<content:encoded><![CDATA[<div class='snap_preview'><p style="text-align:justify;">Aset eks Kelompok Golden Key milik Eddy Tansil, yang hingga kini belum diketahui keberadaannya, ternyata sudah terjual Rp 1,4 triliun. Pembelinya bank sindikasi dan PT Banten Java Persada (BJP).</p>
<p style="text-align:justify;">”Saya membantah pengembalian uang negara dari aset eks Golden Key baru 10 persen (setara harga limit dalam lelang yang akan dilakukan Departemen Keuangan 2 Desember 2009) karena aset yang terjual sudah sekitar Rp 1,4 triliun. Itu sekitar 300 persen dari hukuman pidana tambahan yang ditetapkan Mahkamah Agung (pada 29 September 1995),” kata Tri Adhyaksa, pengacara yang mewakili Rachmat Wangsa Senjaya, mantan Wakil Ketua Tim Penilai atau Penaksir Aset Golden Key Group atau Tan Eddy Tansil, Kejaksaan Agung RI.</p>
<p style="text-align:justify;">Menurut Try, pascaburonnya Eddy Tansil dari Lembaga Pemasyarakatan Cipinang, 4 Mei 1996, Rachmat mulai mengejar aset-aset yang bisa disita. Pada periode 8 Mei 1996 hingga 3 November 1999, Kejaksaan Agung menyita dan mengeksekusi 18 aset, antara lain uang tunai Rp 2,544 miliar (sisa dana di rekening Eddy Tansil di Bank Danamon); Rp 4,173 miliar (kelebihan bunga deposito PT Dinamika Erajaya), dan Rp 101.520.000 (hasil lelang perabot rumah tangga di Kompleks Pondok Cilegon Indah, Serang).</p>
<p style="text-align:justify;">Idealnya, kejaksaan menyerahkan hasil sita itu ke kas negara untuk pengembalian hukuman denda pidana Rp 500 miliar. ”Namun kejaksaan, waktu itu Jampidsus-nya, malah menyerahkan aset-aset itu langsung ke bank yang merugi,” ujar Try.</p>
<p style="text-align:justify;">Belakangan, ungkap Try, diketahui aset-aset itu diserahkan kepada bank sindikasi pemerintah, yakni Bank Pembangunan Indonesia (Bapindo), Bank Dagang Negara (BDN), Bank Bumi Daya (BBD), dan Bank Negara Indonesia (BNI). BBD, BDN, dan Bapindo, pada Juni 1999 bergabung menjadi Bank Mandiri.  ”Kemudian, bank sindikasi itu menjual aset-aset itu pada PT Banten Java Persada dengan nilai Rp 1,3 triliun,” kata Try.</p>

Namun, menurut Wakil Presiden Senior Manajemen Aset Bank Mandiri Agus Sudiarto, mengatakan, pelelangan aset Golden Key belum pernah dilakukan Bank Mandiri sejak bank ini berdiri.</p>
<p style="text-align:justify;">”Meskipun demikian, aset Golden Key terjaga dengan baik. Penjualan aset Golden Key pernah dilakukan oleh legacy Bapindo sebelum merger sekitar tahun 1996,” ujarnya.</p>

<description><![CDATA[Over the years in education, I have always been an average student. Not the best, nor the worst. I g]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p>Over the years in education, I have always been an average student. Not the best, nor the worst. I get good marks, but nothing superb. I failed, but always managed to pick myself up and improve.</p>
<p>15 years in formal education (2 years kindy, 6 years primary, 5 years secondary, 2 years college), I&#8217;ve always tried hard to exhaust my fullest potential. I do admit, I do suck up to teachers, but never too much. I do heaps in school, spending more time in school than at home, but never once was my efforts recognised.</p>
<p>In kindy, I was the shining star &#8211; top student. But I was 5! what do i know?</p>
<p>In primary, I was an average student. I had power, my friends range from top to average students. AND i too had my downfall in my primary school days. My grades at times do not match up to what i was capable of&#8230;</p>
<p>Ahh, secondary school. I was top 10 in class, top 20 in the level. I held important positions, I was involved in almost everything. But if you have known me then, I had my share of failures.</p>
<p>Coming to uni, my only aim was to graduate. get through the course and just do well in what I do best (or try to do the best in it)..</p>
<p>So, it came as a surprise when I got the letter. Last night was my induction as a new member to the Golden Key International Honous Society. It&#8217;s an award plus a lifelong membership thing. It came as a shock, but I&#8217;m just proud of how I&#8217;ve achieved it.</p>

<p>And I can never do it without the support of my mum and dad and siblings; my extended family, especially those from my mum&#8217;s side; my childhood friends who always have been there for me through the almost 20 years that we have been friends; my bestfriends &#8211; Kang and Alee, who never tire listening to me going on and on and on; my closest friends from Brunei especially Jiayi, Chewy, Sarah, Nicole, Ruth and Caroline, who always encouraged me through thick and thin&#8230;; the few teachers who have always believed in me since my schooling years and to the many others that I&#8217;m too lazy to type out the name. Not that I&#8217;m not grateful, but I&#8217;m lazy. <img src='http://s.wordpress.com/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' /> </p>
<p>Thanks everyone for believing in me and getting me through this far. I owe my every success to you and I love you HEAPS!</p>
<p>And Alice deserves a whole paragraph for herself. Thanks dear for coming last night and chia-ing me dinner (I loike&#8230;) and letting me stay over ur place! <img src='http://s.wordpress.com/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' /> </p>

<p>Bishop of Ratnapura, Most Revd. Cletus Chandrasiri Perera in a letter to Ranil Wickramasinghe</p>
<blockquote><p>I cannot but state that the two “<em>unofficial</em>” U.N.P. journals have maliciously offended the feelings of the desperate depositors, some of whom happen to be the Catholic clergy, who have been unfairly highlighted in the journals.</p>
<p>Hence I strongly urge you, Hon. Sir, as the leader of the U.N.P. and of the Opposition, to have the editors of the two journals make amends&#8230;</p></blockquote>
<p>Fredrika Jansz says</p>
<blockquote><p>Since the Bishop of Ratnapura made a conscious decision to deposit the said funds with Golden Key at an astronomical rate of interest, we owe neither him nor the Catholic Church an apology.</p>
<p>The Bishop was spoken to by the Editor on the phone before the said article was published but he refused to answer any questions.</p>
<p>We also wish to place on record that the Bishop attempted to use the good offices of Opposition Leader Ranil Wickremesinghe in trying to influence the editorial content of this newspaper in relation to our references to him and the Catholic Church in our exposes on Golden Key.</p></blockquote>
<p>Right, so what happens is, the Bishop of Ratnapura Most Revd. Cletus Chandrasiri Perera writes to Ranil Wickramasinghe, and tells <em>him</em> to tell the <em>Sunday Leader</em> and sister publication <em>Irudina</em> to shut up about the whole clergy investing money in Golden Key thing, and also to apologize. Jansz adds,</p>
<blockquote><p>A request to this effect from Mr. Wickremesinghe, which, we turned down was in upholding the highest standards of independent, unbiased, professional journalism. We fail to understand why his Lordship subsequently wrote to the Leader of the Opposition who has no interests in this newspaper, when he should have responded in the first instance on the phone with us.</p>
<p>We encourage the Bishop of Ratnapura to go ahead and make a “stronger” statement on this issue “to the state controlled media.” I trust that his Lordship would in that instance be writing through the President of Sri Lanka.</p></blockquote>

I was fondly rememberd of <a href="http://www.youtube.com/watch?v=MeSSwKffj9o">this video</a> by George Carlin which seems very appropriate. I quote,</p>

<p>I won&#8217;t generalise all Buddhist priests, there are plenty of good Buddhist priests in SL who are devoid of wealth and yet helps the society and are well respected and treated by the people. But I think I can safely say that this isn&#8217;t the case for most major cities, for e.g. Colombo, Kandy, Galle, Kalutara etc.</p>
<p>But then many would say, &#8220;may be the money was saved to build a statue, to upgrade a temple or simply donations which some well connected temples receive&#8221;.</p>
<p>Again, in my opinion, this is a classic example where religion has got it priorities wrong, it has become a state affair, a extravagant one. I wont say this is a problem that happened recently, its been happening since I don&#8217;t knows when, but is it so hard to understand that we really don&#8217;t need a Rs 41 million statue? Do we really? Did Lord Buddha want himself represented by a pile of rocks and cement worth millions, overlooking the shanties a few miles way? I think Lord Buddha wants to be represented by good honest people with good morals and values, not by towering structures.</p>
<p>And note I don&#8217;t use words like Buddhist people, or Christian people, or Hindu or Islamic people, because that&#8217;s another form of labelling brought forward by people who see their world through their own eyes. That&#8217;s another discussion for another time.</p>
<p>Sorry to mention this again, but donations to build a statue or otherwise shouldn&#8217;t be going into a investment firm into an investment account. Key word there being investment. I&#8217;m sure any bank would jump up and handle money on behalf of a temple on legitimate matters, using things called savings and current accounts. And I assume there must be Buddhist organisations that handle these kind of things. Surely donations to the temple won&#8217;t involve Treasury bills and bonds, high yield high risk investments, and dropping interest rates?</p>

<p>For what avails correct speech that is not understood by the hearer, when there is no reason whatever for speaking, if what we say is not understood by those to whose understanding we are appealing. The teacher, then, will shun all words that do not inform. It is a mark of a noble character to love the truth in words, not the words. For what is the purpose of a golden key, if it cannot open what we want? Or what objection is there to a wooden key, if it is effective, since we seek only to reveal what is concealed?</p>

June 25, 2008 (LBO) – Sri Lankan businessman Lalith Kotelawala has demanded a billion rupees in damages from Central Bank governor Ajith Nivard Cabraal for trying to introduce rules that would effectively remove him from a bank and finance companies in his Ceylinco group.<br />
Kotelawala also threatened to initiate legal action against Cabraal to remove him as central bank governor if he persists with the implementation of the proposed corporate governance codes for licensed commercial banks and registered finance companies.<br />
In his letter of demand, released to the media, Kotelawala said the code of governance has been promulgated &#8220;specifically&#8221; to remove him as chairman and director of Seylan Bank and six finance companies in the Ceylinco group.<br />
The corporate governance code proposed by the central will prevent directors of banks and finance companies from continuing in their posts if they are over 70 years, have been a director for more than nine years or are directors of more than 20 other companies or entities.<br />
Kotelawala&#8217;s Ceylinco group consists of a diversified portfolio of business activities which include insurance, a credit card company, banking, micro finance, finance, leasing, house and property development, travel, health care, as well as a diamond venture, Blue Diamonds.<br />
Kotelawala is also chairman of six registered finance companies; The Finance, Seylan Merchant Leasing, Finance &#38; Guarantee Company, Asian Finance, Multi Finance and Ceylinco International Reality.<br />
Kotelawala said the proposed code of corporate governance has been introduced as a direction under the Banking Act, &#8220;in ignorance&#8221; of the provisions relating to corporate governance in existing laws.<br />
It was also &#8220;in violation of a citizen&#8217;s right to engage in a lawful trade, without age, number of directorial positions held,&#8221; he said in his letter of demand sent through his Attorney-at- Law.<br />
Kotelawala described the code as &#8220;draconian&#8221; and said its legality has been challenged by Seylan Bank and other commercial banks in the Supreme Court and Court of Appeal of Sri Lanka.<br />
He said that in spite of the pending litigation and sentiments expressed on behalf the Central Bank to bring about a settlement between the parties, Cabraal proposed a draft code of corporate governance for registered finance companies.<br />

Kotelawala is the most honourable businessman in sri lanka.His companies assist business entrepreneurs, small businessmen, indebted citizens and the poor. His companies are the most reliable for the public to invest their savings in deposits or as investments.<br />

<p><strong><span style="color:#000066;"><span style="font-size:small;">Kotelawala sues Central Bank Governor over mandatory code</span></span></strong><strong><span style="color:#ff9966;"><strong><span style="color:#ff9966;"><span style="font-size:small;">Renowned businessman and Ceylinco Group Chairman Dr. Lalith Kotelawala is suing Central Bank Governor Ajit Nivard Cabraal for ‘malicious conduct’ over the proposed mandatory code for finance companies banks which would affect the former.<br />
In a letter sent by his attorney Thushari Weerasinghe to the Central Bank governor, Dr Kotelawala said that if the governance codes applicable to banks and licensed finance companies are implemented, legal action would be taken against the governor seeking his removal, on the grounds that ‘you are not a fit and a proper person to hold the post of Governor of the Central Bank of Sri Lanka, and any other public office.” The Ceylinco chief, who is demanding a sum of Rs 1 billion in damages from losses incurred if the code for finance companies is implemented, says the governance code was promulgated specifically to remove him as Chairman and director of Seylan Bank PLC by preventing him holding the post of director.<br />

<p></span></strong></span></strong><strong><span style="color:#336666;"><span style="font-size:small;">hc code bars directors from serving more than nine years, beyond the age of 70 years and in more than 20 companies or entities. Dr Kotelawala has been having a running battle with Mr Cabraal ever since the mandatory code of governance for banks became effective this year. A second code for finance companies, which will also adversely affect Dr Kotelawala, has been prepared by the Central Bank and is currently under public discussion and scrutiny.<br />
Dr Kotelawala says the rules in the banking code have been formulated, deliberately targeting him to prevent him from functioning as Chairman and director of Seylan Bank PLC, which is a bank created and built up by the vision and guidance of my client, and in defiance of the confidence placed in him by Seylan Bank shareholders, customers and other stakeholders.<br />
“… the code of corporate governance has been introduced as a direction under the Banking Act, in the background and in ignorance of the provisions relating to corporate governance envisaged in the Companies Act No 7of 2007, the Banking Act No 30 of 1988 as amended, and the Finance Companies Act No 78 of 1988 and in violation of a citizens’ right to engage in a lawful trade, without age, number of directorial positions held, being a barrier; which even the said acts passed by the Parliament of Sri Lanka has recognized,” the letter said. Dr Kotelawala, Seylan Bank and other commercial banks have challenged the legality of the banking code and “in spite of the aforesaid pending litigation and sentiments expressed on behalf of you, as well as the Central Bank of Sri Lanka to bring about a settlement between the parties to the said actions; you have initiated to implement an exposure draft code of corporate governance, in relation to registered finance companies, once again, with the malicious intention and sinister motive of summarily removing me from the position of the Chairman and director of the aforesaid finance companies, as well.”</span></span></strong></p>

<p>Finally Finally Finally someone gets it!</p>
<p>Garys&#8217; video reminded me of a conversation I had a couple of months ago with a perspective employer in Beijing. The conversation (which was flowing along quite nicely) came to a halt when the gentleman I was speaking to commented &#8220;I saw your profile on Facebook&#8230;you look like quite the party girl&#8221;. The rest of the conversation consisted of me giving vague ummm and ahhhh answers while I raked my brain trying to imagine what incriminating photos/comments/posts he could have seen on my profile.</p>
<p>Within roughly 30 seconds of putting the phone down, both my Facebook and MySpace pages had been privatised.</p>
<p>Luckily for me my pages are relatively tame. Although at the time the display pic didn&#8217;t scream professional it certainly wasn&#8217;t anything I would be upset if my mum saw. Even more luckily for me, this guy was cool. As a senior PR practitioner he was interested in social media and appreciated my amateur adoption of it. Their company has a Facebook group which I am now proud to be a part of.</p>
<p>While I agree with most of what Gary is saying in his clip, one point I take contention with is his argument that you cannot have multiple personalities. I would argue that we all have multiple personalities, or perhaps more accurately one mulifaceited personality. Different social situations act as forums to express different elements of our personalities. I am a different person around my friends to what I am when I visit my grandparents or when I am at work. I use different language, discuss different topics and wear different clothes.</p>
<p>I think what social media is doing is making it possible for these different personalities to cross over. What Gary is saying is that for the first time our friends/family/colleagues are able to get a fully rounded picture of our lives &#8211; not just one piece of our personality puzzle. We can now be judged (to a higher degree) as entire entities. The separation or distinction that divides our personalities is getting narrower. If an employer visits my MySpace profile they can see the type of person I am around my friends. At first the thought of an employer seeing this side of me was unsettling. However, the more I think about it the more comfortable I am with it.</p>
<p>If Jane happens to be tagged in a bikini on the beach that doesn&#8217;t mean that she views that as appropriate work attire. Any employer who comes to such a conclusion is not someone I would want to work for. If I was photographed at a club with my friends. So What! I am a grown woman and presumably it&#8217;s the weekend. If it&#8217;s 9-5 on Monday through Friday then yes&#8230;I see where an employer may take issue!</p>
<p>I found a quote by the wonderful <a title="Mitch Joel - Twist Image" href="http://www.twistimage.com/blog/" target="_blank">Mitch Joel </a>recently that sums up exactly how I have always approached my professional undertakings&#8230;&#8221;I treated every position I had as if I owned the company and it&#8217;s success (or failure) rested on my shoulders&#8221;. Maybe this sentiment isn&#8217;t apparent on my Facebook or MySpace page (however, there is certainly nothing to contradict it). Different online communities serve different purposes. If you want to see how I will conduct myself on a Saturday night out with my friends check out MySpace. If you want to see how I will behave in the office go to LinkedIn. If you want to see a complete picture of who I am &#8211; have a look at both.</p>
<p>There is no more security in obscurity. Facebook is mainstream. MySpace is mainstream. You are mainstream. Employers and perspective employers are going to look at your profile. Hopefully when they do see you in a less professional context they interpret it as having the work/life balance.</p>
<p>I like Gary&#8217;s point about good triumphing over evil. If you have posts up and down your page talking about how horrible your workplace is, how you should really get off Facebook and do some work, or how much you dislike your boss or colleagues then yes a perspective employer will probably (justifiably so) read into this as you being lazy, unproductive, and socially disruptive. They will hire someone else.</p>
<p>Seeing another side of a perspective employees personality is (in most cases) not a bad thing. Employment ads preach about the quest for diversity, &#8216;people persons&#8217;, and energetic people. People say they are these things&#8230;now an employer can check it out for themselves. Humans are social creatures, we like to express ourselves &#8211; <span style="text-decoration:underline;">obviously keep some things private</span>- however I can&#8217;t imagine an employer who wants to hire an army of 100% all work/no play clones. I&#8217;m sorry, but if I am a recruiter and I go on to a potential candidates MySpace page and see nothing but a slide show of them slaving away in the office i am going to come to the conclusion that this person is a one-dimentional robot. If I go to their LinkedIn page and see some photos of them in a professional setting &#8211; then fine. DIFFERENT ONLINE COMMUNITIES SERVE DIFFERENT PURPOSES AND CATER TO DIFFERENT ELEMENTS OF OUR PERSONALITIES.</p>
<p>Employers have to understand that these social networking devices need to be viewed in context. Facebook and MySpace &#8211; I see as more social networks. I use Facebook strictly for friends. MySpace i&#8217;m slightly more liberal with. I&#8217;ll accept a &#8216;friend&#8217; request if you are my friend, you are a family member that I like, you play music that I like, your profile is interesting, or you write me a nice note telling me why we should be connected. LinkedIn and Golden Key (honour society network) are different. They are professional. I wouldn&#8217;t dream of putting photos that were anything less then professional up on one of these networks.</p>
<p>People who are good are going to win&#8230;I&#8217;ll go one further and say people who are balanced &#8211;  in the personal and professional -  are going to win.</p>
