<p>Recently, at both the state and federal level, a bill has been introduced to randomly test welfare recipients for drugs use. This bill would be put into action to prevent people on governmental assistance from abusing the programs and using the money to purchase and use drugs. Those on assistance would be required to take a pee test and the tests would be administered at random. These random tests would be given to around twenty-percent of those on welfare. Those who have been in favor of the bill are Republicans at both the state and federal level.</p>

<description><![CDATA[Hello Thursday!!  These last couple of days have been somewhat of a dream, a dream where I don]]></description>
<content:encoded><![CDATA[<p>Hello Thursday!!  These last couple of days have been somewhat of a dream, a dream where I don&#8217;t actually get to sleep at all.  Why?  Well, I got a new job!!  I think it is finally hitting me.  I have a new job, better pay, and a foot in the door with UM.  But most importantly I think the big man/woman upstairs is pushing me towards my path in a very seamless way&#8230; or I really hope.</p>
<p>I had a plan in my head, one that I had consulted with my parents and close friends.  I was going to quit my current job in July, and either hopefully be heading off to grad school (Please someone say yes to to me!!), or go and intern (most likely for free) at a lab to be a more attractive candidates for when I apply again (let me tell you, the people who apply for my program are freaking amazing people who have had a lot of great opportunities to work with some incredible people).  But during this time I have also been applying for research positions here and there, trying to gain more experience. Well, Miami is not the place for this really.  The only places where research is done is at the universities, and they are looking for post-docs and 3-5 years experience.  I have neither, but this in no way deters me from applying.  Well, I have received called backs and they quickly go sour when they see I don&#8217;t have years of experience (which really irritates me because they have my resume!  Why do they play with my emotions?? Rat bastards&#8230;), this quickly ends our phone conversation.  But last week I received a call from HR at UM.  They saw I applied for a research position and while, she told me I didn&#8217;t look like a strong candidate there I did have a lot of experience in coordination of benefits yada yada (<em>Seinfeld</em>). Doreen (or as I kept calling her in my heard, Dory)  wanted to pass my resume to the Behavioral Health department for a position that I would fit perfectly in.  I said sure, and then she told me that it was only a temporary position&#8230; three months at the very least.  PERFECT!  Things (at least in my head) started to fall in place!   What are the odds of this all happening so wonderfully?</p>
<p>I was offered the job immediately and thus began my mad dash to get all the crazy requirements done before I start.  I have been given more paperwork than I have for any other job, I have been given a shot, and for the first time in my life made to pee in a cup.  Thank the good man/woman upstairs that I have not indulged in any recreational activities in the last 8 months.  I passed my TB test, and no call from the illegal drug people, so I am good!  I just have to finish one more long online packet that I can do this weekend and my start date is the 11th!</p>
<p>My current employer (their competition) is very happy for me, it really is a step up for me.  But the only problem is that they want to give me a going away party.  I don&#8217;t really like parties that are thrown for me. I feel uncomfortable, I feel like I am not that important to have a party <em>just</em> for me.  I told my supervisor to please not do that.  I&#8217;d rather have everyone do one shot and call it a day (but I couldn&#8217;t say that).  I know it&#8217;s weird, I know, but this is part of my psychosis.  I want to just run, leave quietly, no party.</p>
<p>I am very hopeful that I will get accepted to school soon.  I am working on two more applications&#8230; let&#8217;s see how it goes!  Till then, I will try and figure out how to not offend my current employer when I talk to them again today when I ask for just a little bye, no party.</p>

<content:encoded><![CDATA[<p>I briefly mentioned in a (serious) post on Monday, April 1, that the Kansas state legislature was considering repealing the current state statute that bars the local government from forcibly quarantining HIV+ Kansans. That&#8217;s a <a title="Aksarbent" href="http://aksarbent.blogspot.com/2013/03/kansas-bill-allowing-hivaids-quarantine.html" target="_blank">serious, actual thing that&#8217;s still happening</a>. Kansas&#8217; Department of Health and the Environment (or KDHE) is apparently partying like it&#8217;s 1989, complete with the bigotries we were supposed to all pretend were never a force in US politics.</p>
<p>Hilariously, though, the more you observe the context of this decision the more terrifyingly insightful it is. You see, it doesn&#8217;t make much sense to end a ban on quarantining people if such a quarantine, even a partial one, wasn&#8217;t being considered. But wouldn&#8217;t that be a lot of Kansan taxpayers&#8217; money to spend on a medically inaccurate view of how to stop the spread of HIV? Well, yes, yes it would, but apparently it&#8217;s one that the Republican governor and legislature of Kansas are still considering.</p>

<p>Of course, that wasn&#8217;t their tune in the past couple of months when it came to offering preventative care to the <a title="NECN" href="http://www.necn.com/11/09/12/Coalition-calls-for-Medicaid-expansion-i/landing_nation.html?&#38;apID=a1d76485a6ee4415a0f4f1329de0f5b3" target="_blank">130,000 Kansans without insurance</a> in the form of a state-administered medicaid expansion. No, the head of the KDHE farmed out the analysis of the cost of that to a private firm that gave him and the rest of the state a<a title="Lawrence Journal World - Scott Rothschild" href="http://www2.ljworld.com/news/2013/feb/08/statehouse-live-brownback-administration-releases-/" target="_blank"> page and half report</a> declaring that the cost of that would be over a billion dollars over the next ten years. Of course, there&#8217;s the option available to Governor Brownback to yield to the federal government and allow it to set up the exchange, but he&#8217;s apparently not gotten around to that have yet to announce whether he&#8217;ll select either of those choices.</p>
<p>So to recap: the freedom of the state to quarantine HIV+ people is something to be discussed and the cost is apparently no object. Meanwhile, tens of thousands of people are continuing to go without basic medical insurance but the cost of Kansas doing something is too much and asking the federal government to assist is not even worth discussing.</p>
<p>Actually, this isn&#8217;t the first time such a strange bundle of issues has come before the Kansas government and led to them simultaneously claiming that invasive, costly, and honestly useless programs are completely reasonable and that more effective medical programs are just too much to put on the government&#8217;s dime, especially since they&#8217;re so questionable. In 2011, Governor Brownback <a title="RH Reality Check - Kari Ann Rinker" href="http://rhrealitycheck.org/article/2011/11/16/at-a-forum-meant-only-to-display-his-contempt-for-the-poor/" target="_blank">invited the Heritage Foundation</a> to a public conference about how to help alleviate the lot of Kansan children growing up in poverty. Instead of actually providing family planning services, creating additional programs to assist single mothers in avoiding or mitigating the affects of poverty, or otherwise trying to actually help those families, Brownback found room in the budget to host an event for a political commentator to lecture them and insist that they should just get married.</p>
<p><a title="Kansas City Star - Brent Wistrom" href="http://www.kansascity.com/2013/03/26/4145524/kansas-house-advances-bill-establishing.html" target="_blank">On March 26</a>, the Kansan House passed an additional regulation, that if a social worker has &#8220;reasonable suspicion&#8221; (<a title="Tim Wise" href="http://www.timwise.org/2010/05/reflections-on-racism-and-reasonable-suspicion-immigration-arizona-and-anti-latino-bias/" target="_blank">hmmm</a>) that a welfare recipient is abusing controlled substances, they can report them and make their add contingent on a positive drug test. All the evidence suggests that this <a title="Atomic Citizen - EJ Johnson" href="http://www.atomiccitizen.net/?p=130" target="_blank">won&#8217;t be cost effective</a>, to say nothing of it creating a (probably racist and classist) culture of anxiety over access to necessary assistance. But after multiple years of debate, the bill seems to be heading towards law, because Kansas both has the money to test anyone on welfare deemed &#8220;suspicious&#8221; and the dire need to cut those people from the welfare rolls because of its <a title="NPR - Stephen Koranda" href="http://www.npr.org/2013/01/17/169644088/kansas-bets-on-tax-cuts-to-spur-economic-growth" target="_blank">projected budget shortfalls</a>.</p>
<p>Or maybe, just maybe, a lack of funds is a pretext to deny care that disappears down the memory hole when it comes to the nightmarish idea of quarantining HIV+ people.</p>

<p>My very first <a href="http://ddoublep.tumblr.com/post/6426207431/a-question-of-decency" target="_blank">blog post</a> was about this very question of decency in how we deal with the least among us, and has remained a personal interest. Welfare as it&#8217;s typically defined in policy terms is the state-federal program known as Temporary Assistance for Needy Families (TANF), which replaced Aid to Families with Dependent Children (AFDC) in the &#8217;96 welfare reform effort. Basically the federal government block-grants funds to the states for assisting low-income individuals and families, to which states must also contribute funds, with these four specific imperatives:</p>
<blockquote><p>States can use federal TANF and state MOE dollars to meet any of the four goals set out in the 1996 law:  “<strong>(1)</strong> provide assistance to needy families so that children may be cared for in their own homes or in the homes of relatives; <strong>(2) end the dependence of needy parents on government benefits by promoting job preparation, work, and marriage;</strong> <strong>(3)</strong> prevent and reduce the incidence of out of wedlock pregnancies and establish annual numerical goals for preventing and reducing the incidence of these pregnancies; and <strong>(4)</strong> encourage the formation and maintenance of two parent families.”</p></blockquote>

It&#8217;s worth noting two things here; First, that beyond being the only federal &#8216;welfare&#8217; program that still offers cash assistance, TANF also sets a lifetime maximum of sixty months (five years, consecutive or not, which most states emulate although about a third set limits lower) and the second is the directive I emphasized in the quote, that TANF &#8220;end the dependence of needy parents on government benefits by promoting job preparation, work, and marriage.&#8221; I get the impression that most folks have no idea about the former and Republicans keep forgetting they already won the war on government dependency (unless you <a href="http://www.newrepublic.com/article/112741/republicans-new-welfare-queens" target="_blank">expand the definition</a> of welfare beyond any useful meaning) vis a vie the latter.</p>
<p>I think this is critical context for understanding how particularly cruel these additional state requirements are in Tennessee and elsewhere. Legislators and advocates are essentially telling poor residents that destitution isn&#8217;t bad enough for them, that their stigmatization isn&#8217;t sufficiently codified into law, that the whole TANF process isn&#8217;t <a href="http://www.motherjones.com/politics/2009/01/brave-new-welfare" target="_blank">demeaning enough</a> in your effort to gain benefits that are already &#8220;<a href="http://www.cbpp.org/cms/?fa=view&#38;id=3625" target="_blank"><i>50 percent</i> of the poverty line in <i>all</i> states</a>.&#8221; If you&#8217;re at the bottom of the socioeconomic ladder and your child isn&#8217;t doing well in school, Tennessee wants to punish you by leaving you poorer. If you&#8217;re impoverished and use illegal drugs <a href="http://inthesetimes.com/article/14761/welfares_war_on_drugs/" target="_blank">many states want you to stay </a>indigent and looking for psychotropic escape. Such efforts do not &#8220;strengthen welfare,&#8221; but effectively represent state-imposed floggings meant to dissuade participation. <p>Vaughan hopes all county players remain clean after witnessing the consequences of drug abuse</p>
<p>Former England captain Michael Vaughan has announced that all county players should have learnt some serious lessons from the tragic death of Surrey batsman Tom Maynard.</p>
<p><!--more--></p>
<p>Vaughan welcomed the England and Wales Cricket Board&#8217;s (ECB) announcement of increasing the number of drug tests done during the season and off the field as well.</p>
<p>Vaughan also hopes that Maynard&#8217;s death will &#8220;frighten&#8221; other county players who even consider using recreational drugs.</p>
<p>During an inquest into Maynard&#8217;s death, it was revealed that the Surrey batsman had been three times over the legal alcohol limit and had been a habitual cocaine and ecstasy user for a few months prior to his death.</p>
<p>Maynard was found dead near Wimbledon Park tube station an hour after fleeing from authorities, who stopped him for &#8220;driving erratically&#8221; in the early hours of June 18 2012.</p>
<p>The coroner at the inquest stated that it was impossible to tell whether Maynard had been killed by electrocution after falling on the tracks, or whether the impact of the train hitting his body has resulted in his death.</p>
<p>&#8220;There will be players in cricket who have taken recreational drugs and are still doing it, but I hope Tom Maynard&#8217;s tragic story will make them stop,&#8221; Vaughan wrote in his column for the <em>Daily Telegraph</em>. &#8220;There are around 400 professional cricketers in England and it would be naive to think Tom&#8217;s is an isolated case. There are bound to be more who have taken drugs in the past or are still doing it now.</p>
<p>&#8220;The England and Wales Cricket Board is going to introduce more testing for recreational drugs and that will frighten a few into cleaning up their acts.&#8221;</p>
<p>Maynard&#8217;s death has been tough on the entire Surrey squad, especially captain Rory Hamilton-Brown, who was Maynard&#8217;s flatmate.</p>
<p>Hamilton-Brown was distraught after the death of his best friend and wasted no time in stepping down as captain at the end of last season before joining Sussex.</p>
<p>In an attempt to make up for their losses, Surrey signed South Africa captain Graeme Smith to a three-year deal and have even recruited the services of former Australia skipper Ricky Ponting for June and July this year.</p>
<p>Vaughan noted that the addition of two veterans would be extremely beneficial for all the younger players in the Surrey squad.</p>
<p>&#8220;There was a lack of those players at Surrey 12 months ago but next summer they will have Graeme Smith and Ricky Ponting,&#8221; Vaughan wrote. &#8220;Two men who are exactly the right kind of role models for young kids making their way in cricket.&#8221;</p>
<p>England batsman Ian Bell also voiced his support for the increased frequency of drug testing, and told the <em>BBC</em>: &#8220;Other sports are doing it. It&#8217;s important what has happened doesn&#8217;t happen again.&#8221;</p>

<p>Avertest has offices in Missouri and California, and does tests not only for probation officers but also for companies checking on their employees.  Runge says he&#8217;s seen lots of these prosthetic devices, known as Whizzinators, in this time with the company, in fact, as many as a few a month.</p>
<p>&#8220;The industry has been seeing these types of devices, whether it&#8217;s a Whizzinator or other type of devices used to adulterate or tamper with drug testing samples for years,&#8221; he said.</p>
<p>Though the higher-end devices go for about $150 each, he says they&#8217;re pretty easy to spot, they&#8217;re often plastic, and don&#8217;t look particularly authentic. They strap on, and have a small box that holds the urine, and its kept warm by a small heating device.</p>
<p>&#8220;It&#8217;s ususally&#8230;the people that are going to try to use these things are people brand new to the criminal justice system,&#8221; Runge said.</p>
<p>In other words, using one is a rookie mistake. In fact, falsifying a urine test while on probation could lead to criminal charges, which <a href="http://stlouis.cbslocal.com/2013/03/29/lake-st-louis-man-accused-of-using-prosthetic-penis-during-drug-test/#at_pco=cfd-1.0">KMOX reported on Friday morning</a>.</p>

<content:encoded><![CDATA[<p>ST. CHARLES, Mo. (AP) — A man accused of using a prosthetic penis to try to pass a drug test has been arrested in eastern Missouri.</p>
<p>Authorities say 34-year-old Sydney Levin was submitting a urine sample last week as part of his probation when an officer allegedly spotted him using a prosthetic known as a <strong>Whizzinator</strong>. The prosthetic is advertised as a &#8220;discreet&#8221; device that includes synthetic &#8220;medical grade urine.&#8221;</p>
<p>KMOV-TV reports that Levin, of Lake St. Louis, was charged last week with possessing a forging instrument. He was arrested and released after posting $25,000 bond. He pleaded not guilty Monday.</p>
<p>Authorities say Levin&#8217;s probation required him to submit a urine sample as part of drug test. He was on probation for possession of a controlled substance and felony stealing.</p>

<content:encoded><![CDATA[<p>Years ago, many states attempted to require drug testing for all welfare beneficiaries and the majority of the laws were struck down or are currently in litigation, Florida as one example.  States, including Michigan, have smartened up (one could say) and, rather than requiring blanket searches, are considering legislation that would require a questionnaire that includes questions regarding drug use.  Applicants who indicated prior or current drug use would give law enforcement reasonable suspicion to drug test the individual and they would then be denied welfare benefits.  The significant difference between this new breed of proposed legislation and the previous is blanket drug testing has been ruled unconstitutional, notwithstanding special circumstances, which have consistently been ruled not to exist in the context of welfare benefits.  The new laws would give the executive reasonable suspicion and therefore would not be a blanket policy.  The reasonable cause would allow a warrant to be issued and drug testing to be within the confines of the Fourth Amendment.</p>
<p>Currently,  three states require drug testing <a href="http://www.cga.ct.gov/2013/rpt/2013-R-0100.htm">based on reasonable cause for welfare beneficiaries</a>.  Missouri, Utah, and Arizona currently require suspicion-based drug testing, while many others, including Michigan, are considering similar legislation.  Michigan&#8217;s legislature passed legislation in 2011 requiring the Department of Human Services (&#8220;DHS&#8221;) to <a href="http://media.mlive.com/saginawnews_impact/other/dhsreport.pdf">report </a>on the feasibility of such a program.</p>
<p>In the report, DHS indicated it would develop a procedure for determining suspicion for drug use by either requiring questionnaire or analysis by an expert in drug abuse.  The report concluded that such a program would be feasible despite the inability to estimate cost of the program, relying on other states&#8217; estimates of $100,000 to $20 million dollars.</p>
<p>But the real question is: would the program be constitutional?</p>
<p>MIssouri&#8217;s law has yet to implement a procedure for welfare recipients.  The constitionality will boil down to whether the procedure is individualized enough and satisfies the requirements of reasonable cause.  The future of Michigan&#8217;s proposed law is still tenuous, but it too will have to meet the standards of probable cause.</p>

<p dir="ltr">Miami Marlins prospect, Kolby Copeland, has been suspended 50 games for refusing to take an offseason drug test. Copeland, who is only 19, was drafted in the 3rd round out of high school last year. Under baseball’s minor league drug program, refusal to comply with testing is considered the same as a positive result in relation to discipline. Copeland is 1 of 8 suspensions this year under the minor league program. Going into the draft, Baseball America’s scouting report noted that Copeland “sat out the first part of high school season serving a suspension stemming from an underage drinking and driving arrest.”</p>

<p dir="ltr">London Olympic gold medalist from Turkey, Asli Cakir Alptekin, has tested positive for a banned substance. No official announcement of this has been made by either the World Anti-Doping Agency (WADA) or the International Association of Athletics Federation (IAAF). If an announcement is made, Alptekin could face a lifetime ban. In 2004, Alptekin already served a two-year ban for a precious doping offense. It’s been reported that many in the track world found her 2012 breakthrough to be suspicious. An announcement from the organization is still pending.</p>
<p dir="ltr"><strong>Lavar Johnson, Alex Caceres, Riki Fukuda</strong></p>
<p dir="ltr">This month, three UFC fighters have failed drug tests. Lavar Johnson failed a test for testosterone. He has not yet been suspended. At a show in Tokyo, 2 more fighters tested positive for other drugs after the UFC administered a drug test to all 22 fighters. Alex Caceres tested positive for marijuana and Riki Fukuda tested positive for three banned stimulants. Caceres must attend rehabilitation classes and pass a drug test before he can fight again and is suspended for 6 months. Fukuda has been released from his UFC contract, but UFC Director described this as a coincidence and not as a result of the test.</p>
