Wrongful death is a claim in common law jurisdictions against a person who can be held liable for a death. The claim is brought in a civil action, usually by close relatives, as enumerated by statute. Under common law, a dead person cannot bring a suit, and this created a legal hole in which activities that resulted in a person’s injury would result in civil sanction but activities that resulted in a person’s death would not.

The standard of proof in the United States is typically preponderance of the evidence as opposed to clear and convincing or beyond a reasonable doubt. In Australia and the United Kingdom, it is ‘on the balance of probabilities’. For this reason it is often easier for a family to seek retribution against someone who kills a family member through tort than a criminal prosecution. However, the two actions are not mutually exclusive; a person may be prosecuted criminally for causing a person’s death (whether in the form of murder, manslaughter, criminally negligent homicide, or some other theory) and that person can also be sued civilly in a wrongful death action (as in the O.J. Simpson cases). Wrongful death is also the only recourse available when a company, not an individual, causes the death of a person; for example, historically, families have tried (both successfully and unsuccessfully) to sue tobacco companies for wrongful deaths of their customers.

In most common law jurisdictions, there was no common law right to recover civil damages for the wrongful death of a person. Some jurisdictions have recognized a common law right of recovery for wrongful death, reasoning that “there is no present public policy against allowing recovery for wrongful death.” Jurisdictions that recognize the common law right to recovery for wrongful death have used the right to fill in gaps in statutes or to apply common law principles to decisions. Many jurisdictions enacted statutes to create a right to such recovery. The issue of liability will be determined by the tort law of a given state.

The party

The plaintiff is or was the patient, or a legally designated party acting on behalf of the patient, or – in the case of a wrongful-death suit – the executor or administrator of a deceased patient’s estate.

The defendant is the health care provider. Although a ‘health care provider’ usually refers to a physician, the term includes any medical care provider, including dentists, nurses, and therapists. As illustrated in Columbia Medical Center of Las Colinas v Bush, 122 S.W. 3d 835 (Tex. 2003), “following orders” may not protect nurses and other non-physicians from liability when committing negligent acts. Relying on vicarious liability or direct corporate negligence, claims may also be brought against hospitals, clinics, managed care organizations or medical corporations for the mistakes of their employees.

A plaintiff must establish all four elements of the tort of negligence for a successful medical malpractice claim.

1. A duty was owed: a legal duty exists whenever a hospital or health care provider undertakes care or treatment of a patient.
2. A duty was breached: the provider failed to conform to the relevant standard of care. The standard of care is proved by expert testimony or by obvious errors (the doctrine of res ipsa loquitur or the thing speaks for itself).
3. The breach caused an injury: The breach of duty was a proximate cause of the injury.
4. Damages: Without damages (losses which may be pecuniary or emotional), there is no basis for a claim, regardless of whether the medical provider was negligent. Likewise, damages can occur without negligence, for example, when someone dies from a fatal disease.

Like all other tort cases, the plaintiff or their attorney files a lawsuit in a court with appropriate jurisdiction. Between the filing of suit and the trial, the parties are required to share information through discovery. Such information includes interrogatories, requests for documents and depositions. If both parties agree, the case may be settled pre-trial on negotiated terms. If the parties cannot agree, the case will proceed to trial.

The plaintiff has the burden of proof to prove all the elements by a preponderance (51%) of evidence. At trial, both parties will usually present experts to testify as to the standard of care required, and other technical issues. The fact-finder (judge or jury) must then weigh all the evidence and determine which side is the most credible.

The fact-finder will render a verdict for the prevailing party. If the plaintiff prevails, the fact-finder will assess damages within the parameters of the judge’s instructions. The verdict is then reduced to the judgment of the court. The losing party may move for a new trial. In a few jurisdictions, a plaintiff who is dissatisfied by a small judgment may move for additur. In most jurisdictions, a defendant who is dissatisfied with a large judgment may move for remittitur. Either side may take an appeal from the judgment.

Expert witnesses must be qualified by the Court, based on the prospective experts qualifications and the standards set from legal precedent. To be qualified as an expert in a medical malpractice case, a person must have a sufficient knowledge, education, training, or experience regarding the specific issue before the court to qualify the expert to give a reliable opinion on a relevant issue. The qualifications of the expert are not the deciding factors as to whether the individual will be qualified, although they are certainly important considerations. Expert testimony is not qualified “just because somebody with a diploma says it is so” (United States v. Ingham, 42 M.J. 218, 226 [A.C.M.R. 1995]). In addition to appropriate qualifications of the expert, the proposed testimony must meet certain criteria for reliability. In the United States, two models for evaluating the proposed testimony are used:

The more common (and some believe more reliable) approach used by all federal courts and most state courts is the ‘gatekeeper’ model, which is a test formulated from the US Supreme Court cases Daubert v. Merrell Dow Pharmaceuticals (509 U.S. 579 [1993]), General Electric Co. v. Joiner (522 U.S. 136 [1997]), and Kumho Tire Co. v. Carmichael (526 U.S. 137 [1999]. Before the trial, a Daubert hearing will take place before the judge (without the jury). The trial court judge must consider evidence presented to determine whether an expert’s “testimony rests on a reliable foundation and is relevant to the task at hand.” (Daubert, 509 U.S. at 597). The Daubert hearing considers 4 questions about the testimony the prospective expert proposes:

* Whether a “theory or technique . . . can be (and has been) tested”
* Whether it “has been subjected to peer review and publication”.
* Whether, in respect to a particular technique, there is a high “known or potential rate of error”
* Whether there are “standards controlling the technique’s operation”.

Some state courts still use the Frye test that relies on scientific consensus to assess the admissibility of novel scientific evidence. Daubert expressly rejected the earlier federal rule’s incorporation of the Frye test. (Daubert, 509 U.S. at 593-594) Expert testimony that would have passed the Frye test is now excluded under the more stringent requirements of Federal Rules of Evidence as construed by Daubert.

In view of Daubert and Kuhmo, the pre trial preparation of expert witnesses is critical. A problem with Daubert is that the presiding judge may admit testimony which derives from highly contested data. The judge may expand the limits contained in the “school of thought” precedent. Papers that are self-published may be admitted as the basis for expert testimony. Non-peer reviewed journals may also be admitted in similar fashion. The only criterion is the opinion of a single judge who, in all likelihood, has no relevant scientific or medical training.

Many states also require that a certificate of merit before a malpractice lawsuit is filed which requires a report from a medical doctor that the doctor accused of negligence breached the standard of care and caused injury to the Plaintiff.

The plaintiff’s damages may include compensatory and punitive damages. Compensatory damages are both economic and non-economic. Economic damages include financial losses such as lost wages (sometimes called lost earning capacity), medical expenses and life care expenses. These damages may be assessed for past and future losses. Non-economic damages are assessed for the injury itself: physical and psychological harm, such as loss of vision, loss of a limb or organ, the reduced enjoyment of life due to a disability or loss of a loved one, severe pain and emotional distress. Punitive damages are only awarded in the event of wanton and reckless conduct.

In one particular circumstance, physicians, particularly psychiatrists are held to a different standard than other defendants in a tort claim. Suicide is legally viewed as an act which terminates a chain of causality. Although the defendant may be held negligent for another’s suicide, he /she is not responsible for damages which occur after the act. An exception is made for physicians. Although there exists no protocol or algorithm for predicting suicidality with any level of certainty, courts throughout the United States have found physicians to be negligent. Furthermore, damages are routinely assessed based on losses which would hypothetically accrue after the act of suicide.

Now, as Amanda tries to rehabilitate Rachel’s reputation in an effort to save her own life, she has to rely on a sister’s love and magical knowledge, and a powerful sect of witches named the Guardians to help Amanda get home safely. I give this romantic horror story five hearts. I thought it was great.

60 Votes Needed To Advance Groundbreaking Redesign of Healthcare Industry, Leaving Little Room For Error

As U.S. House members assess the political gains and losses associated with their votes on the multi-trillion dollar H.R. 3962 (the ironically named Affordable Healthcare for America Act), the U.S. Senate prepares to debate similar legislation in what Senate Majority Leader Harry Reid (D-NV) promises to be a much quicker battle. Initial voting could take place as early as Tuesday of next week. Activists on both sides, not having the official “Blue Dog” designation to guide them, have been working feverishly to identify the few perceived fence sitters that might be swayed by grassroots pressure. With successes swaying “Blue Dog” Congressmen throughout the south and elsewhere, the attention of Tea Party groups has turned to centrist, southern Democrats like Kay Hagan (D-NC). While Senator Hagan is not up for re-election until 2014, her vote on this piece of legislation will likely be a key factor in her re-election bid. Judging by the votes ultimately taken by North Carolina’s house delegation, including the last minute decision by Rep. Heath Shuler (D-NC) to oppose the bill, it has been made clear that a plurality of the people who will decide Hagan’s political fate do not support the type of reforms currently on the table.

Vince Kreul, a representative of Huntsville Tea Party, feels the tide is turning in favor of conservatives that want to see a more common sense approach to healthcare reform. “While the arm twisting of house leadership and the Whitehouse was enough to get 2 cushion votes on Saturday, the deep rift in the Democrat party was pushed into the spotlight. In the senate, Democrats don’t have 39 irrelevant votes to sacrifice in conservative districts. They must win every member of their party or the bill will never see the light of the senate floor. What this means is they will be asking red state Democrat senators to fall on their swords for an unpopular piece of legislation. While the leadership might be okay with that, those individual senators will be much more difficult to convince. Senators like Kay Hagan will likely be faced with choosing between re-election or voting for this healthcare plan.”

D.W.Griffith s-a nascut la 22 ianuarie 1875 in LaGrange, Kentucky. Este unul din cei mai importanti regizori din istoria cinematografiei, fiind cel care a inventat flashback-ul, prim-planul si cross-cutting-ul. A realizat in jur de 500 de filme printre care :

Actiunea se petrece in Anglia intr-o perioada in care chinezii nu erau prea bine vazuti(erau considerati inferori si li se spunea chinezoi-cu sens peiorativ).The yellow man(asa apare in film, nu are un nume- profu’ zicea ca treaba asta cu a nu da nume persoanjelor ar fi o chestie specifica lui Griffith) este un chinez (care de fapt nu este chinez, este un actor american machiat ca sa arate ca un chinez) care pleaca din China in Anglia pentru a transimte englezilor un mesaj de pace (ajunsese el la concluzia ca englezii sunt mai violenti). Aici el deschide un magazin de ceaiuri si other stuff like that (nu mi-am dat seama exact ce pt ca filmul era vechi -alb/negru-galben/albastru si se pixela ingrozitor). Lucy este fata unui boxer alcoolic si violent care o bate pt cea mai mica greseala(uneori si pentru vre-o greseala imaginara). Intr-o zi the yellow man o vede pe Lucy si se indragosteste de ea dar prefera sa o admire de la distanta, fara a-i marturisi dragostea lui vre-o data. Intr-o zi dupa o bataie zdravana pe care o primeste de la tatal ei, Lucy pleaca bajbaind pe strazi si ajunge in magazinul chinezului unde lesina. Acesta o ingrijeste, o primeste la el si ii ofera tot ce crede ca ar putea sa o faca fericita. M-a impresionat foarte tare respectul pe care il avea pt ea: nu indraznea sa o atinga si la un momentdat i-a sarutat maneca hainei. Dar, cum nu intotdeauna in viata lucrurile se termina cu happy-end, tatal fetei afla ca fiica lui e cu un chinez si este foarte revoltat de asta. Pandind un moment cand chinezul nu este acasa, merge, isi ia fiica inapoi si o bate pana o omoara. Cand ajunge chinezul acasa vede ca ea nu mai este, ia un pistol si pleaca acasa la tatal fetei. Cand o vede moarta si isi da seama ca tatal fetei este ucigasul si il omoara, apoi ia fata (pe care o poreclise White Blossom) si o duce acasa unde implineste pt ea o serie de ritualuri de inmormantare chineze. In cele din urma se sinucide neputand sa traiasca fara ea. Un film in care mor amandoi, un fel de Romeo si Julieta.

    Si acum sadicul din mine: bine ca nu s-a terminat cu happy-end ca si asa eram plictisita. Mie imi plac dramele si finalul m-a impresionat.

    Chiar daca comparativ cu filmele din zilele noastre este slabutz tehnic (filmul a aparut in 1915) povestea este foarte draguta. Ce nu mi-a placut: este un film mut asa ca intre scene erau presarate fundale negre cu scris-replici sau unele completari la actiune-dar erau postate in engleza aia veche cu “yer” (you) si mi-era mai greu sa inteleg ce si cum.

     Desi nu imi place sa merg la cinema o sa merg la Luna noua(twilight).Merge cineva cu mine?(preferabil la premiera).

    *o chestie sad (pe langa final)-in ultimul moment al vietii ei Lucy reuseste sa zambeasca desi tot filmul s-a fortat sa faca asta la comanda tatalui ei. Mi se pare foarte trist sa faci lucruri atunci cand e prea tarziu pt ele .

Annihilation of various employees, clients – their family, neighbors and friends as property and assets seized.

Fraudulent insurance policies;
Altered / forged insurance polices;
Altered legal documents;
Illegal distribution of assets.

I was employed by Principal Insurance – later employed by their “top agent”, Wilbert G. Swieso, CLU, ChFC. Not only did I see this pattern take place to countless victims, I was also targeted, resulting in the above fraud, suspected homicide of my family members, attempted murder of me and more. Mr. Swieso also targeted my neighbors who were left dead and/or never seen again. He is seizing control of property in order to carry out his “secret sideline” described here ===> Click: Marla

In addition to the gruesome crimes that accompany Mr. Swieso’s “secret sideline” it appears he is changing beneficiaries and distributing funds among those he recruits. New homes, vehicles, much more. Others are “planted” near his targeted victims – vultures who rob, rape and serve as “credible witnesses” that nothing took place. Once recruited, the loyalty is to Mr. Swieso.

Click on the above image to see how Principal Insurance targeted me (my family’s properties) as far back as 1982. Swieso conspired with M in hiring and having me annihilated. After serving his purpose, Mr. M. was annihilated. Same with another employee of Principal Insurance, Diane F. (From what I understand, another fraudulent insurance policy to pay off Diane’s family.) Now it appears that Mr. Swieso has recruited the current managers of Principal Insurance to cover up for him and may likely explain the escalation in death threats against me for exposing this.

Diane F. pled for help, saying she was poisoned with intent to kill. Due to her behavior while being poisoned, no help. Deceased age 39. I am saying the same thing was done to me – again, no help. I am now on “borrowed time.” Mr. M’s called me 2 wks prior to his suicide, distraught, saying I would not understand. I saw this same pattern with others – there is no doubt in my mind that Mr. M was being poisoned as well. Once a person’s credibility and reputation are destroyed, no one cares or questions the deaths. Same with the elderly, who Mr. Swieso specializes in. An outsider does not see the pattern of death that follows Mr. Swieso’s offers of “help with home repairs.” Someone is always sick / dying, often followed by more forged insurance papers and fraudulent legal documents as he cites his motto, “You can’t live for the dead.”

I learned first hand how hospitalization leaves no one home as the unauthorized reconstruction continues without the owner’s knowledge or consent. In my case, the suspected homicide of my handicapped uncle was timed to precision. That allowed Mr. Swieso to conspire in the fraudulent legal documents (appointing himself “Successor Trustee” to my family’s properties in an Irrevocable Trust) for what ensued. He also conspired with a Water District (his pension client) in a fraudulent insurance policy – stating I was THEIR employee with Mr. Swieso appointed “beneficiary.” With my final departure underway, illegal distribution of assets, as his associate told me I would be meeting the others, “in another world.”

In addition to the suspected homicide of my family, our income properties taken by fraud, stripped of a means of survival, left unemployable, robbed of all belongings; raped, poisoned, filmed with hidden cameras, pets killed and/or harmed. My siblings are lined up for execution next – they too, served their purpose. This works on a “rotation system.” It is not over until all victims are OUT – no witnesses left behind.

Wilbert Swieso talks of his German ancestry being superior to others, as he compares himself to “Hitler.” He has good reason to compare himself to Hitler – he has taken control of the entire city. What he has accomplished is beyond most people’s ability to comprehend.

Mr. Swieso is a former employee of the City of Fresno, who boasts of 50 yrs behind this operation. While conspiring with various City of Fresno and PG&E personnel, he laughs at the public for being so oblivious. He refers to city officials as nothing more than “puppets” who are too incompetent to catch or stop him. It appears that he involves them just enough ….. then behind their backs he takes things further. With altered public records to cover up the evidence of what is taking place, he says NO ONE will EVER figure it out. Secret water diversion.

In addition to being a previous employee of the City of Fresno, Mr. Swieso is a long-time insurance agent, financial consultant, Long Term Care specialist, estate planner. He has combined his expertise in these fields to create one of the most horrific operations in CA history.

Below is a description of how Mr. Swieso and his mob took over the lives, properties and assets of his victims located in Fresno’s historic Tower Dist. in order to seize control of properties to have them rebuilt on top of the secretly replaced water system.

Mr. Swieso conspired with his attorney, David A. Silva, in fraudulent legal documents appointing Swieso, “Successor Trustee” of victim’s properties that were in an IRREVOCABLE TRUST!

He conspired with nearby water district (his pension client) in a fraudulent Long Term Care policy, stating in his own handwriting that his victim (who was HIS employee at the time) was employed by the water district – appointing Swieso “beneficiary” of the life insurance portion!

Victim’s neighbor to the east was also targeted. City risk analyst lied and set him up – property torn apart and rebuilt on top of the secretly replaced water system. Parcel map altered in escrow. Signature on new deed looks like the one Swieso forged on an insurance application.

Estate attorney for the estate of murdered William Polzin was the same attorney who conspired in fraudulent legal documents for properties 100′ to the east.

Back up to the neighbor to the east, the one who was never seen again. New owner of this property lives next door to Swieso’s other partner, Jeffry Winslow, who implied elimination of his former wife and her family in order to carry this out on their properties. Click below.

Mr. Winslow accurately predicted 1 year in advance, that the neighbor to the north would have his foot amputated and die. He keeps a score card of people who have had their foot/feet amputated. Diabetics, as this neighbor was, are more susceptible to the raw sewage discharges that take place as this operation continues. Neighbor to the north also contracted hepatitis. Deceased, age 50.

Mr. Swieso conspires with property insurance agents in cancellation / non-renewal of coverage as newly-clamped water lines are loosened. Mold consumes the property; in some cases, tenant sues and ends up owning all.

What took place above, is an example of how the “path is cleared” in order for Swieso and his mob to continue the secret replacement of the city water system without leaving witnesses or complaints. “Planting” of tenants and nearby occupants; elimination of others. All properties then rebuilt without permits or inspections, on top of the replaced water system. Parcel maps are illegally altered in escrow as properties are re-sold as “original” to unsuspecting buyers. Public records show how the “planted” occupants rotate and intertwine as this operation continues throughout town.

With older records replaced with revised records, the City of Fresno claims no knowledge or responsibility for ANY of this. Despite the fact that most Fresnans know that Olive Ave. was widened, the City claims it was not. The City’s own unaltered sewer layout verifies it was indeed widened. It was done block at a time, which called no attention to the secret replacement of the water system.

The City denies relocation / reconnection of utility poles. (The easement for this one was behind the Laundromat. It is now standing where the dumpsters once did.)

The City claims that residential streets were not widened and alleys not narrowed to compensate.

The finished product. (Same block as shown in above diagrams/photos.) Not one structure standing as it was when initially built. Yet no record for any of this – only altered parcel maps and aerial views to make it appear that things were always as they are now.

This is an example of a connecting structure that was rebuilt without authorization, permits or inspections. The entire city is now setting on top of clamped lines, which property owners are held liable to maintain!

Principal Insurance condones the fraud, forgeries, burglaries, destruction of private property, real estate fraud, municipal corruption, and suspicions of much worse. Principal Insurance “feeds” their employees and clients to Mr. Swieso – the trail speaks for itself. They like all the new busine$$ Mr. $wie$o bring$ in – they are not interested in the forgeries, fraud, or welfare of their clients.

Who is paying for all of this? How is this funded? Can you imagine the money behind all the forged insurance papers and real estate theft?!?

J’ai trouvé que les frères de ma nonna lui ressemblaient beaucoup. Les maisons sont prévues pour des familles de 4 ou pour beaucoup plus. Les maisons que nous avons vu à Griffith ont presque toute une piscine car en été il fait très chaud. Je trouve les australiens très généreux et sympathiques!

Nous apprenons beaucoup de choses et nous voyons beaucoup d’animaux différents (même parfois morts au bord de la route). Nous découvrons plein de choses durant nos activités et j’ai beaucoup aimé Questacon, Healesville et rencontrer des kangourous.

Juste avant de partir de Griffith, nous avons eu un avant-goût du tout prochain festival des jardins de la ville. A cette occasion, les habitants votent pour élire le plus beau jardin du coin et les enseignes locales rivalisent d’inventivité pour présenter des sculptures faites d’oranges retenues sur des stuctures métalliques par des élastiques… trop fort…

Une des choses qui nous a surpris est la façon dont les australiens gèrent la propriété d’un terrain ou d’une maison. Si, chez nous, l’achat d’une maison engage pour plusieurs années ou dizaines d’années, ici, le changement de maison est beaucoup plus fréquent.

Wally, par exemple, nous explique qu’il a acheté une petite maison lors de son mariage. Ensuite, une fois ses deux premiers enfants nés, il acommencé à construire une nouvelle maison de ses propres mains. Ceci lui a pris 3 ans. Ils ont alors emmenagé dans la nouvelle, plus grande, et il a loué la première à un de ses ouvriers. Dans le même temps, il a récupéré trois petites maisons pour les retaper et les louer également à des backpackers (personnes de passage à Griffith qui s’arrêtent souvent pour travailler dans les vignes ou les orangeraies avant de repartir vers d’autres régions d’Australie). Les loyers sont payés chaque semaine et lui rapporte suffisamment pour avoir un revenu fixe lorsque l’exploitation ne rapporte pas assez. Son fils a également acheté une petite maison lors de son mariage. Il a aussi un morceau de terrain en ville sur lequel il planifie de construire prochainement. Lorsque la nouvelle maison sera trop petite, il la vendra probablement avec une plus-value qui lui permettra d’en construire une autre… Wally m’explique, qu’en moyenne, les australiens changent de maison tous les 7 ans…

A côté de cela, il y a l’espace… Le prix du terrain étant abordable, la majorité des maisons sont construites sur un étage… et certains peuvent s’offir deux étages… pour la frime

A l’occasion de nos périples dans les diverses familles qui composent la “famiglia”, nous avons l’occasion de partager un moment très intéressant avec deux cousins agriculteurs. Ils font pousser du riz et du blé depuis toujours dans les plaines de la région de Griffith.

Cependant, ces dernières 4 à 5 années, en raison de la sécheresse qui dure, ils se sont vus contraints de réduire le nombre de parcelles irriguées et, par conséquent, une bonne partie de leur profit. Pour “survivre”, ils exploitent 5 domaines et mettent “en eau” les parcelles pour lesquelles il leur reste un quota suffisant d’or bleu. Ils ont même dû vendre leurs moutons qui ne trouvaient plus assez d’herbe à manger.

On peut alors se demander pourquoi ils font encore pousser du riz sachant que celui-ci doit pousser dans 50 cm d’eau en permanence… et que celle-ci se fait rare… La réponse est dans le prix de cette céréale à la vente et à l’exportation… Le riz rapporte…

A part ça, nous prenons vraiment conscience du changement d’échelle durant nos 3 heures de ballades au milieu des champs immenses. Les voisins fermiers habitent à plusieurs dizaines de km les uns des autres et utilisent des machines gigantesques!

Si vous avez déjà vu des compétitions qui consistent à avaler un certain nombre de saucisses en un temps record, celle-ci encourage les participants à ingurgiter un plat de pâtes à la sauce tomate le plus vite possible… sans fourchette bien sûr! Un grand moment de raffinement et de culture locale (communauté italienne = pâtes… évidemment!). Pour info, la même compétition avait réuni des enfants juste avant

Le seul relief dans les environs de Griffith est une crête rocheuse de quelques kilomètres de long qui borde le nord de la ville. Celle-ci offre une belle perspective sur les champs d’orangers et les vignes. C’est aussi à cet endroit qu’un immigré italien s’est établi dans les années 30 et a vécu comme un hermite au milieu des rochers, construisant des terrasses pour y cultiver ses légumes et construisant des murs autour de certaines cavernes pour y cuisiner et y loger. Au début de la IIème guerre mondiale, l’homme a été interné dans un camp étant donné que sa nationalité italienne et son mode de vie particulier en faisait un suspect à surveiller.

Nous effectuons une ballade guidée avec Beckie et Tara, petites cousines d’Adrien, Laura et Eloïse. Le soleil se couche et la lune donne un aspect presque irréel à cette promenade.

Après cette petite marche, nous nous rendons chez Wendy et Craig, enseignants de mathématiques tous les deux et parents de 4 enfants, pour le premier barbecue d’une longue série! Au menu, de manière invariable : viande et poisson grillés, patates douces, quelques légumes cuits et de la salade.

Avec le retour de la chaleur (31 degrés tout de même) et de la poussière, l’atmosphère est un peu étouffante. Mais c’est un moment rêvé pour aller explorer les conditions de vie des premiers habitants de la région de Griffith. Les premiers colons se sont établis au début du XXème siècle et dès l’arrivée de l’eau dans la région (en 1913, après 6 ans de travaux importants pour creuser les canaux d’irrigation avec les moyens du bord). Les premiers immigrants italiens arrivent dans la région vers la même période de régions comme la Vénétie, la Sicile et la Calabre. Les premiers contacts avec les australiens sont assez rudes et la population italienne est mal acceptée. Encore aujourd’hui, les italiens se marient plutôt entre eux (quoique, il est encore difficile pour un italien du nord – 3ème génération tout de même – d’épouser un calabraise même si les rapports entre les anciens immigrants et les australiens se sont considérablement détendus!

Nous nous sommes promenés dans Pioneer Park qui reproduit assez bien l’allure d’un village de pionniers tel qu’il devait être dans les années qui ont précédé la première guerre mondiale.

Griffith n’aurait jamais dû devenir un jardin peuplé d’orangers, d’oliviers ou de vignes. Les premiers colons ont trouvé la terre bonne mais n’avaient pas d’eau à proximité. Ces mêmes colons ont donc détourné un rivière pour irriguer cette région. Ces travaux ont alors permis de faire verdir la terre rouge.

Nous avons fait le tour des cultures d’orangers avec Wally qui nous a expliqué les difficultés quotidiennes pour faire pousser des fruits ou des légumes sur cette terre aride, spécialement quand le salaire de ce travail va dépendre de prix fixés par d’autres (cette année, la compagnie qui achetait son raisin a décidé de ne rien lui prendre… son travail s’avère donc inutile et il se demande même s’il va continuer à irriguer ses vignes…). Nous prenons conscience du prix de l’eau quand Wally nous explique qu’il dépense 2′000 à 3′000 dollars australiens chaque année (= un peu moins d’un Fr suisse) pour simplement s’assurer que son gazon pousse devant la maison! Alors, il explique que, certaines années, il aurait avantage à vendre le quota d’eau auquel il a droit à d’autres fermiers pour gagner sa vie, et laisser sécher ses cultures! C’est là que nous réalisons que vivre en Suisse est un privilège en ce qui concerne l’accès à l’eau!

Durant toute la ballade au milieu des orangers, les arbres en fleurs dégagent un parfum enivrant… Nous passons un moment génial, au soleil… enfin. La température a repris l’ascenceur. Il fait à nouveau près de 25-30 degrés, malgré quelques nuages.

Le soir, un souper est organisé et nous avons le plaisir de rencontrer plus de 60 cousins et cousines de première, deuxième, troisième et même quatrième génération. Chacun, par son histoire, ajoute un peu de substance à notre séjour à Griffith. Lorsqu’un oncle de Patrizia me raconte son périple de 48 jours pour partir de son village natal en Italie du nord et son arrivée à Griffith, avec pour seul bagage une petite valise et un manteau, nous prenons la mesure du chemin qu’ils ont parcouru pour devenir des producteurs respectés pour leur travail dans leur nouvelle communauté.

Le jour de notre départ de Melbourne… évidemment, il fait beau et il commence à faire chaud à nouveau Nous sortons de la ville et partons vers Griffith pour 6 heures de route. Les paysages changent… de la banlieue “à l’américaine”, en passant par les prés à perte de vue, les restes de forêts brûlées, puis des paysages où l’herbe et la couleur verte cèdent leur place aux eucalyptus, épineux et terre rouge.

Cette terre rouge est de plus en plus sèche et nous constatons que les pluies abondantes que nous avons connu à Melbourne n’ont pas atteint ces contrées. Nous apprenons également à gérer la contenance du réservoir… quand on voit un écriteau marqué “next fuel station in 107 Km”… Enfin, c’est l’arrivée à Griffith… des vignes et des vergers à perte de vue… au milieu du désert.

Nous sommes accueillis chaleureusement par Sue et Wally, les cousins chez qui nous allons loger pendant la durée de notre séjour à Griffith. Nous sommes maintenant vraiment dans le “red country”!
