It is often stated that the employer’s most valuable asset is its employees. Most employers invest thousands of dollars selecting and training employees. They also spend thousands of dollars on employee benefit programs and work conditions in order to minimize employee turnover. At the heart of this effort is the development of a positive, trusting, productive relationship between the employer and employee. A work-related injury is, among other things, a major test of this relationship. If the organization fails to show compassion, fails to provide prompt, quality medical care, or treats the employee in a judgmental way this relationship may be destroyed. To make matters worse, employees talk and the word will spread throughout the organization.

Ultimately reducing the total cost of worker injures is all about winning the hearts and minds of employees. Only by sharing the same organizational values and demonstrating these values throughout the pre-injury and post-injury stages of the worker injury can this be accomplished over the long term. As an example, the following are the suggested guidelines for performing the accident investigation with compassion:

1. Treat the employee like you would like to be treated. The “Golden Rule” will serve you well. Anytime you are unsure of what to do or how to do something, just ask yourself “How would I like to be treated in this situation?” More often than not the employee feels the exact same way.
2. Show concern. It is very important to show sincere concern for the employee’s injury, no matter how minor it is. Always take care of the employee’s injury first, and then begin the interview.
3. Put the employee at ease. Use a friendly approach in dealing with the employee. Avoid sarcasm, blame, and threats. Use tact in clearing up any discrepancies in the employee’s story.
4. Explain why the incident investigation is necessary. Emphasize that fact-gathering and prevention is the organization’s objective and not faultfinding. Convey that the organization is sincerely trying to find out what happened and what can be done to prevent it from happening again.
5. Listen carefully. Get the injured employee’s story first before asking questions. Be sure to listen very carefully and avoid interrupting the employee.
6. Avoid “why” questions. Ask any necessary questions that you feel are appropriate but void any “Why” questions as they tend to make the employee defensive. While asking a “Why” question is part of the “root cause analysis” process, it should not be used during the employer interview process as it will only make the employee feel uncomfortable and resist answers.
7. Always repeat your understanding of the story. It is very important that, after listening to the employee, that the investigator repeat exactly what he or she understood the employee to say. This verifies that the investigator has understood what was said and allows the employee the chance to correct the story if necessary. If there are still misunderstandings, the investigator should take the time to correct the misunderstandings to both party’s satisfaction.
8. Always ask the employee for suggestions. Employees are an excellent source of safety suggestions. Up until the injury occurred the employee was probably thinking: “This will never happen to me” - but it did. Take the time to discuss ways to prevent the reoccurrence of the situation. This may also be an excellent training opportunity.

These techniques will significantly reduce both the direct and indirect workers compensation costs, improve your overall workers compensation claim management program, and improve workers compensation disability management.

The case in this POST comes out of Massachusetts where the cases are not quite stopped, but almost so — AND where property title insurance companies are NOT underwriting ANY policy that covers a home whose mortgage was securitized.

The primary point that needs emphasis here is that as you read this case you will see that if you give the Court something SOLID to hang its hat on, you can get the results you want.

The mistake being made repeatedly out there is simple: either the homeowner or the lawyer goes in with a legal argument addressing the conclusions of the case instead of directing the Judge’s attention to the beginning of the case — discovery, motions to compel, TRO etc. based upon discovery requirements.

The obvious requirement that you need to know in your mind what you are talking about it so you know the significance of the issue legally seems to  have escaped all but a few lawyers. Many lawyers are taking half baked “audits” going to court and making legal arguments about a report they have not read, do not understand and which does not contains all the elements needed anyway.

You must educate the Judge not lecture him. You must NOT rely on securitization in your preliminary arguments because it sounds like legal maneuvering to get out of a legitimate debt.

Unfortunately these mistakes are being made even by people who have attended our survey courses. So we are expanding our offering by adding DVDs, Boot Camps and home study.

We are discontinuing our own efforts at forensic review because we don’t actually have the time or manpower to engage in a large venture. We will start to refer cases to forensic analysts and lawyers.

BUT we are are starting courses to train, and certify forensic analysts who pick up even the most minute flaw in a document — like a document you you know in your heart is fabricated and forged but feel intimidated by the process of proving it.

And we are starting specific courses on training forensic analysts and attorneys how to be expert witnesses, how to prepare expert declarations and affidavits and how to defend your expert declarations in deposition or in an evidentiary hearing. The course is also for lawyers who feel they could use a little support on direct and cross examination of experts.

I have no real expertise in the stock market.  One thing I have found tho is that there is no shortage of people who claim that they do.  Google “Share Market Expert”  Results in about 101,000,000.

Of course most of these experts just want some of your money. Probably because they could not make much in the market. What Iv decided to do is gather up as much free info as possible and teach myself by paper trading while I try to save some cash.

It is absolutely essential that your claim management team communicate with the injured employee, healthcare providers, claim adjusters, and attorneys early and often throughout the claim process. Otherwise their “systems” will control them. This communication should be provided both in verbal and written form and well documented. And, because this communication will be performed by many members of the claim management team, it is essential that the team members communicate effectively with each other as well.

Here are proven communication techniques that work effectively:

1. Formalize and communicate your claim management policy. The organization must develop and communicate claim management procedures and policy. This manual will provide information and sample policy templates in a number of key areas. Claim management policy establishes the ground rules for everyone in the organization to follow in the event an employee is hurt on the job. These policies must be fully understood by all members of the claim management team so that infractions are accurately identified and proper action is taken in accordance with organizational policy.
2. Explain the claim process to the injured employee. Successful organizations are proactively communicating with their injured workers throughout the claim management process. This starts the very first day the employee is injured and includes an explanation of what they can expect from the claim process, how their medical bills are going to be paid, and who they can contact for questions.
3. Establish claim procedures with the claim adjuster. It is critical that the claim management team have a formal and detailed meeting with the claim adjuster(s) who will handle the organization’s workers compensation claims. At this meeting the claim management team should review communication procedures with insurance company adjusters so that everyone is on the same page. It is also important to review the organization’s entire claim management process with the claim adjuster and discuss how the organization expects them to communicate with members of the claim management team as they adjudicate each type of claim. In this regard, it is important that the claim management team work with the insurance company to write “Claim Service Directives” that are consistent with mutual expectations.
4. Establish prompt response procedures with the treating physician. The first 48-hours after a worker injury are critical and the healthcare facility has a vital role in it. It is recommended that the organization’s Prompt Injury Response Program be discussed in detail with the treating physician so that everyone is on the same page. If the claim management team senses that the healthcare provider wants total control over the claim process this should be a sign of future problems. It is also recommended that the claim management team discuss the fact that the organization offers a Temporary Duty Program in full compliance with state and federal laws and that it expects all medical providers to fully support the organization in its effort to identify and assign these temporary tasks where medically permissible.
5. Always have on-going communication with the injured employee. The claim management team must stay in constant contact with the injured employee from the date of injury until they are released to come back to work. The injured employee must communicate with the Claim Coordinator at least on a weekly basis and the Supervisor must be in periodic contact with the injured employee as well.

These techniques will significantly reduce both the direct and indirect workers compensation costs, improve your overall workers compensation claim management program, and improve workers compensation disability management.

Safe Aim Mutual Sdn Bhd (SAM), event promoter for PETRONAS AAM Malaysian Cub Prix Championship announced its provisional race calendar for 2010, featuring another 10 highly action-pack rounds beginning from March till December next year.

It’s going to be one race in each month for the 2010 season. The curtain raiser leg will kick off in Alor Setar, Kedah on March 19-20, followed by Kluang, Johor on April 17-18 and move up to Batu Kawan on May 8-9. Then Sepang Circuit (North) will play host on June 12-13, Kuala Terengganu on July 9-10 and next is Kota Bharu, Kelantan on August 7-8.

As usual the championship will take a break during the fasting month and also Hari Raya. The race will resume on September 25-26 at Malacca. The venue for Round 8 is yet to be confirmed but it will be held on 23-24 of October. Round 9 will take place at the Sepang Circuit (South) on 20-21 November while the season finale, in Penang on December 4-5.

Much alike this year, the opening leg and final round for next season will be held right in the heart of the city where the population is high.

According to Ron Hogg, Promotions Director for SAM, the event promoter are also eyeing for new venues to add into the race calendar. “Though at the moment we have 10 venues, we are still on the lookout for new sites to organize the Malaysian Cub Prix. It will spice things up as it offers a different set of challenge for the riders and their respective teams. Not just that, even the sponsors and fans hopes to see new locations as well.”

“For example, this year we introduced the Malacca International Motorsports Complex (MIMC), Pekan, Alor Setar and Penang tracks which made the event more interesting and exciting,” he said.

When asked if more rounds will be added to the Championship, Ron clarified, “We are at the maximum amount of rounds. To add more rounds we will need more venues, a high volume of riders, teams and sponsors. Therefore for now we will not be adding more rounds to the Championship but maybe in the future we might just,” concluded Ron.

Penganjur Kejuaraan Cub Prix Malaysia AAM PETRONAS, Safe Aim Mutual Sdn Bhd (SAM) mengumumkan kalendar Cub Prix tahun 2010 hari ini. Bermula pada Mac hingga Disember tahun hadapan, Kejuaraan Cub Prix ini dijangka akan mengegar Malaysia dengan 10 lagi perlumbaan sengit.

Berdasarkan kalendar 2010, satu perlumbaan akan dianjurkan pada setiap bulan. Pusingan pembuka tirai akan berlangsung pada Mac 19-20 di Alor Setar, Kedah diikuti pusingan seterusnya di Kluang, Johor pada April 17-18 dan Pusingan 3 di Batu Kawan, Mei 8-9. Litar Antarabangsa Sepang (Utara) pula akan menjadi hos pada Jun 12-13, Kuala Terengganu pada Julai 9-10 dan Kota Bharu, Kelantan pada Ogos 7-8.

Seperti musim-musim sebelum ini, Kejuaraan Cub Prix akan berehat seketika bagi menyambut ketibaan bulan Ramadhan dan juga Hari Raya Aidilfitri. Perlumbaan hanya akan bermula semula di Melaka pada September 25-26. Venue Pusingan 8 masih belum ditentukan tetapi tarikhnya adalah pada Oktober 23-24. Bukan itu sahaja, saya yakin penaja dan para peminat Cub Prix juga ingin melihat lebih banyak venue baru,” ujar Ron.

“Sebagai contoh, tahun ini kami memperkenalkan trek baru seperti Kompleks Sukan Bermotor Melaka (MIMC), Pekan, Alor Setar dan Penang. Bukan sahaja ia menarik minat penduduk di kawasan tersebut ia juga menjadikan perlumbaan lebih menarik dan mendebarkan,” tambah Ron.

Apabila ditanya jikalau wujud rancangan untuk menambah jumlah perlumbaan, Ron berkata, “Kami kini berada di puncak dengan 10 pusingan. Jikalau kami berhasrat untuk menambah lagi, kami memerlukan tempat baru, jumlah pelumba, pasukan dan penaja yang lebih banyak. Walau bagaimanapun, kami tetap akan mempertimbangkan kemungkinan tersebut jikalau keadaan mengizinkan,” jelas Ron.

Peter Galbraith is one of the Democratic Party’s leading so-called “liberal hawks” and a generally revered Wise Man of America’s Foreign Policy Community. Throughout 2002 and 2003, Galbraith appeared in numerous outlets presenting himself as a loyal Democrat firmly behind the invasion of Iraq.

After playing a key role in enabling the invasion of Iraq, Galbraith first became one of a handful of U.S. officials who worked on writing the Iraqi Constitution. Reider Visser, a historian of southern Iraq, told The Boston Globe last month:  ”Galbraith has been such a central person to the shaping of the Iraqi Constitution, far more than I think most Americans realize. All those beautiful ideas about principles of federalism and local communities having control are really cast in a different light when the community has an oil field in its midst and Mr. Galbraith has a financial stake.”

He later acted as an “unpaid” adviser to the Kurds on the Constitution, working with Paul Wolfowitz. Galbraith was an ardent and vocal advocate for Kurdish autonomy, arguing tirelessly in numerous venues for such proposals and insisting that Kurds must have the right to control oil resources located in Northern Iraq.

What Galbraith kept completely concealed all these years was that a company he formed in 2004 came to acquire a large stake in a Kurdish oil field whereby, as the NYT put it, he “stands to earn perhaps a hundred million or more dollars.”

Prior to Round 9 of the PETRONAS AAM Malaysian Cub Prix Championship that will be held on December 5 and 6, the Sepang International Circuit (South) will be open for testing on Thursday of the race week. It is scheduled to take place on December 3, 2009.

There will be two test sessions for the day. The first will session kick off at 10am till 1pm while the second will begin at 2pm till 5pm. The fee is fixed at RM100 per bike for one session and is open to all the Cub Prix teams and privateer riders.

Unlike other venues in the Cub Prix calendar where the layout is narrow, more focused on technical skills and designed to match the capacities of ‘kapcai’ machines, Sepang (South) is intended more for machines with greater abilities, power, durability and speed.

Therefore the set up required to master this circuit is completely different from the ones used by teams for other venues on the race calendar- hence this is why the promoter, Safe Aim Mutual Sdn Bhd (SAM) is organizing the test session.

Mr. Ron Hogg, Promotions Director for SAM encourages Cub Prix teams to take full advantage of the opportunity given. He says it is utmost essential to make sure each and every element of man and machine is reviewed and tested before the race because the Championship is now at its crucial and final phase.

“Even though, Sepang track is not new to all of us as we have been racing year in and year out but I hope the teams and riders will take the testing session to improve on their bike set-up. One of the challenges I foresee is the weather. In Round 5 that was held in the month of July this season, we were racing under the scorching sun but this time around, we might be racing under a cooler environment as it is rainy season now.”

“Therefore, I believe the test session will not only boost the chances of bagging good results but it will also help ensure the machine set-up is in top form. Furthermore, both the Expert and Wira epg titles are still wide open and I am sure the riders who are in the running for the title chase will want to collect as many points in Sepang,” added Ron.

FHA guidelines will limit the underwriter to insuring the loan for the lower of two values; the offer price or the appraised value (displayed as the As-Is Value). If your offer price is higher than the appraised value, the FHA underwriter will require that your buyer(s) cover the overbid amount with a cash deposit. The buyer(s) will not be allowed to build the overbid amount into an FHA loan.

HUD’s mortgagee letter 2000-27 will require that the FHA UW use the appraisal obtained by PEMCO. This mortgagee letter instructs the FHA UW NOT to obtain a new appraisal; nor can the FHA UW request that new comps be pulled and the PEMCO appraisal updated.

If your offer price is higher than the appraised value and tentative acceptance is extended to you, the options available to you are:

1.       Proceed with contract execution. PEMCO will require that the selling broker verify that the cash reserves are available to cover the overbid amount before we execute the contract.

2.       Use cash or conventional financing. All of the guidelines outlined above apply to FHA financing only. A conventional lender will have their own set of guidelines not governed by HUD.

3.       Cancel prior to contract execution. If there is an acceptable backup, we will award tentative acceptance to the backup offer. If there are no acceptable backup offers, the property will be relisted.

БАРВИХА, Россия (Рейтер) – Президент РФ Дмитрий Медведев сказал, что его белорусский коллега Александр Лукашенко «вероятно» признает независимость двух бывших грузинских автономий – Абхазии и Южной Осетии, хоть Медведев его об этом и не просил.

«Я неоднократно слышал от Александра Григорьевича, что Беларусь рассмотрит этот вопрос и, вероятно, признает эти республики», – сказал Медведев на встрече с белорусскими журналистами.

Россия признала Абхазию и Южную Осетию, одержав победу над Грузией в пятидневной войне в августе 2008 года. С тех пор две автономии, де-факто отколовшиеся от Грузии в начале 1990-х годов, признали только два государства – Никарагуа и Венесуэла.

«Я ни разу не просил признать Абхазию или Южную Осетию лидера Беларуси или какое-либо другое должностное лицо Беларуси; не обращался ни прямо, ни косвенно к лидеру Беларуси с этим предложением. Все разговоры об этом высосаны из пальца», – сказал Медведев.

«Для России, наверное, было бы лучше, если бы эти новые субъекты международного права получили бы больше признаний, но мы никогда не пытаемся этим рулить, это противоречит принципам международного права, – добавил президент РФ.

«Пусть президент определяется, нужно это ему, или нет», – сказал он о Лукашенко.

Минск недоволен сокращением российской финансовой поддержки и критикует РФ за протекционизм, из-за чего Лукашенко воздерживается от расширения сотрудничества в рамках патронируемого Москвой оборонного блока ОДКБ. Москва, в свою очередь, медлит с выдачей Белоруссии очередного кредита на $500 миллионов.

В начале октября Лукашенко посоветовал России «терпеть» ситуацию с непризнанием Минском Абхазии и Южной Осетии, возложив ответственность за ухудшение отношений на российское руководство и сказав, что прекращение поставок газа Минску в 2004 году – «рубец», который «не зарубцуешь».

В ответ на это Медведев в понедельник посоветовал Минску быть сдержаннее.

»…В последнее время со стороны наших белорусских партнеров и самого президента Белоруссии был сделан ряд заявлений, которые выходили за рамки дипломатического протокола. Я имею в виду и членов, и председателя правительства. Мне это не нравится… Это путь в тупик, – сказал Медведев. – Это правительство, которое было назначено Госдумой по моему представлению, когда тот или иной коллега полемизирует с этим правительством, он полемизирует со мной. Тут другого варианта быть не может. Вывод: нужно быть более сдержанным».

Медведев считает, что России и Белоруссии не нужно отказываться от создания союзного государства, даже если оно буксует. Процесс создания союзного государства идет с 1997 года.

«Да, союзное строительство идет не такими темпами, как мы рассчитывали… но зачем же нам разбегаться в разные стороны? – сказал он. – Я сторонник активного продолжения работы по союзному договору и создания более благоприятных условий для дальнейшей интеграции наших экономик».

При этом Медведев не видит угрозы в сближении Белоруссии с ЕС.

«Я не вижу ничего сверхъестественного в Восточном партнерстве с Европейским союзом. Я и пользы не вижу, но не вижу и угрозы для нашей страны, – сказал он. – Если будут какие-то антироссийские обсуждения, мне это не понравится, но я надеюсь, наши партнеры от этого откажутся».

Медведев сказал, что Россия ни де-факто, ни де-юре не приглашала Белоруссию в свой состав, хотя и добавил, что это может быть вопросом для обсуждения.

«Дискуссия на эту тему может идти, но никакого юридического приглашения на эту тему нет», – сказал он, добавив, что для углубления интеграции союзному государству нужно дать больше полномочий.

Президент РФ не исключил предоставление Белоруссии дополнительной помощи, напомнив, что за последние годы Минск получил от Москвы более $3 миллиардов именно потому, что является участником союзного государства.

«Наше товарищество, наши союзнические отношения должны проверяться при помощи особых экономических отношений. Когда я слышу от наших партнеров иногда, что мы недостаточно помогаем, у меня это вызывает удивление», – сказал Медведев.

«Рассматривается вопрос о предоставлении дополнительных кредитов Белоруссии».
