<p>&#8220;I&#8217;ve done everything I can do, I&#8217;ve done everything that is physically possible, to make myself in better shape this year. Where the years previously I didn&#8217;t lose weight in-season, I didn&#8217;t want my weight issue to be a factor as to why I had an off season.<br />

For four years now, I&#8217;ve been the same guy, and when I slow down a little &#8230; Bad things happen to anyone, not because I need to get into shape. This has been me the whole time, so where is the problem?<br />

Honestly, I&#8217;ve given it a lot of thought these last couple of weeks. The actions of the last two weeks &#8230; am I unhappy with them? Yes. Anyone in my situation would feel the same way, but I want to be part of the White Sox 100 percent. Physically and mentally, I&#8217;m going to be ready. If I&#8217;m not in the White Sox plan, I know there&#8217;s a plan for me somewhere.&#8221;</p></blockquote>
<p>Jenks also didn&#8217;t like how the Sox handled the rehab of his season-ending injury:</p>
<blockquote><p>The White Sox left Jenks home to rehab the injury rather than take him on their final road trip, and that did not sit well with Jenks, either. Jenks could walk on the injury while wearing a protective boot and said he would have liked to have joined his teammates for those six games.</p>
<p>&#8220;They sent me home early, when I could have gone on the road and rehabbed there, instead of going to a place near my house,&#8221; Jenks said. &#8220;I [complained] to my wife every day, &#8216;Why am I home?&#8217;&#8221;</p></blockquote>

<p>UPDATE: A couple points from Kenny&#8217;s interview:</p>
<p>1) He&#8217;d like the the players in the team to have higher OBPs, in the .350 range as a team (<a href="http://www.fangraphs.com/teams.aspx?pos=all&#38;stats=bat&#38;lg=all&#38;&#38;type=1&#38;season=2009&#38;month=0" target="_blank">.329</a> this year). Also, more eXtra Base Hits. (9:30)</p>
<p>2) He hasn&#8217;t seen the sponsorship, advertising, and season tickets projections for next year to say anything about next year&#8217;s payroll. But every year he asks Jerry Reinsdorf, and is over budget. (16:15)</p>

If it leads to something that&#8217;s lower right now, I don&#8217;t know the answer to that question either. &#8220;It&#8217;s kind of irrelevant to me because even in times where I&#8217;ve been given that payroll and still haven&#8217;t formulated an action plan for the club, I&#8217;ve always gone to Jerry Reinsdorf at the end of the day. I&#8217;m always over budget.&#8221;</p></blockquote>

<p>what did Jerry Reinsdorf think of taking on the Peavy contract?</p>
<blockquote><p>Williams waited until the morning of July 31 to seek permission to acquire Peavy, who has $55.9 million remaining on a contract that runs through 2012. The answer was, &#8220;No.&#8221; &#8220;I know I had said, &#8216;Yes,&#8217; back in May,&#8221; Reinsdorf says, &#8220;but Kenny got me in a weak moment. … I didn&#8217;t think we could afford him. But even though I said, &#8216;No,&#8217; I told Kenny I was willing to talk about it.&#8221; Williams, assistant GM Rick Hahn and Reinsdorf talked about the 2010 budget. &#8230; &#8220;I had to be convinced I could handle the money,&#8221; Reinsdorf says. &#8220;They convinced me.&#8221;</p></blockquote>
<p>how about the Rios contract?</p>
<blockquote><p>When the Blue Jays put Rios, 28, on waivers the first week of August, the White Sox claimed him. Williams didn&#8217;t bother to clear the move with Reinsdorf, figuring there was no need. The claim was designed to work out a trade or block another contender from obtaining him. Never did Williams envision the Blue Jays would let Rios go for nothing. &#8220;I really believed there would be a deal,&#8221; Williams says, &#8220;but they wanted the financial relief instead.&#8221;</p></blockquote>

Then I think of the injustices suffered in this case. Then, I put those sappy articles back in mothballs and get back to business.</span></em></p>
<p><span style="color:#888888;"><em>Before I begin, I want to make a personal salute to a ranter on </em></span><a title="Make it seven rants page" href="http://haveavoice.makeitseven.ca/rants" target="_blank"><span style="color:#888888;"><em>Makeitseven.ca</em></span></a><span style="color:#888888;"><em>.  His name is <strong>Patrick Romanoski</strong>, and he has to be one of the most persistent diggers of information that I have ever witnessed. He is a wealth of information and wisdom. Patrick, thank you. And, there are several more contributors that I want to mention. Perhaps we can do this over the next while.</em></span></p>

<p><span style="color:#000000;">We are at the part where the NHL grovels so low that they what? They put their own bid in? No way! Get out! Really?</span></p>
<p><span style="color:#000000;">They say real life is stranger than anything we could possibly think up ourselves. <em>Real life is stranger than fiction</em>.</span></p>
<p><span style="color:#000000;">Did anyone think this case could get any more bizarre than it has? Is it close to over? Is it going to get any stranger?</span></p>
<p><span style="color:#000000;">Let&#8217;s think of the fans in Phoenix right now.</span></p>
<p><span style="color:#000000;">They must be suffering some kind of disbelief of what has happened.</span></p>
<p><span style="color:#000000;">At first, the NHL looked like their best friends. What must have been part of their thinking? How about this:</span></p>
<p><span style="color:#000000;"> <em><span style="color:#666699;">Isn&#8217;t Gary wonderful. Go Gary Go! Save the Coyotes! Game On Arizona!</span></em></span></p>
<p><span style="color:#000000;"><em><span style="color:#666699;">Look, Gary sent us a memo to our rally! He supports the franchise, and says he sees us surviving long into the future.</span></em></span></p>
<p><span style="color:#000000;"><em><span style="color:#666699;">Hey, did you hear? Jerry Reinsdorf is coming in with a bid, and the NHL supports Reinsdorf. He&#8217;s good. He&#8217;s got lots of experience and he knows how to make teams succesful. Jerry will be our white knight! Yeah Jerry!</span></em></span></p>
<p><span style="color:#000000;"><em><span style="color:#666699;">Boy, that Jerry Moyes. He sure ran this team into the ground with poor management. That was it. Just poor management. The other Jerry will show Moyes how it&#8217;s done. What? He wants to get $104 million out of the team when he sells? Forget it! He doesn&#8217;t deserve it. Go Reinsdorf go! We&#8217;re with you! Save the Coyotes!</span></em></span></p>
<p><span style="color:#000000;">That was likely pretty close to the thinking of the Phoenix Coyotes fans at the outset of this case.</span></p>
<p><span style="color:#000000;">The NHL had found the white knight.</span></p>
<p><span style="color:#000000;">Now, the white knight is gone. He bowed out under what is described as <a title="ESPN" href="http://sports.espn.go.com/nhl/news/story?id=4422520" target="_blank">a negative publicity campaign</a>:</span></p>
<blockquote><p>&#8220;We have faced an organized publicity effort designed to provide negative and misleading information to interested parties,&#8221; it said. &#8220;Not only has this stymied negotiations, but it has eroded local market demand for Coyotes tickets, luxury boxes, and sponsorships.&#8221;</p></blockquote>
<p>Okay? Where is the negative publicity effort exactly? Did anyone see a negative PR campaign? Anybody?</p>
<p>I&#8217;d like to know how exactly the Balsillie group did this, and where it was from. How did they do it exactly?</p>
<p>Would this be about the collusion accusations from Moyes? Is that it? If so, those were justified accusations.</p>
<p>When it is claimed they had made great inroads in negotiations, would that have included the $23 million in annual concessions requested from a city already laying off staff to suck up the $14 million deficit? Is that it?</p>
<p>I&#8217;m sorry, but I do not see any favors to anybody in the negotiations. And the negative publicity? Don&#8217;t confuse that with any uncovering of truth that was presented. Don&#8217;t bother. Please.</p>
<p>As for the NHL&#8217;s promises to the fans of the Phoenix Coyotes.</p>
<p>I feel sorry for the fans in Phoenix because, let&#8217;s be real as Dr. Phil, you were fed a lot of snow.</p>
<p>The proof is in the realities that are now apparent.</p>
<p>Fact: Jerry Reinsdorf had incredibly high concession demands, and the city of Glendale would be on the hook for any team financial failures. Not a lot of risk there for anyone but the taxpayers of Glendale.</p>
<p>Fact: The Reinsdorf offer had a five year out clause despite the taxpayers liability. No amount of confidence or risk.</p>
<p>Fact: The NHL&#8217;s bid is even less supportive with a one season out clause.</p>
<p>So much for <a title="Daly on long term" href="http://www.azcentral.com/news/articles/2009/07/02/20090702gl-coyotesdaly0704-ON.html" target="_blank"><strong>Bill Daly&#8217;s press conference</strong> </a>where he claimed this in early July:</p>
<blockquote><p><span style="color:#ff0000;">Daly stressed the new terms would not allow the Coyotes to break the lease in a year or two and move elsewhere.</span></p>
<p>The NHL must fight for the bankrupt Coyotes to stay in Glendale long-term, he said, to send a message to other cities that have spent money attracting or retaining hockey teams.</p></blockquote>
<p> <em><span style="color:#888888;">Yeah Bill! Go NHL go!</span></em></p>
<p><span style="color:#000000;">Sorry Phoenix, that was a snowjob!</span></p>
<p><span style="color:#000000;">This week, the NHL has filed it&#8217;s own offer with the bowing out of Reinsdorf, and the out clause as you know, is one season. No long term. Not even two years.</span></p>
<p><span style="color:#000000;">What happened to the &#8216;message&#8217; the NHL wants to send? That was <em>so last month,</em> eh Bill?</span></p>
<p><span style="color:#000000;">This is late August and things are now a lot different. It&#8217;s snowing in August in Arizona.&#8217;Snow job&#8217; that is.</span></p>
<p><span style="color:#000000;">Well, at the end of the day the NHL has to get it&#8217;s act together and get organized.</span> </p>

<p>Anyhow, back to the issues&#8230;</p>
<p>What really bothers me is no matter how much exposure of the NHL&#8217;s shortcomings are made known, they <a title="ESPN" href="http://www.forbes.com/feeds/ap/2009/08/25/sports-hkn-coyotes-bankruptcy_6815350.html" target="_blank">continue to point the finger</a> at others.</p>
<blockquote><p>The NHL also cited ongoing harm to the franchise as the bankruptcy proceeding drags on.</p>
<p>&#8220;The bankruptcy petition and subsequent events have been incredibly damaging to the club&#8217;s business,&#8221; Daly said, &#8220;and the sooner the club can be extricated from the bankruptcy process, the sooner club personnel <span style="color:#ff0000;">can begin to restore the team&#8217;s vitality and local fan base</span>.&#8221;</p></blockquote>
<p>Oh, Daly said<strong><em> &#8216;vitality&#8217;</em></strong> not &#8216;viability&#8217;. OK, I can live with that. In July he said &#8216;viability&#8217;. I get it. Well, at least he is not saying long term viability anymore, especially with the huge lack of confidence the league has shown with that whole <em><strong>one year and out</strong></em> idea in their bid.</p>
<p>How did I get so off track? Well, this case has become a farce. Let&#8217;s call it. It&#8217;s officially a farce. A sick as all get out joke. A joke that is far from funny, really.</p>
<p>I actually feel sorry for mainstream media. They have to report the facts and the events as they occur.</p>
<p><span style="color:#888888;">&#8220;OK, now we have the NHL in, and Reinsdorf out, and Ice Edge also filed their bid, and yada, yada, yada&#8221;.</span></p>
<p><span style="color:#000000;">Come on! We all know they want to grab a blog and say &#8220;what the _____.&#8221;</span></p>
<p><span style="color:#000000;">We all want to say, come on! </span></p>
<p><span style="color:#000000;">But, let&#8217;s get back to reality for a moment. I will finish with this summary and opinion.</span></p>
<p><span style="color:#000000;">The Coyotes were never just about hockey. The city of Glendale colluded to get rid of Moyes, and they were assisted by certain parties in Glendale and this case, and they were helped also by the NHL. No doubt.</span></p>
<p><span style="color:#000000;">Jerry Moyes was stripped of his money and spat out like a used piece of gum.</span></p>
<p><span style="color:#000000;">The NHL has snowed the fans of Phoenix with a false sense of loyalty, and only now do the true colors of the NHL become obvious.</span></p>
<p><span style="color:#000000;">The NHL and the Reinsdorf group were looking to relocate this team either now, or within five years to another centre that fits the plan of the NHL.</span></p>
<p><span style="color:#000000;">The NHL has painted Jim Balsillie any way they can to avoid him putting a team in southern ontario because of the MLSE objection, and also because they would not get an expansion fee.</span></p>
<p><span style="color:#000000;">The NHL is <a title="Globe and Mail" href="http://www.theglobeandmail.com/sports/nhls-fingerprints-all-over-its-damaged-credibility/article1265993/" target="_blank">looking really bad</a>, and really dishonest. Who can trust the heads of this league anymore?</span></p>
<p><span style="color:#000000;">The NHL has shunned the fans of Canada, and is quickly shunning the fans of Phoenix.</span></p>
<p><span style="color:#000000;">Jim Balsillie has a brighter future in the NHL than Gary Bettman, and let&#8217;s see who is around in 10 years.</span></p>
<p><span style="color:#000000;">Jim Balsillie, despite being voted against, has been <a title="Business Week" href="http://www.businessweek.com/magazine/content/09_36/b4145000470048.htm" target="_blank">approached by other struggling franchises</a>, and is the true white knight to help the destitute owners.</span></p>
<p><span style="color:#000000;">And, because I can, I have this to add. I hope Jerry Moyes gets his $104 million, and Jim Balsillie gets to move the franchise to Hamilton. I hope Jerry Moyes becomes an honorary lifetime member of the new team. It took great courage to bring this team in to court for the ride we are experiencing.</span></p>
<p><span style="color:#000000;">I hope those involved in hanging Moyes out to dry pay the piper.</span></p>
<p><span style="color:#000000;">I hope the league gets torn to the ground and is rebuilt with true, caring hockey people.</span></p>
<p><span style="color:#000000;">I hope we all learn that it is not OK to treat another human being with utter disrespect.</span></p>
<p><span style="color:#000000;">I hope one day some grown men will grow up and be able to take responsibility for their actions, and admit when they were wrong.</span></p>
<p><span style="color:#000000;">I hope the less than ethical officials at Glendale city hall find themselves not getting re-elected for the abuse of the taxpaying voters.</span></p>
<p><span style="color:#000000;">I hope the rich folks involved in this case learn that money and the quest for more is not what is important in life.</span></p>
<p><span style="color:#000000;">But, to start, let&#8217;s get this team to Hamilton, and get Jerry Moyes some money back.</span></p>

<p><a title="Derek King (Wikipedia)" href="http://en.wikipedia.org/wiki/Derek_King" target="_blank">Derek King </a>is becoming the assistant coach of the <a title="King to Marlies - Toronto Sun" href="http://www.torontosun.com/sports/hockey/2009/08/05/10364071-sun.html" target="_blank">Toronto Marlies</a>.</p>
<p>King may be moving from Scottsdale, Arizona, where he had lived and worked as a real estate agent, and worked in the development camp for the Phoenix Coyotes.</p>
<p>King <span style="text-decoration:underline;">was born in Hamilton, Ontario</span> in 1967.</p>
<p>Is Derek King&#8217;s moving a signal that there is less opportunity with the Phoenix Coyotes, and is it also a sign that real estate growth in the Phoenix area is waining?</p>
<p>Does this give a hope for hockey in Hamilton, as King would be a reflection of &#8216;the sinking Coyote ship&#8217;?</p>
<p>On the other hand, we have the <a title="Ontario Teachers buy 2/3rds of MLSE" href="http://www.thestar.com/Business/article/684076" target="_blank">Ontario Teachers&#8217; Pension Fund </a>buying up the shares owned by CTV Globemedia and increasing their share of MLSE to a tune of 66%. That&#8217;s two-thirds ownership. Obviously they consider the profitability of MLSE to continue to grow. With ticket prices so outrageously high for Leaf games, I guess they have a point. I suppose the Ontario Teachers&#8217; Pension Fund doesn&#8217;t think Hamilton will get a team, which would have a downward pressure on usury Leaf ticket prices anytime soon.</p>
<p>And, we have <a title="AP on Sept 14" href="http://www.google.com/hostednews/ap/article/ALeqM5g4wOZpbbkMgtgb4XZWf_LigEiqMgD9A9LR600" target="_blank">Jim Balsillie </a>saying enough is enough already, and showing a level of confidence that his position in bidding is strong enough to force the court to stop the stall tactics of the NHL head office. A court imposed relocation fee and decision that he is an eligible owner is fast becoming expected from his legal team, and his deadline is now September 14th.</p>
<p>For all of us waiting and getting tired of how long this has dragged on, we applaud the &#8216;put up or shut up&#8217; attitude of Balsillie.</p>
<p>So, we have King jumping ship for Toronto, the Teachers buying a bigger stake in MLSE, and Jim Balsillie putting more pressure on the powers that be to put an end to this already, in a move of confidence that his bid is solid.</p>
<p>Who are we to believe?</p>
<p>Real hockey fans in Canada and the U.S.A. will attest that this farce is getting old. The NHL&#8217;s dragging of it&#8217;s heals is going to hurt the game of hockey and it&#8217;s popularity.</p>
<p>Does the NHL think they can continue to insult the hockey fans of Southern Ontario and not have a revolt?</p>
<p>We&#8217;ll see.</p>

<p><a title="Wikipedia on Hicks" href="http://en.wikipedia.org/wiki/Tom_Hicks" target="_blank"><strong>Tom Hicks</strong>  </a>is the vice-chairman of the National Hockey League&#8217;s <strong>Board of Governors</strong>. He is also the owner of the <strong>Texas Rangers</strong> Baseball Club.</p>
<p>Tom Hicks and Jerry Reinsdorf share interest in Major League Baseball, and they also own teams. At least, Hicks still technically has a hold of the Texas Rangers.</p>
<p>You see, Hicks&#8217; sports holding company,<strong> Hicks Sports Group</strong> is in default.</p>
<p>Where Major League Baseball will likely play by fair rules and strip ownership, the story in the NHL office is a little different.</p>
<p>According to the <a title="WSJ on Hicks" href="http://online.wsj.com/article/SB123967866588416173.html" target="_blank">Wall Street Journal</a>, the NHL is protecting Hicks&#8217; interest in the Stars, where the MLB isn&#8217;t:</p>
<blockquote><p>That won&#8217;t happen for at least 180 days, however, as lenders have agreed to National Hockey League provisions that prevent immediate foreclosure. Major League Baseball&#8217;s rules for such situations are more fluid, though if Hicks Sports Group can&#8217;t satisfy lenders, the lenders can eventually force an MLB-sanctioned sale of the Rangers.</p></blockquote>
<p>You see, when you are the Vice-Chairman of the NHL, I suppose like an American Express card, that kind of stature &#8216;has it&#8217;s priviledges&#8217;.</p>
<p>Unlike Jerry Moyes, Tom Hicks has been in trouble for months, but you don&#8217;t see the NHL handing over proxies to strip him of any control, do you? Oh contraire, quite the opposite is occuring it would seem.</p>
<p>And the WSJ adds just how far &#8216;to bat&#8217; the NHL will go on this one for Hicks:</p>
<blockquote><p>A spokesman for NHL Commissioner Gary Bettman declined to comment. Bob DuPuy, chief operating officer of Major League Baseball, also declined to comment.</p>
<p>Relations between the Hicks Sports Group lenders and the NHL have grown increasingly testy of late, with the NHL threatening to do all it could to block a forced sale of the Stars, according to people involved in the matter.</p></blockquote>
<p>Will Gary Bettman spare Tom Hicks from &#8216;embarassment&#8217; as he professed to do for Jerry Moyes?</p>
<p>It would seem there are different sets of rules depending on who you are. At least baseball doesn&#8217;t have the same bias.</p>
<p>Well, let&#8217;s have a look, shall we.</p>
<p>Remember, Jerry Reinsdorf was approved by Hicks as a good choice of owner. Would Hicks know Reinsdorf having  shared owning positions in the MLB? Probably.</p>
<p>Would Hicks have known Reinsdorf when they <a title="Hicks and Reinsdorf Muckety" href="http://www.muckety.com/Query?name=Thomas+O.+Hicks+and+Jerry+Reinsdorf&#38;prev=Thomas+O.+Hicks+and+Jerry+Reinsdorf&#38;SearchResult=25498&#38;SearchResult=11481&#38;graph=MucketyMap" target="_blank">fundraised for John McCain in the 2008 Presidential Campaign</a>?  Good chance.</p>
<p>And, isn&#8217;t it a coincidence that Tom Hicks is also a land developer? My word!</p>
<p>Yes, according to the <a title="Hicks profile on Stars website" href="http://stars.nhl.com/club/page.htm?bcid=sta_bio-hicks" target="_blank">Dallas Stars website </a>on Hicks:</p>

<p>Hicks Holdings is a partner with Hillwood Development Company in the <span style="color:#ff0000;">Victory Park project</span> in downtown Dallas.  Hicks Holdings is a developer of a 75-acre urban town center /multi-use development on the land adjacent to the Rangers Ballpark in Arlington; and of Champions Park, a 40-acre office/retail development in Frisco, Texas</p></blockquote>
<p>And, if we look at the reasons that Dallas originally decided on the <a href="http://downtownuptown.blogspot.com/2009/07/empty-victory-when-urban-planning-fails.html" target="_blank">Victory Park project</a>, check out the similarity in thinking to that of Glendale. Downright scary:</p>
<blockquote><p>Having for a long time failed to populate its dowtown with any residents, the city made a concerted effort (i.e. gave lots of tax incentives) to refurbish and even repurpose vacant office buildings into top-of-the-line apartments and condominiums. It even subsidized a neighborhood grocery store to get residents to stay. Yet these efforts were modest compared to one of the largest new mixed-use developments just outside the central business district <span style="color:#ff0000;">Victory Park.</span><span style="color:#ffffff;"> </span></p></blockquote>
<p><span style="color:#ffffff;"><span style="color:#000000;">Well, how did <a title="Dallas Observer" href="http://www.dallasobserver.com/2009-01-29/news/empty-victory/1" target="_blank">Victory Park do</a>? Probably best described by the <a href="http://downtownuptown.blogspot.com/2009/07/empty-victory-when-urban-planning-fails.html" target="_blank">same blogger</a>:</span></span></p>

<p>Sounds a lot like the thinking of Glendale. Any coincidence that sports ownership and land development goes hand in hand in places outside of Glendale?</p>
<p>Any coincindence that there could be strong support by the vice-Chairman of the NHL to a man like Jerry Reinsdorf, with likely relationship formed over several years?</p>
<p>What chance would a man like Jim Balsillie have? Does he own an MLB team? Did he fundraise for John McCain? Is he involved in land or sports arena development?</p>
<p>For that matter, what chance did Jerry Moyes have? He wasn&#8217;t in the same kind of ventures some others in sports are.</p>
<p>Where Hicks gets six months reprieve from the NHL, Jerry Moyes got six months of takeover planning behind his back. Where Hicks gets 180 days to find more investors, Jerry Moyes got to sign proxies giving up his rights. At least, that&#8217;s what Gary Bettman thought.</p>
<p>But, don&#8217;t feel sorry for Hicks. He is looking to make an acquisition in the $billions for a packaging company. It would seem he has decided to stop flooding his wealth into the hockey and baseball teams to bail them out, and didn&#8217;t pay his $10 million payment.</p>
<p>When you have lots of wealth and power, you can pick and choose, and make some people wait.</p>
<p>And, it would appear Gary Bettman wants to continue to be accomodating to Hicks, because after all, Hicks could likely have pull enough to control the fate of Bettman in the NHL office . No wonder Mr. B is so helpful and supportive.</p>
<p>Ah, power! <em>Ain&#8217;t it grande?</em></p>
<p>So, when we ask ourselves if the vote for Reinsdorf and the overwhelming denial of Jim Balsillie was fair, we only need to look at the relationships and the associated &#8216;treatment&#8217; a friend gets, and the poor treatment one not as connected receives.</p>
<p>How are things in the back pocket of Mr.Hicks, Gary?</p>

<title><![CDATA[Reading 'through' the lines. What you read in the newspapers is not even close to the real story!]]></title>

<div>As many of you know, I started writing about this case more than a month ago. You also know I write out of an underlying compassion for injustices suffered.</div>
<div>Paramount to this case is the position that Jerry Moyes has found himself in. He put the Phoenix Coyotes in Chapter 11, much to the chagrin of Gary Bettman and the NHL, not to mention several key parties involved in this bankruptcy. Jerry Moyes&#8217; move has opened up a world of hurt, that mainstream media has not begun to talk about, and only in a small way has touched on.</div>
<p>I have witnessed this case from an angle that perhaps not too many would understand. I will attempt now to explain a little more of what has happened as seen from my perspective, an angle that includes the  monitoring of &#8216;reaction&#8217; to articles posted, and the key parties it has attracted. Again, in order to bring this to light and help you understand better, it is important that I share this unique perspective with you.</p>
<p>When you have a website or blog, <strong>there are services on the internet that can provide the website owner who has visited their site</strong>, and if there is a company name for the server, it will list the name. It will tell which page(s) were visited, and the times they were visited. It also lists the IP addresses of the computers where the visits were from. This, as you will learn, plays a key role in the research I have done, and will play a key role in the future should the authorities be interested in using this information. I will explain this in more detail as we move along.</p>
<p>I have had more time to &#8216;digest&#8217; the court proceedings of yesterday, and have been able to conjecture, based again on a bigger understanding, the reasons for what transpired.</p>
<p>We can look at several key statements. And, we can then look at the strategy and potential reason(s) the statements were made.  It is also of note that several people came to court to be seen, and to be noted. Specifically,  Anthony LeBlanc and Gary Bettman. OK, let&#8217;s begin the analysis.</p>
<p>Statement from Jerry Reinsdorf&#8217;s attorney <strong><a title="Abramowitz to court" href="http://www.cbssports.com/nhl/story/12053074/rss" target="_blank">Abramowitz</a></strong>:</p>
<blockquote><p>Abramowitz urged the court to &#8220;do anything it can&#8221; to keep Reinsdorf&#8217;s bid alive.</p></blockquote>
<p><strong>Analysis</strong>: It has been shown throughout the articles written on this site, that there is a strong possibility of collusion among several key individuals and companies surrounding the City of Glendale, and it&#8217;s desire to build infrastructure of the city. Jerry Reinsdorf&#8217;s son Michael is pivotal to this idea. Also involved is Michael Dell. At this point, after much comings and goings from the articles related to the suggestion of collusion, the Reinsdorf camp is ready to pull out. Jerry Moyes&#8217; attorney&#8217;s have been applying pressure on Reinsdorf and others to build a case to support the notion of collusion. It would seem the Reinsdorf group is hiding behind the safety net of the court, and specifically the bankruptcy court <span style="color:#ff0000;">to protect information vital to the case that Moyes may have to support the collusion allegations</span>.</p>
<p>The bigger issue at this point is <strong>&#8216;appearance&#8217;</strong>, and not results. I strongly believe that the Reinsdorf group is attempting damage control. It is fairly obvious that the concessions demanded from Glendale are highly unlikely to materialize, but the perception of looking like they are following through on an attempt is the goal at this point. To further back this up, we can look at comments made by Reinsdorf&#8217;s attorney, Alan Klein.</p>
<p>Statement via phone to the court, from Reinsdorf Group attorney <a title="Alan Klein to court" href="http://www.cbssports.com/nhl/story/12053074/rss" target="_blank">Alan Klein</a>:</p>
<blockquote><p>Earlier in the hearing, the Reinsdorf group&#8217;s attorney Alan Klein said by telephone that his clients were <span style="color:#ff0000;">fed up with the meddling and interfering</span> as they attempted to work out the details of their offer.</p>
<p>Klein indicated <span style="color:#ff0000;">Reinsdorf was on the brink of withdrawing</span> the bid.</p>
<p>&#8220;I don&#8217;t know how long we&#8217;re going to be in here wasting time and money,&#8221; Klein said, noting that confidential information already had been made public by Moyes&#8217; attorneys, who said it was a mistake and have apologized.</p></blockquote>
<p><strong>Analysis</strong>: When you are not a straight shooter you tend to contradict yourself in the attempt to cover up truths. Specifically in this case, you have Abramowitz saying that the court is urged to keep the bid alive, and in the next breath we have Klein saying his client is not going to waste time and money, and his client is on the brink of withdrawing?  Which is it, commitment or &#8216;flight&#8217;? Dedication to the cause, or just going through the motions? Again, are we supposed to pull punches when there is potential for collusion, and the stripping of a man&#8217;s wealth and reputation at stake? Short answer: No!</p>
<p>This whole attitude serves two purposes: 1) to give an excuse to pull out, and 2) to give justification for not wanting more information to become public.</p>
<p>The expectation of concessions from the City of Glendale is a PUBLIC matter. There should not be anything held secret regarding negotiations or anything else related to the taxpayers and their money. What could be so secret that it would send a bid and bidder packing? To put this in comparative terms, Jim Balsillie&#8217;s cards are on the table. The money for the team. There are no secret negotiations. Anything that needs to remain so secret in a situation so entirely suspect already cannot help but raise more flags and suspicion.</p>
<p>A further statement from <a title="What Abramowitz would not say" href="http://www.cbssports.com/nhl/story/12053074/rss" target="_blank">Abramowitz</a>:</p>
<p> </p>
<blockquote><p>Outside the courtroom, Abramowitz <span style="color:#ff0000;">declined to say </span>whether the company still supported Balsillie&#8217;s offer, as well.</p>
<p>Balsillie&#8217;s representative Richard Rodier said Abramowitz&#8217;s announcement came as a surprise in the long, twisted bankruptcy process</p></blockquote>
<p><strong>Analysis</strong>: Just like the conflicting lawyer statements for the Reinsdorf group (&#8216;court please consider this bid&#8217;, and the other, &#8216;we are ready to run&#8217;), the lawyer for SOF Investments pulled a turnaround that surprised everyone. Well, in order to appreciate and understand the conflicting positions and  the turnaround, it is important to look at the  <strong>&#8216;cover up&#8217;</strong> thinking.</p>
<p>Why would SOF first say they support the Balisillie bid?</p>
<p> Well, because the aspect again about being part of a collusion was the issue. If they say they do not support the Reinsdorf idea of renegotiated debt, <span style="text-decoration:underline;">that would get them off the hook for collusion</span>. But, upon further thinking, and perhaps discussion with the colluding members, the next strategy would come.</p>
<p> They must make it look like they are not phased by the allegations of collusion and <span style="text-decoration:underline;">go back to the original thinking</span>. The reason for this upon further reflection, is if SOF is scared off at this point, then in civil action, Moyes will have a strong case against the group, and use the evidence from the bankruptcy procedings in the future civil case. So, <strong>&#8216;appearing&#8217;  now as unphased</strong> by the allegations of collusion, explains the turnaround from <strong>the original &#8217;strategy&#8217;</strong> of supporting Balsillie to the new strategy of support for the Reinsdorf debt reworking. Ping pong best played by those scrambling to find the best way out of a terrible situation.</p>
<p> The only problem is, it becomes obvious when the facts are put together. This also further ties into Reinsdorf&#8217;s  &#8216;ready to withdraw&#8217; thinking. Everyone is simply looking for the best way out. The bid is just a means to an end. And since <a title="The concession dream!" href="http://www.winnipegfreepress.com/sports/hockey/escrow-rumblings-might-raise-kane-53028947.html" target="_blank">the expectations of concessions are so far out of sight</a>, and will likely never pan out, going through the motions  is of little risk:</p>
<blockquote><p>Heck, no wonder Jerry Reinsdorf might look at the Phoenix Coyotes &#8212; at least, if he gets the sweetheart deal from the City of Glendale that&#8217;s been reported. It includes a special tax to generate $23 million annually, plus $15 million if the Coyotes lose money.</p>
<p>Here&#8217;s our calculation: $38 million in taxpayers&#8217; money from the city, $8 million to $12 million in revenue sharing from the league, and another $10 million in escrow from players. See, that&#8217;s all you need to make hockey work in Phoenix &#8212; about $60 million every single season in glorified welfare. It&#8217;s so simple.</p></blockquote>
<p>To add further insight from my perspective into this, I will bring up again the &#8216;visits to the site&#8217; information to support the validity that collusion was very likely.</p>
<p>If I was completely out in left field, as a blog writer from Hamilton, Ontario, how in the world would I have had such an impact on this case in Glendale, Arizona? When the article about Jerry Moyes being a victim of a squeeze play was released, it cannot be emphasized enough that it stirred the pot, and <strong>had an immediate ripple effect of going from Vieste LLC, to the NHL offices, to the City of Glendale offices, in a very short period of time, and in that order. That is when they knew the &#8216;jig was up&#8217;!</strong></p>
<p>From that point, I have had a steady stream and pattern of visits to this site at key times. From MSD Capital and the City of Glendale just recently. The order of MSD, then the City of Glendale, further supporting the notion of &#8216;planning&#8217; to answer the allegations of collusion and to change the strategy, which we have seen threw a curve at the participants.</p>
<p>After these recent visits, the SOF position changed to support Reinsdorf&#8217;s restructuring of debt. From the outside view, <em>a twist</em>, but from an overview as explained by reactions and visits to certain articles on this site, a simple change of story, and strategy to minimize a potentially damaging situation. What&#8217;s the best way to handle this, and the potential of Moyes&#8217; taking civil action?  The new strategy we are witnessing now.</p>
<p>Let&#8217;s move on to <strong>Anthony LeBlanc</strong>. First, it is important to note that LeBlanc showed up in court. This was intentional strategy number one for Ice Edge.</p>
<p>What LeBlanc said, was even more important, and <a title="from Brahm Resnik in court" href="http://twitter.com/brahmresnik" target="_blank">this was the key</a>:</p>
<blockquote><p><img src="http://a1.twimg.com/a/1250103249/images/white.png" alt="White" width="1" height="50" align="left" />Coyotes BK: IceEdge&#8217;s LeBlanc says financing nailed down, near &#8220;partnership&#8221; w/Glade. Aware of perceptions: <span style="color:#ff0000;">&#8220;We don&#8217;t want to be <span style="text-decoration:underline;">vilified</span>.&#8221;</span></p></blockquote>
<p><span style="color:#ff0000;"> </span></p>
<p><strong>Analysis</strong>: Who exactly is &#8216;vilifying&#8217; Mr. LeBlanc? If he is referring to the facts as outlined in the articles from this site, then I would suggest Mr. LeBlanc become transparent as well. This is not to be counted on however. You see, when you have things that don&#8217;t work in your favor, you use again the rules of court to get away with not having to be transparent, and admit relationships, and other things. These are saved for civil procedings.</p>
<p>Instead, you agree with other parties that do not want certain things to be discussed, and become known, as in this <a title="LeBlanc as reported by Resnik in court" href="http://twitter.com/brahmresnik" target="_blank"><strong>comment by LeBlanc</strong> </a>in court:</p>
<blockquote><p>Coyotes BK: Leblanc says he agrees w/Reinsdorf threat to walk away. Would do same if asked for more info.</p></blockquote>
<p>Again, it was more important for LeBlanc just to be there. As far as can be remembered, the Ice Edge group is also expecting loan reworking of SOF, and negotations on concessions with the City of Glendale. Ice Edge is almost an afterthought at this time. Where is mention of SOF agreeing to the terms of the loan renegotiation with Ice Edge? Not an issue. The bigger issue is looking like business as usual.</p>
<p>The biggest statement LeBlanc said, was not wanting to be vilified. Translation: no, we are not guilty of collusion too. Please leave us alone.</p>
<p>This group is a non-entity in the grand scheme of things, at least at this point.</p>
<p>Finally, we move on to <strong>Gary Bettman</strong>. It is my understanding Mr. Bettman was ready to &#8216;testify&#8217; to the court, and when he was advised the court was not in session for testimonies, he commented that it was &#8216;like Seinfeld&#8217;, &#8216;nothing was happening&#8217;. Well, there was a lot happening, just not anything that would appear on the surface.</p>
<p>The sheer fact that Mr. Bettman wanted to make a probably well rehearsed speech, is in it&#8217;s own right, a suggestion that there are accusations that need to be addressed. Hence, Mr. Bettman&#8217;s presence in court. His comment though, outside of court, suggesting Reinsdorf was thinking &#8216;roadblocks&#8217; were put in the way of bidding, is absolutely correct.</p>
<p>You must understand, that for Jerry Moyes, his understanding of being setup, and colluded against would be considered grounds for a &#8216;roadblock&#8217; or two. It would be grounds for anyone.</p>
<p>From Judge Baum&#8217;s perspective, I can appreciate he is trying to avoid all unnecessary powderkegs in these proceedings, as he knows there are several. But he also knows that it is &#8216;not his department&#8217;. There are potential civil, and criminal issues at hand here, and he is avoiding them, and rightfully so.</p>
<p>How do I know there are more issues at hand? Well, again, when you can see the comings and goings on the site, it should be noted that the <strong>U.S. Justice Department, and the U.S. office for Fiscal Policy</strong> have been by. There is likely more going on behind the scenes than we will ever know.</p>
<p>This case, and the circumstances surrounding it are far reaching, and may have consequences that are just starting to be realized now.</p>
<p><em>So, in the words of Elmer Fudd, &#8220;Wun you waskle wabbit, wun!&#8221;</em></p>

Those are terms that just don&#8217;t apply to moves made by MLB&#8217;s current set of General Managers anymore. But not every GM in the league has the gumption of the Chicago White Sox&#8217; <a href="http://en.wikipedia.org/wiki/Kenny_Williams_(baseball)"><span style="text-decoration:underline;">Kenny Williams</span></a>.</p>

<p>Of course, not every GM in the league has eaten a peanut butter and jelly sandwich for lunch every work day for the past 9 years either or picks up jaywalking tickets in front of Seattle&#8217;s Safeco Field, but those are stories for another time.</p>
<p>Today&#8217;s news that the White Sox have <a href="http://mlb.mlb.com/news/article.jsp?ymd=20090810&#38;content_id=6357702&#38;vkey=news_mlb&#38;fext=.jsp&#38;c_id=mlb"><span style="text-decoration:underline;">picked up Alex Rios from the Toronto Blue Jays</span></a> in exchange for, well, nothing goes down in my book as one of the most intriguing acquisitions in recent years. The fact that it comes on the heels of Williams&#8217; acquisition of Jake Peavy from the San Diego Padres just adds fuel to the fire.</p>
<p>The Rios waiver claim transaction will be discussed for years due to the length (through 2014) and size (upwards of $60 million guaranteed) of the contract that Rios signed early in the 2008 season.</p>
<p>Outfielder Jermaine Dye, who is certain to be affected by the the addition of another big-money outfielder, is nonetheless <a href="http://blogs.chicagosports.chicagotribune.com/sports_hardball/2009/08/reaction-to-rios.html"><span style="text-decoration:underline;">&#8220;excited with the player he (Rios) is&#8221;</span></a> and expects Rios to help the team down the stretch.</p>
<p>Manager Ozzie Guillen calls it <a href="http://www.suntimes.com/sports/baseball/whitesox/1710184,CST-SPT-sox11.article"><span style="text-decoration:underline;">&#8220;great news, pretty good headache&#8221;</span></a> to figure out how to juggle the lineup to find playing time for everyone and seems ecstatic with the upgrade of Rios, irrespective of the contract situation.</p>
<p>And Ted Keith of SI.com is rightfully focused on the risk involved with taking on another high-priced, long-term contract so soon after bringing in Peavy, but acknowledges that the move confirms that <a href="http://sportsillustrated.cnn.com/2009/writers/ted_keith/08/10/rios.trade.reaction/index.html"><span style="text-decoration:underline;">Williams and the White Sox are going for a World Series title</span></a> this season.</p>
<p>Personally, I love it. Williams knows how to maximize the chips that he has and is bold enough to continue to allocate owner Jerry Reinsdorf&#8217;s money with the unwavering intent to bring another title to Chicago&#8217;s South Side.</p>
<p>The Sox are just three games out of the A.L. Central lead (behind Detroit) and Rios will help to close that gap while giving the franchise another asset to build around for the future. It&#8217;s not my money, but there are definitely worse guys than Williams around the majors responsible for spending it on behalf of their owners.</p>
<p>Williams delivered with a title in 2005, breaking an 88-year spell of futility. With Williams at the helm, there is no way that the Sox wait another 88 years for the next one. Whether or not the Rios and Peavy deals pan out.</p>

<p>Traditionally ,  I  like to sit  down  and   watch   many  of  the  sports&#8217;   magazine programs  that   are  on    television  .  Primarily , to  hear   the  views  of  the  analysts  out  there  and  to  see  how  they  might  view   various   situations  that  are   arising  around  the  sports  arena.   Funnily   enough ,  as  I&#8217;m  sitting in  bar  with  several   friends  enjoying  some  light  hearted  banter.    While   much   of  this  happens to  be  going  on.  I   look  up  to   see  none  other  than    <a href="http://en.wikipedia.org/wiki/Matt_Millen">  Matt Millen  </a>  and   <a href="http://en.wikipedia.org/wiki/Herman_Edwards"> Herm  Edwards </a>    on  <a href="http://espn.go.com/"> ESPN  </a>, discussing  the  <a href="http://nfl.com/"> NFL </a>.  Now   don&#8217;t   get  me   wrong   ,  but     while   both of  these   men   were  successful  over  the  course  of  their   playing   careers.     When  it  came  to   being   on   the  sidelines   either   from  the  executive   standpoint   or   from  a   coach&#8217;s .   Both   Edwards   and   Millen  , <em> shall  we  say , <strong> were less  than  successful  ?   </strong></em></p>

<p>Millen   presided   in   taking  the    <a>Detroit   Lions  </a>  from   being   a  once   respected   franchise   within  the  NFL   and  then    proceeded  to   turn   them  into  a  pedantic  and   absolutely   atrocious   football   team.   In the  2008-09    season  the   Lions    showed  us  ineptitude   that  no  one  thought  that  they&#8217;d  ever  witness  within  the  NFL  .    Losing  <em> all   <strong>  sixteen   regular  season  games </strong></em>    tends  to   take  a   great   deal    effort.   For   the   Detroit   Lions   under   Matt  Millen&#8217;s    tenure ,    they   made   it  all  look  so   effortlessly   easy.  And  that&#8217;d  usually   take  some   doing.</p>

<p>For  Herm  Edwards,   let&#8217;s   just  say  that  the     most  memorable   sound    byte  uttered   from  his   lips,    has  been  &#8220;&#8230;you   play  the   game   to   win.&#8221;   Unfortunately,   for   dear   old   Herm,  winning  wasn&#8217;t  something   that  came  along  with   a  great   deal   of   regularity   in  either  of his    tenureships   as  a   coach,   with  the  <a href="http://nfl.com/teams/newyorkjets/profile?team=NYJ">New  York  Jets </a>  or   the  <a href="http://nfl.com/teams/kansascitychiefs/profile?team=KC"> Kansas  City  Chiefs </a> .     I  can   only  surmise  that    ESPN   had   turned    to  these   two   individuals  , merely   because    on  the   food  chain  when  it  came   to    former   NFL    players  or   coaches  or   any  other   perceived   doyenne  of  that   ilk.   Both   Edwards  and   Millen   were   so   far   down  on  the  totem  pole  ,   that  their   asking   price  may    well  have  been a   cardboard   box    to  sleep   in  and   a  cup  of   soup.    In  reality   though  ,  ESPN  may   well     the  largest    sport&#8217;s    broadcasting     unit  in the  world.  But   when   it   comes  to      credible   sports&#8217;   journalism,    they   lie   up    there ,  somewhere   between    the  guys   responsible    for   the   <a href="http://en.wikipedia.org/wiki/Watergate_scandal"> <em> &#8216;Watergate    Scandal&#8217; </em></a>    and   the idiots   who    presided  over  the   <a href="http://pbs.org/newshour/media/media_ethics/casestudy.blair_php"> Jayson  Blair   cover up </a>.     </p>
<p>ESPN  now   has   become   for  all  sense   purpose   ,  purely  an   enteratinment    outlet   source   ,  rather  than   a   venue  being   well   informed   source   of    sports   information.  In  many   respects   it   borders   on  watching    a  three   ringed   circus with  the  presenters    acting   like  a  bunch  of   circus   clowns.   All that&#8217;s    left   out   of  the   programming    is  the perfunctory   pie  in  the   face routine .    But  then    again   a    pie  in  the  face   is   definitely   meant  to  be   funny , isn&#8217;t  it  ?  </p>

<p>It&#8217;d   appear   that   <a href="http://en.wikipedia.org/wiki/Gary_Bettman"> Gary  Bettman  </a>    in   his    own   perceived   urgency   to   see   the  <a href="http://nhl.com/">  NHL  </a>   remain   relevant.   He can   only  be  aghast,   with   what&#8217;s   allegedly   happening   with   regard  to    what   was  deemed  to  be  the   impending     auction  of   the   almost   defunct    <a href="http://coyotes.nhl.com/"> Phoenix  Coyotes </a> .     It  has     been  a  complete   farce  !       Bettman  and   the  Board   of   Governors  of  the  NHL   have  refused  the   bid  of    <a href="http://en.wikipedia.org/wiki/Jim_Balsillie"> Jim  Balsillie </a>   , who  as  founder  and   CEO  of    <a href="http://rim.com/"> RIM </a> ,  the  makers  of   the   Palm Pilot and  Blackberry,  had  stated    that  should   he   acquire  the  franchise , he  would  move  it   to  Canada.   Something  that   the  NHL  seems  to  have   no   desire   for.    The  other   potential   bidder    is     <a href="http://whitesox.mlb.com/">Chicago  White   Sox  </a> and      <a href="http://nba.com/bulls/"> Bulls&#8217;  </a>  owner    <a>  Jerry   Reinsdorf </a>.     And  it  certainly  hasn&#8217;t   helped    that  it&#8217;s   now  perceived  that   Reinsdorf   is   said  to  be   having   cold   feet   as  to  continuing   his   pursual  of  the bid.   Especially  as  the   litigation  process   surrounding   the  Coyotes   gets  murkier    by  the  minute .    Much   of  this    has   gone   on  primarily  because  the   franchise    has   been  mismanaged    ,  while     onetime   hockey   great,   <a href="http://en.wikpedia.org/wiki/Wayne_Gretzky">  Wayne   Gretzky  </a>   has   presided  over  the  debacle.    The    team   is   literally    bankrupt,   not   only   financially ,   but   also   in  terms   of   their   competitive   being.   There   mightn&#8217;t   be  a  worse   ran   franchise   in  all   of      professional    sports .   And   that&#8217;d   include  <a href="http://en.wikipedia.org/wiki/Donald_Sterling"> Donald  Sterling&#8217;s  </a>  <a href="http://nba.com/clippers/">  Los  Angeles  Clippers </a>.   </p>

<p>Much   of   this     has   come  from the    franchise&#8217;s   eagerness  to  rid   itself    of   its   debts,   incurred   in   operating   in  the  middle  of   nowhere.   Whoever   felt,   that  it   was   a  good   idea    to   have   a  franchise  in  Phoenix , couldn&#8217;t   have   done  a  great   deal  of   research   to  begin  with.    And   while  the  curiosity  factor   initially  brought    in  the  fans.    After   that   initial   impact ,  it  wouldn&#8217;t   have   been   remiss  to  state  that   was  the   only malaise   for the   Coyotes.      But   it  clearly    stems    from  the   fact  that   the  hierarchy  of   the  NHL   and   its   players   have   always    been   at   an   impasse  when  it  comes   to  the  business   aspect   of  making   the   sport   a   truly   successful   entity.    And    even  after    their  historical   labor  shutdown.  It&#8217;d  appear  that   the  NHL   and   its  players   simply   haven&#8217;t   learnt   their   lesson.</p>

<p>The   NHL  franchises   are   simply   back  to  their   idiocy  of   paying  the   players    exorbitantly   large sums   in  the   form  of  long  term   contracts   when  the  revenues    just  aren&#8217;t   simply  there  to    justify  it  at  all.  But  then  again    watching  the   NHL   conduct  their    business   is  very   much    like   watching   a   drunk   taking  a   field    sobriety   test.   They&#8217;re    just  bound  to   screw  things    up    one  way   or  another   and  then  simply   look  to   blame    someone    else    for    their   problems.</p>

The   player   is   obviously     besides   himself   ,  if    he&#8217;s  off  the    impression    that   the  Falcons   are     about   to  acquiesce  to   his   demands ,  and  <strong>pay   him  <em>  Fitzgerald   type   money. </strong></em>  Then    he&#8217;s  a   bigger   idiot   than  the   comedian ,  Carrot    Top  !  Roddy   White   has   yet    to  make  his  mark  within  the  NFL  ,  let    alone   be    considered   one  of  the   pre-eminent   wide    receivers   in  the   NFL.      But   yet     hear   we   have   a  fifth  year  starter    looking  to  be   treated    like   he&#8217;s   veteran  of  the  league    who    ought  to   be    getting   more    respect  than   he   deserves.  His  stats   and   presence   are  nowhere   on  par  with  that  of   Fitzgerald  ,  at  all.<br />
And   he&#8217;s  by   no  means  a    friggin&#8217;   game   changer   by  any   stretch  of  the   imagination  !</p>
<p>It&#8217;s   enough  that  the  league   and    Commissioner      Roger  Goodell </a>   now    has  an   image    problem ,  that   borders   on     being  made   comparison  to   that   of  the   gangsters  of  the     roaring    twenties   and   thirties.   We&#8217;ve    got    players    being   jailed    for    vehicular   homicide    and    another   even   more  prominent   player   in  <a href="http://nfl.com/players/michaelvick/profile?id=VIC311467"> Michael   Vick  </a>    coming  off   federal   jail   term    but   now   looking  to   be   reinstated   get   by  the  NFL.   And   at  the   same  time   resume   his   career   in  football  at  the  professional  level.</p>
<p>Well  now   comes  the   even   more   arduous   task   facing    Goodell   and  that    of  the  newly    designated   NFLPA  Executive  Director    in  <a href="http://www.nflplayers.com/user/content.aspx?fmid=178&#38;lmid=443&#38;pid=3009">DeMaurice  Smith</a>.    With  the  NFL     about  to    opt  of     the  collective   bargaining  agreement    which  expires  at   the  end   of  the   <strong><em>2010-11 </strong></em>   season.     The   negotiations    will   no   doubt ,  become   somehwhat   contentious.   The  players    seek  a  larger   part    of   what   they  believe  to  be   an   even  larger    slice  of   a  pie  that   runs  into    billions  of   dollars.      And the   NFL  now   knows  that  in  this    uncertain    economic    climate,   many  of their    patrons   in terms   of  the   corporate    clients   may   not   be  willing   to  impart  with  their     funds  the   way  that   they   once    did.    Furthermore,    the  broadcast and   cable   networks   though   they   tend  to   make  their  contract   agreements   several   years  in  advance.  They&#8217;ll  be   watching   with   great   intense   scrutiny  as  to    how  everything  plays   out.    They    more than   anyone   else   have   more  to    lose   should   things   go   up   in  smoke.  And   at   the   same  time   the   fans   may   well   be   the    biggest   losers  of   all,   should  an  agreement   not   be   reached   between  the   two  parties.   An   uncapped   season  could   lead  to    ticket  prices   rising    in  order   for  many  of  the  franchises   recoup    some   of   the   lost   revenues.  But  then  again,  what&#8217;s  new  ?    </p>

<p><a href="http://nfl.com/players/plaxicoburress/profile?id=595691"> Plaxico Burress&#8217;  </a>   lawyer    <a href="http://www.lawyers.com/brafman&#38;rosspc/jsp2189093.jsp">Benjamin  Brafman</a>,   states  that  there   were   mitigating  circumstances   concerning  his   client&#8217;s  predsiposition ,   with  regard  to  him  being  indicted   on  illegal   possession  of  a  firearm  and   criminal  neglect.   Unless  I&#8217;m   mistaken  there  can  be   no  mitigating   circumstances   for   carrying   a  weapon  that was   unlicensed  in  any  of  the   states   where   Burress  apparently   either  has  a  home  or   that  was   his   place  of  employment.  Brafman  is   merely  adding  insult  to  injury   by   disprespecting  the  public   and   above all  the  integrity  of the   judicial  system  within  the  state  of  New  York.      But  then  again  one  merely   has   to   look  at  what  occured   at  the  Latin  Quarter   Club in  Manahattan ,  to  realize  what  a  complete  ass     Burress  is  to   begin   with  !  I  can   only   hope  that  the   judicial   system   within the   state  of   New  York  and  in  particular    Manhattan  makes   sure  that  an   example   is  made   of   Burress   to  begin  with.     As   to  Buress&#8217;  former   teammate,  <a href="http://nfl.com/players/antoniopierce/profile?id=PIE190923">  Antonio  Pierce  </a> . Who  states ,   that  he  acted   responsibly  and  would   do  the  same  thing all  over  again.  I&#8217;ve  this  to  say  to   him  <strong> &#8221; &#8230;  did   it  not   for  one  instance   occur  to  you ,  that   with  Burress  having  a  concealed  weapon  in  a  night  club   they   were   asking   for   trouble  to  begin with &#8221; ?  </strong> </p>
<p>Well  there   you   have  it  my   take   on    issues  such  as  credibility  within  the  realms   of  the  sports  arena   and   what   I  for   one   find    completely   comedic     about  it  all.   Hopefully   there  are   one  or    two   stories  that   you&#8217;ve   indeed   come  across  as   of   late.   That&#8217;ve   ended   up   with   you   asking  yourself   the  question  .    Are  they   really  that   stupid  ?  And     surely   they   didn&#8217;t   just   do  that   or  actually  want us  to   believe  that  was    what  they  meant  ?       </p>

<title><![CDATA[Putting your identity in this is just plain, 'silly human pride'!]]></title>

<p style="text-align:center;"><strong><em>Is this just plain silly? Or is there something more sinister underlying the stubborn Commissioner and his disrespect for the court, and Jim Balsillie?</em></strong></p>
<p>Everyone learns a lesson or two in life.</p>
<p>Are we to go through life without ever having to admit we took a wrong turn, made a blunder, or even was so stubborn that we could not admit defeat? You know the expression, &#8216;It takes a big man to say he is sorry&#8217;! It takes a man to swallow his pride!</p>
<p>Well, like Judge Baum, <a title="Commissioner of the NHL (defined)" href="http://en.wikipedia.org/wiki/NHL_Commissioner" target="_blank">Commissioner </a>Gary Bettman has to regain his composure here. It&#8217;s easy to get carried away in the heat of the battle, and lose focus on the bigger picture. Well, it would seem Mr. Bettman, being &#8216;only human&#8217; has gone a little too far, and is not doing what is best for the game of hockey at this point, and is putting all his eggs in one basket.</p>

<p>Since Gary Bettman is <span style="text-decoration:underline;">the NHL&#8217;s first Commissioner</span>, perhaps he can set a precendent of accomodation. Or, he could act like a man obsessed with power and pride.</p>
<p> No doubt the &#8216;opinion&#8217; of the NHL Board of Governors is largely attributable to the spinoff from the anger Mr. Bettman must have conveyed about Jim Balsillie. Let&#8217;s face it. Mr. Bettman is going to have an influence as a leader of the BOG that he reports to.</p>
<p>Will this be a learning experience for the NHL and it&#8217;s owners, players, and fans that putting too much power and influence in the hands of a single man is potentially disasterous?</p>
<p>It really is no different than the analogy of say, a Credit Union. Often, the manager of the credit union reports to the Board of Directors, and most times, his or her opinion &#8216;becomes&#8217; their opinions. In short, the manager is the leader, and well, it is often OK to follow the leader.</p>
<p>But we also have a situation where teams and their finances are &#8216;isolated&#8217; from the other teams. The only common denominator to all the owners and their financial affairs is the Commissioner and his office. This breads an almost unfair advantage. In previous articles, I touched on the mushroom principle (or theory).</p>
<p>Let&#8217;s hope that the Commissioner doesn&#8217;t have something to hide! Would Jim Balsillie&#8217;s entering the mix put pressure on his office, in his mind, and does he fear the obvious strength and opinion a man like Jim Balsillie would bring to the table? Is it a <span style="text-decoration:underline;">question of pride</span> on the part of Gary Bettman, or is it <span style="text-decoration:underline;">something far more sinister</span>, as in trying to keep a secret, well, secret?</p>
<p>Let&#8217;s hope for Commissioner Bettman&#8217;s sake, it&#8217;s just pride. And for him, I would urge him to head the words of a classic.</p>
<p>Silly human pride, words in the &#8216;Stand Tall&#8217; song as sung by Burton Cummings explains it best.</p>
<p>In fact, I keep hearing the words of that song going through my head. Key parts that make me understand the mood of the man when he wrote that, and the revelation he must have experienced. As poor as I am at  remembering lyrics, I remember the words as they went, in part,  something like this:</p>
<blockquote><p>Never been so blue&#8230;&#8230;.ohhh, never knew the meaning of a heartache&#8230;..</p></blockquote>
<p>And then in<a title="I'm scared (B Cummings)" href="http://www.tsrocks.com/b/burton_cummings_texts/im_scared.html" target="_blank"> &#8216;I&#8217;m scared&#8217; </a>another Burton Cummings song, he breaks down yet again to sing:</p>

<p>And, we could look to Hannah Montana, who sang something like:</p>
<blockquote><p>Everybody has those days&#8230;.everybody makes mistakes&#8230;.</p></blockquote>
<p>If we look at the credit union industry again, and some of the managers, know that some of the managers in control and leading the opinions of the board of directors, thought they had too much control.</p>
<p>In thinking so, some of the managers did things less than ethical, and less than legal. They eventually got caught.</p>
<p>I would have to say that should Gary Bettman be listening. If this is just about silly human pride, regain your composure and get over it. If it is something else, then we have a bigger problem, don&#8217;t we?</p>
<p>Time will tell. I would suggest Mr. Bettman does the smart thing, and does not go for broke. All eyes to you Mr. Bettman. Anything you do or don&#8217;t so at this point is going to lend itself to questioning motives. I would suggest we don&#8217;t go that far. Time to forget standing tall. Time to swallow silly human pride. If there is more to hide, <strong><em> I can guarantee one thing; It won&#8217;t be hidden forever</em></strong>.</p>
<p>The Shakespearean expression  from <a href="http://en.wikiquote.org/wiki/Hamlet" target="_blank">Hamlet</a> that <strong><em>&#8216;thou doth protest too much&#8217; </em></strong>fits this situation to a tee. Eventually everyone is going to question the objection. Judge Baum already is questioning it, and he is a man with much wisdom.</p>
<p>Note the smarts of Judge Baum, that should make his son proud. One bid, all bidders in. So when you place your bid, you take your choice. Is this a &#8217;stay home&#8217; or &#8216;pack up&#8217; bid? In other words, a relocation &#8216;in disguise&#8217; is not going to fly.</p>
<p>And, Gary Bettman has little opportunity to pull more rabbits from the hat at this point.</p>
<p>You see, Judge Baum has been insulted. His court has been insulted. His legal eyebrow has been raised. And, in the nicest possible way, he has placed the cueball behind a &#8216;blue ball&#8217;, when the NHL needs to sink a &#8216;red&#8217;. In short, Judge Baum is doing his part, and he has effectively <em><strong>&#8217;snookered&#8217; </strong></em>the NHL and it&#8217;s partners.</p>
<p>How far will it go?</p>
<p>Will Gary Bettman come out as being the bitter but better man for admitting the obvious? Or will he continue to paint himself in the corner, lending question to alterior motive or fears? &#8216;Stand Tall&#8217; or&#8217; fall down to you knees&#8217;? The puck&#8217;s in Bettman&#8217;s end. Will he try another rush, or will he ice it, and give us all a much needed break?</p>

<p>Land development seems to be the order of the day for Related Companies, and MSD Capital. And we are not talking small potatoes either. Here are some exerpts and notes of interest to solidify the land development interests of some of the players in the Phoenix Coyotes case. Take from it what you will.</p>
<p>The <a title="Related Companies at it again" href="http://www.nytimes.com/2006/05/27/nyregion/27garden.html" target="_blank">New York Times reported </a>the Related Company wooing of the Mayor of New York in 2006:</p>
<blockquote><p>The proposal — a commercial complex that would rival Rockefeller Center in scope — is sprawling, <span style="color:#ff0000;">expensive and fraught with <span style="text-decoration:underline;">political consequences</span></span>. But after years of discussions between the developers and the owners of Madison Square Garden, the specifics are finally emerging.</p>
<p>On Tuesday, the developers — Steven Roth of Vornado Realty and his partners at the <span style="text-decoration:underline;">Related Companies</span> — sought to convince Mayor <a title="More articles about Michael R. Bloomberg." href="http://topics.nytimes.com/top/reference/timestopics/people/b/michael_r_bloomberg/index.html?inline=nyt-per">Michael R. Bloomberg</a> that moving the Garden one block west to Ninth Avenue would open up a historic opportunity to transform a dowdy and claustrophobic transit hub, overhaul an important corner of the city and <span style="color:#ff0000;">generate tens of millions of dollars in tax revenues</span>.</p></blockquote>
<p> </p>
<p>And in December 2007, <a title="Seeking Alpha on Related Companies" href="http://seekingalpha.com/article/57538-real-estate-developer-gets-1-4b-cash-infusion" target="_blank">Seeking Alpha reported</a>:</p>
<blockquote><p>Goldman Sachs (<a title="More opinion and analysis of GS" href="http://seekingalpha.com/symbol/gs">GS</a>), Abu Dhabi&#8217;s ever-expanding investment arm and others have agreed to invest $1.4 billion into privately-held Related Cos., a deal that will allow it to continue investing despite today&#8217;s less borrower-friendly climate. The deal, expected to be announced today, includes about $400 million from Goldman and <span style="color:#ff0000;">Michael Dell&#8217;s investment firm <a title="MSD Capital on Zoom" href="http://www.zoominfo.com/Search/CompanyDetail.aspx?CompanyID=80775695&#38;cs=QHE0IoPBc" target="_blank">MSD Capital</a></span>, giving them a <span style="color:#ff0000;">7.5% stake in Related</span>. Abu Dhabi and Saudi company Olayan Group will invest about $1 billion, sources told the <a href="http://online.wsj.com/article/SB119786287442733117.html">Wall Street Journal</a>.</p></blockquote>
<p>And further in the article:</p>
<blockquote><p>Together with Vornado Realty (<a title="More opinion and analysis of VNO" href="http://seekingalpha.com/symbol/vno">VNO</a>), it runs a $14 billion project in downtown NYC which involves building two train terminals and a <span style="color:#ff0000;">new Madison Square Garden</span>.</p></blockquote>
<p>The bigger project did not fly with a moved Madison Square Garden. </p>
<div class="mceTemp">The bigger project ran amuck, and the Dolan&#8217;s pulled out. But renovations of the MSG are looking to take place as in this artist rendering from this <a title="Curbed view of the new MSG" href="http://curbed.com/tags/madison-square-garden-renovation" target="_blank">June 2009 article</a>.</div>

<p>And, if you think luxury boxes are special, wait till you see the <a title="Info on the supersuite in MSG" href="http://www.nydailynews.com/money/2009/06/03/2009-06-03_madison_suite_garden.html" target="_blank">supersuite</a>! :</p>
<blockquote><p>The <strong>&#8220;supersuite&#8221; will be the size of 10 suites</strong> and can be broken down into smaller rooms if necessary.</p></blockquote>
<p> At the end of the day, this is the reality, with the other projects put on hold, <a href="http://blog.taragana.com/sports/2009/06/03/madison-square-garden-renovation-will-cost-more-take-longer-and-include-luxury-supersuite-1377/" target="_blank">the priority is the renovation </a>of the MSG:</p>
<blockquote><p>The renovation of the nation’s busiest arena will take a year longer than planned — the upper level won’t be finished until the beginning of the NBA and NHL’s 2012-2013 season — and will go over its $500 million budget, MSG Vice Chairman Hank Ratner said.</p>
<p>But, “<span style="color:#ff0000;">we’re not going to be looking for anyone else to pay for it,” </span>Ratner said.</p>
<p><span style="color:#ff0000;">The city and state have committed hundreds of millions in bonds and other incentives</span> to the Yankees and Mets’ new stadiums and a planned arena for the New Jersey Nets.</p></blockquote>
<p>Interesting choice of words&#8230;.maybe the City has learned that the bond issues and the promise of &#8216;buy now, pay later&#8217; is not necessarily the best choice. If Related had their way, would the financing have been in the same type of sales tax related land development subsidies? Perhaps it will be of interest in future posts to look at the details of the Yankees, and Mets stadiums and the planned arena for the Nets.</p>
<p><strong>Related Companies</strong> did not realize<a href="http://www.plannyc.org/taxonomy/term/717" target="_blank"> their original proposal </a>that would have been huge:</p>
<blockquote><p>Following rejection, an alternate plan, known as Plan B, was developed by Manhattan Borough President Scott Stringer (D-Manhattan), then-candidate for Governor Eliot Spitzer (D-New York), New York State Assembly Speaker Sheldon Silver (D-New York), and the Moynihan Station Venture – a collaboration between private developers Vornado Realty Trust and The <strong>Related Companies</strong>. Plan B laid out a significantly expanded vision. <span style="color:#ff0000;">At a total cost of $14 billion, Plan B proposed relocating MSG</span> to the Farley Post Office and replacing the existing MSG with a renovated Penn Station and several office buildings. The massive scope and scale of the project, combined with rising construction costs and a weakening credit market, inhibited progress on the proposed project.</p></blockquote>
<p> While Related Companies didn&#8217;t get their way in the MSG and area development, it was not without trying.</p>
<p>On July 31st, it was announced that MSG would <a title="MSG breaks away from Cablevision" href="http://newsfeedresearcher.com/data/articles_b31/cablevision-company-garden.html" target="_blank">break away from the owner</a>, Cablevision parent. I wonder what the new deal will be as a tax incentive to the cablevision shareholders.</p>
<p>The <a href="http://www.nydailynews.com/news/2007/11/18/2007-11-18_christine_quinn_targets_madison_square_g-1.html" target="_blank">old deal</a>, as reported in 2007 saw:</p>
<blockquote><p>MSG&#8217;s owners, Charles Dolan and his son, Jim, haven&#8217;t had to pay property taxes on the famed arena since 1982 &#8211; <span style="color:#ff0000;">an exemption that&#8217;s now worth $11 million a year<span style="color:#000000;">.</span></span></p>

<p>As shown in the &#8216;old deal&#8217; article, there were the folks that were against tax subsidies to the rich owners of the arena, and I am sure whatever deal the Dolan family has now, it will be just as lucrative.</p>
<p>The difference between MSG and Jobing.com arenas are miles apart. I am sure 72% of taxpayers don&#8217;t argue with the deals for MSG. But 72% do argue in Glendale. And that is the important point.</p>

<p>Is it a small world or what?</p>
<p>There are no <em>&#8216;by chance&#8217;</em> referrals in this Glendale saga. Anyone introduced to the <strong>City of Glendale </strong>needs to be connected to the <span style="text-decoration:underline;">bigger picture</span>. That much we know.</p>
<p>So,  it&#8217;s time to now look beyond <strong>Daryl Jones</strong> and his group. We learned that  Jones was connected to <strong>Onex</strong>, and his ex boss <strong>Eric Rosen</strong>, who left Onex to become the partner with <strong>Michael Dell in MSD Capital.</strong></p>
<p><strong>Alan Leventhal</strong> owns the <strong><a href="http://www.manta.com/coms2/dnbcompany_cgnj0t" target="_blank">Beacon Sports Capital Partners</a></strong>, the firm that was brought in <a title="Beacon Sports asseses Jobing.com" href="http://www.examiner.com/x-14945-Phoenix-Coyotes-Examiner~y2009m7d24-July-24-Yotes-Notes" target="_blank">to assess </a>the Jobing.com Arena for the City of Glendale. His firm was referred by <strong>IFG (Michael Reinsdorf)</strong> to the City of Glendale. The report  from Beacon Sports Capital (Leventhal) was sent to <span style="text-decoration:underline;">John Kaites</span> <strong>a month before the bankruptcy</strong>, as described in this <a href="http://www.examiner.com/x-14945-Phoenix-Coyotes-Examiner~y2009m7d24-July-24-Yotes-Notes" target="_blank">article</a>.</p>
<blockquote><p>A letter summarizing these recommendations was sent to <strong>John Kaites</strong> on April 15, 2009, <span style="color:#ff0000;">a little less then one month before Moyes put the Coyotes into bankruptcy</span>. Kaites is a member of Jerry Reinsdorf’s Glendale Hockey, LLC group.</p></blockquote>
<p>The whole month before thing shows us there was thinking in the works before Moyes made the bankruptcy official. So when the NHL says his filing for Chapter 11 took them by surprise, we should not be surprised to know it was really no shock at all. Also explains the proxies that were an attempt by the NHL to deter Moyes from actually going through with it.</p>
<p>Now, <strong>Alan Leventhal</strong> also owns <strong><a title="Beacon Capital Partners" href="http://www.answers.com/topic/beacon-capital-partners-llc" target="_blank">Beacon Capital Partners</a></strong>, that specializes in <em><strong>Real Estate Investment Trusts</strong> (REIT&#8217;s</em>), as described by Answers.com:</p>
<blockquote><p>Beacon earns its bacon by collecting offices. A private real estate investment trust (REIT), <span style="color:#ff0000;">Beacon Capital Partners invests in and renovates commercial and mixed-use properties in major metropolitan markets throughout the US.</span> Beacon also has properties in London and Paris. The company manages investment funds on behalf of institutional, corporate, and government investors. Beacon Capital Pratners was formed in 1998 after predecessor public REIT Beacon Properties merged with Equity Office Properties Trust in a $4 billion transaction.</p></blockquote>
<p>Remember, <em>&#8216;mixed use&#8217;</em> was the term used for the CityNorth land subsidy issue. Could there be use for REIT&#8217;s in Glendale and other parts of Arizona? Where there&#8217;s smoke there&#8217;s fire. Nothing about the Phoenix Coyotes in Glendale is the true draw. Everything outside of hockey is the true reason to help the City with aspects of the Coyotes lease, and arena.</p>
<p>Alan Leventhal is also a <em>Board of Governors member</em> of the <strong>National Association of Real Estate Investment Trusts</strong> (NAREIT), as shown in <a title="Beacon and NAREIT" href="http://muckety.com/Beacon-Capital-Partners/5025902.muckety" target="_blank">this muckety chart</a>. So, he is well connected and well respected with regard to REIT&#8217;s, and seems in it for the long haul.</p>
<p>As we are learning in Glendale particularly, sports management  services go hand in hand with real estate  and land development opportunites. One would wonder where the connection with <strong>Michael Reinsdorf</strong> would be in  this scenario. Why would Michael Reinsdorf connect Lenventhal with consulting for the  Jobing.com arena (and the City of Glendale)?</p>
<p> Could there be more connections related to commercial real estate with Leventhal and the City of Glendale?</p>
<p>Well, let&#8217;s dig a little shall we?</p>
<p>There has to be &#8216;<em><strong>a friend of a friend somewhere&#8217;</strong></em> that would tie in lucrative and influential <strong>Leventhal </strong>with land development and other opportunities, that would make that $48,000 he charged the City via <strong>Ed Beasley</strong> ( carefully placed under the radar) to be a simple loss leader.</p>
<p>Well, here&#8217;s a possibility.</p>
<p>Leventhal is the Chairman of <strong><a title="Muckety connections - Boston U to MSD Capital" href="http://muckety.com/Query?name=Boston+University+and+Eric+Rosen&#38;prev=Boston+University+and+Eric+Rosen&#38;graph=MucketyMap&#38;SearchResult=5000268&#38;SearchResult=82059" target="_blank">Boston University</a></strong>.</p>
<p>A man named <strong>Donald Fraser</strong> is a <strong>Professor at Boston University</strong>, and therefore we could assume he would know Leventhal.</p>
<p>Well, <strong>Fraser</strong> is also by chance a <strong>Director of DRS Technologies.</strong> Isn&#8217;t that a coincidence? So is  <strong>Eric Rosen </strong>( a <strong>Director of DRS, and Partner of MSD Capital</strong>). So Fraser and Rosen are both directors of DRS, and Rosen a partner with Michael Dell. Small world or what?</p>
<p>Therefore, it would seem we can tie Leventhal <a title="Muckety map on Leventhal via Boston U, Fraser, DRS and Eric Rosen" href="http://muckety.com/Query?name=Boston+University+and+Eric+Rosen&#38;prev=Boston+University+and+Eric+Rosen&#38;graph=MucketyMap&#38;SearchResult=5000268&#38;SearchResult=82059" target="_blank">by the muckety map </a>to connections that would lead him to <strong>MSD Capital</strong>. And why not? When you are in real estate investments through REIT&#8217;s, it sure opens up some interesting opportunities to have contacts in Glendale, through Michael Reinsdorf and Michael Dell.</p>
<p> To summarize, could the sports management sideline business be an excuse to get in under the radar with<strong> Beasley</strong> and the City, through <strong>Michael Reinsdorf</strong>, and lead to other real estate investment opportunities with the City and <strong>MSD Capital</strong>? It sure opens up that possibility now, doesn&#8217;t it?</p>
<p>And in this parade of friends that use sports to get to the real money, it would sure seem to fit this story! And as for MSD Capital? Why does this company always seem to be the root of many relationships?</p>
<p>If some reporter for a paper that wants to get to the bottom of things should check the lunch receipts for Ed Beasley, do you think there is good chance Lenventhal would be etched on the receipts somewhere?</p>

<p>Wow!</p>
<p>I sit in reflection of the <a title="Something Smells in Glendale (PNT)" href="http://www.phoenixnewtimes.com/2009-07-30/news/glendale-the-coyotes-and-the-john-kaites-connection/1" target="_blank">Phoenix New Times article of August 3rd</a>, and I can&#8217;t help but think, &#8216;Yes, finally some dog gone, drag out, get to the bottom of it reporting!&#8217;</p>
<p>Well, actually, the first time I was impressed with the PNT reporting was on the excellent article about the CityNorth Phoenix land development subsidies, that basically proved that  a City can act just as  irresponsibly as the average household. Buy now, and prepare to pay large later. The only sure gainers in that <em>game</em> are the lenders and land developers. Easy money for the rich, on the backsides of the middle and lower income earners. And, it  makes you wonder how in the heck these deals could happen. Who negotiates these lucrative opportunities, and why?  At least we can take comfort in learning that the <span style="text-decoration:underline;">land barons</span> lost their appeal in the Supreme Court.</p>

<p>Have you ever wondered how some people are able to &#8216;carry on&#8217; their less than ethical ways and not get stopped?</p>
<p> You know the scenario. We have an expression for some people. We like to call them <em><strong>&#8216;Teflon Tims&#8217;</strong></em>. They seem to do things that are less than noble, time and again, and just don&#8217;t seem to have to pay the piper. We wait, in patience, or sometimes impatiently, for those people to <strong><em>&#8216;finally get theirs!&#8217; </em></strong>Until then, the ramifications of their actions seem to fall away, like food on a teflon fry pan. <em>Swoosh&#8230; gone as if it was never there. </em>No consequences. No exposure.</p>
<p>When Jerry Moyes put the Phoenix Coyotes in Chapter 11, and found Jim Balsillie to buy the team and satisfy his needs, it could have been a non-eventful process. Kind of like when the Montreal Canadiens seemlessly changed hands over the past little while. Blink, and you might have missed it. Wow! It could be that easy?</p>
<p>Over the past while, strange things have occured. Ponzi schemes by the handful exposed. Corporations exposed for less than ethical behaviour or accounting practices. The economy a facade,  to fall on a far grimmer reality. And now, the NHL.</p>
<p>Is it just me, or is &#8217;<em>strange&#8217;</em> becoming the new normal?  With wierd uncoverings of truths. The <strong><em>Teflon Tims</em></strong> losing their lustre, and having to face the past, and their demons.</p>
<p>What&#8217;s incredibly interesting in the current Coyotes case  is that there are so many<strong><em> &#8216;Tims,</em>&#8216;</strong> all coming at once to face the music . Each one having a role to play in this saga, but each  having to face their own realities.</p>
<p> Absolutely fascinating stuff!</p>
<p>It makes you hope the experience will teach each of them a valuable lesson. It makes you wonder if the experience will be <em>&#8216;life altering&#8217;</em>?</p>
<p>Who would have known a simple auction process in a bankruptcy court would be the root of such human drama?</p>
<p>How will <strong>Gary Bettman</strong> surface from the rubble of the exposure that is taking place regarding the NHL&#8217;s potential collusion with the City of Glendale, and the &#8216;friends of Glendale&#8217;? How will it look on the NHL when they seem to have more contact and compassion for everyone else but the current owner Jerry Moyes? With all the mudslinging, how will it look should Jim Balsillie be awarded the team, and Gary Bettman will have to now work with Balsillie as a new owner? Has Gary Bettman crossed the line, and committed himself too far, and made it too obvious that he has a personal dislike for Balsillie? How will he account for the &#8216;uniqueness&#8217; of each team&#8217;s financial position? Will he be able to come clean? With profit sharing issues and the arena subsidies, how will he appease those teams upset by the reality proven by this fiasco? Subsidizing a team that thrives on all kinds of subsidies to survive? Many questions to be answered and faced.</p>
<p>How about <strong>Jerry Reinsorf </strong>? How will he explain the relationship with John Kaites, and in turn Ed Beasley, and the obvious advantage it has with the negotiations with the City of Glendale? And, the advantage he has with son <strong>Michael</strong>, who already works closely with the City, in several key capacities. No matter what happens, a succesful acquiring of the Coyotes will be tainted by accusations of favoritism and unfair advantage. It would seem a situation of networking at it&#8217;s finest. A man that was voted the &#8216;most networked&#8217; in Chicago. Will it be viewed as a man strategically using influence to get what he wants?</p>
<p>What of <strong>Michael Dell</strong>? If he works a deal to renegotiate the SOF debt, will he be looked at as the man that didn&#8217;t do Jerry Moyes any favors, but because of his land development strategies in Arizona, and the contacts surrounding Glendale, that he would favour a fellow friend, instead of compassion for one not in the close knit business group? What of his decision to become a shareholder of Related Companies, involved in CityNorth, and the land development subsidies? How will this be looked upon by the taxpayers of Arizona?</p>
<p> How about <strong>Ed Beasley</strong>, the City Manager of Glendale? As pointed out in the Phoenix New Times article, his apparent favoritism towards John Kaites? It makes you wonder as a public official if he should be holding close friendships of this nature with clients of the City. How will Glendale residents view his character for the role he is playing in the apparent collusion with the Reinsdorf/Kaites group? How will this affect any liability he could expose the City to should Jerry Moyes take civil action for damages?</p>
<p>For <strong>other officials at the City of Glendale</strong> involved in this process, and voted in by residents and taxpayers. How will they appear when the deceptions are brought to the surface? So many secrets and delays for a City accountable to the people. Will there be a public outcry and protest?</p>
<p>And <strong>John Kaites</strong>? A man that has networked and befriended his way to where he is today. A lawyer with roots in Phoenix. After this mess is over, who will have confidence in his ability and feel confident of his ethics? His slip up that the City was negotiating with the &#8216;robust group&#8217; he represented for <span style="text-decoration:underline;">at least six months</span> leading to the bankruptcy was a royal blunder.</p>
<p>As pointed out bluntly by the Phoenix New Times, the whole situation simply &#8217;smells&#8217;! There is no better way to describe it. All the players in this game are going to have to answer for their roles, one way or another. Either now, or sometime in the future, the events surrounding their role in this fiasco will be taken into account. That much I&#8217;m sure.</p>
<p>Even the <strong>Daryl Jones</strong> group is suspect because of relationships as described in previous articles. Can anyone that is pulled from the NHL hat be trusted, or do we simply need to overturn some rocks to find a connection?</p>
<p>We could go on and on. The point is that many will have to face their own shortcomings, seemingly at the same time, due to the same circumstances.</p>
<p>They could have missed this train, if only the sale of the Phoenix Coyotes went as uneventfully as that of the Montreal Canadiens. It was not meant to be.</p>
<p>No, this train of fate, left the station with many passengers. As if the &#8216;Final Destination&#8217; to face their demons awaited them on this journey.</p>
<p>It would seem the ride will have to play itself out. The fate train has left the station, and won&#8217;t stop until the journey comes to it&#8217;s logical end. Until the demons are faced. Until it pulls into the next station.</p>
<p>What will the new lanscape be like?  What will be the <em>life altering</em> lessons learned on this journey?</p>

<p>That is what we were led to believe by the brass at the NHL over the years. Everything is just fine.</p>
<p>Forget Forbes&#8217; or Fitch&#8217;s ratings. Forget the press, forget them all, because everything is just fine, OK!</p>
<p>Well, if everything was just fine, why are we finally getting a glimpse of a reality far removed from fine?</p>
<p>Why has Jim Balsillie had a few chances to be a &#8216;white knight&#8217; on his own terms, and look to bailout some franchises in trouble?  Doesn&#8217;t sound like everything was just fine to me.</p>
<p>Everything was just fine in the U.S. housing market until the bubble burst too, and it was discovered that if you could fog up a mirror, and had a pulse, you were eligible for a fairly large mortgage. We were led to believe it was all just fine till we found out the truth. Then, just how &#8216;not fine&#8217; it was began to surface. And, if you can fog up a mirror and your name is not Jim Balsillie, you might want to call Gary Bettman. Has he got a no money down deal for you. Just don&#8217;t have any bats in the bellfrey. We might find out what they are.</p>
<p>I&#8217;m sure when the dirt of the state of the economy in the U.S. began to surface there were many on edge, and many questions to be asked and answered. Well, we could be at that stage for the National Hockey League.</p>
<p>Look at Bernie Madoff&#8217;s lucrative, but now exposed, Ponzi Scheme, where <a title="Madoff Webbof Deception" href="http://muckety.com/Bernard-L-Madoff/94883.muckety" target="_blank">Muckety adds</a>:</p>

<p>Click on the &#8220;Muckety adds&#8221; link above and you can see a web of people fooled by Madoff. The trick behind it is, don&#8217;t tell one person the deal you have with the other. Because if they knew it was their friends money disguised as &#8216;true return&#8217;, then that would tell a far grimmer tale, than if the money were earned legitimately. We could liken that to &#8220;profit sharing&#8221;. Sound familiar? Kinda like &#8216;robbing Peter to pay Paul&#8217;. Only we call that a league process, to give it validity and meaning. Ok?</p>
<p>The current crisis in the U.S. has been largely due to deception. The reality of the economy not matching the display of wealth and lifestyle many experienced. But it was to be a short-lived bubble. It could not continue for long, without the collapse we see today.</p>
<p>It is interesting to note the similarities though. You need a few, setting procedure and guidelines that many follow. Once it is discovered that the underlying principles behind the guidelines are flawed, then exposure results, and the truth surfaces.</p>
<p>Could this be what we are now seeing as a result of the Phoenix Coyotes court case?</p>

<p>Remember Commissioner Bettman. He explained to Ron McLean that the Coyotes were never in jeopardy, and the thought of it was just &#8217;silly&#8217;. Well, the question is, who wasn&#8217;t in jeopardy? Did Gary Bettman think Jerry Moyes, the owner of the Coyotes wasn&#8217;t in jeopardy? Because the facts speak a different tune. Or, was Bettman thinking the &#8216;plan&#8217; that was there would mean the team was not in jeopardy? The plan, that apparently was in the works for at least six months according to <strong>John Kaites</strong>, the lawyer for the <strong>Reinsdorf</strong> coalition. Would it be that group to suggest the team was never in jeopardy, if we could &#8216;<em><strong>just get the team in the hands&#8217;</strong></em> of that group? Boy, problems would go away!</p>
<p>Well, the team is not in the <strong>Kaites</strong> group&#8217;s hands, it&#8217;s in Jerry Moyes&#8217; hands. He is still the owner until he sells the team. Moyes is questioning the validity of Reinsdorf as a prospective owner for good reason.  Forget Balsillie. <strong><em><a title="see the bullet summary (laundry list) of concerns with the friends of Glendale" href="http://makeiteighteh.com/2009/07/23/bullet-summary-of-the-coyotes-mess/" target="_blank">We have more questions with Reinsdorf</a></em></strong>. Just read some of the articles here, and we could all go to the &#8216;red flag&#8217; store, and wave until we lose a few pounds, and firm the muscles under our arms. Is this why the bidders need more time? Getting the cold feet of <strong><em>&#8216;exposure&#8217;</em></strong>?</p>
<p>Might explain the &#8217;stall tactic&#8217; of a plan six months in the making, that suddenly is getting bogged down in negotiations? Ya, right? More cold feet no doubt, and the excuse is explained well in the <a title="Globe ticket vs. salaries" href="http://www.theglobeandmail.com/news/national/if-ticket-sales-funded-teams-salaries-would-reflect-reality/article1207486/" target="_blank">Globe</a>:</p>
<blockquote><p>Meanwhile, SOF Investments, the largest secured creditor who is owed some $80 million, says it can&#8217;t consent to the Reinsdorf bid because their payment hasn&#8217;t been worked out, although negotiations have begun.</p></blockquote>
<p> Heck, Michael Dell and Michael Reinsdorf had many lunches over several months to go over the fine tuning, no doubt. Suddenly the negotiations are just starting? How about the people are starting to smell a rat. That&#8217;s what&#8217;s more likely <em><strong>&#8217;starting&#8217;</strong></em>!</p>
<p>When Kaites says six months of negotiations, this would have been going on behind Jerry Moyes&#8217; back, while he was the owner. How did they know he would end up broke at the end of the day? We already know the answer to that. It&#8217;s called <strong><a title="The squeeze play collusion story" href="http://makeiteighteh.com/2009/07/21/was-jerry-moyes-the-victim-of-a-squeeze-play/" target="_blank">collusion</a></strong>. Sorry, we keep coming back to that word, but it explaines Moyes desire to discount Reinsdorf as a suitable owner.</p>
<p>Deception uncovered. Financial reality far different than claimed. <em><strong>Irreparable harm</strong></em>.</p>
<p>No wait, the term <strong>&#8216;irreparable harm&#8217;</strong> I believe was reserved for Jim Balsillie, as the &#8216;new&#8217; reason the NHL Board of Governors (that is, those that showed for the meeting) had to say. I wonder how that meeting went. Could it have been, &#8220;this is what I believe, is everyone in agreement?&#8221; Ya, that&#8217;s sounds about right.</p>
<p>So, Jim Balsillie has not gone along with league processes, huh? Well, there is one owner that has seen enough of league processes to call in a friend to help him alter those processes. To blow the whistle when the process doesn&#8217;t serve the owner properly. When the process doesn&#8217;t serve the bankers, the players, the fans, or the league as a whole. The question is, &#8216;who are the processes serving the most?&#8217; It certainly didn&#8217;t do Jerry Moyes any favours, especially since he was being set up for takeover. Could that be an &#8216;unofficial league process&#8217; that is being challenged?</p>
<p>Well, the New York Times has an interesting view of the current legal proceedings.  And, according to the <a title="A hockey Fight! NY Times" href="http://www.nytimes.com/2009/05/31/sports/hockey/31coyotes.html?_r=1" target="_blank">New York Times</a>:</p>
<blockquote><p>This may put the <strong>National Hockey League</strong> and its 29 other teams in an awkward position. Other teams and the companies that do business with them are surely happy to get a glimpse of at least part of the Coyotes’ finances. In an industry where <span style="color:#ff0000;">operational data is closely guarded</span>, any information that helps teams and their vendors <span style="color:#ff0000;">benchmark themselves against their competitors</span> is valued.</p></blockquote>
<p>I would suggest you look at the full article for enlightenment.</p>
<p>The economy of the U.S. is now coming out of a period of deception. They now have to work on repairing what is broken. They need to look at what is there, clear the rubble, and look for ways to live within their means.</p>
<p>I would say the National Hockey League needs to become accountable to it&#8217;s owners, it&#8217;s lenders, it&#8217;s players, and it&#8217;s fans. Everything is not &#8216;just fine&#8217;. There are other franchises that are not fine either.</p>
<p>There would be more respect if the league stood up and finally gave a <em>true account</em> of reality. The longer they delay, the more exposure will take place in courtrooms, in newspapers, and even in blogs. When the chief always says things are great, then start waiving the flag.</p>
<p>So, when the character of Jim Balsillie is challenged now by the Board of Governors for not respecting league processes and guildelines, perhaps there is good reason.</p>
<p>What&#8217;s the real reason the bidders need an extension beyond August 5th? Could it be time to see if they can cover the tracks of deception of their own? Or, is it simply to see if Glendale can offer concessions &#8216; a la&#8217; the <strong>CityNorth</strong> Supreme Court case in Phoenix?</p>
<p>Brings us to wonder that what we read and hear is far removed from reality too. The underlying truths it would seem do not get exposed too often either.  I for one, wish the press would dig a little deeper and give us the real dirt. Getting kind of mundane in the reading department. Making this reader question his newspaper subscriptions. <em>Just sayin&#8217;!</em></p>
<p>For the NHL, I believe this spells the beginning of the<em> &#8216;uncovering of the truth&#8217;</em> and there are a few folks that don&#8217;t like it.</p>
<p>As for the Moyes/Balsillie &#8217;schooling&#8217; taking place&#8230;..it suggests one thing&#8230;..the <span style="text-decoration:underline;">guidelines</span> need repair.</p>

<title><![CDATA[It's official: The San Diego Pirates ]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p>Earlier this week, I learned that the San Diego Padres were ready to move All-Star first baseman Adrian Gonzalez, a ridiculous notion no matter how you shake it with Gonzalez being the best financial bargain in baseball.</p>
<p>I wrote that they would become the West Coast version of the Pittsburgh Pirates (read: complete laughingstocks) if they traded Gonzalez, the lone reason to even care that the Padres exist in the summer of 2009.</p>
<p>But the Padres proved that they are indeed the Pittsburgh Pirates of the West Coast on Friday anyway by giving away 2007 Cy Young Award winner Jake Peavy to the Chicago White Sox shortly before the trading deadline.</p>
<p>The Padres received one major-league caliber pitcher (Clayton Richard) and three I-sure-hope-one-of-you-pans-out pitching prospects from the White Sox, who pulled off one of the swiftest and boldest trading-deadline moves of this decade.</p>
<p>But perhaps that&#8217;s why the White Sox can look back on a recent World Series title and the Padres can look back on &#8230; um, well, all the Padres have to look back on is all the top talent they&#8217;ve given away over the years as they wonder how come they have ZERO World Series titles to crow about.</p>
<p>Jake Peavy, in the prime of his career, is the big winner in this whole deal. Hey, he&#8217;s going to an organization that actually wants to win. The Padres are doing all they can to prove they have no interest in winning &#8212; hey John Moores, you broke every promise you made about how Petco Park would allow you to retain key players.</p>
<p>Let me spell out the word that describes you: L-I-A-R.</p>
<p>You will never heard such sentiment from the soft San Diego media columnists, who are more interested in sucking up to the bad pro sports owners in town than bucking up and writing the truth. Hey, the Padres and Chargers have won the same number of World Series and Super Bowl titles as the local bus driver: None.</p>
<p>Peavy is in Chicago because there&#8217;s a owner (Jerry Reinsdorf) on the South Side of Chicago more interested in winning than hosting fireworks nights or having his players wear ugly camouflage uniforms.</p>
<p><span style="color:#000000;">I love the fact that Reinsdorf was orginally against trading for Peavy on Friday when general manager Kenny Williams approached him 90 minutes before the deadline. But upon hearing out Williams and assistant GM Rick Hahn, Reinsdorf signed on and approved taking on the financial commitment. <p>That right there is the difference between an organization committed to winning and an organization now mentioned along with the Pittsburgh Pirates as the two biggest laughingstock teams in baseball.</p>
<p>Somehow, I get the feeling that Padres general manager Kevin Towers called Williams up and pleaded with him &#8212; &#8220;come on Kenny, please, come on, please do the deal&#8221; &#8211; under orders from the cheap Padres management.</p>
<p>Peavy will earn $15 million in 2010, $16 million in 2011 and $17 million in 2012 with the White Sox holding a $22 million option for 2013 (or they can buy out Peavy for $4 million). And now that he&#8217;s teaming up with All-Star lefty Mark Buehrle (he of two no-hitters, including a recent perfect game), I can predict a World Series ring in Peavy&#8217;s future.</p>
<p>I sure couldn&#8217;t predict that for Peavy if he had stayed in San Diego. Oh, no, not at all. You see, the Padres are run like the Pirates &#8212; you know, a minor-league franchise.</p>
<p>So say hello to your new franchise &#8212; the San Diego Pirates.</p>
