<content:encoded><![CDATA[<div class='snap_preview'><p>As I continue discussing employment, unemployment and social media in helping you find a job, I recently read a <a href="http://www.nytimes.com/2009/11/22/business/22corner.html?_r=1&#38;ref=business">New York Times interview</a> with William D. Green, chairman and C.E.O. of Accenture. He discussed, in part, hearing 68 rules during a managers training meeting over three days at Accenture. Baffled by the myriad of rules that bombarded new hires, he realized only three rules really matter in business.</p>
<p>According to Green:</p>
<p>The first rule is <strong>competence</strong> — just being good at what you do, whatever it is, and focusing on the job you have, not on the job you think you want to have.</p>
<p>The second rule is <strong>confidence</strong>. People want to know what you think. So you have to have enough desirable self-confidence to articulate a point of view.</p>
<p>The third rule is <strong>caring</strong>. Nothing today is about one individual. This is all about the team, and in the end, this is about giving a damn about your customers, your company, the people around you, and recognizing that the people around you are the ones who make you look good.</p>
<p><strong>You can apply these rules to your employment search.</strong> In developing your resume and during interviews, you need to make sure your competence, confidence and caring come through.</p>
<p>So let&#8217;s take a look at the three&#8230;</p>
<p><strong><em>Competence.</em></strong> When you apply to a job and prior to an interview, learn about the company. Look up their annual report on the web, check out recent news releases to see what the company is accomplishing. Set yourself apart from the competition by showing competence about the company.</p>
<p><strong><em>Confidence.</em></strong> Show in your cover letter and interview that you are a confident individual. Highlight accomplishments, look the interviewer in the eye.</p>
<p><strong><em>Caring.</em></strong> While it is hard to be choosy in getting interviews in this economy, show how you would be a caring individual to your prospective boss, team, superiors and more.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>There’s good news and bad news associated with yesterday’s announcement by the CIPD of a huge increase in the number of older workers planning to work beyond state pension age. According to their survey of 2,000 working people, 71% of those aged 55 and over are now planning on staying longer compared to 40% two years ago &#8211; with the main driver being “financial factors”.</p>
<p>The good news is that this implies that older people are taking a realistic view of their financial prospects for the future and are taking appropriate steps to deal with impact of the recession and demographic changes. The slightly less clear implication of this is whether or not they will actually be able to realise their plans as, at present, the majority of employers still retain a default retirement age and a right of veto in respect of requests to work beyond this (with no need to justify a refusal).</p>
<p>The bad news – for both employers and older employees &#8211; is that <em>needing </em>to work longer by no means equates to <em>wanting</em> to work longer. As CIPD spokesman Charles Cotton said, “Employers will have to motivate those who wish they could be elsewhere”.  They will indeed – and it will not be an easy task. Those who have to work longer for financial reasons are not necessarily going to be doing so gladly, so the issue of resentment and disengagement may have to be added to the already heady mix of challenges surrounding later life working. </p>
<p>Employers wanting to avoid a range of attitudinal and behavioural problems should start investigating imaginative solutions to making later life working desirable, aspirational and motivating &#8211; without further delay. They need to work with their older employees to find ways to redesign the later years of working life in a way that is meaningful and appropriate for older people, provides good business outcomes, and doesn’t alienate younger generations.  A big ask? Maybe, but not impossible.</p>
<p>A glance at the demographics shows that the scale of the problem is going to be immense and is unlikely to recede greatly once the recession is over. A head in the sand approach will not be the best way forward.</p>

<p>The speech included a pledge to provide agency workers with the same rights as a businesss permanent employees doing the same kind of work in the same place, ensuring more standardised rate of pay, holiday entitlement, breaks, rest periods and allocation of some bonuses.</p>
<p>Steve Willey, HR &#38; Employment Law Consultant at <a href="http://www.yorkshirelawyer.co.uk/index.php?company=32&#38;practice_area=9&#38;address_id=35">Last Cawthra Feather</a> comments: The most obvious effect of the changes will be to increase the cost of using an agency worker. It therefore seems likely that, although individual agency staff will gain, the bigger picture may be that local businesses have no choice but to reduce their reliance on agency staff because the cost advantages of using them are so dramatically reduced, which is, in turn, very bad news for agencies.</p>
<p>As the largest user of agency staff in the EU, estimates suggest that over one million people work in the temporary labour market in the UK. The CBI has estimated that up to a quarter of those posts could disappear if the differences between agency staff and employees were to be abolished.</p>
<p>Steve continues: Our Regional economy makes extensive use of agency workers with local councils, NHS trusts, and thousands of private companies relying on temporary workers to fill gaps in staffing. We have hundreds of small agencies in the region and, whichever side of the argument you are on, it is undeniable that a reduction in the availability and use of agency staff will have a significant impact.</p>
<p>With a general consensus that the Government will be forced to introduce the legislation because it originates from an EU Directive, it is essential that both companies and agencies assess the full extent the changes will have on their business and what can be done to manage the changes in the most effective way possible.</p>
<p>It may well be that local businesses will try and evade the regulations. As the main rights will only apply after an agency worker has been in an assignment for 12 weeks, an attempt will be made to move workers around so they never accrue 12 weeks within one role, adds Steve.</p>
<p>However, with efficiency of agency staff driven by the level of knowledge they have of a role, and bringing new staff in every few weeks often proving disruptive and costly, end users may find avoidance of the regulations a more expensive alternative in the long run. This approach will also expose the agency and business to the risk of a claim from a temporary worker who thinks they are not experiencing equality.</p>

There are things looking up for me, such as my very small pet sitting business. I am marketing it as best I can on a limited budget. Since the unemployment checks are MIA for a while, the pet sitting business is keeping my head above water. I&#8217;m thankful for that. And I love the pet sitting business.</p>
<p>I work daily to get the message out among my neighbors and friends.</p>
<p>Today we will have brunch for John&#8217;s parents. It will be interesting to avoid any political talk. Maybe his dad will enjoy looking at my new collection of Torture Team cards. Will he offer me $5 for John Ashcroft? How much could I get for Dick Cheney? I am moving the Torture Team cards to the home office.</p>
<p>Happy Thanksgiving. Let&#8217;s continue to work for healthcare coverage for all and employment for all of us able to work.</p>

<p>I wanted to read about your points-of-views to make sure we treat our interns (currently 2) as well as possible.</p>
<p>Most of what I read is extremely fair and I too find it sickening that some companies see it as a way to get free labour. I hope this isn&#8217;t as prevalent as some of the articles make out.</p>
<p>One thing I was a little worried about is that it seems some people what internships banning or a minimum wage implemented.</p>
<p>I was concerned that this would ruin the good opportunities for others. The guys that we currently have on board, I hope find working with us extremely useful for experience and know that they will be offered a fair wage a they progress (in fact one of them was offered a wage 4 days in to his internship as he is so good!). But we wouldn&#8217;t have been able to take the risk investing training and time into unproven employees. I know some have qualifications but there so many people with qualifications AND experience looking for work it just wouldn&#8217;t make sense to take them on.</p>
<p>That said we have taken a gamble on a couple of people without even qualifications. One great, one awful.</p>
<p>What I really want to say is that internships are a great way for agencies to test a persons ‘ unproven skills and have a workforce bolstered for little or no cost, and they can be a great way for people to prove themselves and make themselves an invaluable asset.</p>
<p>However we have had a few interns that have missed the point or had a bad attitude and I would say from most of the people I interview graduates have extremely unrealistic expectations. For instance one guy who joined us on a three month contract demanded a £15k wage after just a month &#8211; and a month of arriving late and leaving early! It&#8217;s a pity as he had a lot of potential and if he had a bit more dedication would have fitted in very nicely.</p>
<p>I hope some of this is a useful view of things from an agencies perspective.</p>

<p>1.     Temps can be employed by an agency or directly by the organisation that uses them. If you are not sure who the employer is, it is usually the person who pays the temp their wages. </p>
<p>2.     The end client can be liable for discrimination claims even if an agency is the employer, since temps can be an employee of the agency AND a worker for the client at the same time. These rights do not require any particular length of service. </p>
<p>3.     Temps accrue rights in line with service, just like any other UK employee, which means they are building up rights to National Minimum Wage (NMW) and statutory holiday from day one.  </p>
<p>4.     Temps are entitled to statutory sick pay (SSP) provided they pay national insurance. </p>
<p>5.     Temps with more than four weeks’ service are entitled to statutory notice of one week. </p>
<p>6.     It is possible to contract with temps on a weekly basis, so that you give notice each Monday to terminate each Friday (and thus there is no need to give notice at the end of the temporary assignment). If you want to do this, take advice. </p>
<p>7.     After one month&#8217;s service, temps have the right to a written statement of particulars of employment, and their temporary status should be set out clearly in that document. Theoretically that statement should be issued no later than two months after the start date, but it is always a good idea to get this document out as early as possible. </p>
<p>8.     If you make a mini fixed-term contract and then change your mind, you may be liable to pay the balance of the term. Be careful when recruiting temps that you do not contract for more time than you mean to. </p>
<p>9.     Continuous service has a complex set of rules. For example: if you recruit a temp for, say, four weeks, then another four weeks with a gap in between you can find that the week in between does not ‘count’ for continuity but does not break it either.  </p>
<p>10.    Temps with less than one year&#8217;s continuous service do not have unfair dismissal rights but they do have a full set of discrimination rights.    </p>
<p>Whilst there is currently government consultation on giving temporary workers more rights, no changes have yet been made and temps have no specific right to benefit from the same terms and conditions as their permanent colleagues.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>The secret is to get into management.  What do managers know really?  They don’t have to be rocket scientists and if the employees and line supervisors are really good at their jobs then a manger doesn’t even have to have detailed knowledge of the process or business he is managing.  But is that the only reason why should to look into management as a career?  Actually, no.  One of the main reasons to consider management is, as a famous bank robber once observed, it’s where the money is.</p>
<p>To demonstrate that managers can make big bucks try the following experiment.  For many in the United States, $100,000 a year would be a very good rate of pay indeed.  Try looking for jobs that make four times that much in a job search engine.  The search engine called Indeed at www.indeed.com allows one to search many if not all the underlying job search engines on the internet in one place.  Put $400,000 in the search box and push Find Jobs button.  Skip the jobs that require a doctor’s degree.  Notice that a lot of the remaining jobs have words like “Manager” or “Supervisor” in the title.  In fact jobs at the $300,000 and $200,000 levels often have words like “Director” or “Supervisor” in the title.</p>

<p>Another reason to try the manager career path can be seen by clearing the search box and typing the word “manager”.  Then push the Find Jobs button.  Notice that over half a million manager jobs are listed if no filters as to date, time and location are used.  So almost anyone can find a suitable job in management.  On the left hand side of the Indeed search page there is a heading that says Location.  Clicking on it reveals there are management jobs in every major city in America.</p>
<p>For those with no management experience or not much experience there is still hope.  Many if not most managers started out at low pay with little recognition.  In order to climb the corporate ladder they had to be willing to put the time in and to buy into whatever bill of goods the corporation was selling.  To make the management track work most people are going to need to be willing to start out as a manger in training or and assistant manager at a salary as low as $20,000.  At that stage the main job is to observe other mangers and develop a management style.  And while it can be argued that managers don’t know much they still have to look like they do.  The would be manager must take all the company courses on management and business and he must get at least an Associate Degree on his own time.  Anyone who wants to be CEO one day then must eventually get an MBA degree as well, but entry level mangers in training often just need to be a warm body willing to learn.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p><a href="http://money.cnn.com/2009/11/25/news/economy/initial_jobless_claims/index.htm">NEW YORK (CNNMoney.com)</a> &#8212; The number of first-time filers for unemployment insurance fell to 466,000, the lowest level in 14 months, according to a government report released Wednesday.</p>
<p>That&#8217;s the lowest number in the Labor Department figures since the week ended Sept. 13, 2008, and a decrease of 35,000 from the previous week&#8217;s 501,000.</p>
<p>A consensus estimate of economists surveyed by Briefing.com expected 500,000 new claims in the week ended Nov. 21.</p>
<p>The 4-week moving average of initial claims was 496,500, down 16,500 from the previous week&#8217;s average of 513,500.</p>

<p>Yesterday, I gave an interview of a different sort: for a freelance (re: temporary) position.  Since the criteria, competencies and job itself are different from a more permanent position (that was discussed in part 1), this post is to serve as a reference point for those wondering what their interviewers may be thinking during an interview for a contract job.  Here are a series of tips based on what I found out during the interviews:</p>
<ul>
<li><strong>Asking more questions is a good thing, but don&#8217;t steer the conversation</strong>.  Since the position is time-sensitive and there are a lot of details that you need to know about quickly, it&#8217;s all right to start asking questions almost immediately.  But if you start trying to steer the conversation, it might go in a direction that you don&#8217;t want it to.</li>
<li><strong>You can bring up money on the first interview, but back up your numbers</strong>.  If you are pitching for a job of a certain type and ask how much the competition is charging, your interviewer may give you a large range (ours had a difference of over $100,000 from lowest to highest bids) that won&#8217;t really help you determine how much to ask for.  But if you are throwing out a number, use facts, previous projects, client testimonials and any materials at your disposal to show that you are worth your asking price, or else you may come across as cocky and overpriced.</li>
<li><strong>Be prepared to get an offer for something you didn&#8217;t come to meet about</strong>.  My company has several projects in the pipeline, and we found that one of our candidates was better-suited to working on a different project than the one he came to interview about.  Despite changing the conversation to reflect the other position, he kept clinging to the first project, and lost out on actually getting the job we could have hired him for.</li>
<li><strong>Don&#8217;t make assumptions about your employer&#8217;s business, especially if you haven&#8217;t done your research</strong>.  The same interviewee had not bothered to look up any information about our company, and jumped right into his assessment of a project that we were showing him &#8211; but that project was completed months ago, and was actually quite successful.  He put his foot in his mouth so severely that it left a bad taste on the rest of the interview.</li>
<li><strong>Speaking of that, make sure to do your research</strong>.  It helps if you know what a company does, has done, what its competencies are, what its limits are, and so on.  This way, you can tailor your approach (and payment figure) to the specifications that will make you seem more attractive, qualified and <em>employable</em> to interviewers.</li>
<li><strong>Speaking &#8220;business&#8221; is not as essential, but make sure you sound socially competent</strong>.  A number of interviewees for the position are technical workers, and as such, did not understand much business jargon or many of the results-driven terms that were used during the interview.  But that&#8217;s okay &#8211; it&#8217;s almost like speaking another language.  However, being able to understand what your interviewer is asking you (and what they want the person they eventually hire to do) is critical, so ask for clarification if you need it.</li>
<li><strong>Don&#8217;t make your knowledge gaps apparent</strong>.  If you start trying to lead the conversation, the interviewer may touch on certain points that expose weaknesses in your experience or knowledge.  If asked if you know something, or about it, at least show more interest or learning potential than saying &#8220;no.&#8221;  That makes you seem unpleasant and unwilling to compromise.</li>
<li><strong>Leave a great last impression</strong>.  I was one of two interviewers yesterday, and although I did not do the majority of the talking (the other interviewer did, as he understands technical stuff better), my assessment is still a part of determining if someone is hired.  When one candidate left, they forgot to acknowledge me or <a href="http://canhasjob.wordpress.com/2009/07/14/handshake/">shake my hand</a>, doing so only with the other interviewer.  As a result, I was less impressed with this candidate.</li>
</ul>
<p>If you&#8217;re going to enter the freelancer&#8217;s world, make sure that you are armed with the right knowledge to get the best results from your interviews as possible.  The tactics that work when applying for full-time positions don&#8217;t necessarily apply.</p>

<title><![CDATA[Employees Must Be Paid for Work Performed...No Matter What!]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p>I was on my friend, Matt McNeil&#8217;s <a href="http://radiotime.com/program/p_111119/Matt_McNeil.aspx" target="_blank">radio show</a> this past Sunday. Matt hosts a talk show on Saturday and Sunday afternoon on KSTP 1500 AM. He is nice enough to invite guests like me to his show to ask us questions about our work and ourselves and to give us a forum to talk. This was the third time that I have been a guest on Matt&#8217;s show.</p>
<p>Each time, we have been brave enough to open the lines to callers, and this past Sunday, we got many calls with very interesting questions. One caller in particular caught my attention. This man was an employee at a local company. At the beginning of the year, his employer told him that he wouldn&#8217;t be able to pay him for the first two weeks of the year (even though he had worked) because the company just didn&#8217;t have the money to pay his wages. So the caller&#8217;s question was whether this was legal. No, it isn&#8217;t!</p>
<p>Employees have a right to be paid for the work they perform. It doesn&#8217;t matter whether the company is low on money, has no money or needs to pay off other debts. Employees must be paid and must be paid on a regular basis (weekly, bi-weekly or monthly) at least once every 31 days according to Minnesota law. These are obligations that can&#8217;t be altered.</p>
<p>A similar Minnesota law states that terminated employees must be paid immediately at the time of discharge. If the wages aren&#8217;t paid and the employee makes a demand for them, the employer then has 24 hours to pay the unpaid wages or risks a penalty equivalent of a day&#8217;s wages, up to 15 days.</p>
