<title><![CDATA[Benchmarking the mire]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p>One of the documents considered around the <a title="Malmo meeting of ministers" href="http://greatemancipator.com/2009/11/22/e-government-back-in-the-news/" target="_blank">Malmo meeting of ministers </a>is the Smarter, Faster, Better eGovernment, 8th Benchmark Measurement report by Capgemini etc for the European Commission. Its available on the <a title="Capgemini" href="http://www.capgemini.com/insights-and-resources/by-publication/2009-egovernment-benchmark/" target="_blank">Capgemini site</a>.</p>
<p>I&#8217;ve not taken much notice of the previous seven for the very fact that they are focused on central government so much and, as in the case of this report, not all the services being benchmarked are delivered centrally in the UK. In fact, in the UK we need to remember that 80% of interactions with the public are delivered by local government (according to one academic report I read recently!)</p>
<p>In the context and content of the report, Capgemini place the control for e-government in the UK to the Cabinet Office &#8211; I wonder where the ODPM were in 2000 &#8211; 2006, then the DCLG, or for that matter the 300 plus local authorities?</p>
<p>One thing the report has finally started to pick up on is citizen satisfaction and the need for feedback channels. Unfortunately, they seem to have got the impression that this is somehow a strongpoint in the UK, whilst it&#8217;s still really only in its infancy.</p>
<p>I&#8217;m not sure what the value of such a report is, apart from shoring up the egos of those ministers in the top few, or highlighting the dismal failure of those less successful, but I&#8217;d like to see another report examining those countries whose citizens are most satisfied with service delivery across the channels &#8211; now that would be interesting!</p>

<title><![CDATA[What do Obama and Meg Ryan have in common?]]></title>

<p style="text-align:justify;">The <a href="http://personaldemocracy.com/europe" target="_blank"><strong>pdf conference in Barcelona</strong></a> was fascinating, as expected of course. Great atmosphere, great crowd, great ideas. So, here are a few belated scattered tidbits and thoughts:</p>
<p style="text-align:justify;">Pdf being a New York-born conference brought in a whole bunch of people from the other side of the Atlantic, people we usually “follow” through the web. The heavy artillery were of course the people who were involved with the Obama campaign. Now, a couple of things come to mind when talking about the Obama campaign.</p>
<p style="text-align:justify;">First of all, our American friends have a tendency to paint an almost activist picture of the campaign. There is always talk around notions of “bottom-up”, “citizen engagement”, “grassroots mobilization” and so on. However one cannot fail to notice that the Obama campaign was still a … hmm…well, “campaign”. Which means that by definition was a top-down exercise and a very expensive one.</p>
<p style="text-align:justify;">Listening to <a href="http://www.bluestatedigital.com/blog/people/joe-rospars/" target="_blank">Joe Rospars</a> from <a href="http://www.bluestatedigital.com/" target="_blank"><strong>Blue State Digital</strong></a><strong> </strong>and <a href="http://newsbusters.org/blogs/brent-baker/2008/08/21/cnn-producer-pitched-video-strategy-obama-campaign-got-job" target="_blank"><strong>Kate Albright-Hanna</strong></a> describe their experiences &#8211; possibly for the 1000<sup>th</sup> time &#8211; this came very clear.  The <a href="http://www.youtube.com/watch?v=2PlJR-KBj1c" target="_blank">“dinner with Obama”</a> idea is a campaign idea, the 2.000 videos (!) produced and the incredible amount of content developed and shot across the web galaxy can only be produced at great expense in money, human effort, coordination and so on. Not considering the sophisticated web platforms developed and maintained.<br />
This is not to detract in any way from the brilliance of the campaign. On the contrary. But it is worth reminding because too many politicians in Europe now<strong> “want whatever he&#8217;s had&#8221;</strong> (remember <a href="http://en.wikipedia.org/wiki/When_Harry_Met_Sally..." target="_blank">Meg Ryan’s famous orgasm scene</a>?).</p>
<p style="text-align:center;"><em><strong>What do European politicians want?</strong></em></p>
<p style="text-align:center;"><span style='text-align:center; display: block;'><object width='425' height='350'><param name='movie' value='http://www.youtube.com/v/eFpnPZpFTEk&#038;rel=1&#038;fs=1&#038;showsearch=0&#038;hd=0' /><param name='allowfullscreen' value='true' /><param name='wmode' value='transparent' /><embed src='http://www.youtube.com/v/eFpnPZpFTEk&#038;rel=1&#038;fs=1&#038;showsearch=0&#038;hd=0' type='application/x-shockwave-flash' allowfullscreen='true' width='425' height='350' wmode='transparent'></embed></object></span></p>
<p style="text-align:justify;">And what’s worse, some still think that the internet is a “cheap campaign medium”. Nothing can be further from the truth of course and for all of us working in the field know that it is a highly labour-intensive effort. However, this point was never raised by us starry-eyed Europeans. Throughout the pdf conference the lines were consistently blurred; between online political marketing and the web’s potential for self-organization and mass mobilization or novel e-democracy experiments for which old Europe can still show a thing or two (at the same time, in Malmo, Sweden an <a href="http://www.egov2009.se/awards/" target="_blank"><strong>eGov exhibition</strong></a> was showcasing 52 projects from all over Europe).</p>
<p style="text-align:justify;">I think that the success of the Obama campaign must be attributed to a conscious strategic decision to invest heavily on the web vs offline media. And with crystal clear conversion metrics: Votes &#38; Donations.</p>
<p style="text-align:justify;">On the question then of whether the Obama case can be copy-pasted to Europe most European commentators rightly gave a clear NO answer and <a href="http://www.atelier-us.com/" target="_blank">Dominique Piotet</a> emphasized this from day1. But I didn’t hear (I did not follow of course all the parallel breakout sessions) the simple argument that the US President has always been nominated through a bottom-up process whereby you need to form community support two years before election time whereas in Europe political parties more-or-less “appoint” their leaders. It’s worth re-reading this <a href="http://www.motherjones.com/politics/2009/03/welcome-new-media-campaign-tools-2012-0" target="_blank">article in MotherJones</a> which explained well the online/offline link.</p>
<p>Other tidbits that I can recall:</p>
<ul>
<li>Linkfluence presented their <a href="http://us.linkfluence.net/blog/2009/11/20/first-map-of-the-eurosphere/" target="_blank"><strong>First Map of the Eurosphere</strong></a><strong>.</strong> An impressive visual map of the structure and dynamics of the European political web and the communities that form inside it. We recall of course the <a href="http://politicosphere.net/" target="_blank">Politicosphere,</a> the similar work they carried out for the American presidential elections.</li>
<li><a href="http://personaldemocracy.com/speakers-pdf-europe-2009#saha" target="_blank"><strong>Rishi Saha</strong></a>, Head of New Media for the Tories, reminded us that politics in the past was never the cosy, small-town, get-together, personal, honest, face-to-face affair that some people think we are moving away from in this internet age. In this sense today, he said, &#8220;we are not re-inventing politics, we invent politics&#8221;. I couldn’t agree more.</li>
<li>A true activist spirit was demonstrated by Jeremie Zimmermann who put the case of the <a href="http://www.laquadrature.net/en" target="_blank"><strong>mobilization against the Telecoms Package</strong></a><strong>.</strong> He explained how decisions were constantly overturned between the European Parliament -where the case went public -and the Council of Ministers -where decisions were taken behind closed doors. “When the issue was decided in public we won, when it was decided behind closed doors we lost”, he said (not exact words). Jeremie said that putting relevant and accessible info on the web raises the political cost for the politicians and also made a useful distinction between “lobbying” (you have to be nice to everybody) and “advocacy” (you have to annoy some).</li>
<li><a href="http://www.motherjones.com/politics/2009/03/welcome-new-media-campaign-tools-2012-0" target="_blank">Jack Thurston</a> put the case of <a href="http://farmsubsidy.org/" target="_blank"><strong>farmsubsidy.org</strong></a> which is a great case of a european transparency project, tracking the single largest EU budget, out of which 85% goes to the 18% wealthiest farmers in the EU. He noted the significant difficulties they had in unlocking the data from government agencies and how important it was to have succeeded in doing so for the two first countries, Denmark and UK. The rest had to follow. Their umbrella project is <a href="http://www.followthemoney.eu/" target="_blank">followthemoney.eu </a>and the next project is the fish subsidy programme. Good luck to them.</li>
<li><a href="http://www.wikileads.net/2008/06/01/wikileaks-julian-assange-discusses-the-ethics-of-corporate-leaking/" target="_blank"><strong>Julian Assange</strong></a><strong> of </strong><a href="http://wikileaks.org/" target="_blank"><strong>Wikileaks</strong></a>, said that there are 200-300 secret gag orders in the UK forbidding press to write about certain topics, something that cought many people by surprise, and he wondered why aren’t more journalists arrested in Europe, which he attributed to a “lack of courage”.</li>
</ul>
<p style="text-align:justify;">But for me the higlights were the following, which just confirmed my preconceived “groupie” tendencies:</p>
<ul>
<li><strong>Tom Steinberg of </strong><a href="http://www.mysociety.org/" target="_blank"><strong>MySociety.org</strong></a><strong> , </strong>who won’t tell you that for many in the UK he is a “black sheep” (a medal of honour) because he builds innovative projects on a shoestring budget (6.000 GBP  for the whatdotheyknow.com project). He said that we need to build online projects that don’t stem from or replicate our offline ideas (“think of something that could not happen before”) and that we need to “nurture the geeks who can really make a difference, not just hire them”.  At the closing of the conference he rose from the auditorium to put a question he said “he may regret”. He proposed for pdf to start a movement to kick-out the people in the European Commission who fund the wasted e-participation projects and give the money instead to some of the people who can do a better job with it. Well, I think only Tom could say this, which is in many people’s minds but nobody dares to express.</li>
<li>The other highlight, was watching and meeting in the flesh, the people of the <a href="http://www.sunlightfoundation.com/" target="_blank"><strong>Sunlight Foundation</strong></a><strong>,</strong> the predominant force of e-transparency in the USA and possibly beyond. <a href="http://www.sunlightfoundation.com/people/emiller/" target="_blank"><strong>Ellen Miller</strong></a>, co-founder and executive director, said that transparency and technology is a hot issue right now, that “technology is not a slice of the pie, is the pan” and that when asked by the administration what should they do, their answer was “put out data in raw, machine-readable format; we’ll do the rest”.<br />
<a href="http://en.wikipedia.org/wiki/Esther_Dyson"><strong>Esther Dyson</strong></a>, member of the Sunlight’s BoD, gave her top-line five points to consider and I keep from those: “power corrupts but also seduces, even people with little power. It’s not enough to change govts, we need to change citizens also” (quoted because it is relevant and true for my country Greece).</li>
</ul>
<p style="text-align:justify;">There are many more interesting points and discussions that went on and thanks to the <a href="http://civicolive.com/pdfeu/" target="_blank">amazing work by Civico</a>, they are documented and archived.</p>

<title><![CDATA[Too little too late]]></title>

<description><![CDATA[Avete ricevuto l’invito a partecipare alla sperimentazione della posta elettronica certificata (PEC)]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p>Avete ricevuto l’invito a partecipare alla sperimentazione della posta elettronica certificata (<strong>PEC</strong>) per rivolgervi all’Inps? </p>
<p>Io non ho aderito. Vi spiego perché.</p>
<p>Intanto, la PEC non serve quasi a nulla. Per quasi tutti gli atti formali vi viene richiesta la firma originale, fresca in penna blu. E questa, è chiaro, non potete inviarla come un allegato PEC.</p>
<p>E’ vero che gli uffici pubblici, <a href="http://www.cwi.it/blogs/usandthem/?p=189" target="_blank"><strong>stoltamente</strong></a>, accettano spesso firme e documenti &#8220;originali&#8221; per fax: ma non li accetteranno per email. Dunque, quando tenterete di usare la PEC vi diranno che serve <strong>anche la firma elettronica</strong>, esattamente come oggi non vi lasciano usare l’email (che sarebbe sufficiente nel 90% dei casi) e pretendono quella certificata. </p>
<p>Quando devo dialogare con l’Inps, la prima cosa che io faccio è cercare l’indirizzo email dell’ufficio competente sul sito web. Spesso mi rispondono. Se non lo fanno, insisto al telefono. Se non funziona neppure quello, scrivo un’email di protesta al Direttore competente. Se non basta, una raccomandata.</p>
<p><a href="http://comuneblog.wordpress.com/files/2009/11/azzecca.jpg"><img class="alignleft size-full wp-image-865" title="azzecca" src="http://comuneblog.wordpress.com/files/2009/11/azzecca.jpg" alt="" width="85" height="120" /></a>Non avverto, dunque, nessun bisogno di PEC. Né la PEC cambierebbe alcunché: se uno non mi risponde, non mi risponde!</p>
<p>Inoltre, ho qualcosina da ridire sul Modulo di Richiesta che mi è stato proposto dall’Inps: </p>
<p style="text-align:center;">(1)</p>
<p>Si parla di Modulo ma in realtà si tratta di un <strong>contratto</strong>. Non potevano dirlo chiaramente?</p>
<p style="text-align:center;">(2)</p>
<p>Si prosegue con l’italico vezzo consistente nel far circolare le fotocopie dei documenti delle persone: qui bisognerebbe allegare fotocopie e del documento di identità e del tesserino codice fiscale (e poi <strong>recarsi</strong> personalmente a consegnare il tutto).</p>
<p>A parte lo spreco di carta e il conseguente <strong>danno ambientale</strong>, del quale ovviamente il burocrate di turno non ha la più vaga nozione, l’articolo 3 della legge sulla privacy prescrive che i dati personali debbano essere memorizzati solo per il tempo strettamente necessario, e poi distrutti.</p>
<p>Voi pensate che le fotocopie dei vostri documenti verranno accuratamente distrutte dall’Inps dopo averne preso visione, oppure che resteranno a prendere polvere in luoghi dai quali una banda di malintenzionati potrebbe sottrarli (succede ogni giorno) per scopi di <strong>furto di identità</strong>?</p>
<p style="text-align:center;">(3)</p>
<p>E per andare più alla sostanza della cosa: pensate che l’impiegato che riceverà dalle vostre mani il modulo e la fotocopia dei documenti, li sottoporrà ad accurata verifica per accertarsi che siate proprio voi che state acquisendo un indirizzo di email certificata?</p>
<p>Oppure pensate che un’altra persona, che si fosse procurata le fotocopie dei vostri documenti in uno dei mille luoghi italiani in cui esse vengono immagazzinate inutilmente, potrebbe andare all’Inps e chiedere la PEC <strong>sotto la vostra identità</strong>? (Se pensate la seconda cosa, avete indovinato); </p>
<p style="text-align:center;">(4)</p>
<p>Il Gestore della PEC non si impegna ad alcun <strong>livello di servizio</strong> quantitativamente espresso;</p>
<p style="text-align:center;">(5)</p>
<p>L’articolo 11 del Contratto/Modulo, sul trattamento dei dati personali, è un pasticcio, campionario di ambiguità e inesattezze. Una <em>legal exposure</em> per l’Inps;</p>
<p style="text-align:center;">(6)</p>
<p>In caso di controversie, il foro legale competente è quello di Roma, in difformità dalla diffusa e ormai antica consuetudine in base alla quale il foro competente dovrebbe essere quello del <strong>consumatore</strong> (nella fattispecie non si tratta di una transazione commerciale, però lo spirito dovrebbe essere quello).</p>
<p>Questo sta a indicare o che l’Inps è molto insicura del servizio e pensa che possa presentarsi spesso la necessità di stare in giudizio per difendersi o che il Modulo/Contratto è stato stilato con fretta e sciatteria. <em>Tertium</em>, mi pare, <em>non datum</em>;</p>
<p style="text-align:center;">(7)</p>
<p>Il Modulo/Contratto è il solito concentrato di sgrammaticature e italiano retorico e ridicolo al quale ormai siamo abituati.</p>
<p>Per esempio: ”Il sottoscritto con il presente modulo di richiesta, compilato e sottoscritto in ogni sua parte, richiede [...]“.</p>
<p>Sorvolando sulle virgole, che bisogno c’era di scrivere “compilato e sottoscritto in ogni sua parte”? Che accidenti di senso o funzione ha questa frase sciocca, inserita in un modulo da consegnarsi a mano allo sportello? Cos’aveva dentro la capoccia il suo estensore?</p>
<p>Voleva forse dire “purché compilato in ogni sua parte e siglato in ogni pagina oltre che firmato in calce?” Può darsi. Ma non è quello che ha detto, anche se magari ha impiegato una settimana per scrivere questo forbito testo.</p>

<p><em>&#8220;I have to keep celebrating that I&#8217;m alive. I shouldn&#8217;t be here now. I&#8217;m on borrowed time&#8221;</em>. These were the words spoken by Jayne before she sat down and told her story about how Individualised Budgets has changed her life, the life of her husband Mark and her wider family including her Mum.</p>
<p>Jayne&#8217;s life as a high energy career nurse was thrown into chaos at the age of 30 when she was diagnosed with cancer. She describes how treatment offered structure to her weeks following the original announcement and how she found a sense of purpose in simply trying to stay alive. <em>&#8220;By finding structure and purpose something positive will merge&#8221;</em> Jayne says. This model of chaos, structure, meaning and emergence has seen Jayne through eight years of fighting cancer and all the ups and downs that entails.</p>
<p>Jayne explains how time became her greatest commodity because no one could say how long she had left to live. Following her first round of treatment Jayne took a part-time job which allowed for flexibility and days away; days spent with Mark on an canal barge &#8211; <em>&#8220;We like canal barging &#8211; it slows life down&#8221;</em>. However, one afternoon Jayne was plunged back into chaos as she fractured her spine pushing the boat through a lock. The cancer had spread to her bones. At this point the nature of the problem had changed. It was was no longer an illness, but a disability. This was going to take away her independence and this was the one thing that scared her the most.</p>
<p>It was at this point that Jayne was offered Direct Payments, but this proved to be rigid and outside of her desire to regain independence &#8211; <em>&#8220;I was trying not to be a disabled person. I didn&#8217;t want many of the installations that were being offered. I did need help though, especially with my food shopping, but the times were fixed and no matter what I had to be well on that prescribed day, but I wasn&#8217;t”</em>. Outside of this chaos Jayne found meaning attending a local college to study art, but was soon hit with a real problem. She was reliant on other students to lift the wheelchair from her car &#8211; <em>&#8220;you can&#8217;t describe how helpless it makes you feel&#8221;</em>.</p>
<p>This is when Jayne was introduced to Individualised Budgets (IB) and she was able to purchase a floating chair and trailer for her car. <em>&#8220;All of a sudden my life was transformed. I could go shopping on my own. I could get to and from college and also take part in local field trips. I felt independent again&#8221;</em>. The IB payments also allowed Jayne to compartmentalise the six hours of support she was offered through Direct Payments. It was broken into different instances allowing Jayne to take the burden of cleaning the house from her busy Mum and instead spend quality time with her at the local swimming pool. <em>&#8220;The IB budget has really allowed me to understand where I want to spend my time and what I want to spend it doing. In the end, this is not about having a service, it&#8217;s about having a life&#8221;</em>.</p>
<p>Jayne does however state that there has been periods where she has been able to reduce the budget &#8211; <em>&#8220;We are very conscious that this is not our money. I keep returning to the IB panel and asking if it&#8217;s okay to procure a particular service. There have even been instances where I have even been able to give money back&#8221;</em>. Jayne now has support on a daily basis &#8211; a position that Jayne gave great consideration to &#8211; <em>&#8220;This is the person I am going to choose to share the last parts of my life and it was important that I was able to make that choice&#8221;</em>.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p><strong>Vergangene Woche lehrten im Zuge des neu gestarteten E-Government Lehrgangs international renommierte Fachleute aus dem E-Government Bereich auf der Donau-Universität Krems. Hans Jochen Scholl von der University of Washington (State) und Viktor Mayer-Schönberger von der National University of Singapore begeisterten die StudentInnen.</strong></p>
<h3>Vortrag Scholl</h3>
<p>In seinem Vortrag „On the State of E-Government. In Practice and in Academia – Where do we go from here?” beschäftigte sich Prof. Dr. Scholl mit den Anfängen von E-Government und mit künftigen Entwicklungen. Besonderes Augenmerk legte Scholl auf den interdisziplinären Zugang zu E-Government und die Tatsache, dass E-Government Studies noch immer eine junge und aufstrebende Disziplin ist. Bei seinen Ausführungen zu „Open Government – Principles, Issues and Current State“ betonte Scholl, dass BürgerInnen nicht mit KundInnen gleichzusetzen sind, da KundInnen abgewiesen werden können, BürgerInnen jedoch nicht. Die Open Government Initiativen in den USA basieren auf dem Freedom of Information Act (1966-2002). Die Informationspflichten der Behörden gegenüber BürgerInnen sind in den USA stärker ausgeprägt als in Europa, da in der Gesellschaft der Gedanke vorherrscht, dass Behörden und BeamtInnen in erster Linie für BürgerInnen arbeiten.</p>
<h3>Vortrag Mayer-Schönberger</h3>
<p>Prof. Dr. Viktor Mayer-Schönberger  stellte fest, dass E-Government nicht zwingend kontinuierlich besser wird. Bevor man E-Government umsetzt muss man wissen, was für Ziele zu erreichen sind. Oft werden Problemlösungen für Situationen angeboten, bei denen es keine Probleme gibt. Die klassischen E-Government Ziele sind:</p>

<li>Effizientere Verwaltung</li>
<li>Verwaltungsreform</li>
<li>Transparenz</li>
<li>Kundennutzen</li>
<li>Partizipation</li>
</ul>
<p>Die Evaluierung von E-Government Zielen ist oft problematisch. Es wird meist das gemessen, was gemessen werden kann, aber nicht das, was gemessen werden soll.</p>
<p>Zu E-Partizipation merkte Mayer-Schönberger an, dass dies oft mit Mobilisierung via Internet verwechselt wird. Partizipation bedeutet Diskussion und Argumente austauschen, wobei man akzeptieren muss, selbst seine Meinung in der Diskussion eventuell zu ändern. Partizipation in der Form von Feedback für Behörden ist erfolgreicher als Partizipations-Portale, die direkt-demokratische Elemente fördern.</p>
<p>Bezüglich Open Government sprach Mayer-Schönberger von I-Government (Information-Government), da es eine Strategie sein kann, möglichst viele Information zur Verfügung zu stellen, damit Falschinformation ausgeblendet werden kann. Die Kontrolle über den Fluss von Informationen ist heute wichtiger Bestandteil von wirtschaftlichen und gesellschaftlichen Strategien. Der Staat hat die Autorität und die notwendigen Ressourcen korrekte Information anzubieten, die dann von Privaten verarbeitet werden können.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>On Thursday 19 November 2009 The Guardian&#8217;s <a title="Michael Cross" href="http://www.michaelcrossjournalist.net/index.htm" target="_blank">Michael Cross </a>published a piece entitled &#8220;<a title="egovernment policy net resources" href="http://www.guardian.co.uk/technology/2009/nov/18/egovernment-policy-net-resources" target="_blank">It&#8217;s now time for e-government policy to take the spotlight</a>.&#8221;</p>
<p>In his usual charming manner Michael highlights the ignorance of one minister just three years ago, but concludes that 13 years on from the Conservative Green Paper, something might finally happen. I suspect that 13 years is still too soon and Micahel is being optimistic, but what is the cause of his optimism? It&#8217;s the <a title="E-government conference 2009" href="http://www.egov2009.se/" target="_blank">EU Ministerial Conference in Malmo, Sweden</a>. For the UK, Bill McCluggage, John Suffolk&#8217;s deputy was talking about &#8220;A Future that is Efficient, Sustainable and Responsible.&#8221;</p>
<p>Andrea di Maio picks up the latest declatation on his<a title="Andrea di Maio's blog" href="http://blogs.gartner.com/andrea_dimaio/2009/11/19/government-2-0-lost-in-eu-declaration/" target="_blank"> blog</a> and does his usual thorough analysis and ends up slightly confused as to where it stands with Gov 2.0, although I suspect for the UK this probably takes on the observation by Michael Cross as to which way we go next year after the election &#8211; there are, of course, at least two choices, open up the data or give it to the private sector to open up!</p>

<description><![CDATA[With the increasing globalization of the world economy, there has been a growing interest in the pot]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p style="text-align:justify;">With the increasing globalization of the world economy, there has been a growing interest in the potential contributions of good governance to accelerating the rate of economic and social development in the developing countries, and enhance their smooth integration into the emerging global economy. Simultaneously, developed economies are experiencing increasing proportion in the contribution of knowledge, information and telecommunication sectors to their overall gross domestic product. This is placing increasing focus on the role and contribution of national information infrastructure to economic productivity, and in extension, to the economic and social development of nations.</p>
<p style="text-align:justify;">This paper explores the link between Information and Communication Technologies (ICTs), governance, and social economic development in the developing countries. It empirically concludes that contributions of ICTs to social economic development are influenced by socio-political governance – leading to national development through more prudent and egalitarian application and use of the ICTs portfolio. The contingent role of governance on ICTs and national development paves the path towards recognizing the importance of socio-political moderators.</p>

<p style="text-align:justify;">Dengan adanya pemberlakuan otonomi daerah, kegiatan antar kerja yang semula berada dalam koordinasi Departemen Tenaga Kerja, dialihkan menjadi salah satu kegiatan yang berada di bawah Dinas yang membidangi ketenagakerjaan Provinsi/Kabupaten/Kota.</p>
<p style="text-align:justify;">Menurut Peraturan Pemerintah Republik Indonesia Nomor 38 Tahun 2007, bagian urusan pemerintahan di bidang Ketenagakerjaan khususnya mengenai Pembinaan dan Penempatan Tenaga Kerja Dalam Negeri yang dilaksanakan oleh Pemerintah Daerah Provinsi/Kabupaten/Kota adalah pemberian pelayanan informasi pasar kerja dan bimbingan jabatan kepada pencari kerja dan pengguna tenaga kerja.</p>
<p style="text-align:justify;">Kebijakan otonomi daerah mengenai peran dinas yang membidangi ketenagakerjaan di Provinsi/Kabupaten/Kota telah mengakibatkan tanggungjawabnya semakin besar dalam pengelolaan kegiatan yang berkaitan dengan bidang ketenagakerjaan, khususnya dalam pemberian pelayanan penempatan tenaga kerja.</p>
<p style="text-align:justify;">Menurut Peraturan Menteri Tenaga Kerja dan Transmigrasi Republik Indonesia Nomor Per.07/MEN/IV/2008, penempatan tenaga kerja adalah proses pelayanan kepada pencari kerja untuk memperoleh pekerjaan sesuai dengan bakat, minat dan kemampuan dan kepada pemberi kerja dalam pengisian lowongan kerja sesuai dengan syarat jabatan yang dibutuhkan.</p>
<p style="text-align:justify;">Selama ini pelayanan antar kerja yang dilakukan secara konvensional di Dinas Provinsi/Kabupaten/Kota belum berjalan secara efektif. Informasi lowongan kerja yang dibutuhkan pencari kerja masih kurang, demikian pula dengan keadaan pencari kerja yang tercatat di bursa kerja pemerintah tidak pernah terinformasi ke pemberi kerja.</p>
<p style="text-align:justify;">Dalam era globalisasi serta perkembangan teknologi informasi dan komunikasi saat ini, dimana hampir tidak ada lagi batas antara wilayah maupun negara lain, arus informasi bergerak dengan cepat melalui media internet. Melihat perkembangan tersebut, diperlukan solusi bagi pengelolaan antar kerja ini agar pelayanan kepada pencari kerja dan pemberi kerja dapat dilakukan dengan praktis, cepat, tepat, efektif dan efisien.</p>
<p style="text-align:justify;">Untuk kepentingan tersebut Dinas Tenaga Kerja, Transmigrasi dan Kependudukan Provinsi Bali dengan memanfaatkan teknologi informasi membangun aplikasi pelayanan antar kerja yang dikenal dengan nama Bursa Kerja On Line (BKOL) dengan alamat website <a href="http://www.bursakerjabali.com/">www.bursakerjabali.com</a>. BKOL diresmikan oleh Gubernur Bali Made Mangku Pastika pada bulan Oktober 2008 berlokasi di Balai Latihan Kerja Pariwisata (BLKP) Jl. Imam Bonjol, Denpasar. BKOL menyediakan 2 buah komputer dengan akses internet yang dapat digunakan oleh pencari kerja dan pemberi kerja. Selain itu ada 2 (dua) orang Petugas Antar Kerja yang akan memberikan pelayanan penempatan tenaga kerja yang meliputi pelayanan informasi pasar kerja, penyuluhan dan bimbingan jabatan, serta perantaraan kerja.</p>
<p style="text-align:justify;">Melalui sistem ini pelayanan kepada masyarakat pencari kerja dan pemberi kerja dapat  berjalan dengan praktis, cepat, dan efisien, karena pelayanan Bursa Kerja On Line berjalan selama 24 jam sehari, 7 hari seminggu, tidak dibatasi lokasi, waktu pelayanan cepat, akurasi data akurat, cakupan informasi tidak terbatas jarak dan waktu. Dengan dibangunnya Bursa Kerja on Line ini juga diharapkan dapat mempercepat proses pertemuan antara pencari kerja dan pemberi kerja yang  mempermudah terjadinya penempatan.<strong> </strong></p>
<p style="text-align:justify;"><strong><span style="color:#993300;">II. BURSA KERJA ON LINE (BKOL)</span></strong></p>
<p style="text-align:justify;">Bursa Kerja On Line adalah sarana (media) yang berisi mekanisme untuk mempertemukan pencari kerja dengan pekerjaan yang diinginkan dan pemberi kerja (pengusaha) dengan tenaga kerja yang dibutuhkan secara cepat dan tepat, dengan basis teknologi informasi (internet).</p>
<p style="text-align:justify;">Komponen Bursa Kerja On Line meliputi : pencari kerja, pemberi kerja, administrator (Petugas Antar Kerja), hardware dan software.</p>
<p style="text-align:justify;">Bursa Kerja On Line merupakan aplikasi yang dibangun dengan basis website dengan memanfaatkan jaringan internet. Website ini berisi berbagai informasi yang berguna bagi pencari kerja dan pemberi kerja/penyedia kerja antara lain :</p>

<p>Sampai dengan bulan Juli 2009, jumlah pencari kerja yang terdaftar pada bursa kerja on line sebanyak 1.472 orang, sedangkan jumlah penyedia kerja yang terdaftar sebanyak 343 perusahaan. Pencari kerja dan penyedia kerja yang terdaftar berasal dari Provinsi Bali dan di luar Provinsi Bali seperti Jawa Timur, Jawa Tengah, Jawa Barat, DKI Jakarta, dan NTB.</p>

<p>Agar dapat memasukkan lowongan dan melihat kriteria pencari kerja yang dibutuhkan, maka penyedia kerja harus mendaftar dan mengisi formulir yang disediakan. Setelah melakukan pendaftaran dan mempunyai user name, penyedia kerja dapat login ke bursa kerja on line.</p>

<p style="text-align:justify;">Pelayanan penempatan tenaga kerja melalui bursa kerja on line ini masih dalam tahap <em>publish</em>. Pelayanan pada tahap ini merupakan implementasi e-Government yang termudah karena selain proyeknya berskala kecil, kebanyakan aplikasinya tidak perlu melibatkan sumber daya yang besar dan beragam (Indrajit, 2002 : 29).</p>
<p style="text-align:justify;">Komunikasi masih berlangsung satu arah, dimana Dinas Tenaga Kerja mempublikasikan berbagai informasi yang dimilikinya berkaitan dengan ketenagakerjaan, pencari kerja melihat informasi lowongan yang diinginkan dan penyedia kerja melihat pencari kerja yang sesuai dengan kriteria yang dibutuhkan, masyarakat dapat memperoleh informasi mengenai Daftar nama PPTKIS (Pelaksana Penempatan Tenaga Kerja Indonesia Swasta) yang terdaftar di Dinas Tenaga Kerja, prosedur bekerja ke luar negeri secara legal, foto-foto kegiatan Dinas Tenaga Kerja, informasi pameran bursa kerja (<em>job fair</em>), dan lain sebagainya.</p>
<p style="text-align:justify;"><strong><span style="color:#993300;"> IV. PENUTUP</span></strong></p>
<p style="text-align:justify;">Dengan dibangunnya aplikasi bursa kerja on line dengan alamat <a href="http://www.bursakerjabali.com/">www.bursakerjabali.com</a>, maka pelayanan penempatan tenaga kerja kepada pencari kerja dan penyedia kerja diharapkan dapat berjalan secara praktis, cepat dan efisien serta mempermudah terjadinya proses penempatan.</p>
<p style="text-align:justify;">Dukungan Pemerintah Provinsi Bali dalam membangun aplikasi bursa kerja on line ini sangat baik yaitu melalui APBD Provinsi Bali. Namun di sisi lain, masih adanya berbagai hambatan dalam menjalankan bursa kerja on line ini antara lain :</p>
<p style="text-align:justify;">1. Sumber Daya Manusia (SDM)<strong> </strong></p>
<p style="text-align:justify;">SDM masih menjadi kendala sampai saat ini. Hal tersebut terjadi karena belum semua Petugas Antar Kerja/ Fungsional Pengantar Kerja di lingkungan Dinas Tenaga Kerja, Transmigrasi dan Kependudukan Provinsi Bali memahami teknologi informasi yang berkaitan dengan internet, sehingga tidak semua petugas dapat melakukan pelayanan penempatan tenaga kerja secara on line. Di masa mendatang diharapkan Pemerintah Provinsi Bali dapat memberikan pelatihan dan bimbingan teknis yang berkaitan dengan teknologi informasi/internet kepada Petugas Antar Kerja.</p>
<p style="text-align:justify;">2. Lowongan kerja kurang <em>up to date</em></p>
<p style="text-align:justify;">Kurangnya informasi lowongan kerja juga menjadi salah satu kendala dalam melakukan pelayanan penempatan tenaga kerja melalui bursa kerja on line. Hal ini terjadi karena tidak semua perusahaan yang memiliki informasi lowongan kerja melaporkannya kepada Dinas Tenaga Kerja. Keputusan Presiden Nomor 4 Tahun 1980 tentang Wajib Lapor Lowongan Pekerjaan di Perusahaan tidak berjalan sebagaimana yang diharapkan. Hal ini perlu menjadi perhatian baik dari pemerintah maupun penyedia kerja. Semoga ke depan ada koordinasi yang baik antara pemerintah dan perusahaan sebagai penyedia kerja, sehingga selalu ada informasi yang <em>up to date</em> mengenai lowongan kerja.</p>
<p style="text-align:justify;">3. Fungsional Pengantar Kerja belum berfungsi dengan      baik</p>
<p style="text-align:justify;">Fungsional Pengantar Kerja merupakan salah satu ujung tombak dalam melakukan pelayanan penempatan tenaga kerja, namun belum semua menjalankan fungsinya dengan baik. Pengantar kerja bertugas untuk menjalankan fungsi pelayanan informasi pasar kerja, penyuluhan dan bimbingan jabatan serta perantaraan kerja kepada pencari kerja dan penyedia kerja. Fungsi-fungsi tersebut belum sepenuhnya dapat dijalankan karena masih adanya ketidakteraturan pembagian pekerjaan. Banyak pengantar kerja yang sehari-harinya melakukan tugas rutin administrasi dan kegiatan bidang, sehingga fungsi utamanya belum dapat dijalankan dengan baik.</p>
<p style="text-align:justify;">4. Kurangnya Sosialisasi Bursa Kerja On Line kepada      masyarakat</p>
<p style="text-align:justify;">Sejak diresmikan oleh Gubernur bali pada bulan Oktober 2008, BKOL belum banyak diketahui oleh masyarakat khususnya di Provinsi Bali. Bagi pencari kerja yang berada di Kota Denpasar dan Kabupaten Badung sebagian besar telah mengetahuinya, namun bagi pencari kerja di Kabupaten lainnya di wilayah Bali belum semua mengetahui adanya bursa kerja on line ini. Untuk itu diperlukan sosialisasi kepada masyarakat di seluruh kabupaten/kota di Bali, sehingga mereka dapat memanfaatkan fasilitas bursa kerja on line ini.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p style="text-align:justify;">The governance problems that most African countries have experienced since independence is nothing new and has received intensive coverage in the press worldwide.  A fundamental cause of governance problems in Africa may have been the disinformation of a vast majority of the region’s population owing to inadequate and poor information infrastructure. This research presents a growing ICT application domain —TeleDemocracy—in Sub-Saharan Africa.  We present several successful TeleDemocracy initiatives in Sub-Saharan Africa, the obstacles they face, and possible strategies to address them.  The research culminates with a discussion on implications for businesses, practice, teaching, and suggests salient areas that warrant future research.</p>

<p><strong>BARCELLONA &#8211; </strong>L&#8217;Europa sarà anche unita a livello istituzionale, ma per quanto riguarda la percezione politica dei cittadini, c&#8217;è ancora molto lavoro da fare. Nella realtà, ma anche sul web. Almeno questo è il verdetto emesso da una ricerca condotta su un campione selezionato di 10 mila siti politici in Francia, Germania, Italia e Olanda. Il risultato dell&#8217;<a rel="nofollow" href="http://us.linkfluence.net/blog/2009/11/20/first-map-of-the-eurosphere/" target="_blank"><span style="text-decoration:underline;">indagine</span></a>, realizzata da linkfluence, azienda specializzata in ricerche di mercato sui media sociali, è una mappa che fotografa le comunità politiche sul web del continente costruita analizzando la rete di collegamenti tra i vari siti.</p>
<p><strong>UNITI MA DIVISI -</strong> Il quadro che emerge descrive un dibattito politico sull’Europa che continua a crescere, ma riproduce sul web i tradizionali confini fisici. Le aggregazioni di siti si compongono seguendo linee linguistiche, con poche intersezioni tra le varie comunità, che continuano, per lo più, a parlare a se stesse: i francesi con i francesi, i tedeschi con i tedeschi. Nella generale tendenza alla separazione, la sorpresa viene proprio dai soggetti che non ti aspetti, i gruppi di euroscettici, quelli che, per ideologia, sembrerebbero meno inclini alla contaminazione. E invece, secondo la ricerca, sono proprio i siti e i blog che esprimono posizioni contro l&#8217;Unione europea ad avere maggiori legami transnazionali attraverso reti parallele a quelle degli altri gruppi.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>A recent post (11 November 2009) on the <a title="Putting the E in Parliaments" href="http://blogs.worldbank.org/publicsphere/putting-e-parliaments" target="_blank">World Bank&#8217;s blog </a>brings into play another &#8220;e&#8221; word! This time its E-Parliament. Paul Mitchell, who recently spoke at the World e-Parliament 2009 Conference in Washington D.C., USA,  is the author and is very confident of the value ICT might have, although he does state that it&#8217;s about providing better service delivery.</p>
<p>As I&#8217;ve stated before, having read numerous papers and books on e-government, e-governance and similar phenomena, I struggle to see how, apart from a little increasing transparency, anything will change when the representatives of representative democracy are going to be unwilling to hand over some of their decision making powers to the electorate.</p>
<p>Two recent posts on the E-government Bulletin reinforce this from different angles: &#8220; <a title="E-government Bulletin 296" href="http://www.headstar.com/egblive/?p=296" target="_blank">The Future of Politics: A Gathering Storm</a>&#8221; and &#8220;<a title="E-government bulletin 288" href="http://www.headstar.com/egblive/?p=288" target="_blank">Political Parties Could Be ‘Swept Away’ By Social Networks</a>&#8220;. I suspect both are a storm in a tea-cup, since the main result of this lack of transparency appears to be citizen apathy.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>E-Gov Bulletin from the UK suggests that <a href="http://www.headstar.com/egblive/?p=288">social networks could sweep away political parties</a>. Dr. Ian Kearns, former Head of the e-Government Programme at the Institute for Public Policy Research, tells the House of Commons&#8217; Parliamentary IT Committee that Web 2.0 is giving people the tools to recognize and use their power to organize and campaign.</p>
<p>Dr. Kearns is speaking in the British parliamentary context where third parties have a reasonable shot at making a difference. I&#8217;m not sure social networks would have as easy of a time upending one of our two dominant parties. However, his point that parties can (and must!) take advantage of the technology is proven by the Howard Dean and Barack Obama presidential campaigns. The Internet and social apps (plus a good spreadsheet) put as much organizing power in the hands of two local advocates in a back office as could have been mustered by a national campaign office a couple decades ago.</p>
<p>While the technology is powerful, Dr. Kearns emphasizes that the big shift is in how we use the technology, how we expect to be involved in the information process. Yes, it&#8217;s the <a href="../2009/09/29/new-media-literacy-demands-conducers/">consumer-producer-conducer</a> paradigm shift! Politicans need to get out of &#8220;broadcast&#8221; mode and recognize that politics is much more a two-way, participatory endeavor. The new politics is all about openness and engagement. If you&#8217;re running for office, you can&#8217;t just put up a website; you have to invite your voters in to build that website&#38;mdash;to build its content&#38;mdash;for you.</p>

<description><![CDATA[V’è un articolo di legge, nel nostro ordinamento giuridico, che fa testualmente riferimento ai «DRMS]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p>V’è un articolo di legge, nel nostro ordinamento giuridico, che fa testualmente riferimento ai «<strong>DRMS (Digital Rights Management Systems)</strong>», intesi come sistemi di gestione dei diritti su opere digitali, al fine di proteggere le stesse contro usi o attività non autorizzati dal titolare dei diritti sulle opere medesime.</p>
<p>La norma in questione è l’art. 12 L.R. 54/2009, emanata dalla Regione Toscana, sulla quale <a title="L.R. 54/2009 - Toscana" href="http://internetsociety.wordpress.com/?s=L.R.+54%2F2009" target="_blank">mi sono già pronunciato con altri commenti</a> in questa sede.</p>
<p>In tale articolo, rubricato «<em>Archivio informatico delle misure antielusione</em>», v’è una forte presa di posizione a favore dei sistemi di DRM, tant’è che, sin dal primo comma, la Regione dichiara il proprio favore per le misure tecnologiche di protezione dei diritti sulle opere digitali, a tal punto di promuoverne la ricerca e la sperimentazione.</p>
<p>Nei commi successivi, invece, viene istituito presso la Giunta regionale, con le opportune garanzie di sicurezza e riservatezza, un archivio informatico dei DRM riservato ai soggetti che abbiano nella regione Toscana la propria residenza o la propria sede legale.</p>
<p>Presso tale archivio, il cui funzionamento e la cui organizzazione saranno disciplinati con separato regolamento, i soggetti interessati «possono volontariamente presentare la descrizione in forma digitale delle proprie opere ai fini del loro riconoscimento ed identificazione per l’apposizione di misure antielusione che verranno custodite presso l’archivio stesso».</p>
<p>Dunque, l’archivio consentirà sia il deposito volontario della misura antielusione, la cui integrità (necessaria all’efficacia del DRM) dovrebbe essere assicurata dalle garanzie di sicurezza e riservatezza che il regolamento individuerà, sia il deposito volontario della descrizione in forma digitale dell’opera che si intende proteggere con la misura tecnologica di protezione, per consentire quell’individuazione e l’identificazione necessaria a rivendicarne la tutela.</p>
<p>La norma (che trascrivo di seguito per comodità di chi legge), sembra contrapporsi alla visione politica ispirata all’apertura profonda e radicale all’open source ed ai formati aperti, risultante dall’<a title="Art. 26 L.R. 54/2009 Regione Toscana" href="http://internetsociety.wordpress.com/2009/11/15/programmi-a-codice-sorgente-aperto-la-scelta-della-legge-regionale-toscana/" target="_blank">art. 26 della medesima legge, dedicato ai «Programmi informatici a codice sorgente aperto e formati liberi»</a>.</p>

<blockquote><p><strong><em>Art. 12 (L.R. 54/2009 &#8211; Regione Toscana) </em></strong><br />
<P><strong><em>Archivio informatico delle misure antielusione</em></strong></p>
<p><P>1. La Regione promuove la ricerca e la sperimentazione di sistemi avanzati di gestione dei diritti digitali o DRMS (Digital Rights Management Systems) quali strumenti che consentono di provvedere alla protezione dei diritti sulle opere digitali contro usi o attività non consentiti dal titolare o non previsti in via contrattuale, secondo quanto previsto dalla normativa statale.</p>
<p><P>2. Ai fini di cui al comma 1 e nel pieno rispetto delle normative e competenze statali ed europee, è istituito presso la Giunta regionale, con le opportune garanzie di sicurezza e riservatezza, un archivio informatico, presso il quale soggetti interessati, residenti o con sede legale in Toscana, possono volontariamente presentare la descrizione in forma digitale delle proprie opere ai fini del loro riconoscimento ed identificazione per l’apposizione di misure antielusione che verranno custodite presso l’archivio stesso.</p>
<p><P>3. Il funzionamento e l’organizzazione dell’archivio sono disciplinati con regolamento, che ne definisce anche modi di accesso ed eventuali oneri a carico dei privati richiedenti.</p></blockquote>

<content:encoded><![CDATA[<div class='snap_preview'><p>Hot off the press (10 November 2009) from the Department of Work and Pensions (DWP) comes &#8221;<a title="Jobcentre Plus Research Report" href="http://research.dwp.gov.uk/asd/asd5/rports2009-2010/rrep575.pdf" target="_blank">A qualitative study of satisfaction and dissatisfaction with Jobcentre Plus</a>&#8221; by Dr Alex Nunn, Fiona Walton and Sukvinder Jassi from the Policy Research Institute at Leeds Metropolitan University.</p>
<p>At 152 pages its a lengthy read but a very comprehensive and worthwhile study. Some of the conclusions could be considered to be common sense but its nice to see well evidenced qualitative research supporting them, such as on page 74 &#8211; &#8220;The website was not used by many respondents because they did not have internet access or computer literacy. The dissatisfaction experienced with this channel was contributed to by the lack of online experience and computer skills.&#8221;</p>
<p>Similarly, on page 84, it presented a  conclusion that &#8220;customers feeling that they cannot access the information that they need through the website, resulting in them using another channel.&#8221;</p>
<p>From a researcher&#8217;s view, two of the &#8220;considerations for future research&#8221;  jump out. These are (from p.103):</p>
<ul>
<li>&#8220;the importance of disagregating satisfaction with intended and unintended consequences of service provision, to isolate what elements of satisfaction are related to the means of service delivery rather than contextual or policy/legislative dynamics;&#8221;</li>
<li>&#8220;the importance of assessing customer satisfaction with provider services on longitudinal and comparitive basis.&#8221;</li>

<title><![CDATA[Programmi a codice sorgente aperto. La scelta della legge regionale toscana]]></title>

<description><![CDATA[La legge regionale 54/2009 compie un passo decisivo verso l’introduzione dell’open source nella pubb]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p>La <a title="L.R. 54/2009 - Regione Toscana" href="http://internetsociety.wordpress.com/2009/11/08/amministrazione-digitale-e-information-society-la-legge-542009-della-regione-toscana/" target="_blank">legge regionale 54/2009</a> compie un passo decisivo verso l’introduzione dell’open source nella pubblica amministrazione.</p>
<p>Colpisce molto la soluzione legislativa contenuta nell’art. 26 (trascritto in calce), ove, a dispetto delle maggiori cautele sulla scelta tra open source software e software proprietari espressa nella direttiva Stanca e poi nel codice dell’amministrazione digitale, qui si abbraccia nettamente ed aprioristicamente il modello open source e i formati liberi.</p>
<p>Quanto alla previsione del necessario ricorso ai formati liberi il discorso è sicuramente più chiaro e meno problematico rispetto alla scelta in ordine al ricorso necessario all&#8217;open source.</p>
<p>Il ricorso ai formati liberi, infatti, intende evitare che i file generati o ricevuti nell’ambito dell’attività amministrativa possano divenire inutilizzabili un domani, come invece potrebbe accadere qualora i formati siano di tipo proprietario. Quindi ben venga la scelta radicale verso i formati aperti, che intendono garantire a priori l’utilizzabilità dei file. Per la pubblica amministrazione ciò deve essere considerato rilevante e sarebbe opportuno che tutte le software house iniziassero a considerare imprescindibile la standardizzazione dei formati, optando definitivamente per i formati aperti.</p>
<p>Quanto alla soluzione che esige il necessatio ricorso all&#8217;open source software, invece, qualche perplessità rimane. Per determinati enti, infatti, con particolar riferimento «alla Regione [Toscana] e agli enti e organismi dipendenti dalla Regione, ivi compresi quelli di consulenza sia della Giunta regionale che del Consiglio regionale», «agli organismi privati, comunque denominati, controllati dalla Regione», nonché «alle aziende sanitarie e agli enti del servizio sanitario regionale», l’art. 26 della legge regionale 54/2009 impone aprioristicamente l’adozione dell’open source, senza preoccuparsi di porre l&#8217;attenzione sulla necessità di valutare se, nel caso concreto, le soluzioni di tipo proprietario siano migliori o meno di quelle a codice aperto.</p>
<p>I due modelli di business, infatti, non si contrappongono in modo tale che il software OS sia necessariamente migliore del software di tipo proprietario, potendosi verificare anche il contrario. Potrebbe cioè verificarsi che venga sviluppato un applicativo non buono con rilascio del codice sorgente aperto, così come potrebbe verificarsi che una società specializzata in un determinato settore sviluppi con logiche di tipo proprietario un software che non ha eguali tra quelli rilasciati con il modello dell’open source. E&#8217; dall&#8217;analisi del caso concreto delle singole soluzioni che si comprende se sia migliore, per quell&#8217;applicazione, il software proprietario o quello con codice sorgente aperto.  </p>
<p>Poiché la qualità del software non è dipendente dal modello di business utilizzato per svilupparlo, non ha molto senso abbracciare a priori un modello anziché un altro. È a parità di qualità del software che il modello open source dà evidenti vantaggi rispetto al modello di sviluppo che segue le logiche proprietarie.</p>
<p>È per questo che la normativa nazionale, dalla direttiva Stanca al codice dell’amministrazione digitale (d.lgs. 82/2005), fissano principi ed indicazioni per consentire alle pubbliche amministrazioni di scegliere la soluzione migliore tra open source software e software di tipo proprietario. La scelta va valutata caso per caso nell’ambito della procedura di acquisizione, condotta secondo le regole fissate, in Italia, dal Codice dei contratti pubblici.</p>
<p>Del resto, una soluzione aprioritica per un modello di business va ad incidere in maniera drastica sul mercato, alterandolo, dato che nega ingiustamente alle software house o agli sviluppatori e programmatori che offrono prodotti software di tipo proprietario la possibilità di concorrere per la fornitura di cui la pubblica amministrazione necessita.</p>
<p>C’è invero anche il dubbio che l’art. 26 della L.R. n. 54/2009, della Regione Toscana, pur lodevole negli intenti, possa risultare viziata perché contrastante con la normativa nazionale e comunitaria, sia con riferimento al codice dell’amministrazione digitale, che con riferimento al codice dei contratti pubblici e alle norme sul regime di libera concorrenza tra gli operatori nel mercato unico europeo.</p>
<p>Al di là del possibile pregiudizio degli operatori del settore informatico che si conformano al modello di tipo proprietario, il rischio è anche che si vada ad incidere, paradossalmente, sul principio di imparzialità, efficienza e buon andamento della pubblica amministrazione sancito costituzionalmente all’art. 97 Cost., proprio con riferimento all&#8217;organizzazione dei pubblici uffici. Infatti, negare a priori l’acquisizione di software non conforme al modello di business «open source» pregiudica l’efficienza dell’azione amministrativa, nella parte in cui viene rifiutata la soluzione qualitativamente migliore anche ove venga offerta con software proprietari.</p>
<p>A parte tali primi rilievi critici, che vanno sicuramente discussi ed approfonditi, il ricorso all’open source software da parte della pubblica amministrazione merita di essere incentivato, per gli enormi vantaggi che puà arrecare alla P.A.</p>

<blockquote><p>Art. 26 &#8211; Programmi informatici a codice sorgente aperto e formati liberi</p>
<p>1. La Regione, nel rispetto della normativa statale in materia di informatizzazione della pubblica amministrazione, sostiene l’innovazione, incentiva la ricerca e promuove lo sviluppo e la diffusione di programmi informatici a codice sorgente aperto e di formati liberi come strumenti e modalità operative in grado di assicurare la libertà di accesso, l&#8217;interoperabilità tra le applicazioni ed i servizi, l&#8217;uso e lo sviluppo delle tecnologie, il pluralismo e la crescita della competitività nell&#8217;offerta dei prodotti informatici.</p>
<p>2. Per le finalità di cui al comma 1, i soggetti di cui all’articolo 2, comma 1, adottano programmi informatici a codice sorgente aperto e formati liberi.</p>
<p>3. Per le stesse finalità di cui al comma 1, la Regione favorisce ed incentiva l’adozione dei programmi informatici a codice sorgente aperto e formati liberi da parte dei soggetti di cui all’articolo 2, comma 2.</p>
<p>4. Ai fini della presente legge, per assicurare maggiore economicità alle attività della pubblica amministrazione e favorire al tempo stesso la concorrenza nel mercato delle soluzioni informatiche, nelle procedure di valutazione delle gare pubbliche per l’acquisizione di programmi informatici costituisce titolo preferenziale l’uso di codici sorgente aperti o di formati liberi, sulla base di una valutazione di tipo tecnico-economico delle diverse soluzioni disponibili sul mercato e delle esigenze organizzative.</p></blockquote>
<p style="text-align:center;">***</p>
<blockquote><p> Art. 2 &#8211; Ambito di applicazione</p>
<p>1. La presente legge si applica: a) alla Regione e agli enti e organismi dipendenti dalla Regione, ivi compresi quelli di consulenza sia della Giunta regionale che del Consiglio regionale; b) agli organismi privati, comunque denominati, controllati dalla Regione; c) alle aziende sanitarie e agli enti del servizio sanitario regionale.</p>
<p>2. La presente legge, nell’ambito dei rispettivi ordinamenti e nel rispetto delle modalità organizzative di ciascuno, si applica inoltre: a) agli enti locali, ai loro consorzi, associazioni e agenzie; b) agli enti e organismi dipendenti o strumentali degli enti locali; c) agli organismi privati comunque denominati controllati dagli enti locali.</p>
<p>3. La presente legge si applica altresì ai concessionari di servizi pubblici regionali e locali e ai soggetti privati, limitatamente allo svolgimento di attività di pubblico interesse nelle materie di competenza regionale.</p></blockquote>

<li>Conocer la nueva normativa de contratación pública que afecta a organismos de la AGE, las Comunidades Autónomas y las Entidades Locales.</li>
<li>Señalar las características del documento electrónico producido por la e-Administración y los procesos de gestión de las instituciones.</li>
<li>Comprender como garantizar la transparencia administrativa.</li>
</ul>

<p>A particularly exciting area is &#8216;Identity Management&#8217;, as this is where cutting edge Internet developments required to enable this type of open collaboration, for example <a href="http://informationcard.net/white-papers/open-trust-frameworks" target="_blank"><strong>Open Trust Frameworks</strong></a>:</p>
<p><em>&#8220;Open government requires a way for citizens to easily and safely engage with government websites.&#8221;</em></p>

<p><a href="http://informationcard.net/gov" target="_blank">Governments pioneering</a> this evolution include the USA, Canada and France. For example <a href="http://www.cio.gov.bc.ca/idm/" target="_blank">British Columbia</a> has an identity management initiative.</p>

<h2>E-Government 2.0</h2>
<p>For President Obama visionaries such as <a href="http://www.govtech.com/gt/699280" target="_blank">Beth Noveck</a> are pioneering the integration of all of them, so as to greatly improve government service delivery.</p>
<p>She recently authored a book &#8216;<a href="http://www.brookings.edu/press/Books/2009/wikigovernment.aspx" target="_blank">Wiki Government</a>&#8216; to describe how government can be transformed through Web 2.0 &#8220;collective intelligence&#8221; models, building on her earlier groundbreaking work documented in <a href="http://jolt.law.harvard.edu/articles/pdf/v20/20HarvJLTech123.pdf" target="_blank">this Harvard review paper</a>.</p>
<p>Beth describes how an extremely important business process is re-engineered to solve real-world problems and greatly improve performance by moving it from a traditional &#8216;closed&#8217; model where only in-house staff can work on claims, to one where a distributed web of experts are applied a la open source software production.</p>
