<title><![CDATA[Private dam not grandfathered from safety regs  ]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p>Because the possibility that a dam could break is a continuing risk, an old dam isn&#8217;t exempt from newer rules for dam safety. So said the Missouri Supreme Court in an <a title="State of Missouri v. Olive" href="dam-not-grandfathered-from-safety-rules-opinion_sc89752" target="_blank">opinion</a> released on May 5, 2009, reversing the ruling of a Springfield trial judge.</p>
<p>The trial judge threw out a suit filed by the Missouri Attorney General against the Olives, who had purchased a farm with an old dam on it. The suit alleged that the Olives violated the Missouri dam and reservoir safety law by failing to register the dam with the <a title="DNR page for Missouri Dam and Reservoir Safety Council" href="http://www.dnr.mo.gov/env/wrc/damsft/dam_res_council.htm" target="_blank">Missouri Dam and Reservoir Safety Council</a>, a state agency. The dam was built in 1974, five years before the dam and reservoir safety regulations went into effect.</p>
<p>Registration of a dam triggers the implementation of a safety program and requires the submittal of an as-built survey of the dam. In other words, registration is the beginning of a process that allows the Dam and Reservoir Safety Council to keep track of the dam, make requirements for maintenance and repairs, and review any proposals for modification of the dam.</p>
<p>The trial judge&#8217;s decision was based on two points<!--more-->:</p>
<ul>
<li>The Missouri Constitution forbids laws to have  a retrospective effect, so the dam was &#8220;grandfathered,&#8221; not needing to be registered.</li>
<li>The dam fit the &#8220;agricultural exemption&#8221;  from registration and safety.</li>
</ul>
<p>The Supreme Court didn&#8217;t buy either point.</p>
<p>According to the Supreme Court&#8217;s opinion, a law is retrospective in effect and unconstitutional if it</p>
<ul>
<li> takes away or impairs a vested or substantial right or</li>
<li>imposes a new obligation, duty or disability with respect to transactions or considerations already past.</li>
</ul>
<p>The dam and reservoir safety law did not require the Olives&#8217; dam to be rebuilt to current standards, but requires the dam to be maintained to protect public safety, because its &#8220;present use and its present ability to hold back substantial amounts of water is the issue,&#8221; the court said.</p>
<p>The Supreme Court also rejected the Olives&#8217; claim for an &#8220;agricultural exemption,&#8221; stating that the exemption for dams for soil and water conservation, irrigation or wildlife conservation, provided by section <a title="236.435" href="http://www.moga.mo.gov/statutes/C200-299/2360000435.HTM" target="_blank">236.435.7</a> of the Revised Statutes of Missouri, was limited to the initial construction permit requirement of section <a title="236.435" href="http://www.moga.mo.gov/statutes/C200-299/2360000435.HTM" target="_blank">236.435</a>, not the registration and safety requirements of section <a title="236.400" href="http://www.moga.mo.gov/statutes/C200-299/2360000440.HTM" target="_blank">236.440</a>.</p>
<p>&#8220;Grandfathering&#8221; doesn&#8217;t apply to matters that present continuing risks to public health and safety.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p><span style="color:#000000;">The debate over whether or not to allow undocumented students entrance into colleges across the state has been fiery topic throughout the past several years. Eliciting strong emotions from both sides of the divide, this controversy has been a back and forth battle between supporters, opponents and the school system itself.</span></p>
<p><span style="color:#000000;">Audrey Bailey, a spokesperson for the North Carolina Community College System, said that while the colleges&#8217; first objective is to educate students, the school system has felt pressure from some local parents to exclude undocumented students.</span></p>
<p><span style="color:#000000;">&#8220;We heard from many, many people with very strong opinions on both sides, but it is an extremely polarizing topic,&#8221; Bailey said. &#8220;But our feeling is that we are an educating institution and we want to educate every individual we legally can.&#8221;</span></p>
<p><span style="color:#000000;">Bailey explained that while the institutions themselves may feel this way, the decision to ban undocumented students was reaffirmed last month. Prior to the decision to close community college doors to undocumented students, the system had an open-door policy. Students who are already enrolled are &#8220;grandfathered&#8221; in and are not at risk to be kicked out if the decision to ban undocumented students stands.</span></p>
<p><span style="color:#000000;"> Bailey says that approximately 112 students will be allowed to finish their degrees through grandfathering.</span></p>

<p>A few things you need to know. </p>
<p>-The application for fosters must be notarized.  A Notary Public is on hand at Dallas Animal Services &#38; Adoption Center during normal business hours, although it would be advisable to call first to be sure someone is available.  Or you can have the application notarized elsewhere and mail it in.  Some businesses provide this service, including most banks, and UPS stores will also notarize your signature for a small fee.</p>
<p>-The foster exemption is available to those providing foster care for an organized foster care program approved by the Dallas Animal Services.  If your organization is not already approved to work with Dallas Animal Services, ask them to contact Maggie at <a href="mailto:DASRESCUE@yahoo.com">DASRESCUE@yahoo.com</a> for the appropriate forms and instructions.</p>
<p>-The Intact Animal Permit must be accompanied by the required $70 fee, micro chip number, and proof the owner is a member of a purebred dog or cat club approved by DAS or has completed a course on responsible pet ownership.</p>

<title><![CDATA[Le nuove misure ambientali dell’UE]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p class="MsoNormal">Nell’ultimo incontro di mercoledì 25 gennaio la Commissione dell’Unione Europea ha proposto una serie di nuove <span> </span>misure relative agli obiettivi che gli Stati membri dovranno raggiungere in merito all’utilizzo di fonti di energia rinnovabili e agli obblighi relativi ai permessi per inquinare.</p>
<p class="MsoNormal">La proposta della Commissione ora dovrà passare al vaglio del Parlamento Europeo e ricevere l’approvazione degli Stati membri. La proposta si basa sulla bozza già approvata marzo scorso che è conforme al <span>European Union Emission Trading Scheme, l’</span>EU ETS<span>,<span> </span>ma rispetto alle fase precedenti si propone come un salto qualitativo. L’</span> EU ETS<span> è lo strumento che l’Unione ha adottato, in fase sperimentale, a partire dal 2005, per raggiungere gli obiettivi del Protocollo di Kyoto e che proprio nel quadriennio 2008-2012 vivrà la sua fase principale. </span></p>
<p class="MsoNormal"><span>Il concetto del commercio dei permessi di emissione è legato all’idea che le aziende, acquistando i permessi per inquinare, internalizzano i costi relativi alla produzione dei beni. Per dare un idea ai non addetti ai lavori, il concetto è che chi produce, ricava un utile privato, ma scarica sulla collettività i costi legati all’inquinamento, in quanto è lo Stato che paga per i cittadini che si ammalano o per l’ambiente che si depaupera. L’economia quantifica il danno che arreca un tot di inquinamento e lo imputa alle aziende attraverso gli <em>emission permit</em>, che le aziende possono liberamente vendere fra di loro. Ci sarà, allora, chi è disponibile a pagare di più, acquistando un permesso da un’altra azienda, che in tal modo è compensata. Rispetto alla prima fase dell’</span>EU ETS, Barroso ha proposto l’abbandono del <em>grandfathering</em>; i permessi non saranno ceduti come crediti alle aziende ma saranno direttamente venduti. La preoccupazione principale sollevata delle industrie è che questi costi per le aziende rappresentino uno svantaggio competitivo rispetto ai prodotti provenienti da Paesi che non perseguono politiche ambientali di questo tipo; è ovvio che le aziende si riferiscono soprattutto all’India e alla Cina: il presidente della Commissione ha, però, garantito che la proposta prevede anche per gli importatori di beni inquinanti extra UE l’obbligo di acquistare i permessi. Ma la cura UE, al meno per le industrie, è peggiore del male. Alcuni osservatori hanno dichiarato che l’idea di imporre agli<span> </span>importatori<span> </span>i permessi può portare ad una serie di contenziosi senza fine, a causa della palese difformità con il divieto di imporre tariffe previsto nel GATT e dalla WTO: e non è un caso che il problema sia stato sollevato, ad esempio, dall’ambasciatore WTO indiano Ujal Singh Bhatia. Il diciassette gennaio la Confindustria europea, l’ERT, aveva scritto alla Commissione una lettera molto critica, soprattutto per quello che concerneva il passaggio da un sistema di libero mercato di permessi gratuiti, ad uno basato sulle aste.</p>
<p class="MsoNormal">Molte aziende, quelle inquinanti, minacciano di trasferirsi fuori l’Unione o di scaricare sui consumatori i costi relativi all’acquisto dei permessi. Cosa, fra l’altro, non nuova.</p>
<p class="MsoNormal">Gli ultraliberisti contrari ad ogni regolazione accusano l’UE di praticare delle tariffe che, seppur ambientali, sono sempre protezionistiche: l’Unione impone una tariffa del 66% sulle lampadine a risparmio energetico della Cina o del Pakistan per rendere competitive quelle della tedesca Osram, di proprietà Siemens. In realtà l’obiettivo dell’Unione è più ambizioso. La  Commissione, allo stato attuale, è consapevole del rischio <em>free riding</em> da parte degli altri Paesi; perché questo è il punto. Per intenderci, mentre l’Unione pratica delle politiche virtuose per la riduzione dell’inquinamento, gli altri ne beneficiano ma continuano ad inquinare. Solo l’azione diplomatica di un grande attore globale come l’UE può costringere gli altri Paesi ad implementare un circolo virtuoso. Ma mentre altre nazioni nicchiano, cosa potrebbe fare l’UE per salvare l’ambiente e non affossare le proprie imprese, se non praticare delle tariffe? Ma è ovvio che se l’ERT interpreta il liberalismo come un dogma al quale la realtà si debba conformare, piuttosto che una misura economica da scegliere fra varie opzioni per raggiungere un obiettivo <em>condiviso di benessere ed equità</em>, la questione non si pone ed ogni critica non è altro che una capziosa riflessione interessata.</p>
<p class="MsoNormal">Gli obiettivi UE proposti sono ambiziosi: per il 2020 le emissioni di gas serra saranno ridotte del 20% rispetto al 1990 e il 20% della nostra energia dovrà provenire da fonti di energia rinnovabili come l’eolico o il solare.</p>
