<p><span style="font-size:11pt;color:#000000;line-height:150%;font-family:Verdana;">Okay, my <a href="http://flickeringscreen.net/2013/05/19/go-boldly-star-trek-into-darkness/" target="_blank">initial review of</a> <i>Star Trek: Into Darkness</i> (is there a colon in the title? It feels like there should be a colon) was a bit threadbare. Yeah, it’s hard to talk about the movie without getting neck-deep into spoiler territory. So, here is my SPOILERRIFFIC™ discussion of <i>Into Darkness</i>. If you haven’t seen the movie yet, don’t click the READ MORE link. Just, uh, hey click this link and read about another movie with <i>Darkness</i> in the title. It’s called <a href="http://flickeringscreen.net/2012/01/19/pitching-and-catching-creature-of-darkness/" target="_blank"><i>Creature of Darkness</i></a>, and it really crazy. Seriously. It’s got this alien that dresses in a raincoat and hat and hunts people, and…well, just read it. Unless you’ve seen <i>Into Darkness</i>. Then, click away…<br />

<span style="font-size:11pt;color:#000000;line-height:150%;font-family:Verdana;">So, I assume we’ve all seen the movie, right? Okay, cool. Now, let’s unpack some of the problems I had with the movie in gory detail. First off, remaking <a href="http://flickeringscreen.net/2013/05/18/star-trek-roundup-star-trek-the-wrath-of-khan/" target="_blank"><i>The Wrath of Khan</i></a> is a truly awful idea. As I pointed out in my review of it, <i>TWOK</i> basically created <i>Trek</i> as we know it. They essentially remade it when they <a href="http://flickeringscreen.net/2013/05/18/star-trek-roundup-star-trek-2009/" target="_blank">rebooted the series.</a></span></span></p>
<p><span style="font-size:11pt;color:#000000;line-height:150%;font-family:Verdana;">But the biggest problem is that <i>TWOK</i> is a damn-near perfect storytelling machine. There is nothing extraneous, nothing overly ambitious, and the screenplay moves with the precision of an <a href="http://www.omegawatches.com/gents/seamaster" target="_blank">Omega Seamaster</a>. It establishes emotional stakes, tells a rollicking story, and ends with an emotional catharsis, and everything in the movie works to those ends. Monkeying with that is a fool’s errand.</span></p>
<p><span style="font-size:11pt;color:#000000;line-height:150%;font-family:Verdana;"><i>Into Darkness</i>, on the other hand, is rife with problems that nag as soon as you leave the theater, to wit:</span></p>
<p><span style="font-size:11pt;color:#000000;line-height:150%;font-family:Verdana;">* <b>Khan:</b> He makes no sense in the context of this story. He worked perfectly in <i>TWOK</i>, because he is an enemy from Kirk’s past, repercussions of a long ago judgment call that turned out bad. This fits perfectly in a movie about Kirk reckoning with middle age. In this he’s just, well, there. He has no history in the rebooted series and is barely introduced through some rushed exposition. Rather than have a tangible story that establishes his ferocity, we’re expected to understand the danger he poses, because, well,  we all liked <i>TWOK.</i> Dude, that’s just lazy.</span></p>
<p><span style="font-size:11pt;color:#000000;line-height:150%;font-family:Verdana;">*<b> Admiral Robocop: </b>Are any Admirals in Starfleet not criminals? I mean, we had that one is <i>DS9</i> that tried to impose martial law, the one in <i>TNG</i> that brokered a backdoor deal with the Cardassians, the one who collaborated with Klingon assassins to derail the Federation/Klingon peace negations…I mean, aside from Kirk, it seems like once you get those Admiral’s bars you immediately become power-mad, hatch the worst scheme possible, and maybe end up <a href="http://www.ign.com/articles/2009/05/06/worst-10-star-trek-movie-moments?page=3" target="_blank">facelifted to death</a> for your troubles.</span></p>
<p><span style="font-size:11pt;color:#000000;line-height:150%;font-family:Verdana;">* <b>The Plan:</b> So, can someone explain this to me? Admiral Robocop’s plot seems to be: 1) thaw out Khan, 2) ???, 3) win the war they aren’t fighting. Uh…a lot of this is confusing. Mostly that middle part, wherein Khan helps design war machines for the Federation. The guy who’s been on ice since before the invention of warp drive. Sure. And if we had a <a href="http://tardis.wikia.com/wiki/TARDIS" target="_blank">TARDIS</a> we could ask Alexander the Great for help upgrading our drones.</span></p>
<p><span style="font-size:11pt;color:#000000;line-height:150%;font-family:Verdana;">* <b>The torpedoes: </b>Khan puts his crewsicles inside the torpedoes he designed. Admiral Robocop kept them there for leverage against Khan. Neither of these seem like good ideas. Or even ideas any rational human being would come up with. Or ideas any human being blitzed on Boone’s Farm and mescaline would come up with. This is a bad MacGuffin.</span></p>
<p><span style="font-size:11pt;color:#000000;line-height:150%;font-family:Verdana;"><b>* Kirk’s sacrifice:</b> In the context of this story it’s pretty meaningless, and has no emotional stakes. Think he’ll stay dead? Of course not. Further, his relationship with Spock is still new, so the moment lacks any emotional fission. Certainly, it shouldn’t send Spock on a rage-fueled quest for vengeance.</span></p>
<p><span style="font-size:11pt;color:#000000;line-height:150%;font-family:Verdana;"><b>* War with the Klingons:</b> Like every other motive in this movie, the reasons for this are heard and not seen. Why does Admiral Robocop want a war with them so badly? Is he bored? Desk getting a bit constricting? I mean, he gives a little speech before he sends Kirk on his kamikaze mission, but it lacks any real rationale. Couldn’t we at least see some sign of aggression from them? Get some idea of the threat they pose? This would give us some idea of why he hatched the Worst Plan in History and give the film the moral complexity it wants to have. And hey, is it a good idea to have a model of your Super-Mega-Banzai battleship right there on your desk?</span></p>
<p><span style="font-size:11pt;color:#000000;line-height:150%;font-family:Verdana;">With all that, why do I still like this movie so much? I’ve been pondering this question for several days now, and finally it hit me: because I’m a <i>Star Trek</i> fan. I’ve been with it since my uncle took me to see <i>TWOK</i> in 1982, through thick and thin, and you know what? This is still a <i>good</i> <i>Trek</i> movie. I mean, we’ve had Kirk makes jokes about farting, <a href="https://www.youtube.com/watch?v=VYezfpJvFsw" target="_blank">Spock nerve-pinch a horse</a>, <a href="https://www.youtube.com/watch?v=QmpACfDiLtE" target="_blank">Kirk die by falling off a bridge</a> on a shithole planet, a movie about a bunch of Space Amish people, Data clowning around, and <a href="http://flickeringscreen.net/2013/05/18/star-trek-roundup-star-trek-nemesis/" target="_blank">that last <i>Next Gen</i> movie</a> made by a director who <a href="http://www.avclub.com/articles/star-trek-nemesis,22322/" target="_blank">couldn’t even be bothered to remember his actor’s names</a>. I mean, c’mon! We’ve been through so much mediocrity a big, exciting, well-made spectacle is still heads-and-shoulders above a lot of the series, even if it had severe narrative problems.</span></p>
<p><span style="font-size:11pt;color:#000000;line-height:150%;font-family:Verdana;">Plus, you know, Kirk threesome with some alien twins with tails. Something well suspected went on, but never had the proof.</span></p>

<content:encoded><![CDATA[<p>With new business getting more difficult to find, you should be leverage every appropriate marketing opportunity you can find to increase your lead flow.  Obviously, referrals are always best, but since the market downturn, there are less referral’s available.  There are other methods that work as well like job signs, truck signs, and direct mailing to expand your exposure in your service area.  Internet-based lead referral companies are another way to maximize your exposure with potential customers.</p>
<p>Internet lead referral companies are getting more and more popular. Largely unheard of several years ago, companies like HomeAdvisor, Reliable Remodeler, BestContractors, QualitySmith, and SafeEstimate are showing up on the marketing landscape. The simple reason for this is that more and more homeowners are using the Internet to research and locate contractors for project, repairs or improvements. I’ve heard numerous comments regarding the quality of Internet leads, and after spending a fair amount of time working on more effective ways for homeowners and contractors to communicate more effectively, I can provide you with a summary of what Internet leads are, and how to incorporate them into your current lead flow.</p>
<p>Online leads are neither good nor bad.  Simply, they are an introduction to a potential customer in a targeted market area. When a contractor receives an Internet lead, they are receiving the contact information from a homeowner who wants some help. You won’t know how serious the homeowner is, you won’t know when they want to start, or if their budget is realistic. You will, however, possess that homeowner’s contact information, and that asset is what you are purchasing. Because Internet leads are targeted by service area and task, you can ask that the homeowner information you receive be targeted for the areas you service. I make that point because most referrals come from specific neighborhoods where houses are the same age, and the homeowners have similar incomes to be able to live in that area.</p>
<p>If you understand the demographics of your best customers, you can request Internet-based project, repair, or improvement leads in those same project areas. While you won’t know how serious those potential customers are until you qualify them, you are assured that they live in homes that match the areas and demographics of your best customers. Over time, this should translate into additional customers for your business. I have spoken with contractors who used to a 25% closing ratio on sales calls and with this economy, homeowners are being more conservative, and cautious. The key to being successful in utilizing Internet-based leads is what you do with that homeowner contact information you receive. </p>
<p>It’s becoming imperative to develop a good marketing pipeline for your business success. A pipeline is simply a list of homeowners who have inquired about your services at some point in the past. Homeowners are going to be working on their homes, but many are postponing the work. To help insure your success in the future, expand your marketing efforts to reach out and touch as many of these potential customers as possible. The key to developing an effective pipeline is to follow-up with your prospect pipeline on a regular basis. Once they are in your pipeline, make sure to reach out to them no less than once every 90 days. Help brand your company name in their awareness by developing a marketing campaign that can include the following:</p>
<p>•   Develop a newsletter for your company<br />
•   During each of the four season inform homeowners what they need to do in preparation<br />
•   Notify homeowners when new projects  are in their neighborhood<br />
•   Host homeowner seminars on a variety of home improvement projects<br />
•   Invite homeowners to an open house if you have a past customers that will help you<br />
•   Provide project pictures from completed projects in the area<br />
•   Host dumpster days (allow homeowners to use the excess space in a project dumpster)</p>
<p>You need to understand that marketing is a numbers game, and your job is to keep the homeowner aware of your company, products, and offers so that when they decide to move forward, you are in a position to “win” that project.  </p>

<p>I went camping over the weekend and had a pretty good time to tell the truth. But the best part of it all was no internet and no phones, I hate to say it but I felt a lot calmer not having to reply to emails and texts, make calls or pretend I don’t have my phone on me and didn’t hear someone calling.</p>
<p>Does this make me a bad person or something? I just really not sure how to feel about this. On the one hand I had a good time and not having to worry about those things was great, but here on the other hand I am writing this very blog post on a computer that by the time you are reading it will have been posted on the internet for the world to say about it what ever they feel like.</p>
<p>Hmm my brain likes to over think things and kill itself doesn’t it….</p>

Persons on the Left, salaried wonks and lobbyists, believe there should be no ownership of Copyright, further arguing the current term, of Life plus 70, is not only too long but should not exist at all because they believe nothing on the Internet should be owned at all or have been owned long enough.</p>
<p> Cool beans. I argue that all is fair in Love and Property Ownership, stating that highly paid proponents of a Free Internet should neither keep their paychecks nor their family heirlooms which I contend they have owned long enough, further stating that I will give up my copyright to others for free use when über paid athletes, actors and Warren Buffets , successors and accessors to his Wealth give up their rights and claims, until then?</p>
<p> GAME ON!</p>
<p> Two hundred years plus after the Founding Fathers established a precedence for Copyright Protection, a Property Right, the 113th Congress chastised from the bench that involved parties are talking at each other, not with each other nor with consensus. Chairman Coble of the Subcommittee of &#8216;Courts, Intellectual property and the Internet&#8217; pointed out in his opening statement, disrespect is being shown to Intellectual Property Creators by Opponents who believe in a Free Internet.</p>

<p>The hearing, Subject, &#8220;A Case Study for Consensus Building: The Copyright Principles Project.&#8221;  </p>
<p> Committee minority leader Mel Watts applauded the We Right The Song event he attended earlier in the week, reminding those who exploit Artists there has been a shift in attitudes to Copyright Protections. Watts reinforced that Free Speech does not mean Free Stuff. Watts addressed those present in the Hearing Room, stating consumers deserve clarity over use of Intellectual Property, IP. Business models must accommodate the digital revolution keeping the focus on creators and not those who exploit them. Mel spoke out for the Committee’s position to enure the rights of the creators, stating the world will be better if the creative community&#8217;s rights are protected.</p>
<p> The Hearing witnesses are participants in a multi year program, The Copyright Principles Project,&#8217; coordinated by Professor Pamela Samuelson. The project, A Case Study for Consensus Building: The Copyright Principles Project.&#8221; CPP participants have met a few times a year, a few days at a time, towards an end goal of consensus on revamping the United States Copyright regs to facilitate the shift of Intelligent thought in a technologically driven world. The Committee was stacked- lawyers, librarians, law professors and, as duly noted and chastised by Legislators- not one representative from the creative arts community. Professor Samuelson indicated her panel participants are all authors. An author on a salary as a professor, staff of the Registry of Copyrights, college does not equate an artist with a song in their heart or a chalk stick in their hands, hoping their passion will pay rent or put food on their table. True artists were not invited to the table. Samuelson said she would have had to invite 50 people. So she invited none.</p>
<p> Witnesses included Jon Baumgarten, former General Counsel of the  US Copyright Office, from 1976-1979 (witness 1); of North Carolina School of Law, a librarian (witness 2);  Dr. Daniel Gervais, Vanderbilt School of Law (witness 3);  Professor Pamela Samuelson,  University of Berkley School of Law (witness 4); and Jules Sigall, assistant general counsel of Copyright for Microsoft Corporation (witness 5).</p>
<p> The Copyright Principle Project report, released in advance of the Thursday late afternoon meeting, was impossible to read without pen in hand. By Page End,the right and left page columns were peppered with WTF and OMG&#8217;s. This report was not conceived of by creative sorts who rely on payments and royalties for survival. Thus was a report written by retired self interested self-described intellects with weekly paychecks, annuities and a need to publish, to stay relevant.</p>
<p> Witness 1: Jon Baumgarten adressed the Copyright Principle Project, the CPP, as a collegial session on stewardship facing the country. Baumgarten presented the result of paid for weekends away as real dialogue emanating from participants listening to each other. The process, developing the Copyright Principle Project, did not generate a great deal of agreement, Baumgarten said, rather, recording a lack of consensus requiring more study, as the exercise demonstrated how a committee can agree to disagree. Otherwise known as a stalemate though not being irrelevant. Baumgarten said the Copyright Principle Project recorded the nature of the disagreements, between proponents if the Free  Internet and their opposers, presenting the focus of the Copyright Principle Project more on the users of IP, Intellectual Property, rather than on the creators. Baumgarten said it is going to take patience to address this problem citing that people look for quick solutions for complex problems. Baumgarten, general counsel of  the Copyright Office in 1976 &#8211; 1979, a survivor of the earlier debates, made his point to state the tone of the debate rhetoric is important. Baumgarten said the pace for change is driven by people confused by the pace of technology  looking to push the past aside. Baumgarten, hesitated at being asked to speak for individual creators, does not feel the concern is or should be that copyright law is broken and dysfunctional. Baumgarten&#8217;s concern, he advised, is that each side listen to each other for solution as Copyright, countered as an impediment, things, rhetoric and debate, get loud.</p>
<p> Witness 2: Professor Laura Gasaway&#8217;s ‘walkaway’ of the trip to &#8216;Copyright&#8217; consensus, she presented to the legislators  is that friendship and law dominated the panel she convened and that friendships evolved over the panels intermittent weekends away debating the Copyright Principle Project. Gasaway explained the community of her focus, on the importance of copyright, was institutions, educational users, archives and museums relying on Copyrighted materials ie books, mags, videos, internet, etc. Gasaway said the 1976 Copyright Act, effected during Baumgarten&#8217;s tenure as General Counsel for the Copyright Office, does not work well for library users. Gasaway speaks as a librarian, in a culture of cutbacks and free Ebola, etc on the &#8216;Net.&#8217; Gasaway said she wants removal of regulations from statutes taken into consideration for the unique role of museums, archives and education. Gasaway wants expanded rights for  museums to utilize digital technology for preservation. Gasaway said, deferring to the European proposed model, she wants a repeal of  Statute 108 of the Copyright Regs, asking that the Register of Copyrights rely completely on 107, Fair Use. Gasaway failed to clarify to the legislators that Fair Use is heavily within Copyright defense, in that Fair Use means a shtickel, a little bit, not the whole enchilada of a photograph, artwork or story. Gasaway acknowledged that maybe addressing libraries and museums needs is thorny, followed by the issue of “the Orphan Works problem.”</p>
<p> </p>
<p>There is no Orphan Works problem if one adheres to the Berne Convention. There is only an Orphan Works problem if someone wants to use IP that is not theirs, refusing to take no for an answer. Gasaway said Orphan Works is important to adress, stating that mass digitization is important for libraries. Gasaway said there is a group in the UK simplifying copyright law. Gasaway did not state that simplifying something is codifying it with an index, a summary, a short sheet. To allow people to understand Copyright Law, write a book for NOLO, the publisher who simplifies Tenant and other laws for consumers but leave the law alone- just bullet point it.</p>
<p> </p>
<p>Gasaway said photocopying in law school is almost dead suggesting that most of the photocopied items are licensed, between what Westlaw and the Courts put on line. Gasaway said that law schools do pay for IP but their law students don&#8217;t, relying on free access to the Internet. Law school of today, Gasaway said, is multimedia, used both by students, teachers and librarians. As an academic, Gasaway admitted she is concerned with the abuse of her work. She is seeing a trend in her colleagues using more off the Internet as a licensed and real solution. Gasaway left out of her conversation consideration for Copyright Creators, excluding Copyright Creators even though she didn&#8217;t think she did. Congresswoman Judy Chu said Internet Copyright Infringement is a whack-a-mole process individual Creators feel they can&#8217;t win within effecting a take down that is then back up on the Internet within hours. Gasaway, feeling if the take down notice is not effective then it should be adressed by the committee, said the CPP project didn&#8217;t not water down Copyright Law but strengthened it. Then again, Gasaway is a librarian not a Creative who she feels there is a problem with. Rights have to be pursued through courts in a system that favors the big guys. Gasawat said compromise which is not a dirty word. Stop being polarized, Gasaway admonished the Creative IP community and focus on how to make work available. No truer words said from someone best described in my biggest lesson about Artists and Agents- a pimp/whore relationship between those who have nothing to sell and need something to sell hence the Artist is courted. Or here, where the artists community is pillaged by those who cannot generate the IP they so desire…..</p>
<p> Witness 3: 1790 &#60;&#62; 1903 &#60;&#62; 1976 . Three dates important to history in the issue of Copyright, pointed out Dr. Daniel Gervais, Vanderbilt School of Law, who sees Copyright creators as small businesses who should flourish. Gervais wants access to IP by Users, seeing a win-win on maximizing Authorized Use rather than focusing on Unauthorized Use. Copyright was once a set of rules negotiated between Users. The world has changed, said Gervais. The use of streamed movies requires a license. Technology makes it easier to use what belong to others. The international vista is beginning to look like a patchwork of rules. Licensing has become an important vehicle for artists, said Gervais. The future of e-industry as commerce depends on the ability to profit. Gervais wants power left in the hands of the Copyright Office, comparing use of IP to buying a car. A User must be registered to confirm details but a car sale requires that the person selling the car has the right to the car to make the sale. Gervais sees monetization as number one issue, recommending reviewing the licensing structure along with a review of formalities as to how royalties are linked to revenues, acknowledging that professional creators need a way to monetize their works. Gervais, challenging people who say they work on behalf of public interest, said he left Mobile out of his conversation. This was mind boggling, since Mobile is the way of the world, and marketing, at this time. The problem is when regulations are on the books people take advantage of it turning it into a model that fuels the antagonization.</p>
<p> Witness 4: Professor Pamel Samuelson convened the CPP, Copyright Principles Project, she said, after having spoke. with Copyright lawyers and the prior Register of Copyright. Samuelson describes the CPP as an effort to reach out to people of differing perspectives to maybe come to consensus. Samuelson describes the Statute as getting longer and complicated to read, stating the law was drafted in the 1960 s before the Internet. Samuelson’s focus is on public performance rights and not on 2d. Samuelson hoped the filed ideas in the CPP might lead to conversation. Samuelson says a better regime is needed to facilitate licensing, alleging there is not enough information out there. Samuelson says, in the high tech world that IP awards are excessive. Samuelson did not state excessive fees is not the world of the 2D creator. Samuelson did not adress the 2D world. Pamela sees the role of the individual as being an empirical issue needing research. Pamela said a conversation started with mutual respect, can move forward. Samuelson adressed Communication Rights applied to broadcasters. Samuelson did not adress the world of 2D. Samuelson simplified setting category by category at to this is what a performance right does, etc. Samuelson said there is a lot of good citing in the Copyright Law, in that it protects works for a period of time although she wrote the time should  be reduced. Samuelson said the consensus of Fair Ase of IP has allowed Copyright law to adapt during a time of change, feeling the antagonization is due to how people would be able to control their IP better but cannot not being effective as she hoped, fearing a toxic environment. That said no one knows what the net new technological advancement is, said Samuelson reminding that the Founding Fathers were themselves authors. Samuelson said the States had competitive Copyright laws, so a uniform law was valuable to transition to a national way of being as a country. Samuelson summed up there should be a focus on maximizing authorized  use citing the “simple laws” it took her 68 pages to write, acknowledging different types of users and how to retain users to fit in multiple categories.</p>
<p> Witness 5: Jules Sigall, assistant general counsel of Copyright for Microsoft Corporation describes a stress in the world of IP challenged by instant sharing in a smart world. Sigall sees Copyright as a way of enriching knowledge but not enriching people. Sigall said he speaks for Microsoft and their protection of Copyright but Sigall did not address Microsoft’s infringement on the rights of others ie with BING GALLERY using images without permission or license. Sigall sees sharing information as a tool in an information world. Sigall says the rules must adress the issue of information sharing but failed to acknowledge a culture of social entrepreneurs themselves fearing infringement creating a safe harbor to protect the technology companies, the technological version of the wolf in sheep’s clothing. Sigall feels a need for safe harbors for creators, at the speed and scale of the digital world. Sigall wants works unlocked from owners who don&#8217;t care for them, a technological version of Children Protective Services, it seems, able to remove a child from a perceived, or real, environment of danger. Would that not be like role playing the man who kidnapped three women, convincing himself they were safer with him, all the while abusing them for ten years or their lifetime which ever came first- mercifully, ten years came first.</p>
<p> The legislators Q &#38; A showed there is spine in the Committee. The Committee adressed piracy a Microsoft concern, using a takedown system, relying in cooperation of Internet providers around the world. The Good v Evil story was avoided with a focus on trying to unerve each other w Copyright being a functional matter. The legislators reminded the panel that Section 1201 is in place for protection of technology right holders.  </p>
<p> While Cloud Computing is delivering legitimate services, making them valuable, it was acknowledged that things, IP violation, are not going to change but going to continue so there must  be a better way of letting people know how to get hold of,artists, ie databases for copyright authors. Such databases exists. They can be tapped into. But databases come with fees and costs. Artists won&#8217;t want to absorb or cannot afford those costs. There was curiosity whether  strengthening penalties might overreach and burden legitimate use of Copyrighted materials.</p>
<p> Congressman Hank Johnson noted the absence of writers from the CPP, also noted the Copyright change should be in consideration of international partners.</p>
<p> Congresswoman Chu on the Creative Rights Caucus expressed concern there were no creators on the CPP panel and none at the hearing today. Chu, noting  Copyright law has contributed to the economy,  is concerned for what will be if the existing law is continued to be watered down. Copyright must allow transformative technology respecting the creators that are needed. Modifying the act so it can be understood easier and simplified for people was put on the table.</p>
<p> Poe said the Copyright law is twice as long as war and peace and not as funny. Poe said America is better because we have the concept of copyright. Then Poe asked what is good about the law now? What is the worst part of the law. The panel took long to respond and review.</p>
<p> Congresswoman Bass asked the meaning of commercial exploitation and if every download isn&#8217;t just that- commercial exploitation. Bass said once people needed someone to download for them but, now, people can download themselves having the notion that personal use is an exempted activity. Bass noted that WIPO is meeting next month to tweak copyright law for the visually impaired. . There are countries, super region meetings where some countries are invited and other countries are not invited, putting counter treaties forth to the proposed treaties. Bass did not acknowledge that blind or not, permission should be sought for use of IP. The heart of a creative person is empathetic. The average designer won&#8217;t say no</p>
<p> Congressman Collins reminded the Founding Fathers knew every thing has an owner and incentivisation is important. Atlanta is one of ghetto five start up locations in the country. Digress with the report.</p>
<p>Congressman Holding asked why the current Copyright and discussions have become polarized. Witness 3 said because it is important to people who invest time and effort into their engine of creation.</p>
<p> Congressman Jeffries asked about the founding fathers, wanting to know how to strike balance in the competitive environment that exists now. Asked thoughts on strengthening penalties for piracy, he had no answer. </p>
<p> Congressman Descant queried on the use of academics as experts. Academics are IP creators with a paycheck. Noted report focused on utilitarian principles rather than property ,rights the founding fathers  believed were important, citing CPP report said copyright is not a property&#8217;s right that it is a utilitarian right.</p>
<p> Congressman Mel Watts summed up the query for 20 pages as proposed by the CPP repudiant Pamela Samuelson. Samuelson said Copyright law can be be done in 20pages. It would have to be enforced and by whom. Not the copyright office, since they have no enforcement. Property theft is perceived as property by the Founding Fathers who envisioned culture of property and people never imagining those principles would be stomped on by a group who want things free….</p>

After his freshman year of high school, the precocious, computer-savvy kid decided to drop out altogether to devote more time to his passion for technology.</p>
<p>A few years later, Karp built Tumblr &#8212; the wildly popular blogging forum &#8212; from his tiny childhood bedroom, hunched over his laptop with bags of Tostitos. And on Saturday, the 26-year-old technology wunderkind returned home to inform his mother that, in a game-changing transaction, Yahoo was buying Tumblr for $1.1 billion.</p>
<p>&#8220;There were a few tears and lots of hugs, and a lot of excitement,&#8221; said his mother, Barbara Ackerman. &#8220;This is something that he built &#8212; it&#8217;s his baby &#8212; and it&#8217;s emotional.&#8221;</p>

<p>The deal was a transcendent moment for Karp, who created one of the world&#8217;s busiest websites. It boasts 75 million daily posts and a user base that&#8217;s loyal, young and hip. While Facebook has morphed into a mainstream social network where grandparents talk golf, Tumblr is still that little corner of the Internet where the cool kids hang out.</p>
<p>True to the company&#8217;s laid-back, jeans-and-sneakers culture, Karp&#8217;s wry sense of humor remained intact on Monday morning, when all employees were summoned to a meeting in Tumblr&#8217;s New York headquarters. Cognizant of media reports that Tumblr was on the verge of a sale, everyone waited with bated breath as Karp kicked off the meeting with a tongue-in-cheek announcement: It was time to formulate a new &#8220;dog policy.&#8221;</p>

<p>&#8220;We have gone above and beyond with our dog policy,&#8221; he told them. &#8220;There is now one dog for every five people in the office at Tumblr at any given time. So we are needing to figure out a better bathroom situation.&#8221;</p>
<p>With just six years of Tumblr&#8217;s existence under his belt, Karp told The Associated Press that he still considers himself to be a green executive. But he&#8217;s learning that he can no longer play the same role that he did in the early days, when he spent most of his time writing computer code.</p>
<p>&#8220;Now the team that I get to work with writes much better than me,&#8221; he said.</p>
<p>Today he&#8217;s the &#8220;chief motivator, the guy jumping around every week to make sure the employees are excited about the product we are building and the direction we are headed in,&#8221; Karp said.</p>
<p>&#8220;He doesn&#8217;t have a pretentious or egocentric bone in his body,&#8221; said Steve Nelson, the head of The Calhoun School, a private institution Karp attended until the eighth grade. &#8220;He doesn&#8217;t take himself too seriously.&#8221;</p>
<p>Yahoo said Monday that Karp will remain in control of the service in an effort to retain the same &#8220;irreverence, wit and commitment to empower creators.&#8221;</p>
<p>Tumblr, which will remain based in New York, has a minuscule 175 employees, compared with Yahoo&#8217;s 11,300.</p>
<p>Yahoo CEO Marissa Mayer showered praise on her new employee, saying Karp possesses a rare combination of computer programming prowess and a sense of aesthetics.</p>
<p>&#8220;He will be one the legends of his generation in terms of an entrepreneur who has really changed the way people express themselves,&#8221; Mayer said.</p>
<p>When he was a little boy, Karp showed an early fascination with electronics and liked to pull toys apart and reassemble them, his mother recalled. By age 14, he liked girls and playing video games like other teenagers, but they never fascinated him as much as the promise of computers.</p>
<p>&#8220;It was mostly about figuring out how to make computers do the things that I wanted to see them do,&#8221; he said.</p>
<p>Though he was enrolled at The Bronx High School of Science, a prestigious New York City public school, attending the school required him to make the long commute to the city&#8217;s northernmost borough every day. And he found himself wanting more freedom to explore the digital world on his own.</p>
<p>So his parents let him drop out. Instead, Karp embarked on a homeschooling regimen with the help of several tutors, learned to speak Japanese and pursued his digital interests with abandon.</p>
<p>&#8220;He needed the time in the day in order to create,&#8221; said Ackerman, who divorced when her son was a teenager. &#8220;And that&#8217;s what he is. He&#8217;s a creator.&#8221;</p>
<p>Just shy of his 18th birthday, Karp boarded a plane to Japan and lived there for several months alone, running technology for the parenting site UrbanBaby. Then he moved back in with his mother, dabbling in various digital startups for several years before alighting on the idea of creating his own blogging platform.</p>
<p>&#8220;David would come running through the apartment saying, `Mom! Mom! There&#8217;s this and this and this!&#8221;&#8216; Ackerman said. &#8220;And I didn&#8217;t know what the heck he was talking about. Because it was a whole other language.&#8221;</p>
<p>Tumblr stands out for a creative layout that enables users to easily share blog posts, photos and video with one another in a mosaic of interlocking information.</p>
<p>Mayer said she knew Karp had to be a good guy even before she met him. She could tell by Tumblr&#8217;s elegant look and simple tools for creating content.</p>
<p>&#8220;With clothes or art or design, you can always tell if the person who made it is nice,&#8221; Mayer said. &#8220;When you use Tumblr, you can tell there are a lot of empathetic people who understand what makes a person feel good, what makes a person feel safe in terms of sharing their work.&#8221;</p>
<p>But as popular as Tumblr has become, the service remains unprofitable. And the company has had its share of stumbles.</p>
<p>In April, Karp announced in a blog post that Tumblr was laying off its team of journalists and editors assigned to cover the &#8220;living, breathing&#8221; Tumblr community.</p>
<p>After hundreds of stories and videos, he said, Tumblr&#8217;s experiment &#8220;has run its course for now, and our editorial team will be closing up shop and moving on.&#8221;</p>
<p>The insensitive handling of the news prompted its fair share of Internet jabs at Karp.</p>
<p>The New Yorker magazine, for example, published a humorous piece called &#8220;The Collected Messages of David Karp.&#8221; It included a would-be Christmas card from the Karp family in 2023, informing David Jr. that there is no Santa Claus.</p>
<p>Advertising has been a missing ingredient because Tumblr, like many online services in their early stages, focused on building a loyal audience before turning its attention to making money. That&#8217;s why the Yahoo deal is so pivotal for Karp and his small team of creative thinkers.</p>
<p>For now, though, they&#8217;re basking in the glow of joining forces with an Internet behemoth. As for Karp&#8217;s mother, she was positively giddy at the prospect of meeting Mayer on Monday night.</p>
<p>&#8220;I&#8217;ll get to talk her ear off about how wonderful David is,&#8221; Ackerman said. &#8220;That&#8217;s what moms do.&#8221;</p>

<content:encoded><![CDATA[<p>On May 17<sup>th</sup>, activists of the <a href="http://nohatespeechmovement.org" target="_blank">No Hate Speech Movement</a> &#8211; <a href="https://twitter.com/search?q=%23nohatespeech&#38;src=typd" target="_blank">#nohatespeech</a> &#8211; have marked the International Day against Homophobia and Transphobia &#8211; <a href="https://twitter.com/search?q=%23idaho&#38;src=typd" target="_blank">#IDAHO</a> &#8211; by taking online actions and standing for human rights and against hate speech online.  I have blogged about the action in my previous blog and you can read it <a href="http://digitalartizans.wordpress.com/2013/05/16/say-no-to-homophobia-transphobia/" target="_blank">here</a>.</p>
<p>In this blog post I will focus on two elements of the action:  <em>the highlights of the action</em> and <em>low-lights</em>, which can serve as a lessons learned for the upcoming European Action Days (hereafter EAD). Also, note that this blog post reflects my personal critical reflection on the first EAD of #nohatespeech movement and cannot be taken as a reflection of the activists, neither people involved in the campaign.</p>
<p><b>HIGHLIGHTS</b></p>
<ul>
<li><b>Activists of #nohatespeech movement</b></li>
</ul>
<p>Although, the timeline to design and develop the EAD and its content on #IDAHO was very short, their commitment, investment and contribution has made possible the action day. Despite various challenges that activists have faced, they achieved to smoothly self-organize and give an oomph to the first EAD of #nohatespeech movement.</p>
<ul>
<li><b>Thunderclap</b></li>
</ul>
<p><a href="http://thunderclap.it" target="_blank">Thunderclap</a> is a crowd-speaking platform that helps people be heard by saying something together. A thunderclap was designed for the EAD and the goal <a href="https://www.thunderclap.it/projects/2157-say-no-2-homo-transphobia" target="_blank">was to reach 250 supporters</a>. In the first glance it doesn`t sound as a big deal, but engaging 250 people in such a short time was a great achievement. Moreover, thunderclap showed that can bring a `social media blast` in a short time and engage new audience with the action. Definitely a recommended tool for the next actions!<b> </b></p>
<ul>
<li><b>Storify </b></li>
</ul>
<p><a href="http://storify.com" target="_blank">Storify</a> is a social network service that lets the users create stories or timelines by integrating/using social media such as: Twitter, Facebook, Youtube, Instagram, etc. Storify has proved to be very efficient on preparing reports and articles in real-time by using multiple online resources (a great example is the article prepared by the activist <a href="https://twitter.com/koberidzegubaz" target="_blank">@KoberidzeGubaz</a> <a href="http://storify.com/KoberidzeGubaz/17th-may-in-georgia-international-day-against-homo" target="_blank">on the manifestations in Georgia against LGBT community</a>). Storify also helped the activists to put in one place the Twitter conversation and share in other social media channels (<a href="http://storify.com/ronsalaj/nohatespeech-movement-celebrating-idaho" target="_blank">look at this example</a>).<a href="/Users/Ron/Desktop/Post%20Mortem%20-%20NoHateSpeech%20and%20IDAHO%20%E2%80%93%20wins%20and%20loses.doc#_msocom_2"><br />

<ul>
<li><b>Engaging influencers in Twitter by</b> <b>activists</b></li>
</ul>
<p>Another win of the first EAD was engaging with Twitter influencers, such as: Stephan Fry team (although not directly involved), high-profile activists &#8211; Peter Thatcher, international organizations like Amnesty; official institutions – Ministry of Foreign Affairs of Norway, Fundamental Rights Agency, etc. Except that these influencers bring an added visibility and value to the EAD and campaign itself, they can play a key role on the future actions. Hence, maintaining these relationships and building other partnerships are key elements for the upcoming actions and social media activities.</p>
<ul>
<li><b>Agility</b></li>
</ul>
<p>It`s not anymore cool preparing and investing in a long-term strategies on actions and campaigning. The times have changed and now the organizations and activists more and more are shifting from traditional actions and campaigning into more dynamic, collaborative, participatory and cross-functional actions by using multiple medias and technologies. Agility it supports the adaptive planning, evolutionary development,  a time-boxed iterative approach alias `sprints`, and encourages rapid and flexible response to change. The EAD has had a twist of agility on it; the activists have self-organized into cross-functional small teams and worked on various contents. Additionally, the features of the action were more adaptive and implemented on several sprints to build the momentum, raise awareness on the action day and engage new audience.</p>

<li><b>TAGSexplorer</b></li>
</ul>
<p><a href="http://mashe.hawksey.info/2011/11/twitter-how-to-archive-event-hashtags-and-visualize-conversation/" target="_blank">TAGSexplorer</a> is a courtesy tool of <a href="https://twitter.com/mhawksey" target="_blank">@mhawksey</a> which makes possible to users to archive and explore the entire event hashtag and reply any of conversations, by using a combination of Google Spreadsheets as a data source and a simple web interface to add interactivity.<a href="https://docs.google.com/spreadsheet/ccc?key=0AhGelKshATD8dGpLRnd2RTZBTUtBaFJQZGdEcU5vRWc#gid=36" target="_blank"> I setup a TAGSexplorer</a> for the EAD and there were around 1000 tweets archived, which provide very interesting data from Twitter and allows users to check out who engaged during the EAD. This tool is a big win!</p>
<p><strong>LOWLIGHTS</strong></p>
<ul>
<li><b>Timeline to prepare the action</b></li>
</ul>
<p>I don`t really remember how much time was given to the activists to prepare the action, but definitely there was just few time! And due to lack of timing, a lot of elements of the action have been developed rapidly, but not reflecting critically on them – if they work or not! Also, the time pressure leads the community of activists to take fast decisions (very often on facebook thread of comments) and this raises couple of questions for the future actions: who made the decisions for the elements of actions? Does the community supports and follows them? Who propose the next steps? Etc. However, in order to avoid this lowlight, more time should be given to the activists for better planning of actions.</p>
<ul>
<li><b>No Hate Speech Facebook group</b></li>
</ul>
<p>I personally do consider that closed facebook groups are one of the most frustrated environments for activists to self-organize for actions. First, they are not secure, second they are not user-friendly and third they lack a lot of collaborative features. And following all the comments and notification system is time-consuming and not fruitfull at all. Instead, activists should use other alternative environments for organizing actions such as <a href="http://dragd.is/7RrtH" target="_blank">Elgg</a>  or <a href="https://n-1.cc/" target="_blank">N-1</a>.</p>
<ul>
<li><b>Pledgeblank</b></li>
</ul>
<p><a href="http://pledgebank.com" target="_blank">Is a website</a> which allows users to create and run online pledges on various causes.  The website is not user-friendly and it consumed the time of activists <a href="http://www.pledgebank.com/nohatespeech" target="_blank">to design the pledge on it</a>. Also, the features of the pledge are very static and not visually attractive. From my perspective, the pledgeblank was a waste of time and if you don`t put lots of efforts and thoughts on how you design it and engage the decision makers to sign the pledge, it can easily fail.</p>
<ul>
<li><b>Official Facebook Page</b></li>
</ul>
<p>Facebook is the main social network used by organizations and nonprofits to raise awareness and promote actions. Although, an event for the action was created, the official Facebook page of the No Hate Speech Movement was very passive. Although, during the action day the facebook page has got more active, but there was a lack of original content. Consequently, a general engagement of the audience with the content of the Facebook page was low. Facebook page should be used more wisely and put more efforts on it, in order to build the momentum for the actions, engage the audience in debate and conversations on the #IDAHo-related topics.</p>
<ul>
<li><b>Official Twitter account </b></li>
</ul>
<p>The last thing you can do with a Twitter account is to connect it with Facebook and automatically Tweet Facebook posts!<br />
Activists all around the world harness Twitter to update in real time what`s happening, engage in conversations, raise awareness, build community and even self-organize. Unfortunately, the official Twitter account @nohate_speech have had low-profile until couple of days before the EAD. Hence, opening the twitter account for the activists, handling to them for 1-2 weeks, making it more participatory, would be an interesting test to try it out. In the end of the day if Sweden did it, why not the @nohate_speech movement?!</p>
<ul>
<li><b>No Hate Speech official website </b></li>
</ul>
<p>The official website of #nohatespeech movement is visually good, but it lacks the main elements of a dynamic platform as intended to be; currently the website is not interactive, participatory and even to join the movement with the photo it require an Instagram or Flickr account, which is very tricky! However, a lot of activists, friends and colleagues have complained for the lack of information for EAD in the website. Although, the homepage of the website should serve as the main page to provide the latest news, call to action, etc, this has completely missed. At last but not least – the Hate Speech Watch is not very appropriate element for reporting hate speech cases and the question is what happened with the reports about homophobia and transphobia during the action day? How do we handle them? How do we debate them? And how do we react against them?</p>
<ul>
<li><b>Collaborative tools</b></li>
</ul>
<p>The social web and new emerging technologies provides today a great variety of collaborative tools to organize the work and speed up the development of the action. Therefore, we failed this time to use several collaborative tools that could save the time and make the performance of the activist more efficient. Perhaps, some of the following tools should be considered for the next actions: <a href="http://www.google.com/+/learnmore/hangouts/" target="_blank">Google Hangout</a>, <a href="https://intertwinkles.org" target="_blank">Dotstorm</a>, <a href="http://etherpad.org/" target="_blank">Etherpad</a>, <a href="http://pastebin.com/" target="_blank">Pastebin</a>, etc.</p>
<ul>
<li><b>Lack of visual identity </b></li>
</ul>
<p>Every action needs a visual identity with whom the audience could identify. The graphic design is a crucial part of each action or campaign. We missed this element in the action and we struggled with it. A lot more original content could be prepared for social media if the designing skill could exist in the community of activists. Perhaps, having a graphic designer on-baord would be a next win for the EAD and the Campaign itself?</p>
