<content:encoded><![CDATA[<div class='snap_preview'><p><a href="http://dui-dc.com" target="_blank">Drunk driving</a> accidents can have life-altering consequences for all parties involved. In the United States each year, over 13,000 Americans die in <a href="http://dui-dc.com" target="_blank">drunk driving</a> related accidents. In order to combat this problem, several innovations have been suggested to protect <a href="http://dui-dc.com" target="_blank">drunk drivers</a> from getting on the roads. One of the most popular, is the installed <a href="http://www.dui-dc.com/field-sobriety-testing.html" target="_blank">breathalyzer systems</a> in cars that would prevent an individual from driving should they be intoxicated.</p>
<p>This new bill is currently pending before Congress. If passed, it would need all people convicted of <a href="http://dui-dc.com" target="_blank">driving while intoxicated</a>- <a href="http://dui-dc.com/definitions.html#DefinitionsA" target="_blank">DUI</a>, <a href="http://www.dui-dc.com/" target="_blank">driving under the influence</a>- <a href="http://dui-dc.com/definitions.html#DefinitionsA" target="_blank">DUI</a>, or <a href="http://www.dui-dc.com/" target="_blank">operating under the influence</a>- <a href="http://dui-dc.com/definitions.html#DefinitionsA" target="_blank">OWI</a> to install the <a href="http://www.dui-dc.com/field-sobriety-testing.html" target="_blank">breathalyzer system</a> in their cars. In order to start the vehicle, the person must blow into a <a href="http://www.dui-dc.com/field-sobriety-testing.html" target="_blank">breathalyzer test</a> installed into the car. If passed, the car will start. If the <a href="http://www.dui-dc.com/field-sobriety-testing.html" target="_blank">breathalyzer test</a> reads higher than the legal limit, the car will not turn on.</p>
<p>Currently, there are 150,000 interlock systems installed throughout the United States. However, this generally applies to people who have multiple convictions for <a href="http://www.dui-dc.com/" target="_blank">driving while intoxicated</a>, <a href="http://www.dui-dc.com/" target="_blank">driving under the influence</a>, or <a href="http://www.dui-dc.com/" target="_blank">operating under the influence</a>. However, anti-<a href="http://www.dui-dc.com/" target="_blank">drunk driving </a>organizations such as Mothers Against <a href="http://www.dui-dc.com/" target="_blank">Drunk Driving </a>(MADD) intend on taking the law a step further with the current pending legislation.</p>
<p>If this bill passes in Congress, then states would not be required to comply with the measures intended to prevent <a href="http://www.dui-dc.com/" target="_blank">drunk driving</a>. Should they decline to adopt the new policies, their highway funding from the federal government will be cut significantly. However, only eleven states  have enacted legislation that requires individuals convicted of <a href="http://www.dui-dc.com/" target="_blank">drunk driving</a> to have an interlock system in their car. Generally, this is a provision  so the convicted person does not have to give up all driving privileges, but at the same time, does not <a href="http://www.dui-dc.com/" target="_blank">drive while intoxicated</a> a second time.</p>
<p>Critics of the new bill say that the pending legislation goes too far. According to Sarah Longwell, the managing director of the American Beverage Institute, if this bill passes it could open the door to implementing interlock systems on <em>all</em> cars, not just those of convicted <a href="http://www.dui-dc.com/" target="_blank">drunk drivers</a>. This could make participating in American past times difficult. For example, Longwell reminds the public: &#8220;If you go to the ball game, and enjoy one beer, you would not be able to drive home,&#8221; regardless of whether the person was intoxicated or not.</p>
<p>Supporters of MADD and other anti-<a href="http://www.dui-dc.com/" target="_blank">drunk driving</a> organizations are realistic about the situation. It is very likely that technology advanced enough to be installed in every car is over a decade off. However, current <a href="http://www.dui-dc.com/field-sobriety-testing.html" target="_blank">breathalyzer</a> technology can make significant improvements immediately. New Mexico has implemented the interlock system on cars of convicted <a href="http://www.dui-dc.com/" target="_blank">drunk drivers</a>. Since that time, <a href="http://dui-dc.com/definitions.html#DefinitionsA" target="_blank">DUI</a> related fatalities in the state of New Mexico have dropped over thirty-five percent. This provides evidence that installing interlock systems can cut the number of injuries and/or deaths sustained as a result of <a href="http://www.dui-dc.com/" target="_blank">driving under the influence</a>.</p>

Thirty-six year-old producer and director, Alexandra Kerry was stopped by Los Angeles police while driving in Hollywood. Because they suspected her of <a href="http://dui-dc.com/" target="_blank">driving while intoxicated</a>, they took her down to the police station and administered a <a href="http://dui-dc.com/definitions.html#DefinitionsD" target="_blank">breathalyzer test</a>. Although the results showed that Kerry was under the legal blood alcohol content limit, law enforcement officials still booked her on <a href="http://dui-dc.com/" target="_blank">drunk driving</a> charges! Possibly, this is evidence that the crusade against <a href="http://dui-dc.com/" target="_blank">drunk driving</a> can and does over step its boundaries.</p>
<p>The reason that Los Angeles police officers stopped Kerry that day was because they claimed that she had &#8220;violated a traffic law which got their attention.&#8221; She was arrested after officers pulled her over. The results of Kerry&#8217;s <a href="http://dui-dc.com/definitions.html#DefinitionsD" target="_blank">brethalyzer test </a>showed a 0.6 percent&#8211; which is 0.2 percent lower than the California legal limit. Then, what was her actual crime? Driving with expired tags.</p>
<p>According to an L.A. department spokesperson, Alexandra Kerry was ultimately arrested because in the state of California, one can be prosecuted for a <a href="http://dui-dc.com/definitions.html#DefinitionsA" target="_blank">DUI</a>, even if they do not surpass the legal limit. It is possible to be arrested for <a href="http://dui-dc.com/" target="_blank">drunk driving</a> if law enforcement officials suspect that the individual has irresponsibly driven their vehicle due to alcohol.</p>

<p style="text-align:center;">“<strong>TMZ has obtained police dash cam footage showing rapper Nas failing several DUI field sobriety tests back in September. He was cleared of the charges &#8212; but does he look sober to you? But you can see Nas wobble during a balance test and take the wrong number of steps during the &#8220;walk the line&#8221; test &#8212; yet still, authorities decided it wasn&#8217;t enough evidence to convict.”</strong></p>

<p style="text-align:left;">Nas also admitted to smoking marijuana the night of his arrest, but was later on excused from the charges after his drug test came back negative:</p>

<title><![CDATA[License effects for breathalyzer refusal]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p> In a previous post I talked about the breathalyzer process, but how does your license actually get suspended. Remember the more you understand the process, the better you will be able to protect yourself.</p>
<p>During the booking process the police will ask if you want to take a breathalyzer. Then the police will show you a form. On the form you can sign that you want to accept the breathalyzer or you choose to refuse the breathalyzer. Not signing the form is considered a refusal. Asking for a lawyer prior to signing the form is considered a refusal. Failing to properly administering breath samples could be considered a refusal. Agreeing to give breath samples and later refusing is also considering a refusal.</p>
<p>First offense. Okay, so say if this is the first time you were ever arrested for suspicion of OUI. You decide not to the breathalyzer, what happens to your license? Well if you decide to refuse the breathalyzer and this if your first time you license will be suspended for 180 days. If you are under the age of 21 and you refuse a breathalyzer, your license will be suspended for 3 years.</p>
<p>Second offense. The analysis for a second offense gets trickier for the purpose of license suspension for breathalyzer refusal. If it is your second offense and you refuse the breathalyzer, your license will be suspended for 3 years for the most part. However, there are different situations that can change the amount of time your license is suspended. If a person was charged with OUI with serious bodily injury for their first offense and then charged with an OUI second offense, then their license will be suspended for 10 years. If a person was charged with OUI manslaughter by motor vehicle, or vehicle homicide, then their license will be suspended for life.</p>
<p>Third offense. If you have two OUIs on your record already and refuse a breathalyzer then your license will be suspended for five years.</p>
<p>Fourth offense. If you have three prior OUIs on your record and refuse a breathalyzer, then your license will suspended for life.</p>
<p>That is a basic summary of license suspension, but the actual analysis is more complicated. It is not uncommon that the DMV or the police incorrectly categorize the refusal. There may also be different ways for you to get license relief. OUIs are serious and you should talk to an attorney right away if you have refused a breathalyzer.</p>

As the Holiday Season hits Arizona, a select few members of the community will be left wondering where the state budget is left teetering, balancing in limbo. For other citizens of the state this time of the year is all too familiar of the flatfeet on the beat who will be in policing the streets incorporated with Arizona Cardinals franchise, the state DUI Task Force, BACIC (Beverage Alcohol Community Information Council)http://www.bacicarizona.org/ridehome/ and MADD (Mothers Against Designated Drunkards).<br />
“Drive hammered&#8211;Get nailed, Knuckleheads,” was probably the most memorable of many sentiments made during a DUI awareness campaign held at 17th Avenue, Between Adams and Jefferson in front of the state capitol, Tuesday, December 1, 2009.<br />
From December 16th to January 3rd, the Highway Traffic and Safety Administration noted that they would be in tenfold the operating capacity, apprehending drunk drivers from such ‘senseless tragedies as Elaina’s. During the meeting a family mourned the loss of their daughter to a drunk driver, severing ‘Elaina’s life just short of her fourth birthday, where she had ultimately died at St. Joseph’s.</p>

<p>Governor Jan Brewer was also in attendance of the event, where she held an open press conference for fifteen-odd minutes after the DUI awareness social. After taking questions from  Howie Fischer of ‘Capitol News’, Brewer pledged that “In the huge crisis that Arizona is in…the state will be working hard this month to balance the budget.” According to Brewer this was going to be difficult for those “not federally mandated” once “You cut only those that are not federally mandated.”<br />
In further thought Brewer also addressed that she “hates photo-radar” and in her words “Would like to have a debate on it.”</p>

<p>Last March 2009, the former Mrs. David Hasselhoff pleaded no contest to the charge of driving under the influence and was sentenced to probation.</p>
<p>The driver of the car Bach crashed into, Mitchell Paulson is now suing Ms. Bach for damages after she injured him when she drove under the influence.</p>
<p>Under the law in California, a second DUI conviction equals mandatory jail time.</p>

He even failed the sobriety walking test. But lucky for Nas his drug test came back negative and it looks he&#8217;s gonna be off the hook. Gotta love science. Phew! <p>Nas was busted for DUI near his home in Georgia. Nas was busted by Henry County cops on September 10, 2009. Law enforcement tells us he was arrested, booked and charges are pending. Nas is in court today in Los Angeles for his divorce from Kelis &#8212; and if custody becomes contentious, the DUI could be a factor.</p>
<p>The police report, which says, &#8220;Mr. Jones had a green tongue with raised taste buds and his pulse was raised to 116 beats per minute.&#8221; The arresting officer says he observed &#8220;eyelid tremors in both eyes and body tremors.&#8221; Cops say the car smelled of &#8220;raw marijuana.&#8221;</p>
<p>Nas told officers he had been smoking weed at his friend&#8217;s house before he was busted.</p>
<p>Nas flunked one of the field sobriety tests &#8212; the walking test &#8212; by taking the wrong number of steps.</p>
<p>Charges are currently pending.</p>

<p>Recently, a car driven by 19-year-old male collided with a minivan.  He already had prior DUI cases.  He was drunk driving and his license was suspended after the car accident.  It seems like he never learned a thing or two from the previous accidents.  The last accident took away his life after he ran pass a red light and was over the speed limit.  It also killed his wife and his two children.</p>
<p>Cases like these are rampant.  It seems like drivers are become more reckless.  The news on car accidents because of drunk driving and the number of injuries or fatalities from these does not seem to stop them from getting behind the wheels and driving.</p>
<p>Even celebrities are often caught by the police for exceeding the BAC limit which is .08.  Chloe Kardashian and Stephanie Pratt are some of the celebrities who were penalized for this.  They were also sent to alcohol rehabilitation programs to learn that drunk driving is wrong and can cause someone’s life.</p>
<p>A driver should learn responsibility when they own a car.  It cannot be simply just driving around the city and not know what the laws are.  It is a simple common sense not to put anyone’s life in danger when they are driving.</p>

<p>Police were called to the scene of a minor accident involving the female driver, who was screened before she was taken to the hospital. The results of her blood test revealed a <a href="http://drunkdrivinglawyer.com">blood alcohol concentration </a> (<a href="http://drunkdrivinglawyer.com">BAC</a>) of 0.385, the story said. As a new driver, her legal alcohol level was 0.02.</p>
<p>A blood alcohol level of 0.55 is usually considered fatal, but the highest level ever recorded by a survivor is 0.914, the story said.</p>

It cannot be age because both are of an age to get a DUI. It must be the money. I get it! College athletes are not paid! Right!!! Maybe keeping your job might have something to do with it as a NFL coach is more likely to lose it if he were to follow thru and discipline a player. If character matters then the level of the athletic playing field should not matter.</p>

<p>The Florida Gator<strong> </strong>football team defensive player was caught slumped over the wheel of his car, sleeping in the middle of an intersection while the light was green.</p>
<p>According to the police, last year&#8217;s national championship game defensive MVP not only failed the field sobriety test but also refused to take a breath test before he was taken into custody.</p>
<p>Dunlap has been suspended indefinitely by his team. His arrest couldn’t have happened at a worst time as the Gators are four days away from playing the most important game of the season and Dunlap is one of the team’s best defensive players.</p>

<p>Defensive end Carlos Dunlap was arrested for driving under the influence at 3:25 in the a.m on Tuesday morning. The first-round NFL draft prospect was discovered by police, passed-out drunk and hugging the steering wheel of his 2000 Chrysler, at a green light not far from campus. He failed a sobriety test on the scene, was arrested and later released without posting any sort of bail. </p>
<p>I could only imagine the position that Urban Meyer is in right now. He has to discipline his best defensive player, before the biggest game of the year. I could only imagine that Meyer slaps Dunlap on the wrist and tells him that what he did was stupid and irresponsible. </p>
<p>I wouldn&#8217;t expect any kind of punishment to come out of this incident. Dunlap&#8217;s 35 tackles and 8.5 sacks are a valuable addition to stopping Alabama&#8217;s offense this weekend. </p>
<p>Dunlap put a lot of innocent lives at risk with the decision he made. But as we all have seen before (Brandon Spikes), winning is far too important to the Florida coaching staff than punishing players for their negligent behavior. </p>

<p>Early Tuesday, Florida Defensive End, Carlos Dunlap was found passed out drunk in the driver&#8217;s seat of his vehicle at a traffic light in Gainesville.  Arrested and charged with DUI and underage drinking, he was released back to the swamp.</p>
<p>Dunlap is one of the Gator Defense&#8217;s top players, tied for the most sacks this season and the MVP of the BCS Championship game earlier this year.  This will be a huge hurt for the Florida D if the staff chooses to suspend him.</p>
<p>What would cause someone in his position to do such a thing?  Could it be the pressure and anxiety of not being able to stop Alabama this weekend?  Alabama will be the biggest test the Gators have seen all year.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Lack of sleep looks and acts like intoxication. Fatigue or lack of sleep slow reaction time, make you unsteady on your feet and can affect speech as well as other cranial nerve functions.</p>
<p>These are the same issues looked at by an arresting officer during a DUI roadside evaluation. There are standardized field sobriety tests that the arresting officer will administer and score. Two of these tests are divided attention tests where there is an instruction phase followed by the performance phase. The walk and turn, for example, has the subject stand with one foot in front of the other, hands at their side, while listening and observing the instructions. Then the subject performs the test. The judging includes both the instruction phase and the performance phase.</p>
<p>Alcohol, at a certain level, will prevent a subject from doing the test correctly. Likewise, fatigue will also affect the performance of divided attention testing.</p>
<p>Fatigue usually occurs after 18 hours of sustained wakefulness.</p>
<p>Workplace studies have shown that fatigue can mimic the reaction time and field study results of an alcohol concentration between .05 and .10% BAC.</p>
<p>The only difference between the fatigued individual and a person under the influence of alcohol is the odor of alcohol!</p>
<p>Otherwise, the scoring on the police standardized field tests and other time reaction testing are very similar between the fatigued person and the drinker.</p>
<p>American, Canadian and Australian work place studies are all in agreement that a person awake for more than 18 hours will have slower reaction times, be more uncoordinated and have trouble with simple commands, such as give me your driver’s license. This  means that driving while fatigued can be dangerous.</p>
<p>This has been a subject of concern for the US Department of Transportation. Tired, unattentive or fatigued drivers are involved in more accidents and traffic violations than alert, well rested drivers. This might fit the description of reckless driving.</p>
<p>This is very different than driver under the influence of alcohol and/or drugs.</p>

Speed limit on the road is 55mph. His little car t-boned a Nissan minivan killing the family of four inside as they returned from the airport after a vacation in Hawaii. John</span></span><span style="color:#000000;"><span style="color:blue;"><span style="color:#000000;"> and Susan</span></span></span><span style="color:#000000;"><span style="font-size:x-small;"> </span></span><span style="color:#000000;"><span style="color:blue;"><span style="color:#000000;">Maloney </span></span></span><span style="color:#000000;"><span style="color:blue;"><span style="color:#000000;"> and their children Aiden (8) and Gracie (5) were killed instantly in the crash,</span> </span></span><span style="color:#000000;"><span style="font-size:x-small;">Steven died on Sunday due to his injuries. To add salt to the wounds, two deadbeats decided that since the family was dead they no longer needed their worldly possessions and robbed their house. The <a href="http://www.nytimes.com/aponline/2009/12/02/us/AP-US-Crash-Kills-Four-Burglary.html">couple was arrested yesterday</a>, ironically they were found out when the woman, Amber True, was arrested for driving without a license.</span></span></p>

<p><span style="color:#000000;"><span style="font-size:x-small;">Steven had his license suspended for a year when he was 17 due to drunk driving. It is unclear at this point if alcohol was a factor in this crash, but an eye witness says he say him drinking two hours before the fateful crash, which, ironically, happened right down the street from Infineon Raceway, a place where people can go those types of speed legally and safely without having to worry about hitting minivans filled with children.</span></span></p>
<p><span style="color:#000000;"><span style="font-size:x-small;">The MINI driver had aspirations of being a racer, and had taken his car to the track&#8211; the only place where one should drive like he was driving on Saturday night. Unfortunately, Steven could not separate track driving from road driving and it lead to his death and the death of four others. He made a big mistake, a mistake that could have implications for your teen.</span></span></p>
<p><span style="color:#000000;"><span style="font-size:x-small;">First off, when ever a crash like this happens, the thing that stands out for everyone is the word teenager. Steven just dropped the credibility of all teen drivers by his mistake. Teens already have really low credibility as drivers due to their inexperience, and their propensity to make bad decisions. Teens do cause more crashes than older drivers, but that doesn&#8217;t mean that teens are always at fault for their crashes or that all teens will make the same mistake Steven did. </span></span></p>
<p><span style="color:#000000;"><span style="font-size:x-small;">Secondly, when crashes like this happen the natural reaction of many is &#8220;change the laws/road so this doesn&#8217;t happen again&#8221;. People love blaming the road. The road didn&#8217;t do anything, it was just a strip of asphalt that accommodated the perpetrator of the crime. There is always something to blame with the road. There&#8217;s a rise in the hill that interferes with visibility, or the speed limit is too high, or there aren&#8217;t enough barriers, no matter what the case, the road will be blamed. Then people will look at the laws, and not the driver training laws, they&#8217;ll try to restrict teen drivers more. This just puts a band-aid on the problem and doesn&#8217;t fix anything.</span></span></p>
<p><span style="color:#000000;"><span style="font-size:x-small;">Third: race car drivers or aspiring race car drivers can have their name tarnished. I&#8217;m a HUGE advocate of taking your car to the track. You learn so much about yourself as a driver and the abilities of your car when you push it to the limits. It makes you a better driver. It is also the only safe place to drive your car fast. I find that going to the track takes the need for speed away and that I drive calmer on the road for weeks after a good day on a race track. Most of the race car drivers I know drive very responsibly on the road. I don&#8217;t want anyone to look down at people who drive on the track, or keep their children from participating in track days, because of this crash. It is worthwhile and driving fast on the track does not mean you will drive fast on the road.</span></span><br />
<span style="font-size:x-small;">I really hope that one day we no longer have to read stories like this. I hope that one day better training means that drivers are more responsible on the road. Until that day: be safe, and keep it on the track!<br />
