Section 17 of Article XI of the 1987 Constitution states:

“Section 17. A public officer or employee shall, upon assumption of office and as often thereafter as may be required by law, submit a declaration under oath of his assets, liabilities, and net worth. In the case of the President, the Vice-President, the Members of the Cabinet, the Congress, the Supreme Court, the Constitutional Commissions and other constitutional offices, and officers of the armed forces with general or flag rank, the declaration shall be disclosed to the public in the manner provided by law. ”

This obligation of a public officer or employee was also included in the provisions of RA 6713 – Code of Conduct and Ethical Standards for Public Officials and Employees under Section 8, which states:

“Section 8. Statements and Disclosure. – Public officials and employees have an obligation to accomplish and submit declarations under oath of, and the public has the right to know, their assets, liabilities, net worth and financial and business interests including those of their spouses and of unmarried children under eighteen (18) years of age living in their households.

1. Statements of Assets and Liabilities and Financial Disclosure. – All public officials and employees, except those who serve in an honorary capacity, laborers and casual or temporary workers, shall file under oath their Statement of Assets, Liabilities and Net Worth and a Disclosure of Business Interests and Financial Connections and those of their spouses and unmarried children under eighteen (18) years of age living in their households.”

The question now arises as to what value to use in determining the “net worth” of the filer? Although the SALN form provides a column for “acquisition cost” some filers do not use this column in determining their net worth.

This leads us to ask how do government determine the value of our real properties?

As far as the government is concerned, the values of our real estate assets are the values indicated in the Tax Declaration [TD] as assessed by the Assessors’ office. These are the values the government used as the amount of just compensation whenever it expropriates our real properties.

So as far as the government is concerned the net worth of a person should be the difference between the government assessed value of his/her asset and liabilities.

We all know that the value of land appreciates in time, this is the reason why the Assessors’ office revised the value of our land every three [3] years to conform to the increase of the current value of the time. So the property tax we pay increases in time.

If a SALN filer uses the acquisition cost of his/her real properties, it will remain the same over time, which when used in determining the net worth will not result to the current net worth of the filer because his/her land already appreciates in value while he/she still used the old value.

If a SALN filer uses the government assessed value of his/her land in determining the net worth of the filer, his/her net worth reflects the logical true value in current time. And this is the logic behind the used of assessed value in determining the current net worth of a filer and why it is a generally accepted practice among filers of SALN.

Take HLI as a case in point, its acquisition cost is 5M pesos, based on 1986 assessed value is around 102M pesos and in 2006 assessed value is 10B pesos. If the owner of this land is a government employee and he/she used the 5M pesos acquisition cost every time he/she files SALN does his/her SALN reflects his/her true net worth?

Based on these, who is more credible filer of SALN, the one who used the acquisition cost that remains the same over a period time or the one who used the assessed value that increases over a period time as determined by the government?

Dear Chief Justice Corona:

We, students and youth from different school, communities and progressive organizations, hereby pledge support to the farmers and farm workers of Hacienda Luisita Inc. We call for the immediate distribution of the lands to the farmers who have been working there for five decades already.

For years of the Hacienda Luisita land dispute, its farmers and farm workers have sacrificed immensely. In return, the current government has been ignoring their demands. In this light, we challenge the current Chief Justice to determine his sincerity and firmness in implementing its decision regarding the distribution of the 6,453 hectares of sugar estate to farmworker beneficiaries without just compensation for the Cojuangco’s. We also denounce the attempts of the Cojuangco-Aquino family in the continuing military harassment to the farmers of Hacienda Luisita Inc.

The living conditions of the families of the farmers have worsened as the oppressive condition continues. The farmers of Hacienda Luisita were reduced to mere “employees’’ of the vast sugar land estate who had to earn their shares of profit by working beyond their means in the plantation.  In the succeeding years, the scheme proved to be fatal for the farmer-workers as they were confronted with scarcity of job and reduced man-days because of the mechanization of the plantation and the conversion of sizable portions of land to industrial parks. The value of the shares of the farmers has been cut down to a pittance making it hardly for any farmer’s family to make both ends meet.

Concretely, we call for the following:

1. Distribute immediately and without condition the 4,915 hectares land to the legitimate farm worker-beneficiaries.
2. Revoke the Conversion order issued on the lot now claimed by RCBC as payment of the Cojuangco-Aquino to a loan acquired to the bank. Include the lot for distribution to the farm worker-beneficiaries.
3. Justice and compensation for the families of the victims of the Hacienda Luisita massacre and other related extra-judicial killings.

While the rage of crisis hits harder, it is apparent that the ‘Coronavela’ issue does not do any good to the people’s issue. The Aquino administration unceasingly intends to focus on CJ Corona Impeachment issue  and Grace Lee affair to shift the public’s attention over the regime’s deficient actions with the arising economic problems including the 13 times price hikes on oil for the first two months of 2012.

The price hikes on oil products serves as additional burden. Last year, the price hike rose 44 times summing P11.On the first two weeks of 2012, the oil price upraised its price to P2.70 per liter while only P0.80 had rolled back. LPG also elevated its price to P99/tank on the first month of this year yet the government still takes no action with this matter. Aquino appears to be playing the tall tale tactics and posture noble while directly pointing Corona as the main deterrence on convicting Arroyo.

“Kinailangan pa na umabot sa 500 na araw bago aksyunan ng gobyernong ito ang kaso ng pagpapanagot kay Arroyo. Malinaw na hindi talaga sinsero ang gubyernong Aquino sa hakbanging pagpapanagot kay Arroyo.” said Dianne Solmayor, Anakbayan NCR Spokesperson.

Aquino keeps on holding speeches concerning the impeachment issue but remains silent and without actions on existing and worsening economic issues and tone-deaf to people’s appeal.

It is clear that the issue of impeachment trial is battle of the reigning class that carries their own interests. The Corona impeachment, evidently, is not people’s fight. Aquino raises the prosecution for Corona as he plans to converse the court ruling regarding Hacienda Luisita land distribution once he placed his appointee for the position. Instead of concentrating on ‘coronavela’, there are numerous issues that must be actualize more than indulging this issue containing direct attack on Arroyo’s conviction, large-scale cases of graft and corruption, human rights violations, VFA and oil deregulation law junk and reproving sovereign interventions and social justice.

“We are challenging Corona as well as the Supreme Court to upsurge pro-people decisions doubly. Kung talagang seyoso si Corona sa desisyon ng korte, dapat ituloy ang pamamahagi ng lupa, ibasura ang oil deregulation law, ibasura ang k+12 program at VFA, at tutulan ang kontraktwalisasyon. Kasabay nito, dapat din na panagutin si Corona sa mga katiwalian at pagpapakapapet niya kay Arroyo. Malinaw na hindi makatao at anti-mamamayan  ang pagiging instrumento niya upang pigilan ang pagpapanagot kay Arroyo, maging ang mga kaso niya ng pandarambong sa kabang bayan.” She also added.

In addition, it is significant to directly appeal for Arroyo’s urgent conviction with her extensive line of cases of human rights violations, graft and corruption and electoral sabotage. Moreover, condemn the continuous domination and crises under the neoliberal policies raise by US-Aquino regime.

“Animnapu’t tatlong araw nang tumatakbo ang trial pero hanggang ngayon, malinaw na walang totoong  patutunguhan ang pagpapanagot kay Arroyo at paglilitis kay Corona. Sadyang pinapayagan ng kainutilan ni Aquino ang ganitong drama para makaligtas siya. The senate ‘Coronavela’ isn’t entertaining anymore.” She ended.#

“Mabuti bersus masama.” Ito ang balangkas ng kwentong pinalaganap ng kampo ni Pang. Benigno “Noynoy” Aquino III noong tumatakbo pa lang siya sa eleksyon. Syempre, siya umano ang mabuti at si Gng. Gloria Macapagal-Arroyo ang masama – kahit pa hindi naman siya tampok na lumaban dito. At iyan pa rin ang ginagamit ng gobyernong Aquino ngayon, sa kampanya nitong i-impeach si Chief Justice Renato Corona. Malakas na naihahatid ang mensahe, salamat sa pagsuporta sa gobyerno ng dominanteng midya.

Pero paano kung hindi na kasing-simple ng “mabuti bersus masama” ang nagaganap? Una, kung ang nagpapakilalang “mabuti” ay hindi naman talaga tumutugis sa masama? Pangalawa, kung ang todong tinutugis ng nagpapakilalang “mabuti” ay ang tauhan lang ng masama? Pangatlo, kung ang pagtugis sa tauhan ng masama ay lumalabas na hindi para papanagutin ang masama kundi para isulong ang makasariling interes? Pang-apat, kung pumapalpak ang pagtugis sa tauhan ng masama dahil sa kagagawan ng “mabuti”?

Konsistent ang gobyernong Aquino sa hindi pagtugis kay Arroyo at mga susing kasapakat nito. Sa loob ng mahigit 500 araw sa pwesto, hindi ito nagsampa ng kaso laban kay Arroyo. Napwersa lang itong magsampa nang magpilit si Arroyo na tumakas ng bansa at tumampok ang paglabag nito sa Korte Suprema sa paggigiit ng hold departure order. Matapos nitong kontrolin ang Ombudsman, pinahina ang kasong pandarambong na isinampa laban kay Arroyo, para maging simpleng graft na lang.

Kung nakakalusot ang malaking isda, paano pa ang maliit? Hindi rin naikulong ng gobyernong Aquino si Hen. Jovito Palparan, susing tauhan ni Arroyo na responsable sa mga pagpatay, pagdukot at pagtortyur. Lumalabas na pagpapakitang-gilas lang ng gobyerno ang pag-astang aarestuhin ito – para ipakitang tutugisin nito si Arroyo sa panahong itinutulak ang impeachment laban kay Corona, susing tauhan ni Arroyo. Sa gitna ng paglilitis sa impeachment, pinayagan pa rin si Arroyo sa hospital arrest.

Pero desidido ang gobyernong Aquino na tanggalin sa pwesto si Corona. Pero kung hindi pagpapanagot kay Arroyo at mga susing kasapakat nito ang layunin, ano? Syempre pa, ang pagbigwas kay Corona dahil sa desisyon ng Korte Suprema sa Hacienda Luisita. Gusto ng pamilyang Cojuangco-Aquino, at ng gobyernong Aquino, na patuloy na mapag-arian ng kasalukuyang panginoong maylupa ang Luisita. O kaya naman ay mapalaki pa ang “makatarungang kompensasyon” na hinihingi nilang kapalit.

At dahil sa kapasyahan ng gobyernong Aquino na isulong ang interes ng mga Cojuangco-Aquino sa Luisita, ginagamit nito ang buong lakas at yaman ng gobyerno laban kay Corona. Tampok ang pagratsada sa hindi-nabasang reklamong impeachment sa Kongreso – sa gitna ng usap-usapang ipinang-ipit ang pork barrel sa mga kongresista. Ang resulta tuloy, sa kabila ng pagsisikap ng mga tulad ni Bayan Muna Rep. Neri Colmenares, mahina ang kasong impeachment. Ang sabi, kahit pagkakasulat, pangit.

Sa ganitong punto mainam suriin ang pagsang-ayon ng Senado sa Korte Suprema sa inilabas ng huli na Temporary Restraining Order laban sa pagbubukas ng dollar account ni Corona. Syempre, pagsagka ito ng kampo ni Corona, at ng mga alyado ni Arroyo sa Senado, sa paglabas ng katotohanan. Dapat nang asahan iyan. Pero sa kabilang banda, resulta rin ito ng kahinaan ng prosekusyon na parang namimingwit ng ebidensya. Resulta ito, sa pangunahin, ng pagratsada ng gobyernong Aquino sa kaso.

Ngayon, pilit nagkukumpuni ang gobyernong Aquino sa kapalpakan nito sa paglilitis sa  impeachment. Bagamat hindi napatunayan ang akusasyong P100 Milyong suhol sa mga senador, itinuturo nito ang pwedeng kahantungan ng gobyerno sa desperasyon nito – sa kalagayang mahihirapang makakuha ng sapat na boto ang pag-convict kay Corona. Nariyan ang lihim na pagsiwalat sa mga deposito ni Corona sa bangko. Nariyan ang mga palabang pahayag ni Aquino – bukod pa sa todo-todong propagandang kontra-Corona.

Nitong huli, may naaamoy ang ilang komentarista: Nagluluto ba ng People Power ang gobyernong Aquino laban kay Corona? Pero ang People Power ay hindi lang ang mapayapang pagtitipon ng maraming tao sa isang lugar para sa isang panawagan. Kailangang may matibay na batayang moral ang People Power. Paano magpi-People Power laban kay Corona gayung may special treatment kay Arroyo? Ano ito, People Power para sa mga Cojuangco-Aquino? May prangkisa ba sa People Power si Aquino?

Noong Edsa 2, ang People Power ay resulta ng pagharang ng Senado sa katotohanan –na tumampok dahil malinaw ang mga ebidensya laban kay dating Pangulong Joseph Estrada. Ngayon, hindi tumatampok ang pagharang ng Senado sa katotohanan dahil hindi kasing-lakas ang mga ebidensya laban kay Corona. Sa Edsa 2, ang People Power ay pagkondena sa pagharang sa katotohanan. Ngayon, ang gusto ng gobyernong Aquino, mag-People Power para pagtakpan ang kapalpakan nito sa pagsiwalat ng katotohanan.

Pero posible pa ring mag-People Power ang gobyernong Aquino. Sampal sa mukha at kahiya-hiya para rito na dumulo ang paglilitis sa impeachment sa pagpapawalang-sala kay Corona – at sa gayo’y sa paglakas ng huli. Mabuway man ang mga batayang moral, magagamit ng gobyernong Aquino ang suporta ng dominanteng midya para palabasing “mabuti bersus masama” pa rin ang nagaganap. Hawak nito ang kabang-bayan at ang  mapanupil na kapangyarihan ng Estado. At todo-todo ang pagsuporta rito ng US.

Dalisay ang layunin ng pambansa-demokratikong Kaliwa sa pagsuporta sa impeachment ni Corona: ang tanggalin ang hadlang sa pagpapanagot kay Arroyo. Malinaw ritong iba ang layunin ng gobyernong Aquino sa impeachment. Sumusuporta man ito sa impeachment at tumutuligsa sa kampong Arroyo-Corona, tumutuligsa rin ito, lalung-lalo na, sa kampo ni Aquino. Iginigiit nito ang pagpapanagot kay Arroyo, ang pamamahagi ng Luisita sa magbubukid, at inilalantad ang mga galaw ng gobyerno.

Pinakamahalaga, tuluy-tuloy na pinapasigla ng pambansa-demokratikong Kaliwa ang mga paglaban hinggil sa mga pang-ekonomiyang isyu ng mga mamamayan – na gustong pagtakpan ng gobyernong Aquino gamit ang impeachment. Puro kontra-Corona ang tinututukan ng gobyerno, habang patuloy ito sa pagiging maka-US, maka-kapitalista at maka-asyendero sa mga isyung pang-ekonomiya ng karaniwang tao. Ang masama pa, inilulusot nito ang mga kontra-mamamayang patakaran sa silaw ng impeachment.

Sa tinatakbo ng mga pangyayari, gayunman, lalong nalalantad ang maitim na tunay na motibo, ang bruskong pambabraso, at ang kapalpakan ng kaso ng gobyernong Aquino sa impeachment. Mas malamang kaysa hindi, bubwelta rito ang mga hakbangin nito. Imbes na umani ng suporta sa pamamagitan ng impeachment, mas mahihiwalay sa mga mamamayan ang gobyernong Aquino. Mula sa dating “mabuti bersus masama,” titining na parehong masama ang naglalaban – at ang isa, todong ginagamit ang kapangyarihan.
