Myth: There must be elements of physical restraint, physical force, or physical bondage when identifying a trafficking situation.

Reality: The legal definition of trafficking does not require physical restraint, bodily harm, or physical force. Psychological means of control, such as threats, or abuse of the legal process, are sufficient elements of the crime. Unlike the previous Federal involuntary servitude statutes (U.S.C. 1584), the new Federal crimes created by the Trafficking Victims Protection Act (TVPA) of 2000 were intended to address “subtler” forms of coercion and to broaden previous standards that only considered bodily harm

Myth: If the trafficked person consented to be in their initial situation or was informed about what type of labor they would be doing or that commercial sex would be involved, then it cannot be trafficking or against their will because they “knew better.”

Reality: A victim cannot consent to be in a situation of human trafficking. Initial consent to commercial sex or a labor setting prior to acts of force, fraud, or coercion is not relevant to the crime, nor is payment.

Myth: Victims of trafficking will immediately ask for help or assistance and will self-identify as a victim of a crime.

Reality: Victims of trafficking often do not immediately seek help or self-identify as victims of a crime, due to lack of trust, self-blame, or training by the traffickers. It is important for law enforcement to avoid making a snap judgment based on the first interviews and understand that trust will take time to develop. (Polaris Project Cheat Sheet)

If not physically abused, through coercive religious manipulation techniques, a polygamist wife can find herself in a psychologically destructive system resulting in oppression, exploitation, worthlessness, submission, micromanagement, loss of independence, misuse of authority, verbal abuse, public humiliation, and confusion. This situation parallels domestic violence and prostitution. Consequently many of the women who leave polygamy do so with their own flaming case of PTSD.  Symptoms are more severe and long lasting when the stressor is of human design.

POLYGAMY STUDY PROVES SADNESS, DEPRESSION, AND DISTRESS

• One study found that children from polygamous families reported more distress, depression, anxiety and problems in establishing social relationships than those from monogamous households.

• Children from polygamous families also have much lower self-esteem and tend to quarrel with their fathers more.

“There is always going to be tension between the women, which ends up creating different camps in the family,” Krenawi said. “The father tends to prefer the junior wife and abandons the senior wife and her children.”

• Men in polygamous families are also not generally happy with their situation, mostly due to the constant arguing between wives.

• Women in polygamous marriages showed significantly higher psychological distress, and higher levels of somatisation, phobia and other psychological problems.

That information was on polygamy as it is practiced in Israel. I wonder what additional negative psychological or physical results would show up if valid studies were done on the FLDS communities. The one study I learned about revealed that a rare genetic disease caused by incest and inbreeding in a polygamist community.  It’s called fumarese deficiency, and 95% of all cases in the world are identified in one polygamist group.   Fumarase deficiency causes encephalopathy, severe mental retardation, unusual facial features, brain malformation, severe epileptic seizures, inability to walk or even sit upright, severe speech impediments, failure to grow at a normal rate, and tragic physical deformities and epileptic seizures. “Polygamy leads to sexual predation, and that leads to genetic problems,” says Rehabilitative Services’ Dr. Theodore Tarby who treats these children. “If you stop the sexual predation, you stop the genetic problem as well. But [FLDS members] don’t think of it as sexual predation. That’s the big problem.”Their brains, he says, “are strangely shaped” and are frequently missing large areas of brain matter that has been replaced by water. An MRI of the brain of one fumarase deficiency child showed that more than half the brain was missing. Phoenix News Times

Imagine that you are a religious female who has never had sex. Your male leader assigns you to copulate with a man over which you have no choice. You may despise the man you have been assigned to, but you must do it anyway. You are now that man’s possession throughout your mortal life and in the hereafter. The consequence of this “assignment” is that you must sweetly serve and obey this man you do not love until the day you die, even if he mistreats you. And then to top it off, you give birth to multiple children who are missing large areas of their brain and who have tragic physical deformities. If you leave, you are indoctrinated to believe you will then burn in hell.

Where is the free will in this?  How did this female make a choice of her own? How is this NOT HUMAN TRAFFICKING through psychological bondage?

Depressing, isn’t it? On the bright side, protective legislation is introduced at state and federal levels each year to combat the increase in domestic and international sex trafficking in the United States.  Often these efforts are sidetracked by conflicting ideas of women’s rights and controversy over the nature of consent.  The federal Trafficking Victims Protection Act (TVPA) requires that force, fraud or coercion be proven to establish the crime of sex trafficking. Minnesota law, on the other hand, does not require force, fraud or coercion. Additionally, Minnesota law specifically stipulates that consent is not a defense to the crime of promoting prostitution. This is tremendous progress.  Maybe someday soon lawmakers nationwide will explore a similar theory when it comes to “required for exaltation” polygamy, or any type of coercive religious manipulation in human trafficking, particularly by cult leaders.

What interests me the most about the parallels between prostitution and polygamy is that many people who see prostitution as an opportunity for empowerment for women see polygamy as the opposite.  In fact, I would argue the contrary.  Prostitution and polygamy share more common values than dissimilar ones.  Those values include a view of women as tools of men, female bodies as tradable commodities, and social superiority of men over women.

She stirred a little flurry of comments – ( some I pasted below again)- because these comments are what riled me up and compelled me to write this blog. I have nothing against the author, but it does show that the citizens of the United States desperately need some education.

A man named Mike commented on Amanda’s blog as follows:

“What’s the difference between a hiring a prostitute and having a mistress. GEEZ; Maybe we oughta outlaw that too. Come to think of it; why don’t we outlaw vibrators. Maybe more women will be looking for a man to have sexual relations with.”

I could barely stomach this male entitlement point of view; both are just female bodies to ejaculate in, what’s the difference to the man?  No doubt Mike was just echoing what he has heard plenty of Neanderthalic men before him say. Now men, let’s take off our jock straps and try some empathy.  Let’s put ourselves in these women’s shoes and imagine the difference in their circumstances. What does the mistress do for a living and what does the prostitute do?  Which one has had more bruises? What’s the difference between the living conditions and abuse levels of a prostituted woman and a mistress?  Which one feels she can go to the police if she is raped and which one feels she can’t? Which gets raped as part of her job? Which has more choices? What is the difference in the condition of their hearts and souls?  And the comment about outlawing vibrators so more women want to look for men to have sex with?  I know that was tongue-in-cheek, but what does that have to do with anything? Do men simply deserve more sexual service?

A few comments later he wrote:

“Yes; sometimes there IS brainwashing. But what about those times when there isn’t? What about polygamy where the women are all willing and over 18 years of age? …What about a high end escort who is selling sex not through force, but of her own free will?”

Should I remind him that “all willing” and “over 18″ is irrelevant? Or that the males in Mormonish polygamy are “ordained” with the authority to preside over the women, and tell them what to do, at the peril of their eternal futures? Should I remind Mr. Mike that 75% of escorts selling sex through their own “free will” have attempted suicide?  Should I ask Mike if he has ever paid a woman for her services, and if so, did he stop to ask if his “free will” sex worker if she was free to leave if he found her another job?  Men who use prostituted women don’t discriminate between those who are there of their own “free will” and those who are there because they have no other way to earn money and those who are owned and controlled by evil traffickers. This is why Sweden has decriminalized prostitution for the women, considering them victims regardless of “free will,” but have kept it a criminal offense for the men.

This final comment, if you remember from Part 1, was the last straw for me.

Men who use prostitutes are not necessarily raping the women. It all depends on the situation. If a man purchases the services of a high end escort who is working in the sex industry OF HER OWN FREE WILL; it is not rape. Comparing the ultimately evil trafficking with either consensual prostitution or polygamy is utterly moronic…Legalize CONSENSUAL prostitution and put a stop to trafficking. Keeping the two issues hopelessly tied together by the fact that both are illegal offers the victims of trafficking no hope for deliverance.

I disagree with you Mike.  Vehemently.  In fact, keeping the issues hopelessly tied together might be the only chance for deliverance some trafficking victims will ever have.
