The earliest dated prints of the ridged skin on human hands were made about 4,000 years ago during the pyramid building era in Egypt.  In addition, one small portion of palm print, not known to be human, has been found impressed in hardened mud at a 10,000-year old site in Egypt.

It was common practice for the Chinese to use inked fingerprints on official documents, land sales, contracts, loans and acknowledgements of debts.  The oldest existing documents so endorsed date from the 3rd century BC, and it was still an effective practice until recent times.  Even though it is recorded that the Chinese used their fingerprints to establish identity in courts in litigation over disputed business dealings, researchers fail to agree as to whether the Chinese were fully aware of the uniqueness of a fingerprint or whether the physical contact with documents had some spiritual significance.

The Federal Bureau of Investigation established its first fingerprint identification division in the year 1924, with a collection of 810,188 fingerprint files taken mostly from the Leavenworth Penitentiary. These files became more and more important with the emergence of an increasing number of intellectual criminals who crossed all legal and state lines.  Today, the FBI has in possession more than 250 millions different sets of fingerprint records. This collection is enormous and is composed of both civil as well as criminal prints. The civil file includes prints of government employees and candidates for federal jobs.

Why was J. Edgar Hoover so sure he could inflict damage on the charismatic Martin Luther King?

After the famous “I have a dream“speech, the FBI was afraid of the “black Messiah”. They called him “the most dangerous and effective Negro leader in the country“[1]. These times are well known in the United States as the anti-communistic containment policy. The FBI feared any possible influence and believed in the domino theory. In result of that fear Hoover wanted to install bugs in King’s House and bureau. No one less than Robert Kennedy gave in 1963 the permission for the technical surveillance. Kennedy who always was shown as a great ally of King allowed the FBI to break into Kings private rooms. Moreover Kennedy added a proviso – he always wanted to get immediately informed of any pertinent information. However, at first sight the technical surveillance was not a success. No demo tape gave any proof of a communistic influence in Kings Work. Furthermore the FBI bugs “never picked any evidence that King himself was a Communist, or was interested in toeing the party line”.[2]

So the bugs couldn’t give any concrete evidence. King was not a Communist, even when he had friends and associates of the Communist Party. Stanley Leviston was one of them. He was one of the immediate advisers in Kings personal environment. Also he was under steady technical surveillance but no evidence was found. King once said about the communist reproaches that “there are as many communists in this freedom movement as there are Eskimos in Florida“. But Hoover did not believe him and searched forward to find other information to inflict damage on King. And he did. The memo tapes gave evidence that King had many affairs- probably with four other women. Maybe today nobody would make a big deal about that- not after the Monika Lewinsky affair. But at these times an extramarital affair was a pretty big scandal- moreover for a Baptist pastor. Even when King affirmed his affairs and said he would have to pass God’s judgment he also knew that the general public would not be so merciful. King and Hoover met once privately to discuss this topic. Afterward King called the meeting a friendly and understanding conversation among two people. King added that all problems should be solved right now. Most probably neither King nor Hoover believed that. J. Edgar Hoover’s private contempt for King was big and he had embarrassing and private details about Kings love life- no doubt he would reveal them.

After King came back from Oslo he received anonymous and ominous letters. “You are a colossal fraud and an evil, vicious one at that.” Or “The American public (…) will know you for what you are — an evil, abnormal beast,” (…) “Satan could not do more.” (…) “King you are done.” Some people have the theory, which says that the intent was to get King to commit suicide. “King, there is only one thing left for you to do,” (…) “You know what it is … You better take it before your filthy, abnormal fraudulent self is bared to the nation.”[3] A draft of one letter was later found in the FBI files. King did not commit suicide but continued his work. Maybe at first sight Hoover did not win the fight with King but surely at the second sight. When King planned the march in Memphis he booked a room in a hotel of a better standard than usually. Hoover immediately began his harassment once again. From his point of view it was hypocritical to fight for the poor and to live in a well-standard hotel. Furthermore Hoover approved an FBI plan to use “friendly press contacts” to pressure Martin Luther King into staying at the Lorraine Motel.

Dr. Martin Luther King bended to Hoover’s will and moved to the Lorraine Motel. At exactly that place he got assassinated- less than 24 hours later.[4]

Drawing a conclusion from the email, laws are only to scare honest people and the government is answerable to no one. Amy Lyngstad does not have to obey the law. Nor does law enforcement and the courts have to obey the law. So what good is paying congress when no one has to obey the laws? Taxpayer dollars are wasted on law makers since Courts do not have to follow the law. Congress is a waste of taxpayer’s money making laws since they don’t apply to everyone? Mike, that sounds like an awful situation-I’m very sorry to hear about it. I’ve personally been a victim four times, and my business was a victim of a Russion gang once more on top of that. The ITRC is one of the best victim advocacy groups around. http://www.idtheftcenter.org/

Their founders, Linda and Jay Foley, are simply passionate about helping individuals like your daughter. They do superb work in this area.

Local law enforcement is very hesitant to get involved due to workload and state or federal groups are hesitant to get involved unless the damage can be shown to be very high in financial terms.

My daughter had her identity stolen by her mother, my ex-wife. The Yankton County Sheriff’s Department investigated last April.

Now my ex wife was convicted of id theft in 2005. For 19 counts of id theft she got a $100 fine and no restitution with a year of federal probation. My ex wife has been using fake social security numbers since 1999. She was not prosecuted for having used 9 different social security numbers on no account checks. She had checks printed with the fake social security numbers and got away with $1000s in bad checks while on probation for no account checks.

SD State Judges don’t think that using your children’s identity is a serious crime, even though it is a federal offense. Since the April report she has not been arrested. No one will say why not as there are federal and state felonies involved while she was on probation both state and federal. Probation officers knew she was committing id theft but they did not want to hear about it.

Now the IDRC was contacted there is nothing they can do about it. The FTC was contacted. They only take reports but do not know why she is not arrested and prosecuted.

My daughter now has bad credit and will be graduating high school. Since she has bad credit, she is not eligible for college loans and grants. In addition on her credit report besides the outstanding debt, her mother used another social security number with our daughters name and her age is listed as 40 not 16.

State Judges have nullified id theft laws and obviously identity theft has been committed. Telling people about id theft should include the caveat that if the id thief has connections they will get away with it and you will be left with bad credit.

Dr Aafia to boycott trial

NEW YORK – While a defiant Aafia Siddiqui declared that she would boycott her trial in January, a federal judge Thursday rejected her lawyers’ plea that she could not be tried in the United States as they pointed out that the Pakistani neuroscientist’s alleged crime took place outside the country. Ms Siddiqui, who was brought to New York in August 2008 from Afghanistan where prosecutors say she allegedly fired at US interrogators. No American was hit but she was shot in the abdomen and was charged with attempted murder and assault.
In a pre-trial hearing on Thursday, her lawyers, led by Charles Swift, argued that Dr Siddiqui could only be tried on terrorism charges in the US, and not on murder charges. In this regard, he quoted various international regulations.
But US District Judge Richard Berman ruled out the motion, saying that the US courts have jurisdiction if American citizens were subjected to attacks abroad, citing some precedents.
But Ms Siddiqui, who is languishing in a maximum security jail, interrupted her lawyers in US District Court in Manhattan to announce that she did not plan to participate in her trial, scheduled for Jan 19.
“I am boycotting this trial,” she declared. “I am innocent of all the charges and I can prove it, but I will not do it in this court.”
Since the very beginning, Ms Siddiqui has said that she has no confidence in the American judicial system or the lawyers appointed for her by the court – even those retained by the government of Pakistan – and that she wants to make peace and knows how to do it.
She has vigorously protested against what she called humiliating strip searches before she is brought to the court.
Judge Berman said that her trial would proceed after her lawyers and prosecutors visit Afghanistan to interview eyewitnesses to finalise their case.
Lawyers for Ms Siddiqui tried to convince the court that she was mentally incompetent to stand trial, citing in part her refusal to cooperate with lawyers and the reports of a psychologist who said she suffers from delusional disorder and depression.
Judge Berman rejected that argument after prosecutors pointed to psychological reports that concluded she was faking mental illness.
Berman on Thursday rejected defence arguments aimed at tossing out charges against Ms Siddiqui that carry a potential minimum prison sentence of 30 years and a maximum penalty of life in prison.
Before he ruled on the request, Dr Siddiqui said visits by her lawyers were “torture for me” and it was a waste of money for lawyers to go to Afghanistan to interview witnesses because she was not participating in the trial.
“I’m not dealing with them anymore,” Dr Siddiqui said of her lawyers. “They’re just people coming to my door and talking, talking, talking.”
During a break, Dr Siddiqui was led out of the courtroom by US marshals when she would not stop talking loudly. “Take me out,” she said. “I’m not coming back.”
She was not present when the judge made his decision.

Appellate Brief Filed By Sanchez Lawyer Kerry Bensinger Flames Trial Judge Manuel L. Real, Asks That He Be Replaced

Alex Sanchez — the admitted former Mara Salvatrucha (MS-13) gangster turned Los Angeles anti-gang worker, now accused by the feds of being a “secret shot caller” — has been repeatedly denied pre-trial release.  Now his lawyer, Kerry R. Bensinger, has taken the matter to the United States Court of Appeals for the Ninth Circuit in a take-no-prisoners brief that (in nice, polite lawyer language) flames trial Judge Manuel L. Real.

The brief scorches a few other targets, including the government’s trial lawyers and the principle MS-13 expert witness in the case, Los Angeles Police Department Gang Detective Frank Flores.  Flores’s testimony about the meaning of wiretaps (Sanchez allegedly directing a “hit” on a renegade gang member) was key in the detention hearings.  The defense claims that the government not only got one of the key phone call participants wrong, but Flores misconstrued what happened during the calls.

But Bensinger focuses his flamethrower on the 85-year old Judge Real, stating, “At a minimum, the matter should be remanded for a detention hearing before a different judge.”

If the judge did anything right, it escaped counsel’s notice.

Reading between the lines, Bensinger is conveying to the appeals court the message that — in his view — Real for whatever reason or reasons is confused or willfully obtuse about what the federal law requires in a bail (“detention”) hearing.  In short, the brief argues that the trial judge just doesn’t “get it.”

The 32-page document landed in the appeals court docket less than a week after that court issued an opinion and order applying its own flame to Judge Real.  (Bensinger has more to say on the matter — he asked the higher court to allow him to file additional material.) Here is the Los Angeles Times on the matter involving Real and the 9th Circuit (November 14, 2009):

A federal appeals court Friday criticized U.S. District Judge Manuel L. Real for his handling of $33.8 million entrusted to him for victims of the late Philippines dictator Ferdinand Marcos, calling his accounting “curious” and “filled with cryptic notations” that failed to show what happened to the money.

The three-judge panel of the U.S. 9th Circuit Court of Appeals ordered a new accounting of the disputed assets by a different judge — a rare act of implied censure that Real has now endured at least 11 times in his long judicial career.

The Stakes

If You Indict Mother Teresa, You Better Convict

The stakes are high for Sanchez in an already complicated case:  “Now five months since his arrest, Mr. Sanchez faces an extended pretrial detention as the parties believe this case will not be ready for trial before December 2010.”

Unstated is the fact that careers will be on the line in the case.  Indicting Alex Sanchez was the rough equivalent of indicting Mother Teresa.  If the Sanchez case flames out, the careers of more than one or two on the government’s side will hit the silk.

The following are unexpurgated excerpts from the appeals brief on behalf of Sanchez.  (“Appellant’s Memorandum of Law and Facts In Support [of] Appeal from Detention Order,” United States v. Alex Sanchez, United States Court of Appeals for the Ninth Circuit, Docket No. 09-50525, filed November 20, 2009.)  Fairly Civil has inserted a minimum of explanatory background.  Additional materials on the case can be found in posts here, here, and here.

The government has ten days to reply.

The Basic Claim — Sanchez Was Denied a Fair Hearing

The core of Sanchez’s appeal is that he was denied a fair hearing on the only issues relevant to whether he should be released, which are (1) is he a risk of flight, and (2) does he present a threat to persons or a community?  Instead, the brief claims, Judge Real essentially held a “mini-trial” on whether Sanchez is guilty of the offenses with which he is charged.

This appeal from an order of pre-trial detention presents the question whether a defendant has been denied his right to a “full-blown adversary hearing” … when the district court limited the hearing to whether the government possessed evidence of the defendant’s guilt, foreclosed the defense from rebutting the government’s case with contrary evidence, shifted the burden of persuasion, ignored evidence relevant to flight and lack of danger and made only a “conclusory finding” misapplying the statutory presumption.

In Happier Times, Sanchez Enjoyed A Saintly Aura Comparable to that of Mother Teresa

Naturally enough, the brief sketches a factual review of a man grievously wronged by arbitrary and misdirected government conduct:

Mr. Sanchez quit gang life nearly 15 years ago, beginning a journey of redemption leading him to become one of the foremost anti-gang interventionists in the United States.  In 2006, he became the Executive Director of Homies Unidos, an organization dedicated to extricating youths from gangs and brokering and maintaining peace in communities afflicted by the scourge of gang violence.

On June 24, 2009, however, Mr. Sanchez, a long time resident of Los Angeles and the 38-year-0ld father of three, was arrested at his home and taken into custody on an indictment charging 24 defendants with various crimes in connection with alleged activities of the Mara Salvatrucha (“MS-13″).  Within days of his arrest, over 100 social workers, professors, politicians, clergy, law enforcement and former gang members from around the country raised a chorus of support to release Mr. Sanchez from custody, all attesting to his good character, commitment to peace and ties to the community.  This overwhelming support included over $2.5 million dollars in bail pledges and property.

At the detention hearing, the government claimed a chest tattoo indicated Mr. Sanchez had not quit the gang and four phone calls where Mr. Sanchez mediated a non-violent resolution to an intra-gang dispute supposedly evidenced a plot to kill  one of the disputants.  Announcing “the only determination I have to make on this motion” is “whether or not Mr. Sanchez was there” and “what they were discussing,” the district court precluded Mr. Sanchez from rebutting the government’s evidence about the significance of his chest tattoo while refusing lay and expert testimony contradicting the government’s interpretation of the calls.  Focused exclusively on whether there was evidence of Mr. Sanchez’s guilt, and ignoring evidence of Mr. Sanchez’s extensive ties to the community and reputation as a tireless and effective gang interventionist and violence prevention advocate, the district judge misapplied a statutory presumption, shifted the burden of persuasion, and ignored overwhelming evidence that Mr. Sanchez presents neither a flight risk nor a danger to others.

…the district judge refused to allow evidence on the three critical issues by (1) rejecting defense evidence undermining the inference the government sought to draw from Mr. Sanchez’s chest tattoo, (2) rejecting testimony refuting the government’s contention Mr. Sanchez spoke to Cameron’s killer, and (3) rejecting Mr. Sanchez’s proposed expert testimony disputing that the calls relayed “coded” messages.

The Right to Explain “the Physical Evidence”: The Tattoo:

The government stressed that “physical evidence,” in the form of a chest tattoo, showed Mr. Sanchez was still active in the gang.  Rosemarie Ashmalla, the Executive Director of the agency that removed Mr. Sanchez’s other tattoos, however, was prepared to testify that a chest tattoo was not evidence of ongoing gang affiliation because the tattoo removal program “had a policy of only removing visible tattoos.”  Ms. Ashmalla would have affirmed that most gang tattoo removal agencies, including hers, “do not generally remove non-visible tattoos, absent extraordinary reasons.”  As the head of an agency dedicated to removing gang tattoos (and the agency that removed Mr. Sanchez’s visible tattoos), Ms. Ashmalla was in a far better position that the prosecutor to explain the significance of a residual chest tattoo.  Rejecting her testimony was error.

The Damning Wiretaps — The Court Erroneously Precluded Mr. Sanchez From Presenting Relevant Expert Testimony to Rebut the Government’s Expert.

A focus of the case so far has been the government’s wiretaps of four calls in which Alex Sanchez certainly takes a leading role.  But the crucial question has developed to be:  was that leading role as a mediator and peace-maker or as a “shot caller” pushing the conversation to the ultimate murder in El Salvador of one Walter Lacinos (aka Camaron) by a gangster known as “Zombie”?  A close second is whether the government got the wrong “Zombie.”

Of critical importance, given the district court’s focus on “the content of these [four wire-tapped] conversations” is the district court’s refusal to permit Father Greg Boyle’s testimony.  Fr. Boyle is the Executive Director of Homeboy Industries, the largest gang intervention program in the country, and a nationally recognized gang expert knowledgeable in gang language, interactions and “codes.”  After listening to the calls and reviewing Det. [Frank] Flores’s declaration re-interpreting the calls and the prosecution’s arguments based thereon, Fr. Boyle concluded that, rather than corroborating a murder plot, Mr. Sanchez’s statements reflected a gang mediator’s peacemaking efforts.

The brief argues that the judge erred in declaring Father Boyle’s statement not “relevant” to the questions in the detention hearing — a specific case of the judge “not getting it.”

The Court Erroneously Rejected Relevant Defense Evidence Explaining the Context of the Conversations in the Four Wire-tapped Calls.

The district court erroneously rejected the testimony of Sonia Hernandez, a witness who knew the government (and Flores) misidentified one of the key participants in the calls, distorting their interpretation of the statements made therein.

The government got its facts wrong.  Although both Hernandez and Bonilla used the name “Zombie,” the person who killed Camaron was not the person Mr. Sanchez spoke to on May 7.  Sonia Hernandez would have identified her brother’s voice (not Bonilla’s) as the Zombie on the May 7 call with Mr. Sanchez.

By authenticating her brother’s voice on the May 7 call, Ms. Hernandez would have confirmed Mr. Sanchez had not talked “to the person who ultimately did, in fact, carry out the murder in El Salvador,” but to another person also nicknamed “Zombie.”

The Court Shifted the Burden of Persuasion

The brief also addresses a technical point that involves the difference between the “burden of production” (producing some favorable evidence) and the “burden of persuasion” (persuading the fact-trier that the evidence is true).  Essentially, Bensinger argues again that Judge Real confused the two:

“The burden of persuasion regarding risk-of-flight and danger to the community always remains with the government…”  As now-Justice Breyer explained, even where the nature of the charges gives rise to “a rebuttable presumption that ‘no condition or combination of conditions will reasonably assure the appearance of the person as required and the safety of the community,” [citing 18 U.S. Code, Section 3142 (e)] this presumption only served to “shift the burden of production” and require the defendant to introduce “some evidence” to the contrary.

The brief argues that Sanchez met this burden of production with witnesses who could rebut the government’s factual assertions about the tattoo and the calls, his agreement to “many restrictions on his liberty,” and the character witnesses and property-owners willing to support his release.

The brief also points out additional problems with Judge Real’s ruling:  he did not provide the requisite written statement of reason for Sanchez’s detention, including findings of fact, and erroneously placed undue weight on evidence of guilt, as opposed to risk of flight or danger.

Despite its refrain that “this is not trial” — invoked only to exclude defense evidence contradicting the prosecution’s case — the district court transformed the detention hearing into a mini-trial on the merits of the charges…Rather than conduct an inquiry focused on whether the release of Mr. Sanchez posed a clear and present danger to any person or community, the district court devoted himself to prejudging the evidence of guilt even though, as now-Justice Kennedy reminded, “the statute neither requires not permits a pretrial determination that the person is guilty.”

This Case Should Be Reassigned to a Different Judge on Remand

The brief ends up with the following request, not coincidentally accompanied by a footnote referring to other instances in which the Ninth Circuit has corrected Judge Real:

Judge Real rejected Ms. Hernandez’s testimony refuting the government’s claim that Mr. Sanchez instructed Bonilla to kill Camaron because it was “totally irrelevant.”  Judge Real excluded this patently relevant evidence not on technical legal grounds but because he failed to appreciate its logical relevance to the crucial issues at hand.  The same is true with respect to Fr. Boyle’s testimony.  Even if the matter were remanded for renewed consideration, there is little chance Judge Real will accord this evidence it proper weight, simply because the disputed evidence has been found relevant and admissible…[He has already] declared that it is entitled to no weight whatsoever.  At a minimum, the matter should be remanded for a detention hearing before a different judge.

For those of us who have tracked Islamic militancy in Europe, Maj. Nidal Malik Hasan’s actions are not extraordinary. Since Muslim militants first tried to blow a French high-speed train off its rails in 1995, European intelligence and internal-security services have increasingly monitored European Muslim radicals. Whether it’s anti-Muslim bigotry, the large numbers of immigrant and native-born Muslims in Europe, an appreciation of how hard it is to become European, or just an understanding of how dangerous Islamic radicalism is, most Europeans are far less circumspect and politically correct when discussing their Muslim compatriots than are Americans.

A concern for not giving offense to Muslims would never prevent the French internal-security service, the Direction de la Surveillance du Territoire (DST), which deploys a large number of Muslim officers, from aggressively trying to pre-empt terrorism. As Maj. Hasan’s case shows, this is not true in the United States. The American military and especially the Federal Bureau of Investigation were in great part inattentive because they were too sensitive.

Moreover, President Barack Obama’s determined effort not to mention Islam in terrorist discussions—which means that we must not suggest that Maj. Hasan’s murderous actions flowed from his faith—will weaken American counterterrorism. Worse, the president’s position is an enormous wasted opportunity to advance an all-critical Muslim debate about the nature and legitimacy of jihad.

European counterterrorist officers know well that jihadists can appear, self-generated or tutored by extremist groups, inside Muslim families where parents and siblings lead peaceful lives. Security officials live in fear of the quiet believer who quickly radicalizes, or the secular down-and-out European who enthusiastically converts to a militant creed. Both cases allow little time and often few leads to neutralize a possible lethal explosion of the faith.

Jake and I attended the event where there was a variety of speakers from congressional candidates to chiropractors as well as a key note from Ron Paul.   I was particular struck by the diversity of the attendees, that spanned ages, races, political affiliations.  This was an ecletic group of people who were brought togeather by a common purpose, that is to pass legislation authorizing Congress to audit the Federal Reserve.

This event comes on the heals of a Congressional vote  on Thursday 11/19/09 that approved legislation introduced by Congressman Ron Paul to audit the Federal Reserve for the first time in the central bank’s 95-year-history.  The audit will investigate the Federal Reserve monetary policy specifically how much the central bank has lent and will lend to specific banks.  Fed Chief Ben Bernanke and other key members of the Obama administration, including Treasury Secretary Tim Geithner, had vigorously opposed the move.

The following communiqué was sent to our e-mail address, and it comes from comrade Diego Ríos, who is making his presence known in order to mark the International Week of Agitation and Pressure in Solidarity with Comrades Captured by the Chilean State (not an anarchist summit, like those idiots are saying over there).

I do not know prison; I have never been in one, and I just cannot imagine the smell of the air there, or the unbearable walks through its corridors, or much less the loneliness of its cells. Today—on the open road, in secret, leaving no trace—I can enjoy the wind, the night, the rain (which is always a good reason to hide my face), the company of a stray dog, the knowledge that I am far away from the swine who are paid to hunt me. Today I run far from the city, but it is not only the generous oxygen from the trees that swells my chest, it is also the pride of knowing that I have more brothers and sisters than I can possibly be aware of. But knowing that they are there does not matter; their actions speak to me, they are their actions.

My footsteps no longer have the certainty of a fixed destination, but they are still heading toward the destruction of power, so they have become quicker and more unpredictable; I am carrying all my hatred and contempt for its laws, its authority, its society, and I have no room for guilt or fear of punishment. I have also thrown away the naive idea that freedom is the place that exists outside the prison walls. For me, freedom is neither place nor permission; it is action, it is the antiauthoritarian meaning that fills each act, it is the nervousness that precedes attack, it is the uncontrollable regard for a comrade, it is feeling alive because you know that your life no longer belongs to capital, but confronts it.

The destination to which the road I now travel leads me no longer matters; there I will find free and wild individuals with whom to attempt revolt, with whom to sharpen solidarity, with whom to support the unbreakable will to blow up the existing order, to destroy every jail and every cell. I do not need to enter a prison in order to feel the anguish of seclusion in my own skin, so I hope that each one of these words arrives loaded with all the force and affection with which they are written, to each one of the comrades captured by the state and by capital, anywhere in the world. Also know that many of us continue to fight the monster that holds your bodies, that we are defending you from oblivion, that no walls will be able to isolate you from all the warmth that we are sending your way—no matter how high or how thick, we will find something to burn.

I and many other comrades living the insurrectional life know that each act/action brings consequences—favorable or unfavorable, successes or mistakes—and we assume responsibility because we take pride in being as consistent as possible. For that reason, I accept and learn from my errors, and I look to share and multiply my experiences of attack, no matter that they look to terrorize us with their prisons and with the FBI after us; we will not be silenced, we will remain concerned and engaged so that our captured brothers and sisters can be with us, so that their struggle can spread and be known, so that we can keep sharing all our affection with them. We do not forget, and we live to urgently wield solidarity against this society of submission and apathy.

Each word of this communiqué looks to destroy the silence that attempts to isolate our captured brothers and sisters; behind the words are lives that insist on doing the same, with something more than words. For each prisoner—for Axel, Cristian, Matías, Pablo, Flora, Marco, Gabriel—for all those who do not submit and who remain ready to go to war: In every life and in every action, you are also alive and present; you, whose lives exceeded the limits of this world, all of you who died confronting power, we do not forget you, including Matías and Jaime, whose murderers did not even have the slightest courage to shoot face-to-face. I also especially want to remember Johnny Cariqueo and Mauri the punk, with whom I was fortunate to know the happiness of exchanging a few words and gestures, and today I have the pleasure of making sure that their lives continue to confront power. 9. Iran holding the rest of the world hostage by demanding reactor fuel in exchange for shipping off uranium to Russia and France.

12. If world climate bills are passed in Copenhagen, then an actual new world government will be born.  Right now the brakes are on.
13. The US. economy seems to be recovering, but is it?  Just long enough for everyone to put their money back in?
14. The US. Government wanting total control over the populace by buying out parts of the private sector in the transportation and health care area.
15. …many inside the Columbus Somali community are fixing their suspicions on leaders of another local Somali mosque, Masjid Ibn Taymiya. This mosque is dominated by supporters of the al-Shabaab terrorist group, and members have made repeated attempts to take over the rapidly growing Salama congregation through an unsuccessful campaign of legal and physical intimidation.

Following the blaze, I met with two leaders of Masjid Salama, who described the ongoing efforts by the leaders of Ibn Taymiya to take over their burgeoning year-and-a-half-old congregation. On November 12, the Salama leaders had to obtain a temporary restraining order to prevent the bulldozing of their rented facility by a leader of the Ibn Taymiya mosque, Mohamed Hassan, who, they say, is the ringleader of the campaign.

“The first thing Hassan did was to obtain the lease rights to the property we rented, and then use his contacts in City Hall to try to illegally evict us,” one of the Salama leaders said. In fact, Hassan took the Salama mosque to court earlier this month, only two weeks after the arson at the mosque property, claiming that they had not paid rent — a claim that was soundly rejected by the judge when the Salama leaders provided canceled copies of the rent checks for the past year. Hassan had also rejected checks for the past three months rent.

But Hassan’s harassment campaign began earlier this year when he obtained trespassing orders from the Columbus prosecutor’s office. According to the Salama leaders, Hassan hoped to force them from the mosque property, change the locks overnight, and reopen the mosque the following day with a new imam appointed by Ibn Taymiya. That plan failed when it was pointed out that the mosque property wasn’t even in the Columbus prosecutor’s jurisdiction, making the orders invalid.

The Salama leaders said that Hassan then sent a team of “mediators,” who proposed that the entire Salama board resign, but the current imam would be retained and the “mediators” would appoint a new board. Needless to say, the Salama leaders rejected the proposal out of hand:

These people have nothing to do with our mosque. Who are they to demand mediation for anything? And all the proposals these mediators proposed would get rid of our board and finish the takeover of our mosque. This new board they would appoint would get rid of our imam as soon as they were in place. Why would we ever agree?

Not long after came the fire that has closed Salama ever since and the unsuccessful judicial hearing on the bogus claims that the mosque had not paid its rent.

Smith & Wesson expects to nearly double its annual sales in the next three to five years as demand for its firearms soars in the recession. It is not alone.

All over America demand for firearms and ammunition is rising amid concerns that rising unemployment, which passed 10 per cent this month, will lead inexorably to higher rates of crime. Fears of terrorism have also helped to lift demand, as have concerns among gun owners that the Obama Administration may introduce restrictions on gun ownership and impose additional taxes.

Smith & Wesson is expecting sales to rise by 30 per cent to $102 million in the first quarter of the next financial year, after growing by more than 13 per cent this year to $335 million.

At Sturm Ruger, sales for the third quarter hit $71.2 million, up 70 per cent from the same period last year.

At Glock, the leader in law enforcement markets, pistol sales rose by 71 per cent in the first quarter of the financial year for 2010, in comparison with the same period last year.

According to the National Shooting Sports Foundation, the FBI carried out more than a million background checks on behalf of gun dealers in September (a check is required with every sale), an increase of 12.4 per cent on the same period in the previous year.

Mike Golden, chief executive at Smith and Wesson, is skeptical about the so-called Obama effect on gun sales, believing that his company’s booming revenues have “nothing to do with the administration” and everything to do with the economy.

“People are worried about personal protection with unemployment and crime on the rise,” he said, adding that 30 per cent of customers who had bought the company’s guns in the first half of this year were “first-time gun owners”, up from 9 per cent nine a year earlier.

Randy Williams, industry editor at Hoover, the research firm, agreed. “As an example of the personal safety and terrorism aspect, Smith & Wesson’s hunting rifle sales in 2009 dropped about 33 per cent at a time when the company’s other gun sales — revolvers, pistols, Walther imports, and tactical rifles — grew 33 per cent,” he said.

At the Freedom Group, whose brands include Remington, Marlin, Bushmaster and Harrington & Richardson, managers are encouraged by the “meaningful percentage of current firearm sales . . . made to first-time gun purchasers, particularly women”.

We called the Twin Towers Correctional Facialty in Los Angeles at 213 473-6080, and reached an employee who admitted that Joseph Moshe has been held there since 8-13-2009. He is charged with “violating a court order”. He has a Court Date on 01/25/2010 at Los Angeles Municipal Court (DIV 141) located at 11701 S. La Cienega Blvd. Los Angeles, CA

We might ask for an accounting of all drugs, or vaccines, that he has been forced to take.

According to the Los Angeles Sheriff Department website, Moshe is charged with a misdemeanor. Yet the media is claiming that he had threatened the President. No such charge has been made.

Gee, have we got this story right?  When a misdemeanor suspect is apprehended is it normal to disable his car with a magnetic pulse, then to use tanks, robots, massive amounts of gas, a taser, and a virtual army of Secret Service and FBI? Of course, when these sorts of things are done, is it not customary to come up with something, with which to actually charge the suspect?

Do not misdemeanor suspects usually get out on bond, or on personal recognizance?

Today, the MSM are not talking about this case any more. Yesterday, they wanted us to believe that Joseph Moshe was a nutcase and a terrorist, arrested for threatening to bomb the White House. Interesting detail about his arrest (the “Westwood standoff”) was that he seemed to be immune to the 5 cans of tear gas and 5 gallons of law-enforcement grade  pepper spray they pumped into his face. He very calmly remained in his car, as the video footage of his arrest shows.

Professor Moshe  had  called into a live radio show by Dr. A. True Ott, (explanation of Joseph Moshe’s call at 06:00) broadcast on Republic Broadcasting claiming to be a microbiologist who wanted to supply evidence to a States Attorney regarding tainted H1N1 Swine flu vaccines being produced by Baxter BioPharma Solutions. He said that Baxter’s Ukrainian lab was in fact producing a bioweapon disguised as a vaccine. He claimed that the vaccine contained an adjuvant (additive) designed to weaken the immune system, and replicated RNA from the virus responsible for the 1918 pandemic Spanish flu, causing global sickness and mass death.

Sources tell us that Bar-Joseph Moshe made no threat against the President or the White House. He did not mention any bomb or attack. He then proceeded to inform the White House he intended to go public with this information. When he noticed men in suits in front of his house and feared that the FBI was about to detain him, he packed some belongings into his car and, him being a dual Israeli citizen, tried to reach the Israeli consulate located in close proximity to the federal building where the standoff took place. The FBI and the bomb squad prevented him from reaching it. Who is this man? His profileon biomed experts.com says he is a plant disease expert with many publications on his name involving the genetic manipulation of virii. Joseph Moshe was soon after his arrest sent or let go to Israel. Nothing has been heard from him since. The Secret Service was not the agency involved in the surveillance of Moshe at his home in California. This was done by the FBI, who had orders to detain or arrest him. Mounted on top of a large black vehicle used in his arrest was a microwave weapon that possibly damaged the electronics in Moshe’s car as well as any communication devices he had which might have been used to contact the media or others who could help him.

Moshe did not suffer the same effects of the gas and pepper spray that others would have because he had built up an immunity to such weapons as a by-product of his Mossad training. Moshe was not handcuffed because he was not placed under arrest.

Does this sound like an insane conspiracy theory? Sure it does. Due to the scarcity and anonymity of the sources we would dismiss it as exactly that, if it weren’t for some uncomfortable facts: Baxter Pharmaceutical has been caught, red-handed, in spreading a live, genetically engineered H5N1 Bird flu vaccine as a lethal biological weapon all over the world, destined to be used for human vaccinations. This happened just a few months ago. And only luck prevented a global catastrophe of epic proportions.

Baxter International Inc. had mixed live, genetically engineered avian flue viruses in vaccine material shipped to 18 countries. Only by sheer luck, a Czech laboratory decided to test the vaccine on a dozen ferrets, which all died in days. The World Health Organization was notified and catastrophe was averted. This was clearly a deliberate act on Baxter’s part, because they adhere to BS3, bio-safety level three. Baxter admitted a “mistake”. Such monumental screw-up are totally impossible at that level. Many safety systems would have needed to be sabotaged, many key personnel would have needed to be bribed. It simply can’t be done without direction from the inside. They did not send out the wrong vial – they produced dozens of gallons of biological-weapon agent (genetically engineered live H5N1 / Bird flu virus), then sent it out as a “vaccine”.

Baxter knew full well that their vaccine was lethal, because the year before they had tested it on a few hundred homeless Polish people – dozens died as a result.

Where’s the meat? Well – Baxter is now being sued for the deliberate, repeated contamination of vaccines with biological weapons designed – by them – to mass-murder people. Here is the complaint (PDF). By some kook nutcase? Not likely – Jane Burgermeister is an experienced, respected journalist. She is not the only one suing Baxter for planning and executing a plan for global genocide: Others are filing complaints as well. Read a well-researched complaint here (PDF).

Qui bono? We think it may be profit-motivated or even sheer incompetence, but for the conspiracy-minded:  The latter complaint alludes to intentional “culling of the herd”. Have you heard of the Georgia Guidestones? An enormous monument loaded with Masonic symbolism costing millions of dollars, it has been erected by unknown, powerful elites (multimillionaires with the clout to erect monuments wherever they please, obviously) around 30 years ago. It gives an “alternative ten commandments”, of which the first is the extermination of six and a half billion people from the face of the Earth. Half a billion will remain. This is the number of people the planet can sustain indefinitely, so that the descendents of the Rothschilds and Rockefellers can live in peace and affluence indefinitely. Slaves are needed to produce that luxury, but 500 million will do just fine. But how does one go about killing off most of the world?

“Vaccinating” the planet with a bioweapon with near-100% mortality would do the trick. Baxter would provide both the bioweapon as well as the vaccine against it to “civilized” Western peoples. Result: We can plunder Africa, we have no more competition from SE Asia, the oil is for our taking and only Western and perhaps Chinese sheeple remain.

Rockefeller said this in 1994 at a U.N. dinner: “We are on the verge of a global transformation. All we need is the right major crisis, and the nations will accept the New World Order.” PNAC said something similar right before 9/11.

Hepatitis B

I understand that 60 percent of patients who are vaccinated for Hepatitis B will lose detectable antibodies to Hepatitis B within 12 years. I understand that in 1996 only 54 cases of Hepatitis B were reported to the CDC in the 0-1 year age group. I understand that in the VAERS, there were 1,080 total reports of adverse reactions from Hepatitis B vaccine in 1996 in the 0-1 year age group, with 47 deaths reported.

I understand that 50 percent of patients who contract Hepatitis B develop no symptoms after exposure. I understand that 30 percent will develop only flu-like symptoms and will have lifetime immunity. I understand that 20 percent will develop the symptoms of the disease, but that 95 percent will fully recover and have lifetime immunity.

I understand that 5 percent of the patients who are exposed to Hepatitis B will become chronic carriers of the disease. CIA Assassinations & Depopulation Using Vaccinations:
A Conspiracy Reality Underlies the Swine Flu Black Op

Los Angeles–CIA assassinations and paramilitary operations secreted from congressional overseers and the American people have extended into the realm of swine flu bioterrorism and vaccinations for profitable depopulation according to medical journalist and CIA analyst, Dr. Leonard Horowitz.

The CIA spent years advancing secret squads to blow things up and kill humans according to U.S. intelligence officials interviewed by Greg Miller of the Los Angeles Times. (July 16, 2009) What the Times failed to report was current connections between drug industrialists and CIA officials that best explain the mysterious emergence of the swine flu virus in Mexico, and the international media’s curious response to the planned pandemic, according to Dr. Horowitz–a Harvard-trained investigator and award-winning author of several books on this subject.

Current and former U.S. intelligence officials disclosed a broader effort than media coverage has portrayed, including black-ops about which congressional oversight committees and Americans knew nothing, the Times published.

The “broader dimensions” of this program, Miller wrote, “may account for why some lawmakers, particularly Republicans, have been critical of CIA Director Leon E. Panetta’s decision last month to kill” funding for the operation that trained America’s deadliest assassins.

Some house Democrats are calling for an investigation to help explain why top counter-terrorism officials, with close ties to Bush Administration Vice President, Dick Cheney, “saw a need for the CIA to develop its own elite paramilitary teams, rather than relying on U.S. military special operations troops.”

In particular, officials said, ambitions for the program expanded to include creating teams that were made up not only of CIA personnel, but counterparts from other countries, presumably Pakistan; and to be capable not just of killing high-value targets, but also executing raids and other operations to gather evidence and intelligence that might lead to” CIA-trained Holy War assassin, Osama bin Laden.

In 1986, William Casey, CIA chief under Reagan, approved a Pakistani intelligence proposal to recruit Islamic fundamentalists worldwide to conduct covert operations. When the Pakistanis recruited, and the bin Ladens and Saudis financed, the Afghanistan black-operatives at that time, American officials, including previous CIA director, George H.W. Bush, “funneled more than $2 billion in guns and money” during the 1980s in the “largest covert action program since World War II,” the Washington Post, reported (7/19/92).

The CIA, often referred to as “the Company,” maintained ties to wealthy financiers, including Carlyle Group investors Mohammed bin Laden and George H.W. Bush, co-investors in this mega defense contractor along with James Baker III, who oversaw the Florida vote recount in Bush, Jr’s contested 2000 election. In addition, Donald Rumsfeld, Defense Secretary under Gerald Ford and George W. Bush, whose connections to the global drug-cartel include his launching of the Tamiflu-manufacturing company Gilead Sciences, conducted business dealings with Carlyle Group executive, Frank C. Carlucci.(JudicialWatch.org,11-30-2001)

In November 2005, George W. Bush urged Congress to pass $7.1 billion in emergency funding to prepare for the possible bird flu pandemic, of which one billion was solely dedicated to the purchase and distribution of Tamiflu.

Earlier, in June 1996, Gilead launched its first commercial product, Vistide (cidofovir injection) for the treatment of cytomegalovirus (CMV) in AIDS patients. “If you want to know where the herpes virus pandemic mostly comes from,” Dr. Horowitz wrote, “think of contaminated vaccines spread to produce cancer for profit by the Carlyle-CIA-backed cartel.”

Cytomegalovirus is one of three herpes type viruses, including herpes B, simian cytomegalo from monkeys used in vaccine development, and Epstein Barr, another vaccination infection.

Epstein-Barr virus (EBV), now known to cause AIDS-like immune deficiency, and one of the three AIDS-linked cancers called lymphomas, was first cultured from a Burkitt’s lymphoma cell line in 1964 that Dr. Horowitz traced to CIA-directed vaccine experiments conducted by the American biological weapons lab called Litton Bionetics. Bionetics operated in Maryland, Virginia, Eastern Zaire and Northwest Uganda during the 1960s according to National Cancer Institute documents discovered by Horowitz. The covert African operation was conducted under the supervision of Frank Carlucci.

Carlucci has been a Managing Director of Carlyle since 1989 and its Chairman since 1993. Carlucci became the point man for CIA-directed “health care” programs in various parts of Africa during the early 1960s. He became the deputy director of the CIA in 1978, deputy secretary of defense in 1980, and national security adviser during the Iran-contra scandal. Carlucci also served as chief “political officer” in the African Congo’s American Embassy at the time Burkett’s lymphoma was allegedly discovered, and obviously distributed in this region of Africa by way of contaminated vaccines, according to substantial evidence compiled by Dr. Horowitz including an interview with one of the doctors engaged in the vaccination operation.

All of this is published, and meticulously evidenced using reprinted scientific and government documents in Dr. Horowitz’s best of three national bestselling books,Emerging Viruses: AIDS & Ebola–Nature,  Accident or Intentional?(Tetrahedron Press, 1998) Barack Obama’s minister, Rev. Jeremiah Wright, recommended reading this book, in defense of harsh criticism he received for his sermon condemning the US Government for creating HIV. For those who do not believe our government would conduct such hideous atrocities, technically called genocide, Barack Obama disavowed his minister.

Under CIA supervision and covert actions by government officials linked to Carlyle on behalf of the global petrochemical-pharmaceutical cartel, new diseases have emerged. Dr. Horowitz evidences these including Burkitt’s lymphoma, nasopharyngeal carcinoma, infectious mononucleosis, AIDS and today, the circulating swine flu, and avian flu threats.

While the Carlyle-Bush-Baker-Carlucci-Rumsfeld connections are troubling enough in their own right, they look even worse when you consider how many different ways Carlyle is profiting from the war on terrorism and bioterrorism. Speaking in particular about Carlucci, and his three main partners at Carlyle, Dan Broidy, author of The Iron Triangle, an illuminating history of the Carlyle Group, wrote, “It’s not an exaggeration to say that September 11″ made these “Carlyle investors very, very rich men.” This is also the case for Dick Cheney, tied to the Halliburton Co. that administers converted military bases to serve as quarantine camps planned by FEMA to be used this fall when the World Health Organization may call for such drastic measures.

Recall also that Donald Rumsfeld was replaced as Defense Secretary because of his administration of the Iraqi war and human rights violations in torturing prisoners, state enemies, and suspected terrorists. “I pray this doesn’t foreshadow how quarantined Americans who refuse vaccinations will be treated in these FEMA camps administered by Halliburton,” Dr. Horowitz said.

Alleging CIA operations to administer assassinations had been generally disappointing, according to the Los Angeles Times interviewed CIA spokesman, George Little, one wonders who was behind the suspicious deaths of John and Bobby Kennedy, Martin Luther King, Vince Foster, Democratic Senate candidate Mel Carnahan, who went on to win the race as a dead man against his rival John Ashcroft (whose campaign was largely funded by Enron, and who went on to become appointed the U.S. Attorney General); Democratic Senate incumbent Paul Wellstone, whose reelection would have shifted the entire balance of power in the Senate during pivotal Bush administration projects fundamental to where we are today regarding “national security,” “biodefense,” and forced vaccinations and quarantines impacting every American.

“Keeping CIA activities like this secret is the biggest challenge,” another former U.S. intelligence official told the LA Times.

Most recently, the program’s focus had shifted toward intelligence collection, officials said. According to past CIA Director, William Colby, since the end of the cold war, the primary function of The Company has been to act as industrial espionage agents on behalf of multi-national corporations, the largest financially engaged with Carlyle.

In 2001, Dr. Horowitz exposed the anthrax mailings as sourcing from the CIA’s “Project Clearvision.” The anthrax was mailed to enemies of Carlyle, including democratic drug legislation opponents, Senators Patrick Leahy and Tom Dashle. The hyper-weaponized germ sourced from the Battelle Memorial Institute in West Jefferson, Ohio, under the direction of CIA-anthrax ace, William Patrick, III, who assayed the mailed virus’s spreading capacity two years before the attacks. According to Dr. Horowitz, and many other experts, this was done to promote sales of Bayer’s CIPRO; and stockpiles of BioPort, LLC’s congressionally-certified deadly anthrax vaccine.

US military leaders reported finding a BioPort annual prospectus in a cave allegedly used to shelter Osama bin Laden in 2002, probably because Carlyle clients, including Mohammad bin Laden, had invested in the company. Today, BioPort, renamed BioThrax, is allied with drug cartel giants Acambis, Sanofi Pasteur, and other companies that make money from people sustaining side effects from their drugs and vaccines; especially the ones exclusively stockpiled by our federal officials.

Regarding company assassins carrying out close-range killings, a former CIA official told Greg Miller from the LA Times,  “This is something they don’t really have a capacity for.”

“But long-range killings through manufactured frights, forced vaccinations, mass quarantines, and compelled druggings,” Dr. Horowitz wrote, “is obviously central to their genocidal operations on behalf of Carlyle and Halliburton investors.”

On July 16, 2009, it was announced that by fall, government health officials and social service workers will be canvassing every American household, carrying four required flu vaccines, that shall be given to those persuaded to take them. The campaign is mostly “targeting” children and the elderly.

In response, there are now many reasonable, responsible, intelligent, and patriotic Americans, including many health professionals, who have decided to leave the United States before flu season.

Perhaps my thinking is a bit unrefined, and I’m willing to concede that I am no authority on the finer points of national security, but I don’t find it particularly unreasonable to ask why the hell the Federal Bureau of Investigation didn’t bother notifying the United States Army that Ft. Hood mass-murderer Major Nidal Malik Hasan was in contact with radical imam Anwar al-Aulaqi through a series of e-mails prior to the murderous terrorist attack there. In fact, I find it absolutely remarkable that correspondence between a US Army Major and a radical Muslim cleric – as many as nineteen e-mails – wasn’t deemed at all noteworthy enough by the FBI to bring to the Army’s attention.

Call me crazy, but it seems like it might have been something worth mentioning.

In the months before the deadly shootings at Fort Hood, Army Maj. Nidal M. Hasan intensified his communications with a radical Yemeni American cleric and began to discuss surreptitious financial transfers and other steps that could translate his thoughts into action, according to two sources briefed on a collection of secret e-mails between the two.

The e-mails were obtained by an FBI-led task force in San Diego between late last year and June but were not forwarded to the military, according to government and congressional sources. Some were sent to the FBI’s Washington field office, triggering an assessment into whether they raised national security concerns, but those intercepted later were not, the sources said.

“He [Hasan] clearly became more radicalized toward the end, and was having discussions related to the transfer of money and finances . . .,” said the source, who spoke at length in part because he was concerned the public accounting of the events has been incomplete. “It became very clear toward the end of those e-mails he was interested in taking action.”

The kicker in all of this – with the mainstream media still reluctant to use the “t” word to describe the Ft. Hood attack – is that even Democrat Senator Carl Levin of Michigan, Chairman of the Senate Armed Services Committee, is now having to face reality.

Levin told reporters after a briefing from Pentagon staff members that “there are some who are reluctant to call it terrorism, but there is significant evidence that it is.”

I’m curious … under what circumstances would communication between an American serviceman and a known radical imam (and supporter of Al-Aqeada) not be anything the military should be made aware of?
