Like when yer heading down the Sunset Hill and you get that view of the whoooole city and all those lights and all those colors. Shit that&#8217;s awesome stoned and sober. Haha. And then you get to that flat freeway stretch again, right past the off-ramp for Lincoln Street and you look to yer left and yer pretty much driving parallel to the 6th floor of all the buildings. Where, if you veered a quickie left, you&#8217;d end up a roof ornament on top of the Conoco gas station. Dude, where else in Washington (I guess besides Seattle) can you get that? No where. Amen Spokane.</strong></p>

<p>Brazil is working hard to get access to Asian markets via ports on the Peruvian or Chilean Pacific Coast.</p>
<p>The route that seems to be progressing the least slowly is via Peru.&#160; However, environmentalist have concerns about the project since both planned route go through the Peruvian Amazon.&#160; One route plans to connect Brazil to the port of Paita on Peru’s northern coast.</p>
<p>The Chilean route, on the other hand, is projected to go via Bolivia to Arica, Chile. It would be less controversial since it would not pass through the Amazon.&#160; However, I haven’t read or heard anymore about this project since the politicians were taking it up.</p>
<p>From what I have read, transportation experts recommend building railroads.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>If you are looking for information about this famous and historic highway, known as Route 66, the Mother Road, or the Main Street of America, it&#8217;s certainly not hard to find.</p>
<p>Many people in the United States as well as other countries honor this legendary road and are a part of its continued existence through clubs or organizations which keep the spirit and road, alive.</p>
<p>According to the National Historic Route 66 Federation, entrepreneurs Cyrus Avery and John Woodruff are the individuals who deserve most of the credit for supporting the idea that this highway should be built in the first place.&#8221;</p>
<p>In the early 1900&#8217;s, the United States government realized that there was a definite need for a national highway system. Legislation for public highways first appeared in 1916 and in 1925. The result was a more comprehensive version of the act that Congress enacted.</p>
<p>In 1925, the government implemented a plan for national highway construction. Early on in the construction, the plan was to connect the main streets to the famous Route 66.</p>
<p>One of the original federal routes, Route 66, was established on November 11, 1926, and originally ran from Chicago, Illinois, through Missouri, Kansas, Oklahoma, Texas, New Mexico, Arizona, and California, ending in Los Angeles.</p>
<p>The total of miles, from start to finish totaled 2,448 miles. Highway signs, however, were not seen until the next year.</p>
<p>Eight states formed what was called, &#8220;The Route 66 Highway Association.&#8221; The purpose of the association was so that the US Highway 66 would be built faster than planned! These folks couldn&#8217;t wait for the final product! In their eyes, US 66 could not be built soon enough! Soon thereafter, the name, &#8220;Main Street of America,&#8221; was adopted.</p>
<p>This famous Mainstreet of America highway even has a song named after it, too. You may not be old enough to remember the song, but it was produced many years ago in 1946 and was a pretty popular American song. The song was composed by Bobby Troup and first recorded by the unmistakable sound of Nat King Cole in the same year. The song was both a hit on both the rhythm and blues and pop charts in the United States. You can hear this song on many of the &#8220;oldies&#8221; stations across U.S. airwaves.</p>
<p>In the song lyrics, the artist mentions the many cities that this historic legendary highway passes through (in order from east to west) such as St. Louis, Missouri; Joplin, Missouri; Oklahoma City, Oklahoma; Amarillo, Texas; Gallup, New Mexico; Flagstaff, Arizona; Winona, Arizona; Kingman, Arizona; Barstow, California; and San Bernardino, California. (According to the online encyclopedia known as Wikipedia, the city of Winona is the only town that is mentioned out of sequence in the list of cities that Route 66 passes through.)</p>
<p>Route 66 has a special place for many Americans as it really was the bread and butter for many. Many &#8220;mom and pop&#8221; stores, diners, gas stations and other small businesses that sprung up along Route 66 prospered until Interstate 40 came along and became the new main highway for travel from the Midwest to the west. This caused many of these once thriving businesses to go out of business. Some of these businesses still exist today, however, with the preservation of some parts of Route 66.</p>
<p>This famous US highway is an American historic icon. Many dreams were discovered along the famous highway 66 only to be shattered many years later with the demise of this famous highway. There are so many emotions tied to the Mother Road.</p>
<p>Big dreams, hope, shattered dreams, love and entrepreneurship, are a sampling of what this highway meant to people who not only built the road, but those whose businesses sustained because of the famous highway.</p>
<p>After the highway was replaced by Interstate 40, there were those who felt like a part of them had died after they had traveled on it for many years and for so many (what seemed) endless miles.</p>
<p>The story of the Mother Road, Route 66, or the Main Street of America is a story of success as well as defeat. Nevertheless, US Highway 66 had become a part of the early business advancements. It allowed many entrepreneurs to be able to transport their goods in fast fashion like never before, certainly better than any of the best dirt roads that existed previously.</p>
<p>There has never been such a relationship with a road and automobiles that involved so many people who wanted to move west to explore the awaited possibilities of financial success.</p>
<p>Whether you remember the legendary stretch of highway as the main artery that folks traveled on from the Midwest to the west or not, doesn&#8217;t matter. To many, this famous highway is just as alive as it was when it was considered the Mother Road or Main Street of America.</p>
<p>This historic road is still very much alive today. The legendary information about the historic highway that you will find will astound you.</p>
<p>To many peoples satisfaction, it is still possible to travel on America&#8217;s first roadway. You can experience the highway along with many of the roadside attractions that still exist today, such as the little diners along the way. There are guided tours that you can purchase online to assist you if you decide to make a mini-vacation out of your Route 66 road trip.</p>
<p>You can find photos of the famous highway, shop for Route 66 products and have no difficulty finding just about anything! Facts and history about the Mother Road, or the Main Street of America, as it is commonly referred to as, are likely to impress any history buff. There are other parts of the United States, other than the state of Arizona, where you can visit this world famous road!</p>

<p>Let’s begin at the beginning. As I’ve well established I’m a bit of an agoraphobic. HATE new experiences, crowds, highway driving, being in over crowded public places…new experiences…</p>
<p>Thursday as the time gets closer for my adventure; I’m well and truly panicked. What am I to wear? How do I get to the theater? I can’t eat because my stomach is torn apart. For the first time I can remember I’m so freaked out I literally broke out in HIVES. I had blotches all over my face, chest, arms and legs.</p>
<p>I finally decide to dress in gray slacks and a mauve bell sleeved sweater with black patent leather Mary Janes. As I’m trying to get dressed, the hives are itchy welts, my hands are shaking, my palms are sweaty, my head is killing me and I just want to curl into a ball and die. I would much rather fight a pair of grizzly bears in a packed rattlesnake den, surrounded by webs filled with black widow spiders than do this…</p>
<p>I’m trying to fix my hair and pull out my curling iron—which I have set at molten lava. I discover this because as I’m trying to lightly curl my bangs the rod slips in my sweating palms and leaves a huge burn across my forehead. Fortunately, my limp bangs cover it.</p>
<p>Putting on makeup proves to be a challenge as I can’t get my contacts in my eyeballs and am forced to wear my glasses. I can’t see to apply evening’s war paint and grab my bronzer instead of my pressed powder.</p>
<p>Ever seen the movie Bride Wars? Remember the traffic cone scene? Yeah…</p>
<p>I try to apply mascara and jab myself in the eye.</p>
<p>DH has sweetly made dinner, which I am unable to eat.</p>
<p>I take the directions, load DD into the truck and we start off down the highway. I’m smoking like a chimney trying to calm my frazzled nerves. The highway I need to take has been closed for the last two years due to construction. Needless to say the directions aren’t helpful—fortunately I had the forethought to print up alternate route maps—YAY me!</p>
<p>The alternate route has me taking a LEFT handed freeway exit. And immediately upon landing on new interstate I need to be in the RIGHT lane as my exit is…<em>righthere</em>! No one is a polite driver, they’re all whizzing by, honking at the fruitcake in the pickup.</p>
<p>Screw it says I, I’m older, bigger and have more insurance—I grab the bull by the balls and tear over to the lane I need to be in. A Prius decides discretion is the better part of valor and stops so I can get in without incident.</p>
<p>We arrive and find a nearby lot completely wide open. We’ve arrived over 75 minutes EARLY. GREAT…</p>
<p>We find a nice little restaurant, enter and order hot chocolate.</p>
<p>Have I mentioned I DO NOT LIKE NEW EXPERIENCES??? I’ve never set foot in this establishment before and am very nervous as there is a huge line out the door and the place looks like the White Rabbit’s house after Alice eats the magic button…</p>
<p>It takes them fifteen minutes to make the hot chocolate, we don’t have silverware and the hot chocolate wasn’t mixed properly. So at the bottom of the empty mugs is this HUGE clump of cocoa mix begging to be eaten—and me without a spoon.</p>
<p>DD and I begin chatting about her grades and how much she loves Russian and French. She tells me that she is planning on automotive technology for a career (major?) with a minor in languages or psychology.</p>
<p>Then she further discusses an elementary experience in which Mrs. (_insert name here_) teached her…</p>
<p>I glance up. “She <em>teached </em>you?”</p>
<p>“Yeah. In third grade.”</p>
<p>“She <em>teached </em>you?” I emphasize… &#8220;I’m glad you can speak Russian because English you’re not so great at.”</p>
<p>She bursts out laughing. “Taught. I meant taught…”</p>
<p>We finish our cocoa and our wonderful hour catching up on the week then bundle up to brave the cold and cross to the theater. Our seats are in the nose bleed section. To get there we must climb what seems like fifteen hundred flights of steps…or we can ride up five floors in the metal box of death.</p>
<p>After three flights of steps, I opt for the metal box of death. We pack into said box with no room for oxygen, which has me white knuckling the brass banister that runs the middle section of the metal box of death.</p>
<p>We arrive on the fifth floor and are escorted to our seats&#8230;Which are situated on aisles that only a mountain goat can navigate. (Did I mention my fear of heights?) So we pack into these tiny little seats, I suffer vertigo as I try to figure out how I’m going to watch the performance without passing out and tumbling down to the bottom. Fortunately I’m…plump, I’d bounce…</p>
<p>As the lights dim I glance around and want to scream. I had spent part of the day stressing over appropriate dress only to find people in our section wearing jeans and comfortable tops.</p>
<p>However, I think the three people seated behind us were in the wrong theater. They were dressed for a Marilyn Manson concert rather than the ballet—but I digress. (They were friends of DD&#8217;s) I was so proud she decided to dress nicely!</p>
<p>I’m sitting here getting swept away by the music and realize nature is demanding I attend personal business. CRAP! Intermission is three scores away…that works to my benefit. I’ve had to wear pantyhose under my slacks because the material irritated my hives. So I have to do a strip tease in order to answer nature’s call.</p>
<p>By the time I’m coming out and climbing the three flights of steps back to the upper balcony, Intermission has begun so I hurry and take my seat while the crowds pass me by.</p>
<p>I was pleased that in our section were only 10 total seats…and only eight people seated in them so I had room to breathe. I was able to sit with my back to the wall and my front to an aisle so that also assisted with my breathing issues.</p>
<p>After the ballet i was introduced to her Russian teacher, a lovely Ukranian lady who couldn&#8217;t stop bragging on my daughter&#8217;s talent for languages&#8211;suggesting she consider a career as an Interpreter! How my DD is the student of her heart, how sweet and wonderful my child is and how much she adores my girl. Tell ya, it did my heart proud! I guess I&#8217;ll keep her around for a while longer after all&#8230;</p>
<p>I float back to the truck thinking okay made a right onto this side street and a right into the parking lot so I make a left then another left at the light&#8230;unfortunately the intersection is a NO LEFT TURN intersection. So I&#8217;m left driving about an unfamiliar part of the city. Suddenly I sdee my road ahead! YAY! Which way do I turn? Left or right? DD says left&#8230;my gut says right. I make the right. DD looks up and says good thing you didnt listen to me&#8230;we&#8217;d have ended up back at the theater&#8230;</p>
<p>On the way home we stop at Taco Bell because by this point I&#8217;m ravenous. They screwed up my order but I was just too tired to fight&#8230;took the chow home and pulled out the Tchaikovsky CD to let DD listen to.</p>
<p>As i reflect on the performance I realize my only question is…aside from being awed by the beautiful and talented people twirling on the stage, I was supposed to get a story out of that?!?!?! I heard the beautiful compositions by Tchaikovsky and was entranced by the beautiful, agile dancers but seeing a story line? Not so much…</p>
<p>The brightest spot to the entire experience? Watching my daughter’s face as she viewed the <a href="http://www.fabulousfox.com/" target="_blank">Fox Theater </a>for the very first time.</p>
<p>It was hell and I’d rather crawl on my hands and knees through broken glass then swim in a tank full of great whites…but being with my baby girl…now THAT was worth it all.</p>
<p>Now she wants to go to see <em>Wicked</em> in June&#8230;I have 6 months to get ready for this outing…where’s that pit?</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Well it is here. The traffic, the accidents, and tow trucks galore! It&#8217;s how I know it&#8217;s the holiday season. That and there is always some new latte at Starbucks. This year it&#8217;s gingerbread. They may still have pumpkin spice, too. Anyway, I left my house at 6:50a.m. and go to school at 8:10a.m. An hour and twenty minutes for a trip that took 15 minutes at most with traffic. 275 North was packed and every mile or so there was another accident.</p>
<p>I kinda wish I had my Chevy Blazer again. It had 4-wheel drive, which made traversing the snow and sleet covered ground a bit easier. Though, I wish I had ANY car. My stupid Taurus blew up on me. Refer to the previous blog post for more details, if you&#8217;d like.</p>
<p>Snow is nice though. Makes me think of Christmas and Charlie Brown specials. Good times.</p>

<title><![CDATA[Pakistan - Day 1]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p>I’m teaching at a leadership summit in Rattanabad, Pakistan, this week.  It’s my first trip to the country, and it has been an unfamiliar experience already.</p>
<p>It began when I got off the plane.  I was met by two men, holding a sign with my name on it.  I didn’t know at the time, but these men were airport security and a customs agent.  They had been sent by my hosts to whisk me through the immigration process and customs.  I was bringing 60 Bibles with me, and my host did not want any problems with the customs agents.</p>
<p>The two men said a few words, offered a handshake and occasionally a hug to each official we met, and I bypassed lines and interrogations.  At Immigration, they took me through one of the “Pakistan Visa” desks so that I didn’t have to wait in the “Foreign Visa” line.  At the luggage carousel, they had a man ready to lift and stack all 200 lbs of my luggage on a trolley (60 hard-cover Bibles are quite heavy).  At customs, one man ran interference with the uniformed agents while the other man led me out to meet my host.</p>
<p>It was all very efficient.  If only I could take these guys with me everywhere I go…</p>
<p>The car ride from Karachi to Rattanabad is about three hours down unlit <span style="text-decoration:line-through;">highways</span> deathtraps equipped with every kind of hazard you can think of…pot holes, uneven surfaces, pedestrians, rickshaws, own-the-road weaving commuter buses and high-beam-blazing oncoming traffic.  I found that it was easier on the nerves to just try to sleep through it, but my host was quite good-natured and chatty and kept me engaged in conversation for the better part of the ride.</p>
<p>Halfway there, we stopped at a McDonalds (because McDonalds has obviously done what no king or conqueror could manage and completed its conquest of the world).  I have never seen a place so busy!  There were easily 250 men, women and children present – half of them in the mosh pit that turned out to be the space where people ordered their food.  There was no semblance of a line.  People just mushed together as closely as they could, and the one who could get his money closest to the order-taker got served next – even if he was three rows back.</p>
<p>My presence attracted more than its fair share of curious stares, since I was the only large, white man in this particular restaurant, but my celebrity status was not enough to get us a table.  We tried to get help finding a spot but then gave up and ate outside, where it was surprisingly peaceful.  From this vantage point, I watched the chaos inside.   Twenty women were tightly packed into the McDonalds Play Place watching four children in the tubes.  Either the children were a fascinating watch or the mothers were excellent conversationalists.  I couldn’t tell which.  And where the hundreds of other children weren&#8217;t in the tubes also, I can&#8217;t tell you.  I assumed that these must have been the four children of a high-level diplomatic official, who forced all the mothers to serve as body guards for his kids.</p>
<p>Two of my new friends ate something called a “McArabia,” which looks like a pita sandwich.  They couldn’t believe that we didn’t have these in the U.S. or Thailand.  When everyone was done, we all loaded back into the car, and I willed myself to go to sleep in anticipation of the death-defying stunts we would do on the last hour of our journey.  I made it in one piece to a nice dorm-type building, where I’ll be staying and teaching over the next few days.  I’m hoping for more out-of-the-ordinary stuff for my next blog post.</p>

Put 1800 dollars worth of new brakes into it. Then it died. One of the rods in the casing shattered, and left plumes of white, awful smelling, smoke pouring from my hood and a temperature gauge screaming in the red.</p>
<p>I broke down on I 71-75 North. In rush hour traffic. On the left side of the highway while driving to a job. Can you say FML? I know I can.</p>

(a) Except as provided in subdivision (b), whenever reckless driving of a vehicle proximately causes bodily injury to a person other than the driver, the person driving the vehicle shall, upon conviction thereof, be punished by imprisonment in the county jail for not less than 30 days nor more than six months or by a fine of not less than two hundred twenty dollars ($220) nor more than one thousand dollars ($1,000), or by both the fine and imprisonment. (b) A person convicted of reckless driving that proximately causes great bodily injury, as defined in Section 12022.7 of the Penal Code, to a person other than the driver, who previously has been convicted of a violation of Section 23103, 23104, 23105, 23109, 23109.1, 23152, or 23153, shall be punished by imprisonment in the state prison, by imprisonment in the county jail for not less than 30 days nor more than six months or by a fine of not less than two hundred twenty dollars ($220) nor more than one thousand dollars ($1,000) or by both the fine and imprisonment.</p>
<p>	When a Police or CHP Officer, or a Sheriff’s Deputy states in his or her report either that the primary collision factor in an auto accident was one party’s violation of a certain vehicle code section such as the one above, and that one of the parties is at fault for violating that code section, the Officer or Deputy is stating what he or she believes to be the underlying cause of the accident.  </p>
<p>	The reason insurance companies treat the collision reports as if they are admissible evidence is that they know if put on the witness stand, the investigating officer or deputy will almost always testify in a manner consistent with the conclusions in his or her report.  That testimony becomes evidence and will often sway a jury in their determination of fault for an accident.</p>
<p>	While an investigating officer’s job is to determine if there was a violation of the law and not to determine who should be at fault in a civil dispute such as a car accident claim, insurance companies often view these two determinations as one and the same.</p>
<p>	A police officer assigned to investigate the scene of an accident does not have the role that a trier of fact does in a courtroom.  The officer is not there to render a verdict and determine who is responsible for the damages.  Rather, the officer is there to determine if any laws were broken.   The officer makes such a determination based on his or her having seen the damage to the vehicles, and having spoken to the drivers and the witnesses when their memories are freshest.  He or she is thus often in a position to make a well-educated determination of who caused the accident.</p>
<p>	Unfortunately, despite the experience of most investigating officers who are dispatched to the scene of an accident, sometimes mistakes are made by these officers.  Quite often one or both parties to an accident will lie to them and an officer or deputy will not always be able to determine which of the parties is telling the truth.  The evidence from the scene, while important, may also be misleading as to what actually occurred to cause the accident.</p>

<p>	Sometimes an Officer or Deputy cannot determine with any degree of certainty which party was at fault and will cite two possible Vehicle Code Sections, one for each party in a two-party collision, that may have been violated.  In that case, the Police or CHP Officer or Deputy will often state that the primary collision factor is unknown.</p>
<p>	Even if there are witnesses to an accident, the Officer of Deputy may discount the statements of some or all of the witnesses if they were friends or relatives of one of the drivers.</p>
<p>	Although, as stated above, the conclusion of fault by an officer or deputy does not carry the same weight as a determination of fault by a judge or jury, the importance of the citation of this or any other California code section in the police report is that insurance companies treat the conclusions in these traffic collision reports in a great majority of cases as if the conclusions were written in stone and evaluate a party’s claim based on the findings of fault in these reports.</p>
<p>	A traffic collision report may be amended by the police department or the CHP where it contains obvious mistakes, such as when the officer or deputy has mixed up the names of the parties.  Supplemental reports are sometimes written when new evidence comes to light, such as when a hit and run party is located.  But for the most part, most police departments, Sheriff’s offices and the California Highway Patrol will not amend a report when a party complains and states why he or she doesn’t feel they should have been found at fault for a collision.  They will, however, in most cases allow a person to fill out a Counter Report, which, unfortunately simply does not carry much weight with an insurance company.</p>
<p>	If the Primary Collision Factor for an accident is unknown, one should look on the traffic collision report to see if the Police or California Highway Patrol Officer or Sheriff’s Deputy cited any “Other Associated Factors” in the traffic collision report as having had a role to play in causing the collision.  There may have been faulty equipment, as with some truck accidents, or the roadway itself may have been dangerous.</p>

<p>	California Vehicle Code Section 20002 provides:</p>
<p>20002. (a) The driver of any vehicle involved in an accident resulting only in damage to any property, including vehicles, shall immediately stop the vehicle at the nearest location that will not impede traffic or otherwise jeopardize the safety of other motorists. Moving the vehicle in accordance with this subdivision does not affect the question of fault. The driver shall also immediately do either of the following: (1) Locate and notify the owner or person in charge of that property of the name and address of the driver and owner of the vehicle involved and, upon locating the driver of any other vehicle involved or the owner or person in charge of any damaged property, upon being requested, present his or her driver&#8217;s license, and vehicle registration, to the other driver, property owner, or person in charge of that property. The information presented shall include the current residence address of the driver and of the registered owner. If the registered owner of an involved vehicle is present at the scene, he or she shall also, upon request, present his or her driver&#8217;s license information, if available, or other valid identification to the other involved parties. (2) Leave in a conspicuous place on the vehicle or other property damaged a written notice giving the name and address of the driver and of the owner of the vehicle involved and a statement of the circumstances thereof and shall without unnecessary delay notify the police department of the city wherein the collision occurred or, if the collision occurred in unincorporated territory, the local headquarters of the Department of the California Highway Patrol. (b) Any person who parks a vehicle which, prior to the vehicle again being driven, becomes a runaway vehicle and is involved in an accident resulting in damage to any property, attended or unattended, shall comply with the requirements of this section relating to notification and reporting and shall, upon conviction thereof, be liable to the penalties of this section for failure to comply with the requirements. (c) Any person failing to comply with all the requirements of this section is guilty of a misdemeanor and, upon conviction thereof, shall be punished by imprisonment in the county jail not exceeding six months, or by a fine not exceeding one thousand dollars ($1,000), or by both that imprisonment and fine. </p>

<p>	California Vehicle Code Section 20001 provides:</p>
<p>20001. (a) The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004. (b) (1) Except as provided in paragraph (2), a person who violates subdivision (a) shall be punished by imprisonment in the state prison, or in a county jail for not more than one year, or by a fine of not less than one thousand dollars ($1,000) nor more than ten thousand dollars ($10,000), or by both that imprisonment and fine. (2) If the accident described in subdivision (a) results in death or permanent, serious injury, a person who violates subdivision (a) shall be punished by imprisonment in the state prison for two, three, or four years, or in a county jail for not less than 90 days nor more than one year, or by a fine of not less than one thousand dollars ($1,000) nor more than ten thousand dollars ($10,000), or by both that imprisonment and fine. However, the court, in the interests of justice and for reasons stated in the record, may reduce or eliminate the minimum imprisonment required by this paragraph. (3) In imposing the minimum fine required by this subdivision, the court shall take into consideration the defendant&#8217;s ability to pay the fine and, in the interests of justice and for reasons stated in the record, may reduce the amount of that minimum fine to less than the amount otherwise required by this subdivision. (c) A person who flees the scene of the crime after committing a violation of Section 191.5 of, or paragraph (1) of subdivision (c) of Section 192 of the Penal Code, upon conviction of any of those sections, in addition and consecutive to the punishment prescribed, shall be punished by an additional term of imprisonment of five years in the state prison. This additional term shall not be imposed unless the allegation is charged in the accusatory pleading and admitted by the defendant or found to be true by the trier of fact. The court shall not strike a finding that brings a person within the provisions of this subdivision or an allegation made pursuant to this subdivision. (a) The regulations adopted under Section 34501 for vehicles engaged in interstate or intrastate commerce shall establish hours-of-service regulations for drivers of those vehicles that are consistent with the hours-of-service regulations adopted by the United States Department of Transportation in Part 395 of Title 49 of the Code of Federal Regulations, as those regulations now exist or are hereafter amended. (b) The regulations adopted under Section 34501 for vehicles engaged in intrastate commerce that are not transporting hazardous substances or hazardous waste, as those terms are defined by regulations in Section 171.8 of Title 49 of the Code of Federal Regulations, as those regulations now exist or are hereafter amended, shall have the following exceptions: (1) The maximum driving time within a work period shall be 12 hours for a driver of a truck or truck tractor, except for a driver of a tank vehicle with a capacity of more than 500 gallons transporting flammable liquid, who shall not drive for more than 10 hours within a work period. (2) No motor carrier shall permit or require a driver to drive, nor shall any driver drive, for any period after having been on duty for 80 hours in any consecutive eight days. (3) A driver employed by an electrical corporation, as defined in Section 218 of the Public Utilities Code, a gas corporation, as defined in Section 222 of that code, a telephone corporation, as defined in Section 234 of that code, a water corporation, as defined in Section 241 of that code, or a public water district as defined in Section 20200 of the Water Code, may be permitted or required to drive more than the number of hours specified in subdivision (a) while operating a public utility or public water district vehicle during the emergency restoration of service. (4) Any other exceptions applicable to drivers assigned to governmental fire suppression and prevention, as determined by the department. (5) A driver employed by a law enforcement agency, as defined in Section 390.3(f)(2) of Title 49 of the Code of Federal Regulations, as that section now exists or is hereafter amended, during an emergency or to restore the public peace. (c) The regulations adopted under Section 34501 for vehicles engaged in the transportation of farm products in intrastate commerce shall include all of the following provisions: (1) A driver employed by an agricultural carrier, including a carrier holding a seasonal permit, or by a private carrier, when transporting farm products from the field to the first point of processing or packing, shall not drive for any period after having been on duty 16 hours or more following eight consecutive hours off duty and shall not drive for any period after having been on duty for 112 hours in any consecutive eight-day period, except that a driver transporting special situation farm products from the field to the first point of processing or packing, or transporting livestock from pasture to pasture, may be permitted, during one period of not more than 28 consecutive days or a combination of two periods totaling not more than 28 days in a calendar year, to drive for not more than 12 hours during any workday of not more than 16 hours. A driver who thereby exceeds the driving time limits specified in paragraph (2) of subdivision (b) shall maintain a driver&#8217;s record of duty status, and shall keep a duplicate copy in his or her possession when driving a vehicle subject to this chapter. These records shall be presented immediately upon request by any authorized employee of the department, or any police officer or deputy sheriff. (2) Upon the request of the Director of Food and Agriculture, the commissioner may, for good cause, temporarily waive the maximum on-duty time limits applicable to any eight-day period when an emergency exists due to inclement weather, natural disaster, or an adverse economic condition that threatens to disrupt the orderly movement of farm products during harvest for the duration of the emergency. For purposes of this paragraph, an emergency does not include a strike or labor dispute. (3) For purposes of this subdivision, the following terms have the following meanings: (A) &#8220;Farm products&#8221; means every agricultural, horticultural, viticultural, or vegetable product of the soil, honey and beeswax, oilseeds, poultry, livestock, milk, or timber. (B) &#8220;First point of processing or packing&#8221; means a location where farm products are dried, canned, extracted, fermented, distilled, frozen, ginned, eviscerated, pasteurized, packed, packaged, bottled, conditioned, or otherwise manufactured, processed, or preserved for distribution in wholesale or retail markets. (C) &#8220;Special situation farm products&#8221; means fruit, tomatoes, sugar beets, grains, wine grapes, grape concentrate, cotton, or nuts. </p>

<p>	California Vehicle Code Section 27360.5 provides:</p>
<p>27360.5. (a) No parent or legal guardian, when present in a motor vehicle, as defined in Section 27315, may permit his or her child or ward who is six years of age or older, but less than 16 years of age, or who is less than six years of age and weighs 60 pounds or more to be transported upon a highway in the motor vehicle without properly securing the child or ward in an appropriate child passenger restraint system or safety belt meeting applicable federal motor vehicle safety standards. (b) No driver may transport on a highway any child who is six years of age or older, but less than 16 years of age, or who is less than six years of age and weighs 60 pounds or more in a motor vehicle, as defined in Section 27315, without properly securing the child in a child passenger restraint system or safety belt meeting applicable federal motor vehicle safety standards. This subdivision does not apply to a driver if the parent or legal guardian of the child is also present in the vehicle and is not the driver. (c) (1) A first offense under this section is punishable by a fine of one hundred dollars ($100), except that the court may reduce or waive the fine if the defendant establishes to the satisfaction of the court that he or she is economically disadvantaged, and the court, instead, refers the defendant to a child restraint education program that includes, but is not limited to, demonstration of the proper installation and use of child passenger restraint systems for children of all ages, and provides economically disadvantaged families with a child passenger restraint low-cost purchase or loaner program. Upon completion of the program, the defendant shall provide proof of participation in the program that includes an inspection of a child passenger restraint system that meets applicable federal safety standards. If an education program on the proper installation and use of a child passenger restraint system is not available within 50 miles of the residence of the defendant, the requirement to participate in that program shall be waived. If the fine is paid, waived, or reduced, the court shall report the conviction to the department pursuant to Section 1803. The court may, at its discretion, require any defendant described under this section to attend an education program that includes demonstration of proper installation and use of child passenger restraint systems and provides certification to the court that the defendant has presented for inspection a child passenger restraint system that meets applicable federal safety standards. (2) A second or subsequent offense under this section is punishable by a fine of two hundred fifty dollars ($250), no part of which may be waived by the court, except that the court may reduce or waive the fine if the defendant establishes to the satisfaction of the court that he or she is economically disadvantaged, and the court, instead refers the defendant to a community education program that includes, but is not limited to, education on the proper installation and use of child passenger restraint systems for children of all ages, and provides certification to the court of completion of that program. Upon completion of the program, the defendant shall provide proof of participation in the program. If an education program on the proper installation and use of a child passenger restraint system is not available within 50 miles of the residence of the defendant, the requirement to participate in that program shall be waived. (3) Fifteen percent to the city, to be deposited in its general fund except that, if the violation occurred in an unincorporated area, this amount shall be allocated to the county for purposes of paragraph (1). </p>

(a) A parent or legal guardian, when present in a motor vehicle, as defined in Section 27315, may not permit his or her child or ward to be transported upon a highway in the motor vehicle without properly securing the child or ward in a rear seat in a child passenger restraint system meeting applicable federal motor vehicle safety standards, unless the child or ward is one of the following: (1) Six years of age or older. (2) Sixty pounds or more. (b) (1) A driver may not transport on a highway a child in a motor vehicle, as defined in Section 27315, without properly securing the child in a rear seat in a child passenger restraint system meeting applicable federal motor vehicle safety standards, unless the child is one of the following: (A) Six years of age or older. (B) Sixty pounds or more. (2) This subdivision does not apply to a driver if the parent or legal guardian of the child is also present in the vehicle and is not the driver. (c) (1) For purposes of subdivisions (a) and (b), and except as provided in paragraph (2), a child or ward under the age of six years who weighs less than 60 pounds may ride in the front seat of a motor vehicle, if properly secured in a child passenger restraint system that meets applicable federal motor vehicle safety standards, under any of the following circumstances: (A) There is no rear seat. (B) The rear seats are side-facing jump seats. (C) The rear seats are rear-facing seats. (D) The child passenger restraint system cannot be installed properly in the rear seat. (E) All rear seats are already occupied by children under the age of 12 years. (F) Medical reasons necessitate that the child or ward not ride in the rear seat. The court may require satisfactory proof of the child&#8217; s medical condition. (2) A child or ward may not ride in the front seat of a motor vehicle with an active passenger airbag if the child or ward is one of the following: (A) Under one year of age. (B) Less than 20 pounds. (C) Riding in a rear-facing child passenger restraint system. (d) (1) (A) A first offense under this section is punishable by a fine of one hundred dollars ($100), except that the court may reduce or waive the fine if the defendant establishes to the satisfaction of the court that he or she is economically disadvantaged, and the court, instead, refers the defendant to a community education program that includes, but is not limited to, education on the proper installation and use of a child passenger restraint system for children of all ages, and provides certification to the court of completion of that program. Upon completion of the program, the defendant shall provide proof of participation in the program. If an education program on the proper installation and use of a child passenger restraint system is not available within 50 miles of the residence of the defendant, the requirement to participate in that program shall be waived. If the fine is paid, waived, or reduced, the court shall report the conviction to the department pursuant to Section 1803. (B) The court may require a defendant described under this section to attend an education program that includes demonstration of proper installation and use of a child passenger restraint system and provides certification to the court that the defendant has presented for inspection a child passenger restraint system that meets applicable federal safety standards. (2) (A) A second or subsequent offense under this section is punishable by a fine of two hundred fifty dollars ($250), no part of which may be waived by the court, except that the court may reduce or waive the fine if the defendant establishes to the satisfaction of the court that he or she is economically disadvantaged, and the court, instead, refers the defendant to a community education program that includes, but is not limited to, education on the proper installation and use of child passenger restraint systems for children of all ages, and provides certification to the court of completion of that program. Upon completion of the program, the defendant shall provide proof of participation in the program. The county or city health department shall designate a coordinator to facilitate the creation of a special account and to develop a relationship with the court system to facilitate the transfer of funds to the program. The county or city may contract for the implementation of the program. Prior to obtaining possession of a child passenger restraint system pursuant to this section, a person shall attend an education program that includes demonstration of proper installation and use of a child passenger restraint system. (B) As the proceeds from fines become available, county or city health departments shall prepare and maintain a listing of all child passenger restraint low-cost purchase or loaner programs in their counties, including a semiannual verification that all programs listed are in existence. Each county or city shall forward the listing to the Office of Traffic Safety in the Business, Transportation and Housing Agency and the courts, birthing centers, community child health and disability prevention programs, county clinics, prenatal clinics, women, infants, and children programs, and county hospitals in that county, who shall make the listing available to the public. The Office of Traffic Safety shall maintain a listing of all of the programs in the state. (2) Twenty-five percent to the county or city for the administration of the program. (3) Fifteen percent to the city, to be deposited in its general fund except that, if the violation occurred in an unincorporated area, this amount shall be allocated to the county for purposes of paragraph (1). </p>
<p>	When a Police or CHP Officer, or a Sheriff’s Deputy states in his or her report either that the primary collision factor in an auto accident was one party’s violation of a certain vehicle code section such as the one above, and that one of the parties is at fault for violating that code section, the Officer or Deputy is stating what he or she believes to be the underlying cause of the accident.  </p>

<p>	California Vehicle Code Section 24002 provides:</p>
<p>24002. (a) It is unlawful to operate any vehicle or combination of vehicles which is in an unsafe condition, or which is not safely loaded, and which presents an immediate safety hazard. (b) It is unlawful to operate any vehicle or combination of vehicles which is not equipped as provided in this code.</p>
<p>	When a Police or CHP Officer, or a Sheriff’s Deputy states in his or her report either that the primary collision factor in an auto accident was one party’s violation of a certain vehicle code section such as the one above, and that one of the parties is at fault for violating that code section, the Officer or Deputy is stating what he or she believes to be the underlying cause of the accident.  </p>
<p>	The reason insurance companies treat the collision reports as if they are admissible evidence is that they know if put on the witness stand, the investigating officer or deputy will almost always testify in a manner consistent with the conclusions in his or her report.  That testimony becomes evidence and will often sway a jury in their determination of fault for an accident.</p>
<p>	While an investigating officer’s job is to determine if there was a violation of the law and not to determine who should be at fault in a civil dispute such as a car accident claim, insurance companies often view these two determinations as one and the same.</p>
<p>	A police officer assigned to investigate the scene of an accident does not have the role that a trier of fact does in a courtroom.  The officer is not there to render a verdict and determine who is responsible for the damages.  Rather, the officer is there to determine if any laws were broken.   The officer makes such a determination based on his or her having seen the damage to the vehicles, and having spoken to the drivers and the witnesses when their memories are freshest.  He or she is thus often in a position to make a well-educated determination of who caused the accident.</p>
<p>	Unfortunately, despite the experience of most investigating officers who are dispatched to the scene of an accident, sometimes mistakes are made by these officers.  Quite often one or both parties to an accident will lie to them and an officer or deputy will not always be able to determine which of the parties is telling the truth.  The evidence from the scene, while important, may also be misleading as to what actually occurred to cause the accident.</p>

<p>	Sometimes an Officer or Deputy cannot determine with any degree of certainty which party was at fault and will cite two possible Vehicle Code Sections, one for each party in a two-party collision, that may have been violated.  In that case, the Police or CHP Officer or Deputy will often state that the primary collision factor is unknown.</p>
<p>	Even if there are witnesses to an accident, the Officer of Deputy may discount the statements of some or all of the witnesses if they were friends or relatives of one of the drivers.</p>
<p>	Although, as stated above, the conclusion of fault by an officer or deputy does not carry the same weight as a determination of fault by a judge or jury, the importance of the citation of this or any other California code section in the police report is that insurance companies treat the conclusions in these traffic collision reports in a great majority of cases as if the conclusions were written in stone and evaluate a party’s claim based on the findings of fault in these reports.</p>
<p>	A traffic collision report may be amended by the police department or the CHP where it contains obvious mistakes, such as when the officer or deputy has mixed up the names of the parties.  Supplemental reports are sometimes written when new evidence comes to light, such as when a hit and run party is located.  But for the most part, most police departments, Sheriff’s offices and the California Highway Patrol will not amend a report when a party complains and states why he or she doesn’t feel they should have been found at fault for a collision.  They will, however, in most cases allow a person to fill out a Counter Report, which, unfortunately simply does not carry much weight with an insurance company.</p>
<p>	If the Primary Collision Factor for an accident is unknown, one should look on the traffic collision report to see if the Police or California Highway Patrol Officer or Sheriff’s Deputy cited any “Other Associated Factors” in the traffic collision report as having had a role to play in causing the collision.  There may have been faulty equipment, as with some truck accidents, or the roadway itself may have been dangerous.</p>
