O documento apresentado na manhã de quinta-feira, 26, no espaço do Fórum Democrático da Assembleia Legislativa, contém 28 recomendações para garantir o respeito aos direitos civis e às liberdades públicas, entre eles a criação do Conselho Estadual dos Direitos Humanos, da Comissão Estadual de Mediação e Conflitos Agrários e a revogação da nota de instruções operacionais da Brigada Militar que regula a atuação em manifestações sindicais, de estudantes e de sem-terras.

“Estamos oferecendo este relatório como um instrumento para a única saída para este problema, que chama-se diálogo”, enfatizou o secretário-adjunto da Secretaria Nacional de Direitos Humanos, Rogério Sottili, que representou o ministro Paulo Vanucchi, que cancelou a visita ao estado em função de problemas familiares. “Cabe agora ao poder público estadual utilizar o documento como instrumento para corrigir as situações apontadas”, emendou o relator Fernando Matos.

O documento, apresentado para representantes do poder judiciário, Ministério Público, movimentos sociais e parlamentares, aponta o Rio Grande do Sul como o estado brasileiro mais violento contra os movimentos sociais. A constatação está amparada em documentos do seminário nacional do Conselho Federal da Ordem dos Advogados do Brasil, que sistematizou informações sobre o tema. Os casos mais emblemáticos são o assassinato a sangue frio do sem-terra Elton Brum da Silva, ocorrido durante desocupação da Fazenda Southall em São Gabriel, os atos de humilhação, violência, repressão e tortura praticados pela BM contra sem-terras, o fechamento das escolas itinerantes que funcionavam junto aos acampamentos do MST e o pedido de extinção do MST, pleiteado pelo Ministério Público Estadual.

“Mais de 600 crianças estão sem aulas no estado por determinação do Ministério Público Estadual e da governadora Yeda Crusius”, reiterou o deputado Dionilso Marcon (PT), presidente da Comissão de Cidadania e Direitos Humanos da Assembleia. O parlamentar também confessou sentir-se envergonhado pelo fato de pessoas de outros estados terem que fazer a defesa dos Direitos Humanos no Rio Grande do Sul.

Pela primeira vez, o Conselho de Defesa dos Direitos da Pessoa Humana não foi recebido por um governante de Estado. Apesar de duas audiências agendadas antecipadamente, Yeda Crusius fechou as portas. Uma das mais importantes reuniões aconteceu com o secretário da Segurança Pública, Edson Goulart, e toda a cúpula da área e foi marcada pela tensão. Na ocasião, a Comissão Especial sublinhou que a segurança e os direitos humanos podem caminhar juntos. Antes, porém, o comando da BM se negou a dialogar como a Comissão Especial para tratar das ações policiais contra o MST, em Pedro Osório, onde mais de cem pessoas foram levadas à Delegacia de Polícia.

Criada em 12 de agosto de 2008, a Comissão Especial ouviu depoimentos de integrantes do MST, de sindicalistas e estudantes, deputados, autoridades, visitou acampamentos e assentamentos e esteve em Porto Alegre, Sarandi, Passo Fundo. Reuniu-se com a Federação dos Agricultores do Rio Grande do Sul (Farsul), Ministério Público Estadual, Ministério Público Federal, Tribunal da Justiça do RS, Instituto Nacional de Colonização e Reforma Agrária (Incra).

Nesses encontros recebeu documentos e dossiês, comprovando que a ação repressiva da Brigada Militar se intensificou a partir de 2005 e que há recrudescimento da violência no campo, esgotamento da capacidade de negociação das autoridades e operações militares forçadas. Há também uma nota de instruções operacionais da Brigada Militar de número 006.1, de outubro de 2007, que “regula os procedimentos administrativos e operacionais” específicos para atuar junto a manifestações sindicais, estudantes e de sem-terra. Também preocupa os defensores de direitos humanos a identificação de lideranças e de entidades. Mesmo em caso de desocupação voluntária, a recomendação do governo é registrar e identificar as pessoas e até mesmo encaminha-las à Delegacia de Polícia para auto de prisão em flagrante delito.

O relatório critica o Ministério Público Estadual por pedir a extinção do MST e por utilizar relatórios sigilosos da BM em ações judiciais. Também contesta o Ministério Público Federal por denunciar lideranças com base na Lei de Segurança Nacional e o Poder Judiciário por proibir liberdade de atuação de sindicatos.

O documento constata ainda que a Farsul pressiona para que o Incra não identifique terras possíveis de desapropriação e se refere ao sobrepreço que os proprietários acrescentam ao valor do imóvel em negociação com o Instituto. Por sua vez, a procuradora-geral de Justiça, Simone Mariano da Rocha, recebeu os representantes na condição de Conselho de Defesa dos Direitos da Pessoa Humana e não de Comissão Especial, alegando não aceitar a “imposição” ao MPE de estar criminalizando setores da sociedade. A reunião não teve avanços.

Policiais civis de Minas Gerais entram em greve por tempo indeterminado a partir da próxima segunda-feira, 30 de novembro. A decisão foi tomada em assembleia que reuniu cerca de 700 policiais na manhã desta quinta-feira, 26, na Praça da Liberdade, em Belo Horizonte.

Durante o movimento grevista, serão mantidos apenas os serviços considerados essenciais, como ocorrências de flagrante e cumprimento de mandados judiciais. Segundo o delegado e diretor do Sindicato dos Servidores da Polícia Civil Regional Zona da Mata (Sindipol), Marcelo Armstrong, apenas 30% dos trabalhadores devem permanecer a postos. Além disso, serão realizadas 30% das perícias que apresentam caráter de urgência.

A categoria votou pela deflagração da greve devido à rejeição, por parte dos policiais civis, da contraproposta apresentada pelo governo do Estado. “Na última quarta-feira, dia 25, o governo declarou estar disposto a criar carreira jurídica para delegados. As outras reivindicações, entretanto, não foram atendidas”, informa Armstrong.

A categoria luta pela criação da carreira jurídica para delegados devido ao fato destes profissionais exercerem funções típicas de juízes e promotores de justiça sem haver equiparação salarial. Além disso, pedem a implantação do terceiro grau para agentes e escrivães. Os policiais civis reivindicam ainda melhores salários. “Temos a pior remuneração da categoria em todo Brasil”, declara Armstrong.

El presidente del Congreso, senador Javier Cáceres Leal, le solicitará a la Corte Constitucional la revisión del fallo que declaró inexequible el acto legislativo 01 de 2008 aprobada por la Corporación que preside, y que permitía a los trabajadores de entidades públicas nombrados en provisionalidad en sus cargos antes de 2004, inscribirse en carrera administrativa de manera extraordinaria y sin necesidad de concurso público.

En reunión con miembros del Comité Ejecutivo de la Central Unitaria de Trabajadores (CUT), y varias de sus organizaciones sindicales afiliadas, el Presidente del Congreso se comprometió en pedir que se examine con detalle la decisión adoptada por el alto tribunal, teniendo en cuenta que afecta a más de 120.000 servidores públicos de todo el país.

El senador Cáceres fue uno de los defensores del acto legislativo mientras cursó su trámite en la Comisión Primera de Senado, a la que perteneció antes de asumir la Presidencia del Congreso.

“No comparto la decisión de la Corte Constitucional, por eso solicitaré esta semana, como presidente del Congreso, que se revise el fallo”, precisó el senador Cáceres Leal.

Francisco Maltas, miembro del Comité Ejecutivo de la Central Unitaria de Trabajadores (CUT), destacó la posición adoptada por el Presidente del Congreso, porque brinda una esperanza a los trabajadores que laboran en entidades públicas de continuar en sus cargos.

Según el líder sindical, al no prosperar el acto legislativo, varios empleados que ocupaban cargos en provisionalidad han sido despedidos de las entidades públicas donde laboraban.

En la reunión con el presidente del Congreso asistieron miembros de los sindicatos: Sintraenal, Sinalserpub, Sindistritales, Sintracaja de Vivienda Popular, Sintraencali, Sintrahospital Universitario del Valle y Sintraltraempross y de la CUT.

Referencia: Solicitud de Nulidad de la Sentencia C-588 del 27 de agosto de 2009. 

Honorables Magistrados: 

Yo, JAVIER ENRIQUE CACERES LEAL, identificado con cédula de ciudadanía 9.092.613 de Cartagena, en mi calidad de ciudadano colombiano y como Presidente del Congreso de la Republica, propongo incidente de nulidad contra la sentencia C-588 del 27 de agosto de 2009, con base a las siguientes consideraciones:  

De Conformidad con los previsto en el articulo 49 del Decreto 2067, “la nulidad de los procesos ante la Corte Constitucional sólo podrá ser alegado antes de proferido el fallo. Sólo las irregularidades que impliquen violación del debido proceso, podrán servir de base para que el Pleno de la Corte anule el Proceso”. 

Según lo señalado por la propia jurisprudencia de la Honorable Corte constitucional, el articulo 49 en cita “se refiere la potestad de la Sala Plena declara nulo un proceso o parte de él, cuando se detecten una violación flagrante del derecho al debido proceso. Y, tratándose de violaciones a este derecho, es posible que estas se presenten en cualquier etapa del proceso, dentro de las cuales esta incluida la sentencia. Por ello, atendiendo al principio según el cual la nulidad en un proceso sólo puede ser alegada después de ocurrida la causal, que lo genera, entonces en los casos que la novedad se ha producido en la etapa procesal de la sentencia, es decir, en el momento de la toma de la decisión, esta no puede ser alegada sino después de dicho momento”. 

Tal como ha ocurrido en el caso de la decisión adoptada en sentencia C-588 del 27 de agosto del 2009, la mayoría de la Sala Plena de la Corte Constitucional, ha incurrido en una clara vulneración del principio constitucional del debido proceso, en tanto declaro la inexequibilidad de un acto legislativo a partir del cotejo de su contenido, con el contenido del articulo 125 de la Carta y los contenidos Constitucionales, relativos a: “(i) (…) los fines del Estado (art. 2) y las finalidades de la función administrativa (art. 209); (ii) (…) los derechos de las personas, entre los que se destacan en primer término el derecho de acceder al desempeño de cargos públicos previstos en el articulo 40-7 de la Constitución y el derecho de los trabajadores a la estabilidad y demás garantías. Contempladas en el articulo 53 superior. (iii) (…) el derecho a la igualdad, particularmente como igualdad de trato y como igualdad en el punto de partida”. 

En efecto, lo anterior indica la vulneración de la regla de competencia establecida en los artículos 241-1 y 379 de la Constitución, según la cual el alcance del control de constitucionalidad ejercido sobre los actos legislativos, le otorga a la Corte Constitucional competencia para declararlos inexequibles únicamente por la configuración de vicios en el procedimiento de su formación. Lo que a su vez quiere decir que las normas constitucionales que pueden fungir como parámetro de control en estos casos, son aquellas que describen el trámite de las reformas Constitucionales con origen en el Congreso. 

En este orden, al utilizar como parámetro de control de constitucionalidad normas constitucionales cuyo contenido no describen procedimiento alguno para tramitar un acto legislativo, la Corte se ha arrogado una competencia que la Constitución expresamente vedó. Por ello, se ha configurado una causal de nulidad en el proceso de decisión de la sentencia C-588 de 2009, consiste en la falta de conformidad de las regla de competencia utilizadas al momento de la decisión, y las que la misma Constitución disponen para el control de actos reformatorios constitucionales. Esto es, que el procedimiento pre-establecido para estos casos ha sido modificado por el Juez de control de Constitucionalidad, por lo cual la decisión en cuestión debe ser anulada.

Nesta quinta-feira (19), a CUT e a Fundação Friedrich Ebert promoveram o segundo e último dia do seminário internacional “Experiências de promoção e igualdade de remuneração entre homens e mulheres”, no hotel Braston, centro de São Paulo.

Antes do início dos debates, o Secretário Geral da Central, Quintino Severo, lembrou que desde 1983 a CUT mantém parcerias internacionais, melhoradas a cada ano. “Nos interessa que esse estreitamento ocorra para ajudar na criação de propostas sobre os mais diversos temas ligados à melhoria de vida do trabalhador e não apenas ao mundo do trabalho.” 

A primeira mesa do dia começou com a coordenadora do programa de promoção de igualdade de gênero e raça no mundo do trabalho da OIT (Organização Internacional do Trabalho) no Brasil, Márcia Vasconcelos.

Márcia afirmou que para a OIT a igualdade de oportunidade entre homens e mulheres é condição fundamental para atingir a democracia, para diminuir a pobreza e preceito básico para alcançar o desenvolvimento econômico e social.

Da maternidade à igualdade – Ressaltando que num primeiro momento a defesa da igualdade se dava por meio da proteção às mulheres, fundamentalmente com relação à maternidade, e somente depois entrou em cena a promoção da equidade no ambiente de trabalho, ela falou sobre as convenções 100, que trata da igualdade de remuneração entre gêneros, da 111, sobre a discriminação em matéria de emprego e profissão, e da 156, que se refere a equiparação de oportunidades para trabalhadores e trabalhadoras com encargos de família. “As responsabilidades familiares interferem diretamente no tempo que a mulher dispõe para se qualificar ou dedicar à profissão. Por isso é importante lutarmos pela efetiva implementação da Convenção 156, que também impede o empresário de usar as responsabilidades familiares como obstáculos para restringir o acesso à ascensão profissional”, explicou. 

A dirigente da Organização Internacional do Trabalho citou ainda fatores geradores de diferença de remuneração, cuja explicação é exclusivamente a discriminação, como a subvalorização de muitos trabalhos considerados tipicamente femininos – especialmente os ligados aos cuidados, como o de enfermaria –, os métodos de avaliação de desempenho com parâmetro nas atividades masculinas e a restrição à participação das mulheres trabalhadoras na organização sindical.

Márcia acredita que para mudar esse cenário é necessário ampliar o espaço para as mulheres nas mesas de negociação coletiva, pressionar o governo para adotar legislação favorável à remuneração igualitária, promover campanhas de equiparação salarial e manter a luta pela valorização do salário mínimo.

Portugal, Quebec e Quixadá

A seguir, companheiras de Portugal, do Quebec (Canadá) e de Quixadá (Ceará) falaram sobre a experiência da luta pela igualdade de ganhos entre homens e mulheres.

Odete Filipe, da portuguesa Comissão de Mulheres da CGTP-IN, comentou a negociação coletiva no setor de bares e restaurantes. “Há quatro anos não havia nada definido contra a discriminação indireta nesse segmento. Resolvemos fazer um projeto centrado no valor dos postos de trabalho, sem diferença de gênero.”
O primeiro passo para a mudança foi uma avaliação realizada no setor, que constatou a predominância de homens nos cargos de chefia. A partir daí apresentamos uma forma de reestruturação do cargos, que apenas será colocada em prática no ano que vem, devido à recente crise financeira”, ressaltou.

Para falar a respeito da legislação nacional equidade de gênero e os avanços obtidos no Canadá, a CUT convidou a especialista da confederação CSN, de Quebec, Judith Carroll.

Segundo ela, da mesma forma que em Portugal, a entidade sindical fez uma avaliação da situação empregatícia para definir a remuneração com base em critérios como qualificação, esforço, condições de trabalho e conhecimento. Isso resultou na necessidade de restringir diferenças com base em outros fatores, tal qual o gênero. “Após um ano, 50% das empresas admitiam que não tinham tomado providências sobre a questão. Os empresários acharam muito complexo tratar o emprego de forma igualitária”, ironizou.

A partir de dezembro de 2010, as companhias que não se adequarem terão de pagar multas.

Setor público – Representante da ISP (Internacional de Serviços Públicos) Brasil e da Confetam (Confederação dos Trabalhadores no Serviço Público Municipal), Graça Costa, falou sobre o processo de pesquisa dos postos de trabalho sem viés de gênero na cidade cearense de Quixadá.

“Em 2002, a ISP lançou uma campanha de igualdade entre sexos no setor público. A partir daí fizemos uma avaliação do funcionalismo na cidade e verificamos que muito mais homens do que mulheres tinha acesso ao crescimento profissional, porque isso depende da indicação do chefe. Resolvemos, então, promover cursos de formação, seminários estaduais e atos de lançamento da campanha, inclusive com participação masculina.”

A atuação das trabalhadoras no setor público deu certo: conseguiram aprovar uma lei que definiu o Conselho Municipal da Mulher e outra para criar o Comitê de Equidade de Remuneração e Gênero. Também aprovaram a licença-maternidade de 180 dias e, principalmente, conseguiram colocar no orçamento público de Quixadá ações para a equiparação, que incluem desde capacitação dos servidores até plano de carreira.

Próximos passos

Na última mesa do seminário, a especialista na temática de gênero, Marilane Teixeira fez um apanhado das discussões dos dois dias e apresentou uma série de propostas com destaque para a criação de uma lei de igualdade no trabalho que garanta acesso à promoção e qualificação, a obrigatoriedade do item equidade de remuneração nas negociações coletivas e a pressão sobre o poder público para apresentar propostas de políticas públicas que favoreçam a inclusão.

Vice-presidente da CSN, Denise Boucher, reforçou que o projeto de eliminação das injustiças no ambiente de trabalho deve unir todos os segmentos dos movimentos sociais. “È preciso que os representantes sindicais, do presidente da CUT ao dirigente do pequeno sindicato no fim do Brasil, acreditem na luta e entendam o que está em jogo.”

Secretária da Mulher Trabalhadora, Rosane Silva, comentou o motivo do relançamento da campanha “Igualdade de oportunidade na vida, no trabalho e no movimento sindical”, durante o seminário. “Esse será o centro da nossa luta em busca de um outro modelo de desenvolvimento com distribuição de renda. A luta pelo fim da discriminação contra a mulher é da CUT e não apenas das mulheres cutistas”, disse.

Segundo a dirigente, estão previstas a construção de diagnósticos sobre a situação das mulheres trabalhadora e a adoção em uma empresa multinacional e outra nacional, em regiões diferentes do País, de um programa que adote a remuneração igual para trabalho de igual valor, conforme determina a Convenção 100 da OIT. “Combinaremos essas ações com os pontos da agenda geral da CUT, como a redução da jornada sem redução de salário e a valorização do serviço público”, finalizou.
