It would be hard to say it much better than this.  This guy wrote this piece 4 months ago, 6 months into the Obama usurpation.  It’s as accurate as if it were written yesterday.

The part that he is the most correct about is that the idiot masses that elected this fool will NEVER admit that they made a mistake.  Obama may be the destructive force taking apart America, but those who voted for him are the ones who enabled him to start his campaign of destruction.

When Obama won the Presidency with the help of the LEFTIST Media, Hollywood and Entertainment Liberals, Ethnic Socialists (ACORN), Stupid Non-Business Professionals and Bush Haters, I wrote:

It won’t take 6 months until the people figure this guy out and realize how horrible a mistake they’ve made. And when they come to that realization, the damage to the United States of America will be so great, that it will take a generation or more to repair – IF EVER.

The IDIOTS who not only voted for the Messiah, but also worked their sorry asses-off to promote his Lordship, are now left holding the bag.

Here are two things they will NEVER do:

1 – They will NEVER admit to making a blunder out of all proportion by electing a snake-oil salesman with no positive social history or management experience of any kind.

2 – They will NEVER take responsibility for the curse they’ve imposed upon the immediate and long-term future of their country.

In essence, the people responsible for putting this horror-show in power are in themselves responsible for every cataclysmic decision he makes and the consequences thereof.  (Also, those who stayed home and did not vote as a real citizen must gave Obama his slim margin of victory.)

In just 6 (SIX) months, the Messiah’s polls are showing the following:

On Healthcare Reform – He’s going under for the third time with polling well under 50%, even within his own Party.

Even though he might be able to muscle a Healthcare Reform Bill by using Chicago BULLY tactics against his fellow Democrats, it will just make things worse.

On Cap And Trade (Cap & Tax) – The Fat-Lady is already singing.

On the Stimulus Package (Tax and Spend) – His popularity is in FREE-FALL.

On the TARP package he took and ran with from President Bush – It’s all but Good-Night Irene.

On the closing of GITMO and “HIS” war on what he no longer wants called the War On Terrorism – He’s standing in quicksand with his head just about to go under.

On a comparison between himself and George W. Bush at the same 6 months into their respective first term Presidencies – Bush is ahead of him in the Polls.

On a comparison between He Who Walks On Water and the 12 preceding Presidents between WW II and now – Obama ranks 10th.

On a Poll just conducted, that asks who would you vote for today between Obama and Mitt Romney – It’s a dead heat.

Between Obama and Palin – Obama’s ONLY ahead by 8 points and she hasn’t even begun to campaign.

It seems to me that Obama wants to be everywhere where he shouldn’t be.

He’s personally invested in screwing-over America’s ONLY REAL Middle Eastern ally (Israel) in favor of Palestinian Despots and Murderers.

He’s traveling the world apologizing for the USA while lecturing others on how to do it right, when in fact and truth, he has no experience at doing anything other than getting elected.

He went to the Moslem world in Egypt to declare that America IS NOT A CHRISTIAN NATION while he heaped praises on Islam, where he compared the “plight” of the Palestinians to the Holocaust.

The Russians think he’s a Putz. The French think he’s rude. The Germans want him to stop spending. The Indians want him to mix his nose out of their environmental business. The North Koreans think he’s a joke. The Iranians won’t acknowledge his calls. And the British can’t even come up with a comprehensive opinion of him.  (None of these views have changed or improved in the 4 months since this article was written.)

As for the Chinese, he’s too frightened to even glance their way.  (At the time of this writing, Obama is over in China cuddling up to the Chinese, doing everything he can to show subservience to them.  He is bargaining from a position of weakness, and the rest of the world knows it.)

Maybe, if America’s first Emperor would stay home more and travel less, and work a little bit instead of being on television just about everyday, or forget about his Wednesday Date Nights with his Amazon Wife, or stop running to “papered” Town Hall Meetings, perhaps he would have a little bit of time to do the work of the nation.  (Sadly, if he were to take Mr. Galganov’s advice he would have more time and energy to devote to actively destroying the America he hates in order to build his totalitarian utopia.  Catch-22.)

In all fairness, it wasn’t HARD to be RIGHT in my prediction concerning Obama’s Presidency, even in its first 6 months, so I’m going to make yet another prediction:

OBAMA WILL PROBABLY NOT FINISH HIS 4-YEAR TERM, at least not in a conventional way.  (We can only hope for change, and pray that it happens soon.)

He is such a political HORROR-SHOW, and so detrimental to the USA and his own Democratic Party, that the Democrats themselves will either FORCE him to resign or figure out a way to have him thrown out.  (Again, we can only hope.)

Who knows, maybe he really isn’t a BORN US Citizen and that’s a way the Democrats will be able to get rid of him.  (They don’t have the guts for that approach.)

Or – MORE LIKELY THAN NOT, the Democrats will make Obama THEIR OWN LAME DUCK PRESIDENT.

I don’t believe the Democrats have nearly as much love for their country as they do for their own political fortunes. And with Obama, their fortunes are rapidly becoming toast.

The Democrats can keep on blaming Bush for EVERYTHING. But, that game’s already begun to wear real thin.

Their mantra was “WE DON’T WANT 4 MORE YEARS”, which the STUPID people bought, since McCain was nothing at all like George W Bush.

The new mantra will soon become: WE DON’T WANT 6 MORE MONTHS.  (Or 6 more days, or 6 more hours, or 6 more minutes, or…)

I should have studied German. Because apparently my uni has an exchange agreement with the Uni in Tübingen where I spent the weekend + some extra days so I could have been studying there!

Disclaimer – I love La Rochelle (obviously) but I grew to love ici. I immediately fell in love with Tübingen. It is gorgeous! Old town centre that is pretty much intact, pretty scenery, a castle and if you know where to go a giant mouse in a Santa suit. And of course lovely people (Danke Sophie for letting me stay!). This sounds so weird, because France is just as old, or close enough, or close enough to relations to Australia’s history in age, but Germany just seemed to have more.. soul? Maybe it was the quaint buildings and the crisp mountain air or something, but I just felt like I was tucked away in History, somewhere far from what I know. Of course French has history too, but I guess I have seen La Rochelle when it was sunny and touristy and open, but considering it was snowing in Tübingen the week before I left the wintery air probably gave it that bit more of an atmosphere. I could see myself living somewhere like nestled away in the mountains

Gah. I can’t even really describe how good the weekend was. There is the obvious like some awesome parties that we went too, (in a univeristy restaurant no less) catching up with Soph and meeting her roomies (and her German friends), literally catching the train from one side of France to the other, and being all cool and Parisian because I know how to use the Metro hehe. I got to try some yummy Schwaben food, and the home cooking of Sophienstraße. And glorious apple strudel. And apple crumble for that matter. I got to forget my travel card and against Douglas Adam’s best wishes my towel. I didn’t forget (to bring home) my awesome avent calendar, featuring not one, but four scantily clad ‘angels’ to remind me everyday of December of my trip.

On a more serious and less sporadic note, I got to see people doing and getting what I want out of my exchange, inspiring me to keep going. I don’t want to be complacent about it, and let it suddenly be July next year and feel like I done nothing that I came here for. I don’t want to go all philosophical, contemplative and introspective on you, because it’s not really a being-able-to-put-into-words-thing, except to simply say that that Tübingen is probably going to mean a lot to me and I am very happy to have it do so. Knowing Soph before we left Australia, and now her after nearly a year overseas and me a few months, was a nice comparison to see where I am coming from and going to and what I want to do on the way.

Plus, I now have German boys* wanting to come visit me in France so if nothing else the weekend was not an entire loss**.

*For those not within ear shot of me in last 24 hours, I have officially decided that on the whole German boys are plus de mieux que boys from France (en general!).

**And do not fear French boys, I don’t think their slightly inebriated plans of visiting me will actually take place, so the French girls will go on thinking you are cute.

There’s a monthly event at a local club, Bierkeller, called Funk Explosion. I looked at the playlist, thought it promising, and went with Janina, a Tübingen University graduate. I met another couch surfer there, Agnes from the Netherlands, who was staying with Janina. Every time I see Janina she’s with a couch surfer, and the more convinced I become of the awesomeness of couch surfing. Goal: couch surf at least once before I leave Europe. Even if it’s really just visiting other couch surfers I met before. The music was 70s funk and soul, which I’m not particularly into normally, but it strongly reminded me of reggae bar in Hongdae, or even the 80s bar, at least in ambience. And they gave out free lollipops.

Today (the day that Solomon Grundy died) I went to Tangente with Aurelie, who wanted to introduce me to a Korean girl. Her name was Yoni and she was very nett. Although she’s doing her Masters in Philosophy (which means she’s way older, at least by Korean standards) she told me to do away with the whole hierarchy thing. The fact that I’m even grateful about it just demonstrates how much I’ve assimiliated into that kowtowing to the elders culture. According to Carsten, my Deutschkurs instructor, Germany is pretty strict about that kind of thing as well. The whole Sie-du differentiation says it all really. Personally I’ve never found much use for the honorific in Korean except to distance myself from a person I dislike. A greeting in the honorific, uttered in a chilling tone, can be very effective in a way that “fuck you” can’t, because you’re being polite but not friendly. Anyway, Tangente was crowded, as it always is on Karaoke Night. I can Becks, a safe choice, but I didn’t want to become too drunk. (The memory of falling off my bike is still too vivid).

As we were leaving some guy came up to me and said,
“I want to ride your bike downhill! On the pole! All the way to the end.” 
“Are you going to come back?”
“No!”
“Bye then, I have to go the other way.”
“Uphill?”
“Yes, uphill.”
“Then I will watch you.” Then he burst into laughter and all his cronies started laughing too.  
It was funnnier in context, but it makes me feel warm inside at how friendly and mild drunks are here. I haven’t been here long, but still. Not a single negative experience. No copious vomiting, no shouting, no fuckwit behavior.

I’m already sad about having to leave so soon. Of course I’ll be back, and of course I’ll make the most of my time here, and of course I’ll get to eat pig intestine noodle sausages again, and of course everything in Seoul is practically free compared to Tübingen, but even so…

I came across a disturbing press notice on the EKD (German Protestant Church) website in the wake of the election of Bishop Margot Käßmann as Chair of the Council of the EKD last month.

It would appear that the Russian Orthodox Church has expressed an intention to cut off ecumenical contact with the EKD because of Käßmann’s election. Apparently, ‘representatives of the Foreign Office of the Russian Orthodox Church had announced that relations with the EKD would be terminated… Archbishop Hilarion said that celebrations planned for the end of November to mark 50 years of dialogue between the Orthodox Church and the EKD would also mark the end of the conversations.’ Archbishop Hilarion was quoted as such in the Kommersant newspaper.

It appears that the fundamental reason for this move is that the Orthodox Church does not allow that a woman can be a bishop. Fair enough – and no surprises so far.

But the conversations between the two churches have been going on for years and the EKD has had female bishops for years. All that happened on 28 October was that Margot Käßmann was elected ‘Chair of the Council’. That isn’t a change of orders – that happened a long time ago.

So, it is not only the EKD that is expressing confusion about this. If ‘female bishops’ was the problem, the Orthodox would presumably have suspended their relationship with the EKD many years ago. But they didn’t.

So, what is this about?

CARDIFF BY THE SEA, California—On a Tuesday evening at Temple Solel, a large crowd came to hear historian and author Mark Rigg talk about his latest book, Lives of Hitler’s Jewish Soldiers. His lecture was well received.

Dr. Rigg began his Nov. 3 lecture talking about himself and his background, including his childhood learning disability.  This seemed strange at first since the audience was there to learn about the 150,000 Jewish soldiers in the Nazi army. However, Dr. Rigg’s story of how he had overcome rather grim predictions about his abilities to succeed in life gave his audience the opportunity to more fully appreciate his remarkable achievements as an author and researcher.

As a youngster attending public school he had difficulty with social skills, which in turn affected his academic performance. He couldn’t sit quietly in class. Eventually he was diagnosed as a “special student” with Attention Deficit and Hyperactivity Disorder, commonly known as ADHD. While he drove some teachers and his fellow students “nuts” with his very active behavior, he bonded with one teacher who understood him, worked with him and got him interested in school learning.  Besides this wonderful teacher, his mother never lost sight of the fact that he was a person with his own being and intelligence.
Rigg emphasized the point that with his condition as a special needs student in Nazi Germany, he might have not survived. One of the first groups slated for death were the young who were mentally and/or physically challenged.
           
Mark Rigg explained how by Jewish law, he is a Jew, although in his childhood, his Jewish identity was not developed.  In Hitler’s Germany he would have been considered a “mischlinge,” a part Jew because his father was a Christian. He was not raised in the Jewish religion, but as an adult he studied at a yeshiva. During his talk he called himself a “yeshiva bocher-a student at a religious Jewish college. When he was in the U.S. Marine Corps he would say the “Shema” along with the few other Jewish marines.

At the age of twenty-three with some grant funding and scholarship money, Rigg went to Germany to study. Leaving a movie theater in Germany where he was one of only two patrons to see the film Europa, Europa he struck up a conversation with the other person. This elderly gentleman who spoke many languages and had been in the Nazi army and knew the stories of many mischlinge who had served under Hitler. This encounter was among the first of a series of unlikely but remarkable encounters that lead him deeper and deeper into his intriguing research of Hilter’s Jewish soldiers through personal accounts and stories told by the soldiers themselves and their comrades.

Rigg interviewed over 200 Jewish/mischlinges who had served in the German army.  He gathered over 20,000 pages of documents in his research.  In his current work he focuses on the lives of 21 of the interviewees. At his lecture he mentioned three.  One man in his nineties invited him to come immediately to interview him-he was ninety-four and ill. It was difficult to reach this former soldier as he lived in the country with little local transportation to his isolated and majestic estate.  Rigg arrived at the closest train depot, about seven miles from the mansion of the person he was to interview. 

With a backpack of 150 pounds, he rode a bicycle to the interview. When he arrived, he was tired, dirty, yet warmly welcomed by the soldier who was close to death and wanted desperately to have his story recorded for posterity.  After a shower and some food the interview took place.  A few weeks later, the interviewee died, confirming that the sense that  Rigg had that  “time was of the essence” was true, adding urgency and importance to each encounter in his research, no matter the obstacles and hardships required to document these events for history.
           
One man, with the last name of “Levy,” was in the SS.  He said the Shema everyday while serving in the SS. He had six children and with the stroke of the pen, Hitler made them all official Aryans, erasing their Jewish ancestry and declaring them to be “pure Germans.”
           
Assimilation in Germany was very high.  More Jews were killed fighting for Germany in World War One than all the Jews killed fighting for modern Israel in all of its wars.  German Jews were loyal citizens of Germany.  They were Germans first, Jewish second. They could not believe that Hitler would kill so many of them.
           
Knowing and understanding what was occurring in Nazi Germany was difficult for most Mischlinges.  They only had a narrow view of what was happening.  They knew that some of their relatives were taken away.  What happened to them, they did not know. As soldiers they heard a little about the concentration camps.  Some saw the slaughter of Jews at the beginning of the war, but most did not. Most did not regret having served in the Nazi army and participating in the war machine. They wanted to protect their family from harm.  If they fought and showed bravery their comrades in arms would accept them.

Rigg stated that the social dynamics of war made the fighting group a cohesive unit.  All depended on each other.  The bravery of the Jewish soldier wiped any prejudice a particular soldier may have held prior to this wartime reality. However, the Mischlinges expressed regret for what they didn’t know about the Nazis´ murder of the Jews.

 Rigg described vividly the deep conflict in the psyches of those who learned after the fact of the horrible fate of their relatives and loved ones while they had been shielded from this same fate because their military service had been useful to Hitler and to Nazi Germany.
    
Rigg’s presentation was inspiring and informative, since the author himself has a remarkable story to tell and has been relentless and determined in his pursuit of otherwise forgotten history of what it meant to be even part Jewish during the Nazi era.

Many would reject the reality that unbelieving Jewish intellectuals led the way in formulating the platform that gave rise to Hitler and the Holocaust.  Yet, not only does German history validate this sad, but true statement; Jewish history as with all human history is bent on exercising its right in futility, ignorance, and denial by repeating its mistakes, no matter how costly.

Israel’s history as a Jewish State and its right to exist as a nation in a specific Land pre-dates the holocaust, regardless of those who are attempting to rewrite Israel’s history, including President Barak Obama.

Furthermore, Jewish dissent and antisemitism is well documented in Biblical text.  The Holocaust was one black moment in the chain of Israel’s enigmatic history and it won’t be its last.  Another horrible genocide is on the horizon for it is written, “For I will gather all nations against Jerusalem to battle; and the city shall be taken , and the houses rifled , and the women ravished ; and half of the city shall go forth into captivity, and the residue of the people shall not be cut off from the city.” (Zechariah 14:2)  And it is men like Shlomo Sand who will lead the way of such judgment.

Shlomo Sand, a professor of history at Tel-Aviv University, recently held a series of talks in  London for the promotion of his new book, “The Invention of the Jewish People,” in which he writes that the Israelites were never exiled from the Promised Land and therefore have no right to return.”

 

Shlomo was described as, “An Israeli academic accused of contributing to anti-Semitic discourse and incidents following his book tour in London promoting the thesis that Jews never existed as a people and the Palestinian Arabs are the true heirs of the biblical Jews.”

His talks also indicted him for the highest level of literary offense, the discounting of Biblical history.  “Sand’s agenda is to sever the historic link between the Jewish people and the Land of Israel” said Jonathan Hoffman, co-chairman of the Zionist Federation of Great Britain and Ireland. “To promote that agenda his book ignores archeological and genetic evidence. At none of his three London appearances was there a historian or Jewish history expert on the platform to counter his distortions, evasions and sensationalism. The result will contribute to anti-Semitic discourse and incidents in the UK, already at a record level.”

Furthermore, in his radio talk with BBC Radio Talk Four he reaches beyond Jewish ethics and national moral boundaries in his statement, “I compare when I am speaking before Arab students the birth of the Israeli state to an act of rape. But even the son that was born of the act of rape… you have to recognize him… the existence of Israel I don’t put in question today, you understand me?”

Comparing the birth of Israel to an act of rape further indicts him before God as it is written, “Thus saith the Lord GOD; I will even gather you from the people, and assemble you out of the countries where ye have been scattered , and I will give you the land of Israel…For I will take you from among the heathen, and gather you out of all countries, and will bring you into your own land.”  Ezekiel 11:17, 36:24

Intriguing, stubborn, stiff-necked, rebellious, and unbelieving are those who spit in the face of God, denying His account of history, His ownership of the Land, His sovereign rule over a people marked with the highest calling, the most rewarding destiny, and the richest heritage ever given to any people group on the face of the earth.

If you examine Shlomo Sands upbringing you see a thread of anti-God theology in both his familial and educational background.  Also, as the son of parents who survived the holocaust the root of bitterness towards God can never be discounted.  Nevertheless, to oppose the LORD at such levels is far worse than being charged for war crimes by the U.N. bet din.  In such a case, you stand before the Great Eternal Judge who is jealous over Jerusalem, His Land and His people.  And His Spirit will not strive with man forever.

Dr. Sands is fueling a fire of anti-Zionism and anti-semitism that will only end in disillusionment.  His anti-semitic stance that applauds Arab control of the Land and opposes Israel’s legitimate birthright to the Land will only hasten the unfortunate and bitter end of those who conspire against Israel as it is written in Psalm 84, Joel 3:2, Zechariah 12, etc. and history itself.  And unfortunately he will be responsible for influencing the destiny of countless ones along the way.

I wonder if he has considered the end of the matter as spoken of by Solomon in the last verse of Kohelet (Ecclesiastes), “Fear God, and keep his commandments:  for this is the whole duty of man. For God shall bring every work into judgment, with every secret thing, whether it be good or whether it be evil.“

And as for the Land, Jerusalem and the Jews (Yehudim), hear what God says, “And I said unto the angel that talked with me, What be these? And he answered me, These are the horns which have scattered Judah, Israel, and Jerusalem…And the LORD shall inherit Judah his portion in the holy land, and shall choose Jerusalem again.“ Zacheriah 1:19, 2:12

It’s been two weeks since my wonderful trip to Budapest, and in those two weeks I’ve painted and painted and painted, interrupted only by my weekly courses and the occasional visit to one of Germany’s plethora of supermarkets. And supermarkets is what I want to start off with, because since I’ve moved here they have sadly become an inescapable part of my daily existence. Never in my life have I seen such a wide-ranging selection of stores to pick and choose from (nor such critical consumers to deal with). There are the all time favorites Aldi, Lidl, Spar and Netto, and then variants such as Hit, Real, V-Markt, Edeka, Plus, Rewe, Toom and the inglorious Tengelmann Group. However uninspiring it feels to be writing about supermarkets, I will probably never be able to think of Germany again without being cast back to the weird and wonderful encounters I’ve experienced whilst sticking my nose into the latest offer on yet another ineffective bio product. Upon complaining about the lack of good street markets, a friend told me that Munich doesn’t need street markets because the supermarkets rule this town, and so they do…

In my first week I dared to exit the local Lidl by sneaking through the sensor gate in opposite direction, only to be publicly embarrassed by a mechanical voice shouting “ACHTUNG, kein Ausgang! ACHTUNG, kein Ausgang!”. Lovely stuff, they should have brought out the waterpistols. Naturally I tried to exit the store as if nothing had happened, hoping I would be able to restore my crushed confidence and inwardly shaking with fear of a reprisal. I’ve learnt my lesson, you won’t see me jumping the gates again. In the meanwhile I’ve also familiarised myself with the loonies inevitably found in every Aldi. They are the granny-trolley bearers of the budget aisles, the flaxen haired, grey skinned children’s nightmare-neighbours trotting about and muttering to themselves and asking you, of all people, where the hell the salt is whilst standing in the cookie section. By now, I’ve learnt to simply wipe off the segments of alien saliva and point to the nearest shelf-stacker. Sometimes I imagine it is the nature of Aldi itself that has driven these people to insanity, due to their forever changing lay-out and outlandish one-offs on kites, gel pack bicycle saddles and thermal underwear. Sort out your act, Aldi! The Hague Convention on the Civil Aspects of International Child Abduction (the Hague Convention) provides that a child who is habitually resident in one party country, and has been removed to or retained in another party country in violation of the left-behind parent’s custodial rights, should be promptly returned to the country of habitual residence. However, many countries are not parties to the Convention, and even some that are parties enforce the laws only sporadically or in accordance with their own societal customs. Thus, the attorney must take special care when faced with the possibility that his client’s foreign national spouse might take the children to such a country.

Preventing Abductions to Non-Hague Countries

The first 4 months are  the golden window, were you have the chance to get your children back due to the Hague convention.

The mother in Ahmad v Naviwala,  learned these lessons the hard way. The Family Court awarded her sole custody of the children but unfortunately (although represented by counsel!) she permitted the father to take them to Saudi Arabia for a 3-month visitation. Had he kept the children in Saudi Arabia, they would doubtless have never been reunited with their mother. The Family Court then granted custody to the father (!), with visitation rights to the mother. Recognizing that Saudi Arabia was not a party to the Hague Convention, and that the mother could not enforce her visitation rights there, the court imposed various conditions upon the father intended to ensure that he would allow the mother to visit the children in Saudi Arabia. For violating the prior custody order, the father was sentenced to a suspended term of incarceration conditioned upon his future compliance.

On appeal, the Third Department awarded custody to the mother, stressing the fact that the father had intended to permanently remove the mother from the children’s lives. The Appellate Division found that the Family Court’s efforts to ensure the mother’s access to the children in Saudi Arabia were entirely insufficient, and allowed visitation by the father only in the United States, with the mother having sole custody of the children’s passports. A successful outcome for the mother was obtained only because the father had brought the children to Texas. This case highlights the fact that, all too often, the courts are reluctant to impose strict conditions to prevent parental child abduction until after an abduction has actually taken place.

The mother’s efforts to secure their return failed and the father procured an order from an Egyptian court granting him sole custody. He returned to the United States without the children and was arrested for international parental kidnapping. He was sentenced to 24 months’ imprisonment and a 1-year term of supervised release, with the special condition that he return the children to the United States. The Second Circuit upheld the requirement that the children be returned, since it was closely tailored to the crime and it served to deter others from wrongfully taking their children overseas.

While Muslim countries are generally not parties to the Hague Conven-tion (Turkey being an exception, although it does not fully comply with its treaty obligations), the problem extends also to many other countries. For example, those Asian countries with Confucian-based state family registration systems, such as China, Japan, Korea and Taiwan, are not parties to the Hague Convention (except for Hong Kong and Macau), and provide minimal assistance for the return of parentally abducted children.

Japan is a renowned haven for child abduction, particularly if the abducting parent is a Japanese national. See http://www.international-divorce.com/ca-japan.htm. In any custody battle involving a Japanese national, it would be foolhardy not to draft a custody order that precludes visits to Japan considering the possibility that that parent might take the child permanently to Japan. The courts in Japan will not enforce foreign custody orders and will not take any effective steps to return abducted children. See “Japanese Family Law — or The Lack Thereof!,” by Jeremy D. A foreign parent in a Japanese court will have minimal chance of securing anything more than extremely occasional visitation with his or her child in Japan if the other parent is Japanese. (Thus, in a case on which the author is currently working, the American father who lives in Japan has been allowed to see his child only once in 6 months, for only 2 hours, in court and with supervision).

Accordingly, if a Japanese parent threatens to take a child to Japan, or wishes to take a child for a temporary visit there during a time of marital strife, it is highly advisable to seek a court order barring any such visit. While a U.S. court will doubtless be skeptical when faced with such a motion, it is extremely important to educate the court as to the law, procedure, customs and traditions of Japan, all of which support a Japanese parent’s desire to raise a child in Japan to the total exclusion of the other (foreign) parent. Similar admonitions apply with respect to other countries that are not party to the Hague Convention.

Parents who oppose prohibiting the removal of children for temporary overseas visits often assert that such orders are unnecessary, because wrongfully retaining a child in a foreign country is a felony. The International Parental Kidnapping Crime Act (IPKCA), 18 U.S.C. 1204, makes it a federal offense to remove a child from the United States or to retain a child (who has been in the United States) outside the United States with intent to obstruct the exercise of parental rights (custody or visitation). Unfortunately, this law often makes a bad situation worse, since parents who have wrongfully retained children overseas fear that they will be arrested if they return to this country (as happened in U.S. v. Amer, supra). In addition, foreign countries rarely permit extradition for international parental kidnapping, and those countries that are the most likely to do so are countries that are already parties to the Hague Convention.

Preventing Abductions to Non-Compliant Hague Countries

Merely because a country is a party to the Hague Convention does not mean that it will effectively enforce its treaty obligations. For example, the U.S. State Department has asserted that Mexico is “non-compliant” with the terms of the Convention. U.S State Department Report on Compliance with the Hague Convention on the Civil Aspects of International Child Abduction, 2004. Mexico’s noncompliance results from the following problems:

• Mexico has not enacted any legislation to implement the Hague Convention, which has not been integrated into the Mexican legal system.
• The Mexican Central Authority has no law enforcement powers and Mexican law enforcement agencies make no serious efforts to locate parentally abducted children.
• The burden of finding an abducted child in Mexico is left entirely to the left-behind parent. Mexican authorities provide no effective help and if the child cannot be located, nothing happens.
• There is an apparent lack of understanding of the Convention among the judiciary in Mexico.
• The Mexican Central Authority does not have adequate resources to perform its functions under the Convention.
• The “amparo” (a special appeal in Mexico claiming a violation of constitutional rights) is used by taking parents to block Hague proceedings indefinitely.
• Mexican courts are able to reconsider the facts of a Hague at any stage of the proceeding, which allows proceedings to be prolonged substantially.

Accordingly, custody orders concerning parents with strong ties to Mexico must be drafted so as to minimize the risk that the child will be taken to that country. It would be reckless to permit a Mexican parent who has expressed a desire to move to Mexico, and who has strong family or business ties to Mexico, to take a child into that country for a visit, regardless of the conditions that may be imposed to encourage the parent to bring the child back to this country.

The State Department’s 2004 report establishes that similar concerns exist with respect to Austria, Colombia, Ecuador, Honduras, Mauritius, Turkey and Romania and, to a somewhat lesser extent, several other countries.

Conclusion

When courts receive applications to prevent children’s temporary visits to their parents’ country of origin, they are tempted to rely on the need to respect other countries’ legal systems and on international comity to preclude them from deciding that the foreign country may not provide sufficient guarantees that the child will be returned. However, if counsel marshal extensive evidence to support the fact that a foreign country will not respect or effectively enforce an American custody order, the courts should be prepared to reach the necessary conclusion and issue an effective remedy. It is far better to prevent children being taken to such countries that do not fully respect their international treaty obligations than to attempt to procure their recovery after the fact.

JCCV tackles teenage alcohol abuse

MELBOURNE–The Jewish Community Council of Victoria (JCCV) has moved forward in its campaign against alcohol abuse and related risky behaviour by young people in the Victorian Jewish community.

JCCV Social Justice Committee chairperson Rimma Sverdlin said the organization had appointed “Debbie Zauder to develop a community education strategy to encourage responsible consumption of alcohol. This has been facilitated by a grant from the Alcohol Education and Rehabilitation Foundation.”

Zauder has a Masters degree in Applied Social Research and considerable experience in research, evaluation and program development in a number of health-related areas, including issues related to alcohol and other drugs. She currently sits on a number of boards and committees under the Monash Division of General Practice and the Department of Human Services. As a mother of young children, Zauder also has a personal commitment to confronting problem drinking in both the Jewish and larger communities. I am confident that she will be a great asset.”

Nonetheless the challenge is a formidable one, according to Sverdlin.”This project has four main goals, namely: To tackle underage drinking by utilising a collaborative approach involving community organisations, schools, synagogues and health services; To reduce levels of underage drinking occurring in the Victorian Jewish community; To increase awareness among parents and the general community of the harmful effects of underage drinking and its risks; to develop a long term educational campaign that will be embedded in the curricula of the Jewish day schools.”

She added: “Our committee members are not so naïve as to believe that we will find a comprehensive solution for problem drinking. However we are hopeful that this project will at least result in positive changes to attitudes about drinking andhence to individual lives. That wouldn’t be a bad outcome.”

A Milestone for Shul

SYDNEY – Nearly 80 years ago, at the tender age of six, Maurice “Morrie” Stein began attending services at Newtown Synagogue with his family.

Today, the 85-year-old is the shul’s oldest living congregant and arguably one of its most revered. He attends services every Friday night and is always quick to reminisce about the past, or share his opinion on everything from prayer tunes to current shul fashion.

On Sunday November 8 he was a guest speaker at the shul’s 90th anniversary celebrations.

Also speaking was Reverend Benjamin Skolnick, who served as Newtown’s rabbi from 1957 to 1969.

“The occasion is a celebration of the individuals who have built and sustained the synagogue over so many years,” said the shul’s vice-president, Lachlan Menzies.

“In that way, it will also be an opportunity for the new generations to be inspired to continue in their footsteps.”

It all started more than a century ago when Newtown residents Abram and Naomi Solomon invited some friends into their home on Georgina Street to form a minyan.

As Jewish migrants poured into the area in Sydney’s Western Suburbs, the numbers quickly grew. Soon land was purchased to build a shul onthe same street where it all began, with the first stones of Newtown Synagogue laid in 1918.

All this time later, one of the city’s oldest shuls, which continues to thrive, will give a nod to its past.

To celebrate the anniversary, a historical display featuring items from a bygone era was held in the hall and included a framed photographof the foundation stone-laying ceremony, a gold key presented to the president on the day of consecration in 1919, and a burnt Bible rescued from the 1992 arson attack that nearly destroyed the shul building.

“We’ve been blessed to carry through to this day,” said shul president Brian Littler, who still remembers the tough times when the shul struggled to regroup after the arson attack and spent nearly a year displaced while the building was being restored.

These days, he said, the shul is prospering.

Is this the final chapter in the Zentai saga?

CANBERRA–Alleged war criminal living in Perth faces extradition to Hungary
after a decision by the Federal Government.

Relatives of Charles Zentai, 88, who is accused of war crimes dating back to 1944, had been hoping Canberra would try to overturn a Federal court ruling for his extradition.

But Home Affairs Minister Brendan O’Connor confirmed that the Government would not intervene.

Subject to any legal challenge, Hungarian authorities have two months to arrange the extradition of Zentai, who has spent the past three weeks in jail in Perth awaiting a decision.

O’Connor said the decision to approve extradition was not an indication of Zentai’s
guilt or innocence. ”It was about deciding whether or not Mr Zentai should be surrendered to Hungary in accordance with Australia’s extradition legislation and its international obligations,” O’Connor said.

Zentai’s son, Ernie Steiner, said the decision was disgraceful. ”My father is an innocent man but people just don’t seem to want to accept that,” he said after visiting his father in jail.

Hungary has been trying to extradite Zentai since 2005, alleging that in 1944 in Budapest when he was in the Hungarian Army, he helped bash a Jewish youth to death.

Michael Danby Calls for refugee review

CANBERRA – Jewish Federal member of Parliament, Michael Danby has called on
Australia to lead the way in a review of the 1951 Refugee Convention.

Danby, the MP for Melbourne Ports and chair of the Joint Standing Committee on Migration, spoke to a reunion of Dunera boys at the weekend.

He told the Dunera passengers — German and Austrian refugees in Britain who were classed as enemy aliens and sent to Australia on a ship and then interned under adverse conditions in 1942 — and their descendants, that lessons from the Holocaust and afterwards should be applied today.

Danby said that at the time, the Refugee Convention had helped to resettle people
displaced after World War II, but its usefulness had expired.

“My view is that the 1951 Refugee Convention is seriously out-of-date, and that we need a new international treaty covering the treatment ofasylum seekers and refugees,” Danby said.

“I would like to see Australia take an initiative in starting a new international conversation about how international refugee law might be clarified and brought up-to-date.”

He added that no-one in 1951 could have predicted a time when millions would be displaced due to civil wars, dictatorships, terrorism, ethnic cleansing and natural disasters.

“The circumstances the world is facing today are not the same as those of the 1930s, but there are enough parallels to make us aware of the moral imperatives that we face, and of the possible consequences of a failure to act with courage and compassion,” he said.

Danby said he had “great confidence” in Prime Minister Kevin Rudd, but called on the Jewish community — particularly those with experience as refugees — “to make our voices heard on the side of reason and justice, and against xenophobia and political opportunism”.

Status Quo on ritual slaughter

CANBERRA – Federal and state agriculture ministers have agreed that current
ritual slaughter practices could continue.

Ritual slaughter, including shechitah — slaughtering meat for kosher consumption– was under review by the Department of Agriculture, Fisheries and Forestry.

Animal welfare groups had expressed concerns about the humanity of shechitah,

which, unlike general slaughtering, does not permit animals to be stunned unconscious before slaughter.

The Executive Council of Australia Jewry (ECAJ) and the Organisation of Rabbis of Australasia (ORA) petitioned Agriculture Minister Tony Burke to maintain the status quo.

That status quo saw shochets (ritual slaughterers) exempt from stunning cattle and lambs before killing them with a knife, in line with halachah.

Jewish representatives held a meeting with Burke’s chief of staff before the ministers’ meeting earlier this month to stake the community’s claim.

Any change to slaughter regulations or moves to withdraw the Jewish community’s exemption would have jeopardised both local consumption and meat export, according to ECAJ president Robert Goot.

Goot called the result of the ministers’ meeting a “great outcome”.

“It is very gratifying,” he said. “For the ECAJ and ORA – which have been making submissions [on this topic] for more than a year — this is very satisfying.”

Meanwhile, a statement from Burke’s office declared it was the role of all governments to “promote the most humane practices, within the spectrum of faiths in Australia”.

Moreover, it was noted that the Primary Industries Standing Committee would continue to consult with religious organisations, meat processors, regulators and animal welfare groups.

I have to rememer that I’m not here as an exchange student. Having German adventures comes first. Above all else. Socializing is important to me, because I’m a needy person, but I need to have more badass adventures that actually deserve the moniker ‘adventure.’ I want more stories. No matter how insignificant, a story really shouldn’t always be about ‘hanging’ out with a bunch of folks, drinking beer, and trying to improve my German. Not that a Great Writer wouldn’t be able to spin something glamorous out of that, or even that such things bore me. I like going to Stammtisch, even if I feel like a ditzy tongue-tied peabrain most of the time. But I’m not a Great Writer and I need better fodder. Any fodder for now, until I get rollin’. Anyway, I should start naming my adventures, however shoddy the fodder.

THE SHEEP STORY
The other day I walked to the Tübingen Hill again. (I really need a better name… maybe hillock? Sheep Hillock? Bleh.) My olfactory senses were literally assaulted by the pungent smell of sheep shit. ‘Manure’ would be a more mature word, but I’m going for an unambiguously negative connotation here. This didn’t deter me from walking on, through the sludgy mud, to the pen where the sheep were having a nice nighttime snack. Why is chewing so cute? They baaed and ran away whenever they noticed that I was standing near. Naturally I tried to reach out to them over the wire fence and received a sudden shock from contact with the wire. It was an electric fence. Borderline painful, but there’s a reason they call it a ’shock;’ you’re too busy being shocked to notice the pain.

THE HERB STORY
On Sunday (yesterday, actually) I finally tried the herb, as Konnie put it. It was diluted with tobacco at one point, and shisha tobacco at another, but never alcohol, as per Mark’s instructions. I don’t know what I was expecting but it was rather underwhelming. I felt myself relaxing, but not to such a significant degree that I was particularly alarmed. The taste is hard to describe as well. The best I can come up with is that it was not sweet. I know this because the strawberry-kiwi aroma (of the shisha) was harder to taste after they’d mixed it. It was more of a sensation, a slight pressure in my chest, perhaps? It was not unpleasant. Bauer, who gave it to me, did laugh a lot after he’d had some… but maybe he’s usually like that. The shisha was really great, though.

I need to think of better titles. Titles are like ties, according to L. Greatman. I don’t want to ruin my outfit with a bad tie.

EL SALVADOR

Travellers tend to skip El Salvador, wooed by marquee destinations such as Guatemala and Costa Rica, and unnerved by stories of civil war and gang violence. But the war ended almost 20 years ago, and crime, while serious, is almost exclusively played out between rival gangs; tourists are virtually never involved. Head to Hamburg, where an entire new quarter is being wrested from the detritus of a 19th-century harbour. Or to Dresden, where the domed Frauenkirche church is once again the diamond in the city’s famous skyline. And to Berlin whose climate of openness spawns more creative experimentation than a Petri dish on Viagra.

Seldom does a travel destination satisfy the blurbs that shout ‘has something for everyone’ but Greece truly does. Whether you’re there to poke around ancient ruins, soak in the sun on idyllic beaches, or party till you drop, Greece will leave you clambering for more. Quickly emerging as a prime ecotourism and sport-fishing destination, Suriname has everything you could hope for in a wildlife adventure, including the biggest fish in the world, more than 700 bird species and such fascinating mammals as puma, manatee, tapir and primates.

USA

Suddenly the US is cool again! Be it from Barack Obama, Abraham Lincoln’s 200th birthday, or just tightened budgets during the recession, but more Americans are looking backwards – and foreigners too – and taking in traditional American historical sites, beginning with Washington, DC’s freebie zone of museums and heroic monuments.

Trains are a great way to see the country. Unlike the highways, trains don’t pass constant billboards and fast-food chains, and – while a point-to-point ticket is often cheaper on a plane – good-value passes let travellers make looping trips to five or more stops and curb their carbon imprint at the same time.

For those of you who read German, a recent death in relation to the “swine flu vaccine” has prompted an investigation by the government in Thuringia, Germany:

Berlin (dpa) – Ein Mann aus Thüringen ist laut einem Zeitungsbericht nach einer Schweinegrippe-Impfung gestorben. Wie die «Thüringer Allgemeine» (Montag) berichtet, hatte sich der 55-Jährige aus Leinefelde im Eichsfeld am Donnerstag impfen lassen und starb in der Nacht zum Freitag.

Thüringens Gesundheitsministerin Heike Taubert (SPD) sagte dem Blatt, dass ein möglicher Zusammenhang mit der Impfung untersucht werde. Sie gehe davon aus, dass eine Obduktion vorgenommen wird. Über Vorerkrankungen oder Unverträglichkeiten des Gestorbenen sei bislang nichts bekannt, hieß es in dem Bericht. Taubert war für eine Stellungnahme am Sonntag nicht zu erreichen.

I am so interested in the American tour that Sarah Palin will be promoting this week for her book Going Rogue: An American Life. I think there is something we all can learn from this. If anything, it is a media spectacle unlike anything ever seen before: Sarah Palin, the former Governor of Alaska, who makes history as the first female Vice Presidential candidate for the Republican Party, dishes her perspective on the inside story behind the McCain campaign. While I haven’t read the book myself, (I plan on buying a copy soon,) it will be interesting to see how this all plays out in the end and how it will bode for the future of national and global politics, if at all.
