<content:encoded><![CDATA[<div class='snap_preview'><p>Last week, officials from the Environmental Protection Agency toured the landfill and visited with families of the children with birth defects in Kettleman City. That action came less than a week after Gov. Arnold Schwarzenegger ordered the State Department of Public Health and California’s Environmental Protection Agency to look into what he called “an abnormal percentage of birth defects” occurring there.</p>
<p>The town, a collection of single-level ranch houses and rough streets, is bordered by electric transmission wires and the California Aqueduct, which is sealed off from town residents by a barbed-wire, chain-link fence.<br />

<p>On January 9, 2009, I launched a free, anonymous blog called Bad Biz Finder that reported on loan modification fraud and the illegal California leases of a large landlord.*</p>
<p>Within 6 months, it had amassed 185,000 hits because it dared to tell the raw truth about the fraud against consumers in foreclosure and landlord-tenant law.</p>
<p>The perpetrators of the loan modification fraud?  Attorneys licensed by the California State Bar.  At that time, Holly Fujie was the President of the State Bar, now Howard Miller is at the helm.</p>
<p>Did the State Bar monitor the activities of its attorney members?  <strong><em>No.</em></strong></p>
<p>Did the State Bar prosecute its attorney members that violated the law? <strong><em>No.</em></strong></p>
<p>Is the State Bar responsible for thousands of consumers who lost their homes (and a lot of money) who relied on their attorney members to provide ethical, competent services regularly monitored for illegal activity?  <strong><em>Yes.</em></strong></p>
<p>Does the State Bar have a client restitution program?  <strong><em>Yes.  &#8220;The Client Security Fund.&#8221;</em></strong>  (See, <a href="http://www.calbar.ca.gov/state/calbar/calbar_generic.jsp?cid=10177&#38;id=1379">http://www.calbar.ca.gov/state/calbar/calbar_generic.jsp?cid=10177&#38;id=1379</a>) </p>
<p>The California State Bar website text describing the Client Security Fund states:  &#8220;The fund may reimburse up to $50,000 for theft committed by a California lawyer.  <span style="text-decoration:underline;">It covers the loss of money or property resulting from lawyer dishonesty</span> (<strong><em>but not because the lawyer acted incompetently, committed malpractice or failed to take certain actions</em></strong>).&#8221;  [Leave it to a lawyer to infer that there is a difference between dishonesty <span style="text-decoration:underline;"><strong>and</strong></span> incompetence, malpractice and negligence.]</p>
<p>Is the California State Bar paying out any money from its Client Security Fund to victims of loan modification fraud perpetrated by its attorney members?  <strong><em>No.</em></strong></p>
<p>Why not?  Beats me.  But I just surveyed the California State Bar&#8217;s Board of Governors to see who might be willing to work with me to right the wrongs committed by their attorney members. </p>
<p>I even offered to help, as a &#8220;consumer liaison&#8221; as I&#8217;ve been championing this cause for over a year and have lists of consumers harmed by California lawyers coming out my ears.  I used to get 500+ emails a day from consumers who had been taken in by the false sense of security one gets from &#8220;working with an attorney.&#8221;</p>
<p>I&#8217;ll let you know who steps up to the plate and who doesn&#8217;t.  Keep your fingers crossed.  Here&#8217;s a little background:</p>
<p>The California Foreclosure Consultant&#8217;s Act contained what I coined over a year ago as the &#8220;lawyer loophole.&#8221;   The law stated that lawyers could take fees in advance of services provided, but no one else could.  So, do you know what happened?</p>
<p>1.    Lawyers began lending their law license to ex-sub-prime mortgage businesses for a cut of the action so that the mortgage companies could get around the law about advance fees.</p>
<p>2. Lawyers, with no experience in loan modifications, opened up &#8220;loan modification law firms&#8221; and called themselves, &#8220;experts.&#8221;  Instead of hiring lawyers to do the work (which would have cut too far into their profits) they hired kids whose last job was serving coffee at Starbucks.  So the &#8220;law firms&#8221; had no lawyers.</p>
<p>I wrote over 300 articles about this subject and profiled 43 of the very worst offenders.  I also informed the California State Bar, the Department of Real Estate, the Attorney General&#8217;s Office and the Federal Trade Commission.  For six months they ignored me. </p>
<p>Then my blog got shut down by one of those &#8220;worst offenders&#8221; (see About Us on this blog)* and then guess what? </p>
<p>One month later &#8230; the California State Bar, the Department of Real Estate, the Attorney General&#8217;s Office and the Federal Trade Commission started announcing how they <em><strong>&#8220;could not believe how many lawyers were involved in the fraud against consumers in foreclosure.  Who knew???  We wish someone would have told us! &#8221;</strong></em>   <em>[And they're secretly thinking to themselves, "Good thing that Bad Biz Finder blog is gone"....]</em></p>
<p>They all became the knights on white horses galloping up to save the day and all the consumers (who haven&#8217;t already been defrauded) are screaming, &#8220;Yay for them!&#8221;  They all started changing their websites to &#8220;warn consumers about thos evil loan modification law firm scams.&#8221;  And then what happened?</p>
<p>On October 16, 2009, Governor Arnold Schwarzenegger signed Senate Bill 94 that proclaimed:  &#8220;<strong><em>Attorneys can no longer take fees in advance of loan modification services rendered.&#8221;   Job well done, Governor!</em></strong>   <strong><em>Glad you thought of that &#8211; excellent!</em></strong></p>
<p>Every Tom, Dick and Harry from the California State Bar, the Department of Real Estate, the Attorney General&#8217;s Office and the Federal Trade Commission held press conferences claiming their brilliance and and patting themselves on the back for <strong><em>&#8220;catching this fraud in time.&#8221;</em></strong>  Thank God.</p>
<p>But wait a minute &#8230; what about the warnings and pleadings and information from Bad Biz Finder and the tens of thousands of consumers who were scammed between January to October 2009?  What about when I was screaming at the top of my lungs about this problem and everyone was ignoring me?  Who is going to help those consumers?  And what about that six-figure judgment I have against me for telling the truth about one of the worst offenders?*  Who is gong to pay for that?</p>
<p>The State Bar started suspending attorneys left and right.  But a year too late!  What about the consumers who trusted the &#8220;clean-as-a-whistle&#8221; records of these attorneys found on the State Bar website, hired them, and then lost everything? </p>
<p>Don&#8217;t get me wrong, I&#8217;m glad Arnold sat down at that table and signed the Bill but what about the consumers who had already been screwed?  Those are the ones I&#8217;m talking about here. </p>
<p>And there will be tons more a year from now if the Governor, the California State Bar, the Department of Real Estate, the Attorney General&#8217;s Office and the Federal Trade Commission don&#8217;t stay on top of it.  Yes, it&#8217;s all very exciting when they all get their little lying &#8220;moment in the sun&#8221; and their fraudulent PR sound bite.  But, it&#8217;s only a couple of months later and the issue has disappeared from the California State Bar website and one of the worst offenders is already advertising again in this area.* </p>
<p>I&#8217;m going to start posting some on the articles I wrote during those ten months to show you that the California State Bar, the Department of Real Estate, the Attorney General&#8217;s Office, the Federal Trade Commission <strong><em>and Governor Arnold Schwarzenegger KNEW WHAT WAS GOING ON and ignored it</em></strong>.</p>
<p>What then?  Well, later I&#8217;ll post the solution I offered to the California State Bar&#8217;s Board of Governors.  But first, I&#8217;m going to give each one of the 23 Board members a chance to really think it over before I jump to any conclusions.  Stay tuned.</p>
<p>*  Please note, I am prohibited by court order from writing about two specific business entities, because they were able to secure injunctions against my writing the truth about them.   Unfortunately, crime pays when it comes to certain judges.</p>

California&#8217;s New Redistricting Commission</span></div>

<div>Our state legislative, Congressional and other district lines are about to change following the 2010 census.</div>
<p>How the lines are drawn determines politics in California for the next decade.</p>
<div>For the first time in our state&#8217;s history, a citizens&#8217; commission will draw the new State Senate, Assembly and Board of Equalization district boundaries.  It&#8217;s incredibly important for this to be drawn in a fair manner.  Partisan &#8220;gerrymandering&#8221; can render districts &#8220;locked in&#8221; and uncompetitive for a decade, compromising the democratic process.</div>
<div>Passed in 2008, Proposition 11 created a 14 member citizens&#8217; commission with equal numbers of Republicans and Democrats, with a smaller number of other political party and independent members.</p>
<p>Applications are now being accepted for citizens to serve on the Commission. <p>Who is Eligible to Apply?</p>
<div>The application process is open to every registered California voter who:</div>

<li>Will have been continuously registered in California with the same political party, or with no political party, for the five years immediately prior to being appointed to the Commission</li>
<li>Has voted in at least two of the last three statewide general elections.</li>
</ul>
<div>A voter is ineligible to serve if, during the past 10 years he or she, or a member of his or her immediate family, has:</div>

Carlson previously was a spa consultant at the Villagio Inn &#38; Spa in 2003 and held the same position at the Ritz Carlton in 2002. Prior to that, she worked for the Nob Hill Spa from 2000 to 2002, holding the positions of consultant, esthetician and sales associate. Carlson is a member of the American Association of Cosmetology Schools and serves on the Foot Spa Safety Task Force. This position requires Senate confirmation and the compensation is $100 per diem. Carlson is registered decline-to-state.</p>

<p><strong>It took seventy years of protesting by California lawyers that the State Bar was un-American before  any California leader decided to take decisive action.  Yet, another twelve years have gone by and only victims of State Bar abuse and corruption fully understand the nature and extent of the evils Governor Pete Wilson warned about. </strong></p>
<p><strong> Calling the organization the &#8220;ultimate political animal&#8221;, Wilson vetoed funding for the group in 1997.  Although this resulted in the closing of the State Bar for nearly a year, the arrogance  of State Bar officials has not only gained momentum, but spread throughout Sacramento and other parts of the State.</strong></p>

<p><strong>as well as members of the California Legislature are making it their business to protect the perpetrators of such abuses.</strong></p>
<p><strong>Because the State Bar is able to censor and sanitize the news through the <em>Daily Journal, Inc</em>. publications,  and is exempt from providing disciplinary statistics under the State Public Records Act, little is know about the wide-spread political tampering which runs rampant through Office of Trial Counsel and the State Bar Court. </strong><strong>What is clear from those members who have attempted to challenge the Bar&#8217;s policies is this:</strong></p>
<p><strong>1] State Bar lawyers and officials routinely use &#8220;moral turpitude&#8221; and other magic buzz words <!--more-->to disbar members who try to blow the whistle on State Bar corruption.</strong></p>
<p><strong>2] Even past presidents, like Sheldon Sloan have been accused of putting bogus discipline cases on opposing counsel to gain an unfair advantage in their own personal litigation &#8211; </strong><strong><a href="http://sites.google.com/site/freerichardfine/">Free Richard Fine</a></strong><strong> .</strong></p>
<p><strong>3] Attorney General Brown still refuses to investigate political tampering in connection with the dismissal of ethical complaints against himself and his top aides. </strong></p>
<p><strong>4] Brown has also turned a blind eye on allegations that a former president of the California District Attorneys Association framed an innocent Afro-American youth to cover up his own corruption &#8211; </strong><a rel="attachment wp-att-1321" href="http://theeliteones.wordpress.com/george-kennedy-papers/kennedypapers-3/">George Kennedy Papers.</a></p>
<p><!--end description--><strong> </strong></p>
<p><strong>5] Brown has not investigated complaints against Clinton-Gore lawyers arising from allegations that Democratic candidates violated federal campaign finance laws which are still buried at State Bar headquarters in San Francisco [State Bar Complaint 96 007049].</strong></p>
<p><strong>6] State Bar lawyers and officials conspired with State Bar members employed by the U.S. Justice Department and U.S. Department of Education to cover up fraud and failures in the administration of Executive Order 12250.The civil rights of tens of thousands of senior and disabled Californians were impaired by this State Bar cover-up [Ibid].<br />

<p><strong>7] Politically connected State Bar members with as many as four ethical complaints against them are never investigated or disciplined.</strong></p>

<p><strong>8]State Bar President Howard Miller was less than truthful when he assured State Bar member he had addressed the concerns expressed by Governor Schwarzenegger in his Senate Bill 641 veto message [<em>California Bar Journal,</em> January, 2010].</strong></p>
<p><strong>9] Miller also gambled with the truth when he told State Bar members that Senate Bill 641 would be re-introduced with the same language [Ibid].</strong></p>
<p><strong>10] No witnesses have yet been contacted in connection with the investigation of State Bar Complaints 10-01702 and 10-01703. These complaints allege State Bar Lobbyist Anthony Williams and Legislative Counsel Saul Bercovitch violated the Rules of Professional Conduct when they slipped Senate Bill 55 past the Legislature over the objection of aggrieved State Bar members.</strong></p>

<div><span style="font-size:small;"> On Saturday, I paid my respects at the U.S.S. Arizona Memorial at Pearl Harbor with RNC Chairman Michael Steele and the members of the Republican National Committee following our Winter Meeting.  The Memorial, and those to whom it is dedicated, serve as a powerful reminder of how our nation and the freedoms that define us have and continue to make America a target for those who do not share the value we place on liberty and self-determination.</p>
<p>For this reason, it is critical that America remain on offense in the global war on terror, and that we recognize that the terrorists who continue to plot against our country are not merely criminals to be defended in court, but enemy combatants to be defeated on this 21st century battlefield.</p>
<p>The election of Scott Brown to the United States Senate demonstrates that even in the bluest of blue states, the policies of this Administration and Congress have fallen out of favor with the American people, who now turn to Republicans to provide a better way on the important issues of national security, government spending, health care, and more.</p>
<p>I just returned from the Republican National Committee&#8217;s Winter Meeting, and what a different environment we face than a year ago.  More Americans are identifying with our party, independent voters are choosing our candidates over the Democrats, and people are favoring Republican solutions over those offered by our opponents.</p>
<p>Our team is fresh off statewide victories in Virgina, New Jersey, Pennsylvania and Massachusetts &#8212; all states Barack Obama won in 2008, but elected Republicans statewide in 2009.</p>
<p>California is not immune from this national trend.  As a matter of fact, as the largest state in the nation we are the biggest contributors to the trends that define today&#8217;s political landscape.  Californians are demanding better solutions than those offered by the Democrats.</p>

<p>I&#8217;m looking forward to working with you to elect those candidates &#8212; leaders who will put Republican ideas into action across our state.</p>

<div><span style="font-size:small;">&#8220;We are very pleased the U.S.  Supreme Court is moving in the direction of more freedom and less restriction  when it comes to Americans expressing themselves in politics, whether  individually or collectively.  Yesterday&#8217;s decision was a good  one.</p>
<p>&#8220;Yet, until the Court revisits  the draconian limits the McCain-Feingold law places on political parties engaged  in activity unrelated to federal contests, the net effect of the  decision is to bias the political system in favor of corporate and labor union  independent expenditures, and away from open, democratically governed political  parties.</p>
<p>&#8220;This is an important  distinction.  Political parties in America are broad based, democratically  governed, and far more transparent in their operation than so-called independent  expenditure committees.  A system which is rightly open to independent  expenditures by not-for-profits, corporations and labor unions is just, but  discriminating against open and democratically governed political parties is  wrong.</p>

<p><strong><span style="font-size:xx-small;">Introduction</span></strong></p>
<p>While it may not have been introduced with the fanfare of the iPhone, the latest gadget available to consumers is the electronic cigarette (E-cigarette). According to the U.S. Food and Drug Administration (FDA), E-cigarettes are battery-operated devices that generally contain cartridges filled with nicotine, flavor, and other chemicals. The E-cigarette turns nicotine, which is highly addictive, and other chemicals into a vapor that is inhaled by the user.<sup>1</sup></p>
<p>Regulators, legislators, and distributors have had differing opinions regarding how, or even if, E-cigarettes should be regulated. However, a recent development in a federal court case challenging the FDA’s ability to regulate E-cigarettes sheds some light on this question.</p>
<p><strong><span style="font-size:xx-small;">Background</span></strong></p>
<p>On April 28, 2009, Smoking Everywhere, Inc. (SE), a distributor that imports E-cigarettes from overseas manufacturers, filed suit in U.S. District Court against the FDA and the U.S. Department of Health and Human Services seeking “to stop the FDA from improperly exceeding its delegated authority by attempting to regulate electronic cigarettes – electronic products that are derived from tobacco and allow a user to inhale a liquid nicotine vapor for the purpose of ‘smoking’ pleasure. The FDA has further exceeded its improperly delegated authority by adding, without opportunity for public notice and comment, electronic cigarettes to an FDA ‘import alert,’ which alerts FDA field offices and the United States Customs and Border Protection (USCBP) to the attempted entry of certain products into the United States. The FDA’s conduct is <em>ultra vires</em> of its authority under the Food, Drug, and Cosmetic Act (FDCA), and by failing to engage in mandatory public notice and opportunity for comment, the FDA’s conduct further violates the notice and comment procedures [of the Administrative Procedures Act (APA)].”<sup>2</sup></p>
<p>SE’s action arises from the FDA’s decision to detain multiple inbound shipments of E-cigarettes belonging to SE and another distributor. In SE’s case, the FDA issued a hold on two shipments that arrived at Los Angeles International Airport in late September 2008. On October 29, 2008, the FDA issued notices of detention on the grounds that the shipments appeared to be adulterated, misbranded, or otherwise in violation of the FDCA. After an exchange of information about the shipments between the FDA and SE, FDA issued correspondence dated December 23, 2008 stating its conclusion that the E-cigarettes and their component parts appear to be intended to affect the structure or function of the body, and to prevent, mitigate, or treat the withdrawal symptoms of nicotine addiction. Thus, according to the FDA, the product appears to be an unapproved drug-device combination under the FDCA. Based on this conclusion, the FDA issued “Refusal of Admission” notices on March 16, 2009 that directed the products to be either exported or destroyed within 90 days. A short time later, the FDA added E-cigarettes manufactured by three Chinese companies to an “Import Alert,” a directive that authorizes FDA district offices to detain any unapproved and/or misbranded drug listed on the alert.<sup>3</sup></p>
<p>As the lawsuit was moving forward, an important related development occurred. On June 22, 2009, President Obama signed the Family Smoking Prevention and Tobacco Control Act of 2009 (Tobacco Act). The legislation gives FDA the authority to regulate tobacco products. At the signing ceremony, the president stated, “This legislation will not ban all tobacco products, and it will allow adults to make their own choices. But it will also ban tobacco advertising within a thousand feet of schools and playgrounds. It will curb the ability of tobacco companies to market products to our children by using appealing flavors. It will force these companies to more clearly and publicly acknowledge the harmful and deadly effects of the products they sell. And it will allow the scientists at the FDA to take other common-sense steps to reduce the harmful effects of smoking.”<sup>4</sup></p>
<p><strong><span style="font-size:xx-small;">Decision</span></strong></p>
<p>On January 14, 2010, U.S. District Judge Richard J. Leon granted a preliminary injunction, pending a final disposition of the case, ordering the FDA to “not detain or refuse admission into the United States Smoking Everywhere’s electronic cigarette products on the ground that those products are unapproved drugs, devices, or drug-device combinations under the Food, Drug, and Cosmetic Act.”<sup>5</sup></p>
<p>In the memorandum opinion accompanying the order, Judge Leon states, “FDA says that the electronic cigarettes marketed by plaintiffs are a drug-device combination and should therefore be excluded from the Tobacco Act’s definition of ‘tobacco product’ because the labeling and promotional materials ‘represent and suggest that the product will provide the same drug effects as cigarettes.’ Because plaintiff’s electronic cigarettes are to be used, like conventional cigarettes, as a means for delivering nicotine and because consumers and scientists widely believe that nicotine has drug-like effects, FDA contends that plaintiffs’ electronic cigarettes are intended to affect the structure or function of the body.<sup>6</sup> As a result, they qualify as a drug-device combination, not as a tobacco product. Put simply, this argument is bootstrapping run amok&#8230;”</p>
<p>Leon continues, “…Against this backdrop, the Tobacco Act reflects Congress’s intent to undo what it had earlier ratified. No longer will FDA lack jurisdiction over tobacco products as customarily marketed. Congress enacted the Tobacco Act to confer FDA jurisdiction over any tobacco product – whether traditional or not – that is sold for customary recreational use, as opposed to therapeutic use. As such, the Tobacco Act, in effect, serves an implicit acknowledgement by Congress that FDA’s jurisdiction over drugs and devices does not, and never did, extend to tobacco products, like electronic cigarettes, that are marketed in customary fashion for purely recreational purposes.”</p>
<p>The judge concludes, “This case appears to be yet another example of FDA’s aggressive efforts to regulate recreational tobacco products as drugs or devices under the FDCA. Ironically, notwithstanding that Congress has now taken the unprecedented step of granting FDA jurisdiction over those products, FDA remains undeterred. Unfortunately, its tenacious drive to maximize its regulatory power has resulted in its advocacy of an interpretation of the relevant law that I find, at first blush, to be unreasonable and unacceptable.”<sup>7</sup></p>
<p><strong><span style="font-size:xx-small;">Reaction</span></strong></p>
<p>The FDA issued a brief statement in response to the judge’s decision, declaring, “The public health issues surrounding electronic cigarettes are of serious concern to the FDA. The agency is reviewing Judge Leon’s opinion and will decide the appropriate action to take.”<sup>8</sup></p>
<p>The Campaign for Tobacco-Free Kids added, “If upheld, Judge Leon’s decision opens a gaping loophole in the protection FDA has provided against the sale and distribution of non-tobacco products that a manufacturer laces with unregulated quantities of nicotine. For years, the FDA has stringently regulated all products containing nicotine when sold to consumers in any form other than a traditional tobacco product because of nicotine’s dangerous and addictive impact.”<sup>9</sup></p>
<p>Ray Story, vice president of SE, said the ruling was a victory for smokers who want a safer cigarette. “The public will have a much less harmful alternative to tobacco products. Wherever they’re sold, we are going to be sold.”<sup>10</sup></p>
<p><strong><span style="font-size:xx-small;">California Actions</span></strong></p>
<p>Following the regulatory pattern of the FDA, the California Legislature has attempted to impose its own brand of restrictions on E-cigarettes. Last year, Senator Ellen Corbett (D-San Leandro) introduced SB 400, which sought to classify E-cigarettes as a drug for purposes of regulation under California’s Sherman Food, Drug, and Cosmetic Law. Governor Schwarzenegger vetoed the bill, stating, “I cannot sign a measure that also declares them a federally regulated drug when the matter is currently being decided through pending litigation. Items defined as ‘tobacco products’ are legal for anyone over the age of 18. If adults want to purchase and consume these products with an understanding of the associated health risks, they should be able to do so unless and until federal law changes the legal status of these tobacco products.”<sup>11</sup></p>
<p>On January 14, 2010, Senator Corbett introduced SB 882, a bill virtually identical to SB 400.</p>
<p>California Attorney General Jerry Brown (AG) has also sought to halt the sale of E-cigarettes. On January 13, 2010, the AG filed a lawsuit against SE which “seeks to prevent the company from selling its products until there is evidence to substantiate its claims that they are safe. The lawsuit will also require the products to display the state-mandated Proposition 65 warnings of ingredients known to cause cancer or reproductive harm and seeks to prevent the company from making false and misleading claims and promoting the products to minors.”<sup>12</sup></p>
<p>At this point it is unclear what impact Judge Leon’s ruling will have on the AG’s lawsuit. However, Ray Story of SE believes that the ruling should render this lawsuit moot. Story further stated he believes all laws barring the sale of cigarettes to minors also apply to E-cigarettes.<sup>13</sup></p>
<p><strong><span style="font-size:xx-small;">Conclusion</span></strong></p>
<p>As they consider SB 882 and any other legislation that attempts to regulate E-cigarettes, legislators may wish to consider the result of the Smoking Everywhere case as they determine whether legislation is necessary and, if it is, how to craft a bill that isn’t preempted under federal law.</p>

<p>Note: I have been corresponding with the Union Health Minister and his department on this subject since 2006. Neither the Minister nor the Ministry have any answer to these points.. Even when Dr Abdul Kalam, then President, raised the subject based on my inputs there was no sincere attempt to clarify the position. I have since then continuously educated the doctors on the subject. I have also written to the current President, Vice President, PM, Sonia, the NHRC, NCPCR, CM&#8217;s of various states, MP&#8217;s of various political parties and all the medical institutions I can think of. I have also written to the WHO, GAVI, UNICEF &#38; PATH, premier institutions that promote this highly controversial medical intervention . Doctors sympathetic to the cause opine that unless the public realise the dangers from vaccines it will be very difficult to stop this industry sponsored menace. You will agree that there should be a public debate on vaccines, otherwise the unfortunate children do not stand a chance.</p>
<p>1.There is no scientific study to determine whether vaccines have really prevented diseases. Rather disease graphs show vaccines have been introduced at the fag end of epidemics when the disease was already in its last stages. In case of Small Pox the vaccine actually caused a great spurt in the incidence of disease before public outcry led to its withdrawal.</p>
<p>2.There are no long-term studies on vaccine safety. Very short-term tests are carried out where the vaccinated subjects are checked against another group who are given another vaccine. Technically the tests should be carried out against a non-vaccinated group. No one really knows what protocols are followed at such industry-sponsored trials.</p>
<p>3.There has never been any official attempt to compare a vaccinated population against a non vaccinated population to know what vaccines are doing to the children and the society. Independent private studies (Dutch &#38; German) have revealed that vaccinated children suffer much more than their un-vaccinated counterparts.</p>
<p>4.The child receives not one but many vaccines. There are no tests to determine the effects of multiple vaccines.</p>
<p>5.There is no scientific basis for vaccinating infants. As per senior doctors quoted by the Times of India, &#8220;Children suffer from less that 2% of vaccine preventable illnesses but 98% of the vaccines are targeted towards them.&#8221; The vaccine pioneers who have recommended abundant caution before vaccinating the population have never advocated mass vaccinations.</p>
<p>6.Children are vaccinated simply because parents can be frightened to forcefully vaccinate their children. Vaccinating infants is the most profitable business both for the manufacturers as well as the doctors.</p>
<p>7.Infants, who are advised ONLY mothers milk till the age of six months and beyond because their fragile system will not tolerate anything else are given 30 extremely toxic vaccine shots, including booster doses, an act that defies both logic and science.</p>
<p>8.The Government of India has come out with a quarter page advertisement in The Hindu warning parents not to vaccinate beyond the Government approved vaccines. Parents have been advised against vaccinating in private clinics and hospitals.</p>
<p>9.The Orissa Chapter of the Indian Association of Pediatricians has admitted in a letter to the CM, Orissa, that private clinics and hospitals are ill equipped to store vaccines and warned parents not to vaccinate upon the advise of private practitioners and hospitals.</p>
<p>10.ALL THE VACCINE INGREDIENTS ARE EXTREMELY TOXIC IN NATURE.</p>
<p>11.Vaccines contain heavy metals, cancer causing substances, toxic chemicals, live and genetically modified viruses, contaminated serum containing animal viruses and foreign genetic material, extremely toxic de-contaminants and adjuvants, untested antibiotics, none of which can be injected without causing any harm.</p>
<p>12.The mercury, aluminum and live viruses in vaccines may be behind the huge epidemic of autism (1 in 10 worldwide as per doctors in the USA, 1 in 37 as per a private study by doctors in New Delhi), a fact that (vaccines cause autism) has been admitted by the US Vaccine Court.</p>
<p>13.The CDC of USA, the vaccine watchdog, has publicly admitted that its much-publicized 2003 study denying any link between vaccines and autism, is flawed. The Chief of CDC Dr Gerberding has confessed to the media (CNN) that vaccines can cause &#8220;autism like symptoms&#8221;. The Autism epidemic is found only in those countries that have allowed mass vaccinations.</p>
<p>14.In the year 1999, the US Government instructed vaccine manufacturers to remove mercury from vaccines &#8220;with immediate effect&#8221;. But mercury still remains a part of many vaccines. The vaccines with mercury were never recalled and were given to children up to the year 2006. &#8220;Mercury free&#8221; vaccines contain 0.05mcg of mercury, enough to permanently damage a infant. As per an American Academy of Pediatricians study: &#8220;Mercury in all of its forms is toxic to the fetus and children and efforts should be made to reduce exposure to the extent possible to pregnant women and children as well as the general population.&#8221;</p>
<p>15.IN INDIA NO ATTEMPT HAS BEEN MADE TO ENSURE THAT MERCURY AND OTHER HEAVY METALS ARE REMOVED FROM VACCINES SIMPLY BECAUSE IT WOULD MAKE VACCINES COSTLIER.</p>
<p>16.In a reply to then President Sri Abdul Kalam, the Health Ministry informed, &#8220;mercury is required to make the vaccines safe&#8221;. To the author&#8217;s query that &#8220;what are these vaccines that it requires the second most dangerous neurotoxin, mercury, to make them safe?&#8221;, there was no reply.</p>
<p>17.Mercury used in vaccines is second in toxicity only to the radioactive substance, Uranium. It is a neurotoxin that can damage the entire nervous system of the infant in no time.</p>
<p>18.Mercury accumulates in fat. The brain being made mostly of fat cells, most of the mercury accumulates there giving rise to the peculiar symptoms of the autistic children.</p>
<p>19.The mercury used in vaccines is ethyl mercury. According to Indian doctors this is an industrial toxin and is 1000 times more toxic than the usual methyl mercury.</p>
<p>20.The aluminum present in vaccines makes the mercury, in any form, 100 times more toxic.</p>
<p>21.As per an independent study aluminum and formaldehyde present in vaccines can increase the toxicity of mercury, in any form, by 1000 times.</p>
<p>22.As per a Tehelka article on Autism, if one considers the WHO limit for mercury in water, they are receiving 50,000 times the limit. The limits set, incidentally, are for adults and not infants.</p>
<p>23.Autism in India has emerged as the most rapidly growing epidemic amongst children. As per a private study done by doctors in New Delhi, from 1 in 500 it has steadily climbed to 1 in 37 today. As per Indian doctors, &#8220;You can go to any class of any school today and find an autistic child.&#8221;</p>
<p>24.Autism is a permanent disability that affects the child physically, mentally and emotionally. It makes the child loose social contact. It impedes both the physical and mental growth of the child. It destroys the brain causing severe memory and attention problems.The majority of symptoms displayed by autistic children match symptoms of heavy metal poisoning.</p>
<p>25.According to vaccine researcher Dr Harris Coulter, vaccines cause children to become pervert and criminal. Majority of the school shootings by the children in the USA have been committed by autistic children. Vaccines can cause more harm that even the medical community privately acknowledges.</p>
<p>26.Autistic children also suffer from severe bowel disorders. As per Dr Andrew Wakefield, this is due to the vaccine strain live measles virus in the MMR vaccine. Nearly all children become fully autistic after the MMR shot. As per a recent study the MMR vaccine has an adverse effect on the vital mucosal immune system. The very basis of trying to prevent childhood Mumps and Measles has been questioned in this study.</p>
<p>27.The DPT also causes children to regress giving rise to fears that multiple live virus vaccines are an important cause behind autism. If three live viruses can cause so much harm we can well imagine what today’s five and seven viruses vaccines will do to children.</p>
<p>28.Before the autism epidemic, it was already well known that vaccines have caused the cancer epidemic in today’s society. Both the Small Pox and the Oral Polio Vaccine are made from monkey serum. This serum has helped many cancer causing monkey viruses, 60 found so far (SV 1 to SV60), to enter the human blood stream. As per recent revelations these viruses continue to be in the vaccines.</p>
<p>29.It is also known that it is the use of green monkey serum in vaccines that has led to the transfer of the Simian Immune deficiency Virus (SIV) from monkeys into humans. The SIV and the HIV that causes AIDS are very similar.</p>
<p>30.Not only AIDS, a blood cancer in infants (Acute Lymphoblastic Leukemia) that is affecting children in thousands may also be primarily due to the extremely toxic nature of vaccine ingredients injected directly into the blood stream.</p>
<p>31.Infantile jaundice and also infantile diabetes is also scientifically connected to the toxic vaccines.</p>
<p>32.The live polio viruses used in the Oral Polio Vaccine has caused Vaccine Attributed Paralytic Polio in more than 1,25,000 children (up to the year 2006) as per doctors of the Indian Medical Association and the Jana Swasthya Abhiyan. The OPV has also let loose a new strain of polio in both India and Africa. The OPV is banned in the USA &#38; European countries.</p>
<p>33.Vaccines contain serum from not only chimpanzees and monkeys but also from cows, pigs, chickens, eggs, horses, and even human serum and tissues extracted from aborted fetuses..</p>
<p>34.Deaths and permanent disability from vaccines is very common and known by the medical community. They are instructed by the Government to keep quiet and not to associate such cases with vaccines.</p>
<p>35.Many doctors argue that diseases during childhood are due to the body exercising its immune system. Suppressing these diseases causes the immune system to remain undeveloped causing the various autoimmune disorders like diabetes and arthritis that have become epidemics today.</p>
<p>36.Vaccines suppress the natural immunity and the body does not have natural antibodies anymore. The mothers milk therefore does not contain natural antibodies and can no longer protect the child against illnesses.</p>
<p>37.By stimulating humoral (blood related) immunity alone vaccines have caused an imbalance in the whole immune set up leading to an alarming increase in auto immune disorders. This is acknowledged by the immunologists themselves.</p>
<p>38.In the USA vaccine adverse effects are recorded and the Government offers compensation of millions of dollars to victims (the most recent case in its Vaccine Court may have received upto $200 million in damages). The Indian Government simply refuses to acknowledge that vaccines can cause deaths and permanent disability.</p>
<p>39.It has been scientifically proven that vaccines cannot prevent disease. Vaccines try to create humoral (blood related immunity) whereas it has been found that immunity is developed at various levels, humoral as well as cellular. We still do not know enough about the human immune system and therefore should not interfere with it.</p>
<p>40.In the USA parents are informed about vaccine after effects and their consent has to be taken before vaccinating their children. In India the Government assures the population through massive advertising campaigns that vaccines are extremely safe. Parents refusing to vaccinate are threatened by the administration.</p>
<p>41.THERE IS NO SYSTEM OF TREATMENT TO TREAT A VACCINE DAMAGED CHILD. The parents have to run from one hospital to another. The Government turns a blind eye and refuses to even acknowledge the vaccine connection. Attempts by private practitioners worldwide to treat vaccine damaged children by flushing out heavy metals and toxins from the body have been frowned upon and discouraged.</p>
<p>42.Senior medical doctors have challenged even the vaccines recommended by the Government of India. The BCG vaccine for tuberculosis has been extensively tested in India as long back as 1961 and found to be totally ineffective. The OPV is causing polio and other neurological and intestinal disorders in tens of thousands of Indian children. The Hep-B vaccine introduced recently is not meant for children at all, it is a vaccine for a sexually transmitted disease that should be targeted only at promiscuous adults. The tetanus vaccine contains both aluminum and mercury besides the tetanus toxoid. The doctors themselves avoid giving the DPT to their children and relatives as per a survey amongst US health care professionals. The measles vaccine is a vaccine that regularly causes severe adverse effects and the health workers I have interviewed want it out.</p>
<p>43.The pediatricians are introducing dubious vaccines in India, which are being opposed by the doctors, politicians, and public in American and European countries. The Rotavirus vaccine, Hib vaccine, HPV vaccine and the various multi virus vaccines being introduced without any kind of testing is only because the vaccine manufacturers and the doctors administering them want to ensure a good income from them. They care two hoots about medical ethics and the fate of the children who will receive these vaccines. Vaccines containing nano particles and viruses and also plant based genetically modified vaccines are being opposed by honest doctors worldwide.</p>
<p>44.Various independent studies, notably the Dutch and the more recent German study, comparing vaccinated with unvaccinated children have found that vaccinated children are prone to asthma, dermatitis, allergies, hyperactivity etc. The death rate amongst vaccinated children is much more than the unvaccinated ones.</p>
<p>45.Vaccines, being a mass medical program which is accepted without question, becomes the perfect launching pad for bioterrorism. The powerful countries can spread lethal epidemics by just polluting the vaccines with bio warfare agents. The USA has handed over vaccine research to a bioterrorism research unit called the BARDA which functions under the Pentagon. A warning to this effect has been sounded by the Vice President IAP in a letter to the DGHS.</p>
<p>46.Besides &#8220;investigating&#8221; into the small pox virus, it is reported that a &#8220;weapons grade&#8221; bird flu vaccine has already been devised by the Pentagon to be used as biowarfare agents.</p>
<p>47.Vaccines have also been used to ensure population control. A batch of the tetanus vaccine has been used in many Asian countries to make the female population sterile. This was done by introducing a hormone that by inducing antibodies would abort the foetus when it is formed. In India, Saheli, a NGO fighting for the rights of women filed a PIL against this when the fact surfaced.</p>
<p>48.Mercury, a part of vaccines, is known to interfere with the endocrine system and induce sterility in both males and females.</p>
<p>49.Through a new Public Health Bill that is being drafted the Government of India is planning to introduce forced vaccinations and threaten anti-vaccination activists with steep fines and jail terms. This is obviously at the instance of foreign (read US) vaccine giants who are shifting base to India reeling at the tremendous opposition to vaccines in US and European countries. The Govt of India is planning a &#8220;vaccine park&#8221; at Chennai where these vaccine MNCs will set up base. This itself is an act of bioterrorism which ironically the proposed bill seeks to oppose.</p>
<p>50.As per the IOM, USA, vaccine research for a probable link between vaccines and autism should not be conducted. The Institute of Medicine in its last report on vaccines and autism in 2004 said that more research on the vaccine question is counterproductive: Finding a susceptibility to this risk in some infants would call into question the universal vaccination strategy that is a bedrock of immunization programs and could lead to widespread rejection of vaccines. The IOM concluded that efforts to find a link between vaccines and autism &#8220;must be balanced against the broader benefit of the current vaccine program for all children&#8221;. What does this add up to? Infants should be sacrificed in order to perpetuate an unscientific procedure?</p>

<p><strong> <span style="font-size:xx-small;">Summary</span></strong></p>
<p>University of California (UC) and California State University ( CSU) fees represent a hidden tax on middle-class students and families because 30 percent of the fee revenue is used to fund financial aid for other students. This expenditure is in addition to General Fund expenditures for Cal Grant entitlements and other aid programs for which UC and CSU families also are taxed. If student aid serves a general good, then it ought to be funded fairly by all taxpayers and transparently allocated in the annual Budget Act.</p>
<p><strong><span style="font-size:xx-small;">Middle-Class Families Pay Full Fees at UC and CSU, <em>or</em> “From Each According to His Ability”</span></strong></p>
<p>In 2010-11, resident undergraduate students at UC will pay fees of $10,302; CSU students will pay $4,429 (these are “system-wide” fees; campuses may charge additional fees). Given the fact that the state heavily subsidizes all resident students, these fees fund only a fraction of the actual cost of attendance. Nevertheless, fees represent a significant expenditure for students and their families. For many, however, these out-of-pocket costs are covered in whole or in part through student aid. In addition to federal Pell Grants, California provides aid to cover fees for more than 113,000 UC and CSU students at a cost of $765 million through the state’s Cal Grant entitlement program (which costs over $1 billion annually when community college and private college students are included). Cal Grant entitlement awards are paid to students earning up to $29,400 for an individual ($80,200 for a family of four). Those students earning more are less likely to be eligible for other aid, including work-study, and many pay full fees.</p>
<p><strong><span style="font-size:xx-small;">Middle-Class Families Pay Hundreds of Millions for Other Students, <em>or</em> “To Each According to His Need”</span></strong></p>
<p>In addition to Cal Grants, there exists another significant, though little known, source of student aid termed generically “institutional aid.” It is funded mostly through fees and allocated by the higher education institutions. UC and CSU have historically set aside a portion of student fee revenue from those who pay fees to fund financial aid for lower-income students who do not, a practice called “return-to-aid.” In 1987-88, 16 percent of new fee revenue was diverted for aid; more recently, fully 33 percent of new fee revenue has been utilized for this purpose (even more for graduate students). As the table below shows, in 2010-11, this diversion is expected to transfer nearly $1.3 billion from fee payers to other students, $772 million at UC and $486 million at CSU.</p>

<p><strong><span style="font-size:xx-small;">UC and CSU Fee Policy: A Lesson in Wealth Redistribution</span></strong></p>
<p>The California Constitution requires any tax increase to be approved by a two-thirds vote of each house of the Legislature. However, the Constitution also creates UC as a public trust governed by the Regents. CSU, alternatively, is subject to legislative direction, but in most matters is governed by the Board of Trustees. Both governing boards retain the power to charge and collect fees. Although both segments rely on the Legislature to appropriate funds for their operations, the expenditure of these funds – and fee revenues – is left largely to their governing boards. Both boards choose to allocate substantial portions of these fees not for the benefit of the fee-paying student, but to pay for the education of other students. In fact, as the table below shows, a hypothetical student who entered UC in 2007 and graduates in 2011 will have paid nearly $1,400 in extra fees – an extra tax – to further subsidize other students.</p>

<p><strong><span style="font-size:xx-small;">When a Fee is a Tax</span></strong></p>
<p>California courts have held that a nexus must exist between a fee and the governmental service funded by that fee. Certainly it is appropriate for university fees to finance a portion of the paying student’s university education, but may a third of these fees be used to pay for someone else’s education? If the people of California determine that the provision of financial aid to some students is a worthwhile public policy goal (and they have, as evidenced by Cal Grant entitlements), then it follows that “the people” – not just <em>some</em> people (namely, other students and their families) – should fund this goal. The fact is, students who pay fees for other students do not derive any special benefit from the fee diversion that the general public does not. Yet because a substantial portion of these fees are being used to support a general fund purpose much like Cal Grants, it is difficult to view this fee policy as anything but a higher education surtax.</p>
<p><strong><span style="font-size:xx-small;">Conclusion</span></strong></p>
<p>This report is not an argument against providing student aid. While it is clear that increasing funding for student aid enables universities to raise their prices, insulated as they are from the market effects of doing so, it is also clear that student aid eases access to college for some students. Nevertheless, in order to more transparently and accurately demonstrate to the public the state’s substantial investment in student aid, to more equitably share the cost of the public policy choice to provide aid, and to relieve students and families from the unseen but no less heavy burden of bearing the cost of other students’ education, the practice of “return-to-aid” should be eliminated.</p>

<p><strong><span style="font-size:xx-small;">Summary</span></strong></p>
<p>The Constitutional protections for both Proposition 42 sales tax revenues and excise tax revenues are similar with a few exceptions.  Both revenue source “uses” are protected under the Constitution and both can have the program priorities for the expenditure of the funds changed in statute.  For Proposition 42, this requires a 2/3 vote of the Legislature while excise tax only has a majority vote threshold.  Furthermore, both revenues can be borrowed for the General Fund; however, Proposition 42 borrowing has more limits pursuant to Proposition 1A of 2006 than excise tax revenues and includes interest.  Proposition 42 allows funding for transit purposes including operations, rolling stock, and capital projects; whereas, excise tax limits the use to planning, constructing, and maintaining transit/rail tracks and related facilities like stations. The following information provides additional details about the Constitutional protections provided to each transportation revenue stream.</p>
<p><strong><span style="font-size:xx-small;">Proposition 42 (Article  XIX B)</span></strong></p>
<p>Since 2002, Proposition 42 constitutionally requires that the portion of gasoline sales tax revenues that previously went to the General Fund be transferred to transportation purposes.  The funds can be used for a broad range of projects including highways, local streets and roads, and transit (including rolling stock).  Since 2007-08, 40 percent of these funds have been used for State Transportation Improvement Program (STIP) projects, 40 percent for local streets and road improvements, and 20 percent for transit purposes.</p>
<p><strong><em>Under Proposition 42, the Legislature  can change the funding allocation by a 2/3 vote.</em></strong></p>
<p>Proposition 42 allowed the transfer to be suspended under certain conditions.  Proposition 1A, passed in November 2006, limits the conditions of the transfer suspensions.  This includes a limit of twice in a ten year period and requires that any transfers to the General Fund in any given year be repaid, with interest, before another transfer could take place.  The repayment includes interest.</p>
<p><strong><span style="font-size:xx-small;">Excise Tax (Article XIX)</span></strong></p>
<p>Currently, the state has an 18 cent excise tax on each gallon of gasoline and diesel fuel.  Excise tax is protected by Article XIX of the State Constitution and restricts how state gasoline and diesel tax revenues are spent.  These monies may only be used to plan, construct, maintain, and operate public streets and highways, and to plan, construct, and maintain transit/rail tracks and related facilities like stations.  The revenues cannot be used to operate transit systems or to purchase rolling stock (trains, buses, or ferries).</p>
<p>Current law sets priorities  for expending state funds as follows:</p>
<ul>
<li>Highway maintenance and operations, and local  assistance.</li>
<li>Highway rehabilitation and safety projects in the  State Highway Operations and Protection Program.</li>
<li>Capital Improvements (including capacity expansion projects such as additional highway lanes and new transit facilities) in the State Transportation Improvement Program (STIP).</li>
</ul>
<p>Current law also sets very detailed priorities for the  expenditure of local funds.</p>
<p>The Constitution provides under Article XIX, Section 3, that the Legislature provide for the allocation of the revenues to be used for purposes of public streets and highways in a manner that ensures the continuance of existing statutory allocation formulas for cities, counties, and areas of the state until the Legislature determines that another basis for an equitable, geographical, and jurisdictional distribution exists.  <strong><em>This  allocation can be changed with a majority vote of the Legislature and  protection of local funding is uncertain.</em></strong></p>
<p>The Constitution also allows for up to 25 percent of revenues to be used by a city, county, or state to be pledged and used for the payment of principal and interest on voter-approved bonds consistent with purposes specified in the Constitution.  For purposes of the 25 percent calculation, truck weight fees may be included.</p>
<p>Furthermore, the Constitution allows for the loaning of the excise tax under certain circumstances to the General Fund.  This includes:</p>
<ul>
<li>Any amount loaned is to be repaid in full to the fund  during the same fiscal year in which the loan was made.</li>
<li>Any amount loaned is to be repaid in full to the fund from which is was borrowed within three fiscal years from the date the loan was made and one of the following has occurred:</li>
<li>The Governor has  proclaimed a state of emergency with negative fiscal impacts to the General  Fund.
<ul>
<li>The aggregate amount of General Fund revenues for the current fiscal year is less than the aggregate amount of General Fund revenues for the previous fiscal year adjusted for change in population and cost-of-living.</li>
</ul>
</li>
</ul>
<p>Funding could also be loaned to local transportation agencies, cities, counties, or cities and counties for specific purposes authorized under Article X1X.</p>
<p><strong><span style="font-size:xx-small;">Governor’s Proposal</span></strong></p>
<p>The Governor’s budget proposal intends to add an additional 10.8 cents per gallon of gasoline and diesel fuel and eliminate the sales tax on gasoline.  This excise tax will escalate over the next ten years to provide funding for debt service while continuing to fund STIP and Local Streets and Roads consistent with estimated revenues if Prop 42 sales tax on gasoline was still in effect.  Taxpayers would continue to receive a tax break over the ten year period of $.04 to $.07 per gallon in any given year.</p>
<p>The Governor’s proposal would statutorily provide funding to STIP, Local Streets and Roads, and the General Fund for debt service payments on transportation bonds.  The funding for STIP and Local Streets and Roads is consistent with Prop 42 funding although there is no Constitutional restriction to ensure that excise tax revenues be prioritized in this manner and it <strong><em>can  be changed by a majority vote of the Legislature.</em></strong></p>
<p>It should be noted that the Administration’s position is that the Constitution does not require locals to get any funding and all of excise tax could go to the Department of Transportation with proper statutory changes.   The Constitution is open to interpretation and there could be an attempt in the future to change statute and direct funds away from local entities and towards state transportation projects and debt service as seen in the 2009-10 Governor’s budget proposals.</p>

<p>SACRAMENTO, CA &#8211; Once more, Senate Republicans held the line for California families and rejected the radical universal healthcare plan that would cost Californians 222 billion dollars.  Without GOP support, Senate Bill 810 passed the Senate Floor 22-14.</p>
<p>Senate Republican pointed out the fact that Sacramento politicians who have mismanaged the state’s budget into a $21 billion deficit now want to create a DMV-style agency to issue Californians health insurance and administer your health care, unless you have a union card.</p>
<p>SB 810 would create a government-run healthcare plan that would cost $100 billion in the first six months and $222 billion a year thereafter.  This is nearly three times the state’s present general fund budget and does nothing to address our current $20 billion deficit.</p>

<p><strong>Senate Republican Leader Dennis Hollingsworth (R-Murrieta)</strong> —“The Democrats in Sacramento still don’t get it.  A government take over of people’s health care to the tune of $200 billion is utterly irresponsible.  How can the Democrats think that taxpayers are going to pay for this new government bureaucracy when they are losing their jobs and California’s government is already running amok?</p>
<p>Today, Senate Democrats in Sacramento passed a government health care plan (SB 810) that would cost $100 billion in the first six months and $200 billion-a-year thereafter and would add another $42 billion to our current $21 billion state deficit.</p>
<p>Democrats in Sacramento showed they are more interested in a government take over of people’s health care than creating new jobs and getting the economy moving again.”</p>
<p><strong>Senate Republican Leader-elect Bob Dutton (R-Rancho Cucamonga)—“</strong>It’s now clear to me that Democrat majority is merely paying lip service to making private sector job creation a priority and making the structural reforms necessary to bring state spending in line with revenues.  SB 810 will cost $200 billion to implement, restrict individual freedom and destroy countless jobs. Instead of imposing a government run health care program, lawmakers should focus on reducing wasteful state spending and boosting job creation.”</p>
<p><strong>Senator Tom Harman, Republican Whip (R-Huntington Beach)</strong> –“California already has a single payer system – in its 33 prisons.  Look what has happened there.  The costs have tripled since 2001.  This is a bad idea that California simply can’t afford.”</p>
<p><strong>Senator Sam Aanestad (R-Grass Valley)</strong> —“You don’t throw out the highest standard of healthcare in the world – which we have in California today – and where people from other countries come to get the treatment they cannot get at home.  You don’t throw it all away for this bill – which will fail in its first year and will put you (Majority Party) out of office.”</p>
<p><strong>Senator Tony Strickland (R-Thousand Oaks)</strong> —“If you like the compassion of the IRS and efficiency of the DMV then this plan is for you.  Californians do NOT want another government bureaucracy that costs almost three times the current state budget and provides limited or no choice for consumers.”</p>
<p><strong>Senator Mark Wyland (R-Carlsbad)—“</strong>To say that health care would improve under this program is simply incorrect. Countries that have adopted a so-called “single payer” plan for all health care experiences the same result: health care is rationed, there are never enough doctors, waiting times for necessary procedures from tests to surgery are long and worsen our overall health care. Further, many treatments available to Americans now would be withheld if the patient did not “qualify”, for example, if the patient were “too old”, as defined by some bureaucrat rather than the doctor. Heart patients are routinely denied surgery that is widely available in the United States. Instead, these patients often receive medication only, thus reducing their quality of life and often shortening their lives.</p>
<p>“Many other treatments, from the newest, most effective drugs to the best surgical or other treatment are also unavailable, while less effective treatments that are offered require months-long waiting times to become available.”</p>
<p><strong>Senator Dave Cogdill (R-Modesto)</strong> –“In the wake of the Massachusetts Senate election, which was fueled by voters angry about the direction our nation is headed, Congressional Democrats effectively pulled the plug on their misguided plans to overhaul our health care system.  Closer to home, California Democrats continue to demonstrate how tone deaf they are to what’s playing out on the national stage.</p>
<p>“The same government that has run its fiscal train off the cliff wants to continue to add to our mounting deficit and take away your ability to choose the health coverage that best suits your needs.</p>
<p>“Previously, Senate Republicans presented CalCare, a cost-effective, balanced and realistic approach to improve consumer choice and expand accessibility, while creating greater reliability in California’s health care system. Most importantly, it proposed to use existing dollars to care for California’s most vulnerable without raising taxes. These common-sense ideas merit attention again.</p>
<p>“Bigger government isn’t the prescription for our nation’s health care ills, but a little common sense is just what the doctor ordered.”</p>
<p>Senate Bill 810 now awaits action in the Assembly.  Senate Republicans are calling for health care reform that addresses the problems facing all Californians that addresses improved access and extends coverage without compromising patients’ quality of care.  Unfortunately, the proposal advocated by the Senate Democrats and special interests simply costs too much and benefits too few.</p>

<p><strong>State Bar Board Members Wm. Gailey, Laura Chick and  Paul Kramer are being asked to meet with Network CEO Phil Stimac and United States Attorney Joseph Russoniello to discuss two bogus disbarments. </strong></p>
<p><strong> </strong></p>
<p><strong>Both cases, involving Stimac and prominent Beverly Hills Attorney Fine, include charges of moral turpitude <!--more-->brought against them. Moral turpitude charges in such cases are inconsistent with the Bar&#8217;s stated policy as well as recent opinions rendered by the group&#8217;s officials. Neither attorneys had any prior discipline or criminal history. Both cases also involve allegations that opposing counsel and / or elite State Bar defendants tampered with the discipline system to gain an unfair advantage in pending litigation.</strong></p>
<p><strong>In addition to filing complaints against State Bar lawyers, Stimac also has one pending against Russoniello for stonewalling on his investigation of alleged federal racketeering activities by State Bar President Howard Miller and other top Bar officials.  As of this date, Office of Trial Counsel has not met with Stimac or reviewed his documents in the Russoniello disciplinary matter.<br />

<p><strong>Howard Miller and Sheldon Sloan have had a few things in common over the years.  Both served inter-locking terms on the State Bar of California&#8217;s Board of Governors.  Both men served as Presidents.</strong></p>
<p><strong>As top Bar officials they&#8217;ve rubbed elbows with each other at board meetings, on committees and at conventions. They have been active in Los Angles County legal groups and their offices are less than five minutes from each other.</strong></p>
<p><strong> Miller and Sloan also rose to power during the Post-Pete Wilson State Bar era, which began with the shutting down of the organization for nearly a year so its managerial problems could be fixed.</strong></p>

<p><strong>In face of new allegations which threatens the integrity of California&#8217;s courts and government leaders in the eyes of the nation, State Bar members are being asked to use any and all legal, legislative, media and online resources to stop the enactment of Senate Bill 55, the new State Bar Funding Bill. </strong></p>
<p><strong>At the center of the controversy is a complaint for ethical violations filed against former State Bar President Sheldon Sloan.  According to Ellen Dutton of Full Disclosure as well as other media sources, Sloan and attorney Richard Fine were opposing counsel in litigation which eventually led to Fine&#8217;s disbarment.<!--more--></strong></p>

<p><strong>&#8220;I have never met Mr. Sloan,&#8221; Network CEO Phil Stimac claims. &#8220;But like most State Bar members, I was very disturbed by what was being reported about him online and in the media. My first concern was to respect his privacy and make sure I had the facts straight. But in response to my inquiry, he simply e-mailed me back &#8220;No comment.&#8221;</strong></p>
<p><strong>&#8220;The State Bar Court&#8217;s official ruling in the Fine case was completely at odds with what was being reported.  So I asked State Bar President Howard Miller to inquire and participate in a video we are making about suspect disbarment cases, but he declined. Even when I informed him that I was trying to &#8220;bend over backwards&#8221; to simply get the facts straight in a way which was both truthful and fair to Mr. Sloan, I was instructed to remove Sloan&#8217;s name from my e-mail directory.</strong></p>

<p>&#8220;<strong>Now, I am hopeful State Bar Board Member Laura Chick will be able to use her position as a member of Govenor Schwarzenegger&#8217;s team to compel an investigation of the Fine case, prior to the Governor&#8217;s signing of SB 55.  Ms. Chick, who served as Los Angeles Controller was also named one of L.A.&#8217;s most influential citizens by <em>Los Angeles Magazine</em> in 2007.  Last year, the Governor named her as the nation&#8217;s first Inspector General of the American Recovery and Re-Investment Act.<br />
</strong></p>
<p><strong>As Los Angles Controller, Chick, like Sloan, had something to benefit by Fine&#8217;s disbarment.  In 2007, Chick told  <em>Metropolitan News-Enterprise </em>that she had &#8220;absolutely no recollection of <!--more-->any conversation with, or briefing by, the Office of the Chief Trial Counsel regarding Mr. Fine.”</strong></p>
<p><strong>&#8220;I have no reason to question Ms. Chick&#8217;s integrity or veracity,&#8221; Stimac noted, &#8220;However, the controversy behind the Fine case has escalated to the point where someone with her clout must intervene to assure State Bar members they are not being forced to fund an organization which secretly employs gestapo-like techniques against its own members. </strong></p>
<p><strong>&#8220;I am hopeful Ms. Chick will investigate,  then facilitate some kind of open public forum media event to review specific evidence which clearly indicates that bogus,  political and retaliatory in-house disbarments are being put on members by trusted State Bar officials in order to gain an unfair advantage in their own personal litigation.&#8221;</strong></p>
<p><strong>Although many State Bar members are reluctant to criticize State Bar officials and publicly come to the aid of politically targeted members like Fine, Stimac and others are developing a network which will allow them to voice their moral outrage against state bar corruption without revealing their identities.</strong></p>
<p><strong>In the meantime, he is urging all California lawyers to network, develop strategy, etc. informally at the county level.  &#8220;Time is on our side,&#8221; he noted. &#8220;We are lawyers and Americans, and like our founding fathers will answer the call.</strong></p>
<p><strong>&#8220;What an exciting time this is for all lawyers, judges, legislators, secretaries, paralegals and law students.  There is no limit to what we can and will do through the court and legislative process, as well as media and online outlets.</strong></p>
<p><strong>This is the dawn of a new awakening. The time has finally come for State Bar and our elected officials to lead, follow, or get out or our way.&#8221;</strong></p>

<p><strong>Although the State Bar of California was founded by men and women with a noble vision, many bar officials, members and their clients, the media, public and our leaders in Sacramento are now contending the group has lost its way.</strong></p>
<p><strong>With the election of Howard Miller and every State Bar President before him, promises were made, but never kept.  <!--more-->Legislation secretly made its way to the Governor&#8217;s desk which State Bar members complained was oppressive, illegal and down-right un-American.  Resolutions were passed, studies and audits conducted which ignored or whitewashed legitimate and long-standing complaints by the rank-and-file members as well as the facts giving rise to the study and audit itself.<br />
</strong></p>
<p><strong>Maybe you&#8217;ve never had a chance to stand up and tell your colleagues how you really feel about compulsory membership. After all this isn&#8217;t the Elks or Rotary where dissatisfied members can simply cancel their membership.</strong></p>
<p><strong>What about you name partners in AV rated firms.  Are you aware and does it even bother you that solo and small firm State Bar members who risk their lives and careers to preserve and protect the civil rights of your children and grandchildren in <em>pro bono</em> cases become victims of bogus and corrupt discipline.  What about other bias among the various classes of State Bar members. Perhaps you object to the secrecy in the way the State Bar is managed or unfairness in how State Bar news is reported by Daily Journal, Inc. Publications.</strong></p>

<p>The possible loss of a U.S. Senate seat in Massachusetts has Democrats on edge 3,000 miles away in California, where party activists fear a GOP upset today could trigger a conservative wave and swamp health care reform and the 2010 midterm elections.</p>

<p>&#8220;Regardless of the outcome &#8230; this should be a gigantic wake-up call to the Democratic Party &#8211; that we&#8217;re not connecting with the needs, the aspirations and the desires of real people right now,&#8221; said San Francisco Mayor Gavin Newsom.</p>
<p>With Republican Scott Brown poised to defeat Democrat Martha Coakley in the Massachusetts race to succeed the late Edward Kennedy, Democrats at the annual Martin Luther King community breakfast in San Francisco were buzzing about the impacts of such an upset: an end to the party&#8217;s 60-vote supermajority and a possible mortal blow to the health care legislation championed by President Obama.</p>
<h3>Ripple effects</h3>
<p>But Democrats also considered the ripple effects on coming elections in the nation&#8217;s most populous state.</p>
<p>&#8220;We better get our act together &#8211; and quickly,&#8221; Newsom said. Voters &#8220;are so angry. They don&#8217;t feel that we&#8217;re paying attention to their needs, in terms of their jobs, and what&#8217;s going on at the grassroots, in their neighborhoods.&#8221;</p>
<p>With just 10 months until the 2010 midterm election, the mayor&#8217;s remarks underscore how the Brown-Coakley race has set off alarms in Democratic-leaning California, which is holding two high-profile elections this cycle.</p>
<p>Sen. Barbara Boxer, a three-term Democrat, faces a re-election challenge &#8211; with three Republicans vying to defeat her: former Rep. Tom Campbell, former Hewlett-Packard CEO Carly Fiorina and Assemblyman Chuck DeVore of Irvine.</p>
<p>Boxer polled no more than 46 percent of the vote against any of the three in a Rasmussen Poll released Friday.</p>
<p>And with GOP Gov. Arnold Schwarzenegger termed out, former two-term Democratic Gov. Jerry Brown will face one of two wealthy GOP challengers: former eBay CEO Meg Whitman or state Insurance Commissioner Steve Poizner.</p>
<h3>Worse than a canary</h3>
<p>For Boxer, a favorite Republican target, a GOP win in Massachusetts would be a particularly dark sign representing &#8220;not just the canary in the coal mine,&#8221; said Wade Randlett, a leading Silicon Valley fundraiser for Obama. &#8220;It&#8217;s the flock of dead ravens landing on the lawn.&#8221;</p>
<p>But Democratic House Speaker Nancy Pelosi, speaking to reporters Monday, expressed confidence in Boxer &#8211; and in Democrats&#8217; prospects in California. She insisted that &#8211; whatever the outcome &#8211; the results today will in no way represent a repudiation of the Obama administration, especially on the matter of health care reform.</p>
<p>&#8220;Certainly the dynamics will change depending on what happens in Massachusetts,&#8221; she said. &#8220;But it doesn&#8217;t mean we won&#8217;t have a health care bill.&#8221;</p>
<p>Still, &#8220;if Brown wins, then Tea Party supporters will smell blood in California,&#8221; said Joe Wierzbicki, coordinator of the Tea Party Express, a conservative organization that counts roughly a quarter of its 353,000 supporters in California.</p>
<p>&#8220;This would be a sign that the momentum in general is in the direction of the Tea Party movement,&#8221; he said.</p>
<h3>Key differences</h3>
<p>There are, however, key differences in party demographics in the two states. While Massachusetts Democrats hold a 3-to-1 registration lead over Republicans, more than half of that state&#8217;s voters are registered independent.</p>
<p>In California, 45 percent of registered voters are Democrats, 31 percent Republicans, and 20 percent decline to state.</p>
<p>Boxer, unlike Coakley, has run three Senate races &#8211; and her office said Monday that she had raised more money than ever in the fundraising period that ended in December. (The figures are to be released today.)</p>
<p>&#8220;What happens in Massachusetts in January doesn&#8217;t predict what is going to happen in California in November,&#8221; said Boxer campaign manager Rose Kapolczynski. &#8220;We&#8217;re taking nothing for granted.&#8221;</p>
<p>But &#8220;if Brown manages to win, I certainly think that will encourage the supporters&#8221; of DeVore, the more conservative GOP Senate candidate, Kapolczynski said. &#8220;If the national Tea Party movement engaged &#8230; that could dramatically change the Republican primary.&#8221;</p>
<p>Going forward, Pelosi said Democrats will continue to pound &#8220;Main Street&#8221; issues, while Republicans will continue to represent the insurance companies, the wealthy and Wall Street.</p>
<p>American voters will be reminded &#8220;the Republicans in Congress &#8230; weren&#8217;t for Social Security, they weren&#8217;t for Medicare,&#8221; she said.</p>
<p>But Newsom said the Republican resurgence in Massachusetts suggests &#8220;there&#8217;s real intensity and fervor out there, as represented by the Tea Party&#8221; activists expressing anger at government spending and at job losses.</p>
<p>&#8220;This is real,&#8221; he said. &#8220;At our own peril, we dismiss these tea parties as &#8230; some sort of isolated extremism. &#8230; It&#8217;s not.&#8221;</p>

<p><strong>Since the Governor&#8217;s veto of Senate Bill 641, the State Bar&#8217;s 2010 funding bill, members, the media and public have come forth with evidence &#8211; lots of evidence &#8211; that the corruption in the State Bar of California is much worse than Schwarzenegger and Attorney General Brown imagined or were advised of.  Falsely accused Californians are imprisoned.  California whistleblower lawyers are disbarred. Government corruption which threatens the lives, health and careers of Californians is covered up by faceless bureaucrats, and judges who have become blinded by their own self-importance.<!--more--><br />

<p><strong>After vowing to meet the State Bar&#8217;s management problems &#8220;head-on&#8221; then claiming it had been done, State Bar President Howard Miller informed the 220,000 members he serves that Senate Bill 641 would be &#8220;re-introduced&#8221; [<em>California Bar Journal</em>, January, 2010].<br />
</strong></p>
<p><strong>Instead, Miller and the Bar&#8217;s legislative unit, which is headed up by Lobbyist Anthony C. Williams and Legislative Counsel Saul Bercovitch, secretly went to work pulling off a deceptive scheme whereby the language of  Senate Bill 55 was gutted and secretly passed by the Legislature under the guise of being an &#8220;urgency measure.&#8221; The voices of State Bar members asking for the right to be heard since Schwarzenegger&#8217;s famous caveat that the State Bar must be beyond reproach were muzzled.<br />
</strong></p>
<p><strong>This was all done with recently filed State Bar complaints pending against Williams and Bercovitch for ethical violations related to their attempts to pass a new funding bill,  cries of foul by State Bar members and Miller&#8217;s refusal to meet and address the crisis in a meaningful way as the lawyer and gentleman he purports to be. </strong></p>
<p><strong>Some might call this politics as usual. I call it fraud, suppression of evidence, obstruction of justice and <em>prima facie</em> evidence of predicate acts of federal racketeering which can only be remedied through member- initiated class action litigation. </strong></p>

<p><strong>But getting back to the issue of the day. A piece of unconstitutional and oppressive  legislation now sits on the Governor&#8217;s desk. It would be gross negligence for Attorney General Jerry Brown and the  Justice Department State Bar members he plans to pack the State Capitol with next year to advise or permit Schwarzenegger to sign it.  Such action will enslave the citizens of California in a secret government to which there will be no escape.</strong></p>
<p><strong>The lights are on you, Mr. Schwarzenegger and the cameras are beginning to roll. Please don&#8217;t make the mistake made by the Legislature and State Bar officials and think the rest of California isn&#8217;t watching. <span style="text-decoration:underline;">Let your greatness shine</span>.</strong></p>
<p><strong>California lawyers and members of the public are urged to phone, fax and e-mail Governor Schwarzenegger and Attorney General Brown and demand the veto of Senate Bill 55 based on its unconstitutionally, illegality and fraudulent passage through the Legislature.<br />

This June, California voters will be asked to consider a ballot initiative changing the way we select candidates for federal and state partisan offices.  If this initiative passes it will mean that the San Francisco Republican Party will not have candidates for partisan offices, from President down to State Assembly, general election ballots in the foreseeable future.</p>
<p></strong></strong></strong></strong><strong><strong><strong><strong>The initiative is falsely being promoted as an &#8220;open&#8221; primary, which it is not.  It is actually a top-two primary, similar to the primary system used in Washington State.  Before going any further, it is necessary to define terms.  According to the Washington State Secretary of State&#8217;s office, the top-two primary, &#8220;allows voters to choose among all candidates running for each office.  Voters do not have to declare a party affiliation to vote.  The two candidates who receive the most votes in the primary election qualify for the general election.&#8221;</p>
<p>The American Heritage New Dictionary of Cultural Literacy, Third Edition, defines an open primary as, &#8220;a type of direct primary open to voters regardless of their party affiliation.  Voters need not publicly declare their party affiliation but must vote for candidates of only one party.&#8221;</p>
<p>The key difference is that with the top two primary the two highest vote-getters to the general election regardless of party affiliation.  California currently uses a closed primary system where voters registered with their party chose their candidates (with an allowance that party&#8217;s may allow decline to state voters to participate in their primaries, which both major parties do).</p>
<p>If the top-two primary passes there will be less democracy in California.  The vigorous exchange of political thought we&#8217;re accustomed to will end.   It will silence debate between the political parties.</p>
<p>As mentioned above, in San Francisco, the Republican Party will not have candidates in general elections.  Minor parties such as Greens, Libertarians, and Peace and Freedom will also be shut out of general elections.   In races for Congress, State Senate and Assembly, we will have to choose in November between two Democrats!  That&#8217;s no choice at all.</p>
<p>In other areas of the state it will be the Democratic Party and the minor parties without candidates.   This can only lead to less interest in elections and lower voter turnout.</p>
<p>You should vote no on the &#8220;top two&#8221; election system that will appear on the June ballot.<br />

<p><span style="font-family:Arial;font-size:small;">SACRAMENTO</span><span style="font-family:Arial;"> – Assemblyman Nestande, </span><span style="font-family:Arial;">R-Palm</span><span style="font-family:Arial;"> </span><span style="font-family:Arial;">Desert</span><span style="font-family:Arial;">, today announced that he has been appointed by Speaker Karen Bass to the Eighth Extraordinary Session Budget Committee.  The committee will hold hearings and work on solutions to close the estimated $21 billion budget deficit that </span><span style="font-family:Arial;">California</span><span style="font-family:Arial;"> is currently facing.</span></p>
<p><span style="font-family:Arial;font-size:small;"> </span></p>
<p><em><span style="font-family:Arial;font-size:small;"> “The Legislature’s priority needs to be getting our fiscal house in order,” said Nestande.  “Transparency and accountability are desperately needed so we never have to face this magnitude of deficit again.  I am pleased to be appointed to this special session budget committee so we can begin working on solutions immediately.”</span></em></p>
<p><em><span style="font-family:Arial;font-size:small;"> </span></em></p>
<p><span style="font-family:Arial;font-size:small;">Nestande’s Assembly Bill 1645 and Assembly Constitutional Amendment 28 have been introduced in the regular Legislative Session and will be introduced into the budget extraordinary session as well in the next few days.</span></p>
<p><span style="font-family:Arial;font-size:small;"> </span></p>
<p><span style="font-family:Arial;font-size:small;">The Governor’s 2010-11 budget proposal forecasts that </span><span style="font-family:Arial;">California</span><span style="font-family:Arial;"> is facing an immediate $6.6 billion shortfall in the current budget year, and a projected $13.3 billion deficit next year.  In response to these projections, Schwarzenegger declared last week that </span><span style="font-family:Arial;">California</span><span style="font-family:Arial;"> was in a state of fiscal emergency and ordered the Legislature to convene an extraordinary session to address </span><span style="font-family:Arial;">California</span><span style="font-family:Arial;">’s fiscal problems. </span></p>

<p><strong>Executive Summary</strong></p>
<p>When the Governor signed the revised 2009 Budget Act in July 2009, the anticipated budget deficit for 2010-11 was $6.9 billion.  However, largely as a result of continued economic weakness and because many of the budget solutions failed to deliver the anticipated savings, the budget gap has grown to $19.9 billion ($6.6 billion in 2009-10 and $12.3 billion in 2010-11) including $1 billion for a reserve.</p>
<p>The  Governor indicates that <em>$4.9 billion</em> of solutions have been lost as a result of federal and state court decisions (e.g., In-Home Support Services program changes, sale of State Compensation Insurance Fund, and use of certain transportation funds to offset General Fund expenditures) – though there are several billion dollars more at-risk in other lawsuits that have not yet been acknowledged in this budget (i.e., state worker furloughs, use of Redevelopment Agency funds, several tax cases and Medi-Cal provider rate cases.)   In addition, increased population/caseload driven costs <em>($1.4  billion</em>) and the “erosion” or failure to achieve some of the enacted solutions <em>($2.3 billion</em>) such as the state prison and Medi-Cal savings have contributed to the increased budget gap.  Lower than anticipated revenues account for another $<em>3.4 billion</em> of the  identified budget deficit.</p>
<p>In order to generate immediate action and focus on the state budget, the Governor proclaimed a “fiscal emergency” pursuant to his Proposition 58 (2004) authority. The Proposition 58 special session requires the Legislature to send the Governor a bill addressing the fiscal emergency within 45 days or it cannot act on any other bills.  The Governor has proposed about $1.2 billion of “special session” solutions for 2009-10 that grow to nearly $7.7 billion in 2010-11 (totaling $8.9 billion).  If the legislature waits until July 1, the savings would be reduced by over $2.4 billion – that is the cost of delay.</p>
<p>The Governor’s proposed 2010-11 Budget includes a combination of major spending reductions, some fund shifts and “other” revenue increases (e.g., sale of EdFund and sale-leaseback proposals), a new category called “alternative funding” that appears to be more new revenues and fund shifts (e.g., Proposition 10 and 63 funds, add speeding violations to red light cameras, Tranquillon Ridge, Emergency Response Initiative, etc.) and a considerable expectation for new federal funds– but <strong>no new general taxes </strong>–  to make up the budgetary shortfall.</p>
