This piece is an illustration for the cover of The Pearl, a novel by John Steinbeck.

The story revolves around a poor Mexican family. The husband earns his meager income by diving for pearls. When his son is stung by a scorpion he searches for a pearl to pay for a doctor to heal his child. He finds a perfect pearl in the ocean that brings optimism and joy to the family but it also places a burden on the family they have a great difficulty dealing with.

Among Late-Night Writers, Few Women in the Room

Based off this article, I’ve formulate my personal top 6 issues I have with Late-Night

1. Letterman’s audience is 55 percent women; Mr. Leno’s is more than 53 percent, and Mr. O’Brien’s just over one half. Yet barely any female writers
2. If a “dude” is the host, you have to write like a dude. Think about it, all late night hosts, minus the newly added Chelsea Handler, are guys. So where are the opportunities for women?
3. Letterman’s scandal pretty much cast a shadow on women working for late-night TV.
4. “Boy Humor” is keeping women away from late-night jobs, according to the article. Yet the audience, which over half are women, seem to be eating it up. So why not give them a chance?
5. Mr. Kimmel and Mr. Leno both have female executive producers. So big deal, there’s one female in charge. What about all the other positions.
6. And it’s now official: Women dominate men at every level of higher education, in terms of degrees conferred. Yet the entry level jobs for women writers on television is mostly held by men. Interesting.

This week, the stars of the vampire movie New Moon were taking over late night TV.

I personally don’t read the books, but I have enjoyed the vampire shows and movies Vampire Diaries, Tru Blood, and Twilight. Twilight was not expected to be as big as a craze as it has become, so the first movie did not have that much funding. Now, with more money backing the cult-like following series, New Moon is getting tons of press.

Una de las cuestiones que mas en boga está por estos días es la de los efectos civiles de la acusación calumniosa. En particular, un reconocido activista por los Derechos Humanos llevó el caso ante la Corte Interamericana de Costa Rica pidiendo que Argentina derogue las normas de derecho civil que imponen a los periodistas del deber de reparar daños en los casos de interés público. Lo que se pretende, a no dudarlo, es lograr la impunidad de la prensa. No caben dudas que existe, para todos los habitantes del suelo argentino, la obligación de reparar los daños causados por una denuncia que contiene una calumnia. No creemos que la creación de un fuero personal especial periodístico sea democrático ni acorde a los tiempos que corren, ni auspiciamos periodistas que susurren acusaciones insidiosas en el oído de la multitud. Sin embargo, no nos parece mal que se consagren legislativamente las reglas de la doctrina de la real malicia, compilándose al efecto la jurisprudencia de la Corte Suprema de Justicia de la Nación.

La configuración de la “acusación calumniosa” a que refiere el art. 1090 del Código Civil requiere que se cumplan varios extremos, a saber:
(a) imputación de un delito de acción pública;
(b) acusación ante autoridad competente, mediante querella criminal o denuncia que origine un proceso penal;
(c) falsedad del acto denunciado;
(d) conocimiento de tal falsedad por parte del denunciante. Hay quienes creen que también procede el factor de atribución “culpa” fundado en los principios generales en orden a los cuales todo aquel que por su culpa o negligencia ocasiona un daño a otro está obligado a la reparación del perjuicio. Nosotros pensamos sólo en supuestos excepcionalísimos puede aplicarse el factor de atribución culposo, puesto que debe juzgarse el caso con sumo cuidado, toda vez que resulta imprescindible preservar el interés social en la investigación y represión de los delitos penales. Es importante que la gente se comprometa en la denuncia de ilícitos penales y que no tenga miedo de ulteriores juicios civiles de daños y perjuicios, cuando lo único que hace es colaborar con el sistema judicial. Además, el juez del caso tiene que saber que rara vez podemos ver las cosas desde el punto de vista de otra persona, porque miramos los hechos a través de la pantalla de una impresión o de un interés que tiñe nuestra opinión.
(e) la existencia de un daño en la persona o bienes del denunciado.

Entendemos sensato que no se derogue el artículo de marras, porque en nada afecta a la libertad de expresión de los periodistas. Si el periodista es groseramente imprudente, debe responder civilmente, igual que el resto de los ciudadanos. La garantía de libertad de expresión no puede ser vilipendiada para amparar a la mala prensa. Louis D. Brandeis fue una gran juez de la Corte Suprema de Estados Unidos, famoso por sus encendidas defensas a los derechos de libertad de expresión y libertad de intimidad. Este gran jurista (a propósito, ¡Como nos faltan esos grandes pensadores en altos cargos, en Argentina!), en un caso resuelto en 1927 (Whitney v. California) en el que se perseguía judicialmente a una mujer por ayudar al Partido Comunista, dijo que: “El miedo sobre las injurias no puede justificar la supresión de la libertad de expresión. Los hombres temieron a las brujas y quemaron mujeres. La función de la garantía de la libertad de expresión es liberar a los hombres de la esclavitud de miedos irracionales. Los hombres que consiguieron la independencia de Estados Unidos por vía de revolución no eran cobardes. No temieron al cambio político. No exaltaron el orden por sobre la libertad”.

Elucidándolo, los periodistas no deben temer por un eventual juicio de daños y perjuicios cuando su accionar sea producto del ejercicio regular de la libertad de expresión. El derecho a la libertad de expresión no es absoluto y se debe armonizar con los derechos a la igualdad, a la intimidad y al honor de los afectados por sus expresiones dilacerantes.

Por último, no es bueno para el interés público de la Nación Argentina, la existencia de periodistas culposos que tienen orejas rápidas para descubrir una acusación civil (?).
