by Jessica Bryan

Focus argued against Judge David Hamilton’s appointment to the 7th Circuit, and also noted the new trend of viewing pornography on public transportation.

An email from Focus discussed health care reform and the Stupak-Pitts amendment.

Another email from the group noted that a CNN poll shows that “61 percent of Americans are opposed to government funding of abortion” and ”51 percent said they believed payment for abortions should come directly from the women seeking them.”

A third email from Focus argued that despite Sen. Harry Reid’s claim that his health care reform bill did not include funding for abortion, it still “would allow coverage through the “public option” and federal subsidies that would cover abortion on demand.”

A final email from the group included an interview with Dr. Stephen Meyer about evolution and intelligent design.

David Hamilton is a hard Left, former ACORN fund-raiser and abortion radical who was rated “not qualified” by the ABA.

LifeNews.com reports on the Republican efforts to block the appointment:

As he promised he would do, pro-life Sen. Jeff Sessions of Alabama led the filibuster and said Hamilton should be opposed in part because of his pro-abortion views.

Sessions noted how Hamilton kept an informed consent measure from being enforced in Indiana, thereby prohibiting women from getting information about abortion’s risks and alternatives so they can find positive alternatives.

“And for seven years, through a series of rulings, Hamilton kept it form being enforced. This case is a blatant example of allowing personal views to frustrate the will of the people and the popularly elected representatives of the government of Indiana,” Sessions said. “This appeared to me to be obstructionism.”

Sen. Jim DeMint, a pro-life senator from South Carolina, agreed.

“Judge Hamilton is the definition of an activist judge and is clearly not qualified to sit on a court of appeals,” DeMint said during the debate. “Hamilton, who spent years working with the ACLU and ACORN, has used his position on the bench to drive his personal political agenda.”

The pro-life group Susan B. Anthony List objected to Hamilton and said it worries about future Obama nominees.

“If Judge David Hamilton is considered a blueprint for the next judge President Obama will nominate for the U.S. Supreme Court, America is in trouble,” Marjorie Dannenfelser, president of the organization, told LifeNews.com.

The Department of Health has asked the High Court to overturn a Freedom of Information Act ruling that gave the Information Tribunal permission to publish the information.

The Information Tribunal is a government body that hears appeals under the Freedom of Information Act 2000.
The Department of Health refused to release the information claiming that it could lead to women who have late abortions being identified. Department lawyers argued that the information was “sensitive, personal and private.”

Senator Jim DeMint’s office tells me that the Republican conservative filibuster attempt was just defeated in the Senate. Here’s more insight into what Obama (and apparently Lindsey Graham) looks for in a federal judge (apparently ACORN ties and a pro-Muslim, anti-Christian disposition are a plus):

Vote No on David Hamilton for 7th Circuit Court – Christian Newswire.

How did Lindsey Graham vote on cloture? His office is saying that he voted against cloture and that he will vote against Hamilton — though, of course, the final vote is now a foregone conclusion.

Cerberus is quickly taking form as Supreme Court judgeship, an important mover of policy. Soon there will be no escape from the socialist hell that the American voter has created for himself. Liberal activist judge David Hamilton slithers closer to a seat next to the wise Latina while we shop for the best pumpkin pie recipe. If combined, they’ll provide powerful influence. Hamilton’s fund-raising efforts for the bottom-feeding organization ACORN, his work on the board of anti-American activist group ACLU, and his anti-Christian rulings make him an ideal candidate for Supreme Court judgeship during America’s socialist revolution.

Democrats are eager to get him there. Senate majority leader Harry Reid filed a cloture motion on Tuesday to end the debate on Hamilton’s nomination. The abolition of fundamental American liberties such as the 2nd amendment have proven to be the first priority of democratic leaders, and with the help of the mainstream media, they’re on a roll.

With the exception of numerous conservative and libertarian blogs, there hasn’t much report regarding Hamilton’s nomination since March, when our newly-elected Marxist leader named Hamilton as a nominee.

An excerpt from a March 18 2009 Washington Post article:

Hamilton has been involved in several controversial cases. In 2005, he ruled that the daily invocation of the Indiana House too often referred to Jesus Christ and a Christian god, in violation of the Constitution, which forbids the government to show preference for any religious denomination. The decision was overturned on appeal on technical grounds.

In 2003, Hamilton struck down part of an Indiana law requiring abortion clinics to give women information about alternatives to abortion in the presence of a physician or nurse. The information had to be given to women 18 hours before the procedure, requiring them to make two visits to the doctor’s office to obtain the procedure. That decision was also overturned on appeal.

This might appear to be a post with a religious theme and in a minor sense it is that. But there is more of a judicial/political element that will dominate our story.

The President has nominated Judge David Hamilton of Indiana to the U S Court of Appeals for the 7th Circuit. He is currently Chief Judge of the U S district Court for the Southern District of Indiana. He was nominated in March and the Senate Judiciary Committee approved him in June. Sen Harry Reid has set a vote for the full Senate on Tuesday the 17th.

A couple of interesting facts about Judge Hamilton. In 2005, he ruled that the Indiana state legislature could not open its sessions with so-called Christian prayers and that these prayers must not use Christian terms such as Jesus Christ or savior. His ruling stated that the use of proselytizing terms in prayers at the Indiana statehouse was in violation of the U S Constitution. This quote from his ruling is oddly disturbing and I am not sure why. ” Those who wish to participate in a practice of official prayer must be willing to stay within constitutional bounds.” I’m uncertain which part disturbs me more; that there is such a thing as official prayer or that there is some type of constitutional bounds for prayer. Somehow, I don’t think prayer can be contained within any bounds known to man. Anyway, Judge Hamilton also ruled in a post-judgment motion that it was not sectarian for a Muslim imam to offer a prayer to Allah. Confused, yep, me too. Kinda, sorta sounds politically correct, does it not?

A couple of other items. The judge was briefly a fund-raiser for ACORN, great thing for your resume, if you want to be an Obama guy. The other you will either like a lot or dislike a lot, depending on your political point of view. He was an officer in the Indiana branch of the ACLU. Presumably, that would indicate his somewhat sympathetic to their viewpoint.

In all probability, given the composition of the Senate, he will be confirmed next week. If so, the 7th Circuit could bear watching along with that left coast bastion, the fabled 9th Circuit.

Mathew Staver, Founder and Chairman Liberty Counsel Controversial Obama nominee, Judge David Hamilto

Mathew Staver, Founder and Chairman
Liberty Counsel

Controversial Obama nominee, Judge David Hamilton, is being
covertly ushered through a Senate confirmation vote next week.
We have to act NOW. Please see below. –Mat

Kevin,

The “No to Jesus, Yes to Allah” judge, David Hamilton, is now
scheduled for a confirmation vote by the full Senate as early
as next Tuesday. This pro-abortion, anti-faith radical nominee
is up for a lifelong appointment to the Seventh Circuit Court
of Appeals.

We are appalled at his very nomination.

As anticipated, Senate Majority Leader Harry Reid is trying to
limit debate on Hamilton and slip the final vote under the radar.
Thus far, all of Obama’s liberal judicial appointees have been
approved by the Democratic controlled Senate.

I’ve recently released a statement, along with other pro-life
advocates, calling on lawmakers to oppose Hamilton. In the
letter we state that, “Judge Hamilton fails to meet the
qualifications”… and that his record indicates that he decides
cases “on the basis of his politics and personal agenda instead
of the Constitution.”

++Tell the Senate, “He is NOT qualified!”

Here is what I’m asking you to do: We are bombarding the Senate
with a Fax Barrage expressing our outrage over Hamilton’s appointment.
I still need thousands of Liberty Counsel friends to stand with me.

Please go here right now to help us FAX BARRAGE the Senate.

http://www.libertyaction.org/r.asp?U=22987&CID=292&RID=20967065

Kevin, Hamilton is a former ACLU activist who, as a district
court judge, ruled that prayers using “Christ’s name or title” were
sectarian and therefore unconstitutional. Then he ruled that prayers
to “Allah” were acceptable.

He ruled, “NO” to Jesus but “YES” to Allah! How skewed was his judgment?
The Seventh Circuit Court of Appeals overturned his decision. Yet

President Obama has now nominated Hamilton to serve on the very court
that rebuked him!

In addition, this former ACORN fundraiser and pro-abortion advocate
blocked reasonable informed consent abortion laws and has a long
history of overt judicial activism.

This is clearly NOT a man whose judgment warrants a
PROMOTION to a lifelong appointment in a HIGHER
Court!

Stand with me, and the leaders of many other pro-life advocacy groups,
in stopping this dangerous appointment by the Senate. Even if you
have done so before, we need a HUGE outpouring of protest to stop
this travesty!

Go here to join in the deluge of faxes into the Senate
informing our legislators that radical nominations like this
one will not be tolerated:

http://www.libertyaction.org/r.asp?U=22988&CID=292&RID=20967065

Of course, if you prefer to send your own faxes, please go here for
fax numbers and sample texts for your faxes:

We must expose the radical opinions of this judge who misused the power
of the courts to say “NO” to Jesus and “YES” to Allah.

Thank you in advance, and may God bless you.

P.S. We must strongly oppose this nomination! David Hamilton is totally
unqualified! He has repeatedly shown his far-left, anti-life, anti-faith
agenda in his radical judicial rulings. Again, even if you have done so
before, I need you to schedule faxes today! Please go here:

As we see our freedoms and liberty evaporate with the leftest Congress we can become ever more active politically. We can vote the bums out, as some like to say. That is all well and good, and, come Judgment day 2010 perhaps some sanity may be restored.

However, it becomes more complicated when those same people that are in office now gerrymander districts with the long term goal of complete political domination for the foreseeable future. Too make things even more desperate for those that love our nation, there is the ever present threat of the judicial branch being stacked with activist’s that ignore the Constitution that they swore to uphold. That, is what we truly need to concern ourselves with.

We can fight tactically, as in voting out treasonous members of Congress and the Senate. We can fight operationally, as was seen this past summer by letting those that Laired it over the masses know that they may well be in for a figurative Tar and feathering.

However, we have indeed lost the initiative in the theater of strategic politics. Lifetime appointments of judicial appointees by the aforementioned enemies of freedom can, and will, undermine any of our other efforts. Witness the rulings this past year that made such blatant a thing as ex post facto law, something that is profoundly immoral, the law of the land, and that is only one example. Hence, this latest threat in the form of a radical that only obamanites could love.

He has been called “extreme” by some. But to others, he’s beyond extreme… he’s a “Radical’s Radical.”

Whatever he is, he could become President Obama’s next choice for the federal judiciary.

This radical is Judge David Hamilton, and he’s been nominated for a position on the Seventh Circuit Court of Appeals.

Hamilton has made many political enemies on the right, seeing that his politics are to the far left of the political spectrum. Oh yes, judges aren’t supposed to be political, but this one has engaged in quite a bit of leftist activism.

His biggest opponent on Capitol Hill is Senator Jeff Sessions of Alabama, the ranking member of the Senate Judiciary Committee. Based on his analysis of Hamilton, gun owners should be very concerned about a judge who is all to willing to “amend the Constitution.” According to Senator Sessions:

Judge Hamilton stated in a 2003 speech that the role of a judge includes writing footnotes to the Constitution: “Judge S. Hugh Dillin of this court has said that part of our job here as judges is to write a series of footnotes to the Constitution. We all do that every year in cases large and small.” In explaining this statement to Senator Hatch, Judge Hamilton wrote that he believes the Framers intended judges to amend the Constitution through evolving case law.

Of course, we have seen this pattern time and time again. Judges ignore the clear wording of the Constitution — in essence, amending the Constitution through each new case they decide.

The courts then become the vehicle for rewriting the Second Amendment!

Not surprisingly, Judge Hamilton’s politics are to the extreme, far left. He spent a brief stint as a fundraiser for ACORN, the organization that was an aggressive supporter of Barack Obama in the presidential election. In addition to all the evils surrounding ACORN is the fact that the organization has lobbied against Second Amendment rights — as seen by the New Jersey chapter supporting a one-gun-a-month ordinance in Jersey City.

Certainly any judicial nomination put forth by our anti-gun President is suspect, but it’s interesting to note who his chief backer is in the U.S. Senate. It’s none other than Senator Richard Lugar of Indiana, who holds an “F” rating from Gun Owners of America.

Lugar has never failed to support one of Obama’s anti-gun nominations, as evidenced by his votes for Attorney General Eric Holder, State Department lawyer Harold Koh, Supreme Court Justice Sonia Sotomayor and the incredibly wacky Regulatory Czar Cass Sunstein.

On policy questions, Senator Lugar is no better. To wit, he voted against repealing the gun ban in Washington, DC this year.

Considering Hamilton’s extreme track record, it’s no wonder that Senator Lugar — in introducing Hamilton to his colleagues — begged his fellow Senators to ignore the judge’s policy views. Lugar asked them not to base their votes on “partisan considerations, much less on how we hope or predict a given judicial nominee will ‘vote’ on particular issues of public moment or controversy.”

Instead, Lugar asked his colleagues “to evaluate judicial candidates on whether they have the requisite intellect, experience, character and temperament that Americans deserve from their judges….”

In other words, ignore Judge Hamilton’s liberalism and just vote for him because he’s so smart and because he’s such a nice guy!

Judge Hamilton’s rulings have made a lot of enemies on the political right, especially the one in Hinrichs v. Bosma where, according to a November 3 editorial in The Washington Times, he “prohibited prayers in the Indiana House of Representatives that expressly mentioned Jesus Christ… yet he allowed prayers which mentioned Allah.”

Gun owners have much to be concerned about, as well. Anytime a judge who believes in rewriting the Constitution is elevated to sit as an appellate judge, that’s a scary thing — especially given the fact that most cases never reach the U.S. Supreme Court and are, thus, decided at lower levels in the federal judiciary.

ACTION: Please contact your Senators right away and urge them to vote AGAINST Judge David Hamilton. You can use the Gun Owners Legislative Action Center at http://www.gunowners.org/activism.htm to send your legislators the pre-written e-mail message below.

—– Pre-written letter —–

Dear Senator:

I urge you to vote against Judge David Hamilton for the Seventh Circuit Court of Appeals. In addition to opposing his far left views, I don’t appreciate his disdain for the Constitution.

To quote Senator Sessions, the ranking member of the Senate Judiciary Committee:

“Judge Hamilton stated in a 2003 speech that the role of a judge includes writing footnotes to the Constitution: ‘Judge S. Hugh Dillin of this court has said that part of our job here as judges is to write a series of footnotes to the Constitution. We all do that every year in cases large and small.’ In explaining this statement to Senator Hatch, Judge Hamilton wrote that he believes the Framers intended judges to amend the Constitution through evolving case law.”

Of course, we have seen this pattern time and time again. Judges ignore the clear wording of the Constitution — in essence, amending the Constitution through each new case they decide.

The courts then become the vehicle for rewriting the Second Amendment!

Not surprisingly, Judge Hamilton’s written answers to the Senate Judiciary Committee show his lack of understanding regarding the Second and Fourteenth Amendments. While Hamilton cannot ignore what the Supreme Court said in DC v. Heller (2008), he refuses to admit that the individual right to keep and bear arms applies anywhere outside of Washington, D.C. — instead, he just says he will rely on evolving “case law [as] developed in earlier incorporation cases.”

Once again, evolving case law — more often than not — takes us away from what the Constitution actually says.

Please vote NO on David Hamilton.

Sincerely,

Judge Hamilton, a district court judge, is Barack Obama’s nominee to the 7th Circuit Court of Appeals. That very court has cited Judge Hamilton for abusing his power as a judge.

In 1994, the 7th Circuit rebuked Judge Hamilton for denying a Rabbi the right to display a Menorah as part of an Indianapolis holiday display.

In United States v. Rinehart, 2007 U.S. LEXIS 19498 (S.D. Ind.
In United States v. Woolsey, 535 F.3d 540 (7th Cir. 2008), the Seventh Circuit faulted Judge Hamilton for disregarding an earlier conviction in order to avoid imposing a life sentence on a repeat offender.

Remember Judge Sonia Sotomayor and her racist views on how latina woman make better judgements than white men? She was one of several radical Libtards Obama has put into his administration. Now Obama is attempting to put another radical judge into the 7th Circuit Court of Appeals. This radical judge is David Hamilton. What has the Obama nominee done to deserve the label of radical? Below are just a few reasons:

Reason #1- The 7th Circuit Court of Appeals is the same court that cited Judge Hamilton for “abusing his powers as a judge.”

Reason #2- In 1994, the 7th Circuit rebuked Judge Hamilton for denying a Rabbi the right to display a Menorah as part of an Indianapolis holiday display.

Reason #3- Judge Hamilton prohibited the Indiana House of Representatives from praying if Jesus’s name was mentioned, but said praying in Allah’s name was perfectly fine.

Judge David Hamilton is another bleeding heart liberal who has a strong affection for criminals because…you know…they are the real victims.

Reason #4- In United States v. Rinehart, 2007 U.S. LEXIS 19498 (S.D. Ind. Feb 2, 2007), Judge Hamilton used his opinion to request clemency for a police officer who pled guilty to two counts of child pornography. The 32 year old officer had engaged in “consensual” sex with two teenagers and videotaped his activities.

Reason #5- In United States v. Woolsey, 535 F.3d 540 (7th Cir. 2008), the Seventh Circuit faulted Judge Hamilton for disregarding an earlier conviction in order to avoid imposing a life sentence on a repeat offender.

As you can see, Obama loves him some radicals. Look at the ones he surrounded himself with early in life [Frank Marshall Davis] and those he recently has attempted to deny [Rev. Wright, Bill Ayers, ACORN]. Now Obama wants to appoint a radical judge who finds it offensive to invoke the name of Jesus Christ but finds it perfectly fine to pray to Allah. Wake up America. The signs have been right in front of you since Obama entered politics.

Still convinced that they matter, the far right, from RedState to NRO, are rallying to oppose District Judge David Hamilton, whose appointment to the Seventh Circuit is now pending before the Senate. One part of their argument is that Judge Hamilton previously forbade sectarian prayer in the Indiana legislature, but offered to construe prayers to “Allah” as nonsectarian, and therefore permissible. Down with Jesus, up with Allah! While terrifying if true — conservatives and liberals can agree on that, if for different reasons — it’s completely false. Here’s why.

The case is Hinrichs v. Bosma, and the offending post-judgment motion is contained at 2005 U.S. Dist. LEXIS 38330. The relevant text:

The Speaker has also asked whether, for example, a Muslim imam may offer a prayer addressed to “Allah.” The Arabic word “Allah” is used for “God” in Arabic translations of Jewish and Christian scriptures. If those offering prayers in the Indiana House of Representatives choose to use the Arabic Allah, the Spanish Dios, the German Gott, the French Dieu, the Swedish Gud, the Greek Theos, the Hebrew Elohim, the Italian Dio, or any other language’s terms in addressing the God who is the focus of the non-sectarian prayers contemplated in Marsh v. Chambers, the court sees little risk that the choice of language would advance a particular religion or disparage others. If and when the prayer practices in the Indiana House of Representatives ever seem to be advancing Islam, an appropriate party can bring the problem to the attention of this or another court. (Emphasis/coloring added.)

The discussion emerges from Judge Hamilton’s attempt to define what constitutes a “sectarian” prayer in the Christian tradition, and is therefore forbidden. In context, this paragraph is an explanation that the choice of the name of God is irrelevant to the question of whether a prayer is “sectarian” — and a reminder, bolded in my copy, that if a prayer to “Allah” were to “ever seem to be advancing Islam,” it would be a “problem” worthy of his attention.

Admittedly Hamilton’s phrasing was unfortunate — it violates “Rove’s Law,” in the sense that the red-lettered portions of the paragraph can be excerpted from the whole to make it seem like Hamilton is advocating for something that he is not. But the bolded section, which describes Islamic sectarian prayer as a “problem” similar to Christian sectarian prayer, controls, and cannot be divorced from an honest reading of the opinion. If conservatives’ concern is that sectarian prayer ought to be permitted in legislatures, that’s a valid disagreement with Judge Hamilton; the contention that he supports Islamic but not Christian prayer, however, is not.

I get tons of emails every day. Many of them are like some you get as well. You know the kind; they say FWD. Those are usually the ones I delete without opening. Many of the FWDs that I do open come from my friend who keeps her eyes peeled for things that she thinks I need to write about or things that I did write about and she knows attract my interest.

I got one from her last night that made me sit up and take notice. I had heard about this, but I didn’t realize the Senate confirmation vote could come this soon. The subject line said:

Fw: “No to Jesus. Yes to Allah” judge vote imminent!

I didn’t count the other email addresses or how many times it had been forwarded before it finally got to me with a subject line like that. It originated from Mathew Staver, Founder and Chairman of Liberty Counsel.

David Hamilton is currently the Chief Judge of the United States District Court for the Southern District of Indiana. On March 17, 2009, Obama nominated Hamilton to the United States Court of Appeals for the Seventh Circuit. On June 4, 2009, the Senate Judiciary Committee approved his nomination along party lines by a 12-7 vote. On November 10, 2009, Senate Majority Leader Harry Reid (there’s that snake-in-the-grass again) filed for cloture on Hamilton’s nomination, and reached an agreement with Republican leaders to hold a vote on Hamilton’s nomination on November 17, 2009. The Senate Executive Calendar says this about the cloture vote:

UNANIMOUS CONSENT AGREEMENT

David F. Hamilton (Cal. No. 184)

Ordered, That following disposition of H.R. 3082, the Senate proceed to executive session to consider the nomination of David F. Hamilton, of Indiana, to be United States Circuit Judge for the Seventh Circuit; that prior to the cloture vote there be 60 minutes of debate with the time equally divided and controlled between the Chairman of the Committee on the Judiciary (Mr. Leahy) and the Ranking Member (Mr. Sessions); provided further; that the cloture vote not occur prior to 2:15 p.m. on Tuesday, November 17, 2009.

Ordered further, That relative to the cloture motion filed on the nomination of David F. Hamilton, of Indiana, to be United States Circuit Judge for the Seventh Circuit, the mandatory quorum required under Rule XXII be waived.

Sounds fair to me, how about you? Of course, it also means there must a reason. Otherwise, the debate would be allowed to continue and then the Republicans outvoted by the Demorats. And yes, I left the “c” out intentionally. And why is it that Reid says they will vote on this appointment even WITHOUT a quorum present? Hmmm…

I wonder if this information could have anything to do with Reid’s decision?

In American Amusement Mach. Ass’n v. Cottey, (115 F. Supp. 2d 943 S.D. Ind. 2000) Hamilton held that the First Amendment did not prevent the city of Indianapolis from requiring parental consent for children to have access to video games containing explicit sexual content or extreme violence. This ruling was overturned by the Seventh Circuit.

In a November 2005 ruling, Judge Hamilton found that the Indiana state legislature is not permitted to begin its sessions with Christian prayers. In his opinion he wrote that invocations must not use names like Jesus Christ or Christian terms like Savior. He stated that using proselytizing words in invocations at the statehouse violated the United States Constitution. “All are free to pray as they wish in their own houses of worship or in other settings,” Hamilton wrote. “Those who wish to participate in a practice of official prayer must be willing to stay within constitutional bounds.”

Hamilton clarified his position in the above case in a post-judgment motion by saying that prayers may include all “non-sectarian” references to God. He wrote that “[t]he Arabic word ‘Allah’ is used for ‘God’ in Arabic translations of Jewish and Christian scriptures” and that “[i]f those offering prayers in the Indiana House of Representatives choose to use the Arabic Allah, the Spanish Dios, the German Gott, the French Dieu, the Swedish Gud, the Greek Theos, the Hebrew Elohim, the Italian Dio, or any other language’s terms in addressing the God who is the focus of the non-sectarian prayers contemplated in Marsh v. Chambers, the court sees little risk that the choice of language would advance a particular religion or disparage others.” He continued: “If and when the prayer practices in the Indiana House of Representatives ever seem to be advancing Islam, an appropriate party can bring the problem to the attention of this or another court.”

In other words, it would be okay for a Muslim Imam to use the word “Allah” which means “God”, a Spanish priest could use the word “Dios” which means “God”, a German Lutheran minister could use the word “Gott” which means “God”, a person offering a prayer in English using the word “Jesus”, which to some Christians means “God”, is unacceptable because only Christians use the word “Jesus” and it invites proselytizing. (Language translations from Babelfish)

Hamilton is a former vice president for litigation of the Indiana branch of the ACLU.

His resume shows that he was a former ACORN fundraiser.

Hamilton boasts a seven-year-long series of rulings obstructing Indiana’s implementation of its law providing for informed consent on abortion. That obstruction elicited this strong statement from the Seventh Circuit panel majority that overturned Hamilton:

For seven years Indiana has been prevented from enforcing a statute materially identical to a law held valid by the Supreme Court in Casey, by this court in Karlin, and by the fifth circuit in Barnes. No court anywhere in the country (other than one district judge in Indiana [i.e., Hamilton]) has held any similar law invalid in the years since Casey. Although Salerno does not foreclose all pre-enforcement challenges to abortion laws, it is an abuse of discretion for a district judge to issue a pre-enforcement injunction while the effects of the law (and reasons for those effects) are open to debate.

Keep in mind that the very Court of Appeals who overturned this and several other Hamilton rulings, the 7th Circuit, is the very Court Obama has appointed Hamilton to serve.

You can see what a travesty of justice it would be if this man should be confirmed. Your senator and any other senators you can think of need to be faxed with your request that they vote against Hamilton. Remember, their jobs depend on it.

Liberty Counsel will fax your requests for you for a fee at this site. There is also a list of fax numbers and sample texts if you prefer to send your own faxes.

Don’t trust Harry Reid to wait until November 17. Send your faxes this week.
