   Fiinţialitatea umană în finitudinea ei irevocabilă e dată odată cu o lume – lumea aferentă oricărei fiinţe umane, lumea ce face ca un om să fie om – închisoare teribilă şi nevăzută, datul existenţial dincolo de care nu poate fi gândită nicio liberatate deoarece acea libertate înseamnă renunţare la sine, anihilare de sine, sfârşit a tot ceea ce este dat în mod existenţial şi finit – începutul a toate câte sunt e undeva dincoace de ceea ce poate fi sesizat, conceput, reprezentat – eşti om înainte de a fi om şi devii astfel doar odată cu lumea ta – cu lumea sortită dintru început locuirii tale .

L’emendamento del deputato radicale del PdL, benedetto Della Vedova, è in realtà il testo voluto da Fini. La famigerata soft-law che regola il “fine vita” in maniera a-dogmatica e non clerico-diretta. L’emendamento è chiaramente un tentativo di disinnescare il testo approvato al Senato, inviso tanto al Presidente della Camera quanto ai deputati radicali e laici del PD.
Di fatto si punta a riaffermare la centralità dell’individuo e della sua opinione in materia di trattamenti sanitari, se espressa, e quando non espressa, a lasciare l’iniziativa ai familiari e ai medici. Laddove il ddl Calabrò prevede “l’assoluto divieto di interrompere l’alimentazione e l’idratazione artificiale, e stabilisce che le cosiddette Dat (Dichiarazioni anticipate di trattamento) siano, per il medico, non vincolanti”, si introducono alcuni paletti fissi (niente eutanasia e niente accanimento) “che lasciano però spazio alle decisioni del paziente, dei familiari, dei medici” (fonte FfwebMagazine). Così si esprime nel testo il pensiero finiano-Della Vedova:

si riconosce «il valore assoluto e non disponibile del consenso o del dissenso alle cure espresso dai pazienti capaci, e demanda ogni scelta di cura per le persone che versano in uno stato di incapacità al rapporto fra i loro familiari, gli eventuali rappresentanti legali e i medici, tenendo conto delle volontà precedentemente espresse dagli interessati, nel rispetto dei principi del codice di deontologia medica, delle norme civili e penali e del dettato costituzionale».

Pur non privo di una certa vaghezza – non crea infatti nessun istituto giuridico atto a raccogliere la volontà del singolo – negli effetti, l’emendamento introduce senza eccesso di regolamentazione, una forma debole di testamento biologico, lasciando aperta la possibilità al singolo individuo di esprimersi, quando capace, sui trattamenti sanitari a cui intende non essere sottoposto, in modalità non definite che possono essere anche scritture private, però vincolanti per il medico.

Ci sarà battaglia in aula. Il Pd ha presentato un centinaio di emendamenti, i Radicali più di duemila. Ma la partita vera si gioca nella maggioranza. Qui i finiani si giocano molte delle loro chance di poter veramente contare nelle scelte del governo. Lo scontro, se ci sarà, sarà aperto e drammatico, poiché dal suo risultato si determineranno i nuovi rapporti di forza fra Berlusconi e Fini e sarà testata la tenuta della maggioranza sull’altro tema che scotta, la giustizia. E dal fallimento del testo governativo si potranno aprire risvolti finora insperati e inattesi: anche una crisi di governo, secondo alcuni. Il ddl Calabrò è uno dei tanti scogli che si sono frapposti fra Berlusconi e il proseguimento del suo governo. I vescovi, in caso di una mancata difesa del principio della insospendibilità dei trattamenti di idratazione, potrebbero voltare la faccia definitivamente a Mr b e appoggiare una convergenza al centro fra casiniani e rutelliani. E quindi ridisegnare nuovamente il quadro politico italiano.

  • Che la legge sul testamento biologico fosse destinata a far discutere lo sapevamo da tempo. Anche perché dallo scranno più alto di Montecitorio vi è chi l’ha caricata di fortissimi connotati ideologici
  • Il biotestamento rischia di diventare, così, non senza una sproporzione tra le differenti posizioni in campo, la cartina di tornasole della compattezza di maggioranza e opposizione
  • una quarantina di parlamentari del Pdl di fede finiana, ma non solo, hanno sottoscritto una proposta di Benedetto della Vedova, parlamentare radicale del Popolo delle libertà, che scompaginerebbe tutto l’impianto legislativo della famosa legge Calabrò licenziata dal Senato
  • La proposta, che sarebbe interamente sostitutiva di quella approvata da Palazzo Madama, rilancia l’ipotesi di soft law
  • “L’emendamento – dice della Vedova – riconosce il valore assoluto e non disponibile del consenso o del dissenso alle cure espresso dai pazienti capaci e demanda ogni scelta di cura per le persone che versano in uno stato di incapacità al rapporto tra i loro familiari, gli eventuali rappresentanti legali e i medici, tendendo conto delle volontà precedentemente espresse dagli interessati, nel rispetto dei principi del codice di deontologia medica, delle norme civili e penali e del dettato costituzionale”
  • Di fatto, l’emendamento della Vedova abolisce le Dat, le dichiarazioni anticipate di trattamento che dovrebbero contenere le volontà di un paziente per il suo fine vita, previste dalla legge del Senato, lasciando che a decidere della vita di chi si trova in condizione di incoscienza siano familiari e medici, secondo una logica del caso per caso
  • si potrebbe verificare né più e né meno di quanto è accaduto con Eluana Englaro, il caso in cui a decidere della volontà ex post di un paziente in stato vegetativo, qualora insorgessero controversie tra fiduciario e familiari, sarebbero i tribunali
  • un ibrido legislativo che – viene il sospetto – sia stato architettato solo per alzare la posta politica su questo tema, per creare all’interno della maggioranza i sempre più soliti distinguo
  • oltre 2600 gli emendamenti al testo sul biotestamento presentati in commissione Affari Sociali alla Camera: 2400 dei Radicali, 103 del Pd, 57 dell’Idv e cinque dell’Udc con Rocco Buttiglione come primo firmatario
  • ipotesi correttive arrivano anche dal Pdl: in particolare, cinque raccolgono ‘le proposte migliorative” del presidente dei deputati Fabrizio Cicchitto, del relatore Domenico Di Virgilio e del capogruppo in commissione Lucio Barani
  • Secondo il relatore di maggioranza, il testo del Senato è perfettibile. E per questo il numero di emendamenti all’esame della Commissione non potrà che migliorare l’impianto di fondo del ddl Calabrò
  • emendamenti “prevedono un ruolo dei familiari –afferma Di Virgilio – misure concrete di supporto ai pazienti in stato vegetativo e alle loro famiglie
  • la possibilità della sospensione di alimentazione e idratazione (che comunque non costituendo terapie non possono far parte della dichiarazione anticipata di trattamento)
  • Le proposte di Di Virgilio puntano anche a “estendere la normativa a tutti i casi in cui si riscontrino dal medico curante una incapacità di comprendere le informazioni e non solo nello stato vegetativo

• Della Vedova “corregge” il ddl Calabrò Asse con i finiani per una soft law – Corriere della Sera

  • Si sta per riapre alla Camera la “battaglia” sul testamento biologico e sul ddl Calabrò
  • Il termine per la presentazione degli emendamenti è scaduto alle 14 di oggi. Quelli elaborati e presentati dal Partito democratico sono più di cento
  • «Chiediamo alla maggioranza di cancellare lo scandalo dell’imposizione per legge dell’accanimento terapeutico» ha detto la capogruppo del Pd in commissione Affari sociali della Camera Livia Turco
  • Quello che però promette di scompaginare le pagine è l’emendamento, interamente sostitutivo del ddl Calabrò, presentato da Benedetto Della Vedova (Pdl).
  • Il testo prevede in sintesi un doppio «no», all’eutanasia e all’accanimento terapeutico, e stabilisce che in caso di contesa venga privilegiato il giudizio dei familiari d’accordo con il medico.
  • L’emendamento che ha Della Vedova come primo firmatario (un articolo unico di sette-otto commi) è stato sottoscritto da diversi parlamentari, molti dei quali vicini alle posizioni che su questo tema sono state espresse dal presidente della Camera, Gianfranco Fini, che aveva chiesto una formulazione «meno dogmatica» di quella votata dal Senato
  • L’idea – spiega Della Vedova – è quella di una “soft law” che quindi dica no all’eutanasia, no all’accanimento terapeutico ma che lasci la definizione della materia caso per caso
  • Se si tratta di un paziente non cosciente, si lascia la decisione relativa ai trattamenti ai familiari e ai medici in base al codice di deontologia medica
  • non fare una legge che comporti uno scontro tra le posizioni autodeterministiche e non autodeterministiche

Cred ca eu sunt un caz destul de fericit, cu flashbackurile astea. ma gandesc la acei oameni care isi refuza amintiri, care se dojenesc cand apare in primplan o scena de dragoste cu exul/exa, care nu mai merg prin nu stiu ce cartier sau zona ca sa nu dea ochii cu fosta mama soacra, iubita, sau prietena. si care, daca se pomenesc intrebati despre trecut, raspund elocvent: ” nu vreau sa vorbesc despre asta”  . dot dot dot

Am cunoscut si cunosc inca(prin voia intamplarii si a conditiei de studenta la medicina) o multime foarte colorata: baieti cu bani, parasute,intretinute,proaste si taranci sau taranci si proaste. Dar deasemenea si tineri simpli, mai mult sau mai putin joviali care de cele mai multe ori sunt prea timizi sa se exprime, dar in locul carora vorbesc faptele  lor.

Greseala pe care mi-o asum si autoatribui este acea idioata preconceptie cum ca “people don’t change. never ever“.  evolueaza, da, traverseaza diverse etape de lifestyle, dar de schimbat nu se schimba. greseala bazata pe obervatiile din viata de facultate ( daca-mi privesc colegii acum 5 ani descoper acelasi caracter si substrat pe care le au astazi si pe care, cel mai probabil, le vor avea si peste alti 5 ani..) . e un fel de “nimic nu se pierde, totul se transforma” . de cele mai mule ori totul se transforma este totul se conserva,  se conserva trasaturi precum prostia, egoismul, marlania, prost-gustul  si autosuficienta.

Imi privesc colegii de an si imi doresc sa ma fi nascut ori cu o generatie inainte, ori cu una dupa. pe mai mult de jumatate din ei  ceea ce i-a determinat sa faca aceasta facultate este “foamea de bani”.  de haine, masini, vile si abonament la ski in austria. dorinta intrinseca de a linge in cur pe altii pentru un post in bucuresti sau in alt oras-centru national. tineri care nu stiu sa gandeasca mai departe de ” sa vb cu ai mei sa-mi dea bani de chirie si de mers la mare/munte in vacanta”.

Acestia sunt parintii, medicii, colegii de maine. aceasta este societatea pentru care  promisiunea financiara este singura promisiune in curs de a fi acceptata. vreti sa spuneti ca lucrurile deja stau asa in romania? inca 2 ani, asta e tot ce va cer. asteptati 2 ani pana cand vine randul generatiei mele sa faca nazuri. adica sa si le transforme, scuzati.

Spending time on non-science classes is deadly. The DOLlar traded higher against the Euro, Australian, New Zealand and Canadian dollars, but not before each of the 3 commodity producing currencies hit fresh year to DATe highs. The U.S. economic calendar was once again devoid of any major economic releases, giving investors the opportunity to let their imaginations run wild. Although there are many reasons why the dollar should continue to weaken, the primary reason is the improvement in risk appetite. So if risk aversion returns and equities give back their recent gains, the relief rally in the dollar could become a full blown turn. Concerns about losses in the commercial real estate sector and the unrealistic expectations of a V shaped recovery have made investors a bit nervous. However with no major U.S. economic reports due for release this week and 2 central banks making monetary policy announcements tomorrow, we still believe that interest rate differentials will drive the Currency market.

More Protectionism

Although there are no major U.S. economic releases on the calendar tomorrow, there are 2 U.S reports worth watching – jobless claims and ICSC Chain Store Sales. After the acceleration of job losses reported last week, Traders will be looking for clues to whether the trend of improvement in the labor market has ended. If jobless claims increase more than the previous week, investors could grow concerned about another month of massive job losses. In addition, there have been a lot of reports that spending this holiday season will be weak and because of that, retailers are just looking to breakeven. However, based upon the SpendingPulse Index, a service by MasterCard Advisors, retail sales rebounded in September. Costco and Family Dollar Stores also posted better than expected quarterly results which give hope to Thursday’s report which will include back to school spending. Meanwhile consumer credit fell for the seventh month in a row due to mounting job losses and tight credit. If not for the cash for clunkers program, the DATa would have been even weaker.

EUR: COULD TRICHET TALK CURRENCIES?

The Euro traded lower against the U.S. dollar on the fear that European Central Bank President Trichet could reiterate his support for the U.S. dollar. There is no question that reporters will jump at the opportunity to ask Trichet about his take on the recent weakness of the dollar and there is no reason why he would change his stance. Although this would be nothing new, it could be enough to tip the

over. Based upon recent economic reports from the Eurozone, the recovery remains “bumpy.” The expiration of the car scrapping program in Germany has driven retail sales sharply lower while his morning’s Eurozone GDP report revealed that growth in the second quarter fell more than initially anticipated. Weakness in other parts of the region has offset growth in Germany and France, triggering a 0.2 percent drop in GDP. Aside from comments on the Currency, the market will also be looking at what Trichet says about the economy and the results of their second one year refinancing operation which was met with lackluster demand. The question of adding a spread to the one year tender is once again an issue. If the ECB adds a spread to the December operation, it would be perceived as a hawkish move. Given the recent trend of economic DATa and the appreciation in the


EUR/USD,





Trichet may postpone this decision until November. In TERms of exit strategies, ECB officials have said repeatedly that now is not the time for an exit and we expect Trichet to reiterate this stance. Aside from the monetary policy announcement, German industrial production is also due for release. The increase in factory orders suggests that there is a good chance that production rose as well.

GBP/USD:





CONSOLIDATION AHEAD OF BoE

The British pound continued to consolidate ahead of tomorrow’s Bank of England meeting while

reversed much of yesterday’s strong rally. The pair will be of particular importance ahead of the BoE and ECB rate decisions. The only economic indicator reported today from the U.K. was Nationwide Consumer Confidence which continues its string of excellent performance. The report showed that confidence hit the highest level in 18 months, while economic expectations reached nearly a four year high. Nationwide attributed the improvement to “continued positive news about the housing market and the strong rally seen in equities.” Of course, the BoE rate decision will be the focus of tomorrow’s calendar. After the surprise decision to expand the asset purchase program in August many Traders are approaching the decision with caution. However, even though the bank is still the most dovish in town, there is not much that could be expected. The main points to look out for will be any mention of the pound or any discussion about the possibility of lowering the banks deposit rate.

AUD: EMPLOYMENT NUMBERS ON TAP

The Australian, New Zealand and Canadian dollars raced to fresh year to date highs before giving up their gains to end the day lower against the U.S. dollar. Australian economic data continues to outperform, adding validity to the Reserve Bank of Australia’s decision to hike interest rates earlier this week. Construction sector PMI jumped from 42.4 to 50.8, putting the Index into expansionary TERritory for the first time since February 2008. Home loans continued to fall while investment lending surged. The housing market in Australia has been fueled by not only Australian but also Chinese demand. This evening, employment numbers are due for release and we believe that the data will help to reignite the rally in the Aussie. With the employment component of service, manufacturing and construction sector PMI all rising in September, there is a good chance that Australia experienced positive job growth last month. Meanwhile the Canadian dollar came under pressure as


oil





prices gave back their earlier gains. Housing starts are also due for release tomorrow and the rise in building permits suggests a recovery in Canada’s real estate market which could help to lift the loonie.

USD/JPY:





FUJII IS AT IT AGAIN

The U.S. dollar fell to a 9 month low intraday before rebounding to end virtually unchanged against the J.P.nese Yen. Despite the dollar’s recovery against other major currencies, it remains weak against the Yen which suggests that the market is still bearish dollars. As the currency pair continues to fall, the market will increase its focus on comments by J.P.nese officials. Finance Minister Hirohisa Fujii’s is at it again – the incoming administration’s rules about foreign exchange intervention seem to change day by day. Mr. Fujii explained that while he does not believe governments should intervene, there are certain exceptions to the rule. In the cases where currency fluctuations are “outrageously reckless” authorities will need to take appropriate measures. However, he does not regard the yen’s strength as being “extremely abnormal.” In an attempt to keep the dollar from falling too far, Fujii mentioned that he does not expect to reduce the level of dollars in J.P.n’s reserves. These latest comments are on the back of signs of distress coming from Sony Electronics. The company predicts that the yen will continue to strengthen, giving them “no moment to breathe”. Economic data released today included the Coincident Index, which jumped to its highest in eleven months, and the Leading Index which improved to 83.3. On the way for tomorrow will be the Current Account and Trade Balance along with the Eco Watchers Survey.

will be the currency pair in Play for the next 24 hours. The Bank of England is set to announce its rate decision at 7:00 am ET or 11:00 GMT. The ECB will follow with its decision at 7:45 am ET or 11:45 GMT. There will also be German Industrial Production at 6:00 am ET or 10:00 GMT.

struggles to regain recent highs and barely is holding within the Bollinger band buy zone. Potential support stands at 0.9077, which was not only the September 30th low but also the September 21st high. Resistance is extremely strong at 0.9300, the high from September 28th. Any sign that the direction of the ECB and BoE are diverging more than expected could send the currency pair that way.

Gold is roofing because investors wanna protect their dollar investments. Gold and dollar are rivals, Euro and gold are brothers. They also hedge against hyperinflation which might come because of low fed rates and huge trade deficit.

Well, I wish the Chinese government officials could use the decisions on U.S. government debt as their bargaining chip for certain important issues. Unfortunately they are not able to. Something behind the scene do not allow. Even some US financial commentators have mentioned, the Chinese officials do not necessarily want to continue to buy the US debt (after they have already owned unprecedented huge amount of it), but they have to. Well, it’s up to the readers about how to understand the comments. At least you know they have no choice but continue to deliver hundred of billions$ to the central bank each month…

You can see a lot of peculiar things happening these days (including the trade issues you pointed out) while the Chinese officials simply have no real action or reaction. People will learn why in the future.
