I woke up around 5:30 this morning on the beeping of my iPhone which received a short message from the wife of my friend and fellow blogger Fouad al-Farhan telling me that Fouad has been released and that he is back home with his family now. That’s great news and this is just how I wanted to start my morning!

The good news made me less nervous and more relaxed about giving my presentation today. I’m doing some final revision now and should be standing on the stage in the main room at the Hilton Hall to speak in a couple of hours.

Someone at CITC has decided to go on a blocking spree this morning and went to ban access to the alfarhan.org, freefouad.com and Horyiat blog. After detaining Fouad Al Farhan for more than 100 days because he spoke his mind, now they are trying to stop people from reading his ideas. Pathetic.

The authorities are yet to reveal the reasons for the detention, and a spokesman for MOI told CNN Arabic last week there was on update on the case. The blockage is indicative of the mentality behind the detention and it also a sing that it will last even longer.

They are wrong if they think the blockage will stop people from getting information about this case and all violations on human rights here. They are wrong if they think the blockage will stop us from raising Fouad’s issue over and over again until he is free and back to his family and friends. We know how to get around your stupid censorship, and if you block two or three blogs we can launch hundreds of new blogs.

Detained Saudi blogger Fouad al-Farhan has been allowed to make a phone call to his wife yesterday, FreeFouad.com reported. His wife said Fouad told her that he is in a good shape and his morale is high. He said he is hoping that authorities would soon allow others to visit him in jail. The website also said that Fouad would like to thank all those who supported him and his family during these tough times.

JEDDAH — The family members of the detained Saudi blogger Fouad Al-Farhan said yesterday that although Saudi authorities allowed Al-Farhan for the first time to make a telephone call from Jeddah’s Dahban Prison on Feb. 12 they would still like to continue to visit him.

Prior to the telephone call, the 32-year-old Saudi father of two has only been seen once by his father-in-law during a brief visit on Jan. 5. Al-Farhan told him that he was being kept in solitary confinement and subjected to questioning for 15 minutes a day. He has also not been informed of the charges against him. The family’s requests for further visits have so far been denied.

Speaking about Al-Farhan’s telephone call on Feb. 12, his wife told Arab News, “He talked to his mother briefly over the phone assuring her that he is all right and that he is not being harassed.” She added that he initially called home and that she was out with their children and so he telephoned his elderly mother, who lives in Taif.

She said although her husband spoke to his mother on the phone, they were still unaware of whether he was facing charges, whether he was still in solitary confinement and whether he had been given the right to legal access.

“Since he was talking to his mother for less than 10 minutes for the first time in more than two months, she was mainly concerned about his health. You know how mothers are,” she said.

Maj. Gen. Mansour Al-Turki, spokesman for the Interior Ministry, told Arab News earlier this month that there is no update on the Al-Farhan case other than the ministry’s previous statement that the blogger was being held for “interrogation for violating non-security regulations.”

Al-Turki would not clarify exactly why Al-Farhan was being held and whether it was in connection with his blog www.alfarhan.org. Al-Turki was unavailable for comment yesterday.

“Since his arrest, I rarely leave home hoping he might call. That Tuesday I had to leave to buy some things for the children,” said Al-Farhan’s wife, who has not seen her husband since Dec. 10 after officials — following his arrest at his office the same day — brought him home to search his belongings. “I was in one of the rooms with my children accompanied by women officers when they searched the house,” she added.

Saleh Al-Kathlan, head of the Monitoring and Follow-Up Committee at the National Society of Human Rights (NSHR) in Riyadh, said that the NSHR had sent a second letter to the Interior Ministry last week inquiring about Al-Farhan.

Al-Khathlan said the letter mentioned the issue of allowing Al-Farhan’s family to visit him. “According to Saudi Criminal Law detainees should not be denied visits after more than 60 days. They also have the right to see a lawyer for advice,” he added. In five days’ time, Al-Farhan will have been in prison for 80 days.

Article 119 of Saudi Criminal Law states that “the investigator shall order that the accused may not communicate with any other prisoner or detainee, and that he not be visited by anyone for a period not exceeding 60 days if the interest of the investigation so requires, without prejudice to the right of the accused to communicate with his representative or attorney.”

This is the second letter the NSHR has sent to the Interior Ministry regarding Al-Farhan’s case. “So far we have not received a response. But we will keep on following up the case,” said Al-Khathlan.

Hussein Al-Sharif, head of the NSHR’s Western Region office and a professor of law at King Abdul Aziz University in Jeddah, told Arab News earlier that the General Investigation and Prosecution Board (the Saudi equivalent of an attorney general’s office) is allowed to legally detain people for up to six months.

After six months, detainees are either freed after investigation is done or presented in a court for trial if they are charged. Al-Farhan can be thus detained for another three months.

His wife said she was perplexed how to answer her children’s queries about their missing father. She told Arab News that her youngest child Khetab, who is only 5 years old, shocked her the other day when he said that his father was not traveling but in prison. “I’ve tried to keep disturbing news away from them. However, after more than two months the kids miss their father dearly,” she said.

Last Tuesday she remained all day at home beside the phone. “I thought to myself maybe phone calls are only allowed on that particular day. But he didn’t call last week,” she said.

Al-Farhan’s blog leads with the slogan: “Searching for freedom, dignity, justice, equality, public participation (shoura), and all the rest of lost Islamic values, and for Raghad and Khetab” (Farhan’s two children).

Al-Farhan is considered in the Saudi blogosphere as being the “Dean of Saudi Bloggers” for blogging under his real name. www.alfarhan.org has tackled social issues in the Kingdom, condemned terrorism and called for “open” and “real” dialogue within the Kingdom.

في أي مجتمع حر، لا، لا يمكن أن يكون الإسلام قيد على الحرية. على العكس من ذلك، في مجتمع يحاول أن يسلبك أي حرية قد تخطر على بالك، فإنهم سيحاولون تقييدك و فرض قيود عليك من كل جانب، و قد أثبت التجارب على مر العصور أن إلباس الاستبداد “بشت” الدين هو أنجح و أقصر الطرق.

المجتمع “الخربان” لابد له من مطرقة تكسر جموده حى يتشكل على هيئة ما. بنفس الطريقة التي يستخدم بها الفنان مطرقته التي ينحت فيها عمل جمالي من لوح من الثلج.

• لماذا البعض يخاف من الحرّية؟

احتمال لأنهم ما جربوها؟ لكن الاكيد إنهم خايفين من المطرقة اللي فوق J

• كيف نرسم الخط بين حرية الفرد ومصلحة المجتمع؟

الإجابة هنا نسبية و تعتمد بشكل كبير على أية مجتمع تريد رسم الخط فيه. في مجتمعنا يرسم هذا الخط بشكل متعرج شديد الانبعاج، فيدور حول الشخصيات المهمة فلا يلمسها الخط وبالتالي تحفظ لها حريتها في رسم الخط فوق رؤوس وأجساد بقية الناس الغير مهمين.

• هل يخطر على تفكيرك اسم عالم متخصص ومهتم بقضايا الحرّيات العامّة والحقوق؟

أمممممم……..مممممممممم…… على أيامي ما كانت التربية الوطنية ضمن المناهج، و لو كانت فأعتقد أن هذا السؤال خارج المنهج يا أستاذ!

• مالذي يجعل أي مجتمع “مجتمع حر”؟

يا أستاذ، ياريت تخلي الأسئلة كلها من داخل المنهج لوتكرمت.

• ماذا سيحصل لنا عندما ينفذ النفط؟

سنبيع البراميل الفاضية في سوق الخردة.

• لماذا لازالت العبودية والإستذلال موجودان حتى الآن عند البشرية رغم وصولها لهذا المستوى العلمي غير المسبوق؟

عندما تنشغل الأمة اللتي لديها الحل الإلهي لمشاكل الانسانية بالنواح و الدعاء على من تقدم عليها، ستمسك بزمام القيادة أمم أخرى قد لاتملك نفس الحلول.

• كيف نستطيع تنمية اهتمام الناس بالشأن العام؟

أخبرهم أن الشأن العام هو (الشأن الخاص لمحمد + الشأن الخاص لعلياء+ الشأن الخاص لإبراهيم + ……) = الشأن العام. المشكلة الحقيقة في نظري هي انه مو كل الناس مهتمين بالرياضيات J

• ما هو الأهم؟ الأمن أم الحرية؟

هذا السؤال غلط، لأن فيه circular logic

• هل أعرف الحقيقة؟ هل تعرف الحقيقة؟ هل لذلك أهمية؟

كنت قد قلت:

بكل صراحة ووضوح، أعتقد فعلاً أن القاعدة قد أجرمت في حق وطننا السعودي وبلاد أخرى كثيرة. وأعتقد أن أسامة بن لادن والظواهري يتحملان مسؤولية الدماء التي أريقت بسبب فتاويهم وتنظيرهم. لا يمكن أن أصدق أن أعمال العنف يمكن أن تخرج لنا أوطاناً يعمها السلام والأمان والنمو والإستقرار. لا يمكن أن أصدق أن من يحمل سلاحاً في وطن آمن، يمكن أن يكتفي بالتحاور معي شفهياً في الغد عندما أختلف معه. أعتقد أن الحل “الجهادي” الذي تطرحه القاعدة وأتباعها هو وصفة سريعة لتحويل الأوطان إلى جحيم لا يمكن العيش فيه.

اليوم الشيخ سلمان العودة وجه رسالة لا تنقصها الصراحة لأسامة بن لادن يتبرأ فيها من أطروحاته وأعماله.
لا يمكن أن يكون ما فعلته القاعدة هو الجهاد الذي نعرفه في الإسلام. هو عنف واضح وإرهاب جلي. نحر الرقاب بالسكاكين وقتل الناس بالجملة واستهداف الآمنين والتدمير العشوائي ليس من الإسلام في شيء. من يرى أن الواقع السيء لأمتنا يبرر أن تصل ردة فعلنا لهذه الدرجة من العنف الجنوني فعليه حقاً أن يعيد النظر في أسلوب تفكيره. لا ينكر عاقل سوء وضع أحوال الأمة ولكن لا يمكن أن أقتنع أن الحل الجهادي كما تطرحه القاعدة هو السبيل للخلاص

“حق الفرد في التعبير عن رأيه”، هو حق إنساني يتمتع به بلايين البشر في عالم اليوم بنسب متفاوتة في درجات شفافية التطبيق. تطبيق هذا الحق على أرض الواقع ساهم في إثراء الحياة المدنية للعديد من الدول والمجتمعات. كما نتج عنه بعض السلبيات والشواذ التي لا يبرر بروزها سعي البعض لإلغاء أو تهميش هذا الحق الإنساني المهم. لن يكون محور كلامي هنا السعي لتأصيل هذا الحق الإنساني أو إبراز إيجابياته وذلك لعمق وطول هذا الموضوع الذي قتل بحثاً من قبل في الآف الكتب والدراسات والأبحاث العربية والعالمية. بالنسبة لي، فقد حسمت هذه القضية عندي. فقد تمحورت قراءاتي خلال الستة الشهور الماضية حول هذا الموضوع، وحول ما إذا كانت “الديموقراطية” متوافقة مع الإسلام أم لا؟، وحول مفاهيم “حقوق الإنسان” وتوافقها مع الشريعة. كلامي هنا ليس موجه لمن لا زال لديه إشكال عميق تجاه هذه المسائل. هذا الإشكال الذي هو نتيجة توهم وجود تعارض بين “حرية التعبير” كما نسعى إليها والشريعة الإسلامية. كلامي هنا موجه لمن حسم أمره تجاه هذه القضية، وأصبح يؤمن بحق الفرد في التعبير عن رأيه بدون خوف وإرهاب، وموجه كذلك لمن لازال منفتحاً على الحوار والنقاش البناء الذي نسعى إليه لنستطيع الخروج جميعاً بحلول جذرية تساهم في إصلاح المجتمع السعودي، وتساهم في نموه بشكل سليم ومنطقي.

إقتناعاً منهم بقدسية “حرية التعبير”، لم تتوانى الأمم والشعوب والجماعات والأفراد عن ابتكار وتطوير الأدوات المناسبة، والتي تسمح لهم من خلالها بالتعبير عن آرائهم بحرية. هذه الأدوات تجعل من الأفراد في وقت قياسي قوة ضغط فعالة ومؤثرة. لا تعتبر هذه الأدوات حكراً على شعب دون آخر، أو أمة دون أخرى، ولكن هي ملك لكل الشعوب لأنها نتيجة نضال المقهورين عبر العصور ضد قوى الظلم والطغيان. ولذلك يحق لكل فرد/جماعة/شعب الإختيار من بين هذه الأدوات ما يعتقد أنها مناسبة له ولمن يشاركه النضال في سبيل التعبير عن آرائهم. أرى بأن التدوين هو أحد أهم وأقوى هذه الوسائل التي يمكن أن نستفيد منها كمجتمع سعودي للتعبير عن آرائنا الفردية.

في السعودية، ليس هناك أي شيء يشير إلى أن حق “التعبير عن الرأي” هو حق مكفول للمواطن للأسف الشديد. ذلك لسبب واضح وهو أننا الدولة الوحيدة التي يمكن أن أتذكرها لا تملك دستور مكتوب. الحكومة تقول لنا بأن دستورنا هو “الكتاب والسنة”. ولكن في عصر مثل عصرنا هذا لا يمكننا العيش والنمو كمجتمع بدون دستور مكتوب يوضح مسؤولية كل من الفرد، ،مؤسسات المجتمع، والحكومة. لأنه بدون دستور مكتوب، يصبح المرجع في تفسير الكتاب والسنة هي الحكومة والعلماء الرسميين فقط. وفي هذا مفارقة صارخة مع أصل الإسلام الذي أتى ليحرر البشرية من الطبقيات والمرجعيات واحتكار تفسير الدين وتطبيقه. لو بحثنا في السنة مثلاً عن الموقف من نقد عمل الحكومة لوجدنا ألف رأي ورأي. مثلاً هناك رأي فقهي معتبر يحث على ذلك، وهناك رأي فقهي معتبر آخر يحرم ذلك. ما لذي علينا كمواطنين أن نلتزم به؟ لا يوجد لدينا دستور مكتوب نعود إليه لنتخذ الموقف المناسب تجاه “حق التعبير عن الرأي”. ولذلك فإن بقاء المجتمع السعودي بدون دستور مكتوب ليس في مصلحة أحد، إلا تيار معين في الحكومة وجزء معين من التيار الإسلامي للأسف الشديد.
ولذلك، نجد أن أول خطوة في سبيل الإصلاح نتمنى من الحكومة اتخاذها هي السعي لتوثيق دستور سعودي متكامل يساهم في وضعه المواطنين ويحق لهم التصويت عليه. هذا الدستور الذي يوضح بشكل جلي العلاقة بين المواطن والحكومة ويفصل في أمرها. دستور يحمي الوطن والمواطن، ويوفر دعامة قوية للنمو والتطور، ويجيب على أسئلتنا المقلقة كمواطنين حول مستقبل وطننا.
ولكن، متى يحصل هذا؟ متى تقدم الحكومة السعودية على هذه الخطوة؟ كل الدلائل تشير إلى أن ذلك لن يحصل في القريب العاجل. فاعتقال الإصلاحيين العشرة في جدة وقبلهم العديد من المواطنين المطالبين بالدستور، يشير بشكل واضح أن أجنحة معينة في الحكومة تسعى لإفشال الخطوات الإصلاحية التي نشعر كمواطنين أن الملك عبد الله بن عبد العزيز ربما يرغب في تطبيقها. ليس هناك ما يشير في الأفق إلى حالة انفراج سياسي قريبة في السعودية. بل إن الأمور تزيد سوءاً يوماً بعد يوم للأسف.

كمواطنين سعوديين، لدينا خياران:
الخيار الأول- أن نبقى صامتين، ونتجاهل الوضع، ونواصل مشاهدة وطننا يتدهور يوماً بعد يوم متجهاً بشكل متسارع نحو المستقبل المخيف. البطالة متزايدة، الجرائم تتعاظم، الفقر يزيد، سوق الأسهم، المشاكل العائلية، سرقات المساهمات، السجن التعسفي، إرهاب وتفجيرات…
الخيار الثاني- أن نسعى وبشكل سلمي إلى التعبير عن آرائنا. نحن مواطنين وهذه بلدنا، ولنا الحق في رفع صوتنا، خاصةً وأننا نرى مستقبلنا كمجتمع يتجه نحو الهاوية.

وضع التدوين السعودي

التدوين هو أداة حديثه وفعاله من أدوات التعبير عن الرأي. وهو أحد إكتشافات الإنترنت المؤثرة. برز التدوين كأداة قوية وفعالة للتعبير عن الرأي للأفراد والمجموعات بشكل قوي في الدول الديموقراطية. وكان ذلك بسبب وجود العوامل المساعدة لتسريع تفعيل أثر التدوين. وأقصد بالعوامل هنا أمور مثل: ثقافة الشعوب، الديموقراطية، وجود الدساتير، حقوق الإنسان، خطوط الإتصال، وغيرها من العوامل. أما في الدول الغير ديموقراطية، فإن التدوين لازال يحاول جاهداً وبشكل مثير للإعجاب، أن يحقق ما حققه التدوين في الغرب من أثر إيجابي على الحياة اليومية للمواطنين. في مصر، هناك محاولات تستحق المساندة. وهناك كذلك تضحيات تثير الإعجاب. وفي إيران هناك مليون مدونة كما قال لي أحد الصحفيين. ويكفي أن نعرف أن للرئيس الإيراني مدونة شخصية لنعرف أن التدوين أصبح شيء واقع ومحرك أساسي في الحياة اليومية الإيرانية.

أما في السعودية، فرغماً أن هناك محاولات فردية مشكورة من قبل بعض المدونين. إلا أنه لا زال دون التأثير المأمول. فالأغلبية الساحقة من المدونات السعودية لازالت تتراوح بين التدوين الترفيهي والتدوين الإجتماعي الأليف. ليس للتدوين السعودي حتى اليوم أثر في الحياة اليومية للمجتمع السعودي. لو قسنا أثر موقع انترنت واحد مثل موقع الساحات لوجدنا أثره في الحياة اليومية السعودية يفوق بمراحل كل ما يطرح في جميع المدونات السعودية. هذه حقيقة مؤلمة ولابد من طرحها بشفافية. لسنا هنا ضد التدوين الشخصي. بل إننا نشجع عليه وبكل قوة. ولكن هذا ليس بمبرر لعدم قيام المدونين والمدونات السعوديين بالكتابة الجادة في الشؤون السياسية والإجتماعية. أصبح للإنترنت تأثير واضح في حياتنا كسعوديين، والتدوين يجب أن يكون كذلك.

أسباب ضعف التدوين الإجتماعي والسياسي السعودي :
على الرغم من وجود بعض المدونات السعودية المهتمة بالشأن السعودي العام، إلا أن عددها قليل جداً مقارنة مع عدد المدونات السعودية المتواجدة على شبكة الإنترنت. هذه المدونات تشكل الإستثناء حالياً، ورغماً عن كل شيء فإنهم يشكرون بشدة على جهودهم. لو حاولت حصر أسباب الضعف الحالية فإنني أجدها ربما لا تخرج عن العوامل التالية:

1- الخوف من الحكومة :
المدونين والمدونات السعوديين هم مواطنين في الأساس. ويجري عليهم ما يجري على المواطنين. وعلاقة المواطن بحكومته قائمة في جانب كبير على الخوف ووجوب الطاعة العمياء “لولي الأمر”. خوف المواطن من التعبير العلني عن رأيه يرجع لأن الحكومة السعودية تعتقل مواطنيها بناءً على آرائهم. وإن لم تعتقلهم، فإنها تقوم بالتضييق عليهم بعدة طرق منها فصلهم من وظائفهم أو حرمانهم من التقدم في مناصبهم الوظيفية بعد إستجوابهم وفتح سجلات خاصة بهم لمتابعتهم. والأمثلة هنا أكثر من أن تذكر. إن إعتقال الحكومة للإصلاحيين السعوديين ومحاكمة بعضهم وزج الآخرين في السجون لشهور طويلة بدون توجيه أي تهم أو محاكمات لهم هو أمر واقع رأيناه وعشناه ونعيشه كمواطنين سعوديين. هذه الأمثلة الثابتة، تشكل أكبر هاجس خوف لدى المدونين السعوديين لأنها تجعل المدون يسأل نفسه “إذا كان من هم أشهر مني وأعلم مني قد زج بهم في السجون وتعرضوا للظلم الفاضح ولم يجدوا من يدافع عنهم، فماهو مصيري إذاً؟ خاصةً وأنه لا أحد يعرفني وما سأكتب لن يغير شيئاً من الواقع؟ لماذا ألقي بنفسي للتهلكة والسجن وأغامر؟”

2- الخوف من نقد المجتمع :
كسعوديين نعرف أننا لا نجيد كثيراً ثقافة الحوار. ولذلك لأول مرة في تاريخنا يقام سلسلة مؤتمرات بإسم “مؤتمر الحوار الوطني”. وهناك عدة أسباب لضعف ثقافة الحوار في المجتمع السعودي، من بينها:
- عمق الهوة بين الأجيال: هناك تفاوت كبير في أعمار أفراد المجتمع. ويكفينا أن نعرف بأن نصف الشعب 50% هم أقل من خمسة عشر عاماً.
- تداخل الدين مع العادات: لفترة طويلة لم يكن يستطع الكثير تمييز الخط الفاصل بين العادات والدين. فقد أدخلت كثير من العادات في الدين ومزجت حتى أصبح من الصعوبة إنتقادها وذلك لأن إنتقادها يوحي بأن الشخص ينتقد ذات الدين.
- العنصرية الداخلية: رغماً أن القبلية والمناطقية ليست مضادة للدين والوطن بل يجب أن تكون داعمة له، إلا أنها في كثير من الأحيان تلعب دوراً سلبي في عملية النقد الذاتي. فعندما ينتقد فرداً ما ظواهر أو عادات معينة في المجتمع، يبادر الكثير بالنظر لأصل وفصل الناقد وخلفيته العائلية. وكثيراً ما تستخدم هذه النقطة كوسيلة لتهميش طرح الناقد وتضعيفها لأنه من أصل أو منطقة دون مستوى أصل ومنطقة الناقد. للأسف، نعم هناك عنصرية داخلية وإن كنا لا نسميها كذلك إلا أن ذلك إسمها. وهذه العنصرية تنطلق من الجميع إلى الجميع. فالجميع ليس بريء هنا إلا من رحم الله.

3- الخوف من العائلة:
العائلة كانت و لازالت أساس بنيان المجتمع السعودي. والمواطن السعودي غالباً ما يكون متأثراً ومحكوماً بشكل كبير بآراء وتوجيهات العائلة (القبيلة، الوالدين، الإخوة الكبار). قليلة هي العوائل التي تدرب أبناءها وبناتها على إستقلالية الرأي وتتيح لهم التعبير عن آرائهم بحرية وبشكل علني وتدعمهم بغض النظر عن مدى موافقتهم على هذا الطرح. بل أنها غالباً ما تلعب دور “المثبط” الداخلي والقامع لأفرادها وذلك بطيب نيه، وسعياً لسلامة ذلك الفرد لأنه “لا يعرف مصلحته بعد” و “متهور” و غيرها من الأسباب الواهية. الأغلبية الساحقة من شباب المجتمع لازال يكترث كثيراً لتأثير نشر آرائه على عائلته. وذلك ينعكس أيضاً على عالم التدوين. وخاصةً بالنسبة للمدونين الذين يعلنون عن أسماءهم بشكل علني. فهؤلاء في موقع أصعب من المدونين المجهولين.

4- الخوف من بيئة العمل:
حتى الآن لم أرى مدونة لمدرس ينتقد فيها بشكل جدي بيئة التدريس ويكشف خبايا ما نجهله في هذا المجال المهم من حياتنا اليومية كمواطنين. ولم أرى موظف في شركة الإتصالات السعودية يدون حقائق حول هذه الشركة والتي اشتهرت بالنصب على المواطنين. أما أن أرى مدونة لموظف من أرامكوا يخبرنا ما يحصل خلف تلك الجدران المنيعة للشركة المسؤولة عن بيع نفطنا فهذا حلم لازلنا ننتظر حصوله. سبب غياب هذه المدونات من وجهة نظري هي ثقافة الإستبداد الراسخة في جهات الأعمال. حيث أن جرأة موظف لأن يدون عن حقائق بيئة عمله ستكلفه غالياً. فربما يخسر وظيفته أو ينسى فرصة ترقيته. وغالباً سيجد أن أصدقاء عمله يتحاشون الكلام معه وسيصح وحيداً لا يدعى لتجمعاتهم ولقاءاتهم. في هذه الحالة أرى بأن عدم ذكر المدون لإسمه مبرر مقبول نوعاً ما.

Saudi Arabia recently passed a law limiting the use of internet in an attempt to fight terror and immoral activities, the news portal Arabian Business reported.

The new law forbids airing websites containing incitement to terrorism, pornography, defamation, fraud, violation of religious values, and disregard for public etiquette.

A person found guilty of operating a terror website faces up to 10 years in prison and a $1.3 million fine.

Site owners, who show pornography and contents violating religious values, may receive up to five years in jail and a $800,000 fine.

The new law was introduced to “combat IT-related crimes that threaten the security and safety of human societies,” the Saudi Interior Ministry said.

On December 10th, the Saudi authorities arrested Fuad Al-Farhan, a local blogger. Al-Farhan was arrested for investigation regarding “suspicions not connected to security matters,” Saudi Arabia’s Interior Ministry Spokesman Man’sour A-Turki said.

Following the arrest, Al-Farhan’s friends posted a letter allegedly from the blogger himself in which said he believed the authorities were targeting him because he “wrote about political prisoners in Saudi Arabia.”

Today there are hundreds of Saudi Bloggers, who rarely use their real names. Al-Farhan was one of the few who do. Ahmad Al-Omran, a Saudi blogger, said he believed Al-Farhan’s arrest may be an attempt to intimidate other bloggers.

Dear President Bush:

The Committee to Protect Journalists is writing to you in advance of your expected meetings next week with Saudi Arabia’s King Abdullah and Egyptian President Hosni Mubarak. We would like to draw your attention to the ongoing imprisonment of two journalist bloggers as well as to other restrictions on the press in each country.

We hope you will use your visits with both leaders to express deep reservations—both in public and in private—about the unjust imprisonment of our colleagues and the ongoing harassment many journalists face.

On December 10, Saudi security agents detained Fouad Ahmed al-Farhan, a young Saudi blogger who runs Alfarhan.org, a popular pro-reform Web site that publishes social and political commentary. Saudi officials have been virtually silent about the detention; a Saudi Interior Ministry spokesman said that al-Farhan was being questioned “about violating non-security regulations.” Throughout his one-month detention, Saudi and other Arab bloggers have rallied on behalf of al-Farhan, deploring his detention without charge and calling for his release.

In an e-mail sent to friends prior to his arrest, al-Farhan explained that he had received a phone call from the Saudi Interior Ministry instructing him to prepare himself “to be picked up in the coming two weeks” for questioning by a high-ranking official. He also stated in the e-mail that he believed he was being summoned “because I wrote about the political prisoners here in Saudi Arabia and they think I’m running an online campaign promoting their issue.” In one of his last posts before his detention, al-Farhan sharply criticized 10 influential Saudi business, religious, and media figures.

Young bloggers like Fouad al-Farhan have taken advantage of the Internet to circumvent tight government control of the Saudi media. The government frequently reins in criticism by dismissing or blacklisting critical writers and by pressuring journalists behind the scenes. In the face of such restrictions, these bloggers have helped expand social and political debate, exercising their right to free speech in a way that is otherwise impossible in their countries.

In Egypt, another reformist online journalist, Abdel Karim Suleiman, remains in jail, serving a four-year jail term for allegedly insulting Islam and President Mubarak. His was the first prison term given to a blogger in Egypt. Suleiman, a former student atCairo’s Al-Azhar University, the preeminent higher learning institution in Sunni Islam, had frequently accused this state-run religious university of promoting extremist ideas. He also criticized President Mubarak, whom he referred to as a dictator. Eventually expelled from Al-Azhar in 2006, Suleiman was arrested in November 2006 and charged for his online writings.

Suleiman’s imprisonment was a prelude to a surge in attacks on independent Egyptian journalists and bloggers over the last year. Several have been criminally prosecuted or convicted in politically motivated trials, among them leading independent editor Ibrahim Eissa, who faces possible prison time for articles he wrote about President Mubarak’s health.

In a speech before a group of international political dissidents in Prague last June, you restated your administration’s policy to support democracy worldwide by saying, “My message to all those who suffer under tyranny is this: We will never excuse your oppressors. We will always stand for your freedom.” You added that the U.S. is using its influence to press close allies such as Egypt and Saudi Arabia “to move toward freedom,” and that it “will continue to press nations like these to open up their political systems, and give greater voice to their people.”

“Inevitably, this creates tension,” you stated. “But our relationships with these countries are broad enough and deep enough to bear it.”

It is in this spirit that we encourage you to urge King bdullah and President Mubarak to do everything in their powers to ensure that our colleagues are released and that other journalists are able to work freely, without the threat of intimidation and harassment. Such a forceful stand would both help support a free press and also bolster your administration’s policy of holding its allies to account when they violate the fundamental right to freedom of expression.

Reporters Without Borders and the Arabic Network for Human Rights Information (HRinfo) wrote today to the King of Saudi Arabia, Abdallah Bin Abdulaziz Al Saud, to request the release of blogger Ahmad Fouad al-Farhan, who has been held for the past month.

Letter sent on 10 January to the King of Saudi Arabia, Abdallah Bin Abdulaziz Al Saud, by Reporters Without Borders General-Secretary Robert Ménard and HRinfo Executive-Director Gamal Eid.

“Your Majesty,

Reporters Without Borders, an international press freedom organisation, and the Arabic Network for Human Rights Information, HRinfo, would like to share with you their concern about the case of Ahmad Fouad Al-Farhan, a blogger who has been held by your Ministry of Interior since 10 December.

HRinfo issued a statement calling on the Saudi government to immediately release Mr. Farhan and to explain the reasons for his arbitrary detention. However, there has been no response from your government and our two organisations would like to know the reason for your government’s silence on this matter.

US assistant secretary of state Sean McCormack raised this issue with your government during a visit to your Kingdom on 3 January. We recommend transparency as the best response and we hope for a positive evolution in this case, which has raised a considerable stir in the international blogosphere and in the media. An online protest staged by prominent organisations on 6 January was a great success and showed the level of blogosphere support for Mr. Farhan. Articles are being posted every day about his plight.

It would be a shame if the Kingdom of Saudi Arabia’s image were to be marred by this arbitrary detention, in which there are no grounds for any charges, as the Ministry of Interior’s spokesman, Gen. Mansour Al-Turki, implicitly acknowledged when he said he had no additional information about the reasons for Mr. Farhan’s arrest.

Access to more than 400,000 websites hosted in Saudi Arabia and abroad is currently blocked in the Kingdom, including websites specialising in human rights and civil liberties. Censorship is visible in Saudi Arabia and is openly defended in the name of the protection of Islamic moral obligations.

We urge you to order Mr. Farhan’s immediate and unconditional release and to reiterate the undertakings you have given on the reforms initiated in the Kingdom, which is still considered to be one of the most repressive countries as regards Internet filtering policies. His release would be seen as evidence of your will to improve respect for free expression.

We trust you will give our appeal your careful consideration.”

Dear Fouad,

It has been a month since you were detained, and I miss you. It has been a rough month for the rest of us here, but it is certainly nothing compared to what you have had to go through and still do. They told us you were detained because you violated non-security regulations. Gibberish, to say the least, but that’s what we were told. I really don’t know what kind of law you violated by merely exercising your God given right of free speech, and I don’t know when calling for freedom, justice, peace and moderation has become a crime.

But here is what I know. I know that all these values you called for are worth fighting for. I know that we believe in a just cause, and that tomorrow belongs to us, not them. I know that no matter how long the darkness lasts, the sun will rise again. I want you to know one thing: I am here for you. I will keep supporting you and I will do my best until you are free again and back to your family and friends. You will not be forgotten.

Reporters without Borders plans to launch a petition this week calling for the release Saudi blogger Ahmad Fouad Al-Farhan, the press freedom advocate group toldArabianBusiness.com on Sunday.

Clothilde Le Coz, head of the internet freedom desk at Reporters without Borders, said the group also planned to write to the minister of interior over Al-Farhans’s imprisonment.

Authorities in Saudi Arabia arrested the popular 32-year-old blogger on December 10 for violating “non-security regulations”, but his detention was not made public until last Tuesday.

Al-Farhan’s blog – Searching for freedom, dignity, justice, equality, shoura and all the rest of lost Islamic values – has posted a letter, allegedly from Al-Farhan, which states he believes he was arrested because he “wrote about political prisoners in Saudi Arabia”.

Reporters without Borders has condemned Al-Farhan detention, which is believed to be the first arrest of an online critic in the kingdom.

“The reforms and the opening announced by King Abdallah Ibn Al-Saud have yet to have any impact on the lives of Saudis, including those who openly express their disagreement with government policies,” the group said in a statement last week.

“After blocking the news website Elaph and the leading blog publishing service www.blogger.com, the authorities have now directly targeted a blogger for the first time.”

Saudi Arabia is on the Reporters without Borders list of ‘13 internet enemies’ and was ranked 148th out of 169 countries in the Reporters without Borders world press freedom index that was published in October 2007.

The Saudi government’s official internet blacklist is believed to affect more than 400,000 websites, ranging from the sites of political organisations to those of unrecognised Islamist movements and pornography sites.

According to Reporters without Borders, Saudi Arabia does not hide its online censorship.

“Censorship concentrates on pornographic content, but it also targets opposition websites, Israeli publications, or sites dealing with homosexuality. Blogs also pose a problem to the Saudi censors. Last year they tried to completely block access to the country’s biggest blog tool, blogger.com. But now they just block the blogs that are deemed unacceptable,” the group said on its website.

En España muchas veces no apreciamos la gran libertad de expresión que disfrutamos. Hay pocas líneas rojas y es difícil cruzarlas. Pero cuando lo consigues dibujando al príncipe en “actitud comprometedora” haciendo un chiste sobre el trabajo de sus majestades, tu revista gana lectores y notoriedad internacional.Sin embargo, unos meridianos más al Este y un paralelo más abajo, las cosas son bien diferentes. Hacer referencia a la parte más incómoda de la realidad puede llevarte a la cárcel sin acusación clara y sin garantías legales. Eso mismo le ha pasado a Fouad Al-Farhan, que lleva desde el 10 de diciembre en la trena “colaborando con la policía” o algo así y se ha comido los turrones entre rejas. Historia en CNN.

Si nos hacemos eco de ésta y otras historias, lograremos que la censura sea contraproducente, como lo fue en la caso El Jueves. Esperemos que los reyes magos le traigan libertad que los otros reyes le quitaron. De momento “El Mundo” ya se ha hecho eco.

El fenómeno blogger en Arabia Saudí es muy interesante. El gobierno que llegó a bloquear Blogspot para luego dar marcha atrás. Y es que no se puede ir contra corriente indefinidamente. Hoy internet es el medio más usado por los jóvenes saudíes para informarse a pesar de la censura de miles de páginas web. Censura que los saudíes han aprendido a saltarse y es que no hay nada más atractivo que lo prohibido.

رسالة إلى الكاتب محمد حسن علوان ردا على مقاله بجريدة الوطن المنشورة اليوم بتاريخ 3 يناير 2008

نشكر لك تفاعلك مع قضية المدون السعودي الشهير فؤاد الفرحان وإن جاء متأخرا بعض الشيء حيث ان الخبر قد تناولته الصحافة العالمية خارج بلده بجرأة عجزت عنها صحافتنا المحلية للأسف، لكن لك كل الشكر على جرأتك على التطرق للموضوع على أية حال. اسمح لي أن أناقشك في بعض النقاط التي وردت في ثنايا موضوعك عن الشاب فؤاد الفرحان والذي يكن له مجتمع المدونين السعوديين بما فيهم – كاتبة هذه السطور- أكبر الاحترام و التقدير لأنه رائد في مجاله و لأنه يعد من أشجع المدونين السعوديين نظرا لكتابته تحت اسمه الصريح و لأنه ساهم في رفع سقف الطرح المحترم في المدونات السعودية دون أن يدعوا للخروج على القوانين ولا الأنظمة المعمول بها، لكن ثق أن احترامي و تقديري للمدون فؤاد لن يكون له أثر في حياديتي في النقاط التي سأناقشك فيها فيما يلي.

أولا: يهمنا كلنا كمواطنين أولاً و كمدونين ثانيا أمن هذا البلد و استقراره ولا نرضى أن يمس وطننا في كرامته أو استقراره أو سلامة مواطنيه ولو بمقدار ذرة من خردل، و من هذا المنطلق تأتي كتاباتنا و تعبيرنا عن أفكارنا الحرة تجاه ما نراه من أخطاء و تجاوزات استنادا على مبدأ حرصنا على هذا البلد ورغبتنا في التطوير و من منطلق حريتنا في التعبير. ولا أظنني أحتاج لإيضاح أنه و من هذا المنطلق أيضا فكلنا كمدونين نعتبر المساس بأمن هذا الوطن أو التحريض على أعمال هدّامة أو فكر ضال – كما يسمى في وسائل الإعلام الرسمية – خطاً أحمر لا نتجاوزه دون الحاجة لرقيب يقف على رؤوسنا ليتأكد من هذا الأمر .

ثانياً:

أننا كمدونين لا نسعى لأي بريق ولا لأي من “العوائد المعنوية” سواء “الساطعة” منها أو غير الساطعة، فنحن لا نتقاضى أجرا على أعمدة صحفية نكتبها، ولا نكتب لإرضاء مسؤول أو للتحريض على أحد أيا كان. نحن شباب هذا الوطن و كل همنا يا سيدي هو أن تكون أحوال وطننا مناسبة لتطلعاتنا كشباب نعيش في عصر التقدم والتكنولوجيا وحرية الفرد ولا يرضينا كما لا يرضي أي شريف غيور على وطنه أن نرى مستوى المعيشة ينحدر بنا يوما بعد يوم سواء من ناحية الخدمات أو الحريات أو غيره في الوقت الذي تتقدم علينا أمم لا تملك مقومات مثل التي نملكها.

ثالثا: ذكرت في مقالك أن “المدونة التي لم تُحجب في السعودية حتى الآن لم تخرج موضوعاتها عن إعادة صياغة إعلامية لما يشغل الرأي العام ابتداءا من غلاء الأسعار، إلى سوء الخدمات، ومشاكل القضاء ” ألا ترى معي أن كون المدونة لم تحجب دليل على أن السلطات لم تجد فيها أي شيء يمس أمن الوطن أو استقراره أو أي آثار من بقايا “ديماغوجيا” أو “ديمونايزيشن” مثل ما وصفتها أنت؟؟ إن لم تتمكن من “هضم” هذا كدليل على براءته من التهم التي نسبتها إليه بطريق مباشر و غير مباشر هل تستطيع أن تفسر لنا بعيدا عن الديماغوجيا تصريح مسؤول وزارة الداخلية الذي أفاد فيه بأن فؤاد لم يعتقل لأسباب أمنية أو ثورية أو لأنه يحرض الجماهير؟ أما وصفك للمدونة بأنها “…ولكنها في نفس الوقت، تفشل في رؤية مشاكل نفسها” إن كنت تعتقد بأن عدم رؤية المدونة لمشاكل نفسها يجعل من العدل أن يرمي بصاحبها في السجن فماهي إذا من وجهة نظرك العقوبة التي تستحقها الصحافة ووسائل الإعلام السعودية وهي تفشل يوما بعد يوم في تلمس مشاكلها المزمنة وإحبإطاتها المزرية؟!؟

رابعا: ذكرتم أيضا أن “المدونة تسطّح بعض القضايا المعقدة، وتغبش أبصارنا بالغضب السلبي … لأنها تنغمس في حالة الحنق الاجتماعي التي جعلتها عرضة لكثير من الأخطاء الأخلاقية والتكنيكية، وأخرجتها من نطاق الإصلاح الاجتماعي لتوقعها في دائرة ديماغوجية ضيقة جداً” وقمت مشكورا بتعريف مصطلح الديماغوجيا لمن لا يعرفها بأنها “استراتيجية لحشد الأتباع عن طريق محاباتهم ودغدغة مخاوفهم وتوقعاتهم وملامسة تظلماتهم … ” إلى آخر تعريفك لكنك أغفلت – ربما سهوا – أهم جزء من التعريف وهو أن الهدف من الديماغوجيا هو لكسب مصلحة سياسية وبدون وجود هذه المصلحة تسقط صفة الديماغوجيا هذه من أصلها سيدي الفاضل. فإن كنت لا تعلم ففؤاد لم يكن من مريدي المناصب ولم يكن لديه طموحات سياسية، و لا أعتقد أن الطموح السياسي هو “طموح مشروع” أصلا في وطننا فلا مجلس الشورى لدينا منتخب ولا أظن أن غاية طموح فؤاد كان أن ينتخب في المجلس البلدي!!

خامسا: ما أثار استغرابي فعلا هو النقطة التالية في مقالك حين قلت أن استراتيجية المدونة – أي بدون لف و دوران استراتيجية فؤاد، لاحظ كلمة استراتيجية وكأن فؤاد أصبح حزب أو منظومة وليس مدوّن يعبر عن مشاعره في مدونة شخصية – “هي استخدام مؤثرات وخطاب عاطفي ملتهب قائم على المغالطات وإلى تهيج شعبي غير نافع في معظم الأحيان” !!! يا أستاذنا الفاضل عن أي مغالطات و عن أي تهييج شعبي تتحدث؟؟ أولا أنت تغالط نفسك لأنك قلت في معرض حديثك : “الشعب ملموسة أعصابه بشكل مكشوف” هل لاحظت ذلك أم أن العبارة قد أفلتت من عقلك الباطن لا شعوريا؟ هل غلاء الأسعار الذي اكتوى بناره المواطنين و أنا و أنت منهم مغالطة؟ أم هل المهازل التي يقوم بها القضاء والتي وجهت أنظار العالم إلينا بطريقة لا نحسد عليها مغالطة؟ أم يا ترى فضيحة حصولنا على مراكز متقدمة في مقياس تخلف التعليم هي المغالطة؟ أوووه عفوا ربما كانت مغالطة فؤاد الكبرى هي إشارته إلى مشكلة السكن التي يعاني منها 60% من سكان المملكة… لا أدري من أين يأتي فؤاد بمغالطاته هذه لكن الذي أعرفه هو أن الكثير من زملاءك من الصحفيين في جريدة الوطن ارتفعت أصواتهم بالشكوى مؤخرا من نفس هذه “المغالطات” التي تحدث عنها فؤاد و لم يقم أحد باتهامهم بالديماغوجيا أوالغضب السلبي!

سادسا: كما أوضحت اختلافي معك في بعض النقاط، ملازمة الحق توجب عليّ أن أشير إلى النقاط الجيدة في مقالك أيضا، أحترم في قلمك أنه لم ينزلق كما هي عادة الكثير من كتابنا إلى الدخول في نوايا الناس و محاكمتهم على مافي داخل عقولهم و إن لم يصرحوا به، فقولك “ لأن حسن النية يبدو واضحاً في كل ما فيها، وشخصية المدوّن الكتابية تنضح بالطيبة، والمثالية، وروح التطوع، والعمل على تطوير الحس الأخلاقي والوطني العام “ تقديمك للنية الحسنة على النية السيئة يدل على رقي قلمك وحسن نيتك أنت أيضا لكن ذلك لا يمنع أن أختلف معك في تبريرك الغير منطقي لحبس شخص عبر بساطة عن آرائه و همومه التي هي هموم كل المواطنين والرمي به في السجن دون توجيه تهمة واضحة له ودون السماح لأهله بزيارته أو السؤال عنه أو حتى معرفة مكان اعتقاله، هذه الأشياء يسكت عنها حين تحصل في دول بوليسية لكن في الدول التي لازال مواطنيها يشعرون بأدنى حد من الكرامة وحقهم في العيش الكريم بإنسانية يحق لنا أن نتساءل و أن نعرف السبب لا نرأن مي التهم جزافا دون أن نشعر بأدنى حرج من ذلك.

سابعا: “الإنزعاج” الذي يعاني منه الشعب السعودي والذي ازدادت حدته مؤخرا يجعل “الصواب المنطقي“ يرحل بعيدا بعيدا جدا دون الحاجة لتدوينات فؤاد أو غيره. فكيف بالله عليك لا ينخفض صوت هذا الصواب بل كيف لا يصاب بالصمم و البكم معا في ظل الظروف المعيشية الصعبة التي يعيشها المواطن المغلوب على أمره و يكتوي بنارها يوميا وليس من طريق لديه للتعبير عن مطالبه؟ فلا نائب انتخبه يستطيع أن يطالبه بتغيير، ولا شفافية في أجهزة الدولة تعطيه القدرة على حتى تخيل نور في آخر النفق، و أعضاء مجلس الشورى -عليهم الصلاة والسلام- يرون أننا لا نعرف مصلحتنا كمواطنين ولذلك من الأفضل لنا ألا تزيد الحكومة رواتبنا ومن تجرأ منا على الاعتراض خرجوا عليه بفتوى عدم جواز الحديث عنهم بسوء. قل لي بالله عليك ألا نستحق أن نأخذ لقب شعب الله المقهور أو على الأقل أن يسمح لنا بالحديث عما نعانيه على الأقل حتى لا نموت كمداً ؟!؟!

ثامنا: إن كنت قد غضبت على ما أصاب بعض الوزراء والمسؤولين – عليهم السلام هم أيضا – من تجريح أو نقد صريح أليس من حق المواطن أن تغضب له مثل غضبتك تلك؟ أليس من أبسط الواجبات على من تولى منصب عام هو أن يتقبل النقد إن أخطأ في القيام بمهامه وواجباته، لم لا يعترف بحق المواطنين في محاسبة مسؤوليهم ويعترف فقط بحق المسؤولين في عدم المساس بهم. أليس من المستغرب أن يصدر هذا من شخص تعلم في الغرب – كما علمت – ؟ أنا شخصيا وإن كنت لا أتقبل صورة وزير التجارة و العبارة التي كتبت عليها في مدونة فؤاد ولا أجدها صورة مناسبة، لكني في المقابل لا أتقبل منظر المواطن المسكين الذي يصرف راتبه الشهري كله في رحلتين للبقالة و يبقى بقية شهره في هم و غم لأنه لا يعرف كيف سيوفر لعائلته ما يكفيهم بقية الشهر دون أن يقف على أبواب قصور الشيوخ من التجار ورجال الأعمال ينتظر حسناتهم. لا أستطيع أن أتقبل صورة العائلة السعودية التي تعيش بيت من الصفيح ويبدو على ملامح أطفالها الجوع و انعدام الرعاية الصحية. لا أستطيع أن أتقبل صورة مدينتي جدة وقد تحولت إلى عجوز البحر الاحمر تعاني شوارعها من الجدري و أنابيب مياهها من التصحر و لا يجد من مرض من ساكنيها أسرة في مستشفياتها المعدودة ومطارها من حالة مرضية أصبحت والله أعلم مزمنة و غير قابلة للعلاج…لا يرضيني أن أرى هذا كله وأنا أسمع عن ميزانيات تاريخية –كما يسمونها في الإعلام المحلي – ولا أرى ذلك ينعكس على مواطنيينا … و لا أعتقد أنه يرضيك أو يرضي أي غيور على وطنه.

تاسعا: ما اعتبرته أنت أخطاء في أسلوب فؤاد وأسلوب الكتاب الذين لا يفصلهم عن القراء سوى حاجز الانترنت – للمعلومية في عالم الانترنت يطلق على هؤلاء الكتاب “مدونون” أو Bloggers- ليست في الحقيقة أخطاء، لكنها طبيعة الإعلام الجديد و على الإعلام “القديم” أن يحسن قراءة الواقع و أساليب الإعلام الجديد – الذي لا يعتمد على المدقق- بدل أن يتهمه بتهم ليست من طبيعته.

أسلوب فؤاد ليس كما وصفته، فهو ليس “أسلوب تفريغ سلبي للغضب الذي يتجمع في قلوب العاجزين عن فهم ما يدور حولهم مما يجعلهم حانقين على المجتمع” فأود أن أحيطكم علما بأن فؤاد لم يكن حانق على المجتمع، فلم يكن عاطل عن العمل أو يعاني من أي مشاكل اقتصادية، بالإضافة لأنه انسان مثقف و متعلم ولديه حس وطني وفكري عالي لا يملكه الكثير من الكتاب و”المثقفون” الذي يطالعوننا يوميا من خلال الإعلام الرسمي، كان يخاطب القراء بأسلوب عملي وواقعي بعيدا عن الأسلوب الأكاديمي البعيد عن أرض الواقع. كان يملك من الجرأة التي تمكنه من أن يقول للمخطئ أنت مخطئ دون لف أو دوران حول الحقيقة تجعله يصيب قارئه بالدوار والغثيان و في النهاية لا يستطيع إيصال فكرته لأنها في الطريق تكون قد فقدت معناها! وإن كان من وجهة نظركم أن كل من ينتقد مشكلة لا بد له و أن يقدم لها الحلول وإلا فليس من حقه الكتابة عنها فهذا منطق أستغرب صدوره من “كاتب” مثلك ويصعب علي استيعابه في الحقيقة، لأنه و بنفس هذا المنطق يصبح ليس من حق المريض أن يصف للطبييب ما يعانيه من أعراض إن لم يكن يستطيع أن يعالجها!

اعذرني على الإطالة في الرد، لكن كان لا بد من وقفة لإحقاق الحق و تسليط الضوء على الموضوع من جهة قد تكون غابت عليك عند كتابتك للمقال. و أخيرا … نحن مجتمع المدونين السعوديين مجتمع واعي نحسب أن حسنا الوطني عالي. نؤمن بأن حقنا في التعبير عن آرائنا حق مكفول لنا كمواطنين في دولة الانسانية. في المجتمعات المتحضرة تعامل الانترنت كوسيلة تثقيف و تنوير واتصال و نحن نريد أن نعتقد أننا نعيش في دولة متحضرة لا في “دولة بوليسية في السبعينات“. نريد أن نعبر عن مشاكلنا، وأن نسمع صوتنا لقيادتنا فهي من أعطتنا الإشارة بأن الأبواب مفتوحة و أن الإصلاح قادم لا محالة، لكن في الوقت الذي نستطيع أن نرى فيه إشارات و بشائر خير وإصلاح تأتي إلينا من قائدنا الأعلى خادم الحرمين الشريفين حفظه الله نرى إشارات معاكسة لهذه النوايا الحسنة من بعض أفراد المجتمع واتهامات بالتحريض وعدم الفهم و الحنق على المجتمع و نحن أبعد ما نكون عن ذلك. كل ما نريد قوله أن هذه وسيلتنا للوصول إلى ولي الأمر، لأن زمن حمل المعاريض والوقوف بها في طوابير داخل القصور و مديري مكاتب المسؤولين قد ولىّ!

Sami asked me to help him with translating these quotes, and I thought it would be good to post them here too so you can learn more about Fouad and what he believes in.

JIDDAH, Saudi Arabia, Dec. 31 — Saudi Arabia’s most popular blogger, Fouad al-Farhan, has been detained for questioning, an Interior Ministry spokesman confirmed Monday. It was the first known arrest of an online critic in the kingdom.

Farhan, 32, who used his blog to criticize corruption and call for political reform, was detained “for violating rules not related to state security,” according to the spokesman, Maj. Gen. Mansour al-Turki, responding to repeated requests for comment with a brief cellphone text message.

Farhan’s Dec. 10 arrest was reported last week on the Internet and has been condemned by bloggers in Egypt, Tunisia, Morocco and Bahrain. The Saudi news media have not yet reported the arrest, but more than 200 bloggers in the kingdom have criticized Farhan’s detention, and a group of supporters have set up a Free Fouad Web site.

Farhan, who was educated in the United States and owns a computer programming company, was arrested at his office in Jiddah and then brought home, where his laptop was confiscated, said his wife, who spoke on condition that her name not be published to protect her privacy. “They arrested him because of his blog. I haven’t seen him since. We don’t know where he is,” she said.

As far as I can see, there is no contact address to complain to on Fouad’s behalf, but if we give this enough publicity, then things may take a turn for the better. The MSM has picked up on it, but every little helps.

Let’s make some noise!

The news of detaining Fouad Al Farhan was not shocking to me because I knew that he has been interrogated and harassed before, but it was certainly disturbing. Although we have seen bloggers in Bahrain, Kuwait and Egypt arrested and jailed, I thought this won’t happen here because a) Saudi Arabia don’t usually jail journalists (they ban them, but they don’t throw them in jail) and b) I thought those arresting citizens who exercise their right of free speech should be wise enough to choose their battles.

Bloggers, journalists, free speech advocates and human rights activists do not carry guns and explosives trying to undermine the government. They are merely exercising their God given right to express themselves freely in the hope of reforming this country and making it a better place. It is a very sad reality when you have people like Fouad who deliver their message of peace and justice detained this way, while extremists in websites like Al Sahat and others are free to poison the minds of youth with a dangerous message that is full of hate and violence.

I have no doubt that King Abdullah is pushing for a reformist agenda. However, it is very unfortunate that some elements in the government are not happy with this agenda because it could curb their powers and change their status. That’s why these elements are so threatened by freedom of expression and therefore try to stifle this freedom even if that means violating basic human rights, national law and international accords.

Let’s pray for Fouad to return to his family and friends, and let’s hope, again, that justice and common sense will prevail soon.

Saudi Arabia, an absolute monarchy that restricts press and speech freedoms, does not allow political parties, civil rights groups or public gatherings. But since King Abdullah took the throne in 2005, official tolerance of criticism and debate has grown.

Even so, Farhan told The Washington Post and others in early December that an Interior Ministry official had warned him that he would be detained because of his online support for a group of men arrested in February and held without charge or trial.

At the time of their arrest, the government accused the Jiddah-based group, made up of a former judge, academics and businessmen, of supporting terrorism. The men’s attorney, Bassim Alim, had said they were arrested for their political activism and their plans to form a civil rights group.

Farhan’s friends have maintained his blog during his detention and posted on it an e-mail he had written to a friend shortly before his arrest.

Farhan wrote that he was told he would be released if he signed an apology for his activism. “I’m not sure if I’m ready to do that. An apology for what? Apologizing because I said the government lied when they accused those guys of supporting terrorism?”

In October, Farhan visited one of the jailed men and wrote about it on his blog, http://www. alfarhan.org.

He also posted an emotional taped appeal from the mother of one of the men, academic Saud Mokhtar al-Hashemi, and asked readers to call the men’s families and offer their support.

Unlike most of the thousands of men and women who blog in the kingdom, on topics from fashion to corruption, Farhan uses his real name. In a post in December, Farhan listed his 10 least favorite Saudi personalities, including a businessman prince, a prominent cleric, a minister, a mayor and the head of the judiciary.

Farhan’s arrest could either scare other bloggers from criticizing the government or create a backlash, said Ahmed al-Omran, 23, who blogs as Saudi Jeans.

“I think some people will be afraid now, especially those who use their real names — they will be more careful. A lot of bloggers will be intimidated. But it could also cause a backlash in the blogosphere, and spur bloggers to write even harsher criticisms,” Omran said.

Farhan has had trouble with the authorities before. In 2006 he was told by the Interior Ministry to tone down his blog and to dissolve an association he was forming to protect bloggers’ rights.

He dissolved the group and quit blogging for nine months because of his business interests, he said subsequently. But he went back to blogging even more critically in July.

Farhan’s is the first arrest of a blogger in Saudi Arabia. Two Egyptian bloggers and one Tunisian are currently behind bars, according to Sami ben Gharbia, advocacy director for Global Voices, an international research group focused on the Internet and founded at Harvard Law School’s Berkman Center for Internet and Society.
