<title><![CDATA[De Amerikaanse boekproduktie ontleed]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p>Er is nog steeds geen definitief akkoord over <a href="http://books.google.com">Google Book Search</a> maar in de afgelopen weken zijn wel weer grote stappen in die richting gezet. Nadat de direct betrokken partijen op 13 november op het allerlaatste moment hun nieuwe voorstellen bij de New Yorkse rechtbank hadden gedeponeerd, kwam dit weekend het bericht dat <a href="http://www.publishersweekly.com/article/CA6708131.html">Judge Chin </a>zijn voorlopige goedkeuring aan deze voorstellen heeft verleend. Opposanten kunnen nu opnieuw tot eind januari 2010 hun bezwaren tegen de geamendeerde voorstellen kenbaar maken en op 18 februari volgt er dan een laatste hearing. Alle belangengroepen kunnen dus weer aan de slag.</p>
<p><a href="http://googlepublicpolicy.blogspot.com/2009/11/modifications-to-google-books.html">Een van de belangrijke wijzigingen</a> die door Google, de Authors Guild en de Association of American Publishers is doorgevoerd is de beperking van de overeenkomst tot boeken die onder het Amerikaanse copyright vallen of die gepubliceerd zijn in het Verenigd Koninkrijk, Canada of Australië. Deze drie landen hebben volgens Google c.s. zowel op juridisch terrein als op het terrein van boekpublicatie voldoende gemeenschappelijks. Britse, Canadese en Australische rechthebbenden krijgen dan ook een vertegenwoordiging in de directie van de voorziene Book Rights Registry.</p>
<p>Juist over die boeken die onder het Amerikaanse copyright vallen hebben <a href="http://www.dlib.org/dlib/november09/lavoie/11lavoie.html">Brian Lavoie en Lorcan Dempsey</a> van OCLC net een heel aardig artikel gepubliceerd waarin ze op basis van de rijke <a href="http://www.worldcat.org/">WorldCat</a>-gegevens de karakteristieken van die collectie trachten te achterhalen. Lavoie en Dempsey publiceerden al eerder over dit <a href="http://zeemanspraat.wordpress.com/2008/05/26/het-digitale-boekenuniversum/">onderwerp</a>.</p>
<p>Zo maar wat observaties uit hun artikel:</p>
<ol>
<li>WorldCat bevat momenteel 84,8 miljoen bibliografische records van gedrukte boeken, waarvan er 15,5 miljoen onder het Amerikaanse copyright vallen. Deze aantallen betreffen unieke manifestaties, niet alle afzonderlijke boeken die daadwerkelijk op de planken staan. Van die 15,5 miljoen afzonderlijke manifestaties zijn ruim 650 miljoen exemplaren in WorldCat geregistreerd. Oftewel, van ieder afzonderlijk boek staan gemiddeld 43 exemplaren op de plank.</li>
<li>Van die 15,5 miljoen boeken is 14% gepubliceerd vóór 1923 (en derhalve rechtenvrij), 65% gepubliceerd ná 1963 (volledig in copyright) en 17% gepubliceerd tussen 1923 en 1963 (ca. 2,6 miljoen boeken), waarvan dus niet bij voorbaat vastgesteld kan worden of ze nog gedekt worden door het Amerikaanse copyright of toch al in het publieke domein terecht zijn gekomen. Dat moet op individuele titelbasis vastgesteld worden.</li>
<li>Van de 12,6 miljoen boeken gepubliceerd ná 1923 is ruim 90% non-fictie en slechts 8% fictie. De non-fictie is verdeeld over alle wetenschapsgebieden onder &#8216;aanvoering&#8217; van geschiedenis (8%), techniek en economie (beide 7%). Van diezelfde 12,6 miljoen boeken van ná 1923 is bijna 55% van academisch niveau, ruim 40% van algemeen niveau en slechts 4% richt zich specifiek op jeugdigen. Lavoie en Dempsey hebben hun analysemethoden ook nog eens losgelaten op drie van de zgn. Google-bibliotheken en dan blijkt de zgn.&#8221;audience level&#8221; nog meer naar het academische niveau getrokken te worden. Niet verwonderlijk natuurlijk.</li>
</ol>
<p>Met deze resultaten in de hand komt het gegeven van één terminal met vrije toegang tot de GBS-database per openbare bibliotheek aan de ene kant en anderzijds de academische bibliotheken die afhankelijk zijn van een licentie met Google waarvan de kosten tot nu toe onbekend zijn weer in een wat ander daglicht te staan. Juist die laatste groep heeft veel te winnen bij onbeperkte toegang tot GBS en zal daar waarschijnlijk een vette prijs voor moeten gaan betalen.</p>

<p>The Supplemental Opt-out, Opt-in, and Objection and Objections to the Amended Settlement deadline is January 28, 2010.</p>
<p>A final settlement/fairness hearing is scheduled to be held on February 18, 2010.  The purpose of the hearing will be to determine: </p>
<blockquote><p>(a) whether the terms and conditions of the Amended Settlement Agreement are fair, reasonable, and adequate;<br />
(b) whether to certify the Amended Settlement Class and the Sub-Classes for purposes of the settlement; and<br />
(c) whether the Amended Settlement Agreement should be approved by the Court and judgment entered thereon.   </p></blockquote>

<p>I called Cory on Thursday November 12th, 2009 from Control Booth B at CJSF.  He was in his hotel room getting started on a day of media publicity for the launch of his new book, <a href="https://www.tor.com/images/stories/blogs/makers-tile-game/" target="_blank">Makers</a>, published by <a href="http://www.tor.com" target="_blank">Tor Books</a>.</p>
<p>I have no idea whether I was his first interview of the day but I am certain that I wasn&#8217;t his last.</p>
<p><a href="http://www.amazon.ca/Makers-Cory-Doctorow/dp/0765312794"><img class="alignright size-medium wp-image-1271" title="Tor_Makers_Cover" src="http://booksontheradio.wordpress.com/files/2009/11/tor_makers_cover.jpg?w=197" alt="" width="197" height="300" /></a>He did <a href="http://www.youtube.com/watch?v=TBf7ov031Ag&#38;feature=player_embedded" target="_blank">TVOntario</a>, <a href="http://www.cbc.ca/thehour/" target="_blank">CBC&#8217;s The Hour</a> with George Strombo and countless other interviews throughout the day.</p>
<p>He eventually finished with a talk at the Toronto SF reference library, <a href="http://www.torontopubliclibrary.ca/uni_spe_mer_index.jsp" target="_blank">the Merril Collection</a>, where his old friends at <a href="http://www.bakkaphoenixbooks.com/" target="_blank">Bakka Phoenix Books</a> (where Cory once worked as a bookseller) sold out of books for him to sign.</p>
<p>His talk the next day at the <a href="http://www.quillandquire.com/blog/index.php/2009/11/13/cory-doctorow-at-torontos-national-reading-summit/" target="_blank">National Reading Summit</a> was a huge success according to all of my sources in Toronto.</p>
<p>Well, all of my sources except the <a href="http://www.theglobeandmail.com/news/arts/meet-publishers-enemy-no-1-cory-doctorow/article1362457/" target="_blank">Globe and Mail&#8217;s John Barber</a>, who apparently couldn&#8217;t be bothered to actually show up.  Not that a little detail like being physically present prevented him from writing about it.</p>
<p>But back to the interview that you may or may not have already started listening to.</p>
<p>It&#8217;s a bit of a reanimated corpse brought together by magic and electricity.  The sound quality is off and my recording software kinda crashed about half way through then came back to life again and then died for good.</p>
<p>So I apologize for the quality and I promise that I&#8217;m going to get this whole &#8217;sound&#8217; thing figured out.  I finish the show off with a recording of Cory&#8217;s reading from the Makers that night at the <a href="http://www.torontopubliclibrary.ca/uni_spe_mer_index.jsp" target="_blank">the Merril Collection</a> Science Fiction Reference Library in front of his home town audience.  It&#8217;s a great piece about Suzanne Church&#8217;s first encounter with a few of the Makers. A scene that I allude to earlier in our talk.</p>
<p>I still like the interview, though.  I&#8217;m sorry that an infernal machine ate chunks of our conversation about DRM and most of the talk on Google Books and everything about his <a href="http://www.publishersweekly.com/article/ca6702526.html" target="_blank">With a Little Help Project</a> that he&#8217;s cataloging for Publisher&#8217;s Weekly.</p>

Data la complessità, mi rifaccio a questo sommario di <a href="http://www.hyperorg.com/blogger/2009/11/15/google-books-settlement-2-0/">Weinberger</a>, estrapolato da <a href="https://sites.google.com/a/pressatgoogle.com/googlebookssettlement/revised-settlement/SettlementModificationsOverview.pdf">qui</a>. Ho integrato un po&#8217; con il poco che ho capito dal sempre ottimo <a href="http://laboratorium.net/">Grimmelmann</a> (consigliato ai meticolosi e ai legulei).</p>
<ul>
<li><strong>Estensione</strong>. L&#8217;accordo è stato ristretto per i paesi non-anglofoni, dunque <strong>vale solo per i libri registrati negli USA, o pubblicati in UK, Australia, Canada</strong>. Il cambiamento più grosso, secondo Grimmelmann.</li>
<li><strong>Opere orfane</strong>. Cambio di rotta: i ricavi generati dalla vendita delle opere orfane non verrà più diviso fra autori, editori e Google, nessuno dei quali ha in realtà alcuni diritto su quesi soldi. Verranno inveec utilizzati per <strong>finanziare la ricerca degli effettivi detentori dei diritti</strong>. La <em>Authors Guild </em>ha infatti affermato davanti ai giudici che il 90% dei detentori potrebbe essere ritrovato, con adeguati finanziamenti. Dopo aver fermato i soldi per 10 anni, il <em>Book Rights Registry </em>donerà i soldi ad enti no-profit che promuovano la lettura pubblica: dunque, <em>forse</em>, biblioteche, programmi di alfabettizzazione, altre biblioteche digitali.<br />
Grimmelmann dice: &#8220;Il trattamento delle opere i cui diritti non sono stati rivendicati è il cuore delle promesse e pericoli del <em>settlement</em>—una categoria che contiene anche le opere orfane.  Il <em>Settlement 1.0</em> permetteva a Google di usarle venderle su un proncipio di <em>opt-out</em> (cioè, se non ti piace, sei tu ad uscirne), e il <em>Settlement 2.0</em> fa lo stesso. Questo da a Google esclusivo accesso ad un segmento di mercato in cui nessun altro pò entrare, e dunque sollevò perplessità sul <em>monopolio</em>&#8220;. Nonstante la creazione del UFW, le preoccupazioni rimangono (la questione è complessa, chi è interessato guardi <a href="http://laboratorium.net/archive/2009/11/14/gbs_midnight_madness">qui</a>).</li>
</ul>
<ul>
<li><strong>Unclaimed Works Fiduciary</strong><em>. </em>Un fiduciario approvato dalla corte, l&#8217;<em>Unclaimed Works Fiduciary</em>, verrà creato appposta per gestire diritti e magagne delle opere i cui diritti non sono stati rivendicati.</li>
<li><strong>Rivenditori</strong>. Il <em>Settlement</em> ora afferma esplicitamente che <strong>ogni rivenditore di libri potrà vendere l&#8217;accesso online ai libri fuori stampa</strong> che Google ha digitalizzato, anche le opere orfane. I ricavi saranno divisi come prima, 63% al detentore dei diritti, “la maggior parte di” 37% al rivenditore).</li>
<li><strong>Biblioteche</strong>. Il <em>Registry</em> potrà ora decidere che le biblioteche possano avere più di un solo misero terminale con accesso ai libri scansionati (e questa è un&#8217;ottima notizia).</li>
<li><strong>Creative Commons</strong>. E&#8217; riconosciuto l&#8217;utilizzo delle Creative Commons: se hai accesso a un libro in CC, potrai riutilizzare anche la versione digitale di Google. Gli autori acquistano maggior potere su quello che Google potrà mostrare.</li>
<li><strong>Algoritmo dei prezzi</strong>. Google specifica meglio come funzionerà l&#8217;algoritmo che deciderà i prezzi dei libri fuori stampa, come in un &#8220;mercato competitivo&#8221;.</li>
</ul>
<p>Da varie parti si riconosce dunque un passo in avanti, soprattutto per l&#8217;aumento della competività e l&#8217;accesso. Amazon, per esempio, potrà vendere l&#8217;accesso ai libri scansionati da Google come Google stesso, con i prezzi stabiliti dal <em>Registry</em>.</p>
<p>Ma vi sono ancora critiche. <a href="http://www.openbookalliance.org/2009/11/open-book-alliance-releases-baseline-requirements-for-revised-google-book-settlement-proposal/">Open Book Alliance</a> continua a dire che Google avrà il monopolio sui libri digitali, mentre l&#8217;<a href="http://www.eff.org/deeplinks/2009/11/google-book-search-settlement-revised-no-reader-pr">Electronic Frontier Foundation</a> si preoccupa che niente di nuovo è stato proposto per salvaguardare la <em>privacy</em> dei lettori.</p>
<p>Sembra che ancora non ci siamo del tutto. Passi in avanti, ma non sembra che Google e gli altri si siano sbottonati più di tanto.</p>

Robert Darnton, who has opted out of the Google Book Settlement for Harvard, has faith that we can do better in terms of providing digital access. His <a rel="nofollow" href="http://www.amazon.com/Case-Books-Past-Present-Future/dp/1586488260/ref=sr_1_1?ie=UTF8&#38;s=books&#38;qid=1257724155&#38;sr=8-1"><i>The Case for Books: Past, Present, and Future </i></a>presents his vision and recommendations. As he asserts in a recent article for <a rel="nofollow" href="http://www.publishersweekly.com/article/CA6696290.html"><i>Publisher&#8217;s Weekly</i></a>:</p>
<blockquote><p>Today, however, we have the means to make that utopia a reality. In many societies, despite enormous inequalities, ordinary people not only read but have access to a huge quantity of reading matter through the Internet. I would not minimize the digital divide, which separates the computerized world from the rest, nor would I underestimate the importance of traditional books. But the future is digital. And I believe that if we can resolve the current challenges facing books in ways that favor ordinary citizens, we can create a digital republic of letters. Much of my book is devoted to this premise and can be summarized in two words: digitize and democratize.</p></blockquote>

<p><a href="http://www.pcinpact.com/media/tgiparis3e_09-06128_google+aufeminin.pdf">Une décision de justice a été rendue le 9 octobre dernier par le TGI de Paris</a> (le même tribunal qui doit statuer dans l&#8217;affaire Google c. La Martinière et autres) qui va peut-être jouer un rôle important dans l&#8217;issue du litige, dans la mesure où elle paraît saper l&#8217;un des arguments essentiels de la défense de Google.</p>
<p>Petit retour en arrière pour bien comprendre de quoi il retourne.</p>

<p><a href="http://scinfolex.wordpress.com/2009/09/26/proces-googlele-seuil-la-martiniere-bientot-le-monde-a-lenvers/">Dans la chronique que j&#8217;avais faite, il y a un mois,</a> de l&#8217;audience qui s&#8217;est tenue le 24 septembre dernier au TGI de Paris dans l&#8217;affaire Google c. La Martinière et autres, j&#8217;indiquais que l&#8217;issue du litige serait certainement déterminée par la question du droit applicable :<a href="http://www.adbs.fr/google-livres-en-france-loi-des-etats-unis-ou-loi-francaise--72117.htm"> loi américaine ou loi française</a> ?</p>
<p>Les avocats de Google revendiquent en effet le bénéfice du <a href="http://fr.wikipedia.org/wiki/Fair_use">fair use américain</a> (usage équitable) pour se dégager de l&#8217;accusation de contrefaçon que constitueraient la numérisation, l&#8217;indexation et la mise à disposition à travers Google Book Search sous forme de courts extraits des ouvrages de l&#8217;édition française trouvés dans les bibliothèques américaines. Pour étayer cette prétention, il s&#8217;appuie sur <a href="http://www.juriscom.net/jpt/visu.php?ID=1067">une jurisprudence française de l&#8217;année dernière, SAIF c. Google, </a>rendue par la même chambre du TGI de Paris qui doit statuer dans le procès La Martinière.</p>
<p>Dans cette affaire qui mettait en cause Google Images contre une société de gestion collective française, les juges avaient considéré qu&#8217;il fallait retenir &#8220;<em>le lieu où le fait générateur de la contrefaçon a été réalisé [...] pour déterminer la loi applicable au litige et non celle du lieu où le dommage est subi</em>&#8220;, selon une interprétation <a href="http://www.wipo.int/treaties/fr/ip/berne/trtdocs_wo001.html#P113_19806">des règles de résolution des conflits de lois énoncées dans la Convention de Berne à son article 5.2.</a> Or d&#8217;après le juge, le fait générateur du dommage consiste en l&#8217;indexation et le stockage des images effectués à partir des serveurs implantés aux Etats-Unis. Dès lors, il faut considérer que c&#8217;est la loi américaine qui s&#8217;applique et Google est en droit de revendiquer le bénéfice du fair use.</p>
<p><!--more--><strong>Les avocats de Google tentent la même manœuvre dans le procès Google/La Martinière. </strong>Ils ont déployé des trésors d&#8217;éloquence pour faire considérer aux juges que le fait générateur du dommage en ce qui concerne Google Book était l&#8217;acte de numérisation initial effectué à partir du sol américain, suivi des actes de stockage et d&#8217;indexation toujours accomplis depuis les serveurs de Montain View.</p>
<p>Les avocats français ont bien tenté de parer ce coup mortel, mais en sortant du procès, j&#8217;avais acquis le sentiment que si Google Book pouvait bénéficier de la jurisprudence SAIF, ses chances de l&#8217;emporter étaient loin d&#8217;être négligeables.</p>
<p><strong>Or le 9 octobre dernier, le TGI de Paris a rendu <a href="http://www.pcinpact.com/media/tgiparis3e_09-06128_google+aufeminin.pdf">une décision</a> surprenante, qui a déjà fait couler beaucoup d&#8217;encre, mais sans qu&#8217;un lien ait été encore clairement établi avec l&#8217;Affaire Google Book &#8230; et pourtant !</strong></p>
<p>Tout part à l&#8217;origine d&#8217;une photo de Patrick Bruel (!!!) postée par un internaute sur le site Auféminin.com sans autorisation et indexée automatiquement par  Google Images. La justice est saisie une première fois pour obtenir le retrait de la photo du site et des index du moteur de recherche. Mais trois mois plus tard, l&#8217;image réapparaît, postée par un internaute différent et n&#8217;échappe pas à nouveau au zèle des robots du moteur de recherche. Au final, la responsabilité du site Auféminin et celle de Google ont été engagées par le TGI. Je ne vais pas m&#8217;étendre plus longtemps sur le sens de cette décision, très contestable, qui tend à imposer aux hébergeurs et aux moteurs une obligation de filtrage a priori des contenus illégaux (je vous renvoie pour cela à l&#8217;analyse qui en est faite <a href="http://www.pcinpact.com/actu/news/53939-aufeminin-google-filtrage-priori-tabaka.htm?vc=1">sur le site PCInpact </a>et <a href="http://decryptages.wordpress.com/">sur le blog Décryptages</a>).</p>
<p><strong>Ce qui m&#8217;intéresse ici, c&#8217;est de voir que Maître Neri (l&#8217;avocate de Google, la même qui plaide l&#8217;affaire Google/La Martinière) a logiquement essayé de demander à nouveau l&#8217;application de la jurisprudence SAIF :</strong></p>
<blockquote><p><em>[...] Pour s&#8217;exonérer de toute responsabilité la société Google invoque l&#8217;application du droit américain et soutient, par référence à la Convention de Berne, que les dispositions du Copyright Act et la notion de &#8220;fair use&#8221; trouveraient à s&#8217;appliquer [...]</em></p></blockquote>
<p><strong>Mais celle-ci lui a été refusée sur la base du raisonnement suivant </strong>(grand merci à <a href="http://twitter.com/Le_Coeur">Jérôme Le Coeur</a>, auteur du blog Décrytages justement, dont <a href="http://decryptages.wordpress.com/2009/11/04/hebergeur-et-moteur-de-recherche-meme-combat/#comments">la réponse à un commentaire que j&#8217;ai posté sous le billet signalé ci-dessus </a>m&#8217;a fourni des éclairages précieux pour bien comprendre le sens de la décision) :</p>
<p><span style="text-decoration:underline;">1) Le TGI décide de mettre en cause Google France contrairement à ce qui lui était demandé :</span></p>
<blockquote><p><em>La société Google France sollicite sa mise hors de cause au motif qu&#8217;elle serait étrangère à l&#8217;exploitation du service Google Images [...]. Mais [...] il n&#8217;en demeure pas moins qu&#8217;en l&#8217;espèce, la société Google France [...] apparaît sur les différents constats APP versés aux débats comme étant le bureau français à contacter de la société Google inc ; que cet élément corroboré par l&#8217;extrait Kbis de la société Google  qui révèle que celle-ci exerce, conformément à ses statuts, une activité de fourniture de services et/ou conseil relatif aux logiciels, au réseau internet, aux réseaux télématiques ou en ligne, notamment par l&#8217;intermédiaire en matière de vente de publicité en ligne, la promotion directe de produits et services et la mise en œuvre de traitement de l&#8217;information, suffit à rejeter la demande de mise hors de cause de la société Google France. </em></p></blockquote>
<p>Donc Google France est responsable solidairement aux côtés de Google Inc. et cet aspect suffit déjà à déplacer le centre de gravité de l&#8217;affaire vers le sol français, ce qui n&#8217;avait pas été le cas dans l&#8217;affaire SAIF où seul Google Inc. avait été mis en cause.</p>
<p><span style="text-decoration:underline;">2) Le TGI écarte l&#8217;application du droit américain et retient l&#8217;acte de contrefaçon sur la base du code français de la propriété intellectuelle :</span></p>
<p>L&#8217;argumentation suivie est très subtile (accrochez-vous, ça en vaut la peine !). Le juge estime :</p>
<p>a) que &#8220;<em>les faits litigieux résultent de l&#8217;affichage de ladite photographie sur le site google.fr</em>&#8220;</p>
<p>b) que &#8220;<em>ni la question de la nationalité de l&#8217;auteur de la photographie en question ni celle du lieu de la première divulgation de celle-ci ne sont discutées par les parties</em>&#8220;</p>
<p>c) que &#8220;<em>le pays sur le territoire duquel se sont produits les agissements délictueux, tel que le revendiquent les sociétés Google, et qui en l&#8217;espèce se confond avec le lieu du fait dommageable, est la France, de sorte que les défenderesses ne sauraient  revendiquer l&#8217;application de la loi américaine</em>&#8220;.</p>
<p><strong>En fait, le TGI maintient le mécanisme essentiel de la jurisprudence SAIF : on doit prendre en considération le fait générateur de la contrefaçon pour déterminer la loi applicable au litige. Mais il estime ici que ce fait consiste en l&#8217;affichage de la photo sur le site google.fr et non l&#8217;acte d&#8217;indexation effectué à partir des serveurs américains. </strong>S&#8217;y ajoutent d&#8217;autres indices de rattachement à la France comme la nationalité de l&#8217;auteur et le lieu de la première divulgation, ainsi que le fait que Google France soit bien mise en cause.</p>
<p>Résultat : à partir de principes quasiment identiques, le juge aboutit à un résultat &#8230; inverse ! Application du droit français &#8211;&#62; contrefaçon &#8211;&#62; condamnation de Google (c&#8217;est ce genre de pirouettes logiques qui font que j&#8217;adore le droit !).</p>

<p><strong>Les parallèles avec l&#8217;affaire Google Book sont troublants.</strong> Les avocats français ont notamment lourdement insisté sur le fait qu&#8217;ils cherchaient à attaquer la filiale Google France et qu&#8217;on ne pouvait la tenir à l&#8217;écart du litige (je comprends mieux maintenant la valeur tactique de cet argument). Et ils ont ensuite établi qu&#8217;il existait pas moins de 11 points de contact entre la France et le litige pour mettre toutes les chances de leur côté pour attirer le juge sur le terrain du droit français.</p>
<p><strong>La question maintenant est de savoir jusqu&#8217;à quel point Google Book et Google Images sont comparables.</strong> Google Images se contente d&#8217;indexer les contenus et de les afficher sous forme de vignettes accompagnées de liens. Google Book va beaucoup plus loin et l&#8217;acte initial de numérisation qui a été effectué à partir des Etats-Unis occupe une place centrale. Le juge pourrait choisir de lui reconnaître un poids suffisamment important pour faire basculer l&#8217;affaire du côté du droit américain (et si cela se produit, il faudra encore que le juge considère que l&#8217;usage que Google fait des ouvrages scannés est bien équitable, ce qui est loin d&#8217;être si évident).</p>
<p>Pour ne rien vous cacher en sortant de l&#8217;audience du procès le 24 septembre dernier, j&#8217;estimais que Google avait 7 chances sur 10 de l&#8217;emporter. Maintenant, la seule chose que je sais &#8230; c&#8217;est que je ne sais plus rien !</p>
<p>L&#8217;issue me paraît tout entière suspendue à un pur acte de volonté des juges.</p>
<p>Il ne reste plus qu&#8217;à attendre l&#8217;audience de délibéré le 16 décembre prochain.</p>
<p>Et croyez-moi, j&#8217;y serai !</p>
<p>PS : il serait également intéressant d&#8217;aller voir l&#8217;équivalent de la jurisprudence SAIF aux Etats-Unis : la décision du 16 mai 2007 <a href="http://www.archivists.org/saagroups/ipwg/Cases/Perfect_10_05_16_2007.pdf"><em>Perfect 10 v. Google</em></a> aux termes de laquelle Google Images s&#8217;est vu reconnaître le bénéfice du fair use [merci à Aurélia pour cette trouvaille !]</p>
<p><strong>Mise à jour du 11/11/09 :</strong> Cédric Manara a écrit un commentaire sur le site Dalloz Actualité qui montre que la décision AuFéminin du TGI de Paris est assez contestable dans son raisonnement et dans ses conclusions : &#8220;<a href="http://www1.dalloz.fr/Actualites/frameSet/default.aspx?typeRevue=dalloz&#38;ActId=31715&#38;news=1">L&#8217;indexation d&#8217;images croquée en justice</a>&#8220;.</p>
<p>Je vous recommande d&#8217;aller lire le commentaire entier, mais l&#8217;entrée en matière en dit déjà long :</p>
<blockquote><p><em>S&#8217;il existait un miroir assez grand pour refléter la surface du globe, son propriétaire se rendrait-il coupable de violations du droit d&#8217;auteur pour les représentations symétriques d&#8217;œuvres que l&#8217;on y verrait? Pour le tribunal de grande instance de Paris, la réponse serait oui: il vient en effet de juger que le moteur de recherche d&#8217;images exploité par la société Google est responsable à raison de son activité d&#8217;indexation automatique destinée à permettre aux internautes de chercher des dessins, photos, figures, etc.</em></p></blockquote>
<p>Et si la jurisprudence<em> </em>SAIF s&#8217;avérait finalement plus solide que prévue ?</p>
<p>On atteint décidément des sommets d&#8217;incertitude !</p>

<p><em>La différence, semble-t-il, réside dans la détermination du fait litigieux. Pour la troisième chambre de 2008, il s’agissait du <em>fait générateur</em> de la reproduction. A savoir, l’activité d’indexation par <em>Google Images</em>, réalisée en Californie. Pour la troisième chambre d’octobre 2009, c’est le lieu du “<em>fait dommageable</em>“, à savoir, le lieu de l’<em>affichage</em> qui décide de la loi applicable. D’où mise en œuvre des règles françaises, et <em>exit</em> l’exception de “<em>fair use</em>“.</em></p>

<p>I would have liked to hear how much the ability to view excerpts from a book affects consumers&#8217; online purchases.  I want to know how this advertising tool affects me, the reader, a member of the public.</p>

<p>On apprend sur le site de Livres Hebdo dans<a href="http://www.livreshebdo.fr/actualites/DetailsActuRub.aspx?id=3618"> un article en date du 22 octobre</a> que le magazine a demandé <strong>à la Mairie de Lyon communication du texte</strong> de <a href="http://www.lemonde.fr/culture/article/2008/07/12/accord-entre-google-et-la-bibliotheque-de-lyon_1072853_3246.html">l&#8217;accord conclu avec Google en juillet 2008</a> au terme d&#8217;une procédure d&#8217;appel d&#8217;offre  pour la numérisation des fonds de la Bibliothèque municipale.</p>
<p>Cette demande s&#8217;est vue opposer un refus justifié par la présence de<strong> clauses de confidentialité</strong> insérées dans le contrat et acceptées par la Ville de Lyon. On sait en effet que Google impose à ses partenaires de telles conditions et jusqu&#8217;à ce jour, seuls les contrats conclus avec l&#8217;<a href="http://www.livreshebdo.fr/cache/upload/pdf/3%20-%20Contrat%20google%20univ%20du%20Michigan%20-%20copie%20pdf.pdf">Université de Michigan </a>et l&#8217;<a href="http://www.livreshebdo.fr/cache/upload/pdf/4%20-%20Contrat%20Google%20-%20Universit%C3%A9%20de%20Californie.pdf">Université de Californie</a> ont été divulgués.</p>
<p>Mais l&#8217;histoire lyonnaise ne s&#8217;arrête pas là, puisque <strong>Livres Hedbo annonce avoir saisi la <a href="http://www.cada.fr/">CADA</a></strong> (Commission d&#8217;Accès aux Documents Administratifs) pour contester la décision de la Ville de Lyon. Cette institution, qui a la qualité d&#8217;<a href="http://fr.wikipedia.org/wiki/Autorit%C3%A9_administrative_ind%C3%A9pendante_en_France">autorité administrative indépendante</a>, est chargée de garantir<a href="http://www.cada.fr/fr/guide/frame.htm"> le droit d&#8217;accès aux documents administratifs </a>posé par <a href="http://www.legifrance.gouv.fr/affichTexte.do?cidTexte=LEGITEXT000006068643&#38;dateTexte=20091028">la loi du 17 juillet 1978</a>. Ce texte établit en effet que les administrations ont le devoir de communiquer aux citoyens qui en font la demande les documents qu&#8217;elles produisent ou détiennent, en dehors d&#8217;<a href="http://www.cada.fr/fr/guide/frame.htm">une liste bien déterminée d&#8217;exceptions</a>.</p>
<p><!--more-->Lorsqu&#8217;elle est saisie, la CADA est tenue de rendre sa décision dans un délai d&#8217;un mois. Livres Hebdo précise dans son article que celle-ci pourrait intervenir <strong>au début du mois de novembre</strong>. Il faut préciser par ailleurs que la CADA ne rend que des avis qui n&#8217;ont pas en tant que tels de<strong> force obligatoire</strong>. Mais il est assez rare dans les faits que les administrations persistent dans leur refus suite à un avis favorable rendu par la Commission et dans ce cas, il reste encore possible de saisir le tribunal administratif pour contester la décision.</p>
<p><strong>La question essentielle</strong> maintenant reste de savoir si le contrat conclu entre la Ville de lyon et Google peut être considéré comme un document administratif communicable. Sur le site CarrefourLocal. Sénat.fr, on trouve <a href="http://carrefourlocal.senat.fr/vie_locale/cas_pratiques/quelles_sont_les_regles_de_co/index.html">une synthèse très bien faite </a>sur cette question qui indique les éléments suivants :</p>
<blockquote><p><strong> <em>Les règles de communication applicables aux contrats et aux marchés des collectivités publiques</em></strong></p></blockquote>
<blockquote><p><em>Selon la jurisprudence constante de la Commission d’accès aux documents administratifs (CADA), <strong>les contrats, et notamment les marchés publics, passés par les collectivités publiques doivent être considérés comme des documents administratifs</strong>. A ce titre, ils sont soumis au droit d’accès prévu par la loi du 17 juillet 1978, <strong>ouvert à toute personne qui en fait la demande, qu’elle ait ou non soumissionné dans le cadre de la mise en concurrence</strong>.</em></p>
<p><em>Ce droit d’accès doit toutefois se concilier avec le secret de la vie privée et avec <strong>le secret en matière industrielle et commerciale</strong>, protégé par le II de l’article 6 de la loi du 17 juillet 1978, qui correspond, pour les marchés, à trois catégories d’information :</em></p>
<p><em>- <strong>le secret des procédés</strong> (techniques de fabrication, contenu des activités de recherche-développement des entreprises…) ;</em></p>
<p><em>- <strong>le secret des informations économiques et financières</strong>, catégorie dans laquelle entrent les informations ayant trait à la situation économique d’une entreprise, à sa santé financière ou à l’état de son crédit (ex : chiffre d’affaires, documents comptables, effectifs employés) ;</em></p>
<p><em>- <strong>le secret des stratégies commerciales</strong> (informations sur les prix et les pratiques commerciales : listes des fournisseurs, montant des remises consenties, etc…). <p>Autant le deuxième type de secret me paraît peu applicable à l&#8217;accord passé avec la Ville de Lyon, autant il n&#8217;est pas impossible que le contrat contienne des informations relevant des autres catégories (plus de détails ici sur<a href="http://www.cada.fr/fr/fiches/fiche11.htm"> le secret en matière industrielle et commerciale</a>). <p>Quoi qu&#8217;il soit, la démarche de Livres Hebdo a le mérite de pointer un aspect essentiel : <strong>la validité et la portée des clauses de confidentialité imposées par Google Book à ses partenaires. </strong>On sait que les dispositions des accords de numérisation varient selon les établissements, certainement de manière très significative (Robert Darnton révélait dans <a href="http://www.ecrans.fr/Il-faut-s-allier-pour-peser-sur,8333.html">une interview accordée à Libération</a> que l&#8217;Université d&#8217;Harvard avait consenti une exclusivité commerciale sur les documents jusqu&#8217;en 2050 [déclaration assortie d'un "je crois" particulièrement inquiétant !] ; alors que la <a href="http://www.livreshebdo.fr/cache/upload/pdf/1%20-%20DELIBERATION%20VILLE%20DE%20LYON%20-%20GOOGLE%20-%20d%C3%A9cision.pdf">délibération de la Ville de Lyon</a> ayant approuvé l&#8217;accord indique que l&#8217;exclusivité sur les documents de la BM durerait 25 ans).</p>
<p>Rendez-vous donc début novembre pour voir si le rideau se lève !</p>

We can define them as libraries in which <strong>collections are stored in digital formats</strong> and accesible by computers. We can affirm that digital libraries are a <strong>type of</strong> <a title="Information retrieval" href="http://en.wikipedia.org/wiki/Information_retrieval" target="_blank">information retrieval</a> <strong>system.</strong></p>

<p>Moreover, one of the main ideas of this post is to present <strong>some of the most important digital libraries</strong> that nowadays exist such as <a title="Project Perseus" href="http://en.wikipedia.org/wiki/Perseus_Project" target="_blank">Project Perseus</a>, <a title="Project Gutenberg" href="http://en.wikipedia.org/wiki/Project_Gutenberg" target="_blank">Project Gutenberg</a>, <a title="Google Book Search" href="http://en.wikipedia.org/wiki/Google_Book_Search" target="_blank">Google Book Search</a>, etc. However, as <strong>I am studying a degree in English</strong> I thought that it would be appropriate to <strong>focus on</strong> one important <strong>digital library with contents in English.</strong> That is the reason why we are going to talk today about the <strong>Darlington Digital Library</strong> (<strong>University of Pittsburgh</strong>).</p>
<p><!--more-->The <a title="Darlington Digital Library" href="http://digital.library.pitt.edu/d/darlington/index.html" target="_blank">Darlington Digital Library</a> was created from the <strong>collection of books, atlases and maps</strong> that were <strong>assembled</strong>, in the first place, <strong>by</strong> the attorney <a title="William M. Darlington" href="http://images.library.pitt.edu/cgi-bin/i/image/image-idx?image.x=160&#38;image.y=89&#38;c=darlfamily&#38;sid=8e4a38e18966d7898f935543635d8566&#38;ox=1&#38;oy=0&#38;lastres=3&#38;res=3&#38;width=283&#38;height=375&#38;maxw=2267&#38;maxh=3000&#38;subview=getsid&#38;view=entry&#38;viewid=1&#38;entryid=x-2.43.da&#38;cc=darlfamily&#38;quality=m600&#38;evl=full-image" target="_blank">William M. Darlington</a>, who was born in Pittsburg in 1815. <strong>After his death</strong> in 1889, it was <strong>his family</strong> that <strong>continued</strong> his passion for <strong>recollecting</strong> documents and <strong>materials</strong> about <strong>colonial American history.</strong> <strong>In 1938 the</strong> <a title="University of Pittsburgh" href="http://en.wikipedia.org/wiki/University_of_Pittsburgh" target="_blank">University of Pittsburgh</a> <strong>Press published</strong> a magnificent <strong>overview of the</strong><strong> </strong>whole<strong> </strong><strong>collection.</strong></p>
<p>In adittion, the <strong>Digital Research Library (DLR)</strong> department <strong>started </strong>digitalizing and <strong>scanning books from the Darlington collection in the year 2006. </strong>In this project there are involved scanning technicians and graduate students who spend <strong>90 hours per week</strong> digitalizing the already mentioned materials. But would you like to know <strong>how does this process take place?</strong> Then pay attention to the following video:</p>

Besides, with this system of digital libraries <strong>the materials that we have access to do not suffer any harm and they are preserved in optimum conditions.</strong> So, if remained skeptical about the benefits of <strong>digital libraries give them a try.</strong> You will not regret.</p>

<blockquote><p>Not only, it turns out, are the readers of the world looking to buy our content if we can deliver it to them digitally, but the world’s leading hardware companies are looking to help us. Along with Sony, iRex, TXTR, and other dedicated reading device manufacturers exhibiting, presenting, and working the floor, two Apple executives were traversing the halls of the Fair to let publishers know all the opportunities that await them on that platform. (Let it be said: that platform, right now, is the iPhone. Not any other rumored device. Apple has not been in private discussions about a larger device and reports that they have are a hoax. But Apple does believe in the opportunity for the publishing industry’s content, contrary to the occasional snarky comment from Jobs.) Apple is working to improve the Books section of the App store to make it more browsable, and they are trying to help publishers find the right developers to work with.</p></blockquote>
<p>You should take the time to read all the contributions from Richard and his fellow <a href="http://www.book-fair.com/en/blog/">Book Fair Bloggers, they provide a nice slice of the fair</a>.</p>
<p><a href="http://www.magellanmediapartners.com/index.php/mmcp/">Brian O&#8217;Leary</a> has put the slides for his trouble causing presentation on piracy up on <a href="http://www.slideshare.net/bfoleary/impact-of-piracy-and-free-t-o-c-f-f">Slideshare</a>, when you read through, you&#8217;ll find it hard to find the controversy and wonder just how tightly poised those knee-jerk reactions are.<br />

<p>The news of Google&#8217;s Google Editions, which first came to light back in June has been formed up by more recent news. <a href="http://www.google.com/hostednews/ap/article/ALeqM5gr_qJI9KI8h7PBC-AEeknD3ezkegD9BBHAT80">Like this AP story</a>:</p>
<blockquote><p>Tom Turvey, head of Google Book Search&#8217;s publisher partnership program, said the price per book would be set by their publishers and would start with between 400,000 to 600,000 books in the first half of 2010.<br />
&#8220;It will be a browser-based access,&#8221; Turvey said Thursday at the 61st Frankfurt Book Fair. &#8220;The way the e-book market will evolve is by accessing the book from anywhere, from an access point of view and also from a geographical point of view.&#8221;<br />
The books bought from Google, and its partners, would be accessible on any gadget that has a Web browser, including smartphones, netbooks and personal computers and laptops. A book would be accessible offline after the first time it was accessed.</p></blockquote>
<p>Of course as you would expect it is platform neutral (if web based/cloud based is neutral), omnipresent and smart. Anyone who thinks that devices are the future is living in the past.</p>
<p>There is a whole load of other stuff on the margins, but in terms of signal, I think this is it!<br />

Unlike Amazon’s strategy with the Kindle dedicated eReader device, Google plans to deliver eBooks to any device with a web browser.</p>
<p>The service, dubbed Google Editions, is slated to launch in the first half of 2010. At launch it will feature about 500,000 eBooks from publishers Google is already working with <a href="http://mashable.com/2009/10/09/brin-on-google-books/">on Google Book Search</a>. Purchases can be made directly from Google or through partner sites like Barnes &#38; Noble.</p>
<p>Interestingly, Reuters names Amazon.com as a potential retailer for Google’s electronic books. Considering Amazon would surely prefer to sell its own titles for use on the Kindle, and also considering Barnes &#38; Noble <a href="http://mashable.com/2009/10/14/barnes-noble-ereader-2/">plans to launch its own eReader</a> device as well, these 3 partners seem interesting bedfellows. Oorspronkelijk was het de bedoeling de conferentie gelijktijdig te laten plaatsvinden met de uitspraak van de rechter over de settlement, maar die datum is mede door het grote aantal bezwaren dat tegen de settlement is ingebracht met een maand verplaatst naar 9 november. Motto van de conferentie was <a href="http://www.nyls.edu/centers/harlan_scholar_centers/institute_for_information_law_and_policy/events/d_is_for_digitize">D is for Digitize</a>. Het logo van de conferentie vulde dat nog eens aan met ABC (is for &#8230;) en ook in het <a href="http://www.nyls.edu/centers/harlan_scholar_centers/institute_for_information_law_and_policy/events/d_is_for_digitize/program">programma</a> kwamen verschillende letters terug (L is for Lawsuit).</p>
