Utah filmmaker fasts for days to raise funds for film

SALT LAKE CITY — A Utah filmmaker is literally starving for his art; the man fasted for 12 days to raise funds for and generate interest in his new movie.

Richard Dutcher directed the films “God’s Army,” “Brigham City,” “Falling” and others, but he said independent filmmaking isn’t what it was just a few years ago.

“The market place has just crashed,” he said. “It’s very difficult for an independent filmmaker to make a film any more or to make money making a film.”

Dutcher’s latest project is called “The Boys at the Bar,” and he said he needs about $30,000 to make the film. With only 21 days remaining in his fundraising campaign, Dutcher made a decision that would prove hard to stomach: He decided to go on a hunger strike.

“This film, if I had been able to fund it myself I would have, but that’s not possible,” he said. “And as a result it was a great learning experience for the 23 student producers to go out and raise the money for it, and these guys are starving artists. And I’m barely not starving. I’m a barely not starving artist.”

Dutcher fasted for 12 days and lost 23 pounds before he called off the fast for health reasons. Dutcher said he’s glad he put himself through the ordeal.

Yeah it was worth it,” he said. “Did we make much money from the project this way? I don’t think so, but it brought some notice to the film.”

A speech by Billy Butterworth of the CWU in solidarity with communication workers in the Philippines. After more than ten years of waiting for the Supreme Court’s decision on their claim to be recognized by the Company, the Highest court finally decided the case in favor of recognizing the Digitel Employees Union. Digitel, which is 100% owned by PLDT, instead of obeying the order and start a collective bargaining negotiations with the DEU, closed the company and declared all the employees redundant. The DEU decided to put up a protest center in front of the Head quarters of PLDT. Some of the sacked workers have been on hunger strike.

More than 100 of the 166 detainees at Guantanamo are starving themselves to death. Twenty-three of them are being force-fed. “They strap you to a chair, tie up your wrists, your legs, your forehead and tightly around the waist,” Fayiz Al-Kandari told his lawyer, Lt. Col. Barry Wingard. Al-Kandari, a Kuwaiti held at Guantanamo for 11 years, has never been charged with a crime.

“The tube makes his eyes water excessively and blood begins to trickle from the nose. Once the tube passes his throat the gag reflex kicks in. Warm liquid is poured into the body for 45 minutes to two hours. He feels like his body is going to convulse and often vomits,” Wingard added.

The United Nations Human Rights Council concluded that force-feeding amounts to torture. The American Medical Association says that force-feeding violates medical ethics. “Every competent patient has the right to refuse medical intervention, including life-sustaining interventions,” AMA President Jeremy Lazarus wrote to Defense Secretary Chuck Hagel. Yet President Barack Obama continues the tortuous Bush policy of force-feeding hunger strikers.

FLASHBACK: Pangilinan: PLDT, Digitel will remain separate entities

MANILA, Philippines – Amid questions about the P69.2 billion deal between Philippine Long Distance Telephone Co. (PLDT) and Digitel, the phone giant’s chair Manuel Pangilinan stressed that the two will remain separate entities and will not require congressional approval.

“We will keep Digitel as a separate company. This is not a merger. We will keep it distinct and separate from PLDT,” Pangilinan said on Thursday.

Pangilinan added that PLDT did not just pay for the assets of Digitel, but its brand as well.

“It will be kept as a brand because we are paying for it. We are paying for the assets, the business and most importantly the equity significant of the brand,” he said. “We will keep Digitel as a company and DMPI (Digitel Mobile Philippines Inc.), which owns the Sun Cellular brand name, as a company and more importantly as a brand. It will not disappear.”

Questions about the deal revolve mostly around issues of a “monopoly” given the large market share of both Smart Telecommunications and Sun Cellular, the respective mobile units of PLDT and Digitel.

While lawmakers and consumer groups have raised the need for a congressional approval for the deal, PLDT has found an ally in Senate President Juan Ponce Enrile.

On Thursday, Enrile said PLDT did not violate any anti-trust laws. “We have an anti-trust law in the Revised Penal Code but it is a dead law,” he said. “Without a law, there’s no crime committed.”

He also said there’s no need to ask Congress for another franchise for the merger because both PLDT and Digitel already have their own franchises.

Malacañang has also ordered an investigation of the PLDT-Digitel deal to ensure that “a level playing field” is maintained.

‘Unlimited’ services

Lawmakers and consumer groups are also worried that PLDT may stop offering the “unlimited” or bucket offerings for text and call services of Sun Cellular.

Pangilinan said their clients need not worry about this as they will continue to offer these “unli” services.

“The fear that we will stop unli and bucket pricing schemes are unfounded. So we are prepared to make a formal commitment to the government, to the NTC (National Telecommunications Commission)… we will maintain the unli services and bucket pricing of Sun Cellular,” Pangilinan said.

He notes that they are also willing to put this promise in writing.

PLDT will file with the NTC next week its application to approve the deal, Pangilinan said.

Better broadband service in 3 years

Pangilinan cited another commitment that PLDT is prepared to make. “Our goal is to provide broadband connectivity to 95% of the population within 3 years.”

“The transaction structure is quite simple. Questions such as ‘Will consumers’ welfare, if not enhance, be protected as a result of the combination? Well, there’s nothing to fear. If government wants us to make a commitment in that direction then we will,” said Manuel V. Pangilinan, PLDT chairman.

President Aquino said the other day that his economic team, the Department of Justice, and the National Telecommunications Commission (NTC) will review the deal as concerns on whether the PLDT-Digitel tandem will kill competition and result in the removal of unlimited telco services were raised by many sectors.

In reaction to this, Pangilinan said, “It’s warranted for the government to take a look at it. In any event, we will file an application for approval before the NTC. So, they are taking the right step on that regard. There’s nothing wrong with that.”

But the telco executive said there is no need for them to secure Congress approval. “We don’t believe so. Though the franchise of Digitel by itself does carry that provision wherein congressional approval is needed for any transfer of control. But there are supervening laws that negate that. Under the RA 7925, it says there that there’s an exemption if a privilege is given to another telco or whatever benefit is given to another telco and that telco’s franchise benefit from it,”

Red Mobile, lay-offs

But Pangilinan could not make the same commitment on whether or not it will continue the operation of Red Mobile, a unit of Smart Communications Inc. which caters to the low-end market.

“We will have to evaluate that. That has got to be observed. We won’t know that yet until after the closing,” he said.

Between now and June, PLDT will also review if there is a need to let go some of Digitel employees. He assured the Gokongwei family that PLDT will not replace 20 executives of Digitel.

Frequencies

PLDT is formally launching the Long-Term Evolution (LTE) technology or the 4G next month. Smart chief wireless advisor Orlando Vea said the cellular firm has enough frequencies to launch the next generation service which promises faster internet connectivity speed.

Pangilinan, Vea and TV5 president Ray Espinosa said PLDT is utilizing all of its frequencies so therefore Globe Telecom should not make any statements about the possibility of divestiture of frequencies by the NTC.

“That one we don’t understand. It’s as if our frequencies are not being used. Why do you want something that we are using? If they need it then they should apply for it,” said Pangilinan.

The PLDT-Digitel tandem give the PLDT group a huge advantage over frequency allocation, having cornered big chunks of the bandwidth for 3G (third generation, wireless broadband, and GSM (global system for mobile communications).

For 3G, the PLDT group’s total frequency is 35 Megahertz (Mhz). These are

15Mhz of Smart Communications Inc.
10Mhz of Cure (Connectivity Unlimited Resources Inc.), which Smart had acquired from Cure owners,
10Mhz of Digitel

On the other hand, second-liner Globe Telecom only has 10Mhz.

For Wimax, touted as the next generation after 3G, the Pangilinan-led phone firm has a total of 45Mhz while Globe has 35Mhz.

For cellular, PLDT holds 37.5 Mhz but when combined with Digitel the phone giant would have a total of 47.5Mhz. Globe only has 20Mhz.

صندوق الزمالة به فائض مليار و 200 مليون جنيه طبقا لتصريح النقابة :
الفلوس دي فين و في بنك ايه و عوائدها و استثارها ازاي و بعدين من خدماتها 50%
دعم للحج و العمرة حد استفاد بالخدمة دي و او سمع ان حد استفاد منها … الصندوق ده دخله السنوي لا يقل عن مليار جنيه ….
…….مطلوب رفع مكافأة الصندوق إلى 25 ألف و زيادة سنوية 5% ……………
صندوق التأمين الخاص لأعضاء نقابة المهن التعليمية صندوق الزمالة “
نبذة تاريخية
تم إنشاؤه في بداية عام 1992 وبدأ الصرف بواقع 20 شهرا للمعلم عند الإحالة إلي المعاش و25 شهرا لحالات الوفاة والعجز الكلي و 5, 12 شهرا لحالات العجز الكلي
- وفي عام 1997 تم رفع قيمة ما يخصم من المعلم من 2% إلي 7 % علي أن الصرف اعتبارا من 1 / 1 / 1997 بواقع 30 شهرا في حالة الإحالة إلي المعاش أو الوفاة أو العجز الكلي و 15 شهرا في حالة العجز الجزئي
- وفي 1 / 1 / 1998 تم التعديل إلي 32 شهرا للإحالة للمعاش والوفاة والعجز الكلي و16 شهرا للعجز الجزئي وبحد أقصي 13000 جنيه
- وفي 1 / 1/ 2003 تم التعديل إلي 34 شهرا للإحالة علي المعاش والوفاة والعجز الكلي و17 شهرا للعجز الجزئي وبحد أقصي 13000 جنيه
- توصية الجمعية العمومية 2004 يرفع قيمة الصرف إلي 35 شهرا بحد أقصي 15000 جنيه
- ويقوم صندوق الزمالة بدعم رحلات العمرة والحج بواقع 50 %

تاريخ التأسيس: 1 / 11 / 1991
تاريخ التسجيل: 25 / 1 / 1993
أولا: الاشتراكات
1- اشتراك شهري 7% من المرتب الأساسي
2-قيمة نسبة 5%من أصل الحصيلة الشهرية لمجموعات التقوية المدرسية
3- رسم انضمام للصندوق كالآتي:
أ) جنيهان لعضو نقابة المهن التعليمية الذي يعمل بوزارة التعليم
ب) عشرة جنيهات لعضو نقابة المهن التعليمية الذي لا يعمل بوزارة التربية والتعليم
في حالة الإعارات والأجازات بدون مرتب يقوم العضو بسداد الاشتراكات المحددة طبقا لهذا النظام مقدما سنويا وفي حالة التأخير يحصل ريع استثمار سنوي من تاريخ الاستحقاق حتى تاريخ الأداء يعادل تكلفة الفرصة البديلة

وزير التربية والتعليم اصدر قرار وزارى بتصفية مرحلة التعليم الاعدادى المهنى على مستوى الجمهورية وقد بداء من الان ونتيجة اهذا القرار سيتم تشريد اكثر من 250000 طالب سنويا ليكونوا نواة خصبة للبلطجة والمخدرات والارهاب وهم فى سن حرجة مابين 12 و15 سنة سيكون مصيرهم الشارع تخيل هذا الرقم وهذا السن ممكن يحصل اية ليهم لما يلقوا بالشارع

نبذة تاريخية
تم إنشاؤه في بداية عام 1992 وبدأ الصرف بواقع 20 شهرا للمعلم عند الإحالة إلي المعاش و25 شهرا لحالات الوفاة والعجز الكلي و 5, 12 شهرا لحالات العجز الكلي
- وفي عام 1997 تم رفع قيمة ما يخصم من المعلم من 2% إلي 7 % علي أن الصرف اعتبارا من 1 / 1 / 1997 بواقع 30 شهرا في حالة الإحالة إلي المعاش أو الوفاة أو العجز الكلي و 15 شهرا في حالة العجز الجزئي
- وفي 1 / 1 / 1998 تم التعديل إلي 32 شهرا للإحالة للمعاش والوفاة والعجز الكلي و16 شهرا للعجز الجزئي وبحد أقصي 13000 جنيه
- وفي 1 / 1/ 2003 تم التعديل إلي 34 شهرا للإحالة علي المعاش والوفاة والعجز الكلي و17 شهرا للعجز الجزئي وبحد أقصي 13000 جنيه
- توصية الجمعية العمومية 2004 يرفع قيمة الصرف إلي 35 شهرا بحد أقصي 15000 جنيه
- ويقوم صندوق الزمالة بدعم رحلات العمرة والحج بواقع 50 %

أولا: الاشتراكات
1- اشتراك شهري 7% من المرتب الأساسي
2-قيمة نسبة 5%من أصل الحصيلة الشهرية لمجموعات التقوية المدرسية
3- رسم انضمام للصندوق كالآتي:
أ) جنيهان لعضو نقابة المهن التعليمية الذي يعمل بوزارة التعليم
ب) عشرة جنيهات لعضو نقابة المهن التعليمية الذي لا يعمل بوزارة التربية والتعليم
في حالة الإعارات والأجازات بدون مرتب يقوم العضو بسداد الاشتراكات المحددة طبقا لهذا النظام مقدما سنويا وفي حالة التأخير يحصل ريع استثمار سنوي من تاريخ الاستحقاق حتى تاريخ الأداء يعادل تكلفة الفرصة البديلة

A new chance to act on Guantanamo

The last time Amina al-Rabeii video conferenced from Yemen with her brother Salman, a detainee at the U.S. military prison at Guantanamo Bay, she barely recognized the skeletal man on the screen.

“His eyes were sunken into dark recesses,” al-Rabeii told me when we met recently in Sanaa, the Yemeni capital. “He was slumped in his chair and he could barely keep his head up. He couldn’t concentrate and he didn’t seem to register what we said. We could hardly keep from crying.”

Salman al-Rabeii, 33, was reportedly picked up in Afghanistan in December 2001. He is among the scores of detainees participating in a three-month-old hunger strike to protest their indefinite detention without charge at Guantanamo.He also is among about 90 Yemenis at the prison – the largest bloc by nationality and the group at the heart of the current Guantanamo crisis.

Last week, Guantanamo detainees got their first glimmer of hope in years, when President Barack Obama renewed his pledge from his first day in office to close Guantanamo. At the same time, Yemen’s new transition government is beginning its own effort to bring the Yemeni detainees home. The Obama administration should do all it can to seize the momentum.

Last month, Yemen’s cabinet approved a resolution from the country’s feisty human rights minister, Hooria Mashhour, pledging that 10 key government ministries will watch over any repatriated detainees, both to prevent them from potentially threatening the U.S. and to ensure they receive counseling, job training and other assistance to help them reintegrate into society.

Mashhour, who is transforming her formerly timid ministry into a bully pulpit for human rights, also has prepared a draft memorandum of understanding with the United States on sharing information on repatriated detainees and providing access to them. In addition, the Yemeni authorities have proposed to build a Yemen-based rehabilitation center to house detainees upon their return.

Both Mashhour and a team from Yemen’s National Security Bureau, one of the country’s intelligence agencies, were in Washington this week to discuss the Guantanamo detainees with U.S. officials. Unfortunately, Mashhour, who was already in town for a World Bank meeting, cut short her visit after learning she had only one official appointment scheduled with the Obama administration.

Mashhour’s visit would have been a golden opportunity for the United States and Yemen to engage on one of the most pressing human rights issues facing the two governments. But her early departure should not become an excuse for Washington or Sanaa to further dally over a solution for Guantanamo’s Yemenis, who account for nearly two-thirds of the prison’s 166 detainees.

In 2009, Obama had cleared 56 Yemenis at Guantanamo for transfer to their homeland, 26 immediately with 30 others following if the initial tranche went well. But the president froze the transfers days after the Christmas 2009 attempted bombing of an airliner over Detroit by a Nigerian youth who claimed to have been inspired by the Yemeni-American preacher Anwar al-Awlaki. At least two Yemeni detainees had actually been removed from their cells and were preparing to head home when, according to their lawyer, their guards were alerted to the freeze and locked them back up. The U.S. killed Awlaki in 2011 in a drone strike in Yemen.

Further discussions on returns got bogged down under the former Yemeni president, Ali Abdullah Saleh, a shrewd leader but a fickle counterterrorism partner. Saleh reportedly gave the U.S. permission to attack Awlaki in a drone strike in 2011, yet al Qaeda in the Arabian Peninsula blossomed in Yemen during his presidency.

Saleh ceded power in 2012 following a popular uprising. His successor, Abdu Rabu Mansour Hadi, has in contrast to his predecessor worked closely with the U.S. on countering terrorism.

Of course, the stated aims of Yemen’s government cannot mitigate all risks of repatriating the detainees. Even if the Yemenis inside Guantanamo were innocent when they arrived, some may have been radicalized inside the prison, or might turn to militancy when they get home.

But prolonged indefinite detention without charge or trial violates U.S. obligations under international law, and the backlash in Yemen to the continued imprisonment is mounting. During one demonstration in April outside the U.S. Embassy in Sanaa, protesters in orange jumpsuits waved banners in English reading: “U.S.A. Give (sic) up Human Rights.”

Amina al-Rabeii regularly attends the rallies to demand the release of her brother Salman, who has never been charged. Amina believes Salman’s only crime is to be the brother of Fawaz al-Rabeii, who was convicted in 2004 for the bombing two years earlier of a French oil tanker and killed by state security forces in 2006. “I used to think the US was trustworthy but now I think everything it says is a big lie,” she said. “When will Obama send the Yemenis home?”

Obama should answer Amina’s question as soon as possible. He would do well to start with a close look at the draft memorandum of understanding and other repatriation proposals from Yemen. Long viewed by Washington as part of the Guantanamo problem, Yemen may instead be part of the solution.

Obfuscation has been the principal strategy of Digitel/PLDT in dealing with the issue of the members of the Digitel Employees Union who have opposed what the union members who have been picketing the PLDT main call “closure via redundancy.” They say this is “clear union busting to promote contractualization.”

It is therefore not a surprise that the letter to the editor of Digitel/PLDT spokesman Reuben Pangan follows what in Filipino idiom refers to as “taktikang hito.”

In his letter, Pangan insists that we committed “material factual error” in our column when we said the January 21, 2013 decision of the Supreme Court did not in fact order the reinstatement of the 13 employees dismissed in 2005.

However, news reports on the issue say that the Supreme Court’s final and executory decision affirmed the 2006 directive of the Secretary of Labor and the National Labor Relations Commission which among others ordered Digitel to one, commence CBA negotiations with the union and two, to reinstate with full back wages.

Of course Digitel/PLDT, through Pangan’s letter, admits that indeed the SC decision ordered reinstatement but the giant telecommunications company latched on to a loophole that “under the doctrine of strained relations, the payment of separation pay is considered an acceptable alternative to reinstatement.”

So reinstatement, contrary to what Pangan claims, is part of the SC decision since the SC was affirming the legality of Department of Labor and the NLRC’s directive. Digitel/PLDT chose the alternative.

Pangan also says that the order to commence negotiations for a collective bargaining agreement (CBA) was not complied with because there was no bargaining unit to talk to after Digitel completed its redundancy program last March 15.

What Pangan is saying is that Digitel/PLDT cannot negotiate because they have already abolished the Digitel union through the Digitel redundancy program.

In his letter, Pangan feigns ignorance of the source of the quote about the insistence of the protesting members of the Digitel Employees Union that the “scheme of closure via redundancy” is a scheme to promote contractualization.

If he is really following all developments in this issue, Pangan would know very well that the statement came from DEU president Alan Licardo and it is in the Web page of the Union. The full quote reads: “Last March 15, 2013, more than four hundred (400) regular employees of Digitel have been terminated via the Redundancy program of PLDT/Digitel Management. Almost 80% regular employees availed the program where they are paid 190% of their number of years in service. Almost all of these redundant employees were offered job as contractual under SERVEFLEX and PEOPLESERVE with the same salary, same position, same job description and same work location. How can this be redundancy? A clear violation and act of illegal dismissal.”

That is DEU’s position and of course Digitel/PLDT has a different one as espoused by its spokesman, Mr. Pangan.

Solidarity with hunger strikers in detention centres in the Netherlands

About 60 asylum seekers in detention centre in Rotterdam, the Netherlands, have been in hunger strike for four days now. 18 of them also stopped drinking since Wednesday 6th of May. They are protesting against the asylum policy that criminalizes refugees: they get thrown out on the streets without money or shelter and they get detained in prisons for up to 18 months. The refugees on hunger strike demand not to be treated as criminals anymore. They clearly stated they want freedom and protection.
Wednesday May 1st, twenty refugees in detention centre Schiphol went on hunger strike. While the guards brutally broke down the strike in Schiphol, by putting the hunger strikers in isolation cells, about 80 refugees in detention centre Rotterdam started a hunger strike on Monday 6th of May. One day later, fifty women in detention centre Bruges (Belgium) also went on hunger strike.
A thirst strike is even more dangerous than a hunger strike: the latter can last for 40 days before people get in a critical situation, whereas a person who does not drink will be dead after one week.
The Dutch government has shown an unbelievable arrogance in this matter. At first, they did not respond to the demands of the refugees at all. One parliament member of the ruling party People’s Party of the Freedom and Democracy (VVD) even went as far as to say the refugees “were taking the government hostage” by going on hunger strike. Then, as late as Thursday 9th May, they “provided” a worthless “offer”. In return for the end of the hunger strike, the government “offered” to shorten the usual 17 hours a day detainees are locked inside their cell with a few hours. The hunger and thirst strikers of course rejected this ridiculous proposal and they will continue with their protest.
But things are getting very serious right now. As of Friday the third day without water begins for the refugees who have no other means of getting their voice out than to go on a hunger or thirst strike. Refugees searching for a better life get thrown into a Kafkaesque bureaucracy of having to provide proof that doesn’t exist in order to get their permit to stay. Once rejected, undocumented refugees get thrown out on the streets and get denied basic human rights, such as food, shelter, work and health care. Racist police hunt them down and jail them. In detention, refugees are stripped from their dignity, their autonomy, their lives and their future. Once deported, no one ever hears from them again. Right now, refugees in detention centre Rotterdam are directly and unmistakeably demanding their rights and their freedom. The government will have to respond very quickly and adequately, if they don’t want to be held responsible for dozens of deaths.
We are strongly calling for solidarity from our friends throughout Europe. Solidarity with the hunger and thirst strikers in special; and with refugees in general. The state is aimed at excluding everyone who is not directly exploitable by capital. Make it known how this insane migration policy of repression destroys the lives of hundreds of thousands of refugees. Show your solidarity by spreading this message.
Print this letter and glue it everywhere, preferably to walls that symbolize exclusion by Fortress Europe: parliament buildings, embassies, deportation offices, immigration offices, etc. etc.

INDEFINITE ENEMIES AND THE INHUMANITY OF OUR ‘WAR ON TERROR’.

You’re strapped to a metal table, unable to move. They stick a two-foot plastic tube up your nose, then down the back of your throat into your stomach. They squirt in the liquid protein. You gag, bleed, vomit. It’s unbearably painful.

The practice of involuntary force-feeding is condemned by most medical organizations, including the AMA. It’s banned by most governments. It’s torture.

When I read about the process by which authorities are breaking the hunger strike at the Guantanamo Bay detention center — a process that’s also used regularly in U.S. federal prisons, by the way — I was struck by the utter efficiency of it. The “food” is transmitted directly from bureaucracy to digestive system, bypassing the consciousness of the individual hunger striker. The human being inhabiting this body is completely irrelevant; he only dies when we say so.

Could anything be plainer? The ruling consensus of the United States is desperate for an enemy, any enemy. There is not the least bit of self-reflection involved.

Just think about how powerful we are. Just think about how secure we are.

In the overall context of the war on terror and the harm it has unleashed on the world, the Guantanamo hunger strike, involving 100 of the 166 detainees still being held at the facility — about two dozen of whom are now being force-fed — is a fairly small matter, perhaps. But the symbolic significance of it is beyond description, not only because of the hatred it foments against the United States and the combatants it recruits, but also because of the obvious common decency and common sense it flaunts.

Could anything be plainer? The ruling consensus of the United States is desperate for an enemy, any enemy. There is not the least bit of self-reflection involved.

“There’s no reason to bring these terrorists into the United States. No reason to increase the threat level here,” House Minority Leader John Boehner proclaimed in response to one of President Obama’s tepid attempts to close Gitmo, several years ago. The words ooze cringing contempt for these caged human beings — so many of whom, it turns out, had no involvement with terrorist activity whatsoever. They were turned in for bounty money, arrested out of mistaken identity. No matter. These broken men, caught in the hell of indefinite detention, are America’s enemies and therefore dangerous beyond comprehension, at least in the minds of those who preside over the security state.

People “create enemies in order to maintain a stable, coherent, clear view of the world,” Nathan A. Heflick wrote in a 2011 Psychology Today article. “This is because they can attribute the negatives of the world (which are inevitable) to these enemies. . . . Having enemies even appears to make people feel, ironically, safer.”

And large institutions, as far as I can tell, have the self-awareness of immature children. Tom Engelhardt, for instance, in a recent essay for TomDispatch, ponders the collapse of the Soviet Union in 1991 and the sudden end to the Cold War, which left the world with a single, dominant superpower: “And here was the curious thing after centuries of arms races,” he writes. “When there was no one left to race, the U.S. continued an arms race of one.”

And trillions of dollars later, it’s still going on. We can destroy the world a hundred times over but, as Engelhardt writes, we can’t “win a war against minimally armed guerillas.”

We can, however, raid their homes, take out their leaders with drone strikes, rattle our symbolic sabers at defiant heads of state and maintain a gulag of bad, bad people, who have virtually zero rights. The Guantanamo facility gouges the national treasury for about a million dollars per detainee annually, and Americans may have more to fear, in the real world, from 5-year-olds with guns than they do from alleged terrorists, but that’s not
the point. We need enemies. Homeland Security is psychological.

Thus the guilt or innocence of the Gitmo prisoners and all our other detainees is irrelevant. It doesn’t even matter that most Americans would probably prefer to see the facility closed, and by large margins elected a president who once promised to do so. In the minds of the ruling consensus and a compliant media, terrorists are not only “out there,” planning the overthrow of our way of life just as the Soviet generals once did, but they are also “in here,” caged, contained, their evil under our absolute control. They can’t even starve themselves to death as a final act of protest against their detention. They have no right to act as human beings, because we have proclaimed them terrorists.

In a world of “what goes around comes around,” we are, of course, not secure at all — not when we abandon our highest values and dehumanize a vast portion of the world. Most of us get this, at least as individuals. But how do we make a nation grow up, especially when its principle shareholders have so much money invested in its continuing immaturity?

The best I can do is echo James Carroll, who wrote this week in the Boston Globe that “the way to respond to the threat of their dying from self-imposed starvation is not to torture them with feeding tubes forced into their nostrils, but to address the legitimacy of their demands.”

In other words, look at their humanity. Once we do, we’ll never be the same.

Day 231: Calling the Beast by it’s Name – Breast Cancer – First do No harm – Day 16

It is suggested that every fourth day the Cancer Patient rub oil from head to toe, sit in a hot tub of water for 15 minutes, and then crawl in bed, cover yourself up with tons of covers and sweat for an hour to release toxins. When I first did it, God I hated it. Mostly because I didn’t like laying in bed sweating for the hour. I felt the same about my two daily baths in the beginning. I take a really hot bath in the morning with a cup of apple cider vinegar added to the water, which aids in leveling one’s PH balance… In late afternoon, I take another really hot bath this time with Epsom salt. It seems odd to think that my mind as consciousness didn’t enjoy soaking in a hot tub of water a couple of times a day but every day the first 2 weeks bath time came with much resistance. Now, I absolutely enjoy them.

Since the biggest part of my treatment is about detoxing, it’s important to remain consistent and keep it simple through remaining within the guidelines of the metabolic diet. The results are that I’m slowly dissolving the lump/cancer from my physical body. (Please remember that this is my treatment plan and in no way is meant to be considered as a cure and/or a miracle of some kind.)

Some people may not realize that when a person has Chemotherapy and Radiation, the reason they become sick is because their body becomes toxic. Which is why detoxing for them is also very important but the Cancer Patient on Chemo or Radiation may not be aware of what is happening to their physical body during the process they’ve embarked upon.

Chemo and Radiation is Not and will Not ever be a solution for me partly because of the particular type of cancer that I have and also, because having investigated and researched the traditional orthodox treatments, I’ve definitely concluded that it doesn’t make sense for something to be considered a Solution when that something kills everything it comes into contact with – chemo poisons and radiation burns the Physical body as well as destroys all types of healthy cells in an attempt to kill the cancer cells.

It makes sense to me that the treatment plan must ‘first do no harm’ to the physical body in anyway whatsoever .. The treatment plan for the Cancer Patient must provide the utmost care that one can give to self and respect must be given in protecting the physical body from any further damage no matter what. That is not so easy because to remove one’s favorite foods and the removal of their place in society as the food requires a dedication to self that one cannot typically prepare for.

I mean, what I’m realizing is that it’s the simplest physical actions of my treatment plan that’s assisting me with stability with a glimpse of self-intimacy, where I’m actually beginning to have a relationship with who I am as my physical body – instead of judging my body through mind/thought participation… It’s a difficult thing to admit about myself. Seeing myself beneath the shame of realizing that I’ve never had that – never had an intimate relationship with me as my physical body. The kind of relationship where I take responsibility for everything going in and coming out both within my mind/physical body/reality.

Another interesting thing is that keeping it simple means keeping to foods that are raw and fresh according to what grows here naturally on Earth, like nuts, seeds, fruits and vegetables. And, did you know a simple warm cup of water with fresh squeezed lemon juice is the very thing to assist the kidneys to flush toxins?

It’s interesting that Nature’s defense against cancer is not only the pancreatic enzyme’s and vitamin B-17 therapy but there’s also a group of Doctor’s in Europe that have reported that hyperthermy – which is a deliberate raising of the patient’s body temperature – that hyperthermy has increased the effectiveness of the vitamin therapy so greatly that when the body temperature is raised from it’s normal 37 degrees to 41 degrees Celsius or 98.6 to 105.8 degrees Fahrenheit, that there is a gain in effect from 3 to 10 fold.

So in other words, at the higher temperature it takes only 1/3 to 1/10 as much B-17 to achieve a given anti-cancer effect. So, it’s possible that the formative function of the cancer cell is impaired by the increase oxygenation and circulation that’s associated with having a fever. So the Solution to Disease/Cancer is definitely in keeping it simple through a means of appropriate nutrition rather than drugs.

I mean just over 5 years ago, I didn’t worry about the strain I caused within my physical body every time I popped a pill. Today that memory came forth as I was soaking in my last bath. I became aware of how my secret mind was looking for/to the memory of me popping a pain pill for comfort. Instead I breathed, and I realize that I’ve never ever felt so comfortable within and as my physical body. It’s like I’m beginning to understand the meaning of taking responsibility for oneself. I’m beginning to enjoy who I am as my Physical body and the fact is, Everyone should have the same opportunity that I have.

I’m able to get up every morning and do what I have to do to prepare my daily nutrition schedule – which is not cheap by the way. I’m also able to take walks to slowly strengthen my physical body and I am amazed at how when you’re making decisions based on whether or not you’ll be here a year from now – and you know your life depends upon nutritional success – you know you have to remain aware to forgive and stop automated behaviors.

The Cancer Patient cannot afford any added waste of any kind. And, I mean who of us can afford to waste one more minute in our delusions of grandeur? How come we won’t see how we’ve placed ourselves within our current money system - that is constantly supported through the use of orthodox medicine? We can all dance around the subject but most of us get that something isn’t right with how our current world/money systems are established and exist as. We see how corrupt things are and how they move within our world. How the rich are only rich because the poor are poor.

Because Money after all, makes the world go round.. But, why should the establishment/system/government/pharmaceutical industries/the AMA, etc, why should they be able to profit from illness and death? Why? Because we allow them to. Why do we continue to accept these destroyer of life treatment plans to continue to receive our support for their control over our society/world/reality?

The System is abusive and ineffective. How do we know that? Because what we’re offering in the way of treatment for the ill – because of profit – are radiation and chemotherapy, deadly drugs, killers of life.

Nutrition is the Solution rather than drugs within the Principle of ‘First do no harm’.. To realize that we require an organization like the Equal Life Foundation to see to it that these things are taken care of according to what’s best for all – where we don’t continue down a road where people are being burned and poisoned just so the fat cats can continue their extravagant lifestyles.

One Month of Struggle…

DEU Gears Up for Battle!

Armed with the Supreme Court decision, G.R.No. 184903-04 issued with finality last January 21, 2013 and the Department of Labor and Employment order, the Writ of Execution issued last March 19, 2013, these Digitel employees are seeking justice, urging PLDT/DIGITEL management to respect the law.

It has been exactly one (1) month since 93 members of Digitel Employees Union started a peaceful protest in front of PLDT Main Office at Makati City last April 10. They were dismissed from their jobs illegally due to redundancy and of so-called end-of-life DIGITEL facilities.

All regular employees were offered enhanced Voluntary Retirement Packages and were served Notice of Redundancy last February 2013 because management said that DIGITEL operations will stop by March 15. After which, contractual employees were hired to work in place of the discharged regular workers.

Digital Telecommunications Philippines Inc., is 99.5% owned and managed by Philippine Long Distance Telephone Co., owned by Manuel V Pangilinan. PLDT/DIGITEL management continues to defy the SC decision and DOLE order to commence Collective Bargaining Agreement with DEU and to reinstate affected employees.

The affected workers, Engineers and multi-skilled technicians, come from various DIGITEL Business Units across Luzon like Ilocos Norte, Ilocos Sur, Abra, La Union, Pangasinan, Baguio City, Region 2, Nueva Ecija, Pampanga, Bulacan, Rizal, Cavite, Laguna, Quezon, Camarines Norte, Camarines Sur, Sorsogon and Albay.

One of the highlights of the DEU protest is the Hunger Strike that started last April 16 led by their president Alan Licardo and member Arly Montecastro, followed by members Jesse Furaque, Marcelino Mari, Nestor Navoya, Eduardo Reyes, Noel De Leon and Robert Tiamson.

These brave men and women of DEU are not only fighting for their jobs and livelihood, but they are also against contractualization. It is a matter of principle and dignity for the DEU that they want the future of labor be secured and the rights of workers not trampled upon by capitalists and the rich.

PLDT/DIGITEL management continue to disregard the law, they are doing anything just to delay and play around the enforcement of the SC decision and DOLE order. But one thing is for sure; the truth will surely come out and the oppressed will prevail.##

VILLAIN or HERO? Ariel Castro, Charles Ramsey and Guantanamo Bay

After all the bad news we’ve been struggling with over the past several weeks, what a breath of fresh air to hear that Amanda Berry, Gina DeJesus and Michelle Knight of Cleveland, Ohio, missing for over a decade, were found alive and restored to their families![1] According to initial reports, the three young women survived more than ten years of confinement, torture and repeated rape at the hands of Ariel Castro, a former school bus driver, homeowner, and longtime resident of the Cleveland neighborhood where the young women were found.

A neighbor, Charles Ramsey became an overnight hero when he heard Amanda’s desperate screams for help and went next door to Ariel’s house of horrors to help her get out, along with her fellow prisoners.[2] Both Charles and the neighbors were shocked by the revelation of this “dark side” of their trusted, and seemingly ordinary neighbor. In the plainspoken words of Charles Ramsey:

I barbecue with this dude. We eat ribs and whatnot, listen to salsa music, you see where I’m coming from? Not a clue that that girl was in that house, or anybody else was in there against their will… You got to have some big testicles to pull this off bro, ‘cause we see this dude everyday. I mean everyday… He’s somebody you look, then look away. He’s not doing anything, but the average stuff. You see what I’m saying? There’s nothing exciting about him. Well, until today.[3]

Cleveland Police Chief Michael McGrath insists that law enforcement officials did all they could to find and rescue the young women. But neighbors claim that police failed to respond to their reports of suspicious conditions at Ariel’s home – windows covered with boards and bags, pounding from inside the doors and even seeing chained naked women crawling around the back yard.[4]

We celebrate Amanda, Gina and Michelle’s extraordinary courage and perseverance in surviving the degrading brutalities of their captivity. We applaud Charles’ homespun heroism in helping with their rescue. And yet it is startling and troubling that Ariel could carry out his heinous hostage horror for more than 10 years in the midst of neighbors and under the nose of the police.

Neighbors said that Ariel Castro took part in the search for one of the missing women, helped pass out fliers, performed music at a fundraiser for her and attended a candlelight vigil, where he comforted her mother. [And yet at the same time] as recently as 2005, Castro was accused of repeated acts of violence against his children’s mother.[5]

As it turns out, even hero Charles Ramsey has a record of domestic violence in his past.[6] These ragged realities show us that good and evil coexist in the human heart – in the words of Martin Luther we are “simul justus et peccator” – both saint and sinner – at the same time.

Yet, in the case of Amanda, Gina and Michelle, we see Ariel as a villain and Charles as a hero—why?

In spite of his past, Charles responded when he heard Amanda’s cry for help. He stopped. He listened. He got involved. He intervened. Each step required more courage than the last – especially, as he so poignantly pointed out, as a black man (who had past dealings with the law) getting involved with a white woman. But he did what was needed, putting her need for help ahead of his need to play it safe.

Ariel, on the other hand, was the ultimate deceiver. For 10 years, he systematically kidnapped, confined, sexually assaulted, terrorized and sadistically controlled Amanda, Gina and Michelle – abducted at ages 16, 14 and 20, all the while presenting himself as a good neighbor, an ordinary guy. He satisfied his twisted need for control and self-importance by dehumanizing these young women.

How could he do it, we wonder? A more searching question now confronting us as a nation is how can WE do it?

Eleven years ago, in the aftermath of 9-11, on January 11 2002, twenty captives of former President George W. Bush’s “Global War on Terror” were taken as prisoners to the Guantanamo Bay detention camp at a U.S. Naval Base in Cuba. By July 17, 2003, the prison population had swelled to 677. The Bush administration asserted that detainees were not entitled to any of the protections of the Geneva Conventions governing global standards for the humane treatment of prisoners of war.[7] Though this executive directive was overturned by the Supreme Court in 2006, current and former prisoners have complained of abuse and torture at the hands of their U.S. captors:

Prisoners at Guantanamo Bay have been subjected to Abu Ghraib-style torture and sexual humiliation in which they were stripped naked, forced to sodomise one another and taunted by naked female American soldiers, according to a new report. Some of the abuse has been captured on videotape. Based on the testimony of three former British prisoners who spoke with other detainees, the report details a brutal yet carefully choreographed regime at the US prison camp in which abuse was meted out in a manner judged to have the “maximum impact”. Those prisoners with the most conservative Muslim backgrounds were the most likely to be subjected to sexual humiliation and abuse while those from westernised backgrounds were more likely to suffer solitary confinement and physical mistreatment.[8]

In addition to sexual assault and physical abuse, Gitmo prisoners have undergone systematic torture techniques including sleep deprivation, sensory deprivation, sensory bombardment, solitary confinement, mock executions, forced medication, temperature extremes, psychological abuse, intimidation with dogs, and being forced to watch the torture of other prisoners.[9] This torture is being carried out by U.S. military personnel, including doctors and medical staff stationed there.[10]

The Muslim prisoners at Guantanamo Bay have also been subjected to religious persecution. The Muslim holy book, the Quran, is routinely desecrated, even reportedly being flushed down the toilet.[11] Non-Muslim interrogators have reportedly thrown the Quran on the ground and stepped on it in front of prisoners. And sexual torture is designed to violate Muslim sexual taboos.[12]

In addition to sexual assault, physical abuse, systematic torture and religious persecution, the prisoners at Guantanamo Bay have been denied their human rights under international law and their legal rights under U.S. law. Though a series of transfers over the years has reduced Gitmo’s population from its near-700 high in 2003 to 166 today, many of those remaining have been held for as long as eleven years with no hearing and no formal charges entered against them, or else declared “enemy combatants” by sham tribunals and sentenced by kangaroo courts.[13] Although in 2008, the Supreme Court – by a one-vote majority- upheld habeas corpus – the right to contest their imprisonment[14] – for Guantanamo Bay detainees, not a single habeas corpus petition from a Guantanamo prisoner has been granted.[15]

Common Article Three of the Geneva Convention

…describes minimal protections which must be adhered to by all individuals within a signatory’s territory during an armed conflict not of an international character (regardless of citizenship or lack thereof): Noncombatants, combatants who have laid down their arms, and combatants who are hors de combat (out of the fight) due to wounds, detention, or any other cause shall in all circumstances be treated humanely, including prohibition of outrages upon personal dignity, in particular humiliating and degrading treatment. The passing of sentences must also be pronounced by a regularly constituted court, affording all the judicial guarantees which are recognized as indispensable by civilized peoples. Article 3′s protections exist even if one is not classified as a prisoner of war.[16] (my emphasis)

These are the provisions that the Bush Administration in 2002 asserted did not apply to detainees at Guantanamo Bay. They asserted that U.S. military personnel at Guantanamo did not have to adhere to these minimal protections. They insisted that U.S. military personnel had the right to treat the prisoners at Guantanamo Bay inhumanely, to commit outrages upon their personal dignity, in particular humiliating and degrading treatment. They asserted that the U.S. military could pass sentences on the Guantanamo prisoners without a regularly constituted court, stripped of all judicial guarantees which are recognized as indispensable to civilized peoples. And even since 2006, when the Supreme Court ruled that these minimal protections in the Geneva Convention did apply to the Guantanamo detainees, Gitmo has gone on with its ghoulish, criminal activity.

We are Ariel Castro. We have systematically rounded up, confined, sexually assaulted, terrorized and sadistically controlled the Guantanamo prisoners under the banner of the United States – presenting ourselves to the world as one of the most advanced and civilized nations on earth — “the land of the free, the home of the brave, the champion of democracy, the leader of the free world.”

Instead of fighting in the “Global War on Terror” we have become the Chief Perpetrators of a United States War of Terror against the prisoners held in the hell-hole at Guantanamo Bay. We have been satisfying our twisted need for power and control by brutalizing and dehumanizing the Guantanamo Bay prisoners.

Denied every legal recourse of appeal and held in the horror of daily brutality and degradation, more than 100 of the remaining 166 prisoners of Guantanmo Bay have resorted to the only means of protest left to them – hunger strikes. In spite of the torturous forced feedings of their captors, they are offering up their bodies as a “living sacrifice” an expression of resistance, a desperate cry to the world for help. Like Amanda Berry, through their self-starvation, they are screaming out for a Charles Ramsey Coalition – international neighbors willing to stop, listen, get involved, intervene, take a risk, demand that justice be done.

One of President Obama’s 2008 election promises was to shut down Gitmo by 2009. Congress thwarted his plans and he has not fulfilled that promise:

The result, at the camp, is near-total stasis. No new prisoner has arrived since 2008; none has left for over a year. Parole-style hearings planned for the group not designated for either trial or transfer have yet to begin. Prisoners have lawyers, but there is little the lawyers can do for them. This bleak situation, says Mr. Stafford Smith, is worse than being on death row.[17]

Gitmo prisoners feel betrayed, forgotten by President Obama and the international community. Will we ignore their desperate cry? Will we let them die? Will we be villains or heroes, Ariel Castro or Charles Ramsey?

Just then a lawyer stood up to test Jesus. “Teacher,” he said, “what must I do to inherit eternal life?” He said to him, “What is written in the law? What do you read there?” He answered, “You shall love the Lord your God with all your heart, and with all your soul, and with all your strength, and with all your mind; and your neighbor as yourself.” And he said to him, “You have given the right answer; do this, and you will live.”[18]

But wanting to justify himself, he asked Jesus, “And who is my neighbor?”[19] Jesus replied,
“166 people were going down from Afghanistan to Guantanamo Bay, and fell into the hands of Ariel Castro, wearing the uniform of U.S. military personnel, who stripped them, beat them, and denied them basic human rights and a fair trial, leaving them half dead. Now by chance some ordinary American citizens were going down that road; and when those citizens saw those prisoners, they passed by on the other side thinking, ‘They deserve it for being radical Muslim terrorists and enemies of freedom and the American way.’

So likewise some other American citizens came to the place and saw them, and passed by on the other side thinking, ‘Hey, we’re just ordinary folks; We keep to ourselves; what can we do? Besides, we might get hurt or get in trouble getting involved in this. The President promised. That’s his problem. Let Congress work it out!

But a Charles Ramsey Coalition of the Concerned came near the hungry, tortured, desperate prisoners screaming for help; and when they saw them, they were moved with compassion. They realized this could be another ugly case of State-sanctioned or socially acceptable violence tolerated by default like our sad past national experience with the lynchings of the Jim Crow era, or the Japanese detainment camps of the World War II era, or the dogs and fire hoses of the Civil Rights era or the military rape culture of our current times.

So the Charles Ramsey Coalition got involved and saw to it that the Guantanamo detainees were properly cared for, transferred to their homelands or other receiving nations or given fair trials. Rather than sanctioning the continued use of their tax dollars to fund or “refurbish” the exorbitantly expensive torture camp in Guantanmo Bay, they demanded that their tax dollars be used to bring an end to this shameful chapter in our shared American history.

When someone asked the Coalition why on earth they would go to such lengths to get involved in this Guantanamo issue, their leader, Charles Ramsey responded on their behalf “We’re Americans, and we’re human beings. We’re just like you. We work for a living. These prisoners are in distress, so why turn your back on that?”[20]

Jesus says to us, “Go and do likewise.”

United States: Keeping Guantanamo Open Shames A Nation That Espouses Liberty

The United States has consistently lost the communication battle in the War on Terror (WoT) to a bunch of self-styled propagandists who, even when combined, don’t have half the resources of the US government (USG).

Consequently, while the US can win short-term battles due to the civil-rights destroying capabilities of its security organizations, long-term success will come only when the USG is able to stop people from becoming its enemies in the first place, and this cannot happen if it continues to lose the messaging battle to its low-cost opponents.

Some of this could be blamed on the USG’s ineptitude in conveying its message and the contradictory nature of its policies – killing people with drones as if life was a video game does not engender positive feelings for those moving the joystick.

However, there are a number of USG agencies and American companies trying to do good things around the world but their message stands no chance of being heard over the din of Guantanamo.

This has been particularly true over the past few months as the Guantanamo Bay Detention Camp (GBDC) has returned to prominence due to the hunger strikes of a majority of those residing at the Camp.

While the world has been stunned at how the US military has been treating those participating in the strikes – force feeding never looks good – the reaction of the country’s political class, especially on the right, has been at best, preposterous, and at worst, dangerous.

Republican Senator Lindsay Graham’s statement that the “American people don’t want to close Guantanamo Bay … to bring these crazy bastards … to the United States” is one example of the numerous idiotic statements being spewed on this topic.

Senator Graham’s credibility, by the way, on representing the wishes of the American people is a little shaky since he voted against a gun-control law that is supported by a vast majority of the country’s citizens.

This view shows a stunning lack of understanding of why GBDC should be closed, some of which are that keeping it open is unethical, against American values and defeats any positive action taken by the USG.

Even putting these esoteric reasons aside, detaining these individuals at GBCD ignores the fact that a number of them have been cleared of any wrongdoing or being of any future threat to the US.

Obviously, the problem with unloading these individuals is that they have been tainted with the stench of suspicion and this makes it more difficult for the US to send them to another nation – even if it may be that individual’s home country.

This leaves Washington stuck between a rock and a hard – but not impossible – place as the USG can take a number of actions to worm its way out of this quandary.

The first action the USG could take is to simply to act as if it was working hard towards transferring these detainees to other nations.

This singular superficial action would show the world the US has no choice but to hold these innocent detainees at GBDC and dilute a large part of the Camp’s impact. However, the current administration’s inaction in not even selecting a senior official to replace the previous ambassador shows a stunning lack of understanding of how easily this part of the issue could be resolved.

Admittedly, this solution would not solve the whole problem since GBDC holds a number of detainees who are certifiable “bad guys.” These should not be released and, consequently, should be either charged in the country’s federal courts or transferred to overseas prisons – Egypt, for example, would likely be happy to take some of these people in exchange for some baksheesh.

In addition, filing cases against these individuals would show the world the US justice system spares no one and gives everyone their place in the sun.

Unfortunately, the US’ existing policies show it to be a bully who hurts innocents thus destroying its global image.

I fully admit, though, that my recommendations are practical and do not consider the political blowback from those blowhards – such as the aforementioned Senator Graham or the talk radio hosts on the right – whose job is to complain without offering solutions.

Regardless of the impact, the USG should not consider the manure being spewed from these intellectually-challenged professional complainers because the US is a nation that rises above sewage, not one that wallows in it.

Indefinite detention of the innocent and guilty alike, without any hope of charges, trial, or release: this is now the American way. Most Americans, however, may not care to take that in, not even when the indefinitely detained go on a hunger strike. That act has certainly gotten Washington’s and the media’s collective attention. After all, could there be anything more extreme than striking against your own body to make a point? Suicide by strike? It’s the ultimate statement of protest and despair. Certainly, the strikers have succeeded in pushing Guantanamo out of the netherworld of non-news and onto front pages, into presidential news conferences, and to the top of the TV newscasts. That, in a word, is extraordinary. But what exactly do those prisoners, many now being force-fed, want to highlight? Here’s one thing: despite the promise he made on entering the Oval office, President Obama has obviously not made much of an effort to close the prison, which, as he said recently, “hurts us, in terms of our international standing… [and] is a recruitment tool for extremists.”
If Congress has been thoroughly recalcitrant when it comes to closing Guantanamo, the president’s idea of what shutting down that prison meant proved curious indeed. His plan involved transferring many of the prisoners from Cuba, that crown jewel of the offshore Bermuda Triangle of injustice that the Bush administration set up in January 2002, to a super-max-style prison in Illinois (“Gitmo North”). That would mean, of course, transferring indefinite detention from the offshore world of extraordinary rendition, black sites, and torture directly into the heart of the American justice system. Obama himself has indicated that at least 50 of the prisoners can, in his view, never be released or tried (in part because confessions were tortured out of some of them). They would be kept in what he, in the past, politely termed “prolonged detention.”
Here’s a second thing the strikers undoubtedly wanted to highlight and it’s even harder to take in: Guantanamo now holds 86 prisoners (out of the 166 caged there) who have been carefully vetted by the U.S. military, the FBI, the CIA, and so on, and found to have done nothing for which they could be charged or should be imprisoned. All 86 have been cleared for release — years late, often after brutal interrogation experiences sometimes involving torture. The problem: there is nowhere to release them to, especially since the majority of them are Yemenis and President Obama has imposed a moratorium on transferring any prisoner to Yemen.
Then there are the prisoners who may indeed have done something criminal in regard to the U.S., but had confessions tortured out of them which won’t hold up in court. They are among the ones who will never be brought to trial, but never cleared for release either. In other words, indefinite detention, something anathema to the American justice system, will for the conceivable future be us. The fact that relatively few Americans seem fazed by this should be startling. No charges, no trials, but never getting out of prison: that would once have been associated with the practices of a totalitarian state.
We know one thing: no one, not George W. Bush, Dick Cheney, Donald Rumsfeld, Condoleezza Rice, or other top officials involved in setting up such a global system of injustice, sweeping up the innocent with the guilty, and subjecting them to horrors without end (including now force-feeding) will ever be brought to justice in an American court, nor will anyone involved in the system of rendition, torture, or abuse. In the Obama years, while indefinite detention remained a grim American reality, the government, as TomDispatch regular and former State Department officer Peter Van Buren himself experienced, honed other methods for punishing those it was unhappy with, especially whistleblowers of all sorts.
One of those methods might be called “indefinite suspension.” Instead of not being charged, you are charged repeatedly and dragged endlessly — your life in a state of suspension — through various bureaucratic judicial processes, the actual courts, and endless appeals thereof, so that even if sooner or later you come out the other side exonerated, you will still have been punished for your “crimes.” Let Peter Van Buren explain this mockery of “justice.” Tom

Homeland Insecurity Seven Years, Untold Dollars to Silence One Man By Peter Van Buren

What do words mean in a post-9/11 world? Apart from the now clichéd Orwellian twists that turn brutal torture into mere enhanced interrogation, the devil is in the details. Robert MacLean is a former air marshal fired for an act of whistleblowing. He has continued to fight over seven long years for what once would have passed as simple justice: getting his job back. His is an all-too-twenty-first-century story of the extraordinary lengths to which the U.S. government is willing to go to thwart whistleblowers.

First, the government retroactively classified a previously unclassified text message to justify firing MacLean. Then it invoked arcane civil service procedures, including an “interlocutory appeal” to thwart him and, in the process, enjoyed the approval of various courts and bureaucratic boards apparently willing to stamp as “legal” anything the government could make up in its own interest.

And yet here’s the miracle at the heart of this tale: MacLean refused to quit, when ordinary mortals would have thrown in the towel. Now, with a recent semi-victory, he may not only have given himself a shot at getting his old job back, but also create a precedent for future federal whistleblowers. In the post-9/11 world, people like Robert MacLean show us how deep the Washington rabbit hole really goes.

The Whistle Is Blown

MacLean joined the Federal Air Marshal Service (FAMS) in 2001 after stints with the Air Force and the Border Patrol. In July 2003, all marshals received a briefing about a possible hijacking plot. Soon after, the Transportation Safety Administration (TSA), which oversees FAMS, sent an unencrypted, open-air text message to the cell phones of the marshals cancelling several months of missions for cost-cutting reasons. MacLean became concerned that cancelling missions during a hijacking alert might create a dangerous situation for the flying public. He complained to his supervisor and to the Department of Homeland Security’s inspector general, but each responded that nothing could be done.

It was then that he decided to blow the whistle, hoping that public pressure might force the TSA to reinstate the marshals’ flights. So MacLean talked to a reporter, who broadcast a story criticizing the TSA’s decision and, after 11 members of Congress joined in the criticism, it reversed itself. At this point, MacLean had not been identified as the source of the leak and so carried on with his job.

A year later, he appeared on TV in disguise, criticizing the TSA dress code and its special boarding policies, which he believed allowed marshals to be easily identified by other passengers. This time, the TSA recognized his voice and began an investigation that revealed he had also released the 2003 text message. He was fired in April 2006. Although the agency had not labeled that message as “sensitive security information” (SSI) when it was sent in 2003, in August 2006, months after MacLean’s firing, it issued a retroactive order stating that the text’s content was indeed SSI.

A Whistleblower’s Catch-22

That disclosing the contents of an unclassified message could get someone fired for disclosing classified information is the sort of topsy-turvy situation which could only exist in the post-9/11 world of the American national security state.

Under the 1989 Whistleblower Protection Act (WPA), a disclosure prohibited by law negates whistleblower protections. That, of course, makes it in the government’s interest to define disclosure as broadly as possible and to classify as much of its internal communications for as long as it possibly can. No wonder that in recent years the classification of government documents has soared, reaching a record total of 92,064,862 in 2011.

Officially, the U.S. government recognizes only three basic levels of classification: confidential, secret, and top secret. Since 9/11, however, various government agencies have created multiple freestyle categories of secrecy like “SSI,” “Law Enforcement Sensitive,” “Sensitive But Unclassified,” and the more colorful “Eyes Only.” All of these are outside the normal codification system; all are hybrids that casually seek to incorporate the full weight of the formal law. There are currently 107 designations just for “sensitive” information. In addition to those labels, there exist more than 130 sets of extra “handling requirements” that only deepen the world of government secrecy.

At issue for MacLean was not only the retroactive classification of a text message already in the public domain, but what classified could possibly mean in an era when everything related to the national security state was slipping into the shadows. Such questions are hardly semantic or academic. MacLean’s case hinges on how they are answered.

The case against Army Private Bradley Manning and WikiLeaks is, for example, intimately tied up in them. The military hides behind classification to block access to Manning’s “public” trial. With WikiLeaks, despite more than 100,000 U.S. State Department diplomatic cables being available to anyone anywhere on the web, the government continues to insist that they remain “classified” and cannot even be rereleased in response to requests. Potential federal employees were warned to stay away from the cables online, and the State Department even blocked TomDispatch from its staff to shield them from alleged WikiLeaks content (some of which was linked to and discussed, but none of which was actually posted at the site).

With author Tony Shaffer, the government retroactively classified its own account of why he was given the Bronze Star and his standard deployment orders to Afghanistan after he published an uncomplimentary book about American actions there. The messy case of alleged “hacktivist” Barrett Brown includes prosecution for “disclosing” classified material simply by linking to it at places where it had already been posted online; and, while still at the State Department, I was once accused of the same thing by the government.

In MacLean’s case, over a period of seven years, the legality of the TSA firing him for using an only-later-classified text was upheld. Legal actions included hearings before administrative judges, the Merit Systems Protections Board twice, that interlocutory appeal, and the U.S. Court of Appeals for the Ninth Circuit. The sum of these decisions amid a labyrinth of judicial bureaucracies demands the use of the term Kafkaesque. MacLean, so the general judgment went, should have known that the text message he planned to leak was a classified document, even when it wasn’t (yet). As a result, he should also have understood that his act would not be that of a whistleblower alerting the public to possible danger, but of a criminal risking public safety by exposing government secrets. If that isn’t the definition of a whistleblower’s catch-22, what is?

What such a twisted interpretation by the various courts, boards, and bodies meant was chillingly laid out in an amicus brief on behalf of MacLean filed by the United States Office of Special Counsel (a small, lonely U.S. government entity charged with protecting whistleblowers):

“Whistleblowers should not have to guess whether information that they reasonably believe evidences waste, fraud, abuse, illegalities or public dangers might be later designated as SSI [unclassified sensitive security information] and therefore should not be disclosed. Rather than making the wrong guess, a would-be whistleblower will likely choose to remain silent to avoid risking the individual’s employment.”

Seven Years Later…

In 2011, five years after he had been fired as an air marshal, MacLean’s case finally reached the United States Court of Appeals for the Federal Circuit. Two full years after that, in April 2013, the court handed down a decision that may yet provide justice for Robert MacLean — and for future whistleblowers. While awkwardly upholding previous decisions that the government can indeed retroactively classify information, even documents in categories like SSI that exist outside the government’s official framework for classification and secrecy, the court tackled a more basic question: Was Robert MacLean a whistleblower anyway, entitled to protection for his act of conscience?

Here lies the conflict at the heart of just about every whistleblower case — between the public’s right (and need) to know and the (at times legitimate) need for secrecy. The government typically argues that individuals should not be allowed to decide for themselves what remains secret and what doesn’t, or chaos would result. At the same time, in a post-9/11 world of increasing secrecy, the loss of the right to know, and the massive over-classification of documents, the “conflict” has become ever more one-sided. If everything can be considered a classified secret document too precious for Americans to know about, and nothing classified can be disclosed, then the summary effect is that nothing inside the government can ever be shown to the public.

The court found that while the Transportation Safety Administration could legally apply any classification it wanted to information any time it wanted, even retroactively, simply slapping on such a label did not necessarily prohibit disclosure. Absent an actual law in MacLean’s case mentioning SSI, a term created bureaucratically, not congressionally, there could be no Whistleblower Protection Act-excepting prohibition. In other words, MacLean could still be a whistleblower.

One of MacLean’s lawyers, Tom Devine, told me the decision “restored enforceability for the Whistleblower Protection Act’s public free speech rights. It ruled that only Congress has the authority to remove whistleblower rights. Agency-imposed restraints are not relevant for WPA rights.”

“With this precedential decision,” MacLean explained to me, “agencies can no longer cancel out Whistleblower Protection Act rights with their semi-secret markings like SSI, Law Enforcement Sensitive, etcetera.”

In a concurring opinion, United States Court of Appeals for the Federal Circuit Judge Evan Wallach was even clearer: “Mr. MacLean presented substantial evidence that he was not motivated by personal gain but by the desire to protect the public… I concur to emphasize that the facts alleged, if proven, allege conduct at the core of the Whistleblower Protection Act.”

MacLean’s case now returns to the Merit Systems Protection Board. The board is a complex piece of bureaucracy inside the already complicated federal government personnel system. In simple terms, it is supposed to be a place to appeal personnel actions, such as alleged unfair hirings and firings. It thus serves as a kind of watchdog over the sprawling federal human resources empire. The Board now has the court-ordered specific charge to “determine whether Mr. MacLean’s disclosure qualifies for WPA protection.”

Note as well that this case could continue without end for years more, traveling on “appeal” back through the federal judicial bureaucracy and the courts. And remember that this, too, is an advantage to a government that wants ever less known about itself. If, as a federal employee, you are watching a case like MacLean’s (or Thomas Drake’s, or Franz Gayle’s, or Morris Davis’s, or John Kiriakou’s, or even my own small version of this), then you can’t help noticing that the act of whistleblowing could leave you: a) out on your ear; b) prosecuted for a criminal act and/or c) with your life embroiled for years in the intricacies of your own never-ending case. None of this is exactly an encouragement to federal employees to blow that whistle.

Whistleblowers and Secrecy

Threats to whistleblowers abound, so any positive step, however minimalist or reversible, is important. Entering the White House pledging to head the most transparent administration in history, Barack Obama has, in fact, gone after more national security whistleblowers, often using the draconian Espionage Act, than all previous administrations combined.

His Justice Department has repeatedly tried to prosecute whistleblowers, crudely lumping them in with actual spies and claiming they endanger Americans (and sometimes “the troops”) by their actions. In addition, through the ongoing case of Berry v. Conyers, Obama has sought to expand the definition of “national security worker” to potentially include thousands of additional federal employees. Many employees who occupy truly sensitive jobs in the intelligence community (for example, real-world spies at the CIA) are exempt from being granted whistleblower status. They also cannot appeal to the Merit Systems Protection Board if fired. By seeking to expand that exemption to a significantly larger group of people who may work at some federal agency, but in non-sensitive positions, Obama is also functionally moving to shrink the pool of potential whistleblowers. In Berry v. Conyers, for example, the persons Obama seeks to exempt as occupying sensitive jobs are merely an accounting technician and a commissary worker at an Air Force base. Neither of them even hold security clearances.

What happens with MacLean’s case potentially affects every future whistleblower. If the mere presence of a pseudo-classification on an item, even applied retroactively, negates whistleblower protections, it means dark days ahead for the right of the citizenry to know what the government is doing (or how it’s misbehaving) in its name. If so, no act of whistleblowing could be considered protected, since all the government would have to do to unprotect it is classify whatever was disclosed retroactively and wash its hands of the miscreant. Federal employees, not a risk-taking bunch to begin with, will react accordingly.

This is what gives MacLean’s case special meaning. While the initial decision on his fate will occur in the bowels of the somewhat obscure Merit Systems Protections Board, it will set a precedent that will surely find its way into higher courts on more significant cases. Amid a lot of technical legal issues, it all boils down to something very simple: Should whistleblower protections favor the conscience of a concerned federal employee willing to risk his job and the freedom to inform the public, or should they dissolve in the face of an unseen bureaucrat’s (retroactive) pseudo-classification decision?

Procedurally, there are many options ahead for MacLean’s case, and the government will undoubtedly contest each tiny step. Whatever happens will happen slowly. This is exactly how the government has continually done its dirty work post-9/11, throwing monkey wrenches in the gears of the legal system, twisting words, and manipulating organizations designed to deliver justice in order to deny it.

MacLean smiles at this. “I did seven years so far. I can do seven more if they want. There’s too much at stake to just give up.”

Listening to the radio today, during a discussion about the hunger strike at Guantanamo Bay, one person’s statement began “Aside from the ethical issues”. His meaning was that if the ethical issues are overlooked, everything else about his statement was acceptable.

What has happened to us? How can overlooking ethical issues even exist as an option?

The question they were discussing had to do with the forced feeding of prisoners who are holding a hunger strike. This is Guantanamo Bay, Cuba. A little patch of hell on an otherwise tyrannically repressed island that we have leased since 1903. Our modern variant of the Black Hole of Calcutta, replete with new horrors gained from our society’s advancements. The primary ethical question should be “Why are we using this place as a prison?”. We’ve had to put many ethical issues aside in order to get to this point, why not keep it up?

In the days following 9/11, suspected terrorists were detained world wide. We were not technically at war (nor were we in Korea or Viet Nam), so we couldn’t hold them as Prisoners of War (besides, if we did we would have to comply with the Geneva Conventions). The fact is, we couldn’t hold them at all. So we dug up the term “Enemy Combatant”, but if we brought them to America we would be constrained by Constitutional Protections. So we found our own little Black Hole, outside of the jurisdiction of anyone we might care about.

This works better than renditions. We get to maintain custody, and there are no constraints.

A brief aside. We began to openly acknowledge a difference between “Legal” and “Moral” in the 90s, “Moral” meaning “Well yeah, in a perfect world, but I’m not legally required to be moral”.

Questioning of prisoners was not restricted to any of the rules of the American Constitution, or the Geneva Conventions, or Human Decency. Triple play. Information leaked anyway, and the American public debated whether water boarding was a legitimate interrogation technique or torture, but who cares? We could do whatever we wanted anyway.

Another brief aside. As a person trained in interrogation techniques, I can unequivocally make the following statements. Torture is in the hands of the interrogator, anything can be torture. Torture does not produce meaningful intelligence. Performed properly, water boarding is not torture.

Along comes a Presidential candidate, and he promises to close Guantanamo Bay. The rationales are endless, but the essential reason is never stated. It is immoral to hold human beings indefinitely and with no restrictions as to their treatment.

That was in 2008. Now it’s 2013. Guantanamo Bay is still open, and people are starting to realize just how long “indefinitely” can be. Of the original 779 prisoners, over 500 were released prior to our current President taking office, leaving 242. Of the 166 prisoners still being held, 86 have been approved for release, but no one will take them. Forty six human beings have been designated by the Obama administration for indefinite detention with no charge or trial.

Presently, one hundred prisoners are on hunger strike. Rather than let them starve, which would be…unethical? they are being force fed, which is…unethical. What quandaries you find when you go dancing with the Devil. When you need to start by using restraint chairs, a device that is so inhumane that not only human rights groups, but even the severe Maricopa County Jail has banned their use, you should have a clue you’re heading down the wrong path. When you recognize that medical personnel will not participate in a medical procedure (intubation) due to ethical restraints, maybe you need to rethink your procedures. These are the issues you run into when you maintain your very own Black Hole. Simply creating new euphemisms for illegal practices can’t work forever.

Long ago I learned that humane is not equal to aesthetic. Very good things can be horribly ugly. This applies not only to the visual realm, but also to our souls. This process works both ways, the Autumn Crocus is exceptionally poisonous. Way back in 2001 using Guantanamo Bay as a prison seemed like a reasonable idea, aside from the ethical issues. Five years ago most of us had realized it was a bad idea. If we cannot tolerate twenty dead children in Connecticut, how can we fathom one hundred prisoners, some already cleared for release, still being tortured? Is there any reason for Guantanamo Bay to be open, at all? And yet, it appears to be out of the President’s hands.

Violating our beliefs does not get better with time, it gets worse. When we step away from being ethical, we step away from being human.

Another prison hunger strike is looming in California, where more than 200 inmates at the Pelican Bay supermax have been in solitary confinement for between five and ten years and nearly 100 have been shut off from most human contact for 20 years or more. Across the nation, on any given day, more than 100,000 inmates suffer in solitary – about 25,000 in the federal system and another 80,000 or so in state facilities. That’s the equivalent of locking up every man, woman and child in Charleston, South Carolina, in their own little 8 by 12 foot box – for an eternity. Nothing like this American form of mass human torment has ever existed on the face of the earth: systematic, industrial strength torture, multiplied 100,000 times per day. Solitary confinement as a form of routine, mass punishment is beyond barbarity. Nowhere in human history do we find barbarians who tortured hundreds of thousands of people every day for decades at a time. Only in America.

Solitary confinement, by its very nature, is designed to ensure that no one but the torturers hears the cries of the tormented. However, knowledge of such monstrous evil compels decent men and women to action, in solidarity with those who have been wronged. The prisoners of Pelican Bay, who went on hunger strike in 2011, have sent word that they will do so again, on July 8, if the state of California does not meet their core demands. One demand is fundamental: that inmates not be confined to solitary unless they have been charged, “and found guilty of, committing a serious offense… a felony!” Instead, inmates are consigned to a life of oblivion based on anonymous allegations that they are affiliated with a gang, or for exhibiting the slightest hint of political thought – or for no discernable reason, at all. Not only is lengthy solitary confinement unconstitutionally cruel and unusual punishment, and a form of torture under international law, it is totally arbitrary and capricious.

In California, alone, more than 14,000 prisoners are held in isolation. The Pelican Bay inmates anticipate many of them will join the hunger strike, as thousands did in 2011, when 13 prisons were involved in the protest, and three inmates committed suicide. This time around, prison organizers have invited the participation of “all male and female prisoners across the U.S. prison systems,” both state and federal. Inmates in Georgia went on hunger strike in 2011 and again last year, pressing a range of demands.

If the California prisoners are forced to put their lives on the line again, on July 8, support networks need to be in place, beforehand. Today, it was as if time kind of stopped as I came to terms with stopping a pattern I’ve recently become strangely aware of myself as.

I guess the truth that I don’t want to speak of is how I’ve become like ‘a woman of war’, that war being the war I’ve waged against the cancer within me… And, I realize I’m no longer willing to continue the war because it’s Not necessary in order to recover.

From the moment I was diagnosed with cancer I’ve been researching and researching and educating myself about the many different kinds of alternative treatments for cancer. So, when I decided on which treatment plan I would be applying, I quickly dove right in, knowing full well that the sooner I move to set my plan of action into motion, the sooner I’ll be on the road to recovery. That was well over a month ago and now I have a well established daily routine that is designed in full support of my physical body first and foremost…

I knew in the beginning that following the strict metabolic diet would be a challenge as well as would taking the massive amounts of daily enzymes, vitamins/minerals, daily injections and daily enemas. All of which is going to require some getting used to and the most effective way to redesign my days accordingly, to be most effective, is to be consistent.

And, with regards to consistency, ‘Blogging’, that’s where I began to understand the Principle of Consistency. The kind of consistency I’m referring to is like nothing I’d ever been before, and I discovered this for myself as I began applying the tools offered through Desteni I Process – which is a life-changing course that everyone will benefit from.

Those very tools assisted me today to’stop and smell the roses’ so to speak… To see, realize and understand that fighting my way through this is Not the solution because the fight I’m referring to has existed from the fear within and as my mind of dying. So, am I actually only fighting for my own right to die???

Ok, so, what in the world am I fighting for? Am I fighting for my right to react or my right to exist? And what about EVERYONE else? Is any of what I’m fighting for going to make one bit of difference in the lives of everyone else on earth or just a difference for me?

At what point do I Stop fighting for what I’d like to receive and instead Begin Giving what I’d like to receive?

Alright that’s all for now as it’s a began a slow rain with a gentle thunder so I’m off to bed to snuggle with my partner.

What happens when you run strap a prisoner down and run a tube through his nose to feed him? What if it’s twice a day? What if it’s one hundred people every day?

This is what’s happening at the prison camp at Guantanamo Bay.

It’s hard to make the argument that the internment of suspected “enemy combatants” in a prison at Guantanamo Bay is a good thing. It’s expensive, difficult, bad press, and violates basic conventions of the rules of war–and, of course, US law. Candidate Barack Obama said all this in 2008, promising to close the prison camp within his first year in the Oval Office.

It was only one of the issues that encountered difficult resistance from Capitol Hill, and it’s one that he didn’t fight–at least not much. Four years later, Gitmo still open, with all the deficits he identified before becoming president, the issue of an off-shore prison camp barely registered in the campaign. After all, one of the attractions of interning prisoners in Cuba is their relative lack of visibility back in the US.

In America some activists keep trying to put Guantanamo back on the political agenda, organizing protests, staging hunger strikes, and generally doing anything they can to get attention. Successes have been fleeting, and the issue has often fallen to the back of the agendas of even most peace groups.

The prisoners themselves have created the latest blip in a history of neglect that stretches more than a decade. When a new rotation of guards allegedly mistreated Korans (I’m sure there’s more to this), the prisoners staged a new round of hunger strikes.

The hunger strike is inherently coercive, and it depends upon eliciting a reaction from others who recognize the humanity of the striker. These strikes began in February, and by most reports, now include most of the 166 prisoners at Guantanamo. The United States has been force-feeding the strikers–with tubes through their noses. It’s awful, and it’s hardly good press for the prison or, more generally, the US and its humanitarian goals. Still, it’s preferable to a series of deaths.

President Obama said as much when he announced that he would re-engage the issue of closing the prison camp. But this was days ago, and he’s been having a hard time with Congress on other issues that most of the public cares far more about, like immigration, guns, and jobs.

Activists would be wise in not expecting follow through from President Obama without significantly more pressure. Some groups are trying, again. Witness against Torture is promoting sympathy hunger strikes. Code Pink is doing the same. Twenty-four human rights organizations, including Amnesty International and the American Civil Liberties Union have signed an open letter calling for the prison to be shut down. (This too has happened before). Organized groups are also trying to stage demonstrations to put the issue higher on the national (and Obama’s) agenda. The point: the mass hunger strike gives activists and politicians the opportunity to raise the issue again. Making change, however, requires a sustained commitment from those outside the prison’s walls.
