Undang-undang Informasi dan Transaksi Elektronik akhirnya disahkan tanggal 25 Maret 2008, dan bermunculanlah pro dan kontra terhadap pengesahan UU itu, termasuk Menkominfo menjadi sasaran serang para kelompok yang kontra terhadap UU ini. Saya juga mendengar rekaman audio/visual dari wawancara Pak Nuh di Perspektif Wimar (gaya ngomongnya tetap sama saat menghadapi mahasiswa ketika masih jadi Rektor, ngewongno ), yang disertai narasumber lainnya Pak Budi Rahardjo dari fany.

Sebuah program maju bagi bangsa ini ketika sebuah langkah2 strategis digunakan untuk memajukan bangsa dengan bermoral. Siapa sih ngak mau kalo situs porno yang jalur publik (sekali lagi publik, dicatet) diblokir? Saya tidak menganggap bahwa saya sudah punya moral lebih baik atau sudah tidak mau melihat yang p***o itu, tapi setidak memberikan minimalisasi terhadap kejahatan2 lainnya.

Acara Sosialisasi UU ITE dan Pengelolaan Akses Internet Sehat ini, selain diisi dengan arahan sosialisasi dari masing-masing pejabat tinggi yang hadir, juga didemokan sebuah sistem pemblok gambar dan video porno atau Porn Blocking System. Dalam demo tersebut, ditunjukkan bagaimana sistem tersebut mengenali gambar-gambar dan video porno yang dibuka dalam komputer.

Diungkapkan oleh Sukari Dhoto, salah seorang pengembang Porn Blocking System, sistem ini berbeda dengan sistem yang telah ada. Pada umumnya, pengenalan situs porno hanya difokuskan pada basis teks dan internet protocol (IP). Tapi, Porn Blocking System ini langsung pada pengenalan gambarnya. “Pokoknya, bila gambar dan video itu porno, entah situsnya porno atau tidak, maka gambar dan video itu tak bisa dibuka. Tapi sistem ini belum sempurna, masih 95 persen,” tutur Sukari yang juga dosen muda PENS ini.

Sistem pemblok gambar dan video porno ini ternyata menarik perhatian Menkominfo. Terbukti, diakhir demo Nuh menyempatkan diri untuk memberikan apresiasi. “Sistem ini bagus sekali. Terus dikembangkan saja. Tapi, saya sarankan ujicoba deteksinya jangan di ruang kelas, di ruang tertutup saja. Takutnya, pesertanya kelimpungan melihat gambar porno yang mau dideteksi. Lagi pula sampean apa mau ditangkap pak Eddy ini gara-gara buka gambar porno?,” tutur Nuh disambut tawa dan tepuk tangan meriah peserta.

Sistem pemblokiran situs porno berdasarkan image processing (bagi anda tidak mengetahui image processing bisa dilihat jurnal-jurnal ilmiahnya di sini) sebenarnya sudah lama dikembangkan di ITS terutama TA mahasiswa, dan sekarang sudah menjadi garapan serius ketika UU ITE ini juga diajukan. Contoh sederhananya bisa di liat di situs ini yang sebenarnya sudah basbang karena sudah diposting chika di sini, mendeteksi kemiripan wajah.

Nah memang sih program itu masih dalam proses pengembangan tapi itu menunjukkan bahwa kemampuan teknologi sudah sampai untuk melakukan hal itu. Saya masih optimis pemerintah melakukan hal itu dan juga disertai dengan pola pembinaan lain yang lebih mendidik ke arah positif seperti yang disarankan pak Budi Rahardjo.

Yang saya cermati dari UU ini adalah yang dibahas oleh pak Anggara yang seorang blawgger itu tentang beberapa pasal yang dikhawatirkan oleh para pengguna internet maupun blogger tentunya (wah membayangkan jiwa idealisme keluar lagi ketika mengkritisi Perpres 36 menjadi posting pertamaku di blog atau UU tentang ketenagalistrikan).

Lah kalau memang dalam point-point UU itu ada pasal-pasal yang tidak berkenan atau terlalu kaku semisal masalah pencemaran nama baik, dll yah silahkan di-judicial review aja, terutama blogger yang tau hukum dan spesialis IT, saya rasa seperti UU yang masuk ke MK itu juga masih bisa direvisi.

Harapan saya, memang UU ITE masih terlihat umum, pemerintah termasuk di dalamnya Depkominfo dalam penjabaran Peraturan-peraturan di bawah yang lebih bersifat teknis agar memperhatikan harapan-harapan masyarakat terutama masyarakat di dunia cyber yang bersentuhan langsung dengan UU ini. Dan saya optimis Pemerintah (Menkominfo red) tidak akan mengganggu blogger koq kan sudah dijanjikan dalam di pesta blogger lalu karena blogger adalah bagian yang membangun bangsa ini.

Looks like Jed Yoong has done it again…. she has wrote something contraversial about Islam again here – Fitna.

To tell the truth I have not seen the film. Maybe I won’t as I am really not interested. However, I know many will get agitated by that films. Yes – that film will definitely arouse the anger of many Muslims.

I suppose that film will be banned under UU ITE (Informasi Transaksi Elektronik ). This film will obviously melanggar “kesusilaan“… as per article (pasal) 27 of the law. Article 27 also mention “penghinaan” and also “pencemaran nama baik“. All these are hallmarks of the film Fitna…. I am sure….

So I suppose in such an example, UU ITE is justified? So you can’t download Fitna from internet in Indonesia I suppose…

Unfortunately such a legislation may be contrary to the spirit of the Freedom of Speech and Expression. And more unfortunately, people like Geert Wilders are abound. They are many people like him who for one reason or another likes to flame hatred especially within the context of inter-religion relationships… In Malaysia especially there are so many Muslim haters who justify hating Islam just for the sake of freedom of speech and expression!

This reminds me of the song Begitu Salah (Tapi) Begitu Benar… a song by 3 beautiful ladies who call themselves Dewi-Dewi…

You have to think like this… censoring Geert Wilders is a right thing to do, because you cannot let people like him create trouble in society. Unfortunately by silencing him, you are killing freedom of speech and expression. However, which one is more important? Freedom of speech or maintaining law and order (and social harmony)?

And remember, you have quite a few Geert Wilders here in Malaysia and throughout the globe!!!

Tell me if you have an answer….

I suppose I have to say that I wish people like Geert Wilders do not exist! These people are encouraging all these censorship laws…. These censorship laws may be appropriate for people like Geert Wilders. Unfortunately it may also hinder genuine and responsible expressions. In other words, people like Geert Wilders (by all their antagonistic approach) are actually destrying the freedom of speech and expression. He will certainly encourage tougher censorship laws in many Muslim (and Muslim majority) countries…

If I have my my way, I would say to Geert Wilders to stop all this antagonism towards the Muslims. I would even tell him to apologise and take back all his claim that he potrayed in his film.

But I suppose that is my opinion…..

Anyway, Geert Wilders is doing all these not for the sake of freedom of expression! After all he did call for the suspension of Muslim Dutch citizens’ rights… for those whom he suspect as “promoting Islamic extremism”…

Aha…. the discussion in Jed Yoong’s Fitna is certainly getting crazier… anyway…. let them (commenters and JY) be…. Let them be…..

According to the news…

Indonesia’s parliament has passed a bill criminalising those who access internet sites containing violent or pornographic material.

Anyone found guilty of the new offence could be jailed for up to three years, or have to pay a heavy fine.

The legislation allows the courts to accept electronic material as evidence in cases involving internet abuse.

One of those involved in drafting the bill said children, in particular, needed protection from online images.

It passed with wide majority support from all 10 factions in the chamber.

The news piece does not mention the specifics of the proposed legislation. But of course if you are an Indonesian observer, you might say that the legislation is the UU Informasi Transaksi Elektronik or UU ITE.

Note UU = Undang -Undang.

UU ITE looks severe. So if you are in Indonesia and you are thinking about getting naked pictures of Sandra Dewi via the internet, you got to do it fast before April, that is the date when the proposed law takes effect.

UU ITE and other censorship laws serve a (or even several) purpose(s). Some of them may beneficial to society.  However what are their impact(s) of the freedom of speech and expression.  Undeniably this is a complex issue.
