Tidak ada yang lebih jahat ketimbang penegakan hukum tanpa keadilan. Hukum tanpa keadilan ibarat tubuh tak bernyawa. Pasal-pasal pada secarik kertas tidak bermakna apa-apa. Pasal-pasal mati.

Patut dicatat, keadilan lebih dari sekadar nyawa bagi dokumen hukum. Institusi penegak hukum pun sepatutnya bernyawakan keadilan. Semua proses yang terjadi pada institusi itu harus bernapaskan keadilan. Proses yang terjadi bukan sekadar memenuhi proseduralitas dan formalitas legal. Kita harus berani mengatakan ini. Formalitas dan proseduralitas legal sekadar sarana bagi keadilan. Apabila sarana itu dipakai untuk melukai rasa keadilan, tidak ada pilihan lain : keputusan politik dijatuhkan berdasar doktrin kedaruratan.

Luka keadilan

Di negeri ini keadilan dilukai berkali-kali. Kriminalisasi KPK baru pemanasan saja. Belum lagi kasus itu terselesaikan, pers mendapat perlakuan sama. Dua unsur pimpinan redaksi dipanggil berdasar laporan pencemaran nama baik oleh Anggodo Widjojo. Sosok satu ini sepertinya berkeliaran di ruang hampa hukum, ikut mengendalikan hukum tanpa dia terjerat hukum.

Dari dua peristiwa itu, kita saksikan luka keadilan lain. Minah, seorang ibu tua, dikenai hukuman percobaan akibat mengambil tiga buah kakao untuk dijadikan bibit. Rasa keadilan kembali terkoyak. Sang hakim tahu, dia memutus berdasar hukum tertulis, bukan rasa keadilan. Dia menjadi hamba secarik kertas, bukan dewi keadilan yang mulia dan sublim.

Compang-camping praktik penegakan hukum berujung pada ketidakpercayaan publik. Ini fatal. Ketidakpercayaan publik terhadap penegakan hukum dipicu absennya keadilan sebagai prinsip dasar sebuah tertib sosial. Keadilan adalah prinsip hidup bersama dalam sebuah tertib sosial bernama negara. Keadilan adalah maksud suci kelahiran negara itu sendiri. Jika maksud suci itu dikhianati aparat negara, alasan keberadaan negara bisa jadi tak ada lagi. Maka, perilaku institusional yang melukai keadilan dapat berakibat hilangnya tertib sosial, bernama negara.

Mungkin hal itu terdengar radikal. Namun, imajinasi kita harus dapat menerobos rezim aktualitas guna menemukan alasan politik. Apalagi kita sudah diingatkan filsuf Prancis, Louis Althusser. Rezim boleh berganti, tetapi aparat ideologis dan represif negara bergeming. Reformasi boleh berjalan lama, tetapi pengkhianatan terhadap keadilan berulang kali dilakukan tanpa punitas. Institusi penegak hukum tetap sama. Itu adalah alat kekuasaan untuk mengamankan diri secara ideologis dan represif dengan memutarbalikkan rasa keadilan masyarakat.

Lalu apa ?

Luka keadilan amat sulit disembuhkan. Politik pencitraan pasti tumpul saat berhadapan dengan rakyat yang terluka rasa keadilannya. Tim 8 sudah selesai bekerja. Rekomendasinya amat komprehensif dan untuk sementara meredam amuk politik rakyat. Namun, kita semua masih berharap, Presiden akan bertindak. Jika tidak (bertindak) dan pasif, dapat membuat kredibilitas Tim 8 rusak. Tim 8 akan dipersepsi rakyat sebagai bagian politik pencitraan.

Luka keadilan sudah cukup dalam. Kita ada di pengujung gerakan sosial yang masif. Rakyat bukan anak kecil yang terdiam setelag diberi baju baru. Hampir di semua media, rakyat yang anonim menjadi subyek lugas dan beridentitas. Rakyat bukan lagi ruang kosong dalam demokrasi. Dia muncul nyata di berbagai forum publik. Rakyat yang nyata memiliki kekuatan yang tidak kalah nyatanya.

Kita sudah menyaksikan bagaimana kriminalisasi tidak hany menyentuh pejabat negara atau pimpinan media. Ketidakadilan sudah dirasakan rakyat jelata bernama Minah. Minah lebih mudah dijadikan ikon guna mengidentifikasikan diri. Kejelataan Minah mampu memompa solidaritas dalam skala besar yang (dapat saja) memiliki konsekuensi politik serius.

Dalam kondisi abnormal seperti ini bukan saatnya berdebat tentang hukum tata negara. Konstitusi adalah dokumen yang dihidupkan keadilan. Konstitusi adalah sarana, bukan keadilan itu sendiri. Kehendak politik yang menciptakan konstitusi harus diperhatikan. Apa kehendak politik itu ? Kehendak politik adalah penciptaan sebuah tertib sosial berkeadilan. Kekuasaan terikat pada kehendak politik itu, bukan pasal-pasal mati konstitusi.

Saat keadulan terluka, kekuasaan dapat mengambil bentuk mistisnya. Kekuasaan eksekutif dapat melepas iktanan konstitusionalnya saat keadilan dalam bahaya. Presiden dapat melepaskan diri dari batas-batas konstitusional dan melakukan intervensi yang diperlukan atas yudikatif. Dengan demikian, Presiden melakukan dua hal sekaligus. Pertama, mengembalikan kepercayaan rakyat. Kedua, meletakkan batu pertama reformasi institusi penegak hukum. Intervensi yudikatif adalah langkah kongkret pertama dalam upaya pemberantasan mafia peradilan.

Presiden Soekarno keras menerabas prinsip Trias Politica saat membubarkan konstituante. Dekrot Presiden 5 Juli 1959 memang menjadi perdebatan hukum tata negara tanpa henti. Namun, dekrit itu, tak dapat disangkal, adalah monumen politik yang menunjukkan kepekaan dan ketegasan Presiden terhadao abnormalitas politik yang sedang terjadi.

Presiden memang tidak perlu bertindak sejauh itu, cukup melakukan dua hal. Pertama, memberhentikan proses hukum Bibit-Chandra. Ledua, mencopot pejabat yang terlibat persekongkolan jahat itu. Setelah itu, proses reformasi institusional berkelanjutan dilakukan. Tanpa itu semua, pemerintahan akan dihantui ketidakpercayaan rakyat yang kian menggumpal. Keadilan mungkin buta, tetapi dia dapat melihat di kegelapan.

A Shaler man faces homicide by vehicle – DUI related and other charges stemming from a fatal accident on an entrance ramp to the Fort Duquesne Bridge in Pittsburgh that occurred in May.  According to the police investigation, the man drove the wrong way on an exit ramp from the Fort Duquesne Bridge and caused a head-on collision, killing one man and seriously injuring two other men.  Charges filed include homicide charges, aggravated assault charges, and traffic violations.

This is another example of the danger created by driving under the influence.  Several lives have been ruined by a driver operating a vehicle while he was much to drunk to drive.  This tragedy could have easily been avoided.  Accident Attorney Thomas Matvey.

For the past week, it’s been hard for Jesse Stormer to stay positive.

“I’ve been trying to find that silver lining, and I’ve struggled to find one, so I decided to make one.”

Soon, Stormer and others will be selling bracelets in memory of their friend Sheldon Harmon, who was killed the Nov. 11 crash on Draketown Rd.

The bracelets will read “WWSD“, as in “What Would Sheldon Do?“.

All proceeds from the bracelet sales will go towards new animation equipment placed in memory of Harmon.  EUP’s Animation Club is backing the fundraiser.

Stormer hopes that the bracelets will help bring about a safer, more responsible university community.

“When people are having a hard day, or facing a difficult decision, they can look at their wrists and ask themselves, what would Sheldon do?”

Students should expect to see the bracelets being sold around campus after Thanksgiving break.

Well folks I had my surgery and thanks be to God for all of your prayers.  I did not have to get an ICD,  instead I got an Implantable Loop Recorder.  This little device which is about the size of a jump drive sits right between the 2 and 4th rib.  The job of the loop recorder is to record all cardiac activity which my doctor can download at any time.  I also wear what is called a Zoll Life Vest.  This vest,  is basically a portable AED.  I wear it next to my skin and it monitors my heart ,however;  unlike the loop recorder,  it actually treats an arythmia when it picks one up.  For instance,  if my heart goes into polymorphic ventricular tachycardia or Torsades de pointes,  which are the most common fatal rhythms that Long QT syndrome sufferers can go into, it will deliver a shock.  Fancy huh?  So I guess you can say I am wired!!! Soo  all in all I am doing well and I thank God for doing the healing.  Yes I went to the hospital and utilized the doctor’s and the wonders of modern technology but God is the one who directed the surgeons hand.  God granted the specialist wisdom to treat my condition and prescribe the correct dosage of medication.  God is holding back the side effects of the medications and allowing them to work as they claim they should.  In the beginning of this sickness I said, “anyway you bless me Lord I will be satisfied”,  guess what folks?  I am…

But assuming that the person who caused the death of your family member was insured, think about whether your loved one would have wanted you to be taken care of and happy in coming years. While a wrongful death claim sometimes can’t be settled without litigation, when that litigation is over, there is usually some closure and a great relief that may not be there if you just continue to think about how unfair your loved one’s death was.

Never let any friends or neighbors push you into something you’re not ready for. Let your friends know that you are still grieving and that you will do or not do what you feel is right when you are ready to face that hurdle. If they are truly your friends, they should know that they need to give you some space and time to grasp and deal with the loss you are faced with.

In California, you have a two year statute of limitations to file a wrongful death lawsuit. But you have only six months to file a claim if a public entity is involved and delay in speaking with an attorney can make it difficult to obtain evidence such as vehicle skid marks after it rains.

CCTV footage has been released of the moment that raiders broke into a supermarket to get at cash inside a cash machine.

Minutes later one of the raiders can clearly be seen using an angle grinder to get at the cash. Although alerted that a robbery was taking place police arrived too late to stop the raiders getting away.

While workers may use precautions for their own safety, they may forget to use such precautions for the safety of patients, staff and visitors. Directions to only use such products in well-ventilated areas to prevent breathing in concentrated fumes may be forgotten when such products are used in patient, staff or visitor areas that are not well-ventilated.

Anyone thinking that the cleaning and disinfectant products used by hospitals are the same as what one finds and uses at home is sadly mistaken. Many of the products used by hospitals have numerous ingredients which have high toxicity. With hospitals using different brands of disinfectants along with germicidal products such as wipes for surfaces throughout the hospital, the risk of overexposure is high with the possibility of irreversible eye damage, redness, swelling, itching, dermatitis, intense pain, blistering, tearing, ulceration, tissue destruction, nasal discharge, headaches, nose and throat pain, cough, vomiting, drying, defatting and cracking of the skin, burns to the mouth, throat and stomach, dizziness, drowsiness, incoordination, slowed reaction time, slurred speech, severe mouth, throat and abdominal pain, nausea, diarrhea, blood in the feces or vomitus, liver damage, shortness of breath, cloudy appearance of the cornea, chemical burns, damage to the central nervous system and significantly impaired vision, or complete loss of vision. Years later, the chemicals can cause birth defects or other reproductive harm. Some chemicals in such products can also cause asthma and cancer.

La fata locului s-au deplasat cinci ambulante si ehipaje de la pompieri, anunta Infotrafic.

Subinspector Infotrafic, Laurentiu Dicu, a declarat la Antena 3 ca sunt cinci morti si circulatia in zona este blocata total.

“La ora 12:20 a fost primit prin 112 un apel prin care ni s-a adus la cunostinta ca pe DN 22 a avut loc un grav accident de circulatie intre un autobuz transport persoane si un tir de mare tonaj. Se pare ca trei persoane si-au pierdut viata, dar nu se stie inca cauza accidentului”, a declarat Dicu.

Din primele cercetari a reiesit ca vina pentru acest grav accident a fost provocat din cauza neatentiei soferului microbuzului care a pierdut controlul volanului si a intrat pe contrasens.

Potrivit primelor date, soferul microbuzului de transport persoane a intrat intr-o curba periculoasa si a pierdut controlul volanului, intrand frontal intr-un TIR. Din cele 12 persoane din microbuz, trei au scaptat nevatamate. Acestea sustin ca, in momentul accidentului, soferul microbuzului scotocea prin acte.

Soferul microbuzului si-a pierdut viata in urma impactului, iar soferul TIR-ului este in stare de soc.

Au rasunat strigate sfasietoare la morga din Constanta, unde joi seara s-au strans rudele celor cinci oameni care au pierit in microbuzul mortii. Au venit sa-i recunoasca pe cei dragi, dupa ore intregi in care i-au cautat prin toate spitalele.

Stiau deja de la televizor cum s-a petrecut macelul de pe sosea. Un sofer care vorbea la telefon si numara in acelasi timp banii si-a dus pasagerii in ultima calatorie: a intrat pe contrasens si s-a izbit de un camion de mare tonaj.

Dupa accidentul care a curmat cinci vieti, alti patru oameni au fost dusi la spital. Doi, un barbat de 54 de ani si un altul de 62, sunt in stare foarte grava.

Joi, la locul unde s-a petrecut accidentul, la 40 de kilometri de Constanta, era o priveliste care iti ingheta sangele in vine. Trupurile neinsufletite zaceau pe camp, chiar si la zeci de metri distanta de microbuzul distrus.

Neatent, soferul n-ar mai fi tinut bine volanul, iar masina ar fi ajuns astfel pe contrasens. Le-a aparut apoi din fata camionul care facea un transport agabaritic. Conducatorul lui a calcat frana brusc, dar tot n-a putut evita nenorocirea. Microbuzul s-a izbit de partea din stanga a remorcii si a fost aproape retezat. Patru dintre pasageri si soferul lor au zburat din vehicul in impact.

Sase ambulante si mai multe echipaje de la descarcerare si politie au raspuns apelului de urgenta primit la 112. Printre supravietuitori au gasit trei barbati si o femeie, raniti, majoritatea loviti grav la cap.

13 oameni se aflau in microbuz, cu tot cu sofer, in momentul tragediei. Era o cursa autorizata, intre Tulcea si Constanta.

One man was killed and another charged with homicide related to his death after an incident early Sunday morning.  A dispute arose between the two men over the ex-wife of the man killed in the incident and an altercation occurred between them, culminating in one man jumping on the hood of the other.

There will be criminal proceedings as a result to determine the level of fault on the part of the driver of the vehicle and there may be a civil claim made as well.  The interesting part of this case from the perspective of an injury attorney is whether or not the automobile insurance coverage will apply to this case.  Automobile insurance policies generally include a provision that denies coverage for an incident if the injury was due to an intentional act.  If this incident is determined to be the result of an unintentional act, then the insurance coverage will apply.  If not, there will be no insurance coverage available, either through the defendant’s automobile insurance or the uninsured motorist coverage for the deceased.

A 37-year-old woman and her two-year old child son were killed Friday night while attempting to cross railroad tracks in Derry.  The woman was attempting to push the child’s stroller across the tracks when a Norfolk Southern train struck them.  The woman’s two other children safely crossed the tracks but were traumatized by seeing the accident, according to the Post Gazette.  For more information on this incident, see the Post Gazette article on Sunday, November 1, 2009.

This accident is a tragedy.  According to the Post Gazette article, trains legally move at a fairly high rate of speed in the area.  The woman was apparently slowed by the stroller she was pushing as she crossed the tracks and could not get herself and her son out of the way of the train.  Suggestions of a pedestrian walkway over the tracks are mentioned in the article and the presence of a walkway would have provided for a safe alternative for this family to cross the tracks.
