<title><![CDATA[Harassment by Computer in Virginia:  What You Should Know]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p class="MsoNormal">Often called cyberbullying or cyberstalking, harassment by computer in Virginia is a serious crime.  As a class 1 misdemeanor, it carries up to one year in jail and a $2,500.00 fine.  A Google search will quickly reveal that cyberbullying and cyberstalking are of particular concern to colleges and schools throughout the country.   So, what constitutes harassment by computer in Virginia?</p>
<p class="MsoNormal">Computer harassment is found in the Virginia Computer Crimes Act (the “VCCA”) in Virginia.  Specifically, it is found at Va. Code § 18.2-152.7:1, which states that</p>
<p class="MsoNormal" style="margin:0 .5in 10pt;">If any person, with the intent to coerce, intimidate, or harass any person, shall use a computer or computer network to communicate obscene, vulgar, profane, lewd, lascivious, or indecent language, or make any suggestion or proposal of an obscene nature, or threaten any illegal or immoral act, he shall be guilty of a Class 1 misdemeanor.</p>
<p class="MsoNormal">Broken down, and in no particular order, the statute has three core elements.  First, the statute requires the use of a computer or computer network.  Importantly, the definition of “computer” in the VCCA is broad.<a name="_ednref1" href="#_edn1"><span class="MsoEndnoteReference"><span class="MsoEndnoteReference"><span style="line-height:115%;font-family:&#38;">[1]</span></span></span></a> Accordingly, the statute is not necessarily limited to harassment through use of a single conventional computer – harassment can arguably originate from devices such as an iPhone or PDA, and possibly even a cell phone, particularly if the message or e-mail is routed through a computer network.</p>
<p class="MsoNormal">Second, the communicator must have the intent to coerce, intimidate, or harass another person.  At least one court has indicated that this language requires that the communicator specifically target another person.<a name="_ednref2" href="#_edn2"><span class="MsoEndnoteReference"><span class="MsoEndnoteReference"><span style="line-height:115%;font-family:&#38;">[2]</span></span></span></a> In other words, in certain circumstances, if an obscene communication is sent to multiple recipients without targeting anyone in particular, it may fall outside the statute.</p>
<p class="MsoNormal">Third, the communication must contain obscene, vulgar, profane, lewd, lascivious, or indecent language, or make any suggestion or proposal of an obscene nature.  The meaning of obscene, vulgar, profane, lascivious, and indecent is not as clear as it may first appear.  In a 2007 case before the Court of Appeals of Virginia involving two college students in the same dormitory, the court considered whether the defendant committed computer harassment by i) repeatedly using of the term “f&#8212; you” towards the victim, ii) calling the victim an “Italian whore,” and iii) telling the victim that he was coming upstairs to her floor of the dormitory, all through instant messaging.<a name="_ednref3" href="#_edn3"><span class="MsoEndnoteReference"><span class="MsoEndnoteReference"><span style="line-height:115%;font-family:&#38;">[3]</span></span></span></a> The Court of Appeals held that while the words “whore” and “f&#8212;“ are sexually explicit, the defendant’s use of the words was not erotic and did not have the purpose to appeal to a prurient interest in sex – rather, they were used as a method to show anger, contempt or disgust.<a name="_ednref4" href="#_edn4"><span class="MsoEndnoteReference"><span class="MsoEndnoteReference"><span style="line-height:115%;font-family:&#38;">[4]</span></span></span></a> Accordingly, they Court of Appeals held that the words failed to meet the definition of obscene in the statute.</p>
<p class="MsoNormal">The third element can be alternatively satisfied if the communication threatens any illegal or immoral act.  Such threats arguably include blackmail, as well as physical and financial threats.</p>

I recently watch the most compelling and disturbing documentary. I almost feel like Oprah when I say – <strong>you have to watch this</strong>! I have never been so moved to anger, rage, and other emotions that we are now confronted with because of monsters that lurk online.</p>
<p>My recent book, <a href="http://googlebombbook.com">Google Bomb</a>, is the tip of the iceberg after watching this film. The victims, and now crusaders, in this film contacted me after hearing about my book and my own experiences.</p>
<p>Many people that have read my book say they have nightmares if they read it before going to bed. I never really understood that. Until I watched this documentary and lived it through other’s lives. My story is horrible, what I endured, however since I was so enmeshed in surviving on a daily basis, I didn’t realize how traumatic it was.</p>
<p><strong>I know many of you have limited time. Watch this 50 minute film in segments if you have to, but watch it.</strong></p>
<p>The title is “Stalkers” however I would prefer to use a phrase that was recently introduced to me – “<strong>criminals with a keyboard</strong>.”</p>
<p>This film shares two stories with you. One with Graham Brown-Martin (pictured above) and his lovely wife, Ren as well as their toddler daughter and the other with a man, Chay, who in one weak moment had a one night stand that takes obsession to a new level. If there was ever a “Fatal Attraction” through the Internet, we have found it. However, unlike the Hollywood movie, Chay literally only had a one night stand, no strings attached. He never heard again from her until months later, and it would be the worse next years of his life.</p>

This came after I was looking at rental accomodations around Australia on my computer.  Its only been a few days since they totally crashed my computer, and stuffed around with my phone also.</p>
<p>Its just after 3am, at about 2.51 am, I heard a noise in the ceiling, about half a minute after that started to have trouble breathing and my hands and feet started to swell, then heard the usual footsteps from no 16, next door,  going down the passage the taste is like insecticides.  Their will be bugs running around soon, there always is not long after this.</p>
<p>Going back a few days ago I was out weeding my lawn, when the neighbour from next door came home with a friend of hers, as they walked from the car to their door the friend says to her as she looks my way &#8220;Have you got someone up your bum&#8221;.   I feel very sorry for her if thats the case and really feel she should seek some kind of medical treatment, as is a nasty way to spread aids,  but besides that,  I don&#8217;t ask anyone if I can sit in my own front yard.  I put that on for a reason, not long after the above was done at 2.50  got &#8220;I&#8217;m going to come and f**k  you up the b*m.&#8221;  and &#8220;Got you good that time you slut&#8221;.  How totally cheap and vulgar this kind of trash is.  As for being a slut? I don&#8217;t  have different men sleeping at my place week on week off.  Take a plane ride somewhere else, preferably somewhere radical.  Yes they will definately know what I mean by that.  While your at it honey give him a hug and put him on a diet, he could really use it.</p>

<p><strong>Remember, these aren&#8217;t mere suggestions, they are warnings. Stop now or be judged later by the Facebook Gods &#8211; they are fierce, unforgiving and may sentence you to eternity on MYSPACE!!!</strong></p>
<p><strong>Facebook Don&#8217;tS:</strong></p>
<p>1. Couples, DON&#8217;T put cutesy &#8220;No, I love you more!&#8221; posts on each other&#8217;s walls. ESPECIALLY when you live together. It screams desperate and just makes others jealous&#8230;like me. Cuz I can&#8217;t even get my boyfriend to put &#8216;In a Relationship&#8217; on his profile. But I&#8217;m totally fine with it. I mean we&#8217;ve only been dating 7 years so it&#8217;s like totally NOT a big deal. Okay, moving on&#8230;</p>
<p>2. Don&#8217;t send notices out for ALL CAUSES. Be selective. Pick and choose. If you are already a part of the cause to stop animal cruelty, stop crimes against children, eat vegetarian and adopt a fugly person to date &#8211; that&#8217;s enough. Stop there. If you&#8217;re for all the causes &#8211; you&#8217;re really for none of the causes and everyone will nickname you FAKEY McFakerson with a capital F!</p>
<p>3. Learn how to flip your pics. Nothing says &#8220;I&#8217;m a total internet granny&#8221; like posting pics that are sideways or upside down. Seriously, you can do it. There is a flipping option under the pic after you upload it.  It&#8217;s just plain unfair because we all know that everyone looks hotter sideways and/or upside down. Show us your TRUE SELF~</p>
<p>4. TMI! There is a such thing as TOO MUCH INFORMATION. Your Facebook friends don&#8217;t need to know about your last bowel movement, what it looked like, smelled like or what it took to create it.</p>
<p>5. Depressing status updates. Quit bumming us out with depressing status updates where you say &#8220;my life sucks&#8221; or &#8220;this is the worst day EVER&#8221; or &#8220;I&#8217;ll be dead by the morning.&#8221; Seriously! At first I liked this because it made me feel better about my life, but after seeing people post these depressors daily &#8211; Facebook friends no longer want to empathize with you. Instead, they want you to start lying. Facebook is not your therapist or BFF. It&#8217;s time to face the reality that some of your friends got stuck befriending you in hopes that this would deter you from stabbing them one day.</p>
<p>6. OVERLY HAPPY STATUS UPDATES WITH TOO MANY EXCLAMATION POINTS THAT ARE IN ALL CAPS!!!!! Okay, so you may think you have the best husband, boyfriend,wife, mistress, kid, cat, or disease EVER, but guess what, you don&#8217;t and no one agrees with you. Our selfish minds won&#8217;t let us because all we think when you proclaim your &#8220;bests&#8221; is  - &#8220;Ours are better!&#8221;</p>
<p>7. Excessive status updates about how much good stuff you do like volunteer, work out, eat vegetables and feed the elderly.  GOOD FOR YOU! Now keep that stuff to yourself, FACEBRAGGER!</p>
<p>8. Taking more than 2 quizzes a day is UNACCEPTABLE. Get a life! Not like I have one, but I know others that do have a life and it doesn&#8217;t involve finding out what Hoggwarts character you are and when you are going to get married. It&#8217;s just nonsense, especially when guess what, you are already married!</p>
<p>9. If you receive event invitations the WORST reply is &#8216;Maybe.&#8217; This is okay if you really are on the fence and plan on making up your mind and posting yes or no before the event. However, always being the &#8216;Maybe&#8217; person doesn&#8217;t go unnoticed and infuriates the Facebook Gods. You don&#8217;t want your FaceRights taken away from you now, do you?</p>
<p>10. If you beat my Farkle score, under no circumstance is it okay for you to post your win to my wall. Since I play Farkle <span style="text-decoration:line-through;">obsessively</span>often, I already know. Braggers don&#8217;t make for good FB friends and sometimes Farkle just feels bad for people and gives them a really high score, which coincidently puts them ahead of me on the scoreboard. So it&#8217;s not about talent or good luck, it&#8217;s just about pity, but not when it happens to me.</p>

<p>It is important to take precautions where you can and to use antivirus protection,as well as other protection.It is also suggested that you make use of a decent firewall and don&#8217;t click on links which you are not sure about.You may be cyberstalked in order to make you part with your money.Cyberstalkers can also be online criminals,who have all types of malicius and deceptive schemes up their virtual sleeve.</p>

<p><em>About three months ago I broke up with the guy I&#8217;d been dating for just under a year.  Things are fine now, we&#8217;re cordial with each other, and we&#8217;ve both dated other people since then.  Last week I went to his Facebook profile once and since then, I&#8217;m hooked.  I check it and refresh it constantly, and there&#8217;s lots of stuff to obsess over on it.  I thought I was over him, but I cannot stop checking his profile.  Does this mean I&#8217;m not over him?</em></p>

<p>Ahh, the wonders of self-awareness, or a lack thereof.  It&#8217;s interesting that we&#8217;re in an age where a girl will write to a stranger to ask about how she feels about an ex.  And I&#8217;m not teasing you at all- sometimes we need a check in with someone uninvolved&#8230; but I am asking you to trust yourself a bit more.  Because I feel like I can tell you with complete authority that you <span style="text-decoration:underline;">are</span> over him.</p>
<p>But first thing&#8217;s first, STEP AWAY FROM THE PROFILE.  Find some time and a quiet space to sit and think about your time spent with this guy, to figure out your feelings about him regardless of your cyberstalking.  Do you miss him?  The way he smells, the way he responds to questions, the way he jokes around?  Or is it perhaps that you miss being in a committed relationship, how settled and easy everything seemed?  That distinction is important, it&#8217;s the difference between wanting him and wanting a warm body to cuddle with.  But I don&#8217;t think it&#8217;s either.</p>
<p>Facebook profiles are damn fascinating snapshots of people&#8217;s lives, titillating both in what they reveal and what they only hint at, so my guess is that you&#8217;re more caught up in the drama of watching someone else&#8217;s life unfold.  I got really into the profile of a girl I kinda knew in middle school, and refreshed like crazy as she finally started dating a guy, only to have him break her heart a few days later.   I checked her profile before checking the news.  Now, would I ever be concerned that I wasn&#8217;t over poor Angie from my middle school?  Of course not.  But was I just as obsessed with her profile as you are with your ex&#8217;s profile?  Probably.   So my advice is to absolutely quit cold turkey, starting right now, and find someone else&#8217;s profile to stalk.  Or perhaps a nice juicy blog.  Just take your ex out of the equation entirely so that you don&#8217;t have to question your own motives.</p>
