of that maturing debt is unsecured and must be refinanced or repaid from the company&#8217;s dwindling cash holdings.<br />
</P></p>
<p>
Regulators have put CIT Bank under a cease-and-desist order, preventing the unit from accepting new deposits. That bank was supposed to be a key source of funding for the company in the future.</p>

NEW YORK (Reuters) &#8212; <a href="http://cfd.net.au/home/topic/play">Play</a>boy Enterprises Inc. Tuesday named an 11-year veteran of the <a href="http://cfd.net.au/home/topic/adult-entertainment-company">adult entertainment company</a> as president, while its chief executive vowed to keep printing its namesake magazine.<br />

Alex Vaickus will serve as the company&#8217;s president, a new position, and will oversee all of its businesses including print, television and digital media, <a href="http://cfd.net.au/home/topic/play">Play</a>boy said in a statement.<br />

Recent comments from the Fed suggest that they intend to keep Quantitative Easing in place for as long as they can.  Over the past few <a href="http://cfd.net.au/home/topic/decade">decade</a>s, the Fed has never raise interest rates before the <a href="http://cfd.net.au/home/topic/unemployment-rate">unemployment rate</a> has peaked. Toyota warned that for each one yen appreciation against the dollar, operating profit is cut by 35 billion yen or $390 million.  For Canon, each one yen appreciation hurts their bottom-line by more than 4 billion yen or $45 million.  No U.S. corporation will be that specific, but from these statistics, we can gage the positive impact that a <a href="http://cfd.net.au/home/topic/weak-dollar">Weak Dollar</a> may have for U.S. exporters. For the third trading day in a row, the <a href="http://cfd.net.au/home/topic/euro">Euro</a> appreciated against the U.S. dollar.  There was no economic data from the <a href="http://cfd.net.au/home/topic/eurozone">Eurozone</a> which means that the strength of the currency stemmed entirely from dollar weakness.  As the greenback continues to lose value, <a href="http://cfd.net.au/home/topic/trader">Trader</a>s will start to wonder about what could turn the dollar around.  Last week, the dollar appreciated significantly on the heels of currency related comments from <a href="http://cfd.net.au/home/topic/europe">Europe</a>an officials.  This is why the <a href="http://cfd.net.au/home/topic/european-central-bank">European Central Bank</a> meeting on Thursday is such a major event risk.  <a href="http://cfd.net.au/home/topic/ecb">ECB</a> President Trichet will undoubtedly be asked about his take on the dollar or euro.  If he simply reiterates his previous support for a strong dollar or expresses concern about excess volatility in foreign exchange it may be enough to turn the<br />

Meanwhile the Swiss Franc traded higher against the euro and U.S. dollar despite news that prices declined for the seventh month in a row.  Labor market numbers are due for release tomorrow and like the rest of the world, unemployment is expected to grow in Switzerland.<br />

HIT BY SHARP DECLINE IN INDUSTRIAL PRODUCTION<br />

Of all the major currencies, the British pound was the only one that failed to benefit from dollar weakness.  Reason being that U.K. economic data has disappointed once again.  On Monday, the market was elated by the improvement in service sector activity, but the manufacturing sector continues to suffer. Industrial production dropped 2.5 percent in August, driving annualized IP down 11.2 percent.  Manufacturing production also fell 1.9 percent, to the lowest level in nearly 17 years.  Although the sharp contraction in activity is partially due to the expiration of the car scrappage program, the report was still very bad.  Numbers such as these validate the dovishness of the <a href="http://cfd.net.au/home/topic/bank-of-england">Bank of England</a> and explain the currency’s underperformance.  However there are pockets of strength, most notably in the housing market as price growth doubles in the month of September.  Unfortunately this will not prevent the U.K. economy from standing still according to the National Institute of Economic and Social research who calculated that <a href="http://cfd.net.au/home/topic/gdp">GDP</a> remained unchanged from July to September.  Consumer confidence is due for release this evening along with shop prices.<br />

The commodity currencies stole the limelight today with the Canadian, Australian and New Zealand dollars all hitting 12 month highs.  The loonie benefited from solid economic data while the <a href="http://cfd.net.au/home/topic/aussie">Aussie</a> and <a href="http://cfd.net.au/home/topic/kiwi">Kiwi</a> propelled higher following the Reserve Bank of Australia’s shocking decision to raise interest rates by 25bp.  The RBA has set the bar and it is now up to other central banks to follow.  According to the statement, this will not be a one off hike.  Instead, the central bank intends to gradually lift interest rates from emergency levels. Their decision to raise rates now rather than later may be a bit strategic since they could have a tough time justifying a rate hike after the third quarter consumer price report.  Australia’s decision is also a vote of confidence for the global recovery.  The RBA’s decision could help lift the <a href="http://cfd.net.au/home/topic/aussie">Aussie</a> to 90 cents and higher.  Meanwhile the Canadian dollar rose to a 1 year high following strong economic reports.  Building permits rose by 7.2 percent in August while manufacturing conditions accelerated by the strongest level since July 2008. The IVEY <a href="http://cfd.net.au/home/topic/pmi">PMI</a> index which measures activity in the manufacturing sector rose from 55.7 to 61.7 in September, reducing some of the Bank of Canada’s fear that the strength of the Canadian dollar is crimping the country’s recovery. Every single one of the subcomponents of the IVEY <a href="http://cfd.net.au/home/topic/pmi">PMI</a> report exhibited strength with employment expanding for the first time since August 2008. This suggests that job growth continued in the month of September which will be important ahead of Friday’s Canadian employment report. The next level of support in the<br />

The only piece of economic data released from Japan last night was loans and discounts which increased by 1.8 percent in August, compared to 2.4 percent the previous month.  The market continues to shrug off comments from Finance Minister Fujii who warned that the Japanese government will take action if the movements in the yen become extremely abnormal.  With the Yen strengthening and Japanese corporations screaming, government officials said it is too early for the central bank to withdraw stimulus.  Deputy Prime Minister Naoto Kan even went so far as to suggest that the government may need to compile an additional program to support the labor market.<br />

A break of today’s high of 1.4762 would open the door for a move towards the 1 year high of 1.4845.  However if the currency pair fails to enter the <a href="http://cfd.net.au/home/topic/buy">Buy</a> Zone, it could retest support at 1.4580, which is the first standard deviation <a href="http://cfd.net.au/home/topic/bollinger-band">Bollinger Band</a>.<br />

Hi Kathy, Well put and may I add that by the end of this year 300 million Americans will come into <a href="http://cfd.net.au/home/topic/play">Play</a> concerning the value of the Dollar. The Fed as we know it will be out and I mean literally out, without a job. Mid <a href="http://cfd.net.au/home/topic/ter">TER</a>m elections will also wake up <a href="http://cfd.net.au/home/topic/wash">Wash</a>ington a little more. For the first time in many many years the average American is talking about the colapse  of their currency. This is huge because millions of Americans that have any money left will move it to gold and foreign currencies. Already some US senators are trying to pass a law to prohibit ownership of foreign currencies. I believe the Dollar is in bigger trouble than most people know. Time will tell but the US debt in my opinion is way beyond repair.Sorry for too much babbling. Maybe its time for the AMERO. Bye for now and good luck trading Darrell<br />

Excellent Kathy. Considering that the national U.S debt is $12T, the unfunded liabilites (pensions et al) are $104T, and current projected deficits are $9T in the next few years, a <a href="http://cfd.net.au/home/topic/weak-dollar">weak dollar</a> will do wonders for the U.S. as they will pay those debts with wooden nickels. <a href="http://cfd.net.au/home/topic/pit">Pit</a>y those on fixed incomes.</p>
<p>I&#8217;d like to point out that gold has risen in <a href="http://cfd.net.au/home/topic/usd">USD</a> and Euros, but has gone down this year in many other currencies, please see live chart at http://nexalogic.com/gold.html. Gold has gone up +18% in USD, but has gone down 17% vs Real (<a href="http://cfd.net.au/home/topic/ytd">YTD</a>). Gold going up is all relative. It is the same thing with the &#8220;markets going up&#8221;.<br />

It is not surprising to see the <a href="http://cfd.net.au/home/topic/dol">DOL</a>lar recover after selling off significantly in the beginning of the week.  In every downtrend there will be relief rallies which is what we have witnessed today.  The <a href="http://cfd.net.au/home/topic/dol">DOL</a>lar traded higher against the <a href="http://cfd.net.au/home/topic/euro">Euro</a>, Australian, New Zealand and Canadian dollars, but not before each of the 3 commodity producing currencies hit fresh year to <a href="http://cfd.net.au/home/topic/dat">DAT</a>e highs.  The U.S. <a href="http://cfd.net.au/home/topic/economic-calendar">economic calendar</a> was once again devoid of any major <a href="http://cfd.net.au/home/topic/economic-releases">economic releases</a>, giving investors the opportunity to let their <a href="http://cfd.net.au/home/topic/imaginations">imaginations</a> run wild.  Although there are many reasons why the dollar should continue to weaken, the primary reason is the improvement in <a href="http://cfd.net.au/home/topic/risk-appetite">risk appetite</a>.  So if <a href="http://cfd.net.au/home/topic/risk-aversion">risk aversion</a> returns and equities give back their recent gains, the relief rally in the dollar could become a full blown turn.  Concerns about losses in the commercial <a href="http://cfd.net.au/home/topic/real-estate-sector">real estate sector</a> and the <a href="http://cfd.net.au/home/topic/unrealistic-expectations">unrealistic expectations</a> of a V shaped recovery have made investors a bit nervous.  However with no major U.S. <a href="http://cfd.net.au/home/topic/economic-reports">economic reports</a> due for release this week and 2 <a href="http://cfd.net.au/home/topic/central-banks">central banks</a> making monetary <a href="http://cfd.net.au/home/topic/policy-announcements">policy announcements</a> tomorrow, we still believe that <a href="http://cfd.net.au/home/topic/interest-rate-differentials">interest rate differentials</a> will drive the <a href="http://cfd.net.au/home/topic/currency">Currency</a> market.<br />

Although there are no major U.S. <a href="http://cfd.net.au/home/topic/economic-releases">economic releases</a> on the calendar tomorrow, there are 2 U.S reports worth watching – <a href="http://cfd.net.au/home/topic/jobless-claims">jobless claims</a> and ICSC Chain Store Sales.  After the acceleration of job losses reported last week, <a href="http://cfd.net.au/home/topic/trader">Trader</a>s will be looking for clues to whether the trend of improvement in the labor market has ended.  If <a href="http://cfd.net.au/home/topic/jobless-claims">jobless claims</a> increase more than the previous week, investors could grow concerned about another month of massive job losses.  In addition, there  have been a lot of reports that spending this holiday season will be weak and because of that, retailers are just looking to breakeven.  However, based upon the SpendingPulse <a href="http://cfd.net.au/home/topic/index">Index</a>, a service by MasterCard <a href="http://cfd.net.au/home/topic/advisor">Advisor</a>s, retail sales rebounded in September.  <a href="http://cfd.net.au/home/topic/cost">Cost</a>co and Family Dollar Stores also posted better than expected quarterly results which give hope to Thursday’s report which will include back to school spending.  Meanwhile consumer credit fell for the seventh month in a row due to mounting job losses and tight credit.  If not for the cash for clunkers program, the <a href="http://cfd.net.au/home/topic/dat">DAT</a>a would have been even weaker.<br />

The <a href="http://cfd.net.au/home/topic/euro">Euro</a> traded lower against the U.S. dollar on the fear that <a href="http://cfd.net.au/home/topic/european-central-bank">European Central Bank</a> President Trichet could reiterate his support for the U.S. dollar.  There is no question that reporters will jump at the opportunity to ask Trichet about his take on the recent weakness of the dollar and there is no reason why he would change his stance. Based upon recent <a href="http://cfd.net.au/home/topic/economic-reports">economic reports</a> from the <a href="http://cfd.net.au/home/topic/eurozone">Eurozone</a>, the recovery remains &#8220;bumpy.&#8221; The expiration of the car scrapping program in Germany has driven retail sales sharply lower while his morning&#8217;s <a href="http://cfd.net.au/home/topic/eurozone">Eurozone</a> <a href="http://cfd.net.au/home/topic/gdp">GDP</a> report revealed that growth in the second quarter fell more than initially anticipated. Weakness in other parts of the region has offset growth in Germany and France, triggering a 0.2 percent drop in <a href="http://cfd.net.au/home/topic/gdp">GDP</a>. Aside from comments on the <a href="http://cfd.net.au/home/topic/currency">Currency</a>, the market will also be looking at what Trichet says about the economy and the results of their second one year refinancing operation which was met with lackluster demand. The question of adding a spread to the one year tender is once again an issue. If the <a href="http://cfd.net.au/home/topic/ecb">ECB</a> adds a spread to the December operation, it would be perceived as a hawkish move. Aside from the <a href="http://cfd.net.au/home/topic/monetary-policy">monetary policy</a> announcement, German industrial production is also due for release.  The increase in factory orders suggests that there is a good chance that production rose as well.<br />

reversed much of yesterday’s strong rally. The pair will be of particular importance ahead of the BoE and <a href="http://cfd.net.au/home/topic/ecb">ECB</a> rate decisions. The only economic indicator reported today from the U.K. was Nationwide Consumer Confidence which continues its string of excellent performance. The report showed that confidence hit the highest level in 18 months, while economic expectations reached nearly a four year high. Nationwide attributed the improvement to “continued positive news about the housing market and the strong rally seen in equities.” Of course, the BoE rate decision will be the focus of tomorrow’s calendar. After the surprise decision to expand the asset purchase program in August many <a href="http://cfd.net.au/home/topic/trader">Trader</a>s are approaching the decision with caution. However, even though the bank is still the most dovish in town, there is not much that could be expected. The main points to look out for will be any mention of the pound or any discussion about the possibility of lowering the banks deposit rate.<br />

AUD: EMPLOYMENT NUMBERS ON TAP<br />

The Australian, New Zealand and Canadian dollars raced to fresh year to date highs before giving up their gains to end the day lower against the U.S. dollar. Australian economic data continues to outperform, adding validity to the Reserve Bank of Australia’s decision to hike interest rates earlier this week.  Construction sector <a href="http://cfd.net.au/home/topic/pmi">PMI</a> jumped from 42.4 to 50.8, putting the <a href="http://cfd.net.au/home/topic/index">Index</a> into expansionary <a href="http://cfd.net.au/home/topic/ter">TER</a>ritory for the first time since February 2008.  Home loans continued to fall while investment lending surged.  The housing market in Australia has been fueled by not only Australian but also Chinese demand. This evening, employment numbers are due for release and we believe that the data will help to reignite the rally in the <a href="http://cfd.net.au/home/topic/aussie">Aussie</a>.  With the employment component of service, manufacturing and construction sector <a href="http://cfd.net.au/home/topic/pmi">PMI</a> all rising in September, there is a good chance that Australia experienced positive job growth last month.  Meanwhile the Canadian dollar came under pressure as<br />

FUJII IS AT IT AGAIN<br />

The U.S. dollar fell to a 9 month low intraday before rebounding to end virtually unchanged against the <a href="http://cfd.net.au/home/topic/jp">J.P.</a>nese Yen.  Despite the dollar’s recovery against other major currencies, it remains weak against the Yen which suggests that the market is still bearish dollars.  As the currency pair continues to fall, the market will increase its focus on comments by <a href="http://cfd.net.au/home/topic/jp">J.P.</a>nese officials. Finance Minister Hirohisa Fujii’s is at it again &#8211; the incoming administration’s rules about foreign exchange intervention seem to change day by day. Mr. Fujii explained that while he does not believe governments should intervene, there are certain exceptions to the rule. In the cases where currency fluctuations are “outrageously reckless” authorities will need to take appropriate measures. However, he does not regard the yen’s strength as being “extremely abnormal.” In an attempt to keep the dollar from falling too far, Fujii mentioned that he does not expect to reduce the level of dollars in <a href="http://cfd.net.au/home/topic/jp">J.P.</a>n’s reserves. These latest comments are on the back of signs of distress coming from Sony Electronics. The company predicts that the yen will continue to strengthen, giving them “no moment to breathe”. Economic data released today included the Coincident <a href="http://cfd.net.au/home/topic/index">Index</a>, which jumped to its highest in eleven months, and the Leading Index which improved to 83.3. On the way for tomorrow will be the <a href="http://cfd.net.au/home/topic/current-account">Current <a href="http://cfd.net.au/home/topic/account">Account</a></a> and Trade Balance along with the Eco Watchers Survey.<br />

Any sign that the direction of the ECB and BoE are diverging more than expected could send the currency pair that way.</p>

Well, I wish the Chinese government officials could use the decisions on U.S. government debt as their bargaining chip for certain important issues. Unfortunately they are not able to. Something behind the scene do not allow. Even some US financial commentators have mentioned, the Chinese officials do not necessarily want to continue to buy the US debt (after they have already owned unprecedented huge amount of it), but they have to. Well, it&#8217;s up to the readers about how to understand the comments. At least you know they have no choice but continue to deliver hundred of billions$ to the central bank each month&#8230;</p>
<p>You can see a lot of peculiar things happening these days (including the trade issues you pointed out) while the Chinese  officials simply have no real action or reaction. People will learn why in the future.</p>

<p align="justify"><a href="http://www.voiceipcomms.com/" target="_blank">SIP</a> is a service offered by <a href="http://www.voiceipcomms.com/" target="_blank">VoiceIPComms</a> ; <a href="http://www.voiceipcomms.com/" target="_blank">SIP</a> is the abbreviation of “Session Initiation Protocol” and is widely applicable in present scenario. It basically works with <a href="http://www.voiceipcomms.com/" target="_blank">Internet Protocol</a>. It initiates the session for multimedia communication among various parties. Multimedia communication includes various online facilities like audio or video recording, conferencing either audible or video, SMS and messaging services, various entertainment options etc. This <a href="http://www.voiceipcomms.com/" target="_blank">SIP</a> protocol basically works for making or discarding connection between two parties or multipartite. The protocol is basically Application Layer based protocol i.e. a TCP/IP protocol, it is designed in such a manner that it is not at all based on Transport layer and can run on TCP and UDP.</p>
<p align="justify">SIP is a text-based protocol with syntax similar to that of HTTP. There are two different types of SIP messages:</p>

<p align="justify">The first line of a request has a method, defining the nature of the request, and a Request-URI, indicating where the request should be sent. The first line of a response has a response code.For each and every client request <a href="http://www.voiceipcomms.com/" target="_blank">SIP </a>offers you at least one response. It is completely a text readable format.</p>

<p>A atriz Eva Todor, 89 anos, deixou a CTI da Clínica São José, na Zona Sul do Rio de Janeiro, nesta quarta-feira (9) após cirurgia que se submeteu devido a uma hérnia de hiato, complicação que sofre desde a infância.</p>
<p>Eva vive a Dona Cidinha de <em>Caminho das Índias</em> (Globo) e teve que ficar de fora das gravações dos últimos capítulos da trama.</p>
<p>A atriz está internada desde a última semana de agosto e foi operada no dia 1º de setembro. Ainda não há previsão de alta.</p></div>
