1►Le virement
Une fois votre commande validée, vous recevez nos références bancaires par e-mail.
Votre virement doit être effectué dans les meilleurs délais afin de ne pas être confronté à une éventuelle rupture de stock des produits désirés.
Nous avons une préférence pour le virement effectué via un compte PayPal.
En cas de non réception du virement au bout de 5 jours, votre commande est annulée.
Les virements par remise de chèques, sur notre compte bancaire, ne sont pas acceptés.

2►Le paiement par chèque (uniquement les chèques provenant d’une banque française)
En choisissant ce moyen de paiement, votre commande vous sera livrée sous 15 jours, à compter du dépôt du chèque sur notre compte bancaire, afin de protéger notre clientèle contre une utilisation frauduleuse de leur chéquier et de pallier aux éventuels chèques impayés.
Veuillez rappeler au verso du chèque la référence de votre commande (visible sur le récapitulatif de commande reçu par e-mail).
Votre chèque, dûment complété et signé, sera libellé à l’ordre de : SARL Ainsi va la mode
Aussi, afin de parer à une éventuelle rupture de stock des produits désirés, votre chèque devra nous parvenir, par courrier postal, dans les meilleurs délais, à l’adresse suivante :
En cas de non réception de votre chèque au bout de 7 jours, votre commande est annulée et les produits remis en vente.
Nous n’acceptons pas les paiements par mandat cash et les chèques tirés d’une banque non française.

Article 7 : Réserve de propriété

Conformément à la loi n° 80.335 du 12 mai 1980, les marchandises restent la propriété de www.originalemode.com jusqu’à leur paiement intégral.

Article 8 : Livraison

Les livraisons sont effectuées par La Poste à l’adresse déterminée par le client.
L’acheteur ne peut pas choisir 2 lieux de livraison différents pour une même commande. Il doit, dans ce cas, passer 2 commandes distinctes, avec les frais de livraison liés.
L’acheteur réel est celui dont l’adresse est mentionnée en facturation.
►Suivi colis
Il peut suivre son colis sur www.coliposte.net, avec le numéro de colissimo qui lui sera communiqué lors de sa confirmation d’expédition.
►Impossibilité de livrer la marchandise
En cas de force majeure ou cas fortuit (incendie, vol des outils de travail, intempéries, rupture de stock avec impossibilité de réapprovisionnement auprès du fabricant, accidents, panne interne ou externe, perte de données, grèves des services postaux, des moyens de transport, de communication, des centres d’approvisionnement en carburant, ,…) www.originalemode.com est déchargé de son obligation de livrer.
►Risques liés au transport
L’acquéreur vérifiera l’état général du colis à sa réception. Il est recommandé de le faire en présence du transporteur si possible. En cas de dégradation avéré du colis et de constatation de produits manquants, pendant le transport, il appartient au destinataire de :
- formuler des réserves manuscrites, accompagnées de sa signature, sur le bon de livraison du transporteur
- refuser, le cas échéant, le colis et signaler les raisons de ce refus sur le bon de livraison (à signer également)
- confirmer par lettre recommandée avec accusé de réception, datée et signée, les réserves émises, auprès du transporteur, dans les meilleurs délais, à compter de la livraison.
- envoyer une copie de ces réserves à notre service client par courrier électronique (clients@originalemode.com) ou par courrier. Veuillez rappeler les références de la commande et de la livraison. Votre réclamation ne sera prise en compte que si des réserves manuscrites figurent sur le bon de livraison et si www.originalemode.com a été informé dans les délais impartis.
Autrement dit, aucune réclamation de quelque nature que ce soit ne peut être recevable, si le colis a été accepté sans réserve et si notre société n’a pas été informée dans les conditions susmentionnées.
Une enquête postale sera ouverte (environ une vingtaine de jours) et sa conclusion débouchera ou non sur un remboursement. www.originalemode.com ne peut être tenu pour responsable de ce délai moyen constaté.
►Colis non reçus
30 jours maximum, après la date d’encaissement de votre commande, vous devez nous signaler tout colis non distribué. Passé ce délai, toute réclamation ne sera pas recevable.
►Modes, délais, tarifs de livraison
Les délais de livraison (délais en jours ouvrables) ne sont donnés qu’à titre indicatif, par notre transporteur (La Poste). Cela implique que le client ne peut demander l’annulation de la commande, réclamer des dommages et intérêts ou demander une indemnisation de quelque nature que ce soit.
www.originalemode.com ne pourra être tenu pour responsable en cas de retard imputable au transporteur et pour quelque raison que ce soit.
Les frais d’expédition/de transport sont à la charge du destinataire et sont calculés automatiquement en fonction du pays de livraison indiqué sur le bon de commande, du poids total des produits et du mode de livraison choisi par le client ou déterminé par www.originalemode.com.

En cas d’absence du destinataire, soit la remise du produit se fait à une autre personne habilitée par le client, soit un avis de passage est déposé dans la boîte aux lettres. Dans ce cas, le client dispose de 15 jours, muni de l’avis de passage et de sa pièce d’identité, pour retirer son colis au bureau de poste mentionné sur l’avis. Passé ce délai, le colis est renvoyé à l’expéditeur. Tout renvoi de ce colis à l’acheteur nécessitera le paiement de nouveaux frais d’expédition. www.originalemode.com ne remboursera aucunement la commande.
►Droits de douane
En vertu des lois de certains pays, des taxes d’’importation de produits, des droits de douane,
des taxes sur la valeur ajoutée, sont dus, à la livraison de la marchandise au client final.

Article 9 : Droit de rétractation et retour de marchandise

Conformément aux dispositions des articles L 121 et suivants du Code de la consommation, vous disposez de sept jours francs (le cachet du transporteur faisant foi), à compter de la réception de l’article, pour exercer votre droit de rétractation.
Passé ce délai, aucun retour ne sera accepté, le produit étant considéré comme accepté par l’acheteur.

Aucune demande de remboursement par téléphone ne sera prise en compte.
Aucun renvoi en port dû ou en contre-remboursement ne sera accepté.
www.originalemode.com s’engage à vous rembourser le montant total du ou des articles à retourner, sous 15 jours maximum, suivant la date à laquelle vous avez exercé votre droit de rétractation. En revanche, les frais de renvoi restent à votre charge.
Il appartient à l’acheteur de conserver toute preuve de ce renvoi. Nous vous recommandons donc de retourner la marchandise par voie postale, soit en recommandé soit par tout autre moyen permettant d’enregistrer la date effective dudit envoi.
Le remboursement s’effectuera par virement sur votre compte bancaire ou par chèque, à votre nom.
Si vous optez pour un échange contre un article de prix inférieur, www.originalemode.com vous remboursera soit par : un avoir sur votre compte client, par chèque ou encore par virement correspondant à la différence de prix.
Si l’échange s’effectue contre un article de prix supérieur, vous pourrez régler la différence de prix via un compte PayPal, par virement ou par chèque. Votre nouvelle marchandise ne sera expédiée qu’à réception de l’article retourné et de la réception du solde à régler.
►Produits défectueux

- soit à l’échange, avec prise en charge des frais d’envoi du nouvel article,
- soit au remboursement de la valeur du produit non-conforme (prix de vente le jour de l’achat) et des frais de renvoi vers nos locaux, pris en charge par le client.
►produits manquants
Si un produit vient à manquer lors de l’envoi, par la faute de www.originalemode.com, le produit manquant sera immédiatement expédié à l’acheteur, sans frais supplémentaires, si ce dernier signale l’oubli par mail (clients@originalemode.com) ou par courrier, le cachet de la poste faisant foi

►Erreur de livraison
En cas d’erreur de livraison de notre part, nous prenons en charge vos frais de retour et nous vous proposons un avoir, un remboursement, ou un échange, expédié à nos frais.

Article 10 : Responsabilité de la société

Article 11 : Garantie

En toute hypothèse, le client bénéficie de la garantie légale d’éviction et des vices cachés (Art.1625 et suivants du Code Civil). Les réclamations ou contestations seront toujours reçues avec bienveillance attentive, la bonne foi étant toujours présumée chez celui qui prend la peine d’exposer ses situations. En cas de litige, le client s’adressera par priorité à l’entreprise pour obtenir une solution amiable.
A défaut, le tribunal d’instance sera saisi.

Article 13 : Informations légales

Le renseignement des informations nominatives collectées aux fins de la vente à distance est obligatoire, ces informations étant indispensables pour le traitement et l’acheminement des commandes, l’établissement des factures et contrats de garantie. Le défaut de renseignement entraîne l’annulation de la commande. Article 4 : prices
