<title><![CDATA[Some stories don't end well in this battle for justice --- A Smiling Judge Refuses to Get it ]]></title>

<p><strong>NOT EVERYTHING ENDS WELL. THE BATTLE IS ON. THIS JUDGE SAID THE ASSIGNMENT DOESN&#8217;T NEED TO BE RECORDED TO PROVE OWNERSHIP. HE&#8217;S TECHNICALLY RIGHT, BUT HIS CONCLUSION WAS WRONG. THIS IS WHY I KEEP SAYING THERE IS NO SILVER BULLET. The fact that an assignment is not recorded does not mean that it can&#8217;t be recorded &#8212; unless it is not executed in recordable form. If it isn&#8217;t executed in recordable form and it isn&#8217;t recorded then it violates the terms of the pooling and service agreement and the prospectus/indentures for the mortgage backed bond sold investors. </strong></p>
<p><strong>If the purported document violates the enabling documents then the assignment has not been accepted. If the assignment has not been accepted then there is no assignment. At best there is a conditional assignment which is clearly in violation of the the express terms of the enabling documents. The existence of the condition creates an issue of fact as to who really has the right to own, enforce and collect on the obligation, note and mortgage.<br />
</strong></p>
<p><strong>If there was no consideration for the &#8220;transfer? then there isn&#8217;t even an equitable argument for why the pretender lender should be allowed to foreclose. They have nothing to lose by the alleged default and obviously don&#8217;t even know if there is a default in the OBLIGATION that was FUNDED with ADVANCED MONEY by INVESTORS. </strong></p>
<p><strong>But you see, this Judge was already predisposed to not giving the &#8220;borrower&#8221; a free house. He/She needs to be coddled and led along the path of education so he/she understands that the &#8220;borrower&#8221; is actually an investor who purchased a financial loan product subject to terms and duties which were breached by all the people in the securitization chain. The &#8220;lender&#8221; is the investor who advanced the money and is not in court. </strong></p>
<p><strong>The pretender lender is using bluff and fraud to get their share of the great American pie at the homeowner&#8217;s expense, depriving the homeowner of the knowledge of the identity of the true lender, the ability to settle out of court with the true lender, the ability to comply with federal law in seeking modification, short-sale, refinance or even payoff because the pretender lender in Court in Florida doesn&#8217;t even have the right, power, authority or justification to execute a satisfaction of mortgage.</strong></p>
<p><strong>If they don&#8217;t have the power to execute a satisfaction of mortgage then how could they have the power to foreclose? </strong></p>
<p><strong>The problem with this case is that the homeowners should be aggressive but not to try to convince the Judge why he/she should get a free house. You must align yourself with the Judge&#8217;s basic sense of fairness and basic mistrust of legal maneuvering to get out of a legally owed debt. By focusing your aggression on discovery, enforcement of the QWR and/or DVL, asking for the name of the true lender and the production of documents and names, addresses and phone numbers of people who can testify under oath, you present the Judge with something he cannot or should not refuse and that any appellate court would reverse him on. You are asking for discovery to test the merits of the pretender lender&#8217;s allegation or position that they have the right to enforce the note, that they are the party to whom the obligation is owed, that they are a creditor in the sense that they advanced money which they will lose if they don&#8217;t get to enforce the note and obligation, and that therefore they are the beneficiary of the terms of the the mortgage that secures the alleged debt.<br />
</strong></p>
<p><strong>If you go into court spouting securitization theories it is very easy to say you haven&#8217;t convinced the Judge. If you go in demanding an evidentiary hearing based upon the rules of evidence and founded on common discovery and enforcement in obtaining relevant information about your loan, and seeking an accounting from those people, entities or parties that were participants in the securitization chain, then <em><span style="text-decoration:underline;">you are only asking for a COMPLETE accounting</span></em> so that you discover what undisclosed fees were paid under TILA and RESPA, and the true identities of the people involved in your table-funded loan.</strong></p>
<p><strong>I&#8217;m sorry for your result Mr Fitzgerald, but perhaps with the aid of competent, licensed, local counsel you can move for rehearing, file a bankruptcy that will stay the proceedings, and/or appeal.<br />

<p>The smiling Judge made this comment ..that shocked us &#8230;</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>This is the view I see off of my back porch, during the day and at night.  The building to the right in the first picture is my office building! It is also a Marriot hotel and residences, and there are several boutiques, high end real estate offices, a gourmet grocery store, and a bunch of jewelry stores in the lobby, along with us. The space was donated, I believe.</p>
<p>&#160;</p>
<p>The islands in the distance is Venetian Island, and the road is the Venetian Causeway, which runs all the way out to Miami Beach. I drove on it this evening (accidently&#8230;I thought I was getting on 395, but nope!) and its really beautiful, lots of homes and the bridges are intricately designed. Except, there is a toll, but it was only a dollar.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>We made it back safely from our trip and while we were gone, boys went to play football up north. Not a successful game but there is always next year.</p>
<p>We had a great time while the boys&#8217; grandma Dorothy moved in with them.  They complained loudly about not wanting her to fix spaghetti too many times so I thought I had better make things easy on Dorothy and fill the freezer with &#8220;pre-fabricated&#8221; foods.   We don&#8217;t usually eat that stuff but it made things simpler and the boys much more appreciative of what I do for them every night.</p>
<p>Alright, where we were, the chefs didn&#8217;t cook frozen dinners, they made special things for us and we loved every single bite they served up.  We had dinner among other places at <a href="http://media-cdn.tripadvisor.com/media/photo-s/01/24/a2/a2/the-bar-at-the-wolfgang.jpg" target="_blank">Wolfgang Puck&#8217;s Cafe&#8217;</a> where we sat at the sushi bar.</p>

<description><![CDATA[If it weren&#8217;t for the coral reef located in the Florida Keys, the United States would have not]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p>If it weren&#8217;t for the coral reef located in the Florida Keys, the United States would have nothing to offer as far as scuba diving and coral reefs are concerned. In addition to the living coral reef that has been a main scuba diving attraction of the Florida Keys for more than 35 years, numerous dive able wrecks are scattered throughout the waters providing exotic and breathtaking artificial reef habitats. Here is a brief overview of some of the wrecks you can visit while scuba diving in the Florida Keys:</p>
<p>Benwood &#8211; The Benwood is perhaps the oldest scuba diving wreck site to be found in the Florida Keys. This WWII ship was sunk in 1942 when it collided with another whip while dodging German U-boats near the coast of Florida. While the wreck is not intact (it was blown apart because it presented a boating hazard) it is home to a wide array of marine life. Scuba diving near the Benwood will bring you face to face with critters such as Pork fish, grunts, lobsters, moray eels, glassy sweepers, Sergeant Majors, Goatfish, and Christmas Tree Worms. Since the ship had run aground before it was blown up, the dive is a relatively shallow one and great for novice divers as well as advanced divers.</p>
<p>Cayman Salvage Master &#8211; This wreck that can be seen while scuba diving in the Florida Keys is a Cuban refugee vessel that was confiscated by the US government. The ship was tied up to a dock where she sank before she was re-floated. Then, during her burial voyage of 1985, she sank in about 90 feet of water coming to rest on her side. Recently, Hurricane Katrina righted the ship and now divers can swim along the hull and deck hoping to spy huge Jewfish and moray eels that reside in the open hatches of the wreck.</p>
<p>Duane &#8211; If you&#8217;re experienced at scuba diving, you might want to pay a visit to the wreck Duane while you&#8217;re in the Florida Keys area. This US Coast Guard Cutter was intentionally sunk in 120 feet of water in the year 1987. Due to the strong Gulf Stream current and depth associated with the wreck, only advanced divers are allowed to dive this site. The Duane is home to grunts, sponges, chubbs, jacks, barracuda, and numerous tropical fish.</p>
<p>In addition to these three wrecks that can be seen while scuba diving in the Florida Keys, there are several other wrecks in the area that have been intentionally sunk to become artificial reef habitats. Each offers a different experience and a unique look into how the ocean transforms a foreign object into a beautiful habitat where marine life can grow and thrive.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>&#8216;Tis the season for <em>A Doll&#8217;s House</em>, Norwegian playwright Henrik Ibsen&#8217;s classic portrait of nineteenth century marriage and gender roles that unfolds on Christmas Eve and Christmas day in 1879, also the year in which it was written and first staged. The title&#8217;s significance, broached by Nora herself in the third and final act, refers to the identical ways her father and husband perceived and treated her&#8211;like a child in an arrested state of development, a p(r)etty play thing for life.</p>
<p>Often identified as Ibsen&#8217;s &#8220;feminist play,&#8221; <em>A Doll&#8217;s House</em> was so controversial when it premiered  that it was banned in Germany and Britain until Ibsen wrote an alternate &#8220;happy ending.&#8221;  The irony, of course, lies in the fact that the original ending (and the one that gets staged almost without exception) is what most now would consider the &#8220;happy ending&#8221; because in this version, Nora leaves her oppressive husband, boldly vowing to honor her duty to herself, to her own human rights, even if it means casting off her socially prescribed marital and maternal duties.  Nora&#8217;s dramatic exit from the stage and her marriage has come to be viewed as a historic social moment because of its metaphoric resonance&#8211;she had also slammed the door on Bourgeois patriarchy.  Watching the play today reminds us of how far we have come and how far we still have to go to fully achieve gender equality.</p>
<p>In the revival currently running at <a title="pbd" href="http://www.palmbeachdramaworks.org/" target="_blank">Palm Beach Dramaworks,</a> directed by William Hayes, Nora Helmer appears not childlike and helpless but constrained and crafty, even if complicit in her own subordination.  This Nora kneels in subjection&#8211;sometimes genuine, sometimes feigned&#8211;at least five times throughout the performance.  Early on, Hayes takes every opportunity to emphasize what may appear to those unfamiliar with the play as Nora&#8217;s self-serving money obsession, by having her count her kroner like Scrooge in <em>A Christmas Carol</em>.  This choice adds greater impact later on<a href="http://dramadaily.wordpress.com/files/2009/11/poster_show451.jpg"><img class="alignright size-full wp-image-1499" src="http://dramadaily.wordpress.com/files/2009/11/poster_show451.jpg" alt="" width="254" height="382" /></a> when Nora reveals to Mrs. Linde that she is not, in fact, a spendthrift, but that she is repaying a loan she secretly obtained years ago to finance a doctor-prescribed trip to Italy for her ailing husband.  A petite-bodied, vocally gifted Margery Lowe seamlessly and flawlessly embodies the role of Nora, subtly revealing the complexity of a character that is vain but selfless, confident but cautious.  I overheard some audience members discussing Nora&#8217;s constant birdlike singing and her transfixion during the tarantella dance, and they actually bought the great Victorian lie that she is &#8220;hysterical.&#8221; Sorry folks, she is subjugated, shackled, disenfranchised, not mentally ill.  Michael St. Pierre portrays Torvald Helmer  as  a formidable patriarch, though one not completely unlikeable or altogether devoid of tenderness. Thankfully, for example, he does not chastise Nora by pulling her  by the ear in the opening scene as the original stage directions indicate, and the two share several kisses and embraces, suggesting their marriage is not completely loveless.  Michael Amico&#8217;s red and gold hued set and Brian O&#8217;Keefe&#8217;s beautiful period costumes are perfect complements that effectively transport us to a bygone era.  It is no wonder this production has regularly been selling out&#8211;the show is well done on all counts. Catch it before it closes this coming Sunday, November 29.</p>

There is a also a fox that lives on Lake Ola Drive towards Earlwood. He can be seen coming out at dusk. Foxes and coyotes are native to Northwest  Orange County. Most likely Stoneybrook most likely has its share of wild predators due to the rural nature of the development.</p>

It is funny how things like that work, not seeing something happen for awhile and then it happening conveniently when you ask for it. It&#8217;s almost as if God dropped it solely because I asked, and I can&#8217;t complain if that were the case. These last days have been filled quite nicely with productivity.</p>
<p><a href="http://frienca.wordpress.com/files/2009/11/image0025.jpg"><img class="alignleft size-medium wp-image-316" title="Image0025" src="http://frienca.wordpress.com/files/2009/11/image0025.jpg?w=300" alt="" width="300" height="240" /></a>Online classes began this week and I have maintained a positive outlook on them and made sure to stay ahead in both classes. Along with classes being online, I have my whole day freed up to allow myself to do whatever I please. I make it sound so heavenly, but it isn&#8217;t being abused. I spent roughly an hour yesterday at the Winter Park Court House so that I could void one of my two &#8220;traffic citations.&#8221; Going to something like this is never a convenience for anyone and no one here looked happy. Sometime you just have to pick yourself up and demand that you go and get it out of the way. Now that I have done that, I am glad I can look on and forget.</p>
<p><a href="http://frienca.wordpress.com/files/2009/11/image0024.jpg"><img class="alignright size-medium wp-image-318" title="Image0024" src="http://frienca.wordpress.com/files/2009/11/image0024.jpg?w=300" alt="" width="300" height="240" /></a>On a different note, I made my first peanut butter and jelly sandwich with added Whopper candy bites. We had some extra Whoppers lying around and I thought to myself what better way to get them out of the way, but still be used. The sandwich was quite delicious, as expected. What I didn&#8217;t expect was how quickly my body tore that sandwich apart, used what it needed, and disposed of it. I found myself driving home and speeding so I could make it to the toilet. Needless to say the sandwich was worth all I went through.</p>
<p><a href="http://frienca.wordpress.com/files/2009/11/image0026.jpg"><img class="alignleft size-medium wp-image-320" title="Image0026" src="http://frienca.wordpress.com/files/2009/11/image0026.jpg?w=300" alt="" width="300" height="240" /></a>Lastly, I felt compelled to get on my bike and ride today, despite the drizzle. The rain had stopped for the most part, sporadic raindrops here and there, and so I went to rode around the surrounding neighborhood that I lived in. On the ride, I discovered very nicely built houses and several ponds/lakes that were surrounded by these houses. I stopped to sit at a bench and have a talk with the big man upstairs. He has been good to me, all my life, and more specifically these past two months that I&#8217;ve lived.</p>
<p>I hope everyone has the opportunity to an incredible Thanksgiving Day that can be spent with friends, family, and loved ones. I made the decision to stay here in Orlando for this holiday and hope that my family back in Oklahoma has a great time . So many babies have come into this world and into the Friend family these past few years, it&#8217;s incredible! Be thankful for that which you don&#8217;t think of on a daily basis and know that everyone is blessed and that there is more to be thankful for than one can imagine.</p>

<title><![CDATA[Which Holiday is the Best?]]></title>

<p style="text-align:left;">With Thanksgiving less than 24 hours away, it got me thinking about the holiday lineup of games that will be made viewable to myself.  It got me thinking about which of the next three holidays has the best slate of games, Thanksgiving, Christmas, or New Year’s Day.  It’s a valid question indeed.</p>
<p style="text-align:left;">Lets start with Thanksgiving.  As we all know, Thanksgiving is always known for their NFL games and turkey legs.  This year’s lineup is very questionable though.  <a href="http://blog.mlive.com/lions_impact/2009/01/medium_090131-thanksgiving-hat-lions.jpg" target="_blank"><strong><span style="color:#99cc00;">Detroit</span></strong></a> always plays a home game, which in itself makes it less than exciting, the Lions host the Green Bay Packers.  Then Oakland travels to Dallas for the <a href="http://blogs.dallasobserver.com/sportatorium/Cowboys%20Thanksgiving.jpg" target="_blank"><strong><span style="color:#99cc00;">Cowboys annual turkey day</span></strong></a> game.  I know Cowboy fans are excited about this (Jesse) but not so much for me.  The final NFL game of Thanksgiving day features the New York Giants traveling to the struggling Broncos.  To me this is the game with the most intrigue.  Thanksgiving also has two NBA games scheduled, and both are good games.  Orlando Magic at the Atlanta Hawks then the Chicago Bulls at the Utah Jazz.</p>
<p style="text-align:left;">Next lets focus in on Christmas day.  Christmas day is all about the NBA, and the NBA on ABC.  Five games are scheduled and all are on either ABC or ESPN.  The Quartet of games is headlined by Lebron James and his Cleveland Cavaliers traveling to play Kobe Bryant and the Los Angeles Lakers.  The other headline game is a big Eastern Conference game between the Orlando Magic and Boston Celtics.  Other games include the Heat vs the Knicks, the Clippers battling the Suns, and the Nuggets playing the Blazers.  One NFL game is scheduled for Christmas day, the Chargers travel to the Titans, and the game can be found on the NFL Network.</p>
<p style="text-align:left;">Finally lets look at the games on New Year’s Day.  <a href="http://espn.go.com/college-football/bowls/projections" target="_blank"><strong><span style="color:#99cc00;">College football</span></strong></a> is well known for hogging up the television time when the new year hits.  The biggest two bowl games on New Year’s Day include the BCS Rose Bowl and BCS Sugar Bowl.  Teams are still being determined. Other bowl games include the Konica Minolta Gator Bowl, the Capitol One Bowl, and the Outback Bowl.  One NBA game is being televised nationally, and that game features the New York Knicks playing at the Atlanta Hawks on NBA TV.</p>
<p style="text-align:left;">So looking at those three days, to me it’s really not even a toss up to which day of games I am looking forward to the most.  I am extremely partial to the NBA and basketball, so I am very excited about Christmas day and that <a href="http://atthebox.files.wordpress.com/2009/05/kobe-v-lebron.jpg" target="_blank"><strong><span style="color:#99cc00;">Lebron Kobe game</span></strong></a>, but that’s not the best day of this bunch. Nothing beats the college football bowl season, and with two BCS games on the dial, it gets even better.  The Rose Bowl looks like it might be a Ohio St. Oregon matchup that would be a really great game.  The Sugar Bowl with include either Florida or Alabama (loser of SEC title game) and most likely Cincinnati.  I won’t be tuning into that NBA game but <a href="http://2.bp.blogspot.com/_NDUmkclAxjY/SVuo-6AprUI/AAAAAAAAD48/Z3BrjiZcK8g/s320/New+Years+Day.jpg" target="_blank"><strong><span style="color:#99cc00;">New Year’s Day</span></strong></a> gets my award for having the best day for sports viewing.</p>

<p>Smith&#8217;s trial has been scheduled for Dec. 21 at the federal court in Fort Lauderdale.</p>

He asked if I wanted to go flying over the gulf beaches and afterwards maybe go up in the tower to meet the guys who work there. How cool is that? I really like Dave and I welcomed the opportunity to hang out with him ~ flying was an added bonus!</p>

<p style="text-align:justify;">On the day of our flight the weather was beautiful, Dave was awesome, and my heart suddenly felt lighter. I cannot tell you how much fun I had that day! I&#8217;ve always dreamed I&#8217;d get my pilot&#8217;s license some day but never really saw it as a possibility. This was the day I changed my mind about that. I&#8217;m convinced now that flying a plane is something I just have to make happen as soon as possible.  Dave, you have inspired me  and lifted my spirit. What a great friend!  Thank you.</p>

Last night I fished as is usual, with the cast of usual suspects, both male and female herons flew over. The male left, the female stays with me and got rewarded with 2 fish. The water meter yesterday was<br />
at  2.98 and falling fast, a foot below the summer peak of 4.17. Will read it tomorrow am to see if the rain gave it a boost. we have to have more before winter makes it fall much more.<br />

This morning is totally gray and rainy, had to make pancakes for Adam, I have found that Hungry Jack wholewheat blueberry complete is AMAZING, you only need water, but I cheated and added Sugar cookie eggnog, (mybad!)   <a href="http://abbesworld.wordpress.com/files/2009/11/100_7397-1.jpg"><img class="alignnone size-medium wp-image-2666" title="100_7397-1" src="http://abbesworld.wordpress.com/files/2009/11/100_7397-1.jpg?w=300" alt="" width="300" height="225" /></a> and of course, top it off with light whipping cream to counter act the egg nog.  I had to top off the whipping cream after eating my pancake -  <a href="http://abbesworld.wordpress.com/files/2009/11/100_7398r1.jpg"><img class="alignnone size-thumbnail wp-image-2668" title="100_7398r" src="http://abbesworld.wordpress.com/files/2009/11/100_7398r1.jpg?w=150" alt="" width="150" height="136" /></a> YUM!<br />
