Więcej mówi pełna angielska nazwa organizacji: Frontex czyli &#8220;<a href="http://www.frontex.europa.eu/" target="_blank">European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union</a>&#8221; (Europejska Agencja Zarządzania Współpracą Operacyjną na Zewnętrznych Granicach Państw Członkowskich Unii Europejskiej).</p>
<div style="text-align:justify;">Jak informują oficjalne strony rządowe (<a href="http://www.mswia.gov.pl/portal.php?serwis=pl&#38;dzial=367&#38;id=4569" target="_blank">MSWiA</a>), w dniu 26 października 2004 r. Rada Ministrów ds. Sprawiedliwości i Spraw Wewnętrznych przyjęła Rozporządzenie Rady (WE) NR 2007/2004 ustanawiające Europejską Agencję Zarządzania Współpracą Operacyjną na Zewnętrznych Granicach Państw Członkowskich Unii Europejskiej. Z kolei, w dniu 14 kwietnia 2005 r. Rada Ministrów ds. Sprawiedliwości i Spraw Wewnętrznych zadecydowała, iż siedzibą Agencji Frontex będzie Warszawa (Rondo ONZ). Agencja rozpoczęła formalną działalność 1 maja 2005 r., faktyczną zaś 3 października 2005 r. Dyrektorem Wykonawczym Agencji Frontex jest Gen. Bryg. Ilkka Laitinen.</div>
<p style="text-align:justify;">Zgodnie z art. 1 Rozporządzenia Agencję tworzy się mając na względzie zintegrowane zarządzanie granicami zewnętrznymi Unii Europejskiej. Ma ona “ułatwiać stosowanie istniejących i przyszłych ustaleń wspólnotowych odnoszących się do zarządzania granicami zewnętrznymi poprzez zapewnienie koordynacji działań Państw Członkowskich w zakresie wdrażania tych ustaleń poprzez wspieranie wydajnej, ujednoliconej i na wysokim poziomie kontroli granicznej i ochrony granicy na granicach zewnętrznych UE”.</p>

<li>&#8220;koordynowanie współpracy operacyjnej pomiędzy Państwami 	Członkowskimi w zakresie kontroli ruchu granicznego i ochrony granicy 	na granicach zewnętrznych;</li>
<li>wspieranie Państw Członkowskich w szkoleniu narodowych Straży Granicznych;</li>
<li>przeprowadzanie analizy ryzyka;</li>
<li>prowadzenie bieżącej obserwacji rozwoju badań w zakresie kontroli 	ruchu granicznego i ochrony granicy na granicach zewnętrznych.</li>
<li>wspieranie Państw Członkowskich w przypadkach, w których wymagana 	jest zwiększona pomoc techniczna i operacyjna na granicach 	zewnętrznych;</li>
<li>koordynowanie współpracy operacyjnej pomiędzy państwami 	członkowskimi w zakresie wydaleń obywateli państw trzecich nielegalnie 	przebywających w Państwach Członkowskich&#8221;.</li>
</ul>
<div style="text-align:justify;">Oznacza to blokowanie imigracji, swobodnego przemieszczania się i deportacje osób &#8220;nielegalnie przebywających na terytorium Wspólnoty&#8221;. Tym samym, Frontex ma za zadanie koordynować, wpierać i szkolić służby odpowiedzialne za &#8220;bezpieczeństwo&#8221; granic zewnętrznych UE. Służą temu rozszerzone prerogatywy, jakie przyznano tej unijnej agencji &#8211; półjawność podejmowanych działań, inwigilacja środowisk imigranckich, tworzenie nowych jednostek specjalnych, nowych baz danych. Dlatego też Agencja Frontex jest w stałym kontakcie z innymi wspólnotowymi i unijnymi organami odpowiedzialnymi za &#8220;bezpieczeństwo&#8221; granic zewnętrznych, takimi jak EUROPOL, CEPOL, OLAF, a także z organami odpowiedzialnymi za współpracę celną i współpracę w zakresie kontroli fitosanitarnych i weterynaryjnych.</div>

<div style="text-align:justify;">Agencja prowadzi prace nad wspólnym programem szkolenia (core curriculum) dla Straży Granicznych Państw Członkowskich. Szkoleniem tym objęci są instruktorzy narodowych Straży Granicznych Państw Członkowskich. Dodatkowo Agencja organizuje uzupełniające kursy szkoleniowe i seminaria dla funkcjonariuszy właściwych służb narodowych Państw Członkowskich z tematyki związanej z kontrolą ruchu granicznego i &#8220;ochroną granicy&#8221; na granicach zewnętrznych oraz wydaleń obywateli krajów trzecich.</div>

<div style="text-align:justify;">Agencja dysponuje sprzętem technicznym do kontroli ruchu granicznego i &#8220;ochrony&#8221; granicy na granicach zewnętrznych. Są to środki służące inwigilacji, monitorowaniu granic, jak i sprzęt militarny pozwalający na &#8220;koordynowanie lub organizowanie wspólnych operacji Państw Członkowskich&#8221; w celu wydalenia (czytaj: deportacji) osób &#8220;przebywających nielegalnie na terytorium UE&#8221;. Jak czytamy na stronach rządowych: &#8220;Agencja wypracowuje najlepsze praktyki uzyskiwania dokumentów podróży i wydalania obywateli państw trzecich przebywających nielegalnie w Państwach Członkowskich.&#8221; Wspomniane &#8220;praktyki&#8221; to: deportacje (do tzw. &#8220;bezpiecznego kraju trzeciego&#8221;, &#8220;kraju pochodzenia&#8221;, czy &#8220;kraju UE odpowiedzialnego za przeprowadzenie procedury deportacyjnej) tworzenie i wspieranie funkcjonowania systemu obozów dla uchodźców wewnątrz i na zewnątrz granic unijnych (np. na Ukrainie, Białorusi, czy w Afryce północnej), osadzanie w aresztach deportacyjnych, przeprowadzanie operacji specjalnych o charakterze militarnym poza granicami UE (np. na Morzu Śródziemnym bądź w Afryce płn.).</div>

<content:encoded><![CDATA[<div class='snap_preview'><p>Ten persons have been arrested in Bulgaria and Poland at the end of November as a result of a EUROPOL-supported investigation on a criminal network -active in the illegal production of skimming devices, payment cards counterfeiting and illegal cash withdrawals all over the EU. The investigation is still ongoing.</p>
<p>House searches in Bulgaria, also, uncovered two illegal production sites of skimming devices, ready to be fitted to many different types of ATMs (Automatic Telling Machines) used all over Europe. Several hundred counterfeit payment cards, raw card data, skimming devices, electronic equipment (micro cameras, PIN pads), and tools used for production of counterfeited credit cards, were also seized in both Bulgaria and Poland.</p>
<p>The successful operation was carried out by the Bulgarian Counter Organised and Serious Crime Directorate, in cooperation with the Polish and Austrian Police supported by Europol. With this operation, law enforcement prevented significant financial losses, which could easily have amounted to several thousand euros per cloned counterfeit card.</p>
<p>&#8220;The success of this operation would not have been possible without excellent cooperation between the Bulgarian, Polish and Austrian Law Enforcement Agencies and Europol&#8221;, says Rob Wainwright, Director of Europol.</p>
<p>Europol coordinated the operation and supported investigators through exchange of information, technical and forensic expertise as well as with operational analysis.</p>
<p>&#8220;Skimming&#8221; &#8211; the copying of a payment card’s magnetic stripe without the knowledge and consent of the card holder &#8211; generally takes place when a payment card is used at a genuine ATM or Point of Sale terminal by its cardholder. The data are then written (cloned) to new cards followed by illicit cash withdrawals, mainly taking place in countries other than where the cardholder resides.</p>
<p>The skimming devices are often used in conjunction with a pinhole camera or a fake pin pad to read the cardholder’s PIN at the same time. The advice to the public is to immediately inform the bank or police if anything unusual is spotted on or around the ATM machine or if there are possible signs of tampering, without using the machine.</p>

<p><strong><big>First, there was ClimateGate – the scandal with hacked emails suggesting scientists have abused data for research on global warming. Now, another international climate scandal is emerging that may have an impact on the talks in Copenhagen.</p>
<p>Europe&#8217;s top police body Europol, the closest thing that European Union has to the American FBI, has exposed a massive fraud with the union&#8217;s official market in carbon credits, the Emission Trading System.</p>
<p>The fraud is costing taxpayers in a handful of European countries more than five billion euro – 7 billion dollars – and raises doubts about the effectiveness of carbon trading as a measure to curb emissions.</p>
<p>Europol director Rob Wainwright issued the following statement:</p>
<p>These criminal activities endanger the credibility of the European Union Emission Trading System and lead to the loss of significant tax revenue for governments.</p>
<p>Police authorities in Belgium, Denmark, France, the Netherlands, Spain and the United Kingdom have worked together in what Europol calls a process to identify and disrupt the organised criminal structures behind these fraud schemes.</p>
<p>Lets see if we can explain the scheme, using this graphic provided by Europol.</p>
<p>The fraud is based on a what tax experts and investigators call as a Carroussel fraud with missing traders. This carroussel generates money by stealing value-added tax from governments.<br />
The first step of the criminals is to open a trading account with a national carbon registry, in the name of a newly registered company.</p>
<p>From there, this company buys EU emission allowances in another country on one of the six official carbon exchanges in Europe.</p>
<p>After that, these emission allowances are moved to another country, and subsequently sold to an unregulated broker in yet another country.</p>
<p>This broker then charges VAT on these transactions but does not pay the collected VAT to the tax authorities.</p>
<p>Just before the tax authorities realize that this company owes them huge amounts of VAT, basically a period of a few months, the company and its owners disappear.</p>
<p>A new company is set up, using other front men, to repeat the carroussel. Crime rings that run such schemes can have several dozen or hundreds of companies whose real owners are difficult to trace.</p>
<p>Basically, this type of fraud is possible because European countries continue to disagree on single market tax legislation. Carroussel fraud is a constant feature in the European cross-border market and until recently only happened with shipments of valuable goods such as iPods or flat-panel TVs, not with carbon credits.</p>
<p>Europes tax commissioner, in an interview with EUX.TV, has estimated the damage from these carroussel frauds at more than 60 billion euro per year as Euroean finance minister continue to disagree on effective measures to fight this fraud.</p>
<p>The Emission Trading System system was set up in 2005 as part of Europes efforts to curb emissions of greenhouse gases. That topic now is at the top of the agenda at the UN Climate summit in Copenhagen this week and next. This unprecedented and massive fraud is likely to prove a major embarrasment for EU negotiators.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>After a two year investigation, Operation Typhon, an international operation into child sex offenders on the Internet, has been concluded. House searches conducted in 19 countries &#8211; Austria, Belgium, Bulgaria, Canada, Denmark, France, Germany, Hungary, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Romania, Slovakia, Slovenia, Spain, Switzerland and the United Kingdom &#8211; enabled the identification of 221 child sex offenders of which 115 have been arrested.</p>
<p>Some of the offenders are teachers or caretakers, professional backgrounds them made them even more dangerous for children &#8211; and worsen their position before law.</p>
<p>The investigation has also led to the identification of 5 children in different countries, aged between 4 and 12, who were the victims of sexual crimes.</p>
<p>The investigation was led by the Austrian Criminal Intelligence Service (.BK) which detected an internet service provider misused by child sex offender groups to distribute illegal content on the Internet. Log files collected by the .BK were sent to Europol together with the child abusive images. After structuring and analysing the content, Europol provided intelligence packages and analytical reports to the EU Member States and those countries affected with a Europol cooperation agreement.</p>
<p>&#8220;Child sexual abuse is one of the most horrific crimes so I am extremely pleased that Europol together with our partners have been successful in having these offenders identified and arrested. But most of all I am glad to see that vulnerable children have been identified and saved from further harm,&#8221; says Rob Wainwright, Director of Europol.</p>
<p>Europol has so far supported 23 international operations. These cases, involving EU member states and other countries with a Europol operational agreement, have so far led to the identification of around 1600 child sex offenders and the identification and rescue of many victims.</p>

<p>The Hague Convention on the Civil Aspects of International Child Abduction created an international treaty and legal mechanism in order to find children that have been abducted. This is just one treaty or law that has been enacted in order to recover children that have been taken away from their loved ones. However, it is really important to make sure that every state has a means to deal with and track down children that have gone missing. Children get abducted for a number of reasons: •Intent to raise the child as their own<br />
•A parent takes the child from the other parent’s care<br />
•For ransom</p>

<p>Despite the seriousness of child abductions it is not publicized enough. This may in part be because the statistics are not very clear. Data collection by different organizations can differ drastically from the definition of “abducted child” to a motivation explanation. Consequently, comparing the numbers is not very helpful or simple. The need for a transnational database is evident in that it will help ascertain the significance of the missing children problem.<br />
Fortunately, in 2007 the European Commission declared the telephone number “116000” to be the single telephone number in the EU to make pressing calls about 3missing children. By securing a single hotline number, hopefully the “116000” number will help this lack of communication that can occur between the EU countries.<br />
Despite this effort to create a line of communication across European borders there is still not a child alert system that would create a network to look for children who may have been taken into a different country.<br />
The United States has a number of different laws that focus on this topic exclusively by engaging in actively preventing crimes against children as well as, similar methods to handle situations in which children go missing. With the ease of crossing borders in Europe it becomes apparent that it can be difficult to work with countries that follow different procedures to help children and this creates a complicated setting to recover and protect children efficiently and safely.<br />
Missing Children Europe is one organization that is tirelessly working to improve and enact legislation that will improve the mechanisms to help children across the European Union while simultaneously working to improve the quality and communication of existing means of handling missing children cases.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Twenty-two people have been arrested today as a result of a joint police operation in France, Greece, Italy, the Netherlands and the United Kingdom.  The arrested persons are suspected of smuggling around 2000 illegal immigrants, mainly from Iraq, into the EU. During a house search also 7 possible illegal immigrants were discovered.</p>
<p>This pan-European investigation started eighteen months ago. In its course a smuggling route via Turkey to Greece and onwards via Italy, through Central Europe to Scandinavian countries was identified.  Europol experts prepared several intelligence reports, facilitated the exchange of information and coordinated the police operations.</p>
<p>The main suspects and new criminal links were discovered in close cooperation with national experts after in-depth analysis. Europol also hosted several preparatory operational meetings and the involvement of both Eurojust and Interpol has been important for the success of the operation.</p>
<p>Investigators found out that illegal immigrants paid up to 2000 Euros for a trip from Paris to UK or Sweden. A trip in a truck cost between 700-1000 Euros. A trip in a car (more secure) with a driver is around 2000 Euros. Sometimes the whole family of an illegal migrant, or even their communities, had to cover the costs.</p>
<p>It was also again established that organised crime groups are very flexible and innovative when it comes to committing crime whilst using various means of transportation and quickly changing modus operandi. One of the methods used is hiding inside trucks.</p>
<p>Recently, a truck transporting flour was found to contain an additional 18 illegal immigrants onboard.</p>
<p>Today’s operation was the third in a row coordinated by Europol since June 2008. During the previous two operations 78 and 46 suspects were arrested. In cooperation with several EU Member States, Interpol and Eurojust, new operations towards these internationally operating criminal networks are foreseen in the future.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>A new campaign launches on the 1st October in Europe to <a href="http://euro-data.noblogs.org">reclaim your data from the European police authorities</a>.</p>
<p>Now in Europe, national police databases systems, the Schengen Information System (SIS) on immigration and border control, the files of Europol and more, are planned to be integrated following the Prüm Treaty and <a href="http://stockholm.noblogs.org">the so-called &#8216;Stockholm Programme&#8217;</a> (now in preparation for European Council vote in December this year).</p>
<p>As the organisers make clear, this does not just concern people convicted of any crime, but all immigrants, political protestors arrested at demonstrations, all the many entirely innocent people included on the UK&#8217;s National DNA Database &#8211; or any other national police database that includes data on the innocent, etc. What&#8217;s more, as a result of pre-existing (and originally secretly negotiated) agreements with the USA, the data will also be shared with the FBI and other US intelligence agencies.</p>
<p>So &#8211; first of all, protest! In what ever way you can. And secondly, as the campaign suggests:</p>
<p>&#8220;to anyone who would like to know what the police (think they) know about you, or simply to register your dissent, we recommend exercising your right to access your own data by sending a request for information to the relevant police authority in your country. The digest received in response will help to give us an idea of the full extent of police access to citizen data, as well as serving as a starting point for getting your data out of the computer systems, by legal or political means.&#8221;</p>

<title><![CDATA[ASFIC/PJ: "Não esquecemos"]]></title>

<p>«Não esquecemos que desde há cerca de dez anos a esta parte que a <a href="http://www.asficpj.org/" target="_blank">ASFIC/PJ</a> denuncia e luta para que sejam resolvidas algumas situações que representam a violação dos mais elementares princípios e direitos, umas inseridas num contexto laboral e outras no contexto organizativo e institucional.</p>
<p>São portanto situações, algumas delas, que persistem desde há vários anos e de responsabilidade partilhada e transversal aos vários governos que foram, sucessivamente, assumindo os destinos do país.</p>
<p>Apesar da referida responsabilidade partilhada, não podemos deixar de referir que resultado da política do actual <a href="http://www.portugal.gov.pt/pt/GC17/Pages/Inicio.aspx" target="_blank">governo</a>, todos os problemas persistem e alguns foram ainda agravados.</p>
<p><span style="text-decoration:underline;"><strong>No contexto laboral: </strong></span></p>
<p>Não esquecemos a falta de vontade na redefinição do modelo e regimes de trabalho, sua prestação e devida remuneração. Referimo-nos aos regimes de disponibilidade (funcional), piquete, prevenção e trabalho extraordinário;</p>
<p>Não esquecemos que não nos foi apresentada qualquer proposta de Estatuto, o que desde logo inviabilizou a possibilidade de adequação dos conteúdos funcionais das várias categorias da carreira de investigação criminal à realidade;</p>
<p>Não esquecemos que nunca foi resolvida a falta de apoio jurídico aos funcionários da carreira de investigação criminal quando assumem num processo crime uma posição diferente da de arguido, mesmo quando se tratam de actos praticados em serviço ou de factos relacionados com o serviço e por força do exercício das sua funções;</p>
<p>Não esquecemos as condições agravadas de acesso aos regimes de aposentação e disponibilidade, com especial enfoque para o facto do actual <a href="http://www.mj.gov.pt/sections/o-ministerio/gabinete-do-ministro-da/curriculo-do-ministro-da8249/" target="_blank">Ministro da Justiça</a> nunca se ter dignado fixar o contingente de funcionários a colocar na disponibilidade como decorre da Lei;</p>
<p>Não esquecemos ainda o facto de numa profissão de risco e desgaste rápido como é a de investigação criminal, se ter aumentado a idade mínima para a aposentação dos 55 para os 60 anos;</p>
<p>Não esquecemos a vontade velada de imposição do <a href="https://www.siadap.gov.pt/PaginasPublicas/Siadap.aspx" target="_blank">SIADAP</a> aos funcionários de investigação criminal, como se as tarefas desenvolvidas nesse âmbito fossem comparáveis e mensuráveis, tal qual, o resultado de uma linha de produção mecanizada;</p>
<p>Não esquecemos o agravamento das condições de acesso à protecção social dos cônjuges do pessoal de investigação criminal no âmbito dos <a href="http://www.sg.mj.pt/sections/home" target="_blank">SSMJ</a>;</p>
<p>Não esquecemos o corte intencional das capacidades financeira e organizativa às associações sindicais, resultante das disposições impostas pela publicação do RCTFP (<a href="http://www.cite.gov.pt/Legis_Nac/ArquivoLN/LeisArqLN/Lei59_08.htm" target="_blank">Lei nº 59/2008 de 11 de Setembro</a>);</p>
<p><span style="text-decoration:underline;"><strong>No contexto organizativo e institucional: </strong></span></p>
<p>O que o fez este governo na área da JUSTIÇA PENAL e da INVESTIGAÇÃO CRIMINAL?</p>
<p>A actuação deste <a href="http://www.portugal.gov.pt/pt/GC17/Pages/Inicio.aspx" target="_blank">Governo</a>, nestas áreas, pode ser resumida em poucas palavras: QUASE TUDO FOI MAL FEITO.</p>
<p>Todas as reformas de âmbito penal e criminal, introduzidas por este Governo tiveram, como não podiam deixar de ter, resultados desastrosos, sobretudo, para as cada vez mais desprotegidas vítimas dos crimes.</p>
<p>A ASFIC/PJ juntou-se, imediatamente, como não podia deixar de acontecer, durante a fase da sua discussão pública, ao coro de críticas aos malfadados diplomas (<a href="http://www.portugal.gov.pt/pt/Documentos/Governo/MAI/Alteracao_Organizacao_Investigacao_Criminal.pdf" target="_blank">LOIC</a>, LSI, LOPJ, alterações penais, etc.), que irmanou juízes, magistrados do ministério público, funcionários judiciais, muitos ilustres penalistas e polícias numa simples ideia: estas leis não servem a Justiça e o combate contra o crime.</p>
<p>De facto, as alterações introduzidas não serviram para tornar mais eficiente a investigação criminal, mas para a complicar ainda mais e não serviram, de igual sorte, para defender a vítima, mas sim, exclusivamente, para facilitar a defesa do suspeito e do arguido.</p>
<p>Como todo o mundo judiciário intuiu, desde logo, todas as leis penais foram elaboradas a pensar em casos concretos e no modo de tornar mais labiríntico o já de si complicado labirinto jurídico, para que seja possível, sobretudo, na área da criminalidade económico-financeira e da corrupção, suscitar nulidades processuais, por tudo e por nada, e complicar o desenvolvimento normal das investigações e dos julgamentos.</p>
<p>O Governo, em vez de clarificar criou confusões  indesejáveis, como, por exemplo, a figura aberrante das «competências partilhadas». Onde antes cada polícia sabia exactamente o que lhe competia (LOIC  2000), agora são todas competentes para fazer o mesmo (LOIC 2009), o que, claramente, visou acentuar a necessidade de coordenação entre  polícias  e assim melhor justificar a intromissão da administração interna em áreas que lhe deviam estar vedadas.</p>
<p>Não distinguiu, propositadamente, em termos de regras, os processos relativos à criminalidade violenta, organizada e complexa &#8211; mormente a criminalidade económico-financeira e a corrupção, que são os crimes que mais preocupam muitos políticos, porque lhes  pode  «tocar»  directamente -, dos crimes de massas, nivelando-os a nível de tratamento e de prazos. Isto fragilizou a investigação dos crimes mais perigosos, mais violentos e organizados, que devem ter um tratamento diferente das demais investigações.</p>
<p>São, por demais, os exemplos negativos que ficam para a história, como iniciativas legislativas pensadas, quase exclusivamente, para proteger os interesses dos suspeitos e dos arguidos, em vez dos interesses das vítimas e da sociedade em geral.</p>
<p>A alteração dos pressupostos das detenções fora de flagrante delito não só criou enormes dificuldades à prevenção e à investigação criminal, como se tornou num factor de desincentivo do empenho policial.</p>
<p>A forte limitação da possibilidade de aplicação da prisão preventiva, só podia ter tido como desfecho, como teve, o aumento exponencial de situações absolutamente incompreensíveis para o cidadão comum e para os polícias, que justificavam, plenamente, a sua aplicação, tendo em atenção, quer a perigosidade e o perigo de reincidência  de muitos arguidos, quer a gravidade de muitas situações.</p>
<p>O resultado mais evidente foi o aumento do descrédito na JUSTIÇA, que varreu transversalmente toda a sociedade, inclusive os próprios operadores judiciários, ainda por cima, vilipendiados, pela tutela, como incompetentes ou pouco produtivos, como cortina de fundo para dissimular os verdadeiros responsáveis por este estado de coisas: os diversos poderes políticos.</p>
<p>Aumentaram os entraves ao recurso a alguns meios excepcionais de obtenção de prova, designadamente as escutas, que se fundamentaram, em grande parte, numa campanha de desinformação da opinião pública – um alegado, mas completamente falso descontrolo e exagero no número de escutas efectuadas em Portugal, que na realidade fica muito aquém do número das que são efectuadas, proporcionalmente, na maior partes dos outros países da UE, omitindo, por exemplo, que em muitos destes países se fazem dezenas de milhares de «escutas administrativas», ou seja, que não passam pelo crivo de um JUIZ, &#8211; o que teve como efeito, a sua redução substancial, com efeitos negativos ao nível da investigação criminal.</p>
<p>Mas, ao mesmo tempo que se defende restrições das escutas na investigação criminal (dependentes da autoridade judicial) começa-se a preparar a opinião pública para a necessidade de atribuir a realização legal de escutas, a serviços «incontroláveis» que, pela sua própria natureza, obedecem a dinâmicas que os conduzem, amiúde, para tarefas e caminhos inaceitáveis num estado de direito.</p>
<p>Ao generalizado encurtamento de prazos para a investigação e às supra referenciadas dificuldades criadas, não correspondeu, como seria lógico, um investimento proporcional em meios humanos e materiais, ignorando-se, completamente, que estes já eram escandalosamente insuficientes, sobretudo, na  <a href="http://www.pj.pt/" target="_blank">PJ</a>, cujo quadro, nos últimos anos, tem vindo sempre a decrescer e tem tido uma taxa de preenchimento do efectivo sempre a rondar os 50% (nos últimos 10 anos).</p>
<p>No que concerne à PJ, não somos só nós que o dizemos, pois a situação da nossa instituição é por demais evidente aos olhos dos outros operadores judiciários, com destaque para a opinião de António Martins, Presidente da <a href="http://www.asjp.pt/" target="_blank">Associação Sindical dos Juízes Portugueses</a>, que considerou e muito bem, numa entrevista dada ao <a href="http://www.correiomanha.pt/" target="_blank">Correio da Manhã</a>, em 30 de Agosto que, «<a href="http://www.asficpj.org/temas/noticias/2009/agosto/Grande%20entrevista%20Antonio%20Martins.pdf" target="_blank">A PJ FOI PRATICAMENTE DESMANTELADA DURANTE ESTE GOVERNO</a>».</p>
<p>Este Governo diz ter dotado a PJ de uma nova lei orgânica com instrumentos legais de organização orientados para o combate à criminalidade organizada, complexa e violenta, mas a verdade seja dita: a única coisa que mudou realmente foi a designação dos departamentos, que passaram a ter siglas impronunciáveis, em substituição de designações míticas com prestígio acumulado. De resto, o Governo manteve a vetusta estrutura da PJ para combater a actual, crescente, super equipada e altamente especializada CRIMINALIDADE ORGANIZADA.</p>
<p>Idêntica percepção é fácil de encontrar entre os magistrados do Ministério Público, que não podem deixar de se sentir indirectamente prejudicados com o definhamento e a asfixia económica que tem sofrido o seu principal órgão coadjuvante, que é a PJ, com quebras orçamentais que, em alguns anos, destes últimos, atingiram os 60%.</p>
<p>Na esteira de preocupações similares que têm vindo a crescer e que começam a justificar uma acção comum, o <a href="http://www.smmp.pt/" target="_blank">Sindicato dos Magistrados do Ministério Público</a> e a ASFIC/PJ vieram a  público, esta semana, manifestar uma «<a href="http://www.asficpj.org/temas/noticias/2009/smmp_asfic24set.pdf" target="_blank">profunda preocupação com o actual modelo de organização da investigação criminal</a>», considerado por ambas as organizações «demasiado permeável à instrumentalização política», permeabilidade «que as recentes alterações legislativas (Lei da Organização de Investigação Criminal, Lei da Segurança Interna, Lei Orgânica da Polícia Judiciária e Estatuto do Ministério Público) acentuaram».</p>
<p>Com efeito, através desses diplomas assistiu-se a uma perigosíssima invasão de áreas da JUSTIÇA, por parte de sectores da ADMINISTRAÇÂO INTERNA, directamente dependentes do poder político (<a href="http://www.portugal.gov.pt/pt/GC17/PrimeiroMinistro/Biografia/Pages/Biografia.aspx" target="_blank">Primeiro-Ministro</a>).</p>
<p>É unânime, menos neste governo e nos sectores que tradicionalmente perfilham doutrinas securitárias e militaristas (hierarquias das forças armadas e das forças de segurança de matriz histórica militar, etc.), que esta política de segurança interna conduz, inevitavelmente, a uma governamentalização da informação e da investigação criminal.</p>
<p>Para implementar essa governamentalização criou a figura de um <a href="http://www.mai.gov.pt/actualidades_d.asp?id=638" target="_blank">Secretário-geral do Sistema de Segurança Interna</a> (SG-SSI), que depende directamente do Primeiro-Ministro, com funções de coordenação da investigação criminal (!) e poderes de organização e gestão administrativa, logística e operacional dos serviços, sistemas, meios tecnológicos e outros recursos comuns dos órgãos de polícia criminal, incluindo o <a href="http://www.portaldocidadao.pt/PORTAL/pt/noticias/08_2009/NEWS_leis+regulam+sistema+integrado+de+informacao+criminal+e+troca+de+informacao+na+ue.htm" target="_blank">Sistema Integrado de Informação Criminal</a> (!).</p>
<p>O governo ousou mesmo, numa dada altura, pretender colocar na dependência do SG-SSI, a <a href="http://www.interpol.int/" target="_blank">INTERPOL</a> e a <a href="http://www.europol.europa.eu/" target="_blank">EUROPOL</a>, subtraindo à PJ, a responsabilidade da ligação com estas entidades (mesmo sabendo que 95 % da informação criminal processada por essas duas entidades diz respeito a criminalidade da competência reservada da PJ). E não deixou de manter o <a href="http://www.mai.gov.pt/data/livro/4b.htm" target="_blank">Gabinete SIRENE</a>, na esfera da Administração Interna, não ignorando, igualmente, que a esmagadora maioria da informação que por ali passa também é de interesse exclusivo da investigação criminal.</p>
<p>Para os principais operadores judiciários (Juízes, Magistrados do Ministério Público e PJ) não existe qualquer dúvida nestes pontos: a gestão e a coordenação de toda a informação criminal tem de regressar, rapidamente, a quem, em termos constitucionais e da lei, detém a acção penal e a direcção da investigação criminal, ou seja, tem de voltar à esfera do Ministério Público e do seu principal órgão auxiliar, a Polícia Judiciária, que foi quem, historicamente, com boas provas dadas, no domínio da integridade da informação criminal e das investigações, assegurou, até à presente legislatura, todos «os recursos nos domínios da centralização, tratamento, análise e difusão, a nível nacional, da informação relativa à criminalidade participada e conhecida…»</p>
<p>Infelizmente, nesta campanha eleitoral, todos os partidos, sem uma única excepção relevante, decidiram lançar os temas da JUSTIÇA PENAL e da INVESTIGAÇÃO CRIMINAL, para o fundo da lista de temas a abordar.</p>

<p>Innere Sicherheit galt bislang als Kernaufgabe moderner Nationalstaatlichkeit. Um den veränderten Erscheinungsformen von Kriminalität effektiv zu begegnen, musste sich die Art der Prävention und Repression entscheidend ändern. Jürgen Storbeck &#8211; ehemaliger Direktor von <a href="http://www.europol.europa.eu/" target="_blank">Europol</a> &#8211; erscheint auf Grund der Internationalisierung der Kriminalität auch die Internationalisierung der Verbrechensbekämpfung das wichtigste Vorhaben zu sein.</p>
<p>&#8220;Wir können nicht mehr von einer kleinen Behörde in Tirol, in Bayern, in Brandenburg gegen eine große weltweit agierende Organisation ermitteln. Da haben wir nur eine Froschsicht auf das Kriminalitätsgeschehen statt der notwendigen Adlersicht&#8221;, so Storbeck. Daher ist eine gemeinsame europäische Intelligence-Arbeit notwendig, um eurpaweitem Verbrechen effizient zu begegnen.</p>
<p>Denn Europa ist heute nicht nur ein gemeinsamer Wirtschafts- und Sozialraum, sondern auch ein gemeinsames kriminalgeographisches Gebiet. Mit der &#8220;Froschansicht&#8221; können nur kleine Teile der organisierten Kriminalität erkannt werden. &#8220;Damit können wir sie nicht wirklich ausschalten, sondern nur die Glieder dieser kriminiellen Organisationen, die unbedeutenden Mitglieder. Das war eigentlich die Idee der Gründung von Europol&#8221;, sagt Storbeck.</p>
<p><strong>Schengen und Europol</strong></p>
<p><a href="http://www.dsk.gv.at/site/6226/default.aspx" target="_blank">Schengen</a> und Europol verdeutlichen eindrucksvoll den Fortschritt betreffend einer europäischen Kooperation im Polizeibereich. Beide wurden mit dem Ziel errichtet, einen Raum der Freiheit und der Sicherheit in Europa zu schaffen.</p>
<p>Durch den Abbau von Grenzkontrollen wurde die Einsetzung von Ausgleichsmaßnahmen notwendig. Diese sollen helfen, die Sicherheit zu erhalten. Demgegenüber ist die Verhütung und Bekämpfung der grenzüberschreitend agierenden Kriminalität die zentrale Aufgabe der Europol. Im Gegensatz zu Schengen, welches insbesondere auf den Fahndungsbereich ausgerichtet ist, dient Europol zur aktiven Recherche bei Ermittlungen und zur intelligenten Auswertung von Daten.</p>
<p>Auf Grund der schwerfälligen Konsensfindung auf EU-Ebene, neigen die Mitgliedstaaten dazu, polizeiliche Befugnisse im nationalen Einflussbereich zu halten. Storbeck betont: &#8220;Polizeiliche Arbeit, die Ausübung von Exekutivmaßnahmen, auch gegenüber dem eigenen Bürger, ist ureigenstes staatliches Verhalten. Das will man nicht abgeben.&#8221;</p>
<p>Europol wird daher in absehbarer Zeit weder Exekutivbefugnisse erhalten, noch zu einer europäischen Polizei aufsteigen. Vielmehr soll Europol eine strafverfolgende Behörde für Schwerverbrechen werden, von welchen mehrere Mitgliedstaaten betroffen sind. Europol wird demnach ausschließlich für europaweit agierende organisierte Kriminalität zuständig sein.</p>
<p><strong>Die Zukunft für Europa</strong><strong> </strong></p>
<p>Auch die Justizbehörden der EU-Staaten arbeiten immer enger zusammen. Mit <a href="http://www.eurojust.europa.eu/" target="_blank">Eurojust</a> wurde 2002 das Vorgehen der zuständigen Behörden der Mitgliedstaaten bei der Verfolgung schwerer grenzüberschreitender und organisierter Kriminalität verstärkt. Weiters liefert Eurojust schnelle Information über fremdes Straf- und Strafverfahrensrecht.</p>
<p>Einen Quantensprung bezüglich der polizeilichen Kooperation in Europa stellt der <a href="http://www.bmj.bund.de/enid/Internationale_strafrechtliche_Zusammenarbeit/Pruemer_Vertrag_v1.html" target="_blank">Vertrag von Prüm</a> dar. 2005 von den Gründerstaaten Österreich, Deutschland, Frankreich, Spanien und den Benelux-Staaten unterzeichnet, soll der Vertrag zur Vertiefung der grenzüberschreitenden Zusammenarbeit in Europa beitragen.</p>
<p>Mit &#8220;Prüm&#8221; gewähren sich die Staaten gegenseitig Zugriff auf ihre Polizei-Datenbanken und damit den Austausch von beispielsweise DNA-Profilen, Autohalterdaten und Fingerabdrücken. Gleichzeitig regelt die Vereinbarung auch die Unterstützung bei Großereignissen, grenzüberschreitende Verfolgungsfahrten und liefert Informationen über politische Aktivisten und Migranten.</p>
<p>&#8220;Europol hat wie keine andere Behörde ein gemeinsames polizeiliches Bewusstsein geschaffen. Dadurch ergibt sich wirklich ein proeuropäischer Ansatz&#8221;, ist der ehemalige Europol-Chef Storbeck überzeugt. Das wird durch Verträge wie Prüm weiterentwickelt.</p>
<p>Für die polizeiliche Zusammenarbeit in Europa wurden damit wesentliche Impulse gesetzt. Zunehmend sind die EU-Staaten dazu bereit, sich in Sicherheitsfragen europaweit zu koordinieren. Der Grundstein für eine einheitliche, rechtliche und freiheitsorientierten Union ist damit gelegt.</p>

<p><strong>Nine Irish organised crime gangs, with some 40 criminals involved, are operating across Europe, according to the European police intelligence agency Europol.</strong></p>
<p>The agency said today it was tracking the activities of 100 separate organised crime gangs with the help of intelligence from various national police forces.</p>
<p>Many of the gangs are believed to be involved in major drug smuggling operations across the continent.</p>
<p>The Assistant Garda Commissioner Dermot Jennings said today the gardaí are working “very closely” with their counterparts in Europe to provide information on the activities of Irish criminals abroad.</p>
<p> </p>
<p>Speaking in Mullingar today, Assistant Commissioner Jennings said that alongside 26 other European Police forces, members of An Garda Síochana are based with Europol in The Hague on a full-time basis and they are “up to date” with the activities of a variety of Irish criminals known to be operating on foreign shores.</p>
<p>“We work very closely with Europol and indeed with Interpol and other organisations including the FBI, and there is an open flow of information between the police force here, Northern Ireland, the UK and Europe with regard to organised crime in, and from, this country.”</p>
<p>He would not specify if there has been an increase in the information passing through the organisations in recent months, but communication between organisations “is improving all the time</p>

Planul UE vizeaza de asemenea masuri drastice impotriva furtului de informatii si distribuirea de troieni sau virusi pe internet. Planul care se va desfasura pe o perioada de cinci ani a primit acceptul ministrilor europeni si va fi finantat cu 300.000 de euro, pentru a infiinta un sistem de centralizare a rapoartelor infractiunilor on-line si alertarea in timp real asupra atacurilor. Printre alte „masuri practice” se numara si colaborarea intre fortele de politie si companiile private, pentru a monitoriza metodele si trendurile din sfera infractionalitatii on-line. Noua politie on-line va efectua „cautari la distanta” in hard diskurile persoanelor suspecte si vor efectua patrulari on-line pentru a descoperi infractorii. Uniunea Europeana a declarat, de asemenea, ca vor fi instituite reglementari si organisme care se vor asigura ca Legea protectiei datelor nu va fi incalcata.</p>

<p>Europol said it and the Italian &#8216;carabinieri&#8217; paramilitary police had arrested 34 suspects in Italy as well as in France, Germany, Greece, the Netherlands, Spain and San Marino. Members of the criminal group had also worked with two Italian doctors to organise forced abortions, the Hague-based agency said.</p>
<p>Europol said investigations had focused on groups located in the coastal Marche region of Italy, where victims were held in criminal cells led by &#8216;madames&#8217; and had to hand over all their earnings to pay off debt incurred for their journey to Italy. &#8220;The victims were subject to continued intimidation and violence, aimed at guaranteeing a daily income and to ensure their compliance,&#8221; Europol said in a statement.</p>
<p>After providing victims with counterfeit documents, some were trafficked through the Netherlands and France where they were met and accompanied to Italy by members of the criminal group, while others came by sea or through Turkey and Greece.</p>
<p>The arrests follow a police bust of a drug trafficking network in April, in which drugs were smuggled from Madrid in Spain to the Italian regions of Piedmont and Marche by using drug &#8216;mules&#8217;, who were often the women forced into prostitution.</p>
