The Forever 10 diamond is a new cut of diamond.  This diamond is a perfectly round cut diamond with ideal proportions featuring 10 hearts and 10 arrows as opposed to the traditional eight.  It has 71 facets compared to the classic 57 facets.  This provides superior light performance.

This cut of diamond requires severe precision and must be cut by hand by a group of specially trained cutters.  A regular round brilliant cut diamond can be cut in hours but it take days for a Forever 10 to be cut.

Dallas–A shareholders’ class-action lawsuit has been filed against Zale Corp., its chief executive officer and three former executives, claiming the Irving, Texas-based, 1,931-store chain deliberately deceived investors.

The suit, filed on Thursday in U.S. District Court for the Northern District of Texas, alleges that between Nov. 16, 2006, and Oct. 29, 2009, Zale issued “materially false and misleading statements” regarding its turnaround plans, financials and compliance with Generally Accepted Accounting Principles.

“Specifically,” court papers state, “the company failed to properly account for its advertising costs, inter-company accounts receivable, depository bank accounts, federal income taxes and personal property taxes.”

As a result, Zale stock traded at “artificially inflated” prices, court papers state, peaking at $31.42 per share on Dec. 5, 2006.

After two delays the company attributed to needing time to work out accounting issues, Zale issued its fourth quarter and full fiscal year-end 2009 financials on Oct. 29, reporting a net loss of $189.5 million for the year ended July 31, 2009.

In addition, the company had to restate its financials for fiscal years 2005 through the third-quarter 2009 in its Annual Report on Form 10-K, also filed on Oct. 29.

“As a result of the restatement, Zale dramatically reduced its reported earnings for the period by 23 percent for $138.3 million on an aggregate basis to $112.7 million. Zale further reported a material weakness in its internal controls. Moreover, Zale announced that the SEC had initiated an investigation related to Zale’s restatement,” court documents state.

The news, court papers say, sent Zale’s stock plummeting, falling $1.66 per share to close at $4.73 on Oct. 30, a decline of nearly 26 percent, on volume of more than 2.7 million shares.

Zale did not respond to request for comment.

In addition to the company itself, the suit names Zale Chief Executive Officer Neal Goldberg, Rodney Carter, Mary E. Burton and Cynthia Gordon as defendants.

Goldberg has been at the helm of Zale since Dec. 20, 2007, and also served as president of the company from Dec. 20, 2007, to Aug. 5, 2008.

He is the only executive named in the suit who has not resigned from the company within the past two years.

Burton served as a director, president and CEO of Zale Corp. until stepping down on Dec. 19, 2007.

Carter was Zale’s former chief financial officer, and from September 2007 until Jan. 20, 2009, served as the company’s chief administrative officer and executive vice president. He resigned on Jan. 20, 2009.

Gordon was Zale’s senior vice president and controller, and served as interim CFO between January and June 2009. She resigned on June 30, 2009.

The suit alleges that “because of their positions with the company, and their access to material non-public information available to them but not to the public, the individual defendants knew that the adverse facts specified herein had not been disclosed to and were being concealed from the public and that the positive representations being made were then materially false and misleading.”

According to court papers, the class extends to all persons who “purchased or otherwise acquired” Zale stock between Nov. 16, 2006, and Oct. 29, 2009.

Members of the class are seeking damages, including interest.

New York–The Rapaport Group and the RapNet Diamond Trading Network have implemented an immediate trading ban on all diamonds from Zimbabe’s Marange diamond fields, due to what the company describes as “severe human rights violations.”

The announcement comes less than a week after Jewelers of America issued a media release in which it stated its call for the Kimberley Process (KP) to swiftly implement a work plan to address the concerns surrounding Zimbabwe’s non-compliance with the KP Certification Scheme, designed to stem the flow of conflict diamonds.

The Rapaport Group stated in a media release issued Nov. 24 that it believes “blood diamonds” from the Marange fields have been legally exported to the diamond cutting centers with KP certificates and may now be reaching retailers as polished diamonds.

“The Kimberley Process is being used as a fig leaf to cover up human rights abuses in the diamond sector,” Rapaport Group Chairman Martin Rapaport said in the release. “Rapaport calls on the WDC to immediately make public all information it has relating to human rights abuses in the diamond sector, including but not limited to Marange. We call on the World Federation of Diamond Bourses and the International Diamond Manufacturers Association to educate its members about human rights abuses in the diamond sector and to immediately halt the trade in Marange diamonds by publicly naming and expelling members that continue to knowingly trade in Marange diamonds.”

The Rapaport Group said that under its ban, all 4,100-plus RapNet members will be required over the next few days to remove all RapNet listings of Marange diamonds and to confirm upon logging onto the trading network that they will no longer knowingly trade in Marange diamonds or other diamonds involved in human rights abuses.

The group stressed that the ban does not apply to all diamonds from Zimbabwe, but specifically those from the Marange area. The Rapaport Group is also advising rough diamond dealers to review the unique characteristics of Marange rough diamonds published by the Kimberley Process and available online at Diamonds.net/Zimbabwe.

The group says that polished diamond buyers should inquire about the source when offered diamonds with a greenish hue in the G-Z color range, as well as faint green colors. While not all Marange polished diamonds feature greenish hues and not all green diamonds are from Marange, significant numbers of such Marange stones are appearing on the market, the company said.

New York–Tiffany and Co. released its quarterly financials Wednesday, indicating a sales drop of 3 percent from the previous year, but executives said the numbers beat expectations, and that U.S. sales declines are slowing.

Net sales for the third quarter totaled $598.2 million for the quarter, which would have been a 5 percent drop in sales, and a 6 percent drop in same-store sales if exchange rates were held constant.

“We were pleased to see that the rate of sales declines in the U.S. lessened as the quarter progressed,” Tiffany Chairman and Chief Executive Officer Michael Kowalski said in a statement issued Wednesday. “At the same time, many countries in Asia-Pacific and Europe achieved considerably better-than-expected sales. These results, combined with ongoing expense restraint, contributed to earnings above our prior expectation.”

In the nine month, year-to-date period that ended Oct. 31, 2009, net sales of $1.728 billion were 14 percent below the prior year. If exchange rates were held constant, net sales and comparable store sales would have fell 13 percent and 15 percent respectively.

Gross margin (gross profit as a percentage of net sales) totaled 54.8 percent in the third quarter and 55.2 percent in the year-to-date, compared with 56.3 percent in the previous year’s third quarter and 57.1 percent in the prior year’s year-to-date financials. Tiffany blamed the declines primarily on “higher product costs.”

In the Americas, sales of $303.5 million in the third quarter and $887.4 million in the year-to-date were, respectively, 9 percent and 21 percent below prior year levels.

Comparable U.S. store sales declined 10 percent in the third quarter (but fell only 5 percent in the month of October) and 25 percent in the year-to-date. Sales in the New York flagship store declined 8 percent for the quarter and 27 percent year to date, while comparable U.S. branch store sales declined 11 percent for the quarter and 24 percent for the year to date. During the quarter, the company opened stores in Roseville, Calif., and Seattle.

Combined Internet and catalog sales in the U.S. market declined 9 percent in the quarter and 11 percent year-to-date, the release said.

In global markets outside the Americas, Tiffany’s fared better.

In Europe, sales increased 12 percent to $65 million in the third quarter and sales of $188.9 million in the year-to-date were equal to the prior year.

In the Asia-Pacific region, sales increased 10 percent to $225.8 million in the third quarter due to improved results in most countries, the release said. Sales of $639.2 million in the year-to-date were equal to last year.

“We believe that Tiffany has performed remarkably well despite the dramatic downturn in consumer spending,” Kowalski said. “We have continued to invest in the business and have not compromised any of our brand principles. At the same time, we have taken the steps necessary to ensure healthy levels of profitability and liquidity.”

He added that the company is confident in the “long-term growth potential of Tiffany,” driven by new store, market and product opportunities in competitive environment.

Citizen watches are yet another famous name in luxury watches. These were first manufactured in 1918 by a Japanese company, Shoshoka Watch Institute, which changed its name in 1930. To this day, Citizen watches are considered some of the finest and most accurate timepieces in the world.
